This complaint is against Veripro Solutions. Many years ago my second mortgage from XXXX Disappeared and could not be found. Veripro solutions Inc Never registered change of lien in MERS or county to continue holding loan so it could not be found. I have requested an Allonge or assignment of Mortgage to Veripro from XXXX XXXX XXXXXXXX ; this should not be too much to ask considering XXXX countrywide lending problems. In XXXX of XXXX I was notified By XXXX XXXX XXXX they acquired servicing of loan from Veripro solutions. I requested all information from Veripro solutions of loan origination to them on XX/XX/XXXX after many attempts to XXXX XXXX XXXX. The sale of loan has no amount due on loan to XXXX XXXX for balance. The transfer of servicing of loan also has no balance due. The new service welcome paper work has no balance due. Veripro Solutions acquired loan on XX/XX/XXXX XXXX.From XXXX XXXX XXXX They have never contacted me ever, they held loan without servicing or had no intentions to collect on loan. Veripro solution Inc after reviewing has no NMLS license for the state of Illinois and has violated my rights by not sending statement or proof of loan. By not notifying they denied me my right to loss mitigation or dispute. Not only did they deny me all rights for three years they sold loan on XX/XX/XXXX and continued to service loan until XX/XX/XXXX again denying my rights to dispute amount on loan no monthly statements or loss mitigation. The new servicer claims payment has not been made since XX/XX/XXXX next payment due XX/XX/XXXX. Exceeding ten years in Illinois on promissory note and contract. Veripro solution has caused great hardship and cost to me in trying to resolve this matter, exceeding {$30000.00} on a loan balance of {$7500.00} Veripro Solutions paper work, loan affiliation for Illinois residents and their right to fair lending practicing, is In need of review for all lenders and consumers protection. I believe they hold many loans not apparent to many borrows in many states ( 205 ILCS 635/1-3 ) ( from Ch. 17, par. 2321-3 ) Sec. 1-3. Necessity for license ; scope of Act. ( a ) No person, partnership, association, corporation or other entity shall engage in the business of brokering, funding, originating, servicing or purchasing of residential mortgage loans without first obtaining a license from the Secretary in accordance with the licensing procedure provided in this Article I and such regulations as may be promulgated by the Secretary. The licensing provisions of this Section shall not apply to any entity engaged solely in commercial mortgage lending or to any person, partnership association, corporation or other entity exempted pursuant to Section 1-4, subsection ( d ), of this Act or in accordance with regulations promulgated by the Secretary hereunder. ( f ) Each person, partnership, association, corporation or other entity conducting activities regulated by this Act shall be issued one license. Each office, place of business or location at which a residential mortgage licensee conducts any part of his or her business must be recorded with the Secretary pursuant to Section 2-8 of this Act. ( g ) Licensees under this Act shall solicit, broker, fund, originate, service and purchase residential mortgage loans only in conformity with the provisions of this Act and such rules and regulations as may be promulgated by the Secretary. ( h ) This Act applies to all entities doing business in Illinois as residential mortgage bankers, as defined by " An Act to provide for the regulation of mortgage bankers '', approved XX/XX/XXXX, as amended, regardless of whether licensed under that or any prior Act. Any existing residential mortgage lender or residential mortgage broker in Illinois whether or not previously licensed, must operate in accordance with this Act. XXXX ( 2 ) Periodic statements. A servicer of a transaction subject to this section shall provide the consumer, for each billing cycle, a periodic statement meeting the requirements of paragraphs ( b ), ( c ), and ( d ) of this section. If a mortgage loan has a billing cycle shorter than a period of 31 days ( for example, a bi-weekly billing cycle ), a periodic statement covering an entire month may be used. For the purposes of this section, servicer includes the creditor, assignee, or servicer, as applicable. A creditor or assignee that does not currently own the mortgage loan or the mortgage servicing rights is not subject to the requirement in this section to provide a periodic statement, 1024.30 ( c ) ( 2 ) limits the scope of 1024.39 through 41 to mortgage loans that are secured by a borrower 's principal residence. The purpose of the early intervention requirement, the continuity of contact requirement, and the loss mitigation procedures is to help borrowers stay in their principal residences, where possible, while mitigating the losses of loan owners and assignees, by ensuring that servicers use clear standards of review for loss mitigation options 735 ILCS 5/13-206 ) ( from Ch. 110, par. 13-206 ) Sec. 13-206. Ten year limitation. Except as provided in Section 2-725 of the " Uniform Commercial Code '', actions on bonds, promissory notes, bills of exchange, written leases, written contracts, or other evidences of indebtedness in writing and actions brought under the Illinois Wage Payment and Collection Act shall be commenced within 10 years next after the cause of action accrued; but if any payment or new promise to pay has been made, in writing, on any bond, note, bill, lease, contract, or other written evidence of indebtedness, within or after the period of 10 years, then an action may be commenced thereon at any time within 10 years after the time of such payment or promise to pay. For purposes of this Section, with regard to promissory notes dated on or after the effective date of this amendatory Act of 1997, a cause of action on a promissory note payable at a definite date accrues on the due date or date stated in the promissory note or the date upon which the promissory note is accelerated. With respect to a demand promissory note dated on or after the effective date of this amendatory Act of 1997, if a demand for payment is made to the maker of the demand promissory note, an action to enforce the obligation of a party to pay the demand promissory note must be commenced within 10 years after the demand. An action to enforce a demand promissory note is barred if neither principal nor interest on the demand promissory note has been paid for a continuous period of 10 years and no demand for payment has been made to the maker during that period. In XXXX we noticed the interest rates going up on our new home loan ; We went through a company called XXXX XXXX XXXX XXXX was working with us in trying to get our interest rate. XXXX cooperated at that time. XXXX ( XXXX XXXX ) did n't even respond. ( We continued to make the payments. ) The next year ; The interest rate started climbing again. ( No the XXXX Turned out to be an interest only home loan, without us clearly understanding this. We had turned down a legitimate great loan but the sellers on the home, whom we thought were our friends, convinced us otherwise. Soon after, we went to XXXX XXXX XXXX, who turned out to be a scam. We saw it on the news on the internet after we had noticed they were n't advertising on the radio. XXXX of there attorney 's tried to take over the loan but he seemed like he was taken our money with no results with XXXX. I searched the internet and came across XXXX XXXX XXXX. Meanwhile XXXX was viciously trying to foreclose on us. The loan modification was successful on the first ( XXXX ). XXXX refused to work with XXXX XXXX Firm. XXXX suggested we come in and file a Chapter XXXX and was certain it would work. We filed for a Chapter XXXX under XXXX XXXX, the Chapter XXXX Trustee, and the could not find XXXX our whom it belonged to. After several attempts to get in-touch with XXXX XXXX XXXX XXXX dismissed our Chapter XXXX and our credit was messed up. My sister, XXXX XXXX 's husband had lost his job. My sister stated asking him for money and came to him for everything, down to putting a huge down payment on cars for her adult children. Not to mention, my niece put herself on my father 's bank account with the help on a friend of hers whom worked at XXXX XXXX. He asked me to become his Power of Attorney and I accepted. When I tried to change his account number and get on the account with him, XXXX XXXX told me I could not because I had filled a Bankruptcy against them and it could not happen. A certain amount of time, around 2 years, had to pass before I could get on the account. They did not care about a power of attorney because they had their own power of attorney. Soon after, on XXXX/XXXX/XXXX my niece and her mother conjured up a plan to take my father out of his apartment, which lived with my brother, and caused his utilities to get turned off for non-payment and left my brother homeless. He, my brother, had left everything he had to care for my parents since XXXX after my father had a XXXX and my mother came down with XXXX XXXX XXXX and walked away from her home in XXXX CA. I brought my parents to come and live with me and my brother to take care of them because I was still working. There was nothing I could do because at the time he wanted to stay with my sister for a while they move to the other children 's home. She would not let no one see or talk to him on the phone him but my brother whom she know was not a threat because he could n't do anything about it. He stayed in the XXXX for 3 days and went to XXXX for until XXXX/XXXX/XXXX which turned out to be my retirement date. The stayed with me and started recovering until his health started giving him problems from the past. He passed on XXXX/XXXX/XXXX. It seemed no one cared because as far as they were concern, he was XXXX of age. I feel if XXXX XXXX were not the crooks that they were ; this would have never happened. Now they want to run a lean on my home after resurfacing from the past. We tried to work with XXXX do business the right way. They disappeared. I do n't want to have to file Bankruptcy again. We are too old to try to rebuild credit.

