In XXXX-XXXX I attended college at XXXX XXXX University. I took out co-signed loans to pay for college. Upon graduation my degree did absolutely NOTHING for me to help me secure a job. In XXXX according to XXXX two debt consolidation loans were created. These loans have reported to my credit report since after being charged off and reported to the federal government as bad debt that is not collectible. They were since removed from my XXXX report ( XXXX ). In XXXX these accounts were added back to my account with updated history stating I was late on the payment in XXXX with no other information being able to be provided from XXXX-XXXX. I refuted these again, and AGAIN they were removed from my account. Yesterday, XX/XX/XXXX these accounts were reopened again with account history being updated from 5 years ago to XXXX. The XXXX XXXX XXXX XXXX XXXX XXXX has no account information on these from XXXX-XXXX yet has gone in back dated there information by 5 years without any rhyme or reason. 7 years after leaving college I still do not have a job that supports me being able to pay a dime on these loans. Additionally my mother had agreed to consolidate my loans into a parent plus debt consolidation in the upwards amount of over {$100000.00}. This company is claiming these are separate from the {$40000.00} they are trying to come after me for and have since reported that I owe more money for these loans the longer they go on unresolved. They have since come after my mothers credit report and mine several times after verifying that they can not prove that these loans soley belong to me. I can not currently even afford to live on my own thanks to repeatedly fighting with XXXX over the years requesting they remove the loan information from my account. I was promised after 7 years the loans would automatically fall off my XXXX report. After 7 years went by I was then told it would automatically fall off after 10 years. After 11 years I called to complain that the loans were not removed from my XXXX score and they told me I needed to file a dispute in order to have them removed but as assured after 10 years they would fall off. Instead they came back to me and told me they would post them on my account for an additional 10 years because I disputed them. In XXXX I was found to have had a XXXX XXXX in front of a court and hospitalized because these creditors refused to remove the accounts from my report. The education I was promised to help me get a job that could pay my bills and someday own a house in no way lived up to its side of the bargain. Instead it has left me close to living on the street due to the credit bureau refusing to find a permanent solution to this problem. It has left me with credit reports that have since updated multiple times thanks to loans that have gone from closed to open to closed to open again with no explanation as to why. I have gone through multiple jobs because no company wants to hire someone with poor credit.The loans provided in no way held up their end of the bargain because if it was not for family thanks to these loans and the policies and procedures the credit bureaus adhere too I would be homeless and on the street. XXXX has confirmed that even tho a loan is closed and removed from my credit report ( in the case of XXXX XXXX ) that XXXX has the right to create a new account with the balance as many times as they wish. The Bureaus have no accurate information on these loans as is reported to the credit bureau 's and have reported incorrect data DOZENS of times such as last paid date ( states XXXX on my file yet when I call I am told something different ), the date of which these loans are to fall off ( I was promised both 7 years and 10 years, meanwhile 11 years passed and they refuse to remove the accounts even with no verifiable history on them ), the amount of days late ( they have reported 5 years after the fact that I was late back in XXXX after reporting for YEARS that I was on time with my payment ), and the amount they claim I owe them constantly changes where as they have told me even if I were to make a payment on these this month the next month I would owe more money. I can not afford to pay for fraudulent information nor can I justify paying for something that negatively harmed my life. MN has a 6 year statute of limitations on loans that XXXX and this creditor refuses to acknowledge. According to XXXX there is a 7 year statute of limitations for the credit bureaus to report loan information and according to XXXX the info should automatically fall off when in fact I have proven this to be a lie on their companies behalf. XXXX now has reported to me going on 7 months that they have system issues and refuse to let me login to dispute any information on my credit accounts. This is a problem because an account with XXXX was paid off in XXXX by a family member that was found to be a duplicate account was reput on my credit report earlier this year with a collection company after previously being removed and found to be fraud. When I emailed XXXX XXXX they replied to me twice and told me it was an internal issue with XXXX confirming they had two accounts setup for me under the same email address. Also reported to XXXX was a collections account for XXXX XXXX VISA that I refused to pay because the products purchased with the credit card were defective, that company was then bought out by XXXX XXXX XXXX and the debt was transferred to a 3rd party collections. When I contacted XXXX they told me they have no control over what is reported to the collections company. When I contacted the collections company they refused to remove the