It 's a rather long story. I am self employed. My husband was diagnosed with XXXX in XX/XX/XXXX and is on SS XXXX. Shortly after my husband was diagnosed the company that he worked for elected not to take him back when he wanted to return from his short term XXXX. He was a XXXX XXXX and his XXXX and XXXX had become XXXX and were the symptoms that caused the lengthy testing and final diagnosis. I believe since the company was self insured that it was their concern more than him being capable of performing the same duties, although he was not going to be able to continue the 60 to 65 hour work weeks. Due to my being self employed we paid the XXXX XXXX until it was exhausted at which time I had formed a small group of one and could add him to the policy. I am telling you all this because it has a lot to do with how I got to where I am. Those premiums started at approx. 1500/mo and increased annually. In XX/XX/XXXX, the economy began to shift, I had absolutely no idea where it would take us and of course thought it would only be short term. In order to meet all of the increased obligations I refinanced our property with XXXX XXXXXXXX XXXX XXXX. They refinanced me into an 80 % interest only first with a 2 year prepayment penalty and a 30 year fixed second at 10.125 %. As those first two years began to pass the spiraling direction of the economy became clearer, the interest was going to adjust on the first and I began to panic. I worked extremely hard to refinance out of that situation. Of course it did n't work. So XXXX transferred the 1st to XXXX and the second to XXXX. I did start to work with XXXX to modify the first mortgage. It took quite a while but was successful and that loan is now 8 years old and still in place at 5.5 %. Then I approached XXXX and requested a Loan Modification. They initially put us on a trial loan mod at 7.99 %. I began to make those payments. The first couple months went by and all seemed to be fine, then I started to receive late notices, I did n't understand until I figured out that the amount that they were considering late was the amount that was the difference between the modified " trial '' payment and the original amount in addition to accrued interest and late charges. They would not accept any further payment unless I brought the entire amount current and said that I would need to re-apply for a modification since they did not have any record of a previous " trial '' modification being approved. So I sent everything in again including their own paperwork showing the modification approval. This time they responded with a denial stating that I did n't qualify financially for a modification and recommended that I consider a short sale on the house. That made no sense. At that time we owed approx. XXXX on the first, XXXX on the second and the house exactly like ours across the street had just sold for XXXX, they stood to get nothing, I was asking for a loan modification so that we could afford to stay and make more affordable payments, seems to me that was better than them getting nothing in a short sale and obviously if I did n't qualify for a mod I was going to struggle with the higher payment that I already had. Shortly thereafter XXXX closed down their mortgage division and transferred all their loans and I did n't hear anything from anyone, no phone calls, no statements, nothing!! I was nervous and certain that the second would surface and the entire amount would be demanded all at once and I would n't be able to do anything to i.e. refi etc..to get that much money. By this time someone being self employed looking to obtain mortgages or refinances were pretty much out of luck, no one was lending let a lone to the self employed. Long story short, this second has transferred 5 times, Over all these years ( almost 8 years ) I have received 2 phone calls and not one statement. Until, 2 months ago I received a threatening letter from West Coast Servicing. Upon receipt of the first notice they sent I retained an Attorney in hopes of resolving this once and for all. He told me that West Coast Servicing very likely bought the debt for pennies on the dollar and he would negotiate with them and try to get them to settle for anamount that was fair and that we could afford, the original loan amount was XXXX, West Coast Servicing has added XXXX, making the total they are demanding approximately 90K! The Attorney sent them 2 letters asking for them to take less, they said no. I have applied to 5 lenders, the most recent being a hard money lender. I initially received approvals but I have obviously told them about the second mortgage and I have sent them the notices and recent notices that I received from West Coast Servicing knowing that there would be questions when a Title search was done since the second only showed recorded by XXXX for XXXX and just recently West Coast recorded a servicing transfer on title. In the beginning the lenders say no problem then they come back and need 12 to 24 months of payment history on the second, Since I cant provide that I have been told that I cant get a conforming loan and need to seek out Hard Money Lenders. The Hard Money lender had even lower allowable LTV and DTI, so there was no way he could help me. He said the same thing all the others have said and that is that the Attorney certainly should have done more and I should be filing this complaint and getting things straightened out because the original second of XXXX ( it was less than that when it went in to default )@10.125 % should not be XXXX now and said the very same thing as the Attorney that West Coast Servicing bought bad debt for pennies on the dollar and are looking to make a huge return. Since I have only received notices of Servicing transfers ( none of which have been recorded until West Coast Servicing several months ago ) and only 2 phone calls in all most 8 years I can not help but think that this has been well planned and thought out. Why did no one ever reach out to me during the many years that the second and at least a third of the first mortgage was under water? Why now? After almost 8 years and absolutely no statements, no contact all this time? Negotiations have failed with West Coast Servicing, they are not willing to work out a payment plan or anything other than paying the amount in arrears ( approx.42K ) by XX/XX/XXXX and resuming monthly payments at 10.5 % and at XXXX with interest continuing, where does this end? It will go on and on forever. I do n't have the XXXX, Obviously we have lived in our home for 26 years and we do n't want to lose it, my husband not only suffers with XXXX but is now in XXXX XXXX XXXX with only 25 % XXXX capacity. I honestly do not think he would survive a move. Please see timeline below : Second Mortgage Summary XX/XX/XXXX - Refinanced with XXXX XXXX XXXX XXXX, received an interest only adjustable rate first mortgage starting at 5.99 % ( Principle {$210000.00} ) with a concurrent second mortgage fixed at 10.125 % for 30 years ( Principle {$53000.00} ). First Mortgage servicing transferred from XXXX XXXX XXXX XXXX to XXXX XXXX XXXX Second Mortgage servicing transferred from XXXX XXXX XXXX XXXX to XXXX on XX/XX/XXXX XX/XX/XXXX Began working with XXXX to negotiate Loan Mod for 1st Mortgage with XXXX XXXX XXXX, after refusing initial offer from XXXX due to higher interest rate, a second offer was made, trial period entered and completed. First mortgage Loan Modification was finalized on XX/XX/XXXX. The first mortgage was modified to a principle of $ XXXX@5.525 fixed interest for 294 months beginning on XX/XX/XXXX. XX/XX/XXXX Initiated Loan Modification Request for Second Mortgage being serviced by XXXX. XX/XX/XXXX XXXX offered trial period to reduce fixed interest to 7.99 % reducing the current payment of approx. {$450.00} to approx. {$400.00}. XX/XX/XXXX, began to get late notices from XXXX. Late charges were being charged. We were not receiving credit for the lower agreed to payments that were being made. I sent receipts to XXXX, called XXXX, tried to straighten out the record keeping with XXXX, had no success. XX/XX/XXXX, sent in all new paperwork requesting Loan Mod ( Second Request ). Also, went above and beyond and sent current Sold Comps showing value on property. XX/XX/XXXX, Received Denial from XXXX for Loan Modification, stated we lacked sufficient income to qualify for modification and was advised to Short Sale Property. The first mortgage was under water, the second mortgage had no value. XX/XX/XXXX, Servicing transferred to XXXX XXXX , XXXX XX/XX/XXXX, Notice received from XXXX XXXX, XXXX XX/XX/XXXX, Email correspondence with XXXX XXXX/XXXX Rep, indicated that an offer to settle for XXXX had been made, I had not received anything and explained that I would not be able to put that amount of money together on such short notice. I never received anything in writing in regards to a Settlement of any sort. XXXX said that the deadline to pay in full on the XXXX offer would be XXXX. When I told XXXX that I could not/did not have XXXX, she told me to tell how much I could do and I told her no more than 2K, she said she would present whatever I wanted her to and she would see if she could get it accepted. I never heard anymore from her. XX/XX/XXXX Servicing transferred from XXXX to XXXX XXXX XXXX , XXXX. XX/XX/XXXX, Notice received from XXXX XXXX XXXX XX/XX/XXXX, Letter sent to XXXX XXXX XXXX requesting evidence of debt, I sent certified, the certified letter was received and signed for by Rep of XXXX on XX/XX/XXXX XX/XX/XXXX, Received letter and copy of Deed from XXXX XXXX ( formerly known as XXXX XXXX XXXX XXXX ) per the bottom of their letterhead XX/XX/XXXX, Received Privacy Policy from XXXX XXXX XX/XX/XXXX, Received Privacy Policy from XXXX XXXX XX/XX/XXXX, Notice of Assignment, Sale or Transfer of Servicing Rights received from XXXX XXXX, Servicing being transferred to West Coast Servicing , Inc XX/XX/XXXX, Notice of Transfer of Servicing Rights received from West Coast Servicing , Inc . XX/XX/XXXX, Received Certified Mail, Collection Letter from West Coast Servicing giving 14 days to request a meeting with them. The total owing on this letter is now {$89000.00}. West Coast Servicing, XXXX XXXX XXXX, XXXX XXXX, CA XXXX / XXXX XXXX XXXX at XXXX XXXX XXXX XXXX, XXXX TX XXXX are using illegal and Fraudulent tactics/actions to collect a debt amount that is not owed. In XXXX XXXX XXXX, we had a 15 yr. loan @ 13 % with XXXX XXXX XXXX, XXXX XXXX XXXX, & XXXX and the maturity of the loan was XXXX XXXX, XXXX. Each of the before mentioned finance companies ALL were frankly taken over by XXXX. After falling behind on taxes, it was made good in a court action, to which back taxes were brought current in a chapter XXXX proceeding. In the repayment plan, XXXX XXXX XXXX. also collected over {$17000.00}, {$12000.00}, and over {$5000.00} in lump sums, in addition to my monthly payments of {$2000.00}. Now that everything was current, while in court, the Trustee also approved the Payoff Application that I made to XXXX, while we were in Court XXXX agreed. Only it was a Ploy/stalling tactic to move out of the " Eyes '' of the law. After court, XXXX resumed taking monthly payments, but XXXX NEVER resumed sending the official " Statements '' as required by Law. None of the Lump sum totals Mentioned above are reflected on our loan account from XXXX, after I requested a summary of my account with them. In XXXX, I paid an undertaking of {$10000.00} to XXXX XXXX XXXX office. Now, this lump sum, I was told by XXXX XXXX XXXX office that this Lump sum was going to be applied to the Balloon payment becoming due XX/XX/XXXX. Again, the facts relating to ALL the Lumps sums paid were hidden and NEVER applied to my account. Even with the breakdown of specific fees relating to attorney fees and related court cost, none of my lump sum payments are posted on my account. I have ordered the bank records and the chapter XXXX & XXXX records. Subsequently, XXXX record does not reflect payments made through the Chapters either. In XXXX, XXXX transferred us while officially in the midst of a Modification. IT is worth mentioning again, XXXX continued to accept monthly payments, but a XXXX Workout Specialist verbally said they didn't know what to do with my account because after XXXX XXXX, XXXX they were not obligated to send out " Monthly Statements. '' I was confused by this because I felt I should know how the money that I continued to send, was going to be applied. In XXXX XXXX, I was sent notice of an upcoming transfer to XXXX XXXX. XXXX XXXX, never sent any documentation of any to our residence. Nor did XXXX continue with the Modification application. In a matter of 8 months, XXXX transferred the Debt to XXXX XXXX with notice. Ever since then, No one has given us an documentation that reflects an accurate record to include ALL of the above amounts paid. Moreover, Its like a Con-job/SCAM more than anything! I have been finically harmed and deceived, plus subjected to harassment! West Coast Serving has never provided me with servicing. In fact, Section 5 of RESPA ( 12 U.S.C.S ) 2605 gives the consumer rights. Given the laws on the books to protect consumers, it is my legal right to submit as truth and fact, that I was never given any proper/official Not of Transfer as required by law. West Coast Servicing, XXXX XXXX, and XXXX XXXX intentionally violated the law and must STILL be held to accountable to the Law according to Section 6 of RESPA. Further, the law provides for damages and cost for individuals where Servicers are shown to have violated the requirements of this section according to transfer Practices and Requirements. Please note, West Coast Servicing has never sent any documentation reflecting ANY of the above payments previously made to XXXX. It is my firm belief and testimony that XXXX has never correctly applied money paid to their representing attorney XXXX XXXX XXXX XXXX, and further the additional monies paid thereafter up until XXXX, and in XXXX, we prepaid our property taxes. Now, our property taxes are once again delinquent. Plus, we are experiencing roof leaks from the serve weather and our heating unit is in need of immediate replacement. Since all the repairs are costly, We are stuck between a rock and hard spot because we need a home equity loan to address all the repairs needed that's also long over due. West Coast Servicing and XXXX have violated the Fair Debt Collection Practices Act.

