I made my mortgage payment due on XX/XX/XXXX to Vitek mortgage group ( payment went to XXXX, who services Vitek mortgage loans ) on XX/XX/XXXX. The check was received and cashed. My loan was then transferred to XXXX XXXX servicing as of XX/XX/XXXX &. XXXX loan servicing is serviced by XXXX. They state that XXXX/Vitek did not forward the payment to them. I have called NUMEROUS times regarding this situation and every time I call, I am placed on hold for about 30 plus minutes as each person I speak to has to review the account and it takes them so long to understand what is going on. I have explained to them that they cashed my payment for XX/XX/XXXX, and have not forwarded or informed my new mortgage company that I have paid my XX/XX/XXXX mortgage payment. On the third call ( because on the 2nd call, the customer service rep hung up on me when I asked to speak to a supervisor after she kept telling me my check was returned, which it CLEARLY was not ), I spoke with supervisor XXXX XXXX. I explained the situation AGAIN, and after 45 minutes of being on the phone with her, she said she had to do more research and will call me back. She never called me back, and here I was calling for the 4th time trying to get this resolved again. Spoke with supervisor XXXX at this point, who said she has to put in a request that can take up to 5 business days for them to try to get the payment reissued to XXXX/XXXX. Finally, I filed a complaint with the Better Business Bureau on XX/XX/XXXX. I received a response ( attached ) that states they will wire over the funds due to all of the issues going on. I called between XX/XX/XXXX-XX/XX/XXXX to confirm this was done and was told that the wiring is scheduled, but not sent out yet. Finally after a few more phone calls and speaking to a supervisor, he told me the wire was sent on XX/XX/XXXX & he needs to get a hold of the wiring department so he can provide me proof of the wire. He never called me back, so I called back again on XX/XX/XXXX & a representative told me he faxed the confirmation to my new loan company, but could not provide me an email of the confirmation, but can try to mail it. He said to contact XXXX as they wired the payment and sent the confirmation. Finally, I call XXXX and spoke with a few representatives before finally speaking to supervisor XXXX on XX/XX/XXXX. He told me he will send it to the cashiering department to research which will take another 3 bus days. He assured me it would be resolved by Tuesday XX/XX/XXXX, and said that he would call me back with any issues, and even gave me his personal line. Sure enough Tuesday comes and no payment on my account and no phone call. Left him a message XX/XX/XXXX, and no return call. I called XXXX today, and spoke with XXXX, and she was able to send me a copy of the fax they received showing the wire confirmation, however, she stated the research department said they did not receive the payment and the address on there is not their payment address, and she advised me to call XXXX/Vitek again. Already frustrated, I call XXXX/Vitek and immediately ask to speak to a supervisor as I was tired of explaining the issue 3000 times. The representative, who said her name was XXXX, was very rude, even make snarky comments and giggling, which I told her I did not see how this issue was funny. After getting nowhere with her, I asked again to speak with a supervisor and she said there is no supervisor there for me to talk to. I asked her for her supervisor 's name, and she refused to give it to me due to " security reasons. '' I then said I do not feel comfortable with her handling my account and that I would like to speak with a different representative. She told me that if I do n't want her help, " it 's a call center '' so " hang up and call back. '' I did and spoke with another representative who told me research is going on and I should expect a result by XX/XX/XXXX. She could not even tell me what they were researching, as I was calling to tell them the wire they sent, was not received and they may have sent it to the wrong company/people, etc. She said it is escalated to a supervisor and I should get a call within 24 hours. The address on the wire confirmation does not match the address on the XXXX servicing transfer letter that XXXX/Vitek sent me. I am extremely tired of this process. I have made my payment as I should have and am having to deal with all of these problems that were not at all my fault! Spending numerous, days/hours on the phone has given me stress and anxiety, when I have done nothing to wrong and I am getting absolutely nowhere. Everyone just keeps telling me wait a few days and call back, and then I call back and the issue is still not resolved. It has been about 3 months that Vitek/XXXX has cashed my check and no one at this company can figure out how to get that payment to the correct people. XXXX took over my loan as of XX/XX/XXXX, which on that date my payment was already made on the account, so I do n't see how they are holding me responsible, when my payment was already made.

What the agent would state on phone would be different of what he would put in text and email. Eventually had another agent working on file and then refused to put simple things in email. When I was not available by phone and wanted everything in writing. Wanted quote from other lending company had this agent send copy of file and they then took upon their-self to close application. Which XXXX us up as we were in escrow! then I found out they omitted items that had to be counted, so they gave an approval that was not going to work and we would have lost house anyways. I lost money for inspections and other things told them they need to reimburse for not securing my approval. ( first agent talked to my of it going through underwriting when i found out it never did ) Not only did we lose money we lost house and has had the worst experience that has made it question if we ever want to buy now. Refused to fix the issue and tried to make it look as if i wanted them to close file. I have 61 pages ( that's not all correspondence ) showing the hassle and headache and the problems I pointed out from beginning. I got 5 different closing cost amounts all in one day from two different people. I was not informed of the inspections or other cost until my agent told me. I asked them about the class that is needed and still never received an answer but my agent confirmed I needed it. So many problems with the way they do business. I can keep going. I started talking to agent XX/XX/2018 and decided after all conversation we were ready and proceeded XX/XX/2018 but then everything he said changed. They options that they gave to " correct it '' was not an option and would cost us more. Plus it wouldn't be able to close and they did not follow guidelines and they put wrong information on the disclosures. I received two loan packets and both had different loan amounts and interest rates but both have same date.

