Dear CFPB, In XX/XX/XXXX, I submitted all required documents to then-servicer XXXX on a mortgage and loan on my late mother 's home. The purpose being to confirm my position as the Personal Representative of her estate, which gives me legal authority to access information and documentation in her stead. I inherited this predatory home loan after she passed over in XX/XX/XXXX. In their letter dated XX/XX/XXXX XXXX confirmed and acknowledged my position and updated their records to reflect their decision. This court appointed position is legally binding into perpetuity. My complaint : Despite the above fact ever since servicers changed from XXXX in XX/XX/XXXX - every servicer and agency connected with this mortgage and loan have ALL required I repeat the same procedure of submitting the same documents time and again to reconfirm my position as Personal Representative. They've recently added the requirements of including copies of my mother 's Will, the Property Deed and even my photo ID. I appeal to CFPB to review the exact documents submitted to XXXX and that CFPB demand that these agencies once and for ALL acknowledge me as the court appointed Personal Representative of my mom 's estate, and order them to cease and desist these stall tactics I've tolerated for the past seven years. An attorney strongly believes the catalyst for this blatant stall and redundancy stems from a curious incident which occurred in XX/XX/XXXX. In XX/XX/XXXX servicers changed from XXXX to XXXX. Since the complete files on a loan are relayed from the previous servicer to their successor, and XXXX said in their letter they confirmed I am Legal Representative and updated the loan records with that fact in XX/XX/XXXX ; it must be contained in those files. In XXXX I requested a copy of the Note on the loan from XXXX. Since they complied, this proves the above ; HOWEVER ; they also sent a copy of the note from a previous mortgage and loan by mother got almost exactly one year prior to this current one. Both loans were brokered by the same XXXX XXXX based law firm and contain some very questionable discrepancies. One month after receiving these documents, XXXX sent a letter saying I must submit a list of documents to them before receiving any information on the loan ( i.e., to repeat the verification procedure completed by XXXX two years earlier ). This letter came one month after XXXX had already sent me the copies of the Balloon Note on the current loan and the unrelated Adjustable Rate Note from the prior mortgage so they must have known I was already confirmed as Personal Representative. So WHY is this reconfirmation process necessary??? The law firm responsible for brokering both of these predatory loans : XXXX XXXX XXXX, XXXX. XXXX XXXX XXXX # XXXX XXXX, RI XXXX ( XXXX ) XXXX The Adjustable Rate Mortgage was signed on XX/XX/XXXX, and the Balloon Mortgage ( current one ) was signed on XX/XX/XXXX. Both mortgages were notarized by the same person ; a partner in the law firm. A Real Estate attorney, who's also a Notary and two separate Notaries from different banks all examined both notary pages and attested to serious flaws in both pages : The XX/XX/XXXX Mortgage has NO Notary stamp. On the XX/XX/XXXX Mortgage, the Notary didn't fill in the form of identification the signee showed him. Finally, the Notary double-stamped the document, resulting in a smudged image. Copies of both Mortgages and their respective Notes are in the attachments. Several attorneys and all banking personnel all concurred my mother was the unknowing victim of a loan flipping scam, as she was XXXX years old when she got this current mortgage and the terms of both loans are ridiculous.One attorney went so far as to ask me if my mother showed signs of XXXX or XXXX, as : Nobody in their right mind would agree to the outrageous terms of these loans. All felt the inclusion of the unrelated Adjustable Rate Note with its revealing Notary errors may have been the catalyst for XXXXXXXX XXXX conditional stipulation and all which followed. Every agency affiliated to this predatory mortgage since this incident have followed suit in requiring me to reaffirm my identity and appointment as Personal Representative of the estate. The three attachments below are labeled accordingly and contain the following : 1. LEGAL DOCUMENTATION All my legal documents sent to various agencies through the years. 2. CFPB COMPLAINT # 1 Documentation spanning servicers XXXX ( XXXX XXXX-XXXX. XXXX ) through XXXX ( XXXX XXXX ' XXXX ). 3. CFPB COMPLAINT # 2 Documentation spanning servicers XXXX ( XXXX XXXX-XXXX. Rather, it seems their sole objective is to impede, hamper and delay my progress until a date is set for the illegal auction of my childhood home. Again, I appeal to CFPB to agree I've met and exceeded all criteria by examining the documentation in the attachments and demand these agencies recognize my legal position as Personal Representative of my mother 's estate. Before I get started there was a case already opened, concerning this issue back in XXXX Id XXXX. At that time our investor WMC Mortgage Corporation, through the servicers XXXX XXXX held the second mortgage loan, on our home located here in California XXXX XXXX XXXX XXXX Ca, XXXX. Their excuse back the was that we failed to provide, information requested by XXXX. This process went back and forth over the course of several years. They XXXX XXXX always claiming they never received requested documentation, which I sent on several occasions. During the course of our last communication in XXXX of XXXX, with XXXX during the height of our once again attempting to negotiate, a modification, our second mortgage was then sold to XXXX XXXX XXXX XXXX. Now lets step back, in XXXX, I lost my working as a XXXX XXXX, for XXXX XXXX XXXX My salary at the time was {$81000.00} per year. I was gainfully unemployed for, a period of 5 years. During