On XX/XX/2021, XXXX XXXX XXXX XXXX XXXX XXXX received a dispute from me in reference to an alleged XXXX XXXX Bankruptcy that is erroneously placed on my report that is on file with them Tracking ID : XXXX. In response to my dispute of this XXXX responded with the attached letter stating that the information had been " verified as accurate '' by XXXX XXXX XXXX ( XXXX ). In response to this, I then sent a letter to XXXX requesting their method of verification, which is my right under FCRA Section 611. I asked for specific information pertaining to how the investigation was completed and who they referenced from the specified courthouse to obtain my information and citing several violations to my Rights under FCRA ( letter attached ). Instead of, providing the information I requested, XXXX responded with the attached letter, putting the responsibility on me " the consumer '', to contact the data source directly to resolve the issue, which they referenced as the XXXX XXXX XXXX In the letter they sent me, they reference themselves as the " furnisher '' and under FCRA " the furnisher '' has an obligation to only provide verified information that they know to be 100 % accurate to CRAs. XXXX has failed to adequately perform their obligation here and it is their responsibility to verify and validate information before furnishing it to other parties, not mine. XXXX has grossly violated my rights not only under FCRA Section 611 by not providing their method of verification but have continued violate my rights under FCRA Section 623 in reference to their obligations as furnishers. Section 623 of the FCRA and Regulation V generally provide that a furnisher must not furnish inaccurate consumer information to a CRA, and that furnishers must investigate a consumers dispute that the furnished information is inaccurate or incomplete. I am requesting immediate remedy in terms of how my rights are being violated now and previously based on the violations in previous paperwork attached to this complaint. I am further requesting that this complaint not be closed with explanation and that all parties respond here in reference to this complaint. I am certain that the item I disputed is incorrect and should be removed, so I am hereby exercising my right under FCRA 611 ( a ) ( 7 ) to request a complete description of all methods used to investigate my dispute, including but not limited to : Name of the courthouse ; Persons name you verified the bankruptcy with ; Address ; Telephone number ; and Documentation furnished by the court, via a court employee, which would be the original creditor, used to verify the dispute. Additionally, I want to reference here as I referenced in my letter to XXXX that also they have violated my FCRA rights : 15 USC 1681 ( a ) ( 4 ) you have violated my right to privacy by going about fishing for erroneous negative information to put onto my credit file and additionally furnishing a 3rd party with information revealing alleged assets ( please see attached paperwork that was furnished by you to XXXX ) - 15 USC 1681 ( b ) ( 2 ) you do not have permissible purpose, nor do you have written instruction to furnish any potential information about me or provide any documents defaming my character to any credit reporting agency. - 15 USC 1681e ( B ) you are required to follow reasonable procedures to assure maximum possible accuracy of information concerning the individual about whom the report relates. I addressed all this in my letter to XXXX as well as asked for their Method of Verification, but instead of addressing my concerns or providing me with what I asked for they sent a seemingly templated response ( see attached ).

