Date of incident : XX/XX/2018 My XXXX told me he had received multiple calls from XXXX ( XXXX ) XXXX and that they were looking to speak with me. I called the number and was hung up on the first attempt, I called back and a woman answered with a vague statement like " civil investigations '', I asked what company this was and she replied " Statewide '', I advised her that someone had contacted my Grandparents in order to reach me, she took my number and said she would look into it. Several minutes later the line disconnected again, I called back a third time and the man answered with a different greeting for the department I had reached, I again asked what company I was speaking to and he replied " XXXX '', this struck me as odd as the woman I was previously speaking with said it was a company called " Statewide ''. He too tried to look my phone number up and when we couldn't find it under my number he tried my Grandparent 's number, he asked me if I was XXXX XXXX, I advised yes and he transferred me to my caseworker. My caseworker, Investigator XXXX with the Finance and Fraud department, immediately started the call by telling me that he " Would NOT, I repeat NOT violate any FDCPA laws '' because he says that they monitor collection companies. He then went on to tell me that he was calling about an account that had an original amount of {$750.00} and that the account had been sold to seven different collection agencies, three of which were sister companies which is illegal. He advised me that these people had said that they tried to send me mail to an incorrect address and that as a result this balance had accrued interest of over {$4000.00} and that it had resulted from a wire transfer to my bank account and that due to the fact that I had subsequently defaulted on the loan after several payments under statue this and code that I had committed wire transfer fraud. He told me it was a good thing I was contacting him because he was " just about to find in favor of the plaintiff. '' I told him that he was using a lot of jargon that I found confusing and terrifying because I am not a criminal, I asked him if I needed to retain a lawyer for this conversation and he immediately went on the offensive. He conference called the local court house, the XXXX XXXX XXXX XXXX XXXX Utah and asked them how much it would be to have me served with court papers and how much it would be to file with them, he was advised by the woman at the courthouse that he would need to call the XXXX XXXX as they don't deal in small claims anymore. She provided him with the contact number and the exited the call. He never called the XXXX XXXX at that point, instead he lead on with " As you can see this can be very expensive, we can also add travel expense costs to have you served to the balance of the debt which could mean that amount would end up being between $ XXXX {$8500.00}. '' I advised him that I don't have that kind of money, I don't have any money as I haven't worked a full time position in over a year due to the fact that I'm a single Mom and that as a result I've been considering bankruptcy because my financial position is so strained. He told me that I shouldn't have advised him of that over the recorded call but he never advised me as to why. He immediately asked me if I wanted to go get my lawyer or if I wanted to work with them, if I could afford to go get a lawyer then obviously I could afford to pay this off. I advised that I didn't have money to do either and that if I did obtain a lawyer it would obviously have to be through one of my parents, he asked me if I wanted to handle this honestly because he's trying to help me, he has no guarantee of what the state will do if they pursue with filing a charge against me for wire transfer fraud. He advised me that talking to him is " a privilege '' not a right. He advised me that he would let me make XXXX payments of {$150.00} and that once I started making payments I would receive an email, I asked him if it would have information about the original loan seeing as he still hadn't told me anything about the loan other than that it was originally {$750.00}, had been sold to seven different agencies, three of whom were sister companies. He advised that after I made payments I would receive a pay off letter with that information on it. I was still terrified so of course I gave him my information. He provided me with a case number ( XXXX ) and told me that I would need to keep this on me for the next 24 hours in case I was stopped or went through a check through point so that I could give the police officers that case number and they would know what it meant so I wouldn't get arrested. After the call ended I looked up the company and found out that they've had cases filed against them in the past for abusive collection tactics. I contacted my State Attorney General 's office and explained the situation, they referred me to the FTC and told me it sounded like I was dealing with scammers. I contacted the FTC and the woman that I spoke with listened as I sobbed my way through recounting what had happened and then she asked me to calm down and think about this situation logically, she said that no debt collector is allowed to threaten any further legal action than seeking a judgement against you. I feel XXXX XXXX used tactics designed to frighten me, he misrepresented himself by saying things like " I was about to find in favor of the plaintiff '', when he is a debt collector, not a judge who would actually have the power to do so. I have never been so terrified in my life as I was when he accused me of committing wire transfer fraud and I feel like these debt collection tactics should never have to be used on anyone else.

