On XX/XX/XXXX, I entered into a 30 month lease with Volvo Car Financials Services ( hereinafter Volvo ), which was scheduled to end on XX/XX/XXXX. The lease indicated that a Vehicle Turn-in Fee of {$350.00} would apply and a {$500.00} refundable security deposit was paid. I was responsible for state properly taxes. The State of Connecticut taxes vehicles based upon the vehicle being on an XX/XX/XXXX Grand List ( assessed at 70 % of average retail value ), and for vehicles registered in XXXX, I would owe 25 % of the amount due ( or 3 months ). Volvo initially charged me for {$180.00} and {$710.00} in property taxes the first amount presumably 25 % of {$750.00} for property tax from XX/XX/XXXX through XX/XX/XXXX, and the second amount for property tax from XX/XX/XXXX through XX/XX/XXXX. In a Lease Invoice dated XX/XX/XXXX, Volvo charged me for {$590.00}. As such, as of XXXX of XXXX, I had paid 27 months of property tax on the vehicle. In late XXXX of XXXX, Volvo requested that I have an " independent inspector, '' supplied by Volvo, inspect the vehicle for " excess wear & tear. '' I subsequently received a report indicating that {$390.00} was being estimated for excess wear & tear. These were for a variety of scratches that were so small that I needed the inspector to specifically point them out to me otherwise they were not readily noticeable. Moreover, when I took the vehicle into my local auto body shop, the estimator also had trouble identifying the scratches and was shocked that Volvo was stating that these were " excess wear & tear. '' While agreeing with the estimator that these scratches were insignificant, I ended upon spending {$120.00} on XX/XX/XXXX, to address these scratches. In my Lease Invoice as of XX/XX/XXXX, all 30 lease payments were indicated as being paid, and I had {$0.00} amount due. On XX/XX/XXXX, I returned the vehicle to the dealer. On XX/XX/XXXX, I received a Lease Termination Invoice from Volvo. This Invoice indicated that I owed {$350.00} for a Disposition Fee ( not disputed ) and {$390.00} for Excess Wear and Use ( disputed ) and {$47.00} tax on the two ( disputed because it was based upon a disputed amount ). Additionally, the statement indicated that I owed {$590.00} for " Actual and/or Estimated Property Tax '' ( disputed ) and that I had a credit of {$500.00}, which was my initial deposit. In at least one phone call with Volvo 's representatives, I disputed both the charge for Excess Wear and Use and also for the Property Taxes. I had already spent money to address the scratches prior to the turning in of the vehicle. Additionally, I disputed the Property Tax amount for two separate reasons. First, the {$590.00} was the amount from the previous year, and the actual assessment amount ( not known until XXXX of XXXX ) would naturally be lower because the vehicle depreciates in value from year to year. Thus, the actual amount should have been lower. Second, I only had the car for 3 additional months since the last time I paid property tax ( as noted above, I already had paid 27 months of property tax for a 30 month lease ). As such, I should have only had to pay an additional 3 months of property tax not 12 months. Based upon my conversation with Volvo 's representative, I did not believe Volvo was going to adequately address my concerns, I wrote a letter dated XX/XX/XXXX, in which I indicated that I disputed the amounts owed. At the same time, I wrote a check to Volvo for {$220.00} in full satisfaction of the amount owed. This checked was cashed by Volvo on XX/XX/XXXX. On XX/XX/XXXX, I received another Lease Termination Invoice in which the Estimated Property Tax was reduced from the prior {$590.00} to {$520.00}. Also, my check of {$220.00} and my {$500.00} security deposit were credited to arrive at a balance of {$600.00}. However, Volvo continued to charge me for 12 months of property taxes instead of 3 months. Assuming that the {$520.00} ( reduced ) amount is correct, I should have only been charged ( {$520.00} x 25 % ) or {$130.00}, which means, at the very least, that the amount due should have been {$200.00}. Considering that I had already spent {$120.00} to repair the vehicle, the difference between what I should have owed and what I already paid was negligible. As such, my settlement offer of {$220.00} ( in addition to the {$500.00} security deposit ) was reasonable. The Uniform Commercial Code ( UCC ) is a comprehensive set of laws governing commercial transactions in the United States. The Lease document does not indicate the choice of law governing the particular lease. As such, I am assuming that the Lease is to be construed under Connecticut law or Alabama law. Identical versions of UCC 3-311 are found in both Connecticut law and Alabama law, a portion of which is reproduced below : ( a ) If a person against whom a claim is asserted proves that ( i ) that person in good faith tendered an instrument to the claimant as full satisfaction of the claim, ( ii ) the amount of the claim was unliquidated or subject to a bona fide dispute, and ( iii ) the claimant obtained payment of the instrument, the following subsections apply. ( b ) Unless subsection ( c ) applies, the claim is discharged if the person against whom the claim is asserted proves that the instrument or an accompanying written communication contained a conspicuous statement to the effect that the instrument was tendered as full satisfaction of the claim. ( emphasis added ) I met all the requirements of subsection ( a ), which is that ( i ) I tendered a check to Volvo in full satisfaction of the claim, ( ii ) I had a bona fide dispute with Volvo over the amount, and ( iii ) Volvo obtained payment of the check. Referring to subsection ( b ), the " claim is discharged '' upon a conspicuous statement that the instrument was tendered as full satisfaction. This statement was contained in both the letter I sent to Volvo and the check. Therefore, under UCC 3-311, Volvo does not have a claim against me for any amount. Therefore, all indications of the charge off amount of {$600.00} with Volvo should be removed from my credit report. I eventually leased another vehicle ( from a different manufacturer ) immediately after returning the vehicle. However, I believe Volvo intentionally used these lease-end " up charges '' in an attempt to coerce me into signing another lease with them since the Volvo dealership repeatedly indicated to me that they would remove those charges if I signed another lease. Additionally, throughout the time period at issue I received numerous solicitations from Volvo. Also, they appear to have used the third party inspector as " cover '' ( i.e., to be the bad guy ) in order to insulate their dealership from their consumer 's anger over the inflated excess wear and tear charges. Additionally, Volvo appears to have intentionally overcharged me ( and likely others ) on property taxes relying upon consumer ignorance to not double check Volvo 's figures. Currently, my credit scores have taken a substantial hit because of Volvo 's misrepresentation of my credit history. I paid everything that was rightfully owed to Volvo, and with regard to the items that were disputed, Volvo took my check in full satisfaction of these debts. Based upon the law, Volvo has no legitimate basis by which to report unpaid amounts ( i.e., charge offs ) to my credit history.