account from my credit report without paying off the account. When it was paid off they still refused to remove it and dinged me 1 point on my credit score saying I am on a paid as agreed method for {$0.00} on a {$0.00} balance. The only reason I paid this was because both XXXX and the collections company told me no matter what they would not remove the negative information from my report even if I was right in stating the products purchased are defective. On top of this account XXXX XXXX claimed I was late on multiple payments on a joint account. When refuted MULTIPLE times I was placed in the hospital as a XXXX XXXX XXXX XXXX. Years after the fact after obtaining a copy of the joint creditors report proving that the information did not add up they agreed to update the " late payment '' claims on the account. Years. Years I had to suffer with a poor credit report for them refusing to acknowledge that their system was reporting inaccurately until the federal government bailed them out. My problem is with XXXX, XXXX, XXXX, & XXXX. I come to work every day as early as I can, I follow all laws, and do everything I can to do the right thing in every situation. Why is it fair that these credit companies can control my life without following any rules or regulations? Under Minn. Stat. Ann. 541.01 et seq. there is a 6 year debt statute of limitations yet these companies continue to think they can resell consumers private information ( XXXX XXXX & XXXX XXXX ) and label it a new account started at a later date and report negatively to the bureaus. The courts don't allow it, why are the credit bureaus allowing it? In XXXX I received a call after my business was sold and moved to a different location after doing multi-millions of dollars in sales and I received a call stating my student loan debt would be 100 % forgiven. I have been working for the XXXX XXXX since about that time indirectly, directly, as a XXXX, with XXXX XXXX, with XXXX XXXX XXXX, and per the reports to XXXX XXXX was under the impression that these loan accounts were completely removed & closed out. Prior to CKS Financial reporting to the credit bureaus my XXXX score was XXXX. That is what I expect it to be at but instead this bureau is reporting different account information each day for the accounts in question and refuses to make the companies reporting the information prove beyond a reasonable doubt that the information reported is inaccurate. Instead I am told I need to prove beyond a reasonable doubt that these accounts don't belong to me and even after doing that the credit bureaus are allowing these companies to reopen new accounts to negatively influence my credit scores. This is not right. Like anyone else I deserve a fair quality of life and have a human right to be able to live. Instead currently these credit bureaus are stating if you don't like it talk to the companies directly, and if you don't like their response too bad because anyone anywhere can report your information as negative and without working with the person reporting negatively there is nothing that they will do about it. Where is the consumer protection here?

The following is my initial complaint in reference to CKS Financial a company that XXXX XXXX uses to collect a debt. On XX/XX/XXXX I received a phone call from CKS Financial Debt Collection on behalf of their current creditor XXXX XXXX XXXX, and original account XXXX, in reference to a credit card/loan ( I am still unsure what kind of debt ). The first representative ( who called ), XXXX ID # XXXX, automatically demanded that I pay the debt and became very argumentative. I told her I was not familiar with the debt and requested they provide me with paperwork in reference to the debt. She refused to send any paperwork and would barely allow me to speak. I asked for a manager, which I spoke with XXXX ID # XXXX, who actually listened and I advised I was not familiar with the debt. I did again asked for paperwork and she advised she would dispute the account, as I was telling them it was not my debt. She did state that they had my address as living in Indiana, which I advised further proved that the debt did not belong to me, as I have lived in GA since XXXX. I also informed her I have had issues with my information being stolen in the past, which is why I currently pay for credit monitoring service and I have a fraud alert on my credit account, through XXXX. She never answered my request for documentation, but only provided me with their account number of XXXX. I thought the issue had been resolved, but Friday, XX/XX/XXXX, I received a letter from CKS Financial advising of the debt yet again. This surprised me as I thought everything had been resolved. On Monday, XX/XX/XXXX at XXXX XXXX., I called CKS Financial ( XXXX ) and initially spoke with XXXX XXXX, who again requested a payment and when I advised her that my information had been stolen, she transferred me to her manager. The manager did provide me with her name, but I was too slow to write down the name, when I asked for the name the manager refused to give me her name or ID number. Stating " I already gave you my name, I do not have to tell it to you again. '' This manager was very disrespectful and argumentative, to such a degree that she made snarky comments and sounds. I advised her she was being disrespectful and all she would say was " that is how you see it, but I do not think that I am. '' While I continued to request for her information, I also advised I would file a police report, in reference to my information being stolen. I asked if this would help them, which she refused to answer my question. I asked