Zakheim was collecting a debt for XXXX XXXX but it was settled years ago. They pulled my credit report without permission, and long after settlement. They told me on the phone that I have no other account with them. IT IS ILLEGAL FOR ZAKHEIM TO HAVE PULLED MY CREDIT REPORT WITHOUT PERMISSION ON XXXX/XXXX/XXXX. 6. Defendant Zakheim & Lavrar, P.A. ( " Defendant '' ) is an entity duly licensed toconduct business in the state of Florida. 7. Upon information and good-faith belief, Defendant 's principal place of businessis located at XXXX, FL XXXX. 8. Defendant uses a means or facility of interstate commerce for the purpose offurnishing information to consumer reporting agencies. 9. Defendant is a " person '' as defined by 15 U.S.C. 1681a ( b ). THE FAIR CREDIT REPORTING ACT10. The FCRA was enacted by Congress to ensure fair and accurate credit reporting, promote efficiency in the banking system, and to protect consumer privacy. See XXXX of XXXX, XXXX XXXX XXXX, XXXX ( XXXX ). 11. To further purpose of protecting consumer privacy, the FCRA requires thatconsumer reporting agencies ( " CRA '' ) may only furnish a report regarding a consumer to aperson who has a " permissible purpose '' to use that consumer 's report. See 15 U.S.C. 1681b ( a ) - ( b ). 12. A permissible purpose exists where a person " intends to use the information inconnection with a credit transaction involving the consumer on whom the information is to befurnished and involving the extension of credit to ... the consumer. '' 15 U.S.C. 1681b ( a ) ( 3 ) ( A ). 13. Obtaining a consumer report is colloquially known as " pulling '' a consumer'scredit report. 14. In contrast to a " soft '' pull of an individual 's consumer report, which does notaffect the consumer 's credit score, " a 'hard pull ' involves accessing a credit report for thepurpose of issuing new credit or increasing the amount of existing credit. These inquiries can beXXXXseen by potential creditors and can impact a consumer 's credit score. '' XXXX, XXXX XXXX, XXXX XXXX XXXX XXXX ( XXXX XXXX. XXXX ) reconsideration denied, XXXX, XXXX XXXX XXXX ( XXXX XXXX. XXXX ). 15. Thus, limiting access to consumer reports and prohibiting persons from obtainingconsumer reports without a permissible purpose not only promotes consumer privacy, but it alsopromotes congressional intent of promoting a fair credit reporting system, as it gives consumersa greater ability to manage their credit scores. FACTUAL ALLEGATIONS16. In an effort to collect an alleged debt, Defendant filed a state court action againstPlaintiff on XXXX XXXX, XXXX. 17. On XXXX XXXX, XXXX, Plaintiff called Defendant and agreed to settle the debt over aperiod of six months. 18. The account was settled in full on XXXX XXXX, XXXX. 19. On XXXX XXXX, XXXX, Defendant filed a notice of voluntary dismissal withprejudice in the state court action. 20. On XXXX XXXX, XXXX, Defendant requested and obtained a copy of Plaintiff'sExperian consumer report. 21. Plaintiff did not provide Defendant with permission to access his consumer report. 22. Upon information and belief, Defendant knowingly and intentionally obtainedPlaintiff 's consumer report. 