My wife was a victim of identity theft some time in XX/XX/XXXX. When it was discovered at the end of XXXX, all bank accounts, credit cards, etc. had to be changed. Volvo Car Financial, like all of our creditors was advised about the theft. I have verified with XXXX that considering the theft, Volvo was supplied all its payments in a very timely manner and can supply those records. Volvo Car Financial, on the other hand, is being VERY unreasonable. Not only did they report our payment 30 days late, which was made on XX/XX/XXXX by autopay, due XX/XX/XXXX, proving that we had NO intention to stiff VCF as our stellar record shows, but they swindled us out of {$480.00}, an extra payment that they insisted we pay and now refuse to return. This is what happened : As anyone who has been a victim of identity theft knows, one only becomes aware of it over time and correcting it takes months, if not longer. Phone messages started coming in about our 'request ' to open credit cards, phone service, etc- things that could have easily been mistaken for advertisement ploys. It was only when actual bills came in the mail at the end of XXXX that we realized our identity was stolen. The thief began his spending spree early XXXX. We went to our bank, XXXX, on XX/XX/XXXX to close our account, worried that the thief would try to steal our funds, as he had already ordered a XXXX XXXX card. We called VCF to alert them, as we did ALL of the other banks and corporations that we do business with. All the other businesses assured us that they would NOT victimize us TWICE by reporting any late payments while we straightened everything out, especially our autopays. Since our VCF autopay of {$480.00} was posted on XX/XX/XXXX, we thought the bank transfer was safe, because we changed our XXXX Checking account on XX/XX/XXXX. We did not realize that the electronic payment had somehow been cancelled. As soon as we were notified by XXXX that the payment did not go through, at least a week later, I called VCF, explained what happened, and paid {$480.00} over the phone on XX/XX/XXXX, posted XX/XX/XXXX to cover the returned XXXX payment. XXXX was then changed to our new bank account and on XX/XX/XXXX Volvo received {$480.00}. On XX/XX/XXXX, Volvo received {$480.00} for the monthly payment. I received an email stating that we owed VCF {$980.00}. I called VCF because I did not agree, but paid them {$960.00}, refusing to pay the delinquent fee they imposed. This payment was made on XX/XX/XXXX. The reason I agreed to pay them was actually because we became aware that they had reported us as having a late payment which dropped our credit rating XXXX points from Exceptional to Fair. I wanted to err on the side of providing them MORE money rather than less, erroneously believing that straightening this out subsequently would be fairly easy and quick. We were also turning in our leased XXXX XXXX on XX/XX/XXXX and leasing a XXXX XXXX. We did not want to jeopardize this transaction. On XX/XX/XXXX, I called VCF to ask about our request that they remove our late payment, considering that they had more money than we owed them. I also asked them to return the extra payment of {$480.00} that they had because we were leasing a another car from XXXX Volvo on XX/XX/XXXX and we were getting the run around from the dealership and Volvo Car Financial as to who would refund our overpayment. Each pointed the finger at the other. We didn't know if they would just apply it to our new lease payments. Speaking with the Volvo Car Financial Rep after we leased our XXXX XXXX, we were told that Volvo Car Financial and XXXX Volvo were two separate entities that have no financial relationship or obligation to each other. To a layman outside of the Car Selling industry this seems odd. We also told the VCF Rep that the Business Manager at XXXX Volvo called Volvo Car Financial to ask that they remove the late payment from our credit report considering the ramifications of our identity theft and that we had been doing business with VCF for decades and never missed a payment by purposefully setting up autopay. The Service Rep at VCF said that was not possible since the XXXXe Dealership manager could not take it upon herself to call without the customer 's permission. We were actually standing right next to the Business Manager when she called VCF upon our request. So yes, she did call with our permission. Insofar as returning the extra {$480.00} held by VCF, this Service Rep told us that we would have had to ask them for a return of the money BEFORE ending the lease and leasing a new vehicle. THAT is exactly what we did on XX/XX/XXXX and were told that it wasn't up to VCF to return the money, it was up to the dealership. Turns out that this is NOT true. So yes, we asked for the return of our money BEFORE the lease ended and got no where. In the interest of fairness and justice, we asked VCF to remove the 'late payment ' status considering the extenuating circumstances. We also filed a dispute with XXXX, whose Rep told us that it was up to VCF to correct it and do the right thing. Their hands were tied and that algorithms would determine our credit score based on VCF 's decision to do right by us or not. This will impact our borrowing of money, the cost of borrowing money etc. for 7 years. Considering that we are elderly, who knows where we will be in 7 years. But that is NOT the point. This is a matter of FAIRNESS. NO ONE should be victimized TWICE because a criminal wanted to steal all of our money and then, because VCF did not have the wherewithal to realize that and NOT jump the XXXX reporting a late payment without any warning, without communicating with us, AND keeping a LOT of our money that they just STOLE from us without any justification. Our bank transactions with VFC are as follows and can be supplied upon the asking. Under UCC 4A discharge automatically takes place by law with no notice of dishonor properly given and the instrument not being returned. Payment is the discharge of an obligation by the actual delivery of money or its equivalent. XXXX XXXX XXXX v. XXXX XXXX. XXXX, CA. XXXX, XXXX. 350 F.2d652, 383 US 906. When an instrument is dishonored, notice of that fact must be given -- -- ..Otherwise they are discharged. P. 17 Law of Negotiable Instruments, XXXX XXXX XXXX XXXX. NOTICE OF DISHONOR UCC 3-503 ( a ) The obligation of an indorser stated in Section 3-415 ( a ) and the obligation of a drawer stated in Section 3-414 ( d ) may not be enforced unless ( i ) the indorser or drawer is given notice of dishonor of the instrument complying with this section or ( ii ) notice of dishonor is excused under Section 3-504 ( b ). Consumer and VCFS LIEN COMPANY, LLC, VCFS AUTO LEASING COMPANY AND THEIR OFFICERS ( hereinafter collectively referred to as Volvo ) entered into a vehicle lease agreement on XX/XX/XXXX. This lease agreement provided for a monthly lease amount of {$650.00} and upfront state sales/use taxes to the State of New Jersey in the amount of XXXX. The Consumer made timely payments every month since the lease date, except for the month in-question XX/XX/XXXX due to a discrepancy in monthly charges of which Volvo was immediately made aware. On XX/XX/XXXX, the Consumer relocated to XXXX, XXXX from XXXX, XXXX and in light of this move, a Volvo representative informed the Consumer that she was required to pay an additional {$450.00} in local taxes. The representative was not clear as to whether the additional tax was for the City of XXXX, the County of XXXX, and/or the State of XXXX. Nonetheless, the Consumer paid the additional {$450.00} over the phone on XX/XX/XXXX. Later, the Consumer received a letter in the mail dated XX/XX/XXXX from Volvo that her new monthly cost would increase to {$710.00} from {$650.00}. The letter failed to make clear as to whether this additional cost was for taxes, or some other fees and instead ambiguously stated that the increase may be due to a change in your sales/use tax. When the Consumer inquired about this letter on XX/XX/XXXX via a phone call to Volvo customer service, she was informed by a Volvo representative that it was due to an increase in taxes. The Consumer, believing the letter was written in error, then informed the representative that she had already paid the additional taxes back on XX/XX/XXXX in the amount of {$450.00}. The representative responded by saying that the additional monthly charge was due to other taxes, but did not state what these other taxes were such as whether this additional tax was for city , county, and/or state tax, or verify the tax rate and the accurate tax amount per this rate. Volvo is in a much better position to ascertain the tax rate and amount of taxes than is the Consumer since Volvo is the owner of the vehicle, is in direct communication with the appropriate governing body, and receives the tax bills. Over the next month and a half, the Consumer inquired about these supposed additional taxes and each time she was given a different answer as to which jurisdiction the taxes are owed or to even how much the total amount of taxes are actually owed. Furthermore, the Consumer was not provided a financial statement of any additional charges with the appropriate breakdowns or itemization as required by law, such as tax rate and to which jurisdiction taxes were owed. Not only is an itemized financial statement required by law, it would have been helpful to the Consumer for ascertaining the appropriate charges owed. On XX/XX/XXXX, the Consumer received an alert from XXXX credit bureau agency that Volvo reported a 30-day delinquency notice regarding a late payment in XX/XX/XXXX despite the fact that there had been constant communication between the Consumer and Volvo since XX/XX/XXXX regarding the discrepancy in the increase in monthly charges. Although on XX/XX/XXXX, the Consumer was promised by a Volvo representative that Volvo would provide an accurate financial statement itemizing all costs, including the appropriate taxes, within 48 hours via facsimile, Volvo never did such thing. To no avail, the Consumer attempted to resolve this matter amicably via 19 different phone conversations with a number of customer service representatives over a two-month period, including Customer Care Manager Ms. XXXX XXXX and her staff member XXXX XXXX. Despite these numerous phone calls and proof that Volvo failed to provide Ms. XXXX with an accurate financial statement detailing the appropriate charges above and beyond what was contracted for, Volvo failed to provide such statement and refused to remove the erroneous reporting of a 30-day delinquent notice that was reported to XXXX in violation of the Federal Fair Debt Collection Act, Federal Consumer Leasing Act Disclosures, Federal Trade Consumer Act, XXXX XXXX Consumer Fraud Act, XXXX Consumer Protection Leasing Act, and XXXX Breach of Contract laws.