what else I needed to do to prove that the debt was not mine, which she stated " I don't know, do what you have to do. '' Baffled with this answer and her increase level of disrespect, I did commence to lose my patience but I was never disrespectful or raised my voice. Also, her increased level of disrespect occurred when I refused to advise or confirm who my employer is. As I was still talking, she heavily tried for me to hang up the phone and when I refused, as I was trying to understand the process and obtain answers to my questions, she transferred me back to XXXX XXXX. I asked why the manager had transferred me back, and XXXX XXXX stated she could not answer the question. I asked if the police report would help the, which she also stated that she was unsure. When I asked what I needed to do to prove that the debt was not mine, I was advised by XXXX XXXX " I truly believe the debt is not yours, but maybe you know who opened the account in your name. '' I advised her that I did not know who did such a things, which is why I was speaking to all of these representatives via phone. I asked for documentation of the debt to provide as part of my complaints and police report, which I was told they would not provide me with any paperwork, as they do not have to by law. I also asked for the managers information, but was told she would not provide me with that information, but that she only had one manager and everyone would know who her manager was. Since speaking and obtaining no help from CKS Financial, I filed a police report with the jurisdiction I reside in, XXXX XXXX, Georgia. The case number is XXXX. I will be attaching the document to this complaint. The following is their response : Thank you for the recent notification of the complaint filed by XXXX XXXX. The result of that investigation and our response follows. Our investigation included a review all outbound and inbound calls. CKS does not take lightly, the complaint of unprofessional behavior by any of our representatives. In response to this concern, we will use this complaint as an opportunity to reinforce to our representatives the importance of treating all customers with courtesy and respect. Please also be advised the account in question has been reported as under dispute. Unfortunately, without sufficient evidence provided to us to substantiate your ID theft claim we are unable to investigate further. If you provide the requested documents below to support your identity theft claim, we will reinvestigate when that information is provided. 1. A copy of your social security card, or a document/statement revealing your social security number. 2. XXXX XXXX I received a generic form letter from CKS Financial in regards to a credit card debt as per FDCPA I requested proof of ownership as they were NOT the original creditor but a debt buying compan y. CKS Financial signed for letter XXXX XXXX XXXX and were considered served a s US Post Office is a legal process server. At the same tim e CKS w as also reporting this account to the credit bureaus. The letter basically stated supply legal proof of ownership and transfer of account from the original creditor XXXX XXXX XXXX XXXX to CKS and I also requested account be removed from credit reports until they properly showed proof of ownership. I also informed them all contact was to be through mail. Its now mid XXXX XXXX well over 30 days and no response from CKS no proof of ownership nothing. In mean time I had disputed account with credit bureaus basically XXXX on XXXX XXXX XXXX whom they report to but it still was reporting after 30 days and investigation finished. So I sent another letter out dated XXXX and a final letter which they signed for and received on XXXX XXXX XXXX Again asking for proof of ownership and to remove account from credit reports and to either supply information/documents or a notice from them they are ceasing collection activities along with removing account from my credit reports. I received a response dated XX/XX/XXXX stating there office is in receipt of my letter of dispute and they did an investigation and confirmed name address and amount owed and account was correct. I didnt ask them to investigate anything I asked them to validate proof of ownership they didnt. Then on XXXX XXXX XXXX credit bureaus somehow randomly deleted account from reports with no investigation pending as investigation was done XXXX XXXX XXXX ( c onfirmed with XXXX on XX/XX/XXXX EMP ID XXXX per phone conversation stating XXXX didnt remove CKS Financial removed ). Last of comunications until XXXX when I called CKS directly because for some reason account suddenly appeared again on credit reports as I get notified immediately of any changes.So I talked to 2 people and was passed down to XXXX XXXX a supervisor. This was 3rd person I had to explain what I explained above. He seemed like a nice guy I told him for a debt they paid XXXX dollars for it could cost them more an it was in there interest and mine to settle. I informed him that failure to supply proof of ownership and ignoring my first letter was a violation of FDCPA and that reporting a non validated account to credit bureaus was also a violation of FCRA. Then I told him not only once but they verified a credit bureau dispute in XXXX XXXX when account was never validated with myself or proof of ownership was supplied. This is another violation of FCRA. Then they proceeded to violate FDCPA again as I sent second letter to CKS and they responded over 30 days later with a generic form letter stating investigation done and accurate but still no proof of ownership. Then again they violated FCRA as