My mortgage company : Virginia Housing Toll Free : XXXX XXXX XXXX : XXXX Toll Free : XXXX Dear Consumer Finance, I am in need of your help, as of XX/XX/XXXX, this month, I found out when I went to pay my monthly mortgage payment, it had gone up several hundred dollars. I immediately call customer service to find out what was going on with my acct. ( Full situation of all my attempts to get matter resolved is reported below. ) As of today XXXX XXXX XXXX, Virginia Housing-VH is not willing to do anything to help me clearly understand what has been going on with my acct over time. Clerks have been vague with acct information and VH has allowed a snowballing deficit to accumulate over time. From what I can piece together from contacts with clerks, I THINK, there was also a problem with new home insurance transfer in XXXX. All three clerks have been very clear with my options : 1. pay the new payment and just deal with it or pay the new full amt or pay nothing at all ( ..this would lend to fast track on foreclosure ). Clerks have shared that VH has no interest helping me get concerns address and WILL NOT be re-calculating/analysis my acct, EVEN AFTER I pay up on ANY deficit on the acct, until next year. I have requested this adjustment on my acct/analysis, three times with all clerks, to reduce my monthly payment and all of them have said NO. I know the clerks are limited to what they can say, as VH has put their staff in the position, to only get money, not be helpful to/with consumers. I am however not interest in being a part of this shake down approach. I WILL NOT blindly throw hundreds of extra dollars a monthly on my acct with no understanding as to what is REALLY get paid on. I will not be put in a position of losing my home ; because of the mishandling of my acct and VH failing to notify me of problems letting a deficit snowball over time denying my requests for full information/ understanding fully of what has been going on with my acct denying adjustment/analysis once I attempt to get deficit pay up and NOW placement me at high risk of foreclosure because VH does not want go to a computer, hit compute button to update my monthly, once deficit is paid up. VH has the liberty to adjust/run analysis when they want to, as VH has done in XXXX XXXX on my acct, according to one clerk. This was for VH convenience. VH also has software to notify a consumer by text, email or mail, if needed, and as I get monthly mail of every payment made. SO, it is not what VH cant do, it is what VH is willing to do for consumers to help set up consumers for success. Situation : On XX/XX/XXXX I CALLED my mortgage company by phone to make my monthly mortgage payment. That is when I found out there were hundreds of extra dollars on my monthly payment. I CALL vh and I connected to customer service rep XXXX and during this call : time was taken to review my account to see where the extra amount of money was coming from. She had limited information but she stated I needed to call my old insrance company get refund check, call VH back,, pay VH AND TELL THEM TO DO ANOTHER ANALYSIS ON MY ACCOUNT TO FIX THE MONTHLY PAYMENT STATEMENT. she DECLINED to take any form of payment. She stated I pay all of payment or I pay NOTHING. I was not able to pay the full amount, as it was hundreds of extra dollars for this month. She was happy to connect me to the her connections department. I was connected to XXXX. she shared a little bit of information and she also DECLINED to take any form of payment. She also offered that I could pay an extra {$800.00} now today..it would to help bring down the monthly payment. ( VH can run a anaylsis if they wanted to ) She gave no other offers of help with me in this matter. I had to remind her that if I couldn't pay the extra for the mortgage payment, where would I come up with extra {$800.00} to bring down my payments. Again, I was ask to pay random sums of money with no clear idea of what/where money was got to. Clerks followed their work scripts to meet VH needs but offer nothing to help me. VH was willing to PUT ME IN THE PROCESS OF NOW MISSING A MONTHLY PAYMENT, GETTING A NEGATIVE HIT ON MY CREDIT REPORT, being charged late fees, AND STARTING THE PROCESS TO FORECLOSURE BECAUSE OF the mis -managment of my acct and failure to notify me. **This is the second time that I have called mortgage company for help, in my 14 years with them and they were happy to set me on the track for foreclosure, because of their rigid, unbending and non-customer service support practices. **In XXXX all electronic software has a way of making adjustments to payments, send out letter of concern ( VH send me monthly an payment received ) when need and/or flag a acct of errors if needed, with the hit of a button and VH has failed