I have sent in two complaints to the XXXX XXXX XXXX and to my States Attorney General but have not heard back from the Attorney General. The XXXX XXXX XXXX has tried to help but can only do so much in this situation. I need help and I need it fast before this loan company charges me any more money when I have already sent them my loan payoff check. I am copying and pasting both complaints in full. I apologize for how much is here, but Im trying to give as many details as possible in order to get this situation resolved. Complaint # 1 : Submitted XX/XX/2021 I currently have a school loan with Utah Higher Education XXXX which I am attempting to pay off after the sale of my home. They have been consistently difficult to work with throughout the years and I am thankful to finally be able to take the proceeds from the sale of my home and pay off the full amount. Unfortunately, UHEAA has always been very difficult to work with and is carrying on the same pattern of fraudulent activities as it always has. I have heard and read of many complaints against school loan companies over the years and thought it is simply a result of people who are complaining solely because they are unhappy with their debt. However, as I have been attempting to work with UHEAA over the past few years and, even as I attempt to pay off my loan currently, I am beginning to realize that all the complaints at least against this company are true. I imagine how many other young professionals are going through the same horror story as my own without knowing how to find freedom from this company and its domineering practices. I hope my complaint will be able to help others in the future. Years ago, my school loan ( initially a XXXX XXXX loan, who was under Federal investigation ) was sold to UHEAA without my knowledge. At this time they began to harass me with phone calls from multiple unlisted numbers regarding paying my school loan. Not knowing that this company now owned my school loans, I ignored the phone calls. Once I found out through a mailing ( which UHEAA no longer does ), I was able to set up payments with this company. Unfortunately, my credit score had already dropped because my account had been listed as delinquent during this time of transition even though I was unaware of the circumstances until it was too late. Despite that, UHEAA has always followed a consistent fraudulent pattern when managing my account. After researching reviews of this company, I see now they do the same pattern to everybody. When requesting a hard times forbearance, or changing the payment plan, UHEAA initially requests that I fill out paperwork and fax it to them. When I call the same day to verify that the paperwork was received, they acknowledge the receipt of paperwork and state that it will take up to 5 business days to process the information. Typically, after submitting the paperwork, I would receive a notice about 7-10 days later stating my account was delinquent. When I would call UHEAA to find out what was going on, they would say the paperwork was never received. When told that I had confirmation that the paperwork was received, UHEAA would then check and confirm that they truly had received the paperwork even though they originally said they had not. This was usually followed by a statement placing the blame on me, stating I had not filled out a form that was necessary or that my paperwork did not have the necessary information. This pattern would go on every week or two for at least 6 weeks with me calling and going through the whole process multiple times until UHEAA finally processed the paperwork on their end. I recently sold my home and am using some of the proceeds to do a full payoff of my UHEAA school loan. This time, when it came time to pay the loan off, I requested my Title broker assist me by taking the payoff of the house and completing the process for me. I hoped they would be more professional with my broker and I wouldnt have to fight with UHEAA anymore. My loan had been in forbearance due to COVID financial difficulties and my first payment was due on XX/XX/2021 after my forbearance was up. The broker called before the XXXX to attempt to pay off my loan using the proceeds of my home sale. She completed all the paperwork and was told by UHEAA that it would take 5 business days to process. UHEAA informed my broker that they would contact her within 5 business days to complete the loan payoff. I called my broker last Friday, the XXXX of XXXX to see if she had heard from UHEAA. Knowing UHEAAs reputation for never returning phone calls, I encouraged my broker to call them and follow up when she stated that she had not yet heard from them. She was unable to reach them until Monday, XX/XX/XXXX. In the meantime, I received an email from UHEAA stating my account was past due and delinquent, despite the fact that the payoff paperwork had already been submitted for nearly 2 weeks. When I informed my broker of this, she immediately called UHEAA. They informed her that they refused to process the previous paperwork she had submitted because I had not signed an authorization for release form for UHEAA to discuss my accounts with my broker. By this time, my broker had carried out at least 3 phone conversations with UHEAA regarding my account and the paperwork necessary to complete the payoff for me. Why did UHEAA never even bother to inform my broker about the need for the release forms on any of the previous phone calls? Being disgusted with UHEAAs practices, I called UHEAA myself after leaving my brokers office and signing the release form. I informed UHEAA that if this payoff was not completed within 2 weeks I would be reporting UHEAA as well as seeking legal counsel against them. Today, in response to my phone call stating I would be reporting their fraudulent practices, UHEAA sent me a notice stating that my account was delinquent and no longer in good standing. UHEAA consistently follows the same pattern of behavior of not processing billing and payoff requests until at least 4-6 weeks unless we, the consumers, call frequently to check up on them. UHEAA further delays the process nearly every time by saying the wrong paperwork was submitted or inadequate paperwork was submitted when it is the representatives at UHEAA who tell us which paperwork to submit. If we are submitting what UHEAA tells us to