account was still on my report on XXXX XXXX XXXX but then it was removed. Rather than argue because he was a very courteous I said can we solve this because it is petty. I said remove from my credit report and then we will settle. He state he couldnt so I then stated then you can supply proof of ownership. He then said he was sorry and said I need to call their compliance department so I did and I thanked him. So I called compliance and I got XXXX XXXX and explained everything over again to her. She seemed like a very nice lady but she was given a policy to follow which she told me and it doesnt comply with federal law. I beg any attorney to tell me different. She told me they DID NOT have to do anything in regards to letters I sent requesting proof of ownership and they were complying to the FDCPA. They only need to show proof in court. I said so you just send a bill and you expect people to pay because you can type a form letter. She again stated they are following the FDCPA. Just kept repeating and stating that they are following policy. Whos? I stated the law and facts she just kept saying we arent required to send anything unless we are pursuing the debt or taking legal action which we arent doing. So if you arent pursuing then why are you reporting. We still own the account. You havent validated I said she replied we dont have to. I said its Illegal to re port a debt on credit reports thats not validated then to remove and then to put back on 5 months later. She replied we investigated with XXXX XXXX a dispute you filed with credit bureaus. Thats all we are required to do. I dont know why XXXX removed you have to talk to them. I did as stated above and she lied. As I said I disputed in XXXX XXXX CKS confirmed without validating per conversation with XXXX on XXXX / XXXX / XXXX . The letter I received from CKS was dated XXXX XXXX XXXX well passed closing of investigation and the reason why I sent request for validation a second time because they were reporting still. CKS has a policy that totally contradicts the FDCPA and the FCRA. They are NOT the original creditor. Then I stated Id like to get this resolved she said sure Ill tr ansfer you and you can make payment. I said ok then you are going to remove account from credit bureau reports. She said they cant do that because of policy with credit bureaus. I said there is no law stating you cant remove she said XXXX poli cy. ( Wron g again when I called XXXX on XX/XX/XXXX as stated above I was told there was no policy they had that the furnisher of information can remove information at any time especially if account hasnt been validate with consumer as that puts XXXX now liable for damages for reporting an unvalidated account also ). CKS has little regard for Law the CPB the FTC period. So I told her I would have to pursue other means of resolving and they are in violation of FDCPA and FCRA on numerous occasions. Something so simple they could of resolved but now I think they welcome lawsuits as If im correct and I know I am as there are many court cases stating de bt collectors have to show proof of ownership and chain of ownership whether they are first to buy debt or 100th to buy. The fact that these people think they can do whatever they want is a real problem with me. This is a blatant violation of federal law but its their policy as she stated. They are not actively pursuing debt but after removing from credit reports then putting back on 5 months later which also violate cease and desist as they legally contacted me on XX/XX/XXXX when they started reporting account again and still havent provided proof of ownership. If one reads this they can figure out how much in fines not to mention damages. I request this be forwarded to FTC as I am going to forward to XXXX XXXX the IL Attorney General and the Illinois Departm ent of Professional Regulations. I dont even believe CKS is licensed in Illinois. Then if CPB does nothing and FTC fails to resolve and fine I will have no choice but to seek legal remedies which are already in the works.

Complaint brings this Complaint to resolve a question of controversy as to whether : A consumer credit account, enrolled in a credit protection program offered by the card issuer, with a live and active claim pursuant to the terms of which monthly minimum payments are made by the card issuer on behalf of the card holder due to XXXX, is delinquent for reporting purposes under the Fair Credit Reporting Act and the Fair Debt Collection Procedures Act. 2. In XXXX, Complainant applied and was approved for lines of cred upon the referenced accounts issued by the XXXX XXXX XXXX ( XXXX ). 3. At all relevant times, XXXX offered a Credit Protection Program, pursuant to the terms of which enrollees could obtain payment relief whereby XXXX paid the monthly minimum payment due to, inter alia, XXXX. 4. In XXXX, XXXX sold the referenced accounts to XXXX XXXX XXXX, XXXX ( XXXX ). 