On XX/XX/XXXX I purchased a new auto insurance policy through XXXX XXXX XXXX, and I gave the Insurance consultant goes by the name XXXX XXXX my XXXX XXXX XXXX Checking Account information to set up an automatic payment plan. XXXX XXXX XXXX took {$190.00} from my account that day. I believe Mr. XXXX has something to do with my case because three days later on XX/XX/XXXX, {$1200.00} ( that was all the money I had in my bank account ) was withdrawn from my account by the Winn Law Group located in XXXX, California. I immediately investigated this suspicious transaction with my bank and they told me that a Levy was placed on my account by the Winn Law Firm who represents XXXX XXXX. I knew right away that this had to be fraudulent, because I never had a XXXX Credit Card. Upon reviewing the levy in person with a banker at a XXXX branch located in the city of XXXX, I learned that my name, social security number, and a random home address appeared to be in the City of XXXX XXXX ( I never lived at that address, and I don't know anyone who lived there ) were used to apply for the XXXX Credit Card and got approved for nearly {$14000.00} sometimes in XX/XX/XXXX, and this person whoever applied for the credit card spent {$13000.00} on an account ending in XXXX. When I initially called XXXX XXXX to ask them about this, no one could find a credit card account ending in XXXX. Then they asked for my social security number, and I gave it to them because I thought they already knew my SS # as showed on the levy. After I was placed on hold for awhile, the representative of XXXX XXXX came back and told me that she found the account ending in XXXX, and if I wanted to dispute the levy I had to contact the Winn Law Firm directly because they were hired to collect the money and they would have all the information pertaining to the case that XXXX XXXX did not have. I asked her if XXXX XXXX had any record of payments made to the account and she said yes and she also told me she would send me a hard copy via regular mail. I made several attempts to contact the Winn Law Firm for about two weeks after I first learned about the levy via telephone but did not get a reply. I filed a police report and tried to work with XXXX to dispute the unauthorized transaction and have not made any progress. People from the Winn Law Firm wouldn't talk to me if the conversation was put on speaker phone or recorded. On the last week of XX/XX/XXXX, a female representative from the firm finally spoke to me about the case. She told me that the case had been placed in dispute status and I should receive " some paperwork '' from them within 2 or 3 days in the mail. Almost 2 weeks later and still no paperwork arrived in the mail, I decided to show up at their office to investigate and get the paperwork in person. At the Winn Law Firm I learned that my case was assigned to an attorney associate named XXXX. I asked XXXX if his law firm obtained my XXXX XXXX XXXX account information from XXXX XXXX XXXX to which he did not deny and only said this, and I quote " we have a research team and that's how we got it. '' I also asked him who would I talk to regarding the dispute, Winn Law Firm or XXXX XXXX, and he specifically told me not to contact XXXX XXXX about the case and to only speak to his law firm regarding the dispute because they were the one who would conduct the investigation and determine its outcome. I also told him that the only people I know personally who had access to my personal identity information at that time were my mother and ex-domestic partner, XXXX XXXX. After he gave me some paperwork to take home to complete and send back for investigation, I asked him when can I expect the investigation to end and be notified the result of the finding. He told me the investigation would take about 2 weeks to complete. Within a week later, I certified mailed all documents required by the law firm, including the police report, an Affidavit, and a personal handwritten answers to all the questions they asked. Two weeks after the Winn Law Firm received the documents from me and they did not contact me regarding the result as they promised. During this two weeks of waiting period, a female staff from XXXX XXXX investigation department called me and demanded that I must submit a utility bill that could prove I did not live at the address indicated on the XXXX XXXX application. She told me that this would be the deciding factor of her investigation. I told her that her demand of a utility bill from a place I lived more than 10 years ago was unreasonable because any normal person would have not kept a copy of their utility bill that long. I asked if she would accept another form of document that would prove I did not live at that address like a credit report or a DMV record, and she insisted that the only form of document she would accept as proof was the utility bill and that the utility department would have it available for me upon request. I called the XXXX XXXX utility department and they told me they did not have any record older than two years. From this point forward until I received a a second letter of the result from the Winn Law firm today, both XXXX XXXX and the Winn Law Firm changed their story completely around.but accused me of being " confused '' and misunderstood them. On my second trip to the law firm after more than two weeks from the day they received my documents but showed no ending in sight, XXXX wouldn't come out and talk to me in person. Instead, he sent another guy out to talk to me, whom when asked if he was a lawyer answered " no '' and " yes '' at the same time very quietly. He also informed me that the firm did not know when the investigation was going to end, and they did not do anything shady. Meanwhile I received several calls from a male staff who said he was from the same XXXX XXXX investigation team told me that they never said the utility bill was a requirement, let alone the deciding factor of their investigation. He accused me of being confused because they were the one who solely responsible for the investigation and its outcome, and the Winn Law Firm was only available to collect the money and not to do the investigation. Also, the utility document was never a requirement, only optional, let alone the deciding factor of their investigation. They also said that me showing up unannounced at the law firm office