submit, how can it always be the wrong paperwork? It is a ploy to lay the blame back on the consumer so UHEAA looks like they are in better standing than they are. UHEAA also states that information submitted on paperwork ( Ie : check stubs, employer forms ) does not have accurate or necessary information for UHEAA to accurately process the paperwork when all the information truly is right where it needs to be on the paperwork. In the meantime, UHEAA is able to drag the process on for weeks and even months, continuing to accrue interest instead of allowing a loan to be paid off or to accrue late fees instead of allowing a loan to be placed in good standing. It is a fraudulent practice to draw the process out to make more money and then blame it on the consumer when the consumer has, in fact, done everything UHEAA has requested. Please, please help me! All I want is to get this school loan paid off forever. But at this rate the interest continues to accrue and UHEAA starts the process of assessing late fees when none of my paperwork was late. Please help me! I just want to be free of this company forever! Complaint # 2 : Submitted XX/XX/2021 I recently filed a complaint over the way UHEAA is handling my attempts to pay off my school loan with them. They use fraudulent and underhanded business practices to prolong any process of the customer taken to pay UHEAA in order to accrue further interest and sometimes even incur late fees where a late fee is unwarranted. I recently sold my home in the end of XXXX and my title attorney and myself have been attempting to pay off my school loans serviced through UHEAA. UHEAA continues to prolong the process by refusing to return phone calls, omitting essential information necessary to complete the process, or misdirecting any requests and questions by myself or my title attorney. Upon further review of other complaints against this company, it is clear that UHEAA does this to many of its customers. I am beginning to believe this is a fraudulent practice enacted intentionally on the part of UHEAA in order to gain more money from their customers. If UHEAA charges {$10.00} a day in interest to 1000 customers attempting to pay off their loans and UHEAA prolongs the payoff process for 30 days, UHEAA stands to make {$300000.00} extra off of these customers above what the customers originally intended to pay. This is a very lucrative means of increasing the amount of money that UHEAA makes on a weekly, monthly, and yearly basis. It is even more lucrative if you consider late fees that UHEAA might stand to accrue if they prolong the process even further than 30 days, say 60 or 90 days ... Especially if UHEAA can effectively make it look like all the delay is the customers fault by stating the customer did not present the necessary documentation, that the paperwork was filled out inaccurately, or by omitting necessary information that the customer needs in order to carry out UHEAAs appropriate protocol. UHEAA may allege that no illegal activity is occurring here by laying all the blame back on the customer, but UHEAA is indeed carrying out illegal activity by refusing to give accurate information necessary to the customer in order to carry out appropriate payment. I state all this in response to UHEAAs response to my previous complaint. After filing my complaint, I received a very prompt return phone call from UHEAA the next day. However, the delay tactics continue even now weeks later. First, UHEAA attempted to lay the blame back on me for payoff problems by stating I and my title attorney filled out the wrong paperwork. Of course, UHEAA never told myself or my attorney about the form required during the multiple phone calls regarding what documentation was necessary in order to finalize loan payoff. Once we learned of the necessary paperwork, it was filled out and returned to UHEAA within 24 hours. Another phone call to UHEAA revealed that UHEAA was now stating we filled the paperwork out wrong. As a result, the paperwork was filled out accurately and returned to UHEAA that same day. My title attorney and I didnt hear anything from UHEAA at all after resubmitting the paperwork. I provided my attorney with a number for the embezzlement department that UHEAA gave me after filing my previous complaint. When she attempted to call more than 3 times, she did not even receive a dial tone on the other end of the line. Not until I called the embezzlement department and told them to call my title attorney, was she able to reach or speak with anybody from that department. The embezzlement office provided my title attorney with an address to send in the payoff amount. My title attorney sent it that day via XXXX next day mail and we received confirmation that the package was received. Four days later, I am still receiving emails from UHEAA stating that my account is past due and in delinquent status even though we started this payoff process before my original payment date. Five days after the package was documented as having been delivered, I called the embezzlement office to determine if they had seen the package with my payoff check yet. I was told by the UHEAA employee that my title attorney had been given an inaccurate address by the UHEAA employee and that the mail had not been delivered to the correct address. The mail was, however, being forwarded to the correct address but the employee was unable to tell me how long it would take for the package to arrive. When I complained about UHEAA stating that my account is delinquent when it is, in fact, in payoff status, the employee told me that I was supposed to continue making monthly payments to UHEAA until the payoff checked is received. I refuse to make any more payments to UHEAA. The check to pay this account off was sent and received over 5 days ago. It is not my fault it went to the wrong address but UHEAAs fault. I will not be penalized any longer for UHEAAs fraudulent activity. If UHEAA has the gall to attempt this one one customer, how many other customers are they taking the exact same actions against? How much extra money is UHEAA making off of prolonging their customers valid and earnest attempts to pay their school loans in a manner that is ethical. UHEAA continues to carry out their unethical practices even while under review from the XXXX XXXX XXXX as well as other reporting agencies.