5. Between XXXX XXXX, XXXX, CKS Financial ( CKS ), a debt collector and agent for CKS, furnished information that Complainant was and remains delinquent to the sum of {$1800.00} upon the referenced accounts to the following consumer reporting agencies ( XXXX ) to be included in consumer files, to wit : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX At the time of the sale, Complainant had and continues to have a live and active XXXX claim as pertains to the referenced accounts whereby XXXX is obliged to make the monthly minimum payments due upon the same. 7. Payment arrangement was set up with debt collector on/around XX/XX/2021 for a payment of {$75.00} to be automatically deducted from my bank account on XX/XX/2021. I suggested I could call my ex husband to inquire about child support and if I received it today, I could call back this afternoon and make the payment. She told me she would speak to her supervisor to see what could be done. I asked for a contact number to call back if I could make that arrangement. She told me I could make two payments on XX/XX/XXXX ( my next pacheck date ) then proceeded to tell me that she had misunderstood her supervisor and could not take 2 payments on XX/XX/XXXX because it falls in another month and I had already missed a payment arrangement in XXXX so my arrangement was voided. I asked if there was a pay in full settlement amount that I could pay in full next month and she told me that she was already sending it to collections since I had defaulted on my payment arrangement. I was under the impression that CKS was already a debt collection agency? She stated that the collection calls will continue until the {$860.00} is paid in full. When I looked at XXXX XXXX, it shows that this account was already sent to collections on XX/XX/XXXX ( the day AFTER I had set up a payment arrangement for XX/XX/XXXX ). XXXX XXXX also does not show any previous credit card totals for {$860.00} ( only in the {$500.00} range for the credit card they are supposedly calling about ). I have never received any written communication stating the total amount owed to this company. I believe the amount of phone calls I am receiving from this company is excessive and that if a payment arrangement had already been made, there was no reason for multiple daily calls throughout the days between, and voicemails should be left regarding what they are calling about.I have since had to block their phone number due to the amount of calls I receive with no voicemail left or no one on the other end of the line when I answer. In late XXXX/early XX/XX/2020, I received a letter from CKS Financial in the mail, stating I owed " XXXX XXXX '' $ XXXXAccount no : XXXX. After calling ( XXXX ) XXXX ( listed on the letter ) and informing the representative I was not aware of the alleged debt, I was told I could not dispute the aforementioned debt verbally and I would have to submit a written dispute to XXXX ( referenced by the employee and included on the aforementioned letter ). I was contacted by CKS and they were attempting to collect a debt from XXXX XXXX. A company with a history of using illegal practices to take advantage of consumers. I explained that I do not owe this debt and the account was paid in full as part of a debt consolidation. They are reporting this debt with a false original creditor. I have attempted do dispute this and they will not put up the correct original creditor. I only assume because they know XXXX XXXX was sued by the CFPB and want to use deceiving tactics to not allow me to dispute the information on my report correctly. Upon research I found that XXXX XXXX was ordered to pay all effected consumers of the illegal practice by direct payment or account credit including credit to collection accounts. If I have a valid debt CKS would have applied this credit to my account. They basically did n't acknowledge my dispute and they continue to report this on my credit report as an original loan from " XXXX XXXX XXXX '' this is not even a real company I have researched and XXXX XXXX XXXX said they are not the same XXXX XXXX and they habve no affiliation with CKS Financial for debt collection. CKS seems to be wanting to tarnish my credit by keeping this on my report as a different lender.I do believe XXXX XXXX is not allowed to effect consumers reports do to the illegal practices. I only asked that they give me more detail in order for me to pay this debt CKS will not give me anything validating this debt and they told me that they did not and do not have to pay for detailed account information in order to attempt to collect on the debt. On XX/XX/XXXX we received a letter from CKS Financial, a debt collector. They said I owe {$1700.00} to XXXX Bank for a XXXX account. My husband and I thought it was spam because we never had an account with XXXX Bank and we use XXXX products. I almost threw the letter away but my husband suggested I check my credit report. I checked XXXX XXXX and I learned that a XXXX Bank loan was opened on my credit report on XX/XX/XXXX and my credit score has dropped by nearly 200 points. My credit score is usually over 800. I immediately submitted an identity fraud alert with the Federal Trade Commission on XX/XX/XXXX. On XX/XX/XXXX I reached out to XXXX Bank customer service and found out that it was a XXXX XXXX loan and not a XXXX XXXX credit card. They notified me that the loan application was made through a XXXX website to purchase an XXXX related product. I have not played video games in over 10 years and I do not own XXXX. No one in my family owns an XXXX or plays video games. They said they will mail us some paperwork. On XX/XX/XXXX we also reached out to CKS Financial to let them know that we are claiming identity fraud. Later on the same day we called XXXX to dispute the charge. Thankfully it was removed from my credit report by XX/XX/XXXX. XXXX Bank sent us paperwork in the mail which requested that we send them the FTC report along with proof of address during the XX/XX/XXXX time frame that the fraud occurred. We supplied them with all the necessary documents they requested. On XX/XX/XXXX we received mail from XXXX Bank. They denied our claim for identity fraud without any explanation. We intend to call them when their office opens up to try to figure out why they denied the claim and see if there is an appeals process.