I have a 30 year fixed mortgage with XXXX XXXX XXXX. My normal payment increased over {$500.00} due to a new tax assessment. I recently started a new business and I am unable to afford to make the required mortgage. In XX/XX/XXXX I requested to work with Vitek Mortgage using their Loan Workout Program which offered a Loan Modification. At that time I mailed the required information to their office in New Jersey in mid - XX/XX/XXXX. I called customer service several times to verify if they had received the information. The package was received and sat in there mailroom for over a month. Finally in XX/XX/XXXX the information was moved out of the mailroom. Several documents were resubmitted at that time because the information had expired. I sent the requested information in with 48 hours of the request. That information included items like paystubs, bank statements and identification. After waiting another month, I called again to check on the status of the loan modification and was told that addition documents were needed. The requested were a Hardship Letter, a Profit and Loss Statement, and a Contribution letter from my wife. All of which was faxed and received by Vitek on XX/XX/XXXX. At that time, I was told that I needed to wait 30 days for a response from the Underwriter. I waited the required time and called again to customer service to get status on my loan modification. The representative that I spoke with told me that the Underwriter had not looked at my file and that they would escalate the matter. I have since " escalated '' this issue on three different occasions since XX/XX/XXXX and have yet to get a response from Vitek Mortgage. According to Section 6 of the Real Estate Settlement Procedures Act this servicer has not complied with the requirements of this law and should be dealt with accordingly. My brother and I are beneficiaries of a family trust set up by our father and step-mother. Our father passed away in XX/XX/XXXX. After his death, our step-mother named us as beneficiaries, however, she was lacking in XXXX XXXX. She was the sole trustee of the trust and had adequate income to sustain herself at the time of our father 's death. In early XXXX she had the front and backyard of the residence ( also named in the trust ), re-landscaped at a cost of around about $ 40k or more. She did not notify us and we believe her neighbors suggested she do this. She took out a loan on top of the current mortgage loan to pay for the landscaping, even though she has a life insurance payout. Later that year, her neighbor, who is a realtor, apparently suggested she put the house into a reverse mortgage. Neither my brother, ( who is also the Successor Trustee and DPOA of the Trust ), or myself, were notified of this transaction. We were in constant contact with our step-mother, however, she was declining cognitively and did not understand what she had done. Her neighbors were always interfering and not helping us help her. They contracted with a caregiving agency without our approval, at a cost that was completely out of line as well and had access to her bank accounts. Our step-mother has been in declining health and passed away in XX/XX/XXXX. The house was also sold in the early part of that month. We agreed to cover the entire pay-off amount to the reverse mortgage company at the time of the sale, but are disputing the entire amount because there were significant over-charges. The entire situation has been a nightmare. We believe that our step-mother was taken advantage of and that she was a victim of financial elder abuse. Our potential inheritance was severely impacted and we are now seeking restitution.

I have been trying to pay my mortgage to Vitek since mid-XXXX. Because I was over 30 days late, my mortgage company 's automated telephone system would n't allow my to make a payment by phone. I 've tried to pay online, but I 'm not allowed to do that either. Apparently I must speak with a live person to pay my mortgage. However, I have called their customer service number dozens of times and spent anywhere from 5 minutes to 38 minutes on hold each time, and a live person has never come on the line. I have sent three emails asking for assistance and have not received a telephone call back. They have told me via email that someone will call me, but nobody has called me. I have not mailed a check to them because I am attempting to call daily and I do n't wish to accidentally double pay, and I also do not trust this company to apply the payment correctly. They advertise that you may pay your mortgage online or by telephone, but I 've been trying for months and have n't been able to do so. I now owe them four monthly mortgage payments, my credit rating is no doubt destroyed, and I am very concerned they will or have begun foreclosure proceedings, all because their automated online and telephone systems will not accept my payment. Please help me.

In XX/XX/2016 my home flooded from a rain storm. I reported it to my home owners insurance and could get help because it was not covered. I contacted Vitek Morgage Group, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, Ca. and ask them for some assistance and was not given any until I contacted several federal agencies. Then they offers me a program that allows your mortgage to be dismissed for a few months, but I still had know where to live of fix my water damage. Finally they offer me a deed in lieu which I had no choice, then I ask them will it hurt my credit score and they said it will possibly show own my credit report, but they all so said the payment would stop once the process began. But they did not stand behind their word and put a late payment own my credit report that has keep me from getting another loan from any mortgage company and buying thing to help me in my life. I am a XXXX veteran and have seriously medical issues.

Vitek Loan 1. Loan originator told me my house may worth more than XXXX and asked me if I am interested to refinance. 2. After quick research, I learned that conservative estimate of my house will be about XXXX. 3. I asked the loan officer if it is possible to remove PMI if the refinance does n't go through. And he confirmed. 4. Paid appraisal fee and the appraised value came about XXXX. as I expected. 5. Since the refinancing did n't go through, I requested PMI removal. 6. Vitek denied my request even though LTV ratio is XXXX %. Claiming that it should be XXXX %.