was unconventional and should not be repeated. Today XX/XX/XXXX, I received a second letter from the Winn Law Firm with the result of their investigation. According to the letter addressed to " Sir or Madam '', which by the way has a completely different letterhead compared to the letter documents I received from XXXX XXXX about the payments made to the account ending in XXXX weeks ago, XXXX XXXX concluded that the balance of the account ending in XXXX to be valid, and the only evidence provided to support their claim is a copy of two checks made as payments to the account, one from my sister and the other from XXXX XXXX. A quick look at the writing on the checks I can tell you with 100 % certainty that the writing on the check does not belong to XXXX XXXX, whom I had a 14 years relationship with. When I showed my sister the copy of the check, she said someone tried to make it looks like her handwriting but it is obviously not her handwriting. She confirmed that she did not write that check. I noticed there are two different versions in form of the court order or levy. The original one I got from XXXX XXXX XXXX on XX/XX/XXXX looks very different from the one I received in the mail package today XX/XX/XXXX. Also the dates and names of the creditor XXXX appears on the documents they provided are all over the place even though they are presumably about one account. For example, the date appears on the XXXX XXXX XXXX check is dated " XX/XX/XXXX '' and " XXXX '' is written on the space designated for Pay to the Order of, and the date appears on the XXXX XXXX XXXX check is dated " XX/XX/XXXX '' and " XXXX Platinum Card '' is written on the space designated for Pay to the Order of, meanwhile the actual name of the credit card in question appears on the statements is XXXX XXXX XXXX and the dates are from XX/XX/XXXX to XX/XX/XXXX. The exact date the account was opened was not provided or indicated anywhere. If you would like to receive a copy of the two different versions of the levy and the billing statements, please contact me directly via phone call or email at anytime. I would be more than happy to send them to you for review. I have suffered a huge financial loss as a result of this fraudulent incident, including lass of work and very bad credit scores that have prevented me from getting loans for my business. ON XXXX XXXX ( THURS ) I GOT A CALL FROM XXXX XXXX ( LEVY DEPARTMENT ) LETTING ME KNOW BY VOICEMAIL THAT THERE IS A CHANGE IN MY ACCOUNT. WHEN I CALLED, THE XXXX PERSON TOLD ME THAT THERE IS A LEVY IN MY ACCOUNT AND THAT THEY ARE HOLDING $ 10,300++ ( DON'T KNOW THE EXACT AMOUNT TO THE PENNY- THIS AMOUNT IS MY WAGE EARNINGS SCHEDULED TO BE USED FOR CHECKS I'VE ISSUED, CHILDREN 'S ENROLLMENT AND OTHER BILLS. ) AND IS SCHEDULED TO RELEASE MY MONEY TO I DON'T KNOW WHOM ON XXXX XXXX. I ASKED THE PERSON WHAT IT IS ABOUT, AND COULDN'T TELL ME EXACTLY WHAT IT IS FOR AND SUGGESTED FOR ME GO TO A LOCAL BRANCH AND GET A COPY OF THE DOCUMENTS THEY HAVE. I THEN GO TO XXXX XXXX BRANCH ( A BRANCH I NORMALLY GO TO ) AND ASKED THE BANKER TO PRINT A COPY FOR ME, I THEN EXAMINE THE DOCUMENT AND SAW THAT IT HAS A NAME I HAVE NEVER USED EVER AND WAS WITH MY SOCIAL SECURITY NUMBER. I CALLED THE ATTY IN THE CASE AND I WAS TOLD THAT HE WOULD PUT MY CASE TO THEIR DISPUTES DEPARTMENT AND WILL SEND ME AN ID THEFT PACKET ( WHICH I NEVER RECEIVED TILL NOW ). I WAS QUESTIONING HIM THAT HOW COME I DON'T SEE THIS IN MY CREDIT REPORT TO WARN ME THAT SOMETHING SUSPICIOUS IS HAPPENING. ON THE SAME DAY, XXXX XXXX, I WENT TO A POLICE STATION IN XXXX XXXX TO REPORT THIS ID THEFT AND THE OFFICER TOLD ME HE CANT FILE A POLICE REPORT BECAUSE IT IS NOT AN ID THEFT BECAUSE IT HAS MY SOCIAL. I DONT UNDERSTAND! I THEN GO TO THE COURT IN XXXX XXXX XXXX ON FRIDAY XXXX XXXX AND GOT A COPY OF THE COURT DOCUMENTS. I SEE HISTORY OF ADDRESSES THEY SUPPOSEDLY HAVE SERVED THE PAPERS. THE COURT DOCUMENTS DONT HAVE MY SOCIAL SECURITY AND OTHER PERTINENT, ADDRESSES THAT I NO LONGER LIVE IN FOR MANY YEARS. IT SEEMS TO ME THAT THEY ARE JUST SLOWLY PUTTING MY INFORMATION TOGETHER, ALL THEY HAVE OF ME IS MY SOCIAL SECURITY. ON THIS SAME DAY I WENT TO THE SAME XXXX BRANCH I WENT TO ON XX/XX/XXXX AND SPOKE TO XXXX XXXX, A PERSONAL BANKER WHO KNOWS ME FROM COMING TO HER WHENEVER I NEED ASSISTANCE FOR ANYTHING REGARDING MY ACCOUNT. I TOLD HER MY STORY AND SHE CONTACTED AND INVOLVED THE BRANCH MANAGER XXXX XXXX AND XXXX INFORMED THEIR ESCALATIONS DEPARTMENT ABOUT MY CASE. WHO SAID THAT THEY COULD NOT DO ANYTHING TO RELEASE MY MONEY BECAUSE THE DOCUMENTATION PRESENTED TO THEM HAD MY FULL SOCIAL SECURITY THOUGH I REPEATEDLY TOLD THEM THAT I AM TRYING TO DISPUTE THIS AND THAT I ASK FOR THEM TO INVESTIGATE FURTHER SINCE IT DIDNT HAVE MY FULL NAME AND I HAVE NO RECOLLECTION WHATSOEVER, THAT I OPENED AN ACCOUNT WITH THIS CREDITOR. THEIR ESCALATIONS DEPARTMENT THEN TOLD MS XXXX THAT THEY WILL CALL ME NO LATER THAN WED OF THIS WEEK TO GIVE ME AN UPDATE. I EVEN TOLD MS XXXX THAT EVEN IF SHE KNOWS MY FACE AND NAME, WHENEVER I COME TO HER FOR HELP REGARDING MY ACCOUNT SHE STILL ASKS FOR 3 FORMS OF IDENTIFICATION : MY ATM CARD, MY PIN AND MY DRIVER 'S LICENSE. HOW COME XXXX CAN NOT DO THE SAME FOR ME? I EVEN ALSO GAVE HER AN INSTANCE WHERE I TRIED TO DEPOSIT A CHECK THAT MISSPELLED MY LAST NAME AND THEY REFUSED TO ACCEPT IT WHEN IT WAS ONLY 1 LETTER OFF MY LAST NAME .SHE JUST SHRUGGED AND SAID THAT IT IS WHAT IT IS AND SHE CAN'T DO ANYTHING ABOUT IT. I ALSO CALLED THE WINN LAW GROUP AND AFTER SEVERAL ATTEMPTS I WAS ABLE TO CALL MR XXXX XXXX AND ASKED HIM ABOUT THIS CASE AND ASKED HIM TO PROVE TO ME THAT THIS IS MY DEBT AND THAT HE HAS TO GIVE ME ANO ORIGINAL APPLICATION AND STATEMENT BUT HE KEPT SILENT AND SAID SOMETHING ELSE. ON THE SAME DAY, FRIDAY, XX/XX/XXXX I WENT BACK TO THE POLICE STATION IN XXXX XXXX ONLY BECAUSE FROM MY RESEARCH, I AM ALWAYS ADVISED TO GO AND FILE AN ID THEFT WITH THE POLICE DEPT, STILL THE SAME ANSWER. AND WAS TOLD TO GO TO XXXX XXXX POLICE STATION. SO I DID AND SPOKE TO A COUPLE OF OFFICERS AND TOLD ME THE SAME THING. IT'S NOT ID THEFT COZ IT HAS MY SOCIAL. BUT HOW COME IT IS NOT IN MY CREDIT REPORT? MONDAY, XXXX XXXX I SPOKE TO OUR ATTY FRIEND, MR XXXX AND HE TOLD ME THAT HE HAD SPOKEN TO THE ATTY IN CHARGE OF THIS CASE ( XXXX XXXX XXXX ) AND THAT HE WILL EMAIL HIM A POSTPONEMENT OF THE LEVY. WE ARE STILL WAITING FOR THAT UNTIL THIS