that time period I was able to acquire part time and temporary employment. I did not return to full time employment until XX/XX/XXXX. During this time frame is when we fell behind on the second mortgage, from XX/XX/XXXX thru XX/XX/XXXX we were able to maintain our second mortgage payment. During this same period of time, the value of our home fell, to the point where we ended up being over {$200000.00} upside down with our mortgage. All along from XXXX thru the present day XXXX, we continued to maintain the payment on our first mortgage. In late XXXX we contacted XXXX XXXX XXXX XXXX, requesting their assistance. The main goal in contacting XXXX was to obtain a Principal Reduction in our property value, to bring our property back to the actual market value. This was accomplished on XX/XX/XXXX. This brought our home from the original amount we paid for this residence {$430000.00} to the actual market value at the time which was in the {$200000.00} range. At the time we had no available equity in our home. After the Principal Reduction was place through XXXX, in XXXX the equity on this property began to climb. Now once the loan was transferred from XXXX XXXX To XXXX XXXX in XXXX of XXXX, XXXX XXXX immediately began the foreclosure process, since by this time period the property had acquired over {$100000.00} of equity. Mind you we had no idea that the loan had been transferred, as we were in the process of working out a modification with XXXX. Since acquiring the second mortgage we have been the victims of the predatory lending practices of our investor WMC Mortgage Corporation. Who have never attempted in good faith to try and offer a modification on this second mortgage. We have been forced to file chapter XXXX bankruptcy, in order to maintain residency here at our home located @ XXXX XXXX XXXX XXXX Ca, XXXX. The only recourse XXXX has offered is 1. ) pay the rearrange of {$59000.00} or pay the entire secure amount of {$130000.00} Which include the original loan amount of {$82000.00} plus the rearrange. Now XXXX is charging a late fee for every months mortgage, not paid plus interest on the late charge, along with interest on the unpaid balance of the entire balance due on the second mortgage. As I stated these are unlawful predatory lending practices, in which WMC Mortgage Corporation should not be allowed to continue to get away with. Mind you WMC Mortgage Corporation themselves filed For bankruptcy protection in XXXX. We have been residing in our home now for 13 years and are taking all steps in order to continue to maintain residency in our home. We are represented by XXXX XXXX XXXX, who are working with XXXX on behalf of WMC Mortgage Corp to obtain a reasonable modification. So far WMC has not budged on its demand to foreclose on our home. We are reaching out to you for your assistance in this matter

My name is XXXX XXXX, I along with my husband owned a home at XXXX XXXX XXXX in XXXX NJ XXXX. In XXXX of XXXX, we decided to refinance our home because the interest was high. We saw an ad on TV for XXXX. I called XXXX and Spoke to XXXX XXXX. he took our application over the phone, checked credit and asked for several documents to qualify us for the refinance. The refinance took about 3 months to be approved. We were offered a lower interest rate, a payment and we wanted cash out to pay off some high interest credit card bills and the balance was for my husband to purchase equipment for his new construction business.. We finally closed the loan on XXXX/XXXX/XXXX. The closing took about XXXX minutes. The closer just gave us document after document not allowing us to take time to read through anything. I asked her questions and she told me to call the Broker. Shortly after the closing she took all the documents with her, and left us with the HUD 1. She told us that we would get a complete package in the mail. I looked over the HUD - 1. To my surprise it was not what I expected, not the program we were offered. So I called XXXX the next day XXXX/XXXX/XXXX and asked why the closing fees were {$30000.00} and why the interest rate was different than what we were offered. He did n't have an answer for me. XXXX and I decided we did not want to move forward with the loan and asked XXXX if we can rescind. XXXX told us to write a letter, fax it to him and mail it to WMC mortgage. I faxed XXXX on XXXX/XXXX/XXXX and mailed the letter to WMC mortgage on XXXX/XXXX/XXXX. XXXX confirmed receiving the letter and also confirmed he will notify WMC mortgage. To my surprise XXXX calls me XXXX weeks later and tells me that the loan was not rescinded, apparently WMC had already funded the loan. Stymied by this news and concerned now that we had to pay this high mortgage of {$4600.00} per month, we had no options, so we started making our payments. WMC closing costs were over {$30000.00}, which was ridiculous. We did n't realize until a few years ago that this loan was a predatory loan. WMC was shutdown XXXX was shut down and soon my loan entered the hands of a XXXX Investor, who eventually committed mortgage fraud lied to the courts and evicted me and my family from my home in XXXX of XXXX. WMC is the first to blame for their deceptive sales practices. IF they had rescinded the loan as they should have I would still be in my home. The Broker disclosure form that we signed at the closer clearly states the broker will not be paid more than 2 %, yet I was charged 3 % {$17000.00} this absurd per the HUD. This is loan fraud. This was deceptive sales practices. This was abusive lending to the consumer. WMC defrauded my family and they should be held full liable for it. I have attached some of the closing documents to this complaint. I would like to be compensated for all my closing costs and in addition for the 4 years of pain and suffering. This was a predatory loan. It was a bait and switch scam as some may call it.