Dear Volvp : I am contacting you regarding 30-day derogatory marks that appear on my three credit bureaus reported by Volvo XX/XX/2020. I dispute these and demand a full removal of the 30- day late mark based on the enacted Section 4021 of the Coronavirus Aid, Relief, and Economic Security Act ( the CARES Act ) which bars ( and makes illegal ) such a derogatory mark, subject to its terms. The purpose of this letter is to ask that the derogatory mark immediately be reported as current to the three major credit reporting agencies, XXXX, XXXX, and XXXX XXXX so that this matter be resolved amicably and without any court intervention. I thank you for your anticipated cooperation. Prior to the missed payments I attempted to contact Volvo regarding my charge card payments, albeit unsuccessfully due to hold times several hours long. My income has been temporarily negatively impacted by the COVID-19 outbreak, I have experienced severe financial hardship as a result of the economic standstill that our country is going through. Recently, and in response to the COVID-19 outbreak, the CARES Act was signed into law by the President of the United States on Friday XX/XX/2020. The CARES Act modifies the Fair Credit Reporting Act, 15 U.S.C. 1681, et seq. ( the FCRA ) by precluding furnishers of credit information ( which specifically includes all major banks ) from reporting any deferred payments, forbearances, or other missed payments during the covered period. More specifically, Section 4021 ( F ) titled Reporting Information During COVID-19 Pandemic ( the Act ) states : if a furnisher makes an accommodation with respect to 1 or more payments on a credit obligation or account of a consumer, and the consumer makes the payments or is not required to make 1 or more payments pursuant to the accommodation, the furnisher shall ... It is important to note that accommodation is defined broadly in the Act and encompasses any consumer who is affected by the coronavirus pandemic during the covered period. ..if the credit obligation or account was delinquent before the accommodation ..if the consumer brings the credit obligation or account current during the period described in ( aa ), report the credit obligation or account as current. The term covered period means the period beginning on XX/XX/2020 and ending.. 120 days after the date on which the national emergency concerning the novel coronavirus disease ( COVID-19 ) outbreak declared by the President on XX/XX/2020 under the National Emergencies Act ( 50 U.S.C. 1601 et seq. ) terminates. Here, it is clear that my missed payments comes within the scope of the CARES Act ( and specifically Section 4021 ) because : 1 ) the industry that I work in has been eviscerated by COVID-19, who has experienced significant financial hardship ; 2 ) the Missed Payment was within covered period ; 3 ) the Missed Payment was delinquent when it was reported to the credit reporting agencies ; and 4 ) I paid the account and brought it to current by XX/XX/2020. Due to the above, such unauthorized reporting on my credit reports has caused and will continue to cause substantial damages. Doing so constitutes a clear violation of the CARES Act which was designed to assist consumers during these unprecedented economic times, not punish them. In addition, violation of the CARES Act also constitutes a violation of Cal. Bus & Prof. Code 17200, et seq. Volvos actions are clearly unlawful ( the CARES Act ) and unfair ( downturn in the economy ). As you may be aware, Cal. Bus & Prof. Code 17206 permits penalties of up to {$2500.00} per violation ( which in our view, is each day that the derogatory mark appears on my clients account, multiplied by three for the three credit reporting agencies ) plus the recovery of all costs and fees. In XX/XX/XXXX, I was approved for the lease on a new XX/XX/XXXX XXXX XXXX. I made a special order for the vehicle and waited nearly two months for the vehicle to be delivered. Before delivery, the lease was approved for a second time. I took delivery of the vehicle in the end of XX/XX/XXXX. I have now had the vehicle for several weeks and during this time I have been harassed and threatened by Volvo Financial. I received a phone call from Volvo Financial after having the vehicle for one week, they proceeded to interrogate me about my income, the vehicles I traded in, who this vehicle was for, etc. The questions were strange, as this vehicle is for myself. I have evidence to back up my income and they questioned it as if they do not believe me. I have provided them with bank statements, pay stubs, tax returns, and my contract of employment, yet they refuse to accept any of this, after the fact that the vehicle has been approved and Ive had it for several weeks and put a {$5000.00} deposit down on the vehicle. The dealership I purchased the vehicle from has been advocating on my part with Volvo yet it has not made a difference, Volvo told the people at the dealership to remind me that the vehicle is not mine. I entered into a contract with Volvo and am relying on this vehicle for transportation in order to get to my job. They are threatening my ability to keep my job, which is 60 miles from my house. I make nearly {$250000.00} per year and this vehicle is well within my means. The payment on this vehicle is less than the two vehicles it replaces. I have been unjustly questioned, harassed, and discriminated against. I have been put through a very unusual level of scrutiny. The implication, however tacit, is that I am somehow lying and I have falsified my income and my pay stubs, bank statements, etc. Volvos refusal to believe me can only be attributed to the fact that I am a high earning woman and they do not believe this. I would like to know how many men Volvo has put through a similar level of scrutiny. Their business practices and the way they have treated a paying customer is absolutely appalling. I have never undergone such harassment from any company when buying a product. I have owned XXXX, a XXXX, a XXXX, an XXXX, etc, and I have never been treated in such an unacceptable manner. It would seem as though that a woman who makes {$250000.00} per year is not good enough for Volvo. If only I were a lesser earning man, perhaps that would be more believable for Volvo. Volvo should be ashamed and embarrassed of their discriminatory business practices. I have more than enough income to make the monthly lease payment of this vehicle, but it is becoming increasingly clear that it is not a matter of having the money or not, they seem to be singling me out and do not want me to have this vehicle. I have had this vehicle for several weeks now and Volvo has not let up with their demands and threats. This has been an emotionally traumatic experience that no person should be subjected to. They are unjustly threatening to take a vehicle away from me that is my only means of transportation, thus putting my {$250000.00} per year job at risk. I will not tolerate this. Volvo approved this lease not once but twice and I will not suffer any consequences due to negative actions against me on the part of Volvo. Volvo has the power to ruin me financially by taking this vehicle away from me. I am trusting Volvo for the duration of this lease to have transportation and they are abusing that trust and putting me in a precarious position. Volvo is not a company that can be trusted. Their irresponsible and discriminatory behavior must be dealt with. This is further putting my safety at risk because I do not even know if I can put snow tires on the vehicle or not, which I ordered, so I am being forced to drive around in unsafe conditions due to the winter weather in XXXX XXXX already.

