This matter arises out of a dispute sent to XXXX XXXX on XXXX XXXX, XXXX at XXXX XXXX XXXX in XXXX, NH XXXX. ( See : Attachments ) XXXX XXXX failed to reply to my XXXX request and upon dispute transferred the debt to XXXX XXXX XXXX. ( See : CFPB Complaints # XXXX and # XXXX ) Upon the CFPB complaints XXXX XXXX XXXX then transferred the debt to Valentine Kebartas who is attempting to collect the same debt that has yet to be validated by XXXX XXXX and/or XXXX XXXX XXXX. In response XXXX XXXX XXXX in complaint XXXX I specifically stated my opposition to XXXX XXXX XXXX that I did not authorization and/or consent to the release, transferring, selling, intrusion, data sharing, etc., of my private and/or personal identifiable information. I requested that any and all file ( s ), contract ( s ) and or information containing the name " XXXX XXXX '', address, email address, phone records, social security number, credit card information, phone number ( s ), etc. in any variation, spelling or derivative is to be DELETED from XXXX XXXX XXXX records. The company has dishonored my request. I also opposed to the disclosure, publicizing or revealing of any personal identifiable information to XXXX XXXX XXXX or any third party entities ; data broker services, direct marketing services, directory services, sponsors and entities in which XXXX XXXX XXXX is acting as an agent ( s ), licensee, joint venturer, publisher and or any other services that are affiliated with XXXX XXXX XXXX. Valentine Kebartas and the aforementioned companies have violated 15 U.S.C.1692 et seq. in attempts to collect a debt by using false, abusive, deceptive, or misleading representation or means in connection with the collection of a debt ; attempted to extort payment with false litigation threats, false garnishment threats, threatening to enter a judgment also in violation of Section 807 ( 5 ) of the FDCPA, 15 U.S.C. 1692e ( 5 ) ; and Section 807 ( 4 ), 15 U.S.C. 1692e ( 4 ) ; Valentine Kebartas are " debt collector ( s ) '' engaging in deceptive and abusive practices that violate the FDCPA. In XXXX, the " FDCPA was enacted as a broad remedial statute designed to 'eliminate abusive debt collection practices by debt collectors, to insure that those " debt collectors '' who refrain from using abusive debt collection practices are not competitively disadvantaged. I had an account with XXXX XXXX but was mislead from the beginning on what the monthly payments would be. After that I switched my account over to XXXX who was supposed to pay off the transfer fees but never did. I received Collections calls from a company called Valentine and Kebartas regarding the debt. I worked with them for some time making bi weekly pmts of XXXX dollars. I had paid off almost half of the debt and came upon harder financial times. I spoke to a single rep regularly, but one day when i called back I spoke with a rep I had never before spoke with. I made a pmt of XXXX dollars and made him aware that I would only be able to pay monthly and that I would not be able to afford to pay what I was paying before. He told me that was fine and that he would schedule for me to be called in a month. Following that payment and agreement with the rep, I continued to receive up to five collections calls per day. After a week of receiving those calls during work and at all hours, I finally answered and spoke with the rep that I normally worked with. I asked why I was still receiving calls after having made a payment and worked out an arrangement with the other agent. She told me that the payment I made was not enough and that the account had been sent back by the " System '' and that is why I was still getting calls. After having worked with them for so long and even having made a payment as recently as the day before, that amount of calls was definitely harassment. Statements of my account automatically being sent to the system were also false and misleading. I work in collections and am very familiar with the way an auto dialer works and the work that is taken to load them. Arrangements should not have been agreed to if they were supposedly not " sufficient '' to keep them off of the dialer. receiving collections calls the next business day after having made a payment and agreements, is harassment and not fair collections practices. And blaming those tactics on the " system '' is misleading and a downright lie. I discussed witht he rep and a supervisor settlement options to avoid legal assistance or escalated complaints, but was not given any real help. I have already paid over half a debt for a service that I practically never used, and canceled because of misleading and deceptive tactics used by a sales rep belonging to the same mother company, XXXX XXXX.