Since XX/XX/XXXX, I have been paying XXXX XXXX XXXX XXXX {$98.00} on my paydays. To date, they have taken {$1000.00} from me and I only borrowed {$500.00} from them. On XX/XX/XXXX, I emailed their customer service to find out how many payments I had left until the loan was paid in full and the representative who responded on XX/XX/XXXX stated the following : XXXX, You had made 6 payments towards your finance fees only. You have not made any payments towards your principal balance. Upon approval we had advised you we debit the finance fees only, and if you add anything towards your principal you would have to call into the office and advise us that 48 hour prior notice before your payday. Otherwise we debit the fees, and that does not apply towards your principal.

My response on XX/XX/XXXX was : I 've been a good customer who had steadily made my payments on time and not missed one yet who is also facing more difficult times. This payment twice a month has been a burden on me.

Your website is difficult to navigate as it does not show my contract and what I printed out in XX/XX/XXXX also does n't show the installment plan. It also does n't give accurate, up to date information about how much I 've paid and what is left. Something about that does n't sound right to me.

Your response did not answer my original question- How many more payments are left?

I 've made 6 payments. 6 times {$98.00} = {$580.00}, meaning I 've already paid over the {$500.00} that you 've loaned me.

A {$510.00} payday loan ( which is the max we can borrow per state law in Hawai'i ) with a 14 day borrowing time frame would have an interest rate of 460.08 %, which would bring my final payoff amount to {$600.00}.

Anything extra will lower your next payment and the total payoff.

You can extend your loan as many times as you need to as long as you pay the minimum finance Your principal balance is XXXX and your finance fees is XXXX There is no specific amount of payments to pay off your account, as mentioned it is up to you to call in and add towards your principal balance.

Your finance fees does not apply to your principal balance, We are different from a payday loan company and we have different rules and policies on our end,.

If you have any questions call into the office and speak to an agent, When I called on XX/XX/XXXX and spoke to representative, XXXX, I was told the same thing. All of the money I 've been paying them has not gone towards my principal rate. XXXX also said that if I wanted to pay back the full principal amount, I would need to call into the office two business days before to make the change. She also told me that it would take their agency over a month to send me back my car title.

On XX/XX/XXXX, XXXX XXXX, the company that has been debiting my account twice a month on my paydays, made a deposit of {$500.00} into my bank account. The contract from XXXX XXXX XXXX XXXX as well as their website provides conflicting information. The contract states they 've financed me {$530.00} and the website is saying {$540.00}. On XX/XX/XXXX, I also received an email from XXXX, a XXXX XXXX XXXX XXXX representative, stating they could only loan me {$500.00}.

According to my findings on the Consumer Federation of America website ( XXXX XXXX XXXX ), car title loans are restricted in the state of Hawaii where I reside. Only 16 states allow three digit APR rates and Hawaii is not one of them.

XXXX XXXX XXXX XXXX is another tribally owned organization by Wakpamni Lake Community, on the grounds of XXXX XXXX XXXX of the XXXX XXXX XXXX, who I believe has scammed myself and others out of their money and they need to be put out of business as what they are doing is illegal.