We are requesting assistance resolving a problem with XXXX XXXX XXXX XXXX and Volvo Financial Services. We leased a XXXX XXXX XXXX on XX/XX/XXXX at XXXX XXXX XXXX XXXX. We signed all documents in their office, located at XXXX XXXX XXXX XXXX, XXXX WA XXXX. The next day we were informed by XXXX, the Finance Manager that XXXX XXXX needed to provide a copy of a Washington State Drivers License before the deal would fund. He asked about the license during the closing the day prior ; we explained that he did not have one. XXXX originally replied that it should not be a problem. Then, later on in the day on XX/XX/XXXX, we were told that everything was fine. However, a few days later we received a call that they actually required a copy of the license. As the State of Washington was updating computer systems and XXXX was travelling, we could not supply the license right away. When XXXX received the license, he immediately provided a copy to XXXX XXXX XXXX XXXX. We called Volvo Financial when the first lease payment was due and was told that we did not have an account and that Volvo Financial would not accept payments from us. We called the local office of XXXX XXXX and were told that we should make payments to them until the lease funds and that they would forward our payments to Volvo Financial. We made payments of {$1000.00} on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, and two on XX/XX/XXXX. We received notifications from credit bureaus that we were being reported as 30 days late by Volvo Financial around the second week of XXXX. This was surprising as we had made all payments within 30 days of the due date. We called Volvo Financial and were told that XXXX XXXX had not forwarded the payment from XX/XX/XXXX. We called and spoke with XXXX, the General Manager of XXXX XXXX numerous times. He told us that they were working on it and that they were speaking with XXXX XXXX to obtain a resolution. He told us numerous times that he would follow up with us by calling and informing us about the status. To date, he has never called either of us. On or about XX/XX/XXXX XXXX informed us that his office was refunding our lease payment that was made on XX/XX/XXXX after keeping the funds in their account for over three months. We expressed dissatisfaction and insisted that XXXX XXXX XXXX forward the payment to Volvo Financial as agreed in XXXX. We do not understand why they would keep this payment for over 90 days, just to attempt to return it to us. Frankly, we do not believe that XXXX is assisting us as he does not return calls and when he takes our calls he responds in an apathetic, demeaning tone. XXXX received an email from XXXX XXXX, who claimed to be another General Manager on XX/XX/XXXX about our interaction with XXXX. XXXX left XXXX messages in the mornings on XX/XX/XXXX and XX/XX/XXXX. We have yet to receive a response from him either. We also spoke with numerous representatives of Volvo Financial on or around XX/XX/XXXX and XX/XX/XXXX. One stated that they would reach out to XXXX XXXX XXXX and another stated that XXXX office would need to contact them. The first representative stated that the report of the 30day late payment would be removed if XXXX XXXX XXXX XXXX stated that we paid the payment in XXXX, XXXX. The second stated that the 30 day late payment would not be removed as Volvo Financial and XXXX XXXX XXXX have no relationship. We were surprised at this response and by the inconsistencies between representatives.

My wife and I leased a vehicle from Volvo Finance VCFS Auto Leasing Company. At the end of the lease term, we dropped off the vehicle at the Volvo dealer as instructed, obtained a receipt from the dealership, and notified Volvo Finance. This was on XX/XX/XXXX. We have performed all routine maintenance at the Volvo dealership where it was dropped off. The vehicle was returned under the mileage limit. In XXXX, we started receiving repeated calls from Volvo Finance that the lease had terminated and they had not received the car. Volvo continued to charge and harass us. We explained to Volvo Finance that they did turn in the car, had a signed receipt, and had notified them at the same time. Volvo continued to call and harass us, and we continued to advise the Volvo collectors that they were not correct. The Volvo collectors did not verify the accuracy of their claims. On XX/XX/XXXX, we received XXXX XXXX alerts that Volvo Finance was reporting our account as delinquent, with a negative impact on their credit scores. There was a charge for a past-due balance for XXXX in the amount of {$590.00}. We then made the complaint to the C.F.P.B. on XX/XX/XXXX. XXXX then backed off of the delinquent calls and delinquent credit reporting that they started in XXXX. It seems that the C.F.P.B. complaint did what it was intended to do to get to someone who would pay attention, rather than the erroneous information they were acting on, and refusing to correct their records. Unfortunately Volvo did not leave it alone. In retaliation for the C.F.P.B. complaint, Volvo claims to have had an inspection of the vehicle done on XX/XX/XXXX. XXXX This was the same date of the C.F. P. B. complaint Coincidence? ) The purported results of the inspection were that three of the tires measured XX/XX/XXXX tread, and one was XX/XX/XXXX tread. They claimed that this constituted excessive wear under their standards ( the XX/XX/XXXX tires ) and they decided to charge us {$1200.00}. This amount is excessive wear for three tires for {$780.00} plus {$60.00} sales tax, and {$350.00} vehicle turn-in fee plus {$27.00} sales tax. This is peculiar and improbable for the following reasons : ( 1 ) when dropping off the car no issue was identified ; ( 2 ) I dropped the car off on XX/XX/XXXX and Volvo located their car, the inspection takes place at XX/XX/XXXX ( over a month later ) and I have no way to validate what wear and tear has occurred over the last month plus. ( 3 ) We also conducted a complete inspection that was certified by Volvo ( document attached to this complaint ) establishing the car was in perfect condition and the tires had not experienced excessive wear by their own report prior to returning the car - the report clearly indicates no concerns were raised by Volvos own service department. Volvo is retaliating against me as a consumer for not renewing my lease and is acting in bad faith against consumers at-large by falsely accusing me of excessive wear to receive more money with the knowledge that many consumers dont or wont fight back. I have offered Volvo that I will pay the vehicle turn-in fee of {$350.00} as per the lease agreement, but they refuse to accept this and continue to operate in bad faith. I am writing to you to make this right and to protect me against Volvos fraudulent actions and to have them XXXX out the balance due as acknowledgement of their continued bad faith and wrong doing.