I got an alert back in XX/XX/2019 from the credit bureaus saying that I had a collection added to my file? So I checked my report to find that a company name CKS Financial, put a collection on my account. No one from this company has ever contacted me before, no letters, no phone calls, nothing. ( So how are that putting information on your credit reports?? which is a clear violation of FCRA ). So I wrote them a letter from the information on my report, disputing this collection and asked for validation of this account with my signature because I have never open an account with XXXX XXXX XXXX XXXX XXXX visa or them. Now 4 months later and the account was never validated or no proof of ownership was supplied. All they do is send generic letter stating investigation was done and result show as listed on the account is correct? But were is the proof?? This is another clear violation of the FCRA. I have been a victim of identity theft two times before, and had to fight to get all of the incorrect information off my reports. What someone did then was use a similar addresses to mine and the account in question is under one of those addresses. So I wrote CKS again all certified mail, telling them that the address they have for me is incorrect, also that I am a victim of identity theft and asked them for validation / send proof of ownership with my signature and still NOTHING!! This debt/ collection does NOT belong to me and need to be removed from my credit file with the credit bureaus ASAP. CKS needs to also send me a letter stating that they are CEASING all collection activities along with removing the collection off my credit report. On XX/XX/2018 this company called me at XXXX XXXX central time. The person on the phone was laughing with someone in the background when I answered. They asked for me. I told them I was XXXX and asked them why they were calling me at XXXX XXXX. The person in the line then disconnected the call. I called the number back immediately and asked who they were and why they were calling me at XXXX XXXX. She said they were XXXX XXXX and asked if I was XXXX XXXX. I told her I was and again asked why they were calling me at XXXX XXXX. I was angry and yelling when I said this so the lady told me I could talk to them later she wasnt going to talk to me and hung up. I called them back again and got a person named XXXX. I asked XXXX why they were contacting me and why they would do it so early in the morning. She asked me if I was XXXX XXXX I said that I was and asked why they were calling me. She said they weee calling to collect a debt. I asked why they would call that early in the morning and what debt would they be collecting. XXXX tried to say they never called me this morning. I told her that was a lie and she was the third person from her company I had spoken with this morning. I then told XXXX to remove me from their system and never contact me Again. I told her I have call logs of her company calling me multiple times a day sometimes 9 times or more and with the calls now being before XXXX I want no more contact from them at all. She told me she would remove me from their system and ended the call. On or around XX/XX/2019 I received a letter from CKS Financial attempting to collect on a debit for XXXX XXXX XXXX ( DBA ) XXXX XXXX. In the orignial letter it outlined that I personally owed a debit in the amount of ( {$19000.00} ). Having never opened this account but having a long history of identity theft I looked into the account in question and called their office. I was instructed that they are a online lending company and all accounts would be opened and funded online. When attempting to discuss the matter, I was informed that they no longer had any information on the account in question. Subsequently, upon reeving this information I made contact with CKS Financial the debit collector attempting to collect on a fraudulent account. As pursuant to the FCRA I requested copies of the original application, proof of a photo id which is required according to the Fair Lending Act, and all appropriate information showing ownership. Upon submitting my detailed request to CKS Financial on XX/XX/2019 I received a letter indicating they conducted an investigation and the name and address was the same therefore the validation was complete. At this present time CKS Financial has refused to supply proof of ownership and to date has supplied absolutely nothing to validate the claim in question. Based on the information presented I have filed a formal complaint with your office requesting assistance due to the blatant disrespect of the FCRA and its laws governed to protect consumers. At this present time I have turned the law enforcement report validating identity theft along with all material facts to our legal counsel for immediate filling.

I have lost my wallet several times through out the years and XXXX day I got checks in the mail from XXXX XXXX on an account that I never opened. At the time I was not monitoring my accounts or my credit report. From this experience I singed up for a credit monitoring service and that is when I noticed this charge off from XXXX CKS Financial that I never knew about. Along with this charge there were many other inquiries from various lenders and accounts that were open in my name that I never opened. There were bank accounts and even bills paid on in my name that I never paid and services that was being used that I never used. This has ranged from loans, to cell phones and internet services that were being used in my name and the bills were being paid. On one occasion I got a text message from XXXX saying that my XXXX account may have fraudulent activity on it and I called XXXX to notify them that I do not have an XXXX account and they could not figure out how this happened. To this day there is a bill from XXXX XXXX that is being paid in my name, using my information and XXXX can not find out who the user is and why the statement is being sent to me saying that the bill is paid. There are so many things that I don't understand about this process. CKS Financial owns and account that I never opened and that is fraudulent and bills were being paid in my name and money was being transferred that I never knew about. I filed a police report that is attached and I would like to be cleared from this debt and the delinquent account to be taken off my credit report. Thank you.