In XX/XX/XXXX I stopped making payments on the second loan, when I purchased the house back in XXXX I was sold an XX/XX/XXXX home loan, and told I was told I could refinance two years later. After XXXX the property values started plumming and both loans started adjusting as they were both fixed for two years and 28 variable if I am not mistaken, both loans adjusted to 11.50 % making my house payments over {$6000.00}, I made payments but around XX/XX/XXXX I no longer was able to keep up as my income was not the same. After the modification of the first loan I would go into the Bank at my local branch and make my payment, I asked about the second loan but the teller told me that nothing was coming up under the loan number. I figured the loan was forgiven as I was told, ( no documentation was ever given to me ). My loan was transferred from XXXX to XXXX XXXX XXXX XXXX XXXX XXXX the second disappear for about a year, and then out of nowhere it appeared again, I was never told of the transferred all I got was a monthly statement for maybe three months? and then it was transferred once again to a collection agency called XXXX XXXX, XXXX. I negotiated a payment plan with them, they offered me to settle the account for {$36000.00} but I did not have that kind of money. I started making {$300.00} payments a month I was told they would be reporting my payments to the credit bureau but they lied to me, they never did, I do not know where the {$300.00} a month that I paid for a year went to, I was given no paperwork to sign nothing so I stopped the balance did not go down at all. Then at the end of XXXX XXXX XXXX sent us a Notice of Default, I believe they filed a lien on the house as I do not think there was one for the second loan. Then the sale date arrived. I begged for a modification, instead, I received a forbearance where they added all the interest since XXXX and late fees from XXXX they asked for $ XXXX down and payments of {$870.00} I can not afford that type of payment and I have a sale date on XX/XX/XXXX In XXXX XXXX finally finalized a loan modification it took about a year at that time the Bank told me that the second would be forgiven as the property value fell to 60 % to what I purchased the house West Coast mail out the forbearance plan, not a modification as we asked on XX/XX/XXXX which we got on the XXXX and they gave us until Monday morning the XXXX of XXXX to give them the deposit of {$5000.00} and signed documents but I do not know what I was signing, all I know is that is not good. I still tried to make a payment for the deposit but they declined to take my payment because is past XX/XX/XXXX. I want to keep my house my fiance has a College student that is doing College from home. Please, please do not sell my house.