I owe a bill XXXX from early cancellation of contract for {$1000.00}. A debt collection agency, Valentine & Kebartas, contacted me on XXXX XXXX, 2015 to arrange payments for this debt from phone number XXXX. The employee of theirs setup payment arrangements of {$25.00} a month which I paid on the XXXX of every month until suddenly I received a call XXXX XXXX stating that the payment arrangement did n't count because the employee was never authorized to setup such an arrangement and has been fired and that I needed to either pay the whole balance or split the remaining {$1000.00} into 6 monthly payments. I explained to them that I should n't be punished for XXXX their employees mistakes and that an arrangement had been made on a recorded line and that I refuse to agree to a new arrangement. I was transferred to the night shift supervisor around XXXX XXXX who said he would keep the payment arrangement the same and transfer it to his accounts and would just call me the XXXX of every month to collect the {$25.00}. I woke up this morning to a missed call again from this agency XXXX and then received another call XXXX stating that their is no payment arrangement and that I need to pay the balance in full or break the now {$980.00} balance into XXXX monthly payments. I again asked for a supervisor and spoke with XXXX, who stated that there is no payment arrangement and he is the one who approves all payment arrangements and that {$25.00} a month is not acceptable and that is why the payment arrangement had been cancelled. I asked him how he could cancel an arrangement that had been okay for past 3 months and he said that it did n't matter that I needed to setup a new arrangement. At this point in time I told them I would be contacting the government because they made an agreement on recorded lines and are breaking them and making false representations. He explained that collection efforts and calls would continue until I agreed to more than {$25.00} a month because that amount is not acceptable and then said okay in reply to me filing a complaint and hung up. I do not believe this should be allowed or else what is the point of having agreements if they can simply break them twice in one month and then act like I have no choice but to accept a new arrangement at 6 times the original payment amount!

I have had several conversations with XXXX XXXX @ Valentine & Kebartas, XXXX in regards to a debt owed by XXXX XXXX/XXXX XXXX XXXX to XXXX XXXX ; the balance is {$7800.00}. XXXX/XXXX/2017- I asked about a SIF ; XXXX offered 1X- {$5800.00}, 2X- {$6100.00}, 3X- {$6600.00}. told me absolute lowest he could go was the {$5800.00}. Told him I would have to get back to him. XXXX/XXXX/2017-XXXX called as follow-up ; I offered 1X- {$3900.00} ( 50 % ) ; now he said he can come down to {$5400.00}, after he told me on XXXX/XXXX/2017 he could n't go any lower than {$5800.00} ( so he lied to me ). I advised to both I would not be able to afford that and would only be able to pay $ XXXX/month. XXXX 's response was that he would not be able to accept that. I responded stating I would just send that amount to either XXXX or his office, did n't matter to me because they would not refuse the money. Call ended after speaking to supervisor XXXX XXXX XXXX/XXXX/2017-XXXX called again asking for intentions. Advised same thing as previous conversation. XXXX 's response was to ask me if we were represented by an Attorney. When I inquired why, he responded stating that this account would move further along ( implying we would be sued ) if I did n't pay exactly what he was offering. He ended call stating he would advised to move this account from his office ( not sure who he is advising ; supervisor, manager, attorney? ) Also stated he would no longer call me, but would only speak with XXXX XXXX, the owner of the company. XXXX/XXXX/17-XXXX called ( Caller ID showed " MAP VER '' XXXX ; he is calling from MA not NY, why is this company trying to deceive me with an incorrect phone number? ) XXXX opened the conversation with what I could pay. I advised we planned to send the {$500.00} as previously discussed, but I was waiting to be contacted by an Attorney 's office like he had advised would happen on the XXXX. When I questioned him on threatening legal action, he immediately tried to retract what he said and said to just send the {$500.00} in ( which he previously told me on several occasions that he would not accept that amount ). I ended call advising I would be submitting a complaint against him and his company with the CFPB for threatening legal when there was no intention of doing so.

We signed up with XXXX XXXX XXXX XX/XX/XXXX and had an automatic draft to pay for services. We never signed a contract for any length of time with XXXX or XXXX XXXX to provide security monitoring for our home. As a security monitoring service, we understood that the agreement was month-to-month, and that all we would need to do to cancel the service was to contact XXXX and cancel the service. I am a member of the military and received orders to move XX/XX/XXXX. As there were many distractions with the move, it was n't until XXXX XXXX that I called to cancel services. I was told that I would have to cancel with the Home Owners Association, which sounded odd. When I called the Home Owners Association, I was told they had no part of our security monitoring system. I called XXXX back ; they again told me to call the Home Owners Association. I told them I did that and that was n't the case, so they reluctantly said they would cancel service. The following month, XX/XX/XXXX, a payment was drafted, and I called again to figure out why. The representative said to cancel with the home owners association and I told her of the previous exchange. After some coordination on her part, she assured me that service was terminated and that we did not owe anything on our account. She said the account was closed and there was no outstanding balance. Following this conversation, there were no more bank drafts. Then we received a letter from XXXX XXXX on XX/XX/XXXX saying we owed {$260.00}. We called XXXX XXXX between the XX/XX/XXXX-XX/XX/XXXX, and spoke with XXXX XXXX. He looked up our account but it did n't report an outstanding balance, so he told us to disregard that letter because it was probably a mistake. Then on XX/XX/XXXX we received a letter from Valentine & Kebartas for a debt collection in the amount of {$300.00} related to XXXX XXXX. I wrote a letter disputing the debt. We received another letter on XX/XX/XXXX from Valentine & Kabartas notifying us that they are " confirming our payment arrangement '' in the amount of {$300.00}. Within this letter they provided a person to contact, XXXX XXXX, with any questions. I called twice on XX/XX/XXXX and was assured she would call back if I left a message, and still have n't received a call back.