23. Upon information and belief, Defendant knowingly and willfully obtained aconsumer report for Plaintiff without a permissible basis. XXXXCOUNT I15 U.S.C. 1681b ( f ) ( 1 ) 24. On XXXX XXXX, XXXX I have received a letter in the mail, informing me of the fact that XXXX has retained an attorney firm Zakheim and Lavrar of XXXX, FL in order to collect a debt in the amount of {$8700.00}. Later on XXXX, XXXX I have been served with a summons which states that a law suit was filed against me. The summons also states the I had 20 days to respond to this notice or to dispute the debt. I filed response to complaint denouncing the claim. No other communication has been received from the creditors attorney. They had disappeared until on XXXX XXXX, XXXX, without any warning or additional correspondence I have received a letter informing me that a Judgement in the amount of {$9200.00} has been entered against me. Said letter also threatened to to begin the process of enforcement of said judgement in form of wage and bank accounts garnishments. No hearing notices were ever serviced to me. An offer to settle was then mailed to me on on XXXX XXXX, XXXX, but because I was thinking of hiring an attorney I left it unanswered and then due to a number of significant changes in my household arrangements related to my children moving in with me, and increased expenses due to that, and having to retain an attorney to represent me in a child support modification case, this slipped my mind. In XXXX, XXXX XXXX the collector have filed a writ of garnishment against my wages Immediately upon receiving the correspondence containing the copy of the writ I responded with the Head of Household exemption claim dated XXXX XXXX, XXXX. On XXXX XXXX, XXXX The representative of XXXX ( Collector ) files an affidavit where they contest my claim of exemption. On XXXX XXXX, XXXX Court issues a notice of dissolution of writ of garnishment. however on XXXX XXXX, XXXX a an order setting setting hearing is issued with regards to my claim of exemption. Not only do the collector misrepresented the fact that they have not communicated as required by law, now this case became even more confusing. I had no choice but to hire an attorney. My attorney has attempted to cancel the hearing set for XXXX XXXX, XXXX however it ended up just being rescheduled for XXXX XXXX, XXXX Given that we have been issued a letter of writ dissolution, I was advised by my attorney to ignore further hearing as they are most likely set due to a clerical error, so I will follow the professional advise, however I am totally confused and worried about the situation and really need help resolving this matter. On XXXX XXXX a garnishment in the amount of {$2500.00} was placed on my checking account by Zakheim & Lavrar XXXX XXXX, Florida for a debt owed to XXXX Bank. Zakheim & Lavrar claims to have sent XXXX documents to my residence warning me of an impending garnishment. We received neither of these letters. If we did we would have immediately paid off the debt. We were n't made aware of the garnishment until after we tried using our debit card and it was declined. After contacting the bank and learning where the garnishment was from we immediately drew a tellers check for the amount owed and mailed it. Zakheim and Lavrar received the check on XXXX XXXX. We asked when the hold would be released and they said between 7-10 business days. After 10 days we checked and the hold was still on our account. We contacted them and they informed us that they mailed out a Dissolved Writ of Garnishment to the court and our bank on the XXXX. We waited 5 days and the hold was still on. We contacted them again and they stated that they had mailed the Writ on the XXXX, and again that day, the XXXX. After contacting both our bank and the court today we learned that neither have received any documents regarding our case. The court informed us that the document needs to be sent via XXXX, the way the original documents to place the hold were sent, and to date, they have received nothing from Zakheim and Lavrar. We feel that we are being directly lied to by Zakheim and Lavrar and they are doing nothing to resolve our issue. From the beginning they have been giving us erroneous information.