I was at work today and my employer notified me they had received a fax from a company calling themselves Apex Servicing of Utah representing themselves as XXXX XXXX. The fax stated I had agreed in a court order to repay a loan to this company. I have never been to court on this matter and I am unfamiliar with the associated charges and actions. Therefore that brought up red flags. I did a quick search online for the company and discovered it was tied to several fraudulent related claims by consumers including claims of fraud from the XXXX XXXX XXXXXXXX XXXX XXXX and uses this tactic of false court proceedings as a tactic to trick employers into providing payroll deduction on unsuspecting employees. I attempted to contact the company at the number on the fax XXXX and was asked for personnel information such as social security number and date of birth which I refused to provide. I did not ask for case details but rather asked was the business licensed to operate in Alabama and what was their state licensing number with the XXXX XXXX XXXX XXXX XXXX? I asked this on repeated occasions in a call that they state was recorded. The operator on the other end stated she could not provide me that information and that they were a tribally licensed company. The company would not provide me any information and has falsely used the court system as a pun to try to steal wages through a false wage garnishment. This action seems fraudulent and illegal and I feel reporting it to the FTC since it appears this company is hiding behind tribal law was the best measure. A search of the company also revealed the following similar instance with a filed complaint XX/XX/2020 : Complaint received, file # XXXX. This company appears to be an illegal operation and trying to hide behind tribal law as a way to justify its fraudulent actions.

I took out a loan from XXXX Boulevard Cash '' back in XXXX 2015. Unfortunately, due to circumstances, I have not been able to re-pay the loan. While I understand this is a debt that must be paid, I can not make the payments right now. I have communicated that to the debt collector " XXXX XXXX '' who calls me on a weekly basis to follow-up with my status. Back in XXXX 2015, XXXX XXXX started calling my work daily and would give information to my colleagues. Since I work at a XXXX, the debt collection calls at work were inappropriate and I contacted Boulevard Cash to stop calling me at work. They agreed to remove my work phone number. However, today, I received a voicemail from Boulevard Cash at my work number. XXXX XXXX was following up on the same debt that has been pending with Boulevard Cash. I have asked for him to provide me IN WRITING with the debts that are owed. He stated on XXXX different occasions that he would and I sent an e-mail to " XXXX XXXX '' to give me the debts in writing as well, with no luck. I would like Boulevard Cash to be made aware that they CAN NOT call me at my work number. The only number that I should be contacted at is my cell phone number, which is the number they already have on file : XXXX. Thank you.

This collection company called my sisters phone number and left a voicemail. When we called them back they were stating they are a lawyer office and were going to garnish my wages for a debt from XX/XX/XXXX. When I started asking questions she said she could not give me details on the loan. I asked who she worked for and she said an attorney in Delaware. She proceeded to call me ignorant and stupid because I kept asking questions about the original company as well as the company she worked for. She informed me they would be sending information to my employer tomorrow XX/XX/XXXX to start garnishing my wages. She called from XXXX ( XXXX XXXX XXXX and when I asked for her supervisor she refused saying she is the supervisor. I advised her I have not received any information regarding this debt and I would not be paying anything until I receive proof. She again proceeded to call me ignorant several more times.

I have XXXX XXXX California. I had paid my {$500.00} payday loan in the payments they said. But of course they said all that I paid was to fees and not my loan. So I tried to stop they payments from my account. I could n't pay my rent my car or anything due XXXX XXXX cash. I tried calling them to have them give me more time. They did n't call back instead they took another payment for interest on money I had less than 14 days it was supposed to help. Instead it landed me in more debt stress and the crisis center from an XXXX. Since they took what I needed for my rent. Now they are threatening my job and harassing me. They should f be allowed to do this to people at all. I 've used pay day loans before and I pay maybe {$45.00} extra. These guys want XXXX $!!!! If I had that I would n't have needed the help. And I asked the girl that set me up. And she said no that I was even getting a discount. Horrible!!

I made them aware that a garnishment has already been made against my wages and they are still taking money out of my personal checking account they gave me a number to call their finance department who also told me that they can not do this but now the finance department wants me to send all sorts of paperwork to them. Inbox loans never sent me a notice of garnishment they sent it straight to my employer which I didnt know about until I received my paycheck and it was money missing so I called my payroll department and thats how I learned of this garnishment.

I am the employer of the employee who is named in the " debt collection. '' Additionally, I was sent illegal documents to withhold pay from my employees paycheck. Apex Services is a well known unlicensed debt collection. Fraudulently, sending what look like formal payroll deductions with out court orders to do so. I have now by email XXXX times asked that they stop contacting me at my office number as I am not in a private environment AND my voice mail is not private. The most recent call was XXXX minutes ago.