TIME. TUESDAY, XX/XX/XXXX : XXXX ESCALATIONS DEPARTMENT CALLED AND INFORMED ME THAT THEY WOULD NEED 2 DAYS TO INVESTIGATE ON THIS MATTER AND WILL LET ME KNOW BY THURSDAY. I DON'T KNOW IF THAT IS ENOUGH TIME FOR ME TO BE ABLE TO PUT A HOLD ON THE LEVY UNTIL IT IS FURTHER INVESTIGATED FAIRLY THAT THIS ACCOUNT IS MINE. AFTER A FEW HOURS I CALLED XXXX COMPLAINT AND ESCALATIONS DEPARTMENT AND ASKED THEM FOR A VERIFICATIONS OF DEBT LETTER, I SPOKE TO XXXX AND SHE TOLD ME THAT THEY DONT HAVE THAT AND THAT I NEED TO ASK THE ATTY ASSIGNED TO THE CASE WHO IS MR XXXX XXXX FOR THAT. I KNOW THAT I HAVE ASKED THIS FROM MR XXXX THE TIME I CALLED HIM ON XX/XX/XXXX AND ASKED TO FURNISH ME THE ORIGINAL NOTE OF THE DEBT, AND HE JUST KEPT SILENT AND TOLD ME SOMETHING ELSE. ALSO, ON XX/XX/XXXX, I WENT TO THE SHERIFF 'S DEPARTMENT TO FILE A CLAIM OF EXEMPTION -ENFORCEMENT OF JUDGEMENT. I WAS TOLD THAT THIS COULD HOLD OFF THE DISBURSEMENT OF MY MONEY TO THE CREDITOR. In XXXX I received a letter from the Winn Law Group for a debt collection in the amount of {$8200.00}. This was the first time I had any communication from this group. The plaintiff was XXXX XXXX XXXX XXXX. I had no knowledge of this debt. No other information was provided. By contacting the Winn Law Group ( WLG ) I questioned the debt and after many requests was finally sent documents pertaining to this case ( which legally they should have already sent me. ) My name, address, Social Security number, etc were on the cover sheet. The following pages then belonged to a different woman with her information and details of a debt. I immediately contacted the WLG and informed them of their error and that it was a case of Mistaken Identity ; that this was not my debt and they had somehow managed to obtain my personal information and attach it to another persons debt. The receptionist said she made note of this and I was not advised any further of any actions to be taken. I received an additional letter and when I contacted the office of the WLG, I was told by a receptionist that the case had been dismissed. Regrettably I did not research my rights and provide a written dispute, nor did I keep these documents as I believed this to be concluded and that the WLG had realized their mistake. One year later I received another attempt of collection for this debt. Again I informed the WLG that this was their mistake & I had been told it had been dismissed. I asked them not to contact me again and warned them that I would report them for harassment if they continued to send me letters. In XX/XX/XXXX I went to my bank and found a charge in the amount of {$120.00}. I contacted the bank and informed them that I had not authorized this charge. I was advised to contact the XXXX XXXX County Sheriff. The Sheriff 's Department then advised me to contact an Attorney at the WLG. I tried relentlessly to talk with an Attorney but was either put through to voicemail, ( which I left multiple messages requesting they call me back and send documents relating to this case ), hung up on several times or placed on hold for an eternity. I called the bank back and they notified me through their Fraud Dept. that due to a legal order, there had been an attempt to try and extract {$8200.00} from my account to satisfy all or part of a debt. They charged me a processing fee ( {$120.00} ). If I had any substantial amount in my account, it would've been taken. I then received a Notice of Levy. The WLG falsely claim to have sent copies for 'Notice of Renewal of Judgement and Application of Renewal of Judgement. ' to my address. I never received these copies. The 'Proof of Service ' letter was not even dated & only claims to have 'placed such envelope for collection and mailing ' on XX/XX/XXXX. ( Document attached ). I am doubtful and question if these copies were ever actually mailed. I am certain the WLG did not want me to be able to challenge this Judgement but slyly went to the Courts without my knowledge to obtain a legal order. On XX/XX/XXXX, I was shocked to receive completely new documents. This copies show an attempt at debt collection dating back to XXXX ( for a Credit Card debt concluding in XXXX. ) Again, the WLG falsely claim that I was served with a copy of the Summons and Complaint. According to their documents, these copies were in fact served to a 'XXXX XXXX XXXX ' ( Docs attached. ) I never received these copies. They were never forwarded to me. The WLG neglected to send any follow up letters whatsoever, for the collection of this debt. In that same time period I had unfortunately accumulated two other debts that were in debt collection. Ironically, I had held onto all of these notices with the intention of settling them when possible. In XXXX, I was in a position financially to do so. I was able to 'Satisfy in Full ' these outstanding debts. ( Docs attached. ) I also contacted the Credit Agencies in an attempt of good faith, to locate and finalize any additional debts. None had been reported. Why were no letters of collection sent or a report filed for this debt? I believe the WLG has deliberately and intentionally been holding onto this debt to accrue interest. They have sent me incorrect documents ( leading me to believe I was the victim of Identity theft and filing a complaint with the FTC ) and neglected to inform me, by law, of my rights. They have failed to provide me with documentation that legally they were obligated to do and have been incredibly difficult and extremely unprofessional to deal with. It is highly questionable to me the business practice of the WLG. That I have never received the most important and relevant copies of documents that would've enabled me to settle this debt eleven years ago is troubling. I am very frustrated by the incompetence and negligence of the WLG. I would've gladly made arrangements to settle this debt in XXXX if I had the relevant information to do so. Instead there was an attempt to gouge my bank account for over {$8200.00}. The judgement from XX/XX/XXXX was a total of {$4000.00}. I am now a XXXX with XXXX children. My spouse supports himself and XXXX dependents. I have read warnings about this Collection Agency in regards to their tactics and dishonesty when dealing with payments made to debts. For this reason ( in addition to my horrible experience thus far with the WLG ), I am very hesitant to continue dealing with them at all.