I was sued by Zakheim Law Group allegedly representing XXXX XXXX on a credit card debt XX/XX/XXXX- case # XXXX XXXX XXXX XXXX XXXX . I answered ( pro-se ) alleging they had no standing as they did not appear to have been actually authorized by XXXX to represent them. Subsequently they filed an affidavit ( 149 pages ) containing my complete account records for over 2 years including the unredacted account # s and ID of various medical and other accounts. After losing my case and my counterclaim I was told by the Court that I could file to have this data redacted. This was not the case as I do not qualify for that and I am not permitted to have this filing made private as that is something only the plaintiff is allowed to do. I had notified Zakheim on XX/XX/XXXX in my answer that I am a widow on a fixed income from SS and a small pension and exempt from any possible garnishment or attachment as I have no assailable assets. Zakheim proceeded to obtain some sort of authorization in XX/XX/XXXX to actually represent XXXX and proceeded to obtain and record a judgment against me, as well as proceeding to file judgments in several other cases that were in the same Court that were still open and had no activity for 3-6 Months prior. It is my contention that Zakheim had used the Court as a collection agent in many cases without actually at the time of filing being authorized to do so. In addition the publication of my account records including the names and account # s of various medical payees is a violation of my privacy rights under HIPAA.

What happened? I HAD A CREDIT CARD ACCOUNT WITH XXXX XXXX ACCT # XXXX ) THAT WAS CHARGED OFF IN XXXX OF XXXX. IT WAS PURCHASED BY XXXX XXXX XXXX ( FILE # XXXX ), AND WE REACHED A SETTLEMENT AGREEMENT OF XXXX. XXXX TOOK THE FUNDS FROM MY CHECKING ACCOUNT, ( 6 DRAWS OF XXXX AND 4 DRAWS OF XXXX ), BUT DID NOT SEND A SETTLEMENT STATEMENT. THREE YEARS LATER I RECEIVED A LETTER FROM ZAKHEIM XXXX XXXX, ( FILE # XXXX ) WANTING A SETTLEMENT FOR THE SAME ACCOUNT. I REQUESTED THE SETTLEMENT AGREEMENT PAPERS FROM XXXX BUT WAS TOLD XXXX NO LONGER HAS XXXX AS A CLIENT AND THEY DO N'T HAVE THE DOCUMENTS. I CONTACTED XXXX AND WAS TOLD THAT XXXX RECEIVED THE ACCOUNT ON XXXX XXXX, XXXX. THEY WANT TO SUE FOR THE SAME AMOUNT AS XXXX. ( XXXX ) THEY REFUSE TO ACKNOWLEDGE ANY PAYMENTS AND XXXX WO N'T SAY WHERE MY PAYMENTS TO THEM WERE APPLIED AS I WAS PAYING THEM 6 MONTHS AFTER THE CHARGE OFF. I WAS THEN TOLD OF THE LAW SUIT FILED AGAINST XXXX FOR THE SAME THING AND DURING THE SAME TIME FRAME. THE ACCOUNT WAS SOLD TWICE. FIRST TO XXXX AND THEN TO XXXX ( AKA ZAKHEIM AND XXXX ). WHAT HAPPENED TO MY SETTLEMENT WITH XXXX AND ASSOCIATES AND ACCORDING TO THE LAWSUIT, XXXX CAN NOT SELL THE SAME DEBT TWICE. EVEN THE COURT DOCUMENTS LIST MY XXXX PAYMENT.

I called XXXX card customer service about an old credit card debt from about 10 years ago. They referred me to Zakheim Law Group and provided the phone number. I contacted Zakheim Law Group and requested written information on the debt, including payoff. They requested that I fax a signed statement that I was not being represented by an attorney before they would speak to me. I complied. I called again and requested the written information about my debt. They said they would have it to me by the end of the week. They did not. I called again Monday, they said they would have it to me by Wednesday. They did not. I called again and was told they would have it to me by Friday. They did not. I called again the following Monday and could never get a person on the line. I called again Tuesday and could not get a person on the line. I called XXXX card. The XXXX XXXX representative attempted to contact Zakheim Law Group as well, and was unable to reach anyone after a very long hold. So, ultimately, after more than 2 weeks and a multitude of phone calls and requests, I still have no written statement of my debt. In the meantime, there is a lien on my home, and interest continues to build daily ( as I was informed ).

Back in XX/XX/XXXX my wages was garnished for a credit card debt that I had no knowledge of. I did not know about the debt until my wages was garnished. At the time of garnishment my employer gave me the contact information for the debt collector. I disputed the debt XXXX XXXX, XXXX. The garnishment was dismissed. Now, on XXXX XXXX, XXXX a motion to continue writ was filed by another firm. I did not receive a letter from them, XXXX XXXX XXXX, XXXX. until XXXX XXXX. I again filed a motion to stop the garnishment and also filed an exemption due to me being the head of my household. The debt does not belong to me and in addition to that they failed to respond to my dispute as required by the FDCPA. The debt also seem to be time barred because the case is from XX/XX/XXXX and I can only imagine the date that the account was opened or the last time they receive a payment from the person who the account belong to. The is company is violation FDCPA for trying to collect on time barred debt and for not responding to my dispute within the required time frame.

On XX/XX/2018 the company by the name of XXXX XXXX XXXX XXXX XXXX XXXX Located in XXXX XXXX XXXX XXXX XXXX XXXX FL XXXX Took out {$900.00} dollars from my XXXX XXXX XXXX account. When contacting them they said it was for a Credit Card from XXXX from more then 10 years ago.This " Debt '' that they were referring to does not even exist in my credit report. In the State of Florida there is a Statue that states within 4 - 6 years a debt can no longer be collected. Also I have been making payments to this same law group about 4 years ago. So on this day they took all the money from my account and had the bank freeze my account for no legitimate reason.

Total amount owed is of {$4400.00} from XX/XX/2021. My identity was stolen back then and I did notify the bank about it and nothing was done. My debt was sold to a company. which I do not have a contract with and I am not familiar with the amount they are charging. I contacted zakheim law group concerning a Judgement that was placed on my credit profile. Upon doing so, I requested the letter informing of a lawsuit, Service letter, Date of first delinquency, the debt collector l number and bond number. They have very limited information and XXXX who was the person assisting me was very limited on information and was not willing to disclosed certain information.

XXXX refuses to send me statements for what is owed, they purchased the dept from sears financial. The dept was incurred when we purchased an over priced air conditioning system for the house seven years ago. When I have called and asked for statements I am told I have to sign up for and automatic payment plan. They do not call and do not communicate by mail.