My Complaint is against Veripo Solutions, XXXX, XXXX, XXXX XXXX, XXXX XXXX, XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX and maybe XXXX XXXX XXXXXXXX XXXX and XXXX if they had anything to do with this fraudulent claim. On XX/XX/2022, I was advised by XXXX XXXX XXXX. XXXX that their records reflect that XXXX was the master servicer of the loan. The loan was transferred to XXXX XXXX XXXX XXXX XXXX XXXX ) however, due to the delinquent status of this account, the account was referred to Veripo Solution XXXX XXXX XXXX for handling. XXXX XXXX stated in her letter that they do not service the loan and no longer have a record of the account ; however, in efforts to assist me they reached out to Veripo Solutions. XXXX XXXX from XXXX XXXX stated that Veripo Solution informed her that the increase in the amount owed is due to no payments being made for several years. Veripo Solution is a debt collector not a residential mortgage lender in the state of New Jersey. Since Veripo Solution is a debt collector they do not have authority to hold, transfer/sell a mortgage note. Veripo Solution nor XXXX, XXXX can collect interest rate on a mortgage loan since they are not residential mortgage lenders in the state of New Jersey. XXXX, XXXX 's Complaint stated that XXXX, XXXX was in physical possession of the Note of Mortgage which was allegedly in default for over XXXX ( XXXX ) years. After I filed a Motion to Dismiss counsel for XXXX, XXXX stated that they did not realize that they were not in possession of the physical Note they allegedly bought from XXXX XXXX. However, XXXX XXXX XXXX as servicer does not have custodial responsibility, they did not have any authority per the trust instrument to sell, liquidate, and/or convert the NOTE for its own personal gain. The documents submitted to the Court on behalf of XXXX, XXXX have never been verified. I am sure that the documents have been altered and are fraudulent. This company is seeking a payment in the amount of {$120000.00} from a Note which was initially in the amount of {$59000.00}. Counsel for XXXX, XXXX has never provided any original copies or any " true copies '' of the documents they state in their alleged file regarding my property. I have been provided with copies of copies that are redacted and altered in some form. I check with the XXXX XXXX XXXX and Insurance and verified that Veripo Solution is not residential mortgage lender in the State of New Jersey. I have never been advised that Veripo Solution was involved in the transactions of the alleged transfer of the Mortgage loan with regard to my property.