Back in XX/XX/XXXX my daughter needed some XXXX services. I applied for a XXXX XXXX XXXX XXXX and the credit card was granted on XX/XX/XXXX, so I paid my child XXXX service with the new XXXX XXXX XXXX XXXX card. The first payment was scheduled on XX/XX/XXXX, unfortunately I did not receive a bill with the payment phone number or the payment address to send a payment, so almost at the end of the month decided to call and ask the best way to process my first payment, the XXXX XXXX XXXX XXXX representative told me that I needed the account number to make the payment, number that in the time of the call I unknown, for their security reason she couldnt gave me the account number, so the best was XXXX XXXX send me the bill to my mailing address and then process the payment. Until XX/XX/XXXX I received my first bill from XXXX XXXX XXXX XXXX, it was the XX/XX/XXXX bill with the payment information, STETEMENT WITH CLOSING DATE OF XX/XX/XXXX, PAYMENT DUE DATE of XX/XX/XXXX, and a MINIMUM PAYMENT DUE OF {$190.00} Dollars. On XX/XX/XXXX I paid {$100.00} dollars to XXXX XXXX XXXX XXXX over the phone, and in XX/XX/XXXX I paid another {$100.00} dollars online, so the minimum payment was covered before the due date. Come XX/XX/XXXX, I tried to process the monthly payment over the phone, XXXX XXXX XXXX XXXX refused to accept my payment because they had the suspicion that I applied for bankruptcy, I informed to the representative that it was not the case and I will continue with my payments in time before the due date, the representative refused to accept the payment. In a second call before the XX/XX/XXXX payment due date I called to the XXXX XXXX XXXX XXXX to check if they cleared the information and if I could process my payment, again the representative refused to accept the payment and this time I was informed the account was sent to the collection department, even when my previous payments were paid in time and I was trying to pay the third month. I tried to get the recovery or collection department phone number to stop the collection work, but the representatives told me I cant contact or make a payment because they were updating the account to the collection department and they will contact to me, I told several times to the representative that I was in the position to continue with regular payments and continue with the original credit card agreement, but they refused to give me a solution to stop the collection process. After several calls I gave up making my XX/XX/XXXX payment because the continually refused to accept it. Months went by and never did we receive another phone call or notice or some documentations or letter in regards this debt. The XXXX XXXX XXXX XXXX sold my account to a collection agency named XXXX XXXX XXXX XXXX. XXXX XXXX hired a Law Office to collect this debt, on XX/XX/XXXX they sent me a paper work of the account and I discovered the details that make this illegal collection. Originally the payment schedule was : 1rst minimum payment of {$98.00} before XX/XX/XXXX 2nd minimum payment of {$98.00} before XX/XX/XXXX 3rd minimum payment of {$98.00} before XX/XX/XXXX. And continuing every XXXX of the month until the balance be paid in full. But as I said the first bill was lost in the mail or just XXXX XXXX XXXX XXXX never sent out, So the 1rst payment was paid on XX/XX/XXXX over the phone, the second payment was paid on XX/XX/XXXX, On XX/XX/XXXX the first and the second payment were covered before the second payment due date. On the third payment it was not possible to process because on XX/XX/XXXX XXXX XXXX/XXXX XXXX sold the account to the collection agency XXXX XXXX XXXX XXXX, even before the third payment due date -remember the due date is the XXXX of each month-, that should be the real reason why the did not accept my payment because they sold the account to a collection agency before the account was a charge-off, but the account was not a charge off because I paid the first and the second minimum payments before the due date of the second payment. XXXX XXXX/XXXX XXXX excused in I was applied for a bankruptcy but that is a lie, the true is they sold an account to a debt buyer before the account was a charge off. To whom it may concern, I am attaching all information regarding the fraudulent debt, improper service and defamation of character as it relates to Winn Law Group / XXXX XXXX. I have no debts in collection at this time and all three of my credit reports are clean. This is an invalid debt from a XXXX credit card from XXXX that was removed from my credit report in XXXX due to Statute of Limitations. It looks as though they tried to reset the debt in XXXX and have been mailing me throughout the years and sending lawsuit paperwork which I know is a scam. When I tried to contact Winn Law Group they harassed me and were extremely rude and even when I stated this was illegal and it is an invalid debt they have continued over the years to mail me more paperwork. At first I thought it must have been an identity theft since I had been robbed but it turned out it was an invalid debt that was over the statute of limitations. I tried to send a certified demand letter stating the debt was invalid in XXXX but it went nowhere and the letters continued to come. Currently as of XXXX/XXXX/XXXX they placed a hold on a joint XXXX account in XXXX and have stolen {$45.00} and have caused my life to be in ruins. I moved XXXX/XXXX/XXXX to XXXX due to a XXXX called XXXX XXXX and am unable to work. It is my hope that we have Winn Law Group and XXXX XXXX put out of business for this illegal behavior and all Lawyers disbarred who work at their fraudulent firm. I think they should be imprisoned for these frauds. As the attachments will show they have been stalking me for years via mail and I used to get harassing calls as well. I suffer from XXXX XXXX due to years of their mail and harassment and have never been able to enjoy my quiet and peaceful enjoyment of life, so they are directly violating my Consumer and Civil Rights for the last seven years. I had a professional help me clean my credit report in XXXX when I was applying for an apartment and was being charged over {$2000.00} for a deposit for a studio apartment rental since my credit was not good. He told me and wrote on my reports that almost all my debt was 'SOL ' and told me about the Statute of Limitations. It was then that I learned about time barred debt and we disputed all the items and they were cleared off my credit reports. I even have the charge off letter from XXXX XXXX from XXXX, see attached. I am livid to find out this fraudulent company can steal from a XXXX person and ruin my life and credit. I was improperly served on XXXX/XXXX/XXXX by the XXXX County Police Department and never got paperwork showing I was served. I moved out of XXXX on XXXX/XXXX/XXXX so I am stunned they were able to steal {$45.00} from our joint XXXX checking account and place a hold on it stating I owe {$3000.00} for an invalid debt. They even had a judge sign off on this bogus paperwork, so now I am disgusted how far this scam has gone. I called the XXXX Court to follow up with why they would improperly serve and sign off on a fraudulent debt and all I got was a bunch of lip service. Seems like everyone is corrupt and nobody is accountable. They were extremely rude and informed me they can not give legal advice so I knew it was a matter for the CFPB to help me. My husband and I are very concerned they will steal from us again and are hoping to resolve this and get our money that was stolen back as quickly as possible. In XXXX of XXXX they also sent