A letter of notice of error was sent to WVHDF on XXXX XXXX, XXXX which stated the following : This letter is to serve as official notice that an error has been made on my loan account as required under the Real Estate Settlement Procedures Act ( RESPA ). This error was reported to your office on XXXX XXXX, XXXX at XXXX XXXX. by telephone ; however, RESPA only governs written notices of error. My escrow account on loan XXXX has been erroneously charged {$310.00} for Mortgage Insruance Premiums which were cancelled after the XXXX XXXX, XXXX payment. Disbursements were made in error for XXXX XXXX, XXXX for {$62.00}, XXXX XXXX, XXXX for {$62.00}, XXXX XXXX, XXXX for {$62.00} and XXXX XXXX, XXXX for {$120.00}. Under Section 1024.35 ( d ) of RESPA I should be provided a written response acknowledging receipt of the notice of error. Section 1024.35 requires a servicer to respond to a notice of error by correcting the error or errors identified by the borrower and providing the borrower with a written notification of the correction, the effective date of the correction, and contact information, including a telephone number, for further assistance ; or conduct a reasonable investigation and providing the borrower with a written notification that includes a statement that the servicer has determined that no error occurred, a statement of the reasons for this determination, a statement of the borrowers right to request documents relied upon by the servicer in reaching its determination, information regarding how the borrower can request such documents, and contact information, including a telephone number for further assistance. The servicer should also comply with these requirement no later than seven days ( excluding legal public holidays, Saturdays, and Sundays ) after the servicer receives the notice of error or errors asserted. WVHDF replied on XXXX XXXX, XXXX that they would review my information and a formal response would be forwarded to me within 7 days. I have not received a formal response as of XXXX XXXX, XXXX. It appears that according to my online history {$250.00} has been refunded to my account which is {$62.00} less than disputed. I have not received an explanation as to the difference disputed and it appears my escrow account will be left materially over funded if this is left on account.

There 's an organization in West Virginia that 's loaning money to Municipalities for demolition and these loans are required to be used for redevelopment. The Agency is called the West Virginia Housing Development Fund and they 've loaned about XXXX XXXX dollars to the City of XXXX, WV and countless homes have been destroyed by way of illegal use of theses funds. Residents and property owners have had their homes wrongfully Condemned and placed for demoltion and have been denied the opportunity to repair or do work on their houses. Funds loaned to the Municipalities were required to comply with WV XXXX The Urban Renewal Authority Law for Slum Blight Clearance and owners were by law to have had their homes acquired and compensated. This did n't happen and the City of XXXX demolished houses that they had no intention of redeveloping and vacant lots were left and owners told they could n't build on the land because variances had changed so that they were left with a useless piece of land. Incidentally. houses were Condemned by uncertified Code Officials that XXXX hired and permitted and hired them to do this. There is a lot that XXXX 's XXXX mother lived across the street from that I owned and the neighbor was friends with the City Officials and complained to Code Enforcement until the house was Condemned and placed on the Demolition list, torn down, and vacant lot obtained by XXXX from my bank whom I was buying the property off of. The bank told me to deed the property back over to them or be foreclosed on and then the bank deeded the property over to the City for partial payment of the demolition cost and the neighbor who all along wanted the lot purchased it from XXXX.There is a property where a demoltion occured and the lot where the City demolished it later was the sight of new construction of a apartment house owed by the XXXX City XXXX 's brother and his XXXX called XXXX. This all sounds like racketeering and must be stopped and acted upon. Please help this stop-now XXXX is using XXXX XXXX XXXX XXXX to continue on with the illegal demolitions. The WVHDF is now lending money again illegally to the City of XXXX, WV Thank You, XXXX XXXX

This is not one specific incident, simply a frustration with a recent change to mortgage billing. I believe a law has recently been enacted that requires monthly billing statements rather than coupon booklets ; I presume the method behind that is to serve as a reminder for borrowers to make their payment, rather than being expected to submit payment on their own via coupon booklet without prompting. That, in and of itself, is ridiculous ... .the mortgage payment is due at the same time every month ... if you ca n't be responsible for making such an important payment, then a late charge or being reported to the credit bureaus, is simply a consequence that you 've earned. All of that aside- if monthly billing statements are necessary, why can they not be mailed out earlier in the month? Typically these statements are cut in the middle of the month, by the time I receive the billing statement, often I 've already mailed payment in. It 's frustrating, because losing the ability to use a coupon booklet limits the control you have on when payment can be mailed & what documents you have available to you before issuing payment.

West Virginia Housing Development Fund ( WVHDF ) is incorrectly reporting balances on XXXX XXXX credit reports. They either need to delete XXXX XXXX completely or make the balances correct. I personally have a mortgage with WVHDF and on a monthly basis I have to dispute the incorrect balance. I also work for a bank and can see other WVHDF customers incurring the same issue.