In XX/XX/XXXX/XX/XX/XXXX I started my own business. I lived in a condo with a mortgage. I applied for and received a Home Equity Loan from XXXX XXXX in order to finance my business. At first I was able to make the payments because business was still decent. The recession hit really hard and I lost almost everything. I had to declare bankruptcy but was just barely able to keep my condo. It was terrifying and exhausting. XXXX XXXX sold my loan to some bank in XXXX ( I have the details at home but am trying to type this out at work while I have a moment of spare time, I 'm sorry - I can add the details! ). I contacted that new holder of my loan and they told me that I did n't have anything to worry about - they were n't trying to take my condo - and they were simply going to hold the loan without charging interest or requesting payments and they would just take the money they were owed when I sold the condo. This " business loan '' was the only thing I was n't able to relieve myself of in my bankruptcy. That was years ago - and NOW there is a company ( West Coast Financing ) who apparently bought the loan and is now demanding payment PLUS and exorbitant amount of interest ( WAY more than I ever agreed to and WAY more than the original loan ). I ca n't make the payments and I never agreed to this. Now they have a local attorney who is taking me to court over this! There is a date set for later this week or next. I do n't know what to do. I do n't know who to turn to over this and I need advice as soon as possible. I do n't want to be take to court again over losing my business. My original mortgage was with XXXX ... everything about the loans I received was quintessentially everything that went wrong with all of the banking that caused the recession. I feel like I 'm still caught up in the teeth of the ramifications of easy lending and now very predatory practices. I never agreed to any of these terms! I think they want to foreclose on my condo - the only thing I was able to salvage after so many years of loss and hard work. Please Help!!!