'' the offer was for 24 months new lease, didn't specify an amount to be paid at signing, and the offer expires on XX/XX/XXXX. I discussed the offer with Volvo Cars XXXX, but they didn't have a car to match the XXXX XXXX which I've leased from them. However, they gave me quotations for similar cars in case they can get one from other Volvo agencies based on 24 months new lease, and insisted on {$5200.00} at signing, because that was the sum I paid when I had the XXXX lease. However, and since my lease ends on XX/XX/XXXX we agreed to talk again after XX/XX/XXXX on he assumption that a matching car is available at Volvo Cars XXXX, CT. Eventually, on XX/XX/XXXX I returned the XXXX XXXX, and signed a new lease for 24 months at {$390.00} per month and paid {$5800.00} at signing., with the salesman referring to his Manager to give me answers and assurances that this is the best they can do for me based on the XXXX " not so clear '' offer. On XX/XX/XXXX I leased a XXXX Volvo XXXX and ended the lease on a XXXX Volvo XXXX. Both cars were covered by a 36-month bumper to bumper warranty. The XXXX XXXX was turned in after 34 months because Volvo would pay the lease costs on the final months of the lease if I leased a new XXXX. On XX/XX/XXXX Volvo Car Financial Services sent me an invoice for {$200.00} that included a charge of {$130.00} because the maintenance light and the tire pressure light stayed on ( attachment XXXX ). When I asked XXXX Volvo XXXX XXXX XXXX XXXX, XXXX, VA XXXX, where I leased the car, I was told that both items were covered by Volvos warranty. However, I had to talk to Volvo Car Financial Services since they sent me the invoice. In a series of phone conversations with Volvo Car Financial Services on XX/XX/XXXX, and XXXX the total bill was reduced to {$140.00}, a reduction of {$67.00} XXXX attachment 2 ). When I asked how they came to that amount I was told that the maintenance light/tire pressure light was taken off the bill, but I still had to pay for {$130.00}, plus tax, for the right front door. I have no issue with paying for the door panel ; however, no tax was ever charged before, so why is tax suddenly being charged. The second issue I have, is that if the {$130.00} is subtracted from the {$200.00} that I was billed, I should be paying {$73.00}. I have never been given an explanation of how the {$140.00} was calculated, only that was the amount that I had to pay. When I further questioned the amount, I was told to talk to XXXX Volvo and they should pay any difference. When I again talked to XXXX Volvo, I was told that it had been mentioned to management, but no action had been taken. I also did not receive a response to a follow-up email I sent to XXXX Volvo. Consequently, I am in a catch-22 situation where Volvo Car Financial Services say I need to talk with XXXX Volvo and XXXX Volvo says I need to talk to Volvo Car Financial Services yet both are part of Volvo Car XXXX XXXX or its affiliates or licensors ). The maintenance light/tire pressure light issue was covered by Volvos warranty. The XXXX XXXX had been scheduled for maintenance at XXXX Volvo on XX/XX/XXXX, but was cancelled when I no longer was leasing the car. I have contracted Volvo Car Financial Services XXXX times and requested quotes for ending my lease early. After I turned my car in, they requested payments after quoting me {$0.00}. I first contacted them in XXXX of 2022 after receiving mail about ending my lease early and having remaining payments waived. Subsequent contacts were made in XXXX and XXXX to obtain " quotes '' for early lease termination. Each time I contacted them, they told me " management '' would approve early termination of the lease and a decision takes XXXX business days. I was moving from XXXX state to another and my lease was set to terminate in XXXX of XXXX. I asked them how much would be due to turn-in the car versus taking it with me and shipping it across the country. Each time I inquired they forward the request to management and a turn in quote is issued and good for 14 days. I made the third ( and last ) request in XX/XX/2022 ( due to previous requests expiring and reinitiating a new request ). The rep told me the balance due would still be {$0.00}. I asked if I needed to sign anything and they told me I did not, that I only needed to turn the leased XXXX XXXX in to a Volvo dealer no later than XX/XX/XXXX of 2022 and then call XXXX back and advise the car has been turned-in, time, and mileage. On XX/XX/XXXX of 2022, I turned my XXXX car into my local dealer in XXXX Indiana around XXXX to a sales person representing XXXX XXXX ( who was on a call and couldn't meet me ). I then called Volvo Financial and let them know the mileage. I inquired with the dealer about turning the car in and if I needed to sign something and they said no. I have now received requests for payments for ; " Remaining payments : '' {$1400.00}, " Excess Wear And Use Charge '' {$130.00} and " Vehicle turn in fee '' {$350.00}. My XXXX Volvo lease was coming due in XX/XX/23. I contacted different dealerships looking for the best deal. Which was no money down, take in my current Volvo XXXX as is for a trade, XXXX XXXX miles a month, tinted windows and have my payment as close to the current monthly payment amount as possible. Two Of Volvo dealerships were able to offer that deal, however they did not have all XXXX XXXX XXXX. I saw XXXX XXXX cars of XXXX XXXX had XXXX XXXX me and girlfriend XXXX called new car sales manager XXXX XXXX XXXX him on the speaker. Told him what deal we were looking for and what we have for him as a trade. We were very specific and told him that we have two other dealerships that are offering us the deal. We asked him if he was able to match it. He asked us to send him mileage of my XXXX and VIN number. A few moments later we got a text message saying they got some good news-XXXX will do the deal! We called XXXX again asked him to email us to confirm it. He told us he was a man of his word and will do the deal as he promised. I scheduled to pick the car on Saturday XX/XX/23 XXXX. I arrived at XXXX met with my sales man XXXX XXXX I asked if he needed to see my car and test drive and look at tear and wear he said no. Shortly I went to sign my new lease papers with XXXX. XXXX XXXX and asked if I could get some paperwork from him saying that they are taking my car as trade and that I wont get any bills or invoices from XXXX XXXX. He said not to worry everything is taken care off and I can contact him or XXXX Monday and he will email me what I need. I reviewed the paperwork again in the car and noticed I did not see any XXXX per lease term listed. Went back and spoke to XXXX XXXX said it was XXXX a year. I asked him to call XXXX and fix it. He did. Called XXXX XXXX Tuesday asking for XXXX trade in papers he said he didn't take it as trade and never said he would. We told him we were very upset of his lies and deceit and will speak to someone else. Couple weeks later I received the invoice from XXXX XXXX for wear and tear of {$440.00}. I have been a long time customer of Volvo and Volvo Financial Services over the last six ( 6 ) years and three ( 3 ) vehicles. During that time, I have never had a late payment or negative mark of any kind on my credit. However, when upgrading my lease from my second lease to my third lease, Volvo Financial did not update my current Volvo Financial portal account as it had done in the past. This meant that my auto-pay settings from which all of my previous payments were made never rolled into the new lease ( as had been done in the past ) and the automated payments that I had relied upon in the past were not made. As a result, no payments were submitted for two months which lead to a 30-60 day non-payment event on my credit report. In addition, no attempt was made to contact me in order to let me know that the third lease was behind in payment. It was only when I tried logging into my Volvo Financial Portal account did I realize that my original account was deactivated and I would need to register a new account for the new lease ( a step that I did not have to take in my previous two leases ). Once I registered for a new account, only then did I see that my account was two ( 2 ) months past due. Upon realization, I immediately paid the outstanding amount and set up a new auto-pay. This new requirement for creating an entirely new Volvo Financial Portal account for each lease was not made known to me until it was too late. In fact, when I spoke to my Volvo Dealer at the time of the third lease, he told me that I would NOT have to update my Volvo Financial Portal account. I followed up with him after learning this and he and his team were completely unaware of this new requirement. Volvo Financial has been a wonderful leasing company and this situation does not change that opinion. I realize that I represent a bit of an edge case ( three sequential leases ), but still believe that I shouldn't be held responsible for a change in their technology platform impacting an auto-pay function that was set up and working for the first two leases. Hopefully, this story helps anyone working with Volvo or a customer of Volvo Financial avoid this situation.

I visited the lender 's website to determine the total payoff amount for my XXXX Volvo XXXX. In addition, called the lender, by telephone and it was confirmed. I also specifically asked about the GAP insurance refund as I am now cancelling due to the car being paid off. They instructed me to contact the dealership for cancellation, which I did. The Dealership provided me the form/instruction for cancellation ; I completed and returned to them. I was told I would receive the refund in 6-8 weeks. Upon waiting for 6 - 8 weeks and not receiving any refund, I contacted the dealership to follow-up. I was then told that they had sent my refund to the lender, and not to me because the lender requested it. When I called the lender ( Volvo Car Financial ), they told me that they received the requested refund but will not send/forward to me because the refund should've been included in my payoff amount but wasn't. So I had two questions which they haven't answered : 1. How did they know how much my refund would be, to pay off the loan if and/when they didn't know I would be paying my car off? 2. If an amount ( {$900.00} ) is charged/included in my loan for this GAP insurance for X amount of years, I pay the entire loan off early, should I receive the unused portion of the insurance cost, or shouldn't I have received that credit from my payoff balance? Neither has been done and they're refusing to give me the {$750.00} due. They're stating that the State of Maryland is a " No Refund '' State so I'm not entitled to a refund for services/insurance I didn't use. In addition, Volvo Financial Services has never would include the Principal Balance of the loan on my statement ; only the Payoff, which includes interest. I leased my first Volvo via Volvo Financial on XX/XX/XXXX. I have always paid my account with Volvo Financial online as I have been doing since the inception of the lease term. In seeking to update the history of my account with Volvo Financial I noticed I didn't have all monthly statements for my account including back to XX/XX/XXXX. I have since discovered that I can not get more than 3 last most recent leasing statements via the payment website ( https : //www.volvocarfinancialservices.com/ ). I called Volvo Financial today with the purpose of requesting the missing statements. I was told I can not get any statements other than the 3 prior consecutive months ( I can't get the XX/XX/XXXX statement today because the online system is down ). There is no way to request paper statements to be mailed. I was told by the CS rep that it is a Volvo Financial company policy not to provide any other statements and that I can't make a request for prior monthly statements because they don't exist. Every other company I do business with including different vehicle leasing companies and credit card companies allow me to access online up to 2 years or more of my monthly statements. Some allow me to request statements to be mailed that are older than 2 years, which I have done in the recent past. Furthermore, Volvo Financial should be required to DATE the monthly statements retrieved on line. None of the statements I have been able to download contain a statement date!!! The only way I have any idea when the monthly statement that I can view on Volvo Financial 's website is because of the date the available statement appears to be posted. There is no logical explanation for why a statement does not have a date reflecting when it was generated. These issues constitute a violation of my consumer rights and I want Volvo Financial to be required to provide the " missing '' monthly billing account statements. I don't believe they can not be provided ( I bet they could find them if there was litigation surrounding the debt at issue ) and because I have a right to be able get this documentation to verify for MY records.