PLEASE see Case number : XXXX for additional supporting documentation that was sent last year. I was able to modify my mortgage through NACA XXXX Neighborhood Assistance Corporation of America XXXX ) and met with Home Loan Services XXXX Homeownership Preservation Team in the year 2009. MODIFIED XXXX home loan mortgage to 2 % fixed for life and to the market value of the home to {$360000.00}. REMOVED XXXX mortgage loan and moved balance to the XXXX home loan mortgage XXXX combined ). * ISSUE - A collection agency named Veripro Solutions thinks that my XXXX mortgage loan still exist. I sent them my loan modification documents/spoke with their representatives numerous times, to show that the XXXX MORTGAGE WAS REMOVED and the balance was moved to the XXXX mortgage. But they still keep sending me letters that I still owe the XXXX mortgage. XXXX My loan modification was personally negotiated with XXXX XXXX XXXX XXXX Assistant Vice President Loss Mitigation - Resolutions ) and XXXX XXXX XXXX Homeownersip Preservation Team ) from Home Loan Services XXXX XXXX XXXX Original Servicer ). XXXX personally explained to me how the loan modification would be with XXXX present. XXXX clearly even wrote and explained it to me on how the loan modification would be ( attached ). And XXXX stated that the XXXX mortgage was removed and balance combined with the XXXX mortgage. Loan Modification : XXXX XXXX loan mortgage deferred to 100 % LTV XXXX Loan to Value XXXX which would make it XXXX. * XXXX loan mortgage removed and balance moved to XXXX. Part of that balance/portion ( {$45000.00} XXXX will be postponed and be paid once the XXXX loan balance has been paid. If my XXXX mortgage was not removed and not part of the loan modification then : XXXX Why is my principal balance {$540000.00}? XXXX If my XXXX loan mortgage was modified to 100 % LTV ) * Where is the amount {$45000.00} coming from? last week, i called Veripro Solutions to see if i could negotiate a reasonable amount to release the lien that was included in my bankruptcy XXXX in XXXX. My case worker, XXXX, gave me an offer but I said NO because the property isn't worth it and he really tried hard to think he was smart and was going to compel me to make a bad business decision. However, i said NO and i asked if he could just send me a letter of that offer even though I WAS NOT going to accept it .... i wanted it in writing because i may have to file a quiet title or a motion to make them release the liens. The mortgages were discharged and last payment on this house was in XXXX. The first mortgage company just released their lien for {$120000.00} to me because this area in NJ was hit very hard by the crisis. My house is worth MAYBE XXXX at the most. I left for an extended period of time and someone broke in and started a fire there last month. On top of ceilings falling down, and the roof and the new furnace that is needed. I was willing to pay maybe a grand but nope i would rather it go to tax sale or consider filing a motion. the house isn't worth it i was trying to take care of it because its a duplex and this fire was at XXXX in the morning and there is a family that is attached to that building so i wanted to see what i could do so this doesn't happen again. i was willing to settle with 2 mortgage companys if i knew i could sell it fast to get my money back. i am not stupid and i know when to walk away ... i suggest XXXX XXXX understand that if he calls me again i will get compensated. His call today/time has been recorded in my journal. So .... my complaint is that he called me trying to collect on the offer that i clearly told him I WAS NOT GOING TO ACCEPT but i just needed it in writing. I told him AGAIN TODAY this debt was discharged in a chapter XXXX. he continued to annoy me until i hung up on him ... he was obviously not done harassing me and thought it was fun! game over XXXX!