a wage garnishment to my ex employer after I was not working there which was defamation of character. Attached are all of the correspondence from Winn Law Group / XXXX XXXX from over the years and my past credit reports which show there are no collections on my credit. My life has been ruined from a bureaucratic nightmare and I am currently filing for XXXX which is pending and unable to survive, so Winn Law Group / XXXX XXXX steals from XXXX people and they should be held accountable for their many illegal actions and shut down. As the world was heading into a recession back in the early XXXX 's, my family and I found ourselves in a bind. My husband was laid off from work two days after we found out I was pregnant with our first ( and only XXXX child. We had large medical bills due and insurance premiums due to XXXX, no income from my husband and I was working part time. We used credit cards to survive. I tried several times to set up payment plans with XXXX XXXX, we even had paid for the insurance in case you lose your job, and no assistance was given. After a while, XXXX claimed our account, which was less than {$3000.00} was closed and they no longer can assist us. Fast forward to XXXX and out of nowhere we get a hit to our bank account taking everything that was in there. After talking to the bank, we finally got information that the Winn Law Group had gotten a levy on our bank account. I called their offices in XXXX of XXXX, to see what was going on. I spoke to XXXX ( ext XXXX ), who literally told me I had to pay {$600.00} a month for 12 months or a lump sum, there were no other options. I mentioned to him that I do not recall even getting a notice regarding this, supposedly they were able to get a judgement and the account was also about 8 years old already ... He assured me that they do a one-time " hit '', take what they can, then close the account. Since then, Winn Law Group has attacked our bank accounts a few more times, each time taking a little something, and never sending me any communication on the matter. They did take my son 's savings, which I had to fight to get back a few years ago. As I have looked on the court pages online, I see they got a Judgement on XX/XX/XXXX. I have verified with the courthouse that judgements expire in 10 years, unless renewed. They have not renewed. Also, they tried to take my son 's XXXX Account, this is a blocked trust account, this past XX/XX/XXXX ... two years after the last writ was executed ( court said the writ is good for 6 months ), thankfully, my son 's bank stopped them from taking it, but now I see they filed something again on XX/XX/XXXX ... Few issues I have are : 1- they never validated the debt, I asked, they said " don't you have your old bills '' ... 2- the judgement is over 10 years old, no extension filed 3- I don't recall ever getting anything to appear in court 4- they refused any payment plan besides what they wanted, which financially I could not afford {$600.00} a month, I still can't ... 5- they told me they do a one time " hit ' then it's closed, obviously, that was a lie. 6- the last writ of execution was filed XX/XX/XXXX, yet they tried to take funds in XX/XX/XXXX and probably now XX/XX/XXXX. 7- if they got a judgement in XXXX, they literally stalled for years before notifying me, and in that were able to accrue additional interest charges, as I had absolutely no knowledge of this until I went to use my debit card, in a restaurant and found out all the money in the account was gone ( in XXXX!!!!! ), so they accrued 5 years of interest charges basically behind my back. I don't understand how this works, if a person were to commit a crime, they are innocent until proven guilty ... but if your family life is turned upside down, and you rely on credit cards to live ( who also raise your credit limit without permission so you spend more, even though you have called and asked for help to get caught up ), you are made to be guilty until you show up for a court date to prove otherwise, And, the person suing you doesn't even have to prove they notified you ... Collection calls come all the time, it's the same message, nothing is ever explained and they usually threaten you to pay over the phone that instant so they can get their commission. The debt isn't validated and pretty much any scam artist can call pretending to be a collection agency. Then they can file a case against you, knowing you won't know about court, and they will win by default. This is wrong!! The consumer is not protected in any way. Banks get bailouts, major companies can fraud the people, then be forgiven of their debt, and even more, they make tons of money and never pay a dime in taxes ... where is the protection for the people? Why don't we get a fair chance to explain our situation, set up a payment plan and pay what we owe, not additional monies to fatten these collection agencies???!!!

On XX/XX/XXXX our vehicle was stolen and it was paid by XXXX at a total loss in the amount of {$23000.00} on XX/XX/XXXX. We had sold and moved from our XXXX XXXX XXXX home in XXXX of XXXX. CaseNo XXXX in the amount of {$1000.00} on behalf of XXXX XXXX XXXX with an interest amount of # XXXX and attorney 's fees in the amount of {$200.00} total judgement {$1500.00}, however we didn't received information on this because we moved and our address was still listed at XXXX XXXX XXXX XXXX. Then on XX/XX/XXXX an attorney XXXX XXXX XXXX of XXXX XXXX XXXX in XXXX, CA XXXX filed a case to extend the original judgement and has re submitted the judgement and renewal of the case on XXXX, XXXX in the amount of {$3200.00}. I XXXX XXXX was not named on any of these documents as of XX/XX/XXXX. Then on XXXX XXXX another document was filed with my husband 's and my name again to renew the judgement. Then on XXXX XXXX a writ of execution and the attorney was changed and to XXXX XXXX XXXX and another document was filed with interest in the amount of {$80.00}. totaling the amount at {$3300.00}. Then on XXXX XXXX another acknowledgement of credit was entered with interest in the amount of {$960.00}. Then on XXXX XXXX another document execution ( money judgement ) was presented and the total amount due was {$4200.00}. My address listed is still the XXXX XXXX XXXX, XXXX address. Another document was filed XX/XX/XXXX with Superior Court of California Memorandum of Costs after judgement. Then on XX/XX/XXXX another Writ of Execution was filed and the amount totaling was {$4100.00}. My address is still listed as XXXX XXXX XXXX, XXXX ca. Then on XXXX XXXX, XXXX a wage garnishment was sent to my husband 's work requesting 25 % of my husbands earnings from each paycheck and my husband is paid every two weeks. In XXXX of XXXX I called XXXX and requested information on my car loan and if there was money owed. After several calls I was advised that there was no attorney that was listed to sue for the amount as the amount had been written off and a XXXX was issued to me from XXXX XXXX made out to my husband as I was not part of the loan. I was told that my address listed was XXXX XXXX XXXX XXXX Ca and that was were the XXXX was sent to. I provided my current address and received the document in the mail. I have since filed a notice to vacate the judgement as I was not part of the loan and my address was never updated. Since this time I have learned that that original lawyer passed away and the there was paperwork filed included XXXX 's check to XXXX XXXX and the XXXX. We had court on the XXXX of XXXX and the judge was not convinced that the attorney is the attorney for XXXX XXXX and instead a credit that