I have XXXX student loans throug h UHEAA. I g raduated in XXXX of XXXX . With my first job, I did not make enough to pay all my student loans every month, so I applied for deferment with UHEAA. It was granted. I finally did get a better job but that was right when my deferment was supposed to end XXXX XXXX . I went ahead and moved across country and began the process of buying a an expensive dental practice. I called UHEAA in early XXXX . I can not supply the specific date without a court order because it is from my business phone line. I spoke with a representative and told him my situation and that my wife and I were also having a baby in XXXX XXXX , and that I still could not pay my student loans for a few more months. The rep asked when I thought I could, and I replied that I could in XXXX of XXXX . He said Great, I will put your account in deferment until XXXX and we will have your first bill due in XXXX . He told me that he put my accounts in deferment. He did not say I needed to do anything else to make it so. It was done. I was so relieved! A representative of the company said I was deferred. He even told me what I needed to do next, which was to call back sometime in XXXX to set up my payment. I called them back on XXXX XXXX , at which point, I was informed that I was not in deferment and was in fact XXXX whole months late and owed {$3000.00} right then! They had left no message on my phone number listed on my account. My phone number had not changed since XXXX . They had it. I never received a letter from them even though I gave them my new address in that phone call previously mentioned. None of the emails they sent clearly said I was overdue, just that I should contact them and had coded images. I wasnt concerned at the time because I knew exactly when I needed to pay again. This is UHEAAs error. UHEAA tells me over the phone that it is not their problem and that there is nothing they can do to help me because I do not remember the name of the person I talked to that told me I was put in deferment. Every phone conversation is supposed to be documented and or recorded. They also claim over the phone that the only way they can look up a specific phone call is if I supply the phone number that I called from. They used my cell phone to look up the previous call. They did not find it of course because I remembered after that phone conversation that I had decided to use my work phone ( with multiple lines ) so that I could have my account info in front of me on my cell phone for ease on the phone call in question. It really is upsetting to me that, if I understand what I was told correctly, somehow they have recorded or otherwise documented phone calls floating in their system unattached to the appropriate account holders? Just telling you what I was told. How is this appropriate? I decided that the only way to communicate with UHEAA is through written letters. I sent them certified mail asking them to report to the credit bureaus that I was disputing the claim that I had been 6 months late. By law they have 30 days to report Disputed on my account to all the credit bureau s. ( Fair Credit Reporting Act sect ion 623 ( a ) ( 3 ) ). Th ey never indicated that I was disputing their record keeping within those 30 days or ever. I have proof of this to be supplied along with this testimony. This impacted me because I can not consolidate or refinance any of my student loans at lower interest rates with a longer term with another company that I can trust. I am always denied. I have very high interest rates on my student loans and I was given no option other that those interest rates and was only offered a ten-year term. Furthermore, I applied for a home loan 4 times with XXXX different companies. All were denied because my credit report says that I was 6 months late on XXXX accounts with no other indication in my defense. I have had to lose money through rent since. Next I decided that maybe they needed to hear it from a lawyer. So I had my lawyer write to them XXXX XXXX , XXXX requesting that they retrieve the phone call that I made to them in the beginning of XXXX supplying my company phone numbers. I did this hoping they would actually look into it and finally deal honestly with me. They replied two months later on XXXX XXXX XXXX by sending the same letter they had sent on XXXX previous occasions with an added line saying that the only phone number THEY called was the phone number on my account. I was asking about a call I made to them. They also indicated or implied in this letter that they did not have to follow FDCPA law because they are governed by the Department of Education. The Fair Credit Reporting Act is a federal law and they are an entity who reports to credit bureaus. How does this not apply to them? In this same letter, they indicate that they have included my Master Promissory Note, bu t they did not. They literally pretended to not even understand the request clearly stated from my lawyer. They did not include information that they said that they did. In the beginning of XXXX I called them, they did not call me. This is the call I was asking them to look for. Since I can provide documentation that they do not report fairly on my credit report by supplying that I dispute their claims within the 30 days they are given by law, I want them