I was contacted about a debt from Valentine and Kebartas about a month ago and I told the person that now was not a good time for me to talk and that she needed to call back at a different time. She seemed to be understanding, but a month later I received a harassing phone call from a customer service representative about this debt and they said it was XXXX. They wanted me to verify my social security number and my date of birth and I refused. I asked her did she look up the information that the other person had told her and she said yes, but that she was still calling about this debt. I told her to send me a debt validation letter and she said that one was mailed, and that I needed to take care of this. I told her to stop calling me and to send me the letter. She told me that she would continue to call me after I told her that the law states that, that she can not harrass me once I tell her to stop calling me. I then hug up the phone on her. Today, on XX/XX/2021 at XXXX. A representative called and pronounced my name wrong and wanted me to verify my information and stated that this was an important business matter. I asked him what this was about and he kept asking me to verify my information. He asked for my address and my social security number and I wouldn't give it to him. I was then frustrated because I heard all of this loud noise in the background and told him that he needed to turn his TV down. He then kept asking me for my information and I told him no and he said well you verified it on the XXXX and we have been sending you letters. I kept asking him what this was about and he refused to say. The noise in the background was getting louder and I told him that I could barely here him. He then replied that it's COVID-19 and it's his kids and that he is working from home. Then he kept asking for my information, I told him that he needs to stop calling me and that they need to send me a debt validation letter. He hung up the phone on me and told me that it was because I didn't very my information.

The debt collector handling my federal student loan, Valentine and Kebartas, LLC, has not notified me about their possession of the loan or the status of the loan. I also believe Valentine and Kebartas, LLC is avoiding my calls and correspondence so that they can continue receiving a tax offset and now garnish my federal stimulus for covid-19 relief. I hope that is not the case. Valentine and Kebartas, LLC currently has a default status setup on my XXXX federal student loan, has charged over 25 % interest, and recently received my tax refund ( of over {$3400.00} ) in full for an amount greater than my original student loan ( {$3200.00} ). The loan is currently still in default and based on these actions, despite my severe financial hardship during covid-19, it appears that Valentine and Kebartas, LLC is still looking to receive more. I have entered severe financial hardships, and was unaware that this loan even existed thinking I had consolidated it with other loans. The loan has been through 3 different service providers, and I have not been notified of these changes or of the additional interest that would be charged to my account. I was also not notified that my account was in default. Furthermore, I was not notified that a tax offset was active for this loan. Last, I was not made aware of any options I had to remedy the loan, call, or make payment arrangements. I have tried contacting the debt collection agency several times over the last four weeks. I sent Valentine and Kebartas, LLC a fax on XX/XX/XXXX and called their number ( XXXX ) XXXX numerous times with no response. Their telephone number sends me to voicemail, and they do no list an Email address. Per federal student loan guidelines I should have been informed of the nature of the loan, the new handling of the loan, options to remedy the loan, and a notice of tax offset, I have not received any of those notices and was taken by complete surprise. Per covid-19 relief efforts, I currently have rights to my full tax refund.

Several months ago, Valentine and Kebartas, Inc. ( VKI ) began contacting me using my work cell phone number regarding the collection of a student loan debt that is not mine ( I have never carried a debt related to student fees or tuition and this simply can not be my debt ). Each time I was contacted ( at least XXXX times in the past 4 months ) I responded by indicating that, while I have the same first and last name of the individual they are seeking, I am not that person. We have different middle names, we live in different states, and we have different social security numbers ( why would I know that? see below ). In some cases their telephone representatives were rude and dismissive. In XXXX case, their telephone representative hung up on me. Despite my repeated attempts to dispute the claim and assert that I am not the debtor, VKI has continued to contact me by calling the main reception line at my workplace and by sending " orders of withholding from earning '' statements to my work address. These notices include the full name, address, social security number, and total amount currently due of the debtor they are seeking to collect from. At first I thought it was simply incompetence that led them to make repeated attempts to contact me via my work cell phone. When they began contacting our main reception line and sending XXXX Mail to my work address, I realized it is not incompetence. Through their repeated attempts to collect a debt from an individual who has made a good faith effort to inform them of their mistake, VKI has:XXXX. ) Demonstrated a clear and willful pattern of creditor harassmentXXXX. ) Negligently violated the privacy of the actual debtor by freely distributing that individual 's name, address, social security number, and " amount due '' XXXX. ) Negligently caused damage to my personal and professional reputation