purchased the remainder amount. In any case the XXXX advised that it is wrong for a company to have sued for an amount and there are several inconsistencies with the case. The judge ordered that the attorneys provide additional documentation that stated we had agreed as part of stipulation to repay the original amount and if not then she would need to make a decision. So the case was postponed till XX/XX/XXXX. On XX/XX/XXXX XXXX XXXX advised that we should file a case in small claims court to get our money back from the attorney and that the statue of limitations She told us we should not have to pay twice since we had to file taxes using the XXXX as additional income and have wages garnishments at a higher amount. Where I believe our rights were violated is that XXXX filed the same paperwork that has already been filed on XX/XX/XXXX with no written response or acknowledgement that it was sent to me or my spouse. Because this is a creditor the amount was not addressed prior to the 4 years that a creditor has to retain payment. The original lawyer XXXX XXXX XXXX did not file until XXXX and was a debt collector which means they were not the original creditor. Also XXXX XXXX XXXX practice filed paperwork to name a new XXXX XXXX XXXX XXXX after XXXX XXXX XXXX passed away. Then in XX/XX/XXXX filed a new state of information with the secretary of state in California. Winn law group proceeded to send me a stipulation agreement for the first year to pay {$25.00} a month and then the following year {$75.00} a month. I have been making payments ever since XX/XX/XXXX to present and never have been late. The payoff date stated in the stipulation agreement is on or before XXXX XXXX XXXX From XX/XX/XXXX to XX/XX/XXXX I have made payments in a total of {$2600.00} and the amount left owed is {$2300.00} from the stipulated settlement agreement of {$5000.00}. On XX/XX/XXXX I received a letter from XXXXXXXX XXXX XXXX XXXX located XXXX XXXX XXXX XXXX XXXX XXXX MN XXXX. I spoke to XXXX XXXX ( Winn law group ) around XXXX XXXX She said that Winn law group no longer has my account that XXXX had it and to call the number on the statement. I called XXXXXXXX XXXX XXXX the same day XX/XX/XXXX. The operator that answered was XXXX XXXX. XXXX XXXX explained to me that XXXX bought out Winn Law group. I was very confused on why I was never notified of the change and received a new debt collection letter with a higher amount than I owed. Winn law group never notified me of this change and has broken the stipulation agreement. Winn law group and XXXXXXXX XXXX XXXX has falsely claimed the wrong balance on the total amount owed of the stipulated account settlement of {$5000.00}. Today, XX/XX/XXXX, an individual from the XXXX XXXX Sheriffs Department delivered a writ of garnishment to my employer. The writ was endorsed by the Superior Court of the State of California, XXXX XXXX County. The attorney of record on the writ is Winn Law Group ( Winn ) and the plaintiff/petitioner on the writ is XXXX XXXX XXXX, XXXX ( XXXX ) as an assignee of XXXX XXXX. ( XXXX ). The writ of garnishment contains a mistaken identity. While it is addressed to my employer, the defendant ( who has the same first and last name as me ), has a different middle name, address, and social security number. I do not currently live in the same state as the defendant. I believe the mistaken identity originates from the fact that the defendants address is in the same zip code as my employers headquarters, despite the fact that I work in a separate office, in a separate state. I immediately contacted the sheriffs department and an individual there represented that he had no ability to change the writ, the sheriffs department merely serves the writ. I then contacted Winn. The first operator I spoke with forwarded me to an unattended phone line. The second operator I spoke with forwarded me to one of the firms attorneys XXXX XXXX. Mr. XXXX asked for my address and the last four digits of my social security number. He confirmed that the defendant does not appear to be me and said he would draft a release letter to send to the sheriffs department. I requested a copy of the release letter as well. He requested my email address and said he would send me a copy of the release letter in the next 15 minutes. I did not receive any emails from Mr. XXXX today. I tried four additional times to reach Mr. XXXX and left two messages. My haste in filing a complaint is an attempt to force Winn or XXXX to submit a release of claims within the 10 day window in which my employer is required to respond. I believe Winns misidentification, identifying me as the defendant, is a material violation of my rights and privacy. Further, Winn caused significant embarrassment to me by matter of a sheriff appearing at my employers headquarters and making the false identification public to my coworkers. My complaint will be satisfied when Winn ( and/or XXXX ) : 1 ) prepares a release of claims letter that is sent to me, my employer, the XXXX XXXX County Superior Court and the XXXX XXXX County Sheriffs office ; 2 ) each entity confirms receipt of the release letter, 3 ) Winn submits to me an apology letter, and 4 ) Winn posts a new policy on its public-facing website stating the appropriate procedure an individual may follow when it believes it is subject to misidentification and, in that policy, Winn commits to addressing every complaint alleging misidentification. I am lucky that I was able to catch the misidentified writ of garnishment before my employer deducted wages. Other individuals may not be so lucky.

XXXX and it's associates makes claims to proof of service by substituted service in XX/XX/XXXX at an address I no longer lived at. XXXX has been attempting to collect and sue/take me to court ; all without my knowledge using an old address to pretend to contact me until XX/XX/XXXX in which I received notice from the county recorder of an involuntary lien recorded. On XX/XX/XXXX I called XXXX ' Collections Attorney ; Winn Law Group to receive information and dispute debt. They stated I now owe {$7200.00} ; which is a misrepresentation and not what is stated in the lawsuit. I sent a dispute letter and request for validation of debt by certified mail to both XXXX and Winn on XX/XX/XXXX in which they both received. Winn Law Group sent me their first correspondence ever stating they were attempting to collect a debt. The amount stated over the phone and on paper are different. The information provided in their correspondence to me does not belong to me ; nor are there any documentation of proof showing that I had such account or that there is a debt owed by me. The file sent to me was incomplete, unverifiable, and inaccurate and the dates do not match up nor are there any signatures or valid information to link me to this false account. XXXX filed in XX/XX/XXXX an abstract of judgment against me which should be stopped immediately. I only know of this recent file by way of the county recorder. XXXX has been attempting to collect a false debt since XX/XX/XXXX. XXXX obtained a default judgment in which I never knew about in XX/XX/XXXX by using a previous address so that I could not dispute or fight for my rights. A debt collector must serve you with notice of a lawsuit if it sues you. And if it gets a default judgment against you because it failed to serve you with notice of the lawsuit, it is prohibited from trying to collect on that judgment. Collectors are not able to collect phantom debts ; this is violating the Fair Debt Collection Practices Act. Saying I owe a nonexistent debt is in violation.