I have made my payments to West Coast Servicing on time and in the correct amount. West Coast Servicing has notified me that the terms of the loan have changed and that I have/had no say in the terms of the loan. The loan is not collateralized and West Coast Servicing has informed me they intend to foreclose. I have contacted them and asked for mitigation of the loan. They have not responded to me other than sending monthly statements which do not explain the charges. I have written to them offer a payoff amount and they have not responded to me. I would like to draw your attention to the fact that West Coast Servicing has not been compliant in the following ways : 1. The servicer must establish or make good faith efforts to establish live contact 2. The servicer must inform the borrower about the availability of loss mitigation options 3. The servicer must assign personnel ( which can be one or more persons ) XXXX to the delinquent borrower, or an authorized agent of the borrower, who will be available via telephone, immediately or in a " timely manner 4. The personnel assigned should be able to respond to the borrower 's inquiries and assist the borrower with available loss mitigation options 5. The servicer must enclose a separate page with the periodic statement or in a separate letter : including the date the borrower became delinquent 6. The servicer must include an account history covering the period since the account was last current or for the last six months, whichever is shorter, and showing for that period the amount past due from each billing cycle and the date on which any payment was credited as fully paid ; 7. If the borrower does provide any information that would be evaluated as part of a loss mitigation application, the provision of the information IS an application. 8. the servicer must review the loss mitigation application to determine if it is complete. There was no Good faith efforts to establish live contact with a borrower generally consist of reasonable steps, under the circumstances, to reach a borrower. There were numerous Servicers/Debt Collectors, starting with XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX XXXX XXXX West Coast Servicing XXXX and without any written notice, now XXXX XXXX XXXX. The truth is the 6-year statue to file a foreclosure in New York State XXXX had legally expired. Only the Judge in this case granted the Plaintiff 3-extensions altogether to file this expired foreclosure. The extraordinary financial costs added additional filing fees 3-times, additional lawyer fees, additional interest fees, and additional lates charges, which all of these additional foreclosure costs, were unfairly accumulated at the expense of me, the homeowner. The Judge without my knowledge, at the request of Servicers, the Judge appointed/installed a Guardian Litam, who accepted Service, and then a foreclosure judgement was entered by default. The Guardian Ad Litam was inappropriate, and unauthorized, and to the complete benefit of the Plaintiff, which tilted everything in the favor of the Debt Collector/Attorney 's. The results of the Judge inserting the Law Guardian was epic, inappropriate with negative consequences to the homeowner ( s ) and it was legally improper! I am not impaired, incapacitated, or in the military. This appointment was improper