On XX/XX/2021 I mailed a certified letter to LCI requesting a method of verification for a previously disputed bankruptcy with XXXX on XXXX XXXX. XXXX advised that they confirmed bankruptcy XXXX was verified as accurate by this company and that I would need to follow up with them, as they are the company used to research public records. My first contact was made with a method of verification letter that was sent certified. I paid for certified mailing with The United States Postal Service so that I could have a tracking number which is XXXX XXXX XXXX XXXX XXXX and it confirms it was delivered and signed for on XX/XX/2021 at XXXX. LCI failed to reply to my certified letter within the allowed time frame for a method of verification request. According to the FCRA, a company is allowed 15 days from the date of request to reply. On XXXX XXXX LCI mailed me a letter that never responded to my first letter. Instead, it states In order for them to dispute the accuracy of the bankruptcy I would need to send a letter or email and include the basis for the dispute and all substantial information. This was already ready disputed with Transunion, and I did not request another dispute with LCI. I requested a method of verification which I requested they send the evidence of how they verified this bankruptcy was mines. Instead of them responding with that information they deflected from doing so and sent me the attached letter. So I decided to reply to their response by email on XXXX XXXX and requested the same information. I again asked for a method of verification for the previously disputed bankruptcy with XXXX In my email I asked once again for the company to provide what method of verification they used to confirm this chapter XXXX bankruptcy and advised that according to the FCRA, a method of verification is to be completed within 15 days of receiving the request. I advised that they failed to respond to the initial letter that was received on XX/XX/2021, within the 15 allotted days. I also advised that since they failed to respond that the inaccurate bankruptcy has to be deleted. On XX/XX/2021, they respond to my email and STILL failed to address my request that was sent via email again for the method of verification. Instead they replied with the attached letter, and stated they received my correspondence on XX/XX/2021 requesting to freeze my credit report. This company also replied with inaccurate information on the letter which I attached. The spelling of my name is inaccurate. They spelled my last name as XXXX and that is not correct. My last name is spelled as XXXX, and I will attach my driver license. They also has an inaccurate spelling of my address. They have my address as XXXX XXXX XXXX XXXX XXXX. My correct address is XXXX XXXX XXXX XXXX XXXX. These are clear indicators that they have inaccurate information, and could have even possibly mixed my information with that of someone else. I never requested my credit report to be frozen. This again is another example of this company failing to respond to numerous requests for a method of verification. This company is refusing to reply to my request as I am sure they are unable to verify this inaccurate bankruptcy, therefore they are deflecting from responding to my method of verification requests. I have attached the email I sent on XX/XX/2021 which confirms I asked only for a method of verification, not a credit freeze. This company has violated my rights and I wish to file a complaint.

XX/XX/2021 Dear, CFPB & To Whom It may concerned I obtained my credit report from XXXX and there were U.S. Bankrupcty Court listed. For the FCRA 623 ( a ) ( 5 ) : If LCI Financial Consultant can not VALIDATE the information with the ORIGINAL CREDITOR, they must remove said Information from consumer credit file. The county Recorder of Deeds and Bankrupcty Courts have both mailed me letters which emphatically stated that they do NOT provide any information to credit reporting agencies, and/or other third parties providers who collect information regarding public cases from public records. Public records information is NEVER validated by the Recorder of Deeds nor the U.S. Court system due to Fair Credit Reporting Agency PRIVACY LAW. My inquiry to the County Recorder of Deeds and U.S. Bankrupcty Courts confirmed XXXX Credit Bureau has never validated or verified these public record entries on my credit report, neither will they have ever be by them. They further stated while they are NOT liable or responsible for any MISUSE or INCORRECT public records, nor the distribution of said information, public records may, and oftentimes are reported by third party sources unawares to the consumer, and in most cases, incorrectly. Considering the information indicating a Fair Credit Reporting Act violation, I need all tax lien and Bankrupcty information currently showing under my social security number to be PERMANENTLY DELETED from my credit report immediately. You needs to provide me with copies of all documentation associated with these Public Record Accounts bearing either a court order to place this information in my credit report, or my authorization of release bearing my signature. In the meantime, to be in full compliance with the FCRA laws and guidelines, all information listed under Public Records needs to be immediately deleted from the credit file you maintain under my name and social security number. Be further advised that I am closely monitoring my credit file. Per the Federal Law, you have exactly 30 days to complete this investigation as outlined per the Fair Credit Reporting Act 623 ( a ) ( 3 ) Per the Federal Credit Reporting Act, Section 609 ( a ) ( 1 ) ( a ), you are required by federal law to verifythrough physical verification of the original signed consumer contract and/or judgement ( s ) all accounts and public information that you post on anyones credit report. Otherwise anyone paying for your reporting services could fax, mail, email in fraudulent and erroneous account information. As such, if this unauthorized public record information is not deleted from my credit report within the next 30 days, I will be filling a compliant to the Federal Trade Commission, Consumer Financial Protection Bureau. Failure to respond in a satisfactory manner within 30 days of receipt of this certified letter will result in a small claims action against the XXXX Credit Reporting Bureau. I will be seeking no less than {$5000.00} in damages for, but not limited to : 1 ) Defamation ; 2 ) Negligent Enhancement of Identity Fraud ; 3 ) Violation of the Fair Credit Reporting Act and Consumer Financial Protection Bureau.