I am lodging this formal complaint against Volvo Car Financial Services, related to an unjust credit report dispute connected to my account ( number XXXX ). Despite having an impeccable payment history with Volvo, I am now facing a damaging mark on my credit report. This stems from a disposition fee of {$350.00} that I promptly paid via check in May this year upon receipt of a requested invoice from Volvo. Regrettably, it appears that this check may have been lost in their third-party payment processing center, and my attempts to resolve the issue have not been successful. In the absence of clear communication and documentation, including the lack of a contract copy at signing, I initially found the fee surprising and suspicious. OnXX/XX/2023 I signed a lease with XXXX Volvo in XXXX for a XXXX XXXXXXXX XXXX. The salesman gave me a lease agreement ( signed by the manager ) that stated the selling price of the vehicle was price was {$57000.00} and the net CAP cost was {$55000.00} after the Federal EV Rebate and Teacher Rebate. The same day, I went to sign for official lease when I saw that the selling price is now {$59000.00} ( an increase of {$1900.00} ) and net CAP cost was {$55000.00}. I saw the price increase and asked the finance manager about it as that was not what we agreed upon. The finance manager then went to checked with the general manager, and she assured me that the reason for the selling price increase was due to the " tax on the federal rebate ''. XX/XX/XXXX I returned a XXXX Volvo XXXX as instructed by Volvo. Volvo had performed a preinspection and noted several minor repairs I should have completed before turn-in. I followed their direction and left all the documentation in the car front seat. Volvo still charged me for all the repairs. After several phone calls and multiple resubmissions of the documented receipts and pictures, Volvo finally removed most of the charges. I paid the lease termination fee of {$300.00} and a lost key for {$250.00} but Volvo continued to send me invoices each month. As you can see in the attached XXXX report the balance changed almost monthly for no apparent reason or without any clear itemization. Finally, Volvo claimed that the roughly {$390.00} was for personal property tax. Since the State of VA prorates I ask Volvo to send me a statement of the tax record. They didn't send anything other than non-informational monthly statements. recently my credit score took a big hit 100+ points. After investigating I found that Volvo had charged off {$2800.00} dollars. I have escalated this to a supervisor who claims there is nothing they can do, I ask the supervisor who would not provide his name or case/claim number. I ask for the supervisor I was speaking with for the 3rd time and he said " she '' would call me. I have received no call. I ask Volvo to update the credit bureaus with the status of the account has been paid in full. Volvo agrees it's been paid in full but refuses to report this to the bureaus or have the {$2800.00} charge off. This was a 3-year lease. Not a single payment was ever late. Hoping you can help me. I have Federal Government clearances and that charge off could prevent me from obtaining future clearances to provide assistance to our Federal clients. I had an existing lease with Volvo that was financed through Volvo Car Financial Services. Before the lease was up I was repeatedly contacted to turn the car in early to participate in a " XXXX XXXX XXXX '' where I would be bought out of the lease and get a new Volvo to lease. As part of that program, it was sold to me that it did not matter what damage there was to the vehicle or if we were over the miles. In XX/XX/XXXX we opted into that program and turned in a XXXX Volvo and leased a XXXX Volvo. I left the XXXX at the dealership and left in the XXXX. I was told we were all set and there was nothing left to do with the XXXX Volvo. Subsequently, I was contacted by Volvo Car Financial Services and told that I owned them {$160.00} for a scratch on the car. I told them that I participated in their Pull Ahead Program and that I was advised we were not responsible for that damage. They told me to discuss it with the dealer, so I did and was again told the same thing ; that I was not responsible for the {$160.00}, so we didn't pay it. I even have a letter from them attesting to this. Fast forward to XX/XX/XXXX and all of a sudden my credit score drops 120 points because Volvo Car Financial Services " Charged off '' the expense maintaining that it was bad debt I owed and they could not collect. I have spoken numerous times to the dealer and Volvo Car Financial Services and they just point the finger at the other party saying that its their fault. Volvo Financial Services serviced my loan for my XXXX. My payment due date was the XXXX of every month. I paid the remainder of my loan off in XXXX XXXX XXXX After I paid my account in full, I pulled my credit report and saw they had marked me 30 DAYS PAST DUE on 4 occasions over 4 years. I went back through all of my payments made via bank statement. Only one of these payments was 30 days late and that was in XXXX. The other 3 payments were paid late but not 30 days or more. The most recent late payment on my report was for XX/XX/XXXX. Which I paid in full along with XXXX payment ( paid on XX/XX/XXXX ) That is a total of 18 days. That was my latest payment made. I called to address this with the customer service Dept. And a rep told me that because my payment for XXXX, which I paid early, on XX/XX/XXXX, that it was considered 30 days past due as of the XXXX. I explained that made no sense! My due date was the XXXX. How could it be 30 days past due as of that date? She argued with me and was not pleasant to deal with. She did not have an answer to my question. Ive exhausted all options, and am trying to get my credit report to reflect accurately. We had a lease of a XXXX XXXX, beginning in XX/XX/XXXX. My husband incorrectly believed he had set up direct deposit for recurring payments to the lease. On XX/XX/XXXX, we noticed the car was no longer parked on our property and learned it had been reposessed by Volvo due to lack of payment. We faxed this letter to the leasing company and have tried repeatedly to speak with a supervisor, who is always " busy '' and whose line or direct contact information has not been made privy to us, despite numerous requests. I recently traded in my leased XXXX XXXX XXXX early in exchange for a new XXXX XXXX XXXX vehicle for lease. About 1 month after returning the XXXX vehicle, I received an invoice for the amount of {$100.00} for " excessive wear and tear '' for a scratched rim. I contacted Volvo Car Financial Services explaining that I had purchased the premium tire and rim protection plan for this vehicle so that warranty would pay the amount for the rim scratch. I did state that they had no proof of my doing this damage to the car as I turned it in to the dealership upon taking ownership of my new vehicle. Volvo Car Financial Services said to please fax them a copy of the policy, which I did, and they are stating that this warranty does not cover " excessive wear and tear. '' I explained that they should not code this as " excessive wear and tear '' but as a scratched rim. They would not waive the fee, and as a valuable three-time leasee, I feel their customer service is abhorrent and unprofessional. The representative said, after calling me Ma'am several times when I corrected him to say it was " Sir, '' they would turn me into a collection 's agency, and I stated I would contact the XXXX XXXX XXXX XXXX AL as well as the three major credit bureau agencies and state that the car is now out of my possession and am in a new vehicle, responsible for the new vehicle, not the old vehicle. Volvo Car Financial Services has charged off an account that was never delinquent and in voluntary forbearance and covered by the reporting regulations within section 4021 of the CARES Act. The account was opened for " excess millage '' from a previous leased vehicle. The lease was returned in XX/XX/XXXX ( XX/XX/XXXX ) but the account stayed open to cover the above referenced charges. Volvo Car Financial Services, a company we have been doing business with for many years and continue to do so today, placed this account into a voluntary forbearance due to the Covid-19 crisis and then abruptly changed the accounts reported status to " Charged-Off '' in XXXX ( XX/XX/XXXX ). In XXXX ( XX/XX/XXXX ) when these changes were noticed we contacted Volvo Car Financial Services to inquire about the status change. We were told by Volvo Car Financial Services that they were not aware of any changes to credit reporting requirements within the CARES act and thus " had the freedom to charge-off and report any account they deemed delinquent ''. Again, this account was never reported as delinquent and was reported as " current '' and " paid as agreed '' from XX/XX/XXXX to the time of charge-off in XX/XX/XXXX. Also in XXXX ( XX/XX/XXXX ) a dispute was opened with XXXX to further attempt to rectify this situation. The results of the dispute found in favor of Volvo Car Financial Services and a reinvestigation was denied. Volvo Car Financial Services ( VCFS ) offers a vehicle lease extension option on their website, for XXXX, XXXX, or 3 months. On XX/XX/XXXX, I selected XXXX and the automated response said I would hear back. When I did not hear back, I called VCFS today ( XX/XX/XXXX ). I was told they only extend leases when you have an order placed with a dealership. If that is the case, along with being a consumer-unfriendly policy, it is radically misleading to even offer the extension option on the website without this important qualifier. That is my first complaint. My attachments show the denial issued. Moreover, the VCFS representative told me on the phone I did receive a reply. I checked my email and recent voicemails. Had neither. But, it turns out, that yes, I did receive a denial via VCFS ' messaging platform. That messaging platform does not notify the consumer through any other means when you get a message. No email to say " you have a secure message '' or anything of the sort. Had a not followed up with VCFS, I never would have known. That would be my second complaint. I am also attaching the full message history via VCFS ' " secure messaging '' which shows that the denial was made without my providing a single fact and was a denial that appears consistent with Volvo 's maintaining a policy of no extensions. I am also attaching a screenshot of the message I got when submitting an extension request ( for the purposes of this complaint, I just requested another extension via the website ), that suggests I'll be hearing back in 48hrs.