This company has been attempting to collect on this debt for nearly 11 years now. I had a 2nd Mortgage with XXXX XXXX XXXX, which became XXXX XXXX. This company apparently collects for them. They have been continually sending correspondence offering settlement amounts, below what the full balance is, with incredibly short deadlines, like 2-3 weeks. When you call with " cash in hand '' to try and take advantage of the last offer, they always advise, that the offer was no longer good and say you have to pay the full amount of {$7800.00}. But in one of the calls, they learned that my home is nearly paid off and as a result have not been willing to take any sort of settlement. They allegedly sent a letter in XX/XX/XXXX, advising they were now going to be charging interest, going back to the time they obtained they loan I never received such correspondence ). In XX/XX/2020, we received an offer letter for {$1500.00} ish off the full amount of the loan of {$7800.00}. MY wife and i decided to try and take advantage of this and started to refinance our mortgage, so we could do this. The load was not completed in time, due to questions on lien holders on the house. Long story short, when I contacted Verirpo in XX/XX/XXXX, to ask for a payoff letter, I was expecting to get on showing the {$7800.00}, but instead they sent a pay off amount of {$13000.00}. Once again, when I am able to give them a payment, based on a letter they sent with an offer, they moved the marker again. I feel they are not acting in good faith to settle/collect on this debt in an ethical manner, as they keep changing the amount they want every time I have called over the years to pay them. They have never sent any notification of any other amount owed other than {$7800.00}, until I ask for a payoff, to change my mortgage.