to be accountable for what their representative said from the beginning of this ordeal. I have never been late on a payment with them since this time. I have paid more than the minimum multiple times. I have tried over and over again to speak to or write to this company with the belief in professional integrity. I have not found it with this company. I believe they should be investigated for poor record keeping, poorly trained customer service and other personnel, hour long wait times, illegal credit reporting practices, but also, and maybe more importantly, intentionally finding ways to charge people unfairly. I have already complained to the BBB. I have tried to communicate with UHEAA for so long, for too long. They are government run and feel that they are above the law. They will claim that they have no evidence of that call. If that is even possible to be true, then they do not keep good records, and they have untrained people dealing with thousands of other peoples dollars. They say they do not have to follow the fair credit reporting laws in writing to me AND that it is not their job to make the change to the credit report, that the credit bureaus are the only ones who can. This is not true. The credit bureaus go off of what UHEAA supplies to them. I would like for them to find my call or to figure out why they dont have it. I am not sure if anyone even looked for the phone numbers supplied in the letter from my lawyers in XXXX of XXXX . Their response indicates they did not even understand the question, so this strongly suggests that they did not. Does UHEAA have record of what letters were sent to me and when? Did the letters they supposedly sent to me, get returned to them? What address is listed on those letters? Did they make reasonable effort to contact me? The fact that no messages were left on my pho ne ( a num ber that had not changed since XXXX ), in dicates that they did not. They claim they called my parents, but if that were true, my par ents ( who I see frequently and have given me numerous mes sages ) w ould have contacted me for that is who they are, but they did not get any message. Ever. Their phone number has never changed since before I was born.

XXXX XXXX, XXXX, I specifically informed XXXX that each specific payment/overage paid online is to be credited to each outstanding principal balances. Payments are as follows : XXXX Loan transferred on XXXX/XXXX/XXXX, payments made before transfer as follows : YEAR XXXX XXXX/XXXX/XXXX {$150.00} XXXX/XXXX/XXXX {$150.00} XXXX/XXXX/XXXX {$150.00} XXXX/XXXX/XXXX {$150.00} XXXX/XXXX/XXXX {$150.00} XXXX/XXXX/XXXX {$150.00} AND XXXX/XXXX/XXXX XXXX received loan on XXXX/XXXX/XXXX XXXX payment made over the phone on XXXX/XXXX/XXXX held onto the payment and sent a letter stating the bank returned the check on XXXX/XXXX/XXXX. My financial institution never receives a payment from XXXX. Also, there 's no way an ACH debit clears the bank less than XXXX hours. I requested a copy of the transaction from XXXX because it would show if there bank processed my ACH and if it was returned it would have all the bank information. XXXX sent a generic letter with no information of my bank. Also stating unable to locate account. If they had processed the ACH and it came up invalid account than they would have called me on the same day i paid to inform me the bank account is coming up invalid. First of all, I have never written a check in paying my student loan. ACH transactions from my bank institution handle all monthly payments. XXXX stated that the bank reversed my payment to them in XXXX of XXXX and credited me my payment back. My bank has never received any payment from this third-party lying company. The difference was taken from paid principal balances and daily accrued interest I already paid into you people deducted interest and subtracted from my XXXX/XXXX/XXXX loan. The forensics account audited all XXXX loans XXXX assumed XXXX/XXXX/XXXX and committed federal fraud for financial gain. What you people did is committed fraud which is a federal offense. Instead of applying for payments correctly to each loan what you are doing is adding monthly payments back into the principal balances. XXXX payment of {$520.00} did the same thing by trying to cover up your own errors by adding payment all to the interest which my monthly installment payment is XXXX. Ever since you idiots did n't properly change my correct payoff date on XXXX XXXX, XXXX, XXXX term you have messed up my account. What you should have done was correct your error by reverting back to to the original payoff date then contacting me to go over everything, but you idiots kept on committing federal fraud and then trying to blame all your errors on the borrower. Having a forensic accountant handle the audit and finding fraudulent activities done by XXXX has given me to present all documents to the Calfornia XXXX 's office and forwarding all documents requested by the California XXXX XXXX office. I am seeking damages from XXXX and all the XXXX emotional stress you people have caused me. Copies of every email sent to XXXX since last year will be sent to ALL XXXX BOARD MEMBERS, XXXX, ETC. You people caused detrimental problems for me and fraudulently reported delinquent student loans to my credit report. Suing XXXX in civil and federal court.