to do this/unwilling to do any to help consumer. Continued XXXX on mortgage problem with VH. Monday XX/XX/XXXX I made a second telephone call to Virginia Housing VH at XXXXXXXX XXXX XXXX I spoke with XXXX, and explained why I was calling and she stated that she could help with payment part of call and she could transfer to collections for manager. She waved a {$15.00} fee and was able to work with me with getting {$400.00} paid, ( owed to VH form old insurance company ) by phone authorized the one-time payment reference number XXXX. I asked her to apply to VH and she stated she couldn't apply the XXXX specifically for VHS refund but it goes towards the balance of the escrow account. Doing this phone call I also found out for the FIRST time that my account before, the new insurance company bill in XX/XX/XXXX, that II had a DEFICIT of XXXX. I asked her why VH did not notify me of the deficit and I did not get a answer to that question. In the deficit of XXXX. XXXX, She stated that I had {$390.00} in taxes that also contributed to this total. I asked her if I paid that amount and get this deficit caught up could a analysis/adjustment be run, in order to get my monthly payment adjusted to/around my former payment. My goal was to get my monthly payment back to a manageable amount per month. No it is not in VH interest to run another analysis unless, I pay VH a large sum of random money. All clerks have denied the request for adjustment. My goal, in XX/XX/XXXX, is to get payments caught up with the deficit and to get another analysis run to bring down my monthly payment as of XX/XX/XXXX. This is very doable be VH WILL NOT work with me. She was very clear that the only way VH would do another analysis is if I PAID off the full amount of the new insurance companies insurance. This would be a {$1900.00} payment and to pay off deficit balance to VH.???? I HAD TO REMIND THIS CLERK THAT IF I COULDN'T PAY SEVERAL HUNDRED DOLLARS MORE A MONTH IN A MONTHLY PAYMENT WHERE WOULD I GET {$2700.00} FOR ONE-TIME PAYMENT. My current mortgage payment problem is of no interest to VH, and VH is not willing to work with me to fix problem or tell me what is going on with my acct. *** I AM IN A CURRENT SHAKEDOWN SITUATION with VH WITH NO ONE HELPING ME AND I'M CURRENTLY BEING ASKED TO THROWING RANDOM MONEY INTO AN UNENDING BLACK HOLE AND NO ONE AT VH IS TAKING RESPONSIBILITY WITH TRYING TO HELP ME FIX THIS PROBLEM. Hello, I am reaching out to this eclectic group as a humble Virginia and XXXX. I am desperately hoping for a miracle from you. I am a husband and a father who always wants the best for his family. In this case I have tried going the normal course and have tried everything in my power to prevent getting to this point. Facts : For the past 4 years my wife has suffered with debilitating XXXX XXXX. I have a XXXX XXXX XXXX son who relies on me for all the comforts he is entitled to. I was in a repayment agreement with XXXX regarding my mortgage in XXXX XXXX. In XXXX XXXX, when I was notified of a layoff of my job, I notified XXXX by mail of my change in income from {$56000.00} per year to {$0.00}. As is their custom I called to advise them and they referred me to their borrowers assistance package to determine if anything could be done to help with my payments. On XXXX XXXX I filed this paperwork via XXXX mail after 30 days ( their timeframe ) I had received no response. I called and spoke with XXXX or XXXX who said it had not been received and to refile, which I did on XXXX XXXX. Again I heard nothing and I called in XXXX and was told again to file the paperwork. During this time, I received no reinstatement letter or notification of possible foreclosure. I try to file paperwork again only to find out foreclosure occurred XXXX. I believe my paperwork was not processed due to my wifes mental illness and as a way to discriminate against her. I made multiple contacts to XXXX to see if they could help me avoid this action. Fast forwardI attended an eviction hearing on XXXX thinking that the judge would hear my argument and at least continue the case. He didnt. Rather he sent me back to the lawyer for XXXX and to the company but ordered eviction proceedings could be filed I XXXX business days. I tried to work with XXXX to get them to go back and allow my borrowers assistance package from XXXX and XXXX to be reviewed. They said they have no evidence it was received and they refused indicating that they could do nothing. Request : I want a temporary stay of the eviction so my original paperwork can be resubmitted and reviewed. I am seeing commercials now about the holiday but how do you have XXXX in a car? I have no where to go nor do I have any extra funds to locate. This is the only home my son has known. We are fully prepared