Continued calls looking for " XXXX XXXX '' to collect a debt. I have had this phone number for 25 years, and no " XXXX XXXX '' has been at this number in that time. After eight calls, I called " XXXX XXXX '' ( XXXX ) XXXX on XX/XX/XXXX. " Miss XXXX '' said that she would remove my number from their calling. I asked for information about " XXXX XXXX '' and she rudely hung up on me. After receiving yet another call, I again called " XXXX XXXX '' on XX/XX/XXXX and spoke with " XXXX '' who said that she would remove my number. I asked her if the Attorney General of Texas would be interested in hearing about this case and she rudely hung up on me. After receiving another eight calls, on XX/XX/XXXX I called the number on my answering machine ( XXXX ) XXXX which seems to be " XXXX XXXX XXXX '' and spoke to an unidentified representative. I explained that I had been receiving calls for XXXX XXXX, not at this number, and the rep hung up on me mid-sentence. I immediately called back and spoke with " XXXX '' and explained the harassment, and asked her if the Attorney General of Texas would be interested in the case. She sarcastically responded " You mean that we have removed the number from our systems? '' I responded no, that I had been harassed numerous times despite telling them that there is no XXXX XXXX at this number. " XXXX '' hung up on me. I received a letter dated XX/XX/2021 from this company called CKS Financial trying to collect a debt for XXXX XXXX XXXX XXXX in the amount of {$630.00}. Per the letter, they advised that I had 30 days to dispute the validity of the debt. I mailed a response to CKS Financial on XX/XX/2021 requesting that they provide me with proper validation of this unrecognized debt. Based upon the information contained in their letter, and my lackof knowledge of an established business relationship, and or obligation withthis company, the alleged debt was disputed in its entirety, including all amounts alleged to be due and owing. To my surprise, when I refreshed my credit report today, XX/XX/2021, I see that CKS XXXX XXXX is now reporting on my credit reports across the 3 bureaus! On top of that, they listed a date of last activity of XX/XX/2021. How could their possibly be any activity on an account for which I have no knowledge of and that I have yet to receive any documents to validate this debt? How can this company send me a bill to my home and ask that I can request verification of the debt and when I do, not only did I not receive a response but the account was added to my credit report causing further damage to my credit and putting tremendous stress on me because it is hindering my ability to apply for new lines of credit. I am including all of my communication with CKS Financial, including the letter they sent to notify me of this debt and my response to them informing them that I dispute this debt.

Not only have I not received any mail showing the verifiable proofs needed to justify the accounts to be on my report, I haven't even received any letters at all stating the investigations have begun. Per the FCRA and federal law, the process is supposed to be 30 days. 130 days later, I'm still here shelling out money for certified mail with no end in sight and no results to show. This is my last option before I take this up with my lawyers and sue for full compensations and damages incurred. I asked XXXX what exactly does the company do and how and why does she have my personal information and she refused to answer what her company did. I informed her that she does have my personal information and why does she have it. She refused to tell me what the company was. At one point she laughed and still asked me my DOB and I once again informed her yes that is my personal information and how and why she has it and what exactly does the company do. I asked for a manager and a XXXX got on the phone, he called out the last 4 of my social, I again asked how do they have my personal information and who are they. On XX/XX/2019 I called CKS Financial to discuss a debt that was owed to XXXX XXXX XXXX XXXX ( XXXX Credit Card ). That day I spoke with 4 different customer service representatives on 4 separate phone calls. I had previously called in numerous times and I was told several different answers to the same question. I was concerned with this debt being removed from my credit reports and on some occasions I was told yes, it would be deleted ( removed from all 3 credit bureaus ) after payed and then on some occasion I was told it would not be deleted. On XX/XX/2019 I was told that it would be deleted upon satisfying the debt so I decided to satisfy the debt. I was told by 2 different customer service representatives that it would be deleted once it was payed and that " they do things differently now as in, in the past, this was not an option but now it is ''. I took a leap of faith and was hoping that I was being told the truth. Now, a month later and the amount is updated to " paid '', my credit score has dropped yet again due to this company reporting on the payment and after a dispute with all 3 of the credit bureaus, it has not been removed. In SXXXX/XX/XX/2020, I discovered a debt on my credit report that was not mine along with addresses, phone numbers, etc. The debt was from XXXX XXXX XXXX XXXX opened XX/XX/2020 in the amount of {$1500.00}. Since the discovery, I have called multiple times to report it as identity theft. I have spoken with the fraud dept., managers, etc. and I am always told that they will send me paperwork to fill out or someone will call me but neither have happened to this day. I then found out that the account had been sent to CKS Financial which is a collection company. They called me to try to collect the debt and I told them that it is identity theft and sent them proof with all the information they had asked for. They assured me they received everything but were waiting to hear back from their client and they would notify me once they heard something. I have been a victim of identity theft on XX/XX/2022 I received a letter in the mail from XXXX XXXX concerning