My son is a XXXX XXXX at XXXX University. This is my son 's account. His name is XXXX XXXX. I am helping him by paying the interest on his loan every month. He started at XXXX in XX/XX/XXXX. I made my first interest payment in XX/XX/XXXX, I did this via their website and all went as it should have. I made another online payment in XXXX and was told ( after I sent the money ) that the payment had to go to principal because it was within 120 days of a disbursement, BUT I could call in to make an interest payment. Since then, faithfully, I have called and supposedly paid the accrued interest on his account. In XX/XX/XXXX, I discovered that most ( not all ) my payments had gone to principal, not interest. I called them and after a week of 'discussing ' with various people at XXXX, the payments were adjusted to go against interest. Thinking the problem was fixed, I continued to call in faithfully every month to pay his interest. However, in XXXX, I discovered that, once again, most ( not all ) the payments had gone to principal not interest. I just spent 1 hour and 4 minutes on the phone with 3 different XXXX employees with no resolution ( most of that time was on hold ). They are now telling me that I have to get my son on the call with them to approve an interest payment every month. This is the first I've heard of this. I am authorized on his account. They are now supposedly going to go back and review the recordings of all my calls because apparently, they were doing it wrong when they did apply the money to interest without his authorization. All payment amounts are what they verbally told me he owed in interest when I called in. Here is the info on my calls, I didn't start keeping notes until XXXX XXXX these are ALL supposed to be interest payments. XX/XX/XXXX {$100.00} paid, confirmation number XXXX, name of CS rep not recorded XX/XX/XXXX {$350.00} paid, confirmation number XXXX, name of CS rep not recorded XX/XX/XXXX {$190.00} paid, confirmation number XXXX, CS Rep XXXX XX/XX/XXXX {$170.00} paid, confirmation number XXXX, name of CS rep not recorded XX/XX/XXXX {$200.00} paid, Confirmation number XXXX, CS rep XXXX XX/XX/XXXX, this is the month I went on line to check the account and discovered that most of the payments had gone to principal rather than interest. I called and had a very long conversation with a young man, XXXX I think ( I can't believe I didn't write down his name ), who corrected all the payments to interest including the XXXX payment of {$200.00}. Confirmation XXXX. I naively thought the problem was resolved and would not continue into the future. This is when I went on line and discovered that, once again, most of my interest payments had been applied to principal, not interest. I called back on XX/XX/XXXX and spoke with CS Rep XXXX who tried to tell me I COULD NOT make an interest payment on the account within the 120 days of disbursement. So then I spoke with a supervisor, XXXX who told me that she would make the adjustments to XX/XX/XXXX-XX/XX/XXXXand I should check the account in 2 weeks. She also said that " its such a little thing to get money moved to interest ''. The procedure is for the CS rep to apply the payment to principal and send an email to their supervisor to have it adjusted to an interest payment. I informed her that either her CS reps were the most poorly trained CS staff that I'd ever seen before or the supervisors were incompetent if the CS reps were sending the emails. She also stated that she would send a note to their Training Department to have followup training with the CS reps ( which seems to me was her way of putting the blame squarely on the backs of their customer service department. I checked the account a couple times and some adjustments had been made but not all of them. However, I got distracted by current events and did not call again until XX/XX/XXXX. XX/XX/XXXX. Called and spoke to CS rep, XXXX, who told me the interest balance was approximately {$440.00}, I did not write down the exact amount because I told her that according to the payment history on their website I had made {$680.00} in principal payments had been made and I wanted her to make the XXXX interest payment from the principle they had incorrectly posted. She promised she wound call me back NLT Friday XX/XX/XXXX with a status report. Of course, did not hear from her. I called again today and spoke with CS agent XXXX, then to manager XXXX, then manager XXXX. XXXX and XXXX gave me the same song and dance about the 120 days after disbursment. Then XXXX told me that they couldn't make adjustments to the account with out a power or attorney from my son or his verbal approval during each phone call. This information is new after over a year of making interest payments over the phone with out my sons presence AND when I've fought with them before to correct their errors and they did. Now, XXXX is going to listen to all the conversations I've had with various CS reps, ( which is fine, I clearly stated in each conversation that I was making an interest payment ). But she is going to listen to find out where they went wrong in allowing me to apply the payment to interest!! She is supposed to call me back on tomorrow, XX/XX/XXXX by XXXX XXXX cst with an update. I have NO faith that she will call. Can you help me with this.