I returned a leased vehicle to XXXX XXXX XXXX on XX/XX/2020. I got a new leased XXXX at the same time. It was delivered to me and the old vehicle taken. I received a bill from Volvo in XXXX ( for the vehicle I turned in ) for the monthly payment, a late charge and excessive mileage charge. I had not exceeded the mileage, in fact it was under the amount allotted in my lease. When I called Volvo Financial Services ( VFS ) to inquire about why I was being billed for a car I no longer had possession of, they said they hadn't received the odometer disclosure from the dealer yet. I was told " not to worry, it sometimes took a few weeks for the paperwork to " catch up ''. I was told " they would make a note in my account and my credit would not be in jeopardy ''. I then started getting phone calls from VFS about my past due account. I explained repeatedly and was told the same thing- 'do n't worry, we noted this and it won't affect your credit. VFS asked me to contact the dealer and get the odometer disclosure statement because " I would have better luck as the customer ''. I did and it took several weeks to actually get the report. Once they had it, VFS agreed to close the account and remove the 30 day late status on my credit report. They still have not removed and I am being charged a higher rate on a new loan because this lowered my credit score.I have also disputed this with all three credit bureaus and was just informed my dispute was denied.

Volvo is claiming that 3 of the tires on my car at lease turn-in are below tread. This is peculiar and improbable to me for the following reasons : ( 1 ) when dropping off the car no issue was identified ; ( 2 ) I dropped the car off on XX/XX/XXXX and Volvo has tried to charge me for additional months of lease and claimed I had not returned the car in a timely manner ( i.e. Volvo couldn't find the car at their own dealership ). Now that they have located their car, the inspection takes place at XX/XX/XXXX ( over a month later ) and I have no way to validate what wear and tear has occurred over the last month plus. 93 ) Of further concern, the odometer they note in their Lease Termination Inspection Report does not match the amount the dealer noted on XX/XX/XXXX. I have attached both reports. One odometer reading is XXXX and the Inspection Report cites XXXX. ( 3 ) I dropped the car off at the same dealership that has completed all the annual maintenance for the car, and never was low tread identified as an issue ( nor at the last schedule maintenance ) ; ( XXXX ) the XXXX XXXX tires have a 70,000 mile warranty down to tread of 2/32 '' in which there should be a rebate at a minimum. This position is very convenient for Volvo to make these claims at the detriment of consumers. I contacted Volvo to better understand and they were completely unhelpful in trying to resolve this matter.

I had a 36 month lease with Volvo Financial for an XXXX. The lease had an option to buy the vehicle at the end of the lease for {$34000.00}. I've been working with the dealer to finalize the paperwork for the purchase and I noticed the amount due was off, it was too high by about {$640.00}. I investigated and found that Volvo Financial failed to credit a payment I made towards the property taxes for the car, so it was adding on the {$640.00} to the back end purchase price. I've made numerous calls to Volvo- every day- to get this resolved. Every time I call I get a new agent who tries to help and then they refer it to the accounting department and tell me to wait 3 days for the records to update. I called yesterday and was told that the account was updated. I looked and the amount due for the purchase had not changed ( i.e. it was not reduced by {$640.00} ). I was then told that because my lease had expired on XX/XX/13 I now owe an extra monthly payment because I still have the vehicle. The only reason I still have the vehicle is Volvo has dragged its feet by not updating the purchase price so I can buy the car. I was told the issue would be fixed and someone would call me back. That has not happened. I need assistance from the CFPB. Volvo has a responsibility to properly allocate payments, update records, and respond to customer inquiries.

We leased a new Volvo suv through one of my XXXX in 2018. Every payment was made on time and was auto drafted from our account. The dealership we leased the vehicle through no longer existed when the lease was up. We returned the vehicle to the new dealership in XXXX XXXX as instructed. There were no issues, they said we were good, checked all the boxes, and I signed the paperwork. After I asked about several of the extras we purchased through their lease program that were never delivered to us, and we were told we would have a credit issued to us. Nothing ever happened. Unfortunately sometime in the last few months volvo has filed a negative action on my personal credit report for all of {$360.00}. No idea where that came from, especially since they were supposed to owe us money. Now my pristine credit history with exceptional payment history for more than 10+ years looks like I did not make 4 payments on this volvo , and that they charged off the account, even though we paid every payment on time, and returned the car in pristine condition. I am writing about a situation that occurred when two leased cars from XXXX XXXX in XXXX XXXX Florida XX/XX/XXXX. The leasing company is Volvo Financial XXXX XXXX XXXX XXXX, AL XXXX. This was in the middle of the pandemic and things were locked down and the dealer agreed to deliver two new XXXX cars to me and at the same time pickup the two XXXX models that were due to be returned on the lease. My XXXX cars were paid monthly via autopay draft from my bank account. After getting the XXXX cars I later found out that one payment in the amount of {$340.00} was auto drafted from my bank account by Volvo Financial in error. I contacted them soon after and they advised me that the ( one car ) was returned on XX/XX/XXXX according to their paperwork and not XXXX which is when the dealer XXXX XXXX in XXXX XXXX FL picked up the car. I did email the dealer/salesman at the dealership and never heard back. As my current leases became due I was called by Volvo to see if I would continue to do business with them. I advised them of this issue. They told me ( XXXX ) on XX/XX/XXXX at XXXX EST that they would do nothing about this. I asked them why could they not confirm this with the dealer and they acted as if there was no relationship there between the two parties. I was told that there may or may not be an additional payment depending on Volvo 's final evaluation of the vehicle. I was in the process of moving from XXXX to XXXX in XXXX and lost track and contact with the company through time. The account was showing a status of " Paid, closed '' previously but ended up going in to a collection status for {$380.00}. I thought there was a mistake so I disputed it and around that time my credit score decreased by 100 points. There was a lot of confusion so I payed the additional payment but the account status is now showing up as 24 Charge off 's. This is frustrating because its derogatory and looks bad after I paid in full as agreed for {$17000.00} plus the exiting {$380.00}, and is obviously affecting my score negatively. I tried contacting Volvo several times to try and come to terms on this, but I keep getting shifted around, or I need to set up a new account but don't have information to start an account etc.. They're very difficult to work with, and to get in touch with the right people seems nearly impossible.