an account I did not open with them. This letter says that I'm being held accountable for an account I did not open. This letter basically states that an email address that was used to open the account was mine. This is not accurate. During the investigation period, no contact with me was made and any attempts made by me to call XXXX have ended with them hanging up on me. When I filed a police report and an FTC identity theft affidavit and sent the complaint, XXXX sold this account to a collection agency immediately. A person by the name of XXXX XXXX called my work phone, which is not a direct contact line. When I returned the call they were asking me personal identity questions while refusing to identify why they were calling or who they were calling on behalf of. They were rude, and in the end threatened me and told me I had to make arrangements today to pay today. I had no prior contact from this agency called CKS financial. I am filing this complaint against CKS Prime Investments. I called their office on XX/XX/19 to make a payment of {$4600.00} as this is the amount that they were reporting that I owed on my credit report. I was told that they no longer had the debt and they provided me the number to XXXX XXXX. I then called XXXX XXXX and was told that I needed to contact XXXX XXXX XXXX XXXX to make a payment as they were now the owner of the debt. I made an e-check payment to XXXX XXXX XXXX XXXX on XX/XX/19 for the full amount and was told that this would be reported to CKS Prime. The check cleared my account on XX/XX/19. I can provide my bank statement to validate payment. CKS prime has continued to report to all 3 of my credit reports and is updating the debt as unpaid and is unwilling to update their records. I am so furious that any company can have power to mess up your lifelyhood to that extent without one 's knowledge most of the time, and they walk away free like this???. Inaccuracies on credit reports costed a lot. I stumbled on my credit report found out that a company named CKS Prime Investment claimed I own them money which I had no clue about. I never entered any agreement nor made any transactions with them. I tried calling them, no info. I filed complaints to the credit bureaus to remove the information so far, no success. I can't believe it's that easy for companies to target your life without consequences and no one says anything about it. I have no real address for this company, no manager to speak to in order to formally have this information removed from my credit report. I am against these 3 bureaus which allow such practices without reaching out to costumers. I would have never known otherwise that such injustice was hanging on my head.

I have called this company, CKS PRIME INVESTMENTS XXXX and I don't know who they are and what they have allegedly lent to me. From what I can see, they are a debt collector and not a creditor. They do not have a license to provide credit and I do not recall ever having received credit from them. They have not provided debt validation according to the Fair Debt Collection Practices Act or the Florida Consumer Collection Practices Act. They are extorting me by appearing on my credit report as a creditor that I have not paid. I do not know this company and they need to remove themselves from my credit report. They are impeding my home buying by reducing my credit score. Due to the low score, I will have to buy my rate and that will cost me extra money at the closing table. Received a call from CKS Financial this morning at XXXX XXXX from phone number XXXX. They were trying to collect a debt which was paid in full to Client Services on XX/XX/2023. After staying the debt was paid in full I the agent continued to ask me personal questions. I asked why she needed this info since the debt was paid and I would forward an email confirmation to her. She stated that collection efforts would continue until they got the payment. I told her they are not allowed to contact me again and if they do, I will sue them for the maximum amount I can recover. I was them given their email address to forward the conf to : XXXX. I believe the time of the call is outside of the allowable times for collection calls and also believe I was threatened with further legal action over a debt which has been paid. I was contacted by CKS Financial Services, LLC, on Wednesday, XX/XX/2022, at XXXX CST. I filed a previous ticket against CKS Financial Services, LLC, for contacting me multiple times and I have not received any notification, information, or validation of debt/ debt dispute information in writing or anything by XXXX Mail . I have been contacted numerous times by their company. I have received nothing in writing indicating a debt is owed. The company will call and not leave voicemails as well. CKS Prime Investments placed a collections account in my credit reports. I sent certified letters to the company using information from my credit reports informing I don't owe them, to cease and desist any further reporting and disputed the information in the credit bureaus, but it still remains. It has adversely affected my credit and reputation as a credit worthy person financially because of the decrease of my credit score since they added this to my file. I have never entered into any type of financial agreement with this company nor have I ever signed any documents agreeing to any type of financial responsibility. On XX/XX/2019 I spoke with the collection agency CKS financial. We had agreed that if I paid the account in full, the account would be deleted from all 3 of the credit agencies. I have attached a recording of myself and a representative/manager for CKS financial agreeing to submit the removal of the account. I am 35 days from closing my home and this is really hindering my ability to move forward. The only reason I agreed to pay it all in full was because they agreed to have it removed. I have been working out a debt settlement with CKS Financial. They have my cell phone number and email and I have been extremely responsive about my desire to work out a settlement with them.