From my own research, XXXX doesn't report full SSN 's so again how did LCI verify the bankruptcy ( they DID NOT ) XX/XX/XXXX : I sent an email to XXXX and XXXX Responded that they provide electronic access to case information from federal courts however they DO NOT contact consumer reporting and credit reporting agencies. XX/XX/XXXX : LCI responded asking me to provide further information about the alleged bankruptcy. XXXX : I replied stating that per the FCRA if I am asking for LCI to provide my consumer report and they are refusing to do so this goes against my rights. Per the FCRA if a consumer reporting agency is unable to verify my account within 30 days then they must delete the inaccurate information. XX/XX/XXXX : I sent an email to LCI stating the person they addressed the letter to is incorrect. LCI responded same day stating please disregard the previous response with the same response they sent to the incorrect person. XX/XX/XXXX, XXXX I asked LCI to send me my Consumer report XX/XX/XXXX : LCI XXXX XXXX XXXX me an internal email about a mail merge with someone else contact information who was also trying to see how LCI verify bankruptcies. I responded to them on XX/XX/XXXX asking am I getting my consumer report or do I need to file a complaint to let everyone know that the company is sending the wrong personal documents to the incorrect consumers. They then tried to recall the email but it was too late. This company is sending employee 's personal information to the wrong consumer and violating consumer rights. They have yet to provide me with a consumer report it's been beyond 30 days. They have not provided their method of verification. I have been battling with XXXX and LCI since XXXX regarding their refusal to 'freeze " the consumer report they each have on me, which per the FCRA I am entitled to do. I have also been battling with them regarding a Bankruptcy they each have listed within the consumer profile they have on me. LCI and XXXX both claim they can not and will not freeze my consumer information. Furthermore, I believe they have committed fraud to violate the FCRA and violate my consumer rights. When first addressing the Bankruptcy they have listed, they first claimed the information came from XXXX and XXXX XXXX. Upon notifying them that XXXX XXXX did not have a bankruptcy listed they then claimed the furnisher was XXXX. XXXX maintains the information/furnisher is LCI. When pressed further, each company claimed that the information came from the other. With each piece of evidence I sent to them, proving that their verification and supposed furnisher was false, I would get a different excuse which violates the FCRA to delete if the item disputed can not be properly verified. Most recently both XXXX and LCI both claim that now the information and/or furnisher of said bankruptcy came from the Courthouse and/XXXX. I proved this was not true by contacting the Courthouse and XXXX. I have letters and email from each entity claiming they do not report to third party reporting agencies nor do they report to credit bureaus. Furthermore neither XXXX or the Courthouse confirm a Bankruptcy. I also have an email from XXXX stating they do not list anyone 's full social security number. However LCI and XXXX both maintain the Courthouse and XXXX as the verification and furnisher. This is after all of the previous different entities they falsely claimed were the furnisher. XXXX further violated my consumer rights by sending me a supposed voluntary petition that they fished from the XXXX XXXX which is not a legal form if verification since I have the email from XXXX stating full social security numbers are not listed in their system. Furthermore, fishing of information that can not be verified violates the FCRA and my consumer rights. A Bankruptcy can not be verified when neither the courthouse or pacer report to agencies, do not confirm information and do not list full social security numbers. LCI has lost several lawsuits recently for these practices I've mentioned. XXXX and LCI must comply and follow the law, yet they are not doing so. If XXXX is working with them or paying them then they should be held liable as well.