Volvo Financial Services had sent an End of Lease invoice to me. I received this invoice but was very limited in methods of payment. I logged on to my Volvo online account and the account had been removed from my profile because the lease had ended. Their automated system allowed a look up by social security number. When I entered my social security number, once again nothing was found. This was due to the account being closed due to end of lease? How can an institution invoice you a final bill for wear and tear, yet remove all online forms of payment available to you? Due to XXXX and my own XXXX, I couldn't go to the post office. Additionally, I don't have checks for my account as they cost too much. Its 2021 and super frustrating that Volvo charged this account off. Mind you, I also called and every time I tried to pay the invoice over the phone during Covid there was over a 2 hour wait on the phone. In fact, when I got notice of the charge off I ended up paying right away over the phone. It took me 90 minutes of hold time. I missed to mandatory meetings at work and had to be XXXX for it. This is not something that should result in a charge off. Volvo should take responsibility for removing my ability to pay my invoice online.

I believe that Volvo missapropriated several lease payments and instead of assigning large payments which were to be attributed to the pay off amount, they instead applied as lease payments after the termination of the lease. I ended having to make extra payments to ensure I exercised the purchase option prior to the termination of the lease. This is my third CFPB complaint on this issue, I really need your help and assistance. Please do not close the complaint without discussing with me first. This is my second serious issue with Volvo as it relates to financing/purchasing a vehicle. A representative at a dealership changed the agreed terms and forged my signature on a previous purchase adding items I did not agree to. If Volvo 's assertion is that the payments I have made were allocated correctly they should provide a statement reflecting payments and how they were allocated. That is a simple request and will either validate my complaint or help resolve it. While Volvo has acknowledged that I have purchased the car, they have not provided me with the new title and I still have not received the new tag. We recieved a citation today and I have had to renew the tag despite this being included in the payment sent to Volvo.

In XXXX, I purchased the vehicle I had been leasing through Volvo Car Financial Services. They were paid for the vehicle plus the taxes for the state of Ohio. They sent a check to the state of Ohio for the taxes but the amount was incorrect so they voided the check. In XXXX my credit union called and asked me to call VCFS because the check had not been received. I called VCFS and was told that they had sent a check to me made out to the state of Ohio on XX/XX/XXXX and that I should wait because the postal service is running behind. I leased a new XXXX XXXX XXXX last year. I love the car ; however, I do not have any need for it anymore due to some life changes and working at home. We also have too many sedans in my household. When I looked at the lease no one other than Volvo or myself can end the lease with a payoff. I contacted 2 Volvo dealerships and Volvo of XXXX offered to but it out at {$39000.00} due to the car being too new to have a book value. There is a book value on the same car one year older with a range of XXXX, the loan payoff is XXXX according to them. I tried another volvo dealer, Volvo of XXXX and they stated they could not buy it out, I would have to buy it out myself, then sell it to them after that. This is patently absurd and while I did sign the contract this is placing the consumer in a unfair position. I can only sell the car to one place, that place knows that, and thus is not paying the value of the car properly. I only want to get bought out of the lease, the book value supports that, as does other 2022 XXXX XXXX 's for sale, but they refuse to help. The locking out of 3rd party payoffs is unfair and deceptive and is against the consumers intrest.

On XX/XX/2019, unbeknowest to the customer ( Leasee ), the dealership ( Leasor ) changed the money factor from the agreed upon rate to a much higher rate and hid the change within the sales contract ( as it was not visble on the same ). Additionally, the Leasor also charged the Leasee for a nearly {$1200.00} 'Pre-Paid Maintenance ' plan by including and hiding it in the total capitlized cost of the vehicle without properly disclosing or getting the Leasee 's approval to do so. As a result, the Leasee is paying higher monthly lease payments due to the fraudulently increased capitalized cost and money factor/interest rate resulting in higher rent charges throughout the duration of the lease term. The Leasee has attempted to contact the Leasor on multiple occasions in an attempt to resolve the issue but the Leasor has failed to respond. It's the Leasee 's position that the Leasor performs the alleged conduct regularly in their day-to-day business practice when the Leasor modify money-factor rate and charges for hidden and unapproved service agreements to the benefit of the Leasor without the Leasee 's knowledge or consent.

Had an 800+ credit rating for 8 years until Volvo Financial Services became grossly negligent in the handling of my dispute and subsequent inaccurate credit reporting. - Volvo updated my home address and updated all credit reporting companies with an address that was not mine. - No correspondence was received regarding any disputed balance amount. I surrendered my Volvo old lease for a new lease offer with Volvo and after 1 month I have received a bill with an " excess wear & tear '' in tires for {$780.00}. Volvo Dealership accepted my old lease after check all the car with no issues the same. They didn't tell me that I have to pay anything ( I think because they wanted to sell the cars : 3 cars, XXXX $ value the same day ). After I signed contract, one month after, I received a bill for excess wear for tires, and they try to charge me premium brand tires ( 3 ). We turned in our lease to Volvo of XXXX in the summer of 2020 and to our surprise our final bill included {$210.00} in late fees, however we were never informed during the lease term that our account was being assessed late fees. In XX/XX/2022 I got a flat tire in XXXX XXXX I then contacted Polestar Roadside assistance to have my car towed to the Polestar dealership in XXXX to get my tire fixed. Now that my lease is completing I am told that the only way I can sell it is to buy a new a new vehicle with volvo AND it must also be financed with Volvo. This complaint is specific to Volvo Financial Leases. When leasing a XXXX or newer Volvo via Volvo Financial you are essentially trapped in the lease meaning they have added a clause that you can not trade it in at non Volvo dealer, can not sell to a third party, can not even transfer the lease to another consumer. I have leased vehicles previously and when I was done I simply traded it in, paid the balance ( if any ) and moved on. I have also been advised by XXXX Volvo dealerships that even the Volvo dealers are not allowed to purchase the vehicle or they could face significant fines from Volvo financial. The only way to leave the lease is for me to buy out the vehicle completely which does not make sense. I am certain this is written in the lease but definitely something I feel they snuck in post XXXX and shame on me for not reading every detail of the lease contract.

I leased a XXXX XXXX directly from Volvo which had a purchase option exercisable prior to the end of the lease. I notified Volvo that I intended to purchase the vehicle and asked that they credit my security deposit to the purchase price. They agreed to do this subject to the completion of a form requesting that the deposit be credited. I did everything that Volvo requested and we have followed up six times via their call center and via the messaging center on their website. My lease payment auto-pay sent, by my mistake, an extra payment in XX/XX/2022 to Volvo Car Financial Services ( VCFS ). Over a month and a half after turning in the vehicle, I received a letter which incorrectly stated I had missed a payment and charged me for a payment amount which was inconsistent from what my actual monthly payment was. I returned my leased vehicle on time and was present for the inspection. 4 years later I discovered that there was a charge that I never knew about for over {$600.00}.