and have been to assume normal house payments but XXXX will not take partial payments so I havent been able to give them less than the repayment plan amount which was $ XXXX due to my layoff. I need help and XXXX XXXX I go down I get turned away. XXXX still owns this property so why wont they help me. I have also filed a complaint with the CFPB but that takes upwards of 15 days to resolve which I dont have. I hate to beg and Im not trying to get out of my debt but I need help. I dont usually ask but rather rely on my own to resolve issues directly with the business. In this case those attempts have been futile. In XX/XX/XXXX, we received correspondence from the Consumer Financial Protection Bureau regarding a legal settlement between CFPB, the United States Department of Justice and XXXX XXXX XXXX ( now XXXX XXXX ). In the consent order, it states that there are allegations regarding possible " discrimination impacting approximately XXXX XXXX and XXXX borrowers who potentially were charged higher interest rates and fees than XXXX borrowers because of their race or national origin rather than the borrowers ' credit worthiness. '' As part of the XXXX XXXX dollar settlement, impacted borrowers will be receiving a one-time disbursement of approximately {$540.00} once a signed Borrower Verification and Release of Claim form is submitted. We are very appreciative that this is being investigated, but wanted to know why a review for a possible interest rate reduction for these impacted borrowers is not part of the settlement. Is that something that can be considered? With low appraisal values preventing impacted borrowers ( like us ) from refinancing with their current mortgage company/servicer for a lower interest rate, we are paying a significant amount in interest each year with no way to lower the interest rate until the housing market rebounds. We have personally tried for years, however, due to our current loan to value, we are stuck at an interest rate of 7.25 % unless we come up with $ XXXX out of pocket, which really defeats the purpose of refinancing. Currently, our servicer is the Virginia Housing Development Authority and they have no plans to assist any of its borrowers with interest rate reductions, unless they are distressed. Unfortunately, no other company will refinance our mortgage due to our loan to value. The current HARP programs do not apply to loans owned by VHDA. In light of the recent allegations documented in this consent order, we are hoping the aforementioned can also be looked into, in hopes of helping some of these potentially impacted borrowers ( like us ) with a little relief. A {$540.00} one-time disbursement ( though we are appreciative ) compared to over $ XXXX we pay in interest a year on our current mortgage at 7.25 % in no way compensates. Although we feel the disbursement should be much more, we are more concerned about at least reducing the interest we will pay in the future through an interest rate reduction. We do n't want to lose this disbursement and have until XX/XX/XXXX to sign the Release of Claim which would prevent us from pursuing any further legal action. VHDA is currently looking into options, now that we have provided them with the documentation regarding the settlement, but we are not sure they will assist. Lastly, we reached out to the Department of Justice who referred us to the CFPB for any further inquiries, which is why we are completing this complaint per their instruction. My wife has her house financed through the Virginia Housing Development Authority. In the last year we have had to change our home insurance policy on that house. VHDA has continually made mistakes with correctly paying out the policy to the provider XXXX XXXX insurance Company with XXXX as the agent ) via the escrow account. It was so bad that at one point because VHDA paid out to XXXX wrong insurance providers, who were not XXXX, XXXX and XXXX informed us that they were going to drop us due to non-payment. We thought we had that whole issue taken care of in the XXXX timeframe of this year. However about XXXX months ago we got notified by VHDA that the escrow account was shorted by over {$1200.00} and therefore the mortgage payment on the property was increasing by over $ 200/month to cover the shortage. The reason for this shortage was because VHDA had paid out, twice for about {$1200.00}, insurance companies who were not our providers. Therefore After spending over XXXX hours on the phone with XXXX trying to understand what the issue was and who caused it, my wife and I thought we had this issue taken care of. VHDA even sent us an annotated print out showing where they had sent out XXXX incorrect payments, received return payments from those companies and finally paid out, correctly, to