Company named Valentine & Kebartas keeps calling about a debt they purchased from XXXX, XXXX purchased from XXXX, XXXX was XXXX XXXX. I originally had my loan with XXXX XXXX. The company in question will continue to call my personal cellphone, then call my place of employment during the day. Tuesday after attempting to call my cell phone 5 different times from all different numbers they then proceeded to call my place of employment. I answered the phone and requested for the 4th time that they don't call my office ( this has happened before ). I told them to call back tomorrow, they did while i was at work, I told them to call me after work and I gave them a time that worked best for me. They called me back XX/XX/2020 at XXXX, I spoke with a gentleman who claimed to be the case manager. I told him that my wages are already being garnished for Federal Student loans and that I had just enough money to live on and no way to pay them. They then threatened me and said they would come after me. I stated that I already have my wages garnished, get in line with the rest of the loan servicing companies. He then got extremely upset, cursed at me and threatened me again. I got a fax today at work for employment verification, which I filled out and sent back. I have a feeling that they will continue to harass me and threaten me. I told him that his actions were unprofessional and unethical, that is when he got very angry at me, cursed at me and hung the phone up. I know my rights and I know that this is not how you should be treated. That is why i have decided to file this complaint.

Between the time of XXXX and XXXX ( XXXX XXXX XXXX ) on XXXX/XXXX/2016, I received a call from the phone number XXXX. I spoke to a lady there. She did not give a clear description on who she was calling regarding. She told me that my credit card was n't going through, etc. I was transferred to her supervisor. Her supervisor told me that he could not take half of the payment after I offered to pay half. He said I was " calling his bluff. '' He raised his voice and said " XXXX wants this NOW '' and " you can not pay half. '' period. You owe a debt. you pay it. I informed him the line was recorded. He said, " I know the line is recorded. I am not stupid. '' I told him I was going to report him verbally abusing me and harrassing me. He said he didnt care. He was very verbally abusive. He said many more things and was raising his voice at me and yelled at me saying I had to pay the whole amount. I called back in around XXXX XXXX, I spoke to another person who said that the supervisor was lying to me and she could take half of the payment. She gladly took half of the balance that I owed as a payment. The supervisor harassed me and bullied me. He also practiced deceptive collection practices, which is completely illegal. Please take care of this issue. I was on the phone in tears after my phone call with them. I did not get the name of the agency when they called, I 'm sorry, but that is their phone number. We received an attempt to collect a debt from Valentine & Kebartas , LLC through the mail on XX/XX/XXXX. We disputed the debt and requested that they no longer contact us for purposes other than verifying the debt, this letter was mailed to Valentine and Kebartas on XX/XX/XXXX. Valentine & Kebartas , LLC made no attempt at verifying the debt, instead the next time we heard from them was on XX/XX/XXXX when we received yet another letter attempting to collect the debt and ignoring our request not to do this until they could verify the debt first. I sent them a second letter in response that was mailed out on XX/XX/XXXX reiterating our dispute of the debt and the need for verification before any attempts at collection continue. Again we did not receive any attempt to address our dispute or verify the debt. Instead, on XX/XX/XXXX we received a third letter from Valentine & Kebartas attempting to collect on the same debt despite us requesting on XXXX separate occasions not to do so until they could verify the debt. On XX/XX/XXXX we mailed them a XXXX response notifying them we are still disputing the debt, we still expect not to be contacted for purposes other than verification and also notified them that they are now in clear violation of the CFPBA and I would be reporting their violations to the FTC.

It is absolutely ridiculous that I am being harassed by this company. I was called on XX/XX/XXXX and would not even be given any information about why I was getting this call. The only thing they would tell me was that I was put down as a number for my mother. When I took down the contact information of who had called and told my mother, she informed me that it was a collection call, that I had, in fact, been put down as a character reference and not someone to contact, and that they were not allowed to be contacting for such a matter. My mother then filed a complaint due to the contact that this company had with me. I just got another call again today ( XX/XX/XXXX - less than three weeks later!! ) from this company, and when I told the woman that I was not to be called, I was treated quite curtly and frankly, rudely. I do not understand why this company thinks that they can harass family members MULTIPLE times, particularly when the law prohibits this. Saying " this is not a collection harassment call '' does not make it something other than exactly that. This company needs to be held responsible for its actions and treat its customers and family members with more respect than it currently does. I am thoroughly angry with the encounters I have had with this collection agency.