I am writing in regards to a debt collection that is not valid nor mine. As a single mother and sole provider for my household, I have worked diligently since XXXX to pay off all debts owed and clean up my credit in order to purchase a home for myself and my daughter. I started in XX/XX/XXXX by contacting all my debtors based on my credit report and outstanding debts owed. By XXXX I was able to pay off all debts with the exception of my school loan and car payment. I continued on my journey of cleaning up my credit by no longer acquiring credit cards and living by " cash only ''. In XX/XX/XXXXI received acknowledgement that I had finally paid off my school loan in full. This was the best day of my life considering how long I had been paying on this school loan and was now only left with my current car payment as my only open credit account. In XX/XX/XXXXI started the process of purchasing my own home. I would not have been able to accomplish this with any outstanding debt, collections or judgments against me. In XX/XX/XXXXI was able to purchase my first home and felt fantastic about all of my hard work since XXXX to make this dream come true. In the background as all of this was going on, Winn Law Group sent me notice after notice after notice threatening me with debt that was not mine nor owed. I repeatedly told them via phone calls, refusal of mail, and written communication that I did not owe this money and that they were harassing me. They have been relentless in their pursuit and it has escalated now to them trying to garnish my wages. I have provided them with copies of my credit report showing that there is NO DEBT that is outstanding nor owed to any parties. The Winn Law group has been aggressive, rude, non-compliant and basically just harassing. They have phished my social security number and will not leave me alone. They are now trying to steal over {$6800.00} from me via wage garnishment without cause. I am the sole provider for my household and every penny I earn is budgeted and accounted for. In addition I monitor my credit daily to weekly and any time there is a change I am monitoring it. Please help, Winn Law Group needs to be stopped. I am being sued by XXXX XXXX XXXX in the state of California. The debt I created with XXXX XXXX XXXX was created in the state of XXXX. I did not sign for the debt in the state of California. Why am I being sued in the state of California? Also, I received a letter from XXXX XXXX , Executive Office of Customer Advocacy for XXXX, dated XXXX XXXX, 2015. This letter was pertaining to an investigation that XXXX performed concerning my previous CFPB complaint. She stated that Winn Law group reported that there were XXXX repayment options offered to me which I declined. This was a false statement made by Winn Law Group. I was offered only XXXX payment option which was a 60 % reduction of the balance in a XXXX lump payment or XXXX monthly installments. I declined the offer because I thought the debt had passed the statue of limitations to be sued on in the state of California. So, I decided to make a complaint to the CFPB for relief of this debt. Additionally, the Winn Law Group stated to XXXX that I declined another offer of a two year repayment plan. The law group never made an offer of a two year repayment plan to me. This is false. When I spoke to XXXX XXXX, a lawyer at Winn Law Group, I told him that they never mentioned more than XXXX option of repayment to me ; however, if there is another option for me, I would prefer a 60 % reduction of the balance with a first payment of {$3100.00} and the remainder to be divided into XXXX monthly installments of {$260.00}. XXXX agreed that this was a doable arrangement ; however, I did not hear from him anymore on the matter. I faxed him a copy of XXXX XXXX ' letter for his records. I received a letter from Winn Law Group dated XXXX XXXX, 2015 stating that they have verified my debt with XXXX and it is their intention to continue with collection activity. XXXX XXXX contacted me regarding a charged off XXXX. I advised the collector that I did not believe the debt was collectible because it was already charged off. I requested debt validation via phone, fax, and mail. I never received anything and they stopped contacting me. They then obtained a default judgement. I was never served. They never validated the debt. My paycheck was garnished and when I contacted my employer I was notified that my paycheck would garnished for 25 % until the debt to Winn Law Group is paid. Hello, First off, I was never served. I did however, receive notice of a wage garnishment so I made arrangements with all documentation of my personal debts to appear in court. I sat in a courtroom which was noted where my case would be heard, then not realizing I was given the wrong court room number until court hearings were completed. After I have been trying to settle this debt for over 1 year and the company never responded to my many attempts, I contacted CFPB and all of a sudden Winn Law Group was able to respond, but still did not provide a written settlement. When my ex-wife failed to make payments on a leased car so I had the car picked up when we separated. I have been trying to fix this problem for a long time ( over 15 months ), have offered pay-off, settlement etc. Company keeps calling me on a daily basis, about 3-6 times per day from different numbers. XXXX ownes this debt. Winn Law Group calls me all the time, instead of providing a signed settlement in writing - they have provided a setetlement, but with amount too high, I had explained to them that I am under a single parent COVID-19 hardship with no income since XX/XX/XXXX. RThey sent me a settlement that they did NOT SIGN, amountb too high. They need to provide a settlement offer that I can AFFORD and that they SIGN before they send it to me. A printed out settlement offer NOT signed is not valid and I can NOT send any money to them if it is not legitimate and SIGNED!! They also need to assure that they will dismiss the lawsuit against me within 10 days after receiving the 1-TIME SETTLEMENT PAYMENT, that they will provide a copy of the dismissal of the lawsuit to me within 15 days, that they will refrain from suing me about this matter and the remaining balance in the future, that the entire debt will be dismissed with my one time payment of {$200.00} They just called me again from a robo-call saying they are offering a disount, press 0 - when I pressed 0 the call was being disconnected. I contacted the Winn Law Group to get information on a collections account that is being handled by them. They told me they could not give me any information because I was being represented by an attorney. I told them that was no longer the case, they asked that I send that in writing. I sent that in writing as requested, then I call back and they tell me they still cant give me I formation because the letter doesnt state that Im validating the account ( which they never asked me to do that in the first place ) I call back and ask why I wasnt told that because i could of easily done that the fist time. Once again I sent what they requested, another letter that stated I wasnt being represented by an attorney and that I am validating the account. I call back thinking Im going to get information finally and Im told they still cant give me any information because the letter I sent doesnt state that I am not disputing the account. At this point I am very frustrated because again I wrote what they told me to and at no moment did they say I should write that. Back in XXXX I stopped making payments on a {$1600.00} XXXX credit card as my identity had been stolen and was going through financial difficulties. It seems that in XXXX XXXX decides to sue me but I was never served. XXXX attorneys put a judgement against me and continues to try to collect the debt. I settled the debt with XXXX back in XXXX XXXX and part of my settlement condition was that they would remove the judgement. That was not done. The attorneys are the Winn Law Group in XXXX, CA. I am now trying to sell a piece of property I own but the judgement is showing up on my credit report. When I got the information from the escrow company as to who to call, I called them and they sent me a letter trying to settle the debt that I had already settled and the amount had gone up to {$6400.00}. I got a letter from XXXX that my account had been settled and to please remove the judgement and my name from their list back in XXXX XXXX, XXXX. To date, I have not received a response from them and the judgement still appears in my credit report. XXXX XXXX, 2017 XXXX XXXX XXXX with held the fund {$2200.00} in my bank account due to a Notice of Levy Under Writ of Execution in the amount of {$30000.00}. I did n't know where this debt came from. I received a judgement letter notifying me of the bank levy on my account after the withdrawal had already taken place. I was short on all of my rent and bills. The attorney has engaged is unfair and deceptive practices in violation of FDCPA in his actions related to the attempted collection of a credit card debt which his firm bought from another agency. In my attempt to resolve the debt in good faith, I provided financial information as a means to establishing a repayment plan. The attorney represented that they would cooperate with me in arriving at resolution. Instead, the attorney, without due notice levied my personal bank accounts. With the difficulty I have encountered in making contact with this attorney and his firm via phone, email, and correspondence via mail, I have not been given sufficient opportunity to communicate effectively nor has the attorney been forthright in their communication with me. My demand is that this attorney immediately be order to cease and desist all and any actions against me in the matter of collecting a debt, and be investigated by your office for disciplinary action.