I have been trying for months to move from an Income-based Forbearance Repayment Plan to an Extended Repayment Plan with XXXX XXXX. Here are a list of things that went wrong and incorrect information I was given : XX/XX/XXXX : Interest Capitalization for a total principle balance of {$31000.00} XX/XX/XXXX : Last normal payment on income-based plan for {$180.00} XXXX XXXX : I was told all I had to do to move from Income-based to Extended was to use a temporary hardship forbearance so the current amount due would be taken care of and my Extended application could be processed to begin for my XXXX due date. ( My income-based plan was ending after XXXX and I was told as long as I didn't reapply, I would be fine. ) XX/XX/XXXX : I logged into my account and found a full payment of nearly {$700.00} due. I called XXXX and was told that I actually had to make a payment of at least {$5.00} to get off of my Income-Based plan. I made the payment on XX/XX/XXXX for {$15.00}. Once I did this, my Extended plan could be processed. Again, I was told to do a temporary hardship forbearance to take care of the amount due. XX/XX/XXXX : I logged in and again saw a payment due of nearly {$700.00}. I called again and was told the exact same things as XXXX with the exception that I should wait a little bit so I pay the amount after it had been billed out. I made a payment on XX/XX/XXXX for {$15.00}. Again, I do a temporary hardship forbearance before I make the payment. XX/XX/XXXX : Same circumstances. I call and am finally told that I need to actually get a bill and then I can pay it. I call later in the month after I still have not received anything in my inbox. The person tells me I can make the payment. I make a payment of {$15.00} on XX/XX/XXXX. Same song and dance with Temporary Hardship Forbearance. XX/XX/XXXX : I am told I paid the wrong amount in XXXX. I paid {$15.00} but I should have paid {$35.00}. I do a temporary forbearance, and am told I am right on the cusp so I won't get a bill until XXXX. XX/XX/XXXX : I log in a few times, but my amount due is always {$0.00}. I receive no notifications other than an email for a regular billing statement. XX/XX/XXXX : Still a high payment. I call again and was told I didn't pay the XXXX reduced amount of {$50.00}. I am almost sure I agreed to a {$5.00} amount for XXXX, but regardless, I had never received notification. I ask again to do a reduced payment for {$5.00}. I am told I should call back around XXXX or XXXX. XX/XX/XXXX : I call on XX/XX/XXXX. I inquire about my bill because I have not seen any emails about it. I am told on this call that the notifications for these bills are being sent via traditional mail and not via email. I have been paperless with XXXX since at least XXXX. My bill has been generated. I make my payment. I am told to call back at the beginning of XXXX to make sure my Extended Plan has been processed correctly. The representative and I went through my notifications on the website. There were none in the folder she expected them to be in. XX/XX/XXXX : I call back on XXXX. I logged in before I called and see an amount due of {$700.00}. I am put on hold for around 15 minutes while the rep tries to see what has gone wrong. When she gets back on the line, she tells me that it seems my payment has been overlooked because usually the bills are created on the XXXX or XXXX, so they look for payments AFTER those dates. I was billed on the XXXX and paid on the XXXX. She says she's going to process my paperwork and get me going on the extended plan, but it might not take before my payment is due, so I should do a temporary hardship forbearance. I said I will keep checking in and ask if there is anything I can do about the fact that I have not been able to pay down my principle in 8 months and now that the interest has capitalized again, my principle balance is over {$1000.00} higher. She says there is nothing that can be down because technically I could have been making payments this whole time. I tell her that I really could not have been and was suggested to wait until it all went through because it is super complicated to get off of an Income -based plan. My complaints boil down to these : 1 ) I have been paperless for years and yet received no notification of these bills via email and was only sent notification via traditional mail. I was not told this until 8 months into this problem 2 ) It took at least 3 months for me to be told that I even needed to wait to be billed for a smaller amount. ON top of that, I was told at first I didn't have to do anything because my forbearance plan had expired. 3 ) I was told nothing can be helped because " technically '' I could have making payments is a slap in the face. I feel like I am being thrown into shady processes to avoid having to put me on an extended repayment plan. All I want to do is to be able to afford my student loan payments, but XXXX is making it extremely difficult.