XXXX XXXX. Therefore, my wife and I thought everything was taken care of both with XXXX, to ensure we had insurance on the house, and VHDA, such that there was no longer a shortage in the escrow account. However, when we went to make the monthly mortgage payment this month, the payment amount reflected an amount that VHDA told us we would have to pay because the escrow was short funds. What I am filling a complaint about is this issue. Why do I have a document from VHDA showing that my escrow account is in good standing and any issues with the lack funds in the account are as aa result of their mistakes and not ours as a homeowner, and somehow I 'm still responsible for missing funds that should n't be missing from my account in the first place. This is the second time I've had to file a complaint regarding my experience with Virginia Housing during a forbearance plan. Background : I was laid off from my full-time job in XX/XX/2020. The layoff was prior to the COVID-19 pandemic, however, my ability to find a new job was impacted by the COVID-19 pandemic and a job I was offered was then delayed due to the COVID-19 pandemic. All of this was communicated to Virginia Housing. However, in violation of the CARES Act, my missed payments were reported to credit bureaus and my credit score subsequently plunged. I tried several times to resolve the issue with Virginia Housing before filing a complaint through CFPB. Only then was the issue resolved. Calls and emails went unreturned several times during the forbearance process. Current issue : I informed Virginia Housing that I am employed as of XX/XX/XXXX and would be able to resume mortgage payments by XX/XX/XXXX. I was directed to submit an attestation form, which I did. I then received a call indicating that the end of my forbearance was approved and the amount owed would be added to my existing loan. I was told I would received a letter via email by XX/XX/XXXX and later via regular mail verifying as much. When I did not receive the promised XX/XX/XXXX email, I followed up. I was then told that there were " concerns '' with my file and that my forbearance appeared to be not due to the COVID-19 pandemic and therefore the loan would need to be modified and more time was needed for that process. I once again, as I had before, explained that my forbearance was indeed due to the COVID-19 pandemic. However, Virginia Housing is still refusing to make good on the original approval and send the documentation effectively ending my forbearance. Instead, they are asking for my " patience. '' I am still behind on other financial obligations and desperately need resolution so that I can refinance my loan and consolidate the debt accrued to support my daughter and myself for the past 18 months. I was laid off from my full-time job in XX/XX/XXXX. After significant job seeking activities and interviews, I received a verbal offer of full-time employment by a hiring manager with the federal government in XXXX of XXXX. However, due to the COVID-19 pandemic, the hiring process has been significantly delayed at every stage and created a hardship for me and my daughter. I received the written offer in XX/XX/XXXX, was in the security clearance process through XXXX and the agency is now awaiting budget approval for the position. I was able to pay my mortgage, secured in XXXX with Virginia Housing and backed by XXXX XXXX, with personal savings and severance pay until XX/XX/XXXX. At that time I was approved for a forbearance program with Virginia Housing. I have discovered that Virginia Housing has reported missed payments to credit bureaus. I have verified with a Financial Education counselor at the XXXX XXXX Extension office that the federal CARES Act directs lenders to not report missed payments as part of a forbearance program associated with hardship and the COVID-19 pandemic so long as the account was current at the time of the forbearance program application. I have explained this to my forbearance program representative and a customer service representative over the past few months, but my credit report still reflects missed payments to Virginia Housing. I received a letter this month stating that Virginia Housing would not be correcting the information because it is " accurate. '' While I understand the information is " accurate, '' reporting the information is in violation of the federal CARES Act, as I've stated above and verified. I have also reported this issue to XXXX and not received a response. I would greatly appreciate help rectifying this situation with Virginia Housing and the credit bureaus in order to protect my previously good credit score.