XXXX allegedly executed an assignment of mortgage on XXXX/XXXX/XXXX and alleges that XXXX was the assignor and XXXX was the assignee. This document was not recorded in the XXXX XXXX records until XXXX/XXXX/XXXX and the document was NOT recorded by XXXX The document was recorded by XXXX XXXX XXXX and prepared by a known robo-signer and false document mill by the name of XXXX XXXX. The document states that it should be returned to XXXX XXXX XXXX after being recorded. There are XXXX loan numbers on the assignment. XXXX belongs to XXXX XXXX ( XXXX ) and the other belongs to XXXX ( XXXX ). There is also a min number ( XXXX ) on the document and the first XXXX digits of the min number are the company number for XXXX XXXX XXXX. At the time this document was prepared and signed, XXXX, had in fact been defunct for 2 years. XXXX merged and became XXXX for name purposes only in XXXX. When the assignment was executed, the loan was with XXXX XXXX and there was never an assignment of mortgage made from XXXX to XXXX XXXX. When this document was recorded, XXXX fully purchased the loan from XXXX XXXX. This assignment of mortgage is a fraudulent document. XXXX , Inc nor XXXX has ever had a license in the state of Fl. to service, lend or perform any functions regarding to mortgages. XXXX or XXXX, did not have the authority to assign my mortgage to XXXX. This document was signed 2 years after the co. was defunct and this company was never a member of XXXX.The company that prepared the assignment is XXXX XXXX and this is a known robo signer and fraudulent document mill. There are XXXX different companies involved on the assignment of mortgage.I have a statement from an employee at the company WMC Mortgage which is now the company for XXXX in regard to a QWR I sent stating " XXXX nor WMC would have the duty to respond as neither was your loan servicer ''. How did XXXX have the authority to assign my mortgage to XXXX when XXXX was not the servicer or the owner? It is my understanding that an assignment of mortgage has to be made by the owner or original lender, otherwise my next door neighbor could walk into the court house and assign the mortgage to himself.Why would a company that did not own my mortgage execute an assignment to XXXX in XXXX, which they were not a member of and then wait until XXXX to record the document in the county records? The mortgage was not even placed into the XXXX system until XXXX/XXXX/XXXX and this was done by XXXX XXXX XXXX. XXXX has refused to provide me with an acceptable response in this matter and I find it odd that no one seems to be able to answer a simple question ... Who is the lender?

I was received a letter from XXXX XXXX XXXX for XXXX XXXX of Maryland stating plaintiff : XXXX XXXX XXXX , XXXX has put in a motion for Default Judgment in the amount of {$130000.00} for a loan that I borrowed from XXXX XXXX XXXX on XX/XX/XXXX. for a single unit property located at XXXX XXXX XXXX XXXX , XXXX , Maryland XXXX. I believe I owe XXXX XXXX XXXX none of this amount ( {$0.00} ) as I was a victim of subprime lending and part of the National Mortgage Settlement filed with the United States District Court for the District of Columbia in which Maryland was one of the states who alleged XXXX XXXX XXXX, XXXX : XXXX XXXX XXXX XXXX. All of whom collectively state these banks violated the Unfair and Deceptive Acts and Practices laws of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989. I also received a check from the XXXX XXXX XXXX on XX/XX/XXXX in the amount of : {$1400.00} as my portion of the amount of the lawsuit settlement.