Beginning in XXXX 2016, I inquired about the annual process of renewing my 2016 IBR with XXXX but I was told that they were no the servicing company and that I should now contact UHEAA who was the direct loan holder. Subsequently, I spoke with a UHEAA representative who confirmed that my loans had been transferred to their company and was given a new account UHEAA number. I indicated that I needed the 2016 IBR application in order to file on a timely basis. I was told that they would mail it out to me. Unfortunately, I learned later that my local Post Office returned my UHEAA IBR application mailed to my Post Office Box to them as " Addressee Unknown '' even though it was addressed correctly and that is my postal address. When I did not receive the IBR application from UHEAA within a " reasonable '' timeframe, I called them up to ask what happened. It was only then that I learned that my local Post Office had returned the IBR to UHEAA. At that point I asked to speak to a supervisor and requested that I receive a copy of the officially postmarked " Addressee Unknown. '' My plan was to take that paperwork into my local Post Office and meet with the Station Manager. I was unable to do that because when I received the " promised '' paperwork from UHEAA, it did not contain the " Addressee Unknown '' documentary evidence I was seeking ; although it did contain the 2016 IBR application. Upon receipt, I called UHEA and asked to speak to a supervisor who then explained to me that their system does not save the actual returned mail - it 's simply scanned into their system as " Returned to Sender - Addressee Unknown. '' At this point I was anxious to complete my IBR application and send it in. When I attempted to fax the IBR to UHEAA, the fax machine repeatedly showed the line as " busy '' or " connection not made. '' After repeated unsuccessful attempts to fax my 2016 application to UHEAA, XX/XX/2016 I mailed my fully executed 2016 IBR application to UHEAA. Subsequently, I received notification that my IBR application was under review, however, the next letter I received from UHEAA indicated that they could not approve my IBR until they received further information. At that point I called UHEAA and spoke to a supervisor again since it was not clear to me what the delay was about. The supervisor indicated that UHEAA wanted more specific documentation of my income. I immediately complied with their request which included sending a copy of a recent paystub for my wife. Then when I did not hear anything back from UHEAA, I called them up but was unable to reach them on the phone. This was during a two week period XX/XX/XXXX into XX/XX/XXXX. At the time I chalked the paperwork delay up to it being close to the XXXX holiday period. Unfortunately, that does not appear to be the case : in XXXX when I could not get through on the phone to a UHEAA representative, I went to their social media pages and saw that on XXXX and XXXX it said that the company was experiencing a " business interruption. '' Alarmed by this news, over the next several days I kept trying to reach them on the phone. Finally, I called the Public Affairs Office of UHEAA and they were able to connect me. They told me that they had been " unaware '' of any business disruption or that customers could not get through on the phone lines. Cutting to the chase : UHEAA sent me a letter denying my IBR request indicating that they could not determine my income. This is despite the fact that my 2016 IBR paperwork was immediately approved by XXXX other lenders. Importantly, that IBR paperwork was approved with LESS information than what I provided UHEAA. At this point I feel that UHEAA is operating in an unethical manner and is not in compliance with the standard IBR approval process. Furthermore, I wanted to alert your office to the fact that this may represent a pattern of unethical behavior.

I am a victim of being informed that my student loans from XXXX of {$21000.00} were being bought from XXXX. I had a 1 year forbearnace from XXXX, and XXXX never informed me that they became my new service provider. In addition, it was not until XXXX XXXX 2016 when I became aware that I was in repayment and all type of confusion happened with XXXX. Utah sloppily wrongfully advised me that I was behind and used deceptive trade practices and provided wrong forms for me to fill out for a unemployment deferement request. I Explained to the XXXX that I am a displaced employee and have had employment since XX/XX/2016. I requested for the unemployment deferment form be sent to me atand sent it back in my purse substantiating that I was registered with the state employment office, the Texas Workforce Commission. I called in on XX/XX/2016 to the XXXX who is servicing my loan comma and was told on XX/XX/2016 at XXXX has been received at XXXX a customer service agent. However on XX/XX/2016 I received a letter that my unemployment deferment was denied and no reason was given. Immediately I called the service provider and I was told XXXX sending information including that I was currently late and delinquent, that my forbearance is on the account, and that there was no one for me to speak with regarding their error they made on XX/XX/2016 confirming they had received my unemployment request along with the appropriate documentation. Ask to speak to a supervisor or the department to correct the error that was made on the servicing providers part I was told that everyone was busy and there was no one that I could speak with him I need to call back another time. The service providers for argumentative until I was not able to escalate the matter. I have absolute no confidence in XXXX, and I need your help getting my loans in the correct unemployment deferment status