In XXXX I sued XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX ( XXXX ), in Federal Court for reporting false, and duplicate information to the credit reporting agencies, and then refusing to take the information off my credit reports, after the issue was brought to their attention ( violations of the FCRA & FDCPA ). In XXXX, XXXX paid a substantial settlement to me in order to settle the lawsuit. The debt was a 2nd mortgage on my property. My complaint today is because I have since been made aware that XXXX violated the terms of the settlement agreement that they signed with me and are in breach of the contract, as our Settlement Agreement and Mutual Release ( SA ) specifically states and promises that I would be release " of all claims whatsoever '' ( item # 4 in the contract ) as a result of the agreement. However, I later learned that they sold the 2nd Lien rights to Veripro Solutions Inc. ( I am filing a complaint against them as well ). The 2nd lien they sold to Veripro is a " claim '' by definition, and was the only security they held against my property, therefore, XXXX is in violation of our SA. I am currently trying to refinance my house, however, Veripro has stated that the will not provide a lien release on the 2nd lien that XXXX sold them, until they are paid {$35000.00}. I have now suffered damages, as my lender is unable to secure a lien release. XXXX was unable to respond to a recent Validation request yet is demanding $ XXXX for the lien that XXXX had already promised to release me from.

Back history : We purchased our home in XXXX of XXXX with an XX/XX/XXXX loan. The 80 % was with XXXX, the 20 % was with XXXX. Roughly in about XXXX we got behind on our house, XXXX sold our loan to XXXX XXXX XXXX at that time we thought that they had purchased the 80 % and the 20 % at the same time since we had done a modification with them. Since after XXXX we have never received another bill from XXXX. Fast forward to XXXX we started the process to refinance our home and when the title company came to pull title we found out there is a Lien on our home with someone named XXXX, They are listed on the MERS website as the Lien. MERS # XXXX I have never heard of them up until 60days ago. I have tried to work with XXXX XXXX to release lien since I have talked to numerous people at the office stating that they have NO account under my name, my husbands name, our property address, they only reason I am talking to them is that they hold lien on my home. I have talked to Veripro Solutions and they only thing they can provide me with is a DEED of trust. I have requested the NOTE over 20 days ago. And every time I have spoke to some one they keep telling me they are researching it and it will be 3-5 business days. I have multiple emails and phone calls from them. Stating that they have escalated there manager but NOTHING has happened. There is still a lien on my house and I can not refinance and no one will provide a NOTE or proof that the debt is valid.

My mother is XXXX I have some major concerns with Veripro Solutions ( VS ) because I have tried to negotiate settlement with 2nd mortgage debt. I received a reduced payoff offer of {$4300.00}, however I spoke to the point on contact with this account that stated the reduced payoff amount is {$5000.00}. I property is in my mothers name and I informed them that I would like to discuss settlement options. I informed XXXX that my mother XXXX XXXX and I was trying to discuss to settle the account. I informed her that I paid off the 1st lien for a lower amount, which I have faxed documentation to show the lower payoff amount. She stated that she was unconcern with my financial hardship and that I would be responsible for agreeing with the payoff offer or I would lose the property. Venripro Solutions is trying to take advantage of our family because the representative stated that they would sell the home since VS is now in 1st lien position. There are several issues ( 1 ) property value decreased ( 2 ) VS tried to increase settlement offer ( 3 ) no income ( 4 ) trying to sell the property without my consent. I cant afford the required monthly payments or come up with enough to pay off the total amount of the debt ; I have tried to negotiate a settlement for 2nd lien position.

In XXXX of XXXX, I found the company Veripro Solutions who held a 2nd mortgage lien on my property. This was from my original mortgage when I purchased the property in XXXX. I paid it for a few months until I was diagnosed with XXXX in XXXX. I was unable to pay both mortgages and stopped paying the 2nd mortgage after requesting. I was never contacted by the 2nd mortgage lien holder since I stopped paying it. It has been transferred a few times since then. I entered into an agreement on XX/XX/XXXX with Veripro Solutions to pay {$250.00} per month until a Bank they suggested would refinance me to include the 2nd mortgage pay-off of $ XXXX. The process with XXXX XXXX XXXX XXXX XXXX started in early XX/XX/XXXX and not has been stalled because Veripro Solutions can not produce the proper paperwork for the Bank 's title company so the loan can close. I have spent $ XXXX out of the closing costs to keep the rate locked in with the bank@3.25. I have called Veripro Solutions, my account rep XXXX XXXX 4 times since this process has started and he continues to tell me that the investor will not produce the paperwork the title company is requesting. I was just informed again today that the rate lock has expired and I will have to pay again to keep it at 3.25 % Thank you, XXXX XXXX XXXX XXXX XXXX