I came across a bankruptcy on my credit report that was not fully verified. I disputed on XX/XX/2021 this information to XXXX and they claimed that it was verified XX/XX/2021. I asked for a description of procedures along with the source who provided them the information. On a phone call XX/XX/2021 they refused to provide the source other than stating that the courts hired a third party to verify the Information. Before filing the dispute I reached out to the court house and they responded to me in writing stating that they don't provide any information to credit reporting agencies or third parties and that they are unaware of how credit reporting agencies get there information. I also provided to the courts an Affidavit of facts that was notarized because I didn't authorize the release of any personal information. I then went on XXXX 's website and came across XXXX and LCI is the vendor for public records in which XXXX records. Problem is, if XXXX did a proper investigation from XX/XX/2021 dispute then they would have realized that XX/XX/2021 XXXX removed the alleged bankruptcy because it was unverifiable. On LCI 's website it states " XXXX, not LCI, matches bankruptcy information to the XXXX consumer credit files. '' Im trying to understand why XXXX would tell me that the court house hired the third party? How can XXXX trust this information if LCI hasn't verified this Information before selling it to XXXX? I want to make XXXX aware that they must fully understand by law that they must fully identify anything they get from a reseller or vendor. This not only includes the name and address but it must include date of birth and full 9 dight social security number. The FCRA also states that a bankruptcy may be on a consumers report up to 10 years but it never stated that it must be on a consumers report. Lastly I pulled a XXXX report with the docket number provided on the consumer report and it lists incomplete information which makes the report unverifiable by not listing all 9 dights of the social security number and does not have any report of a birthdate making it unverifiable. In this complaint is attached of all the evidence that XXXX should have investigated but they failed to do so because they would have to delete the bankruptcy that they erroneously reported.

I pulled my XXXX consumer ( Property Loss ) report by contacting Verisk. The report contains information on a Homeowner 's policy listed in my name and I DO NOT own any Real Property of any kind. Publishing a property loss claim on a homeowners policy in my name is a fraud and any insurance company uses this as an excuse to inflate insurance premiums as additional risk. I wrote Verisk on XX/XX/2018 and again on XX/XX/2018 to request documentary evidence of an insurance policy bearing my name and signature associated with the reported insurance loss. Verisk simply states the loss is verified by telephone and has referred me to XXXX 's XXXX to request information from their data furnisher. My dispute letters are very clear that I requested a copy of the insurance papers bearing my name and signature ( as required of the FCRA ). I do not believe there was any investigation because XXXX XXXX XXXX, XXXX 's, and Verisk has sent me nothing of any merit to verify any homeowner 's policy and/or a loss bearing my name. I received two identical letters and a print copy from their database ( pages attached ) This property loss needs to be deleted from my property loss report because there is no verification, it is inaccurate and/or incomplete. The reporting agency XXXX XXXX that XXXX used in the past several years. Complete their investigation after being contacted by me and removed all 3 Bankruptcy from their database. XXXX was also notified by XXXX XXXX requesting deletion of inaccurate reporting in results to their errors. XXXX XXXX is the Original Reporting Agency who I was advised to contact. I was informed from a Supervisor with XXXX even after verifying they received the certified letter. That my credit report will remain unchanged because they now use a different agency XXXX XXXX XXXX whom advise them the XXXX public records is accurate and needs to remain on my report. I submitted a dispute regarding a public record a few months ago ( 60 days approximately ) which was in writing via certified mail. The investigation resulted in no change and I inquired about how the dispute was investigated. I was informed a third party ( XXXX and LCI ) had provided information. I followed up with a second written dispute and provided supporting documentation showing an incorrect public record. I asked for a thorough investigation and explained why XXXX and LCI had incorrect information, as they only had access to Pacer and did not contact the record holder. I provided a statement from the original placer of the record and confirmed XXXX and LCI had not contacted them. After submitting the second dispute in XXXX the investigation was again closed without change and without reasonable investigation, so I opted for a 15 day reinvestigation, but was denied this right by the consumer reporting company who instead opened a new dispute and clearly stated they did not have to reinvestigate, even under XXXX XXXX 1681 and with supporting documents. The item was not removed as required by law during the reinvestigation period and I was told that my documents were not reviewed by the third parties XXXX and LCI. I would request the public record be removed as it contains an error and the consumer reporting agency did not investigate the claim properly.