The company name is Valentine and Kebartas. After missimg multiple calls a day from this company I finally spoke with someone on XXXX/XXXX/16. XXXX had sent my final bill to my old address and I never got it. The person I spoke to at Valentine and Kebartas corrected my address and arranged to send out a reprint of the bill. She waved the ridiculous {$5.00} fee to have the bill reprinted. I let her know that I would be taking care of the bill as soon as I received it. Not 1 day later the calls started again. I received a call this morning by a very pushy caller and was told that if I was taken off the call list without making payment arrangements my bill would go into collections. I asked why my file had n't been updated to show that I was cooperating and s ( he ) said their system just does n't show everything. When I complained about their repetitive calls the caller said that legally the system could call my phone up to 6 times per day. This is harrassment and also threatening by saying my bill would go into collections. By their admission, even though I was cooperating, they were going to call me up to 6 times per day until my bill was paid. These are nnacceptable business practices. Please look into the company.

Valentine & Kebartas is the company trying to contact me. The first representative was extremely rude and would not disclose the company he was calling from. I had to do my own research to figure out who they were. I was not comfortable with the first agent so I requested for a supervisor to call me back. I spoke to the supervisor and was told I would receive a call the following XXXX. I did not hear back until that following XXXX and each phone call that I received until today I have answered, no one speaks and then they hang up. I had to call back multiple times today just to get in contact with someone and was met with an extremely pushy and rude supervisor. I tried to explain my concerns to this individual who told me that there has been no one on his team that has been difficult with me, and that when I want to settle my debt to call him back. I also asked for documentation of this matter before I give them any info and it didn't really seem like they could give me anything. I am very frustrated as I want to clear this up, but I am not comfortable giving any of my information to this company.

My name is XXXX XXXX. I received a phone call this evening at XXXX from what showed up on the callerID as " XXXX , PA ( XXXX ) XXXX. '' This came up as XXXX XXXX ( e.g. XXXX or XXXX XXXX ) type. The person on the other end, when asked, stated that her name is XXXX****. Due to a persistent hearing issue I have, I could not clearly catch her name, even after asking twice for it. I then was told that the company calling me is Valentine Kebartas Inc., located at XXXX XXXX XXXX, XXXX . XXXX, XXXX, MA XXXX, and that the phone number of the company is ( XXXX ) XXXX ( ext. XXXX??? ) and this was in an attempt to collect a debt. Because I had never heard of the company and that the call came from a type associated with most scams, I stated that I would not confirm my name unless I knew the name of the client attempting to collect such a debt. The woman claimed that the company have several clients and would not provide any further information for said debt. After I stated that without the name of client, I have nothing to confirm, she then stated that the company will continue to call me nonstop.

I switched phone companies to save money and avoid the inconsistent information I was getting from XXXX 's employees. The new phone company advised they would pay off the final amount owed for the phone ( approximately XXXX ) but when they gave me the money for the final payment they failed to tell me that they used part of the money on my new phone. Therefore, they led me to believe that I would owe nothing, when in fact I now needed {$190.00} to pay to XXXX the first phone company. This collector ( for XXXX ) has continuously placed calls to me at all hours of the day. They usually call at least twice but usually about four to five times in a day. I have already received final bills from XXXX itself ( and only switched phones a few months ago ), as well as another letter from a collector explaining its collecting a debt. But they continue to place calls all day to me despite the fact it is receiving payments and was told incorrect information by both companies from the beginning.

This " debt '' results from fees incurred when I terminated my XXXX XXXX account upon moving to XXXX pursuant to XXXX. As an XXXX, I invoked the protections of the Servicemembers Civil Relief Act and provided XXXX XXXX with requested documentation at the time of termination. XXXX assured me no termination fees would be charged. XXXX assessed me the fees anyway, and I called them ( at XXXX long distance rates ) to work things out. They apologized and refunded the {$340.00}. The next month, XXXX again debited the {$340.00} from my bank account, and I again called them ( XXXX long distance ), receiving an apology and a refund. I received a call from the Valentine and Kerbatas Collection company. The representative explained to me that she had me on a recorded line, however failed to name the company on the recorded line. She then proceeded to ask me to verify my SS # and DOB. He has violated the FDCPA and stated that I can not consolidate my loans because he is going to submit me for garnishment which is falsifying information and a scare tactic to get me to pay him and do the rehabilitation program.