Document B Veripro Solution never contacted me, The note requires in notice section Document A any notice that must be given to me under this note will be given by delivering it or by mailing by certified mail addressed to me at the property address above. 1st Breach of contract. On XX/XX/XXXX Veripro solutions sold loan to XXXX trust owner XXXX and retained servicing with out notification to me 2nd breach of contract. On XX/XX/XXXX Veripro Solutions transferred Servicing to XXXX XXXX XXXX with out notification to me again 3rd breach of contract.Veripro Solutions never changed loan assignment in MERS to them selves, which made loan transparent to find. XXXX XXXX XXXX did not contact me until XXXX of XXXX Upon request i was sent false information, i can only assume came from Veripro Solutions. Document B In XX/XX/XXXX after not receiving proper information from XXXX XXXX XXXX I requested information from Veripro Solutions Dated XX/XX/XXXX. I have contacted Veripro Solutions, Inc numerous times in XXXX, XXXX, XXXX and XX/XX/2019 to try and settle my delinquent 2nd mortgage for less than owed. Each time I was verbally told the full payoff amount was {$47000.00}. I tried to settle for less than owed and each time I offered an amount, the representative stated they had to submit the request and never called me back. Now I have put the home up for sale and when the title company requested the payoff, it was {$61.00}, XXXX. This servicer never stated anything about past due interest in any conversation regarding the full payoff. I have tried to speak with the servicer of the loan but they state the payoff is out of their control. The owner of the mortgage note is a Trust that states I must speak to the servicer who is the acting agent on their behalf. In XX/XX/XXXX-XX/XX/XXXX I was in the process of trying to settle an old mortgage with Veripro and, unfortunately we could not reach an agreement. Approximately 10 days ago I contacted Veripro to try and settle the account and after speaking with the representative, we were again unable to reach a settlement amount. During the conversation, the rep mentioned that the reason we had not heard from them was that there was a " Cease and Decist '' letter on file. The rep then asked if I wanted to remove the letter so they could contact me regarding any specials or promotions and I declined. She attempted to persuade me to remove the letter a few more times and I said no. Then 2 days ago, my wife received a voice mail with an aggressive message from the rep stating we needed to call right away! I can not believe they would blatantly disregard our Cease and Decist letter and also our request via phone to not be contacted. This is NOT ok.

I filed chapter XXXX bankruptcy in XXXX. The bankruptcy included all my debts including my 1st and a 2nd mortgage. Recently I have tried again to obtain a loan because I have more equity. I now have a finance company willing to work with me, however Veripro Solutions says I now owe {$45000.00}. I dont understand how they came up with this pay off. During this pandemic I need to refinance my loan due to financial circumstances and Veripro Solutions is taking advantage and is bullying consumers.

I received a letter from Veripro Solutions and while they did lower my amount owed it is not lowered enough to pay. I am requesting them to lower the amount so that I can resolve this debt they say I owe. While I do appreciate them lowering the amount they say I owe, they have given me less than a month to find a lender to refinance my house, which I am finding impossible to do because of the time and the lien they have on my home. I don't understand how a debt collector can only give you less than a month to resolve this issue. Currently my wife is unemployed because of Covid pandemic and finding a loan without her salary is tough. I feel that veripro is out of touch with reality and is not in the business of helping consumers to resolve these financial issues. If they really wanted to help they would be more sympathetic to us consumers and give us a fair settlement during these difficult times.

The company that purchased my home equity load which was discharged through bankruptcy six years ago has contacted me and told me that my debt was satisfied through some government program and that they were sending documents to city register to remove the lien from my property. I had to sign some Dodd Frank form and forward it to them. I did that. This was back in the beginning of XXXX. Since then I have checking acris.nyc.gov website to see if the lien was removed but nothing happens. I have contacted the company numerous times and each time they are telling me that the paperwork has been submitted but nothing happens. I went down to the city department that handles the liens and they told me that it takes 5 weeks to process a record. It has been way longer and I am afraid that this is some kind of scam.

I have tried repeatly to get the amount of the debt so I can do a settlement to no avail. I did a loan modification in XXXX when I had a first and second mortgage.