This mortgage servicer has entered my property without authorization, contacting both my XXXX grandmother and father. I possess evidence in the form of video surveillance, which prominently displays a " no-trespassing '' sign on my premises. They have engaged in unwanted surveillance and left blank notes on my window and doorstep in an attempt to establish contact, employing the practice known as " ding-dong ditching . '' Despite repeated requests, the mortgage servicer has not provided a copy of the purported contract between us. It is essential to clarify that I have never entered into a contract with this company. My original contractual arrangement was with XXXX XXXX XXXX. Unfortunately, XXXX XXXX XXXX engaged in mortgage fraud by creating false budget sheets, resulting in my qualification for a fraudulent loan. They were aware of the fraudulent nature of the loan, leading to its sale. Importantly, I was not provided with full disclosure regarding this fraudulent activity, including my right to rescind under the Truth in Lending Act. I keep asking them to produce the original note. The deed alleges the home was purchased for XXXX dollars. They are claiming a loan took place but they have yet to furnish any proof that any loan happened. The only money that has been exchanged has been extorted from me to this servicer under false premises. The current servicer is falsely claiming that my home is vacant, potentially as part of their predatory lending and mortgage fraud misrepresentation tactics, which also violate my civil rights. I hereby dispute any alleged power of attorney by this company, as they claim an irrevocable power of attorney without making me aware of it. In XXXX of XXXX I started the process of refinancing my home in order to lower my monthly payments. My original loan was with Virginia Housing Authority, now Virginia Housing. The closing for the refinance was XX/XX/XXXX, and the payoff statement included the mortgage payment for XX/XX/XXXX, with payout to Virginia Housing on XX/XX/XXXX. I paid the mortgage payment for XXXX on XX/XX/XXXX. This means that Virginia Housing received XXXX payments for the month of XXXX. They have NOT reimbursed me for the double payment. I called Virginia Housing on XX/XX/XXXX, and spoke with a representative of the company. Selling house found issue on vhda loan. I must have forgotten to pay the XXXXdollars on my loan and got no correspondence that I was late. I was trying to change my name on my loan and they told me a month ago I was 30 days past for 7 months. The man I originally spoke with said they had sent out a letter every month for seven months that they had proof of that. I squared up this month. I got divorced back in 2004 and was awarded the home as long as I maintained the mortgage. The Respondent never responded to the prompt execution of the deed transferring all his interest to me after several attempts made throughout the years. I submitted my divorce papers to Virginia Housing Development Authority ( VHDA ) several times and they are not helping me stating I need his signature. If he ignored a court order of signing the house over to me how am I suppose to get a signature from him? I have not seen nor spoken to my ex since 2004 and I do not know his whereabouts or whether he is dead or alive. I am not able to remove his name from the mortgage/deed because he is unfound. I keep explaining the situation to VHDA and they offer no assistance even though their website states say to contact them if you are having financial trouble. I can't apply for any modifications or forbearance during the Corona Virus due to this ongoing situation and I do not want to go into foreclosure. We pay our mortgage every single month and the mortgage company let our home insurance lapse. Multiple attempts from my husband, myself, and our home insurance company and they still let it lapse. Several times the invoice was sent and they ignored it completely. We have construction going on in our home for over 6 months now due to the previous owners not fixing things properly & all this with XXXX children. Earlier this year i changed lender on home insurance. XXXX gave me a very hard time with that transition AND staff kept telling me I was wrong for change, as new amt was too high. I pay my mortgage online and this month there was an additional fee of {$350.00} indicating it was a fee for possibly mitigation and/or short sale ( it was n't clear ). I tried calling VHDA but could not reach them. I tried just paying my regular mortgage fee but the system would n't allow me to. Then when I was out of forbearance was told I qualified for a Virginia housing relief grant of XXXX XXXXk but I owed $ XXXX and needed to bring the balance down to $ XXXX to be able to receive the grant to pay what I owed. I requested the 180 forbearance on my mortage as granted to me by the federal cares act.