In XXXX of XXXX I leased a car from XXXX. Along with my down payment they had offered me a credit card in the amount of {$2500.00} to also use towards the down payment. I told them that I was not interested. I did not want a car payment plus a credit card payment. Gave my down payment signed all the paperwork and drove home in my new car. I Contacted the Winn Law Group who are located at XXXX XXXX XXXX XXXX XXXX XXXX XXXX CA XXXX. I contacted them at XXXX XXXX XXXX XXXX on XX/XX/21, XX/XX/21, XX/XX/21 and left messages on their voice mail system. I never received a return call. On XX/XX/21 I spoke with customer service clerk XXXX at extension 107. Faxed and emailed paperwork requested. XX/XX/21 -called to follow up and left a voice mail. Hello, I am attempting to lodge a complaint against debt collectors and law firms who work in conjunction to pressure and threaten individuals by suing them in State Civil court ( California ). They have created their own industry, to enrich themselves and prey on citizens who can afford no real defense for themselves, and I am including myself. By suing them in state court as apposed to Small Claims court. They create an environment in which the defendants have no previous experience or knowledge and therefore are prevented from offering any real defense for themselves. These collection agencies, which are mostly paying pennies on the dollar for these outstanding loans, then turn around and demand a repayment of at least 70 %. Which should be construed as illegal Usury. I am talking about thousands of suits brought to court every week in the state of California. The plaintiffs attorney ( who was a paid litigate stand-in for most of the firms who were due in court that day ) explained to me afterward how terrible this practice was and that it had been going on for at least 8 years.

Winn law group aggressively started their collection efforts for the XXXX XXXX account back from XXXX which was already stipulated and paid by the client on XX/XX/XXXX. Winn law states there is a law suit and threatened the client to renew legal complaint because they have not received any payments on the account and are demanding a full pay plus legal fees of On XX/XX/XXXX they issued a letter stating that attached judgement is sufficient documentation for debt validation. But failed to attached this judgement with their letter. I recently found out that I was a victim of Identity theft. Someone used my personal information to open a loan with XXXX XXXX XXXX about 15 years ago. The current balance is {$11000.00}. I believe this creditor is located in the State of Ohio, where I never have lived. I have been a California resident for my whole life. In addition, I have never received any type of communication regarding this matter. I was never served or receive any summons from the court. The Winn Law Firm sued me in which they told the judge that I was served. I never received the court papers I have no idea who they gave the papers to. I missed the court date.They won by default judgement. The complaint was supposed to have been mailed to me also, but who reads mail in which they have no knowledge of. My accounts was frozen, my only means of support for my son and myself. I was not on the look out for this company or the lawyers representing them because the debt was not my own. To whom it may concerned, I am respectfully requesting help with a law firm/debt collector, Winn Law Group, in which I have recieved 2 letters threatning legal action if I did not contact them for a resolution. The last letter I recieved was XX/XX/2020, notifying me that they intend to enforce legal proceedings to obtain payment. This is a XXXX XXXX Credit Card Debt from XXXX. I have been trying to settle this debt for over 1 year with XXXX ( who owns this debt now ), as well as with Winn Law Group ( their lawyer, Mr. XXXX ) - however, XXXX says they can not receive payments, because Winn Law Group is handling this for them. I received a XXXX credit card in XX/XX/XXXX. I was married and in XXXX when the card was received. I went through a divorce in XX/XX/XXXX. Yesterday evening I received a call from my employer notifying me that there was a wage garnishment order from a law firm by the name of Winn Law Group. The order is requesting more than 25 % of my check, as a single mother during COVID this seems excessively cruel and perplexing. Winn Law group on the first hand will never answer their phone and will keep you on hold until you basically give up. I even went to their office location and was threatened that they would call the police. This lawyer has some sort of serious ax to grind with me personally and they are collecting on a debt that they already successfully garnished my wages and the full amount was collected until they came up with an amount and even placed a lien on my home. In their statetments, XXXX instructed them to remove the levy and return all the money they took from me. The letter ends without providing any Information on how, when, and what way I can expect to get my money back from them in full. XXXX was notified by my employer about a possible wage garnishment regarding a judgement I had never made aware of. I was shocked when I found it this legal action was filed in 2012. I was not properly served, and I have a very strong suspicion that they purposely lied about whom they served in order to push this lawsuit through and obtain a default judgement. Furthermore, the law firm has engaged in unfair and shady practices by attempting to use outdated writs to try to seize my property. This account was established over 10 years ago. I closed it by choice between XXXX and XXXX. I informed the creditor at that time that I needed to arrange a lump sum payoff settlement amount because of financial hardship but they declined my offer. However, I continued to make the minimum monthly payments until XXXX. In XXXX, I became financially unable to make the payments anymore and the account went into default. I received a letter from Winn Law Group that indicated their intent to file a lawsuit for an aggressive collection agency XXXX, XXXX, that only recently obtained an account from XXXX that I had been making small payments on. They use excessively aggressive tactics and when I attempted to call them indicating at the time that no law suit had yet been filed they tried to claim I needed to pay the entire debt off or in several large payments, which I indicated I could not do. They showed no respect, courtesy, or flexibility, and demanded I provide them a lot of documentation about my current income. Before this could be gathered I was served with the evidence of the legal summons. I had a debt with XXXX credit card. XXXX charged off the debt a third party debt collector picked up the debt and sued me in court recieving a judgement against me. I live in the state of california, the law here states a third party debt collector can not sue a person in a court of law, they may contact the individule and try to collect but they may not take them to court. Also this third party debt collector sued me in court after the statute of limitations ran. I was mailed a judgement this weekend. The judgement was for a credit card I shared with my ex husband over 10 years ago. He agreed to pay this debt in our divorce. I paid the debt in full in XX/XX/2008 and received a notarized letter from them stating that this debt was paid in full and that I no longer owed them any money. They contacted me a little over a year ago regarding this. I called and spoke with someone who had me fax over the paperwork that I have showing that it was paid in full. I called again to confirm that he received it and he said that he did and that everything looked to be in order. He said that if he had any other questions that he would call me back.
