To Whom it May Concern, I have been being constantly harassed by Vargo XXXX Janson, a law firm in XXXX, CO, attempting to illegally collect outdated tuition costs on behalf of the University XXXX XXXX. I filed bankruptcy and qualified as a result of the outstanding tuition bill I had with the University XXXX XXXX. At the time this debt was incurred, I was a lot younger and I made the mistake of representing myself in court after Mr. XXXX responded to a complaint I made against him to the US Bankruptcy court. His law firm continued to illegally garnish me after the debt was discharged, per the documentation listed in regards to my bankruptcy. He stated it was a student loan even though neither this law firm or the University are a student loan provider ( the University XXXX XXXX is also legally registered as a non-profit ) and the court initially ruled that they were not. The judge presiding over the complaint not only ruled in favor of the law firm stating the debt was a student loan, but he denied my hardship dischargeI did research and found out he also attended XXXX : His name is XXXX XXXX XXXX. Apparently he is continuing to issue new judgements to collect on this debt. The trustee of the bankruptcy court, XXXX XXXX, initially discharged the debt and disagreed with the Judges ruling. I also owed a small amount of tuition to XXXX XXXX University XXXX XXXX at the same time I filed for bankruptcy, and this was discharged as a bill/debt and not a student loan. Same circumstance, different school. I had outstanding Federal student loans that were not eligible for discharge on which I currently make monthly payments via XXXX and XXXX. I contacted the US Department of Education and they stated Mr. XXXX was committing fraud - and they have no record of this debt being listed as a student loan or qualifying as such. The representative advised I report this as fraud if he tried to illegally collect again - I received a wage garnishment order today from my employer. Another issue regarding this is that if this is a student loan, they have consistently broken the regulations and laws surrounding student loan repayment. The last time I dealt with them they wouldnt offer me less than a $ XXXX payment plan ( this was in 2018 ). I made less in 2018 than I do now, and the actual student loans I have are only charging me $ XXXX combined. I was never given an income based repayment plan option or any other options legally allowed by the US Department of Education. They have also garnished my paycheck when I was in school, and never offered a forbearance option. In either case, XXXX XXXX XXXX has consistently broken multiple state and federal laws in regards to this debt, and I am asking assistance in receiving justice and possible restitution. Even if I had not have declared bankruptcy, he should not have been allowed to collect on this tuition past the seven year mark. When I first reached out to an attorney, they wanted {$8000.00} to defend me and prevent MrXXXX XXXX from illegally collecting on this debt. I did not have that at the time and was unaware I had other options, which is why I am reaching out to you eleven years later. Dear Sir or Madam, I am writing to file a formal complaint against Machol & Janson LLC regarding their actions in relation to an alleged debt collection on behalf of the XXXX government. This complaint pertains to a series of incidents that have raised concerns about their practices, including potential fraud and harassment. I first encountered Machol & Janson LLC in XX/XX/2023, when they claimed to be representing the XXXX government in the collection of unpaid violations and liens. I was informed that the total amount owed had escalated to $ XXXX, despite my suspicions about the legitimacy of these claims. I took the following actions : 1. I contacted the XXXX government directly and paid all outstanding liens and violations online ( about {$600.00} ), as there was no record of any outstanding penalties or liens on their official website. 2. I blocked the phone number associated with Machol & Janson LLC to prevent further harassment. 3. Subsequently, Machol & Janson LLC continued to send numerous letters, all asserting that I owed them money. I remained vigilant and unresponsive. In XX/XX/2023, an individual appeared at my doorstep and served me with documents claiming to be a summons from the XXXX XXXX XXXX. This was the most alarming development, as I was unable to find any active case against me in the court records. Given the discrepancies between their claims and the official records from the XXXX government, I believe Machol & Janson LLC is engaged in fraudulent and harassing practices. They have misrepresented their authority, creating undue stress and inconvenience. I kindly request that you and the relevant department investigate this matter promptly. I believe Machol & Janson LLC 's actions are in violation of consumer protection laws, and their misrepresentation as a government entity is deeply concerning. I am seeking the following actions : 1. An investigation into the practices of Machol & Janson LLC to determine if they are engaging in fraudulent debt collection and harassment. 2. An official response confirming the authenticity of the summons they served, or assistance in addressing any illegitimate legal actions against me. I sincerely appreciate your attention to this matter and the action taken to ensure that Machol & Janson LLC is held accountable for their actions, and no one will be deceived by their scams. In XX/XX/XXXX and XX/XX/XXXX I was at XXXX XXXX college trying to the knowledge I needed to be a successful automotive tech and because of the school regulations after my class was over I met after school to meet an instructor at his shop to help with homework and to help me understand how a business works at XXXX I was not an employee however a creditor started making calls there and I didnt appreciate being bothered while I was trying to learn. I went on from XXXX to go to XXXX XXXX after this creditor messed up my relationship I had with the instructor at XXXX .. Im still very XXXX this even happened and I lost XXXX dollars because I failed that semester and creditor took school funds. I told this creditor I was in school and it was on a legal document in XXXX county however I was completely ignored While attending XXXX XXXX I was offered a chance to attend training and schooling at a body shop all was through XXXX XXXX in XXXX and it was not a job. In XX/XX/XXXX Janson and vargo started garnishments on student funds took XXXX creating problems with my tools then continued to take XXXX a week till XX/XX/XXXX when I was placed on medical leave Im furious that I was bothered while trying to pass a very hard course. Thanks to janson and vargo my position was given to someone else and I lost the tools that where given to me XXXX from XXXX XXXX. My tools are now being repoed Im 13 weeks behind. So I spent 30 years trying to build a career only for screwed up creditors to destroy everything I worked hard for. I filed many complaints on here and other agencies and was told that I was sent documents to exempt this yet no papers ever showed up at my address. I was completely taken advantage of if I knew everything about law I wouldnt be having to pay for an attorney constantly. Your a complete disgrace and hope your happy with completely destroying my life all over a debt I doubt I owed. I just had to freeze my credit do to fraud and identity theft