Someone took out a fraudulent loan against my property in XXXX of XXXX {$5400.00}. The loan was never repaid so a lien was placed against my property. The original company XXXX XXXX has gone out of business. Since then West Coast has picked up the debt attaching their name on to my title. I addressed this years ago during the purchase of my home. At the time, the 3 credit bureaus removed this from my credit. I thought this was resolved, until i placed the home for sale. The closing attorney notified me. I have been in contact with XXXX asking for documents. The only thing they sent was the demand letters, and the contract from XXXX that was singed fraudulently. All but one of the documents provided where mailed to XXXX XXXX XXXX, which I moved from in XXXX. They know that I am in the process of selling the property so they have requested a payment of {$26000.00}. I offered them {$3000.00} just to move on with the sale of my property. XXXX is not trying to work with me. I have filed a police report as they instructed. Now they are asking for me to share with them my HUD closing documents. I feel i am being exploited. I have spoken with so many different agencies regarding this. Everyone is giving me the same advice, " This should be removed '', but no one is enforcing it. My home sale is due to close on XX/XX/XXXX. I can not move forward with this pending. PLEASE HELP ME. How is this legal?

In my initial complaint to the CFPB I pointed out that the investor WEST COAST Servicing Violated TILA/HOEPA by FAILING to provide me with ANY notices and disclosures of the rate adjusting periodically in violation of 12 C.F.R 1026.20 ( c ) and ( d ) at least 210 days before the adjustment took place as dictated by the CFPB. My rate adjusted in the life term at least 10 times and WEST COAST SERVICING and prior investors not once sent out 1 SINGLE Notice of this. Furthermore, in the discovery documents West Coast sent out in response to the notice of information and error the aforementioned documents evidencing this were not found. West Coast has not produced this to me nor have they addressed this in any of their responses to previous council, myself, nor the CFPB. This is a defective loan with many inaccuracies and it doesnt seem like West Coast s Attorney XXXX XXXX is advising their clients appropriately letting them know the liability here and future legal issues. Once again, I am asking for a response on the aforementioned violations. If West Coast continues to claim that my aforementioned claims are False then please provide the pertaining documentation ; specifically the rate adjustments notifications that should have been sent out. These were NEVER sent out and that is a FACT.

I Had a home equity loan with a bank that something happened to 2008 call XXXX XXXX I stopped getting payment notices, for a couple years then I received mailings from entity call XXXX XXXX and I talk to a male from this entity asking that he show ownership of the said loan and I never received any documentation, then I got a notice from XXXX XXXX saying that rights where transferred to " West Coast servicing inc. " they are saying I owe late charges totaling {$3100.00} I never had any loan information or numbers etc I have only been threatened by this entity. this has never been on the up and up they never gave me payment slips or nothing. now they have found away to get a trustee to file a notice of default. I never had any information on this loan. I do n't even know if they have a legal right or chain of custody or ownership of this loan. I filed a complaint against them 4 years ago and was told they were n't in your network and you where turning it over to the federal trade commission for prosecution. how is it fair to turn up after so many years and tell me I owe late fees? I always intended to pay my debts if owed but this is not right how they have dealt with this problem. I have only wanted to be treated fairly but this has been a night mare!