Several times I've tried to work with LCI you deleted the bankruptcy they're listing on my consumer report. I've sent emails and letters inquiring as to how they got their information and how they supposedly verified the accuracy of said bankruptcy. They willfully refuse to delete the bankruptcy even though it can not be properly verified due privacy issues. Per Rule 9037 of the Federal Bankr uptcy Procedures section 205 ( c ) ( 3 ) that addressed privacy issues, the bankruptcy can not be verified due to information being redacted, such as a person 's full SSN ( only the last 4 digits of a social security number is listed ). This means that LCI is unable to properly prove that the Bankruptcy listed belongs to me. Furthermore, per the FCRA, XXXX is not a proper verification of a bankruptcy as the information is fished from the XXXX system and not actually reported to LCI. Per the FCRA, if a bankruptcy can not be proven with absolute certainty that it belongs to a consumer it is to be deleted. To date LCI refuses to comply with the FCRA or Federal Rule XXXX, they continue to site Pacer which as I've described above is fraudulent on behalf of LCI. It should be noted that XXXX XXXX deleted the bankruptcy to be in compliance with FCRA and Federal Rule XXXX. Yet LCI refuses to comply leaving themselves up to lawsuit and fines.

I was in contact with XXXX regarding a Public Record listed in my consumer file. XXXX stated LCI was the source of information. After multiple calls I finally got the chance to speak with a XXXX XXXX on XX/XX/20. Regarding the public record which contains an Chapter XXXX Bankruptcy. I requested the source of information I was told they do not provide that information. I asked for any file they had on me I was told I needed to contact XXXX. The company is stating that they are verifying/researching information about a bankruptcy to XXXX services ( please see attached where XXXX shows verified as accurate ). It is impossible to verify the information as the bankruptcy court does not verify the information ( see attached letter from bankruptcy court ). OnXX/XX/XXXX, I contacted the consumer reporting agency to dispute the information listed on the report, specifically, claim dated XX/XX/XXXX. I've never had late or missed payments on anything in my 74 years! My credit has been perfect. But to see what they reported to an auto insurance ( XXXX ) company was down right slanderous! I wasn't looking for an ins company but somehow my info, address, etc was given to them and they sent the ( rejection ) report to me and I just received it today to find out that my once excellent credit is in the dumpster because of the lies reported on me and my payment history - not one thing on it was true! On XX/XX/22, I contacted Lundquist Consulting Inc. ( LCI ) requesting a copy of my consumer report. The reason is because they are sharing false information to XXXX about me in the form of a bankruptcy. They responded stating that they do not have the authority to provide me a report that they are furnishing about myself and I have to contact the data source directly to request changes or a deletion of the information. They admitted that they did not have a proof that the information belong to me since they obtain the information via " obtained from a publicly available source ''. If that is so how did XXXX know that the information belong to me without having 10 percent of my personal information. I received a letter back dated XX/XX/2019 that they are unable to do such a thing because they are not a Credit Reporting Agency blatantly implying they do not have to follow the credit reporting laws that protect consumers. I requested a copy of my A-PLUS report from Verisk and learned that it had been used against me by an insurance carrier. The documents that came with the report directed me to call the Verisk customer inquiry center if I wanted to open a dispute regarding inaccurate information. I called the Verisk customer inquiry center and spoke to Angelys who refused to open a dispute, stating that if I wanted to dispute something on my report I had to contact the claims department of the insurance company myself and have them tell Verisk to remove the information from my report.