In XXXX I was in a car wreck but was making payments on bills. I assumed debt was paid off. However about two years ago someone acting to know me called me at work when I noticed it was n't anyone I knew I hung up phone. I was servered papers by someone that was very rude and got me in trouble with work stating they where going to have a court date and begin garnishment of my wages however I was in college at the time and not getting paid for my work I was in a training position volunteering my time to gain knowledge of my profession. Creditor XXXX XXXX XXXX took my XXXX dollars of a student loan I was getting to pay for my classes I have records from XXXX to prove this fact and caused problems with my courses because they took my funding for college courses at XXXX XXXX XXXX which I also have records showing I was in college there from XXXX to beginning XXXX then I was at XXXX XXXX XXXX of XXXX XXXX to XX/XX/XXXX. I lost my position at XXXX due to harassment by creditors on business phone. I was recently highered by a collision center XX/XX/XXXX about two weeks ago I was served again garnishment papers which then also got me in trouble with my work that to is only a training program but I do get paid enough to pay for tools needed for my jobs duties. I missed payments on my tools due to garnishment and it 's causing problems at my work. For several month I received calls about this debt and still have them saved on my phone. I was not given any chance to defend myself either and talked to an attorney which said there is a statue of limitation on debt of 6 years however it 's been over 14 since. I hope something is done about this.

The company and their lawyer has only given me limited information on the debt, so it is hard to say what it is. I had numerous credit card numbers stolen 11 years ago and didn't find out until the accounts were closed, that it happened. I didn't know what to do. The tactics performed by this company and their lawyers seem unlawful. They are trying to have me arrested, despite their limited knowledge of the account. They can't prove that I owe the money, based on the letter they sent me with all the info. It was only a single sheet of paper. I requested the full file on the account and their lawyer XXXX said that is all they have. They obviously bought the account for pennies on the dollar and are trying to harass me to get over $ 10K from me. They know that I don't hold a job and am XXXX. They continue to harass myself and my parents. One of their employees who delivered a letter to my mother used inappropriate language when dropping off the court hearing request. These tactics need to be looked into, because my poor mother shouldn't be cursed at by some sketchy XXXX they employee. I also find it funny that the addresses listed online for both businesses are the same. Seems like they are trying to pull something on consumers to parade around to be an entity which they aren't. Please help myself and others from further harassment caused by these bottom dwelling low-life lawyers only out to get rich at the cost of people 's livelihood.

Im going to state this again Im beyond fed up with XXXX and XXXX XXXX and XXXX XXXX. I have had funds taken from me while I was in school and filed complaints on here yet they claim they didnt know I was in school which is a flat out lie. I have multiple records from all my previous complaints. This has been going on for several years and no they will not get to garnish anything else from me .i have stated I didnt recognize these bills and someone has been able to get my information and was using it. They used it to buy things in my name including phones this is reported with the XXXX XXXX police and other fraud companies. I have now frozen my credit. I never had a card in XX/XX/2007. I do however think its absolutely ridiculous that these companies and collectors have continually bugged me for several years. No you will not get any more funds from me period go jump in a lake. I will fight this until all my funds are returned

I received a notice of Collection letter from Vargo and Jansen. I submitted a request to have the debt verified. I outlined specific Information that needed to be included. I said that if it could not be provided to me, to not contact me again. Vargo & Jansen still contacted me trying to use their generic tactics to verify a debt. A couple of statements showing no activity and fees being charged on top of fees doesnt cut it. I asked for the original signed contract between myself and the original creditor. That was not provided. I feel that Vargo and Jansen violated FDCPA because I asked not to be contacted if that couldnt be provided. They contacted me anyway. I am currently working with a family friend to take Vargo and Jansen to small claims court for the FDCPA violation. I do not owe this debt. I have attached the letter I sent and their response.

My identity was stolen years ago including credit card numbers. Some company who bought this debt, even though I told them that it was the result of identity theft, has been threatening to have me arrested. I have filled out all information to the best of my knowledge and returned to the courts. I am XXXX XXXX so it is hard for me to maintain a job to either file bankruptcy or hire a lawyer.