I filed an initial complaint to the CFPB on XXXX 2019 and on XX/XX/XXXX West Coast 's response to the CFPB a government agency was that they are eager to reach a mutual agreement to put this matter to rest yet a week later on XX/XX/XXXX they filed a motion to continue to foreclose on my house and a motion for relief on the Automatic stay with clearly full intentions to foreclose and collect their profit without a reasonable doubt. West Coast purchased my note for pennies on the dollar in 2019 and have refused to disclose that dolor amount. They are predator investors dedicated to pray on consumers with equity in their homes. The Chief judge denied their motion 100 percent. West coast has lied time and time again and this is just one more of the instances in where the evidence shows they contradict their own statements and have now provided False information to the CFPB a government agency. A full trial is much needed for this claim to be disallowed entirely. I have attached a copy of the status report filed on XX/XX/XXXX from West Coast and their council with their motion to request to foreclose and motion to lift the Automatic Stay on my home.

I found out through the fraud investigator a XXXX XXXX that someone impersonating me called their customer service department and asked for a loan payoff on my first mortgage. When asked to verify that it was authentically me calling, they gave the last four digits of my SSN to the customer service representative at XXXX XXXX. The person impersonating me asked to have loan payoff faxed to them at XXXX. This fax incurred at {$15.00} charge on my account that I had to fight to take off as I never called XXXX XXXX for a payoff statement. This required me to freeze my credit reports and file a criminal complaint with XXXX XXXX XXXX for ID theft and fraud. The person impersonating me has been identified as West Coast Servicing out of XXXX XXXX, CA. They are a loan servicing company that was hired by the noteholder on the second loan on my house. They wanted this information to use against me for financial gain.

wanted modification on mortgage had to get mediator then when asked for modification was told they would but only to raise exisiting loan amount then was told to give deed in lue and given 3 months to vacate home they keep changing fees during payment amount every month they are private invester are there laws the same as every other company.Any way i was working when i became XXXX and lost wages and had to go on XXXX know my income dropped by over half my pay days so i was trying to get payment that was in range of my XXXX but was told that that was not possible and to catch up on past revenue they had me at XXXX in the rears and wanted it up front, who has XXXX laying around anyhow they were supposed to give us XXXX to keep house up and help us find new place to live there is really nothing out there in range of my monthly income what do i do know.help

Mortgage was approved for 2MP program in conjunction with my current and in good standing HAMP modified primary mortgage. Instead, the bank sold loan without any notification to borrorlwer while the loan was supposed to be in the process of modification. As per HUD 2MP program. Loan was " lost '' for two years with no communication even attempted with the borrower during that time. Borrower did escrow modified payments on her own, believing that the loan was being modified as was promised by lender. Loan re-surfaced 36 months late with a new servicer who had made no communication attempts with the borrower, already in foreclosure with a sheriffs sale scheduled. Please help. This is our home and where we are raising our children. please help us get what HUD already assured us was in the process of being done.

I am writing this complaint to address the fact that I did a modification with my previous lender ( XXXX XXXX XXXX, XXXX ) 3 years ago who sold the loan to the current loan servicer ( West Coast Servicing ) ; when the modification was finalized the balance on the account was brought current. I have been working with West Coast Servicing and gave them proof that the loan was brought current from the modification and they are insisting that I owe them XXXX dollars. Please see supporting documentation that I have been making all payments for 3 years and the account is brought current. Included in the attached are the paid checks for Year XX/XX/XXXX and XX/XX/XXXX and XX/XX/XXXX and XX/XX/XXXX are available through West Coast Servicing because I submitted those statement directly to them.

West Coast Servicing took over our 2nd mortgage last year from about 5 lenders before them. They have file proof of claim as the owner of the loan. However, we have no contract with them and wanted to know if they are a legitimate company. They have filed a Notice of Default and continue to charge us interest and fees starting from XXXX. We have filed bankruptcy and is pending confirmation. However, the fees and interests are piling up causing us more stress. We wanted to know if they are the owners of the loan, and if so how they acquired the loan last year and what steps did they do to offer refinancing or loss mitigation.

Our home equity loan was sold three times. The current owner of the loan West Coast servicing has not sent a detailed statement of the account since XXXX. The only correspondence we receive are delinquent notices with a lump sum that is due ; there are no details of the charges or recent payments to the account. I recently sent a request for this detailed information because I do not believe this amount they are requesting is correct. I wil attach the last full statement that we received from them dated X/XX/2016, and the subsequent delinquent notices that they send.