becuase I have provided the documentation and diligently made efforts to see that the processing has taken place, but have fallen victim to XXXX deception and captialistic interest to corrupt my current unemplyed status. XXXX failed to defer my loans under my rights and reported my federal student loans in a negative status without cause. The letter I recieved does not state any reason in which my unemployment deferment was denied. My concern I am being shown late and more interest is being applied. I didnt get the correct forberance. XXXX on XX/XX/2016 lied and told me everything was approved. Then on XX/XX/2016 they neglegently told me a borrower that they made an error. Too many wide range- sloppy-patchwork practices are creating obstacles for me with raising costs, causing XXXX as an unemployed single mother. The XXXX errors are cuasing more ecoonmic harm to me to quicly go in default, at no fault of my own. Please remove them as my servoce provider!! I am requesting that the Bureau launch an investigation as a priority to take action against this company. They are using deceptive trade practices too quickly lead students to default in there student loans and are engaging in illegal servicing practices. They failed to address this ongoing problem, and I would like another service provider that is professional and competent to service my loans, and provide me with information and updates regarding federal student loans. and that ongoing work includes addressing many of the problems to increase my bororow protection rights in coordination with the U.S. Department of Education and the U.S. Department of the Treasury. My first original complaint stated o XX/XX/2017 : We obtained a student loan for our daughter several years ago with the XXXX. The loan is nearly paid off and only has a balance of {$1900.00}. On XX/XX/XXXX we went to our Credit Union and obtained a loan to payoff XXXX. The funds were mailed to the P.O. Box my daughter had sent all her prior payments to in XXXX, Utah. The XXXX. XXXX is XXXX XXXX, Utah XXXX. I kept a close eye on the XXXX website. After a week or so, I called XXXX and was told that the check was probably in their system and should clear soon. I gave it a week or more knowing that the XXXX loan still showed now delinquent. I called XXXX again and was told to gibe it a little longer and it should be applied to payoff the balance. I dug deeper into the mailing process and discovered that payments generally go to XXXX CO. The XXXX. XXXX is XXXX XXXX CO. XXXX, so I had my Credit Union put a stop payment on the check and reissue to XXXX and was sent to the XXXX CO address. I felt confident that this would be the final solution to getting the proceeds to XXXX, however, today is XX/XX/2017 and the loan still shows way too far past due. We simply want to pay off this account. I am concerned about any credit bureau repercussions as a result. We planned way far enough in advance to get this loan paid off. This has been going on since XX/XX/2017 ... Can you please intervene and help get this issue resolved? The CFPB responded on XX/XX/2017 with this : XXXX received your payment of {$1900.00} dated XX/XX/2017. This payment cleared any delinquency on your account. We are able to confirm no negative delinquency information has been reported to the credit bureaus by XXXX. However, we are unable to honor your requested payoff amount of {$1900.00} from XX/XX/2017, since the delay in receipt of your intital XX/XX/2017 payment and the payment dated XX/XX/2017 were not due to any error on our part. Interest continues to accrue on a loan balance in repayment until a payment is received and processed. As per our telephone conversation on XX/XX/2017 we have waived the remaining late fees as a one-time courtesy. With your payment of {$14.00} dated XX/XX/2017 your account is now showing as paid in full. You should shortly receive a " Paid in Full '' letter, indicating you no longer owe any money for these loans. I am simply making this public for all to read that XXXX intentionally kept putting me off with the numerous phone calls that I made though out this nightmare ... They kept telling me, do n't worry, we 'll find the payment, this happens all the time, .... When in reality, they were saying, we are glad to let the loan you took out from your Credit Union accrue interest as well as continue to charge interest on our loan. They were not interested in helping me solve my frustration, they simply turned out to be greedy. They proudly waived the late fees that should not have been assessed in the first place ... how generous on their part. The {$14.00} in interest I had to pay to avoid reprisal is a slap in my face. The subordinates at XXXX actually were very kind, but clueless. I finally asked to speak to a manager and was directed to XXXX who treated me with utter disdain, contempt and was blatantly rude and unsympathetic. He is a poor excuse of an employee and needs to be taught by his subordinates how to provide customer service. I paid the amount of {$14.00}, because I was strong armed and threatened by the manager that if I did n't agree that he would go back on XXXX 's word and charge the entire amount. He even threatened to disconnect the call, because he is XXXX. I would highly recommend anyone reading this to avoid dealing with XXXX

I had Stafford Loan that I took in XXXX. The first lender given by government as it is government Loan according to the people in Financial Aid of XXXX XXXX where I went to school was XXXX XXXX XXXX. Few Years later, I was contacted by another lender called XXXX. Now XXXX sold me to another called XXXX ... My original amount was {$5000.00}. I started paying even though I had part time jobs for some time. After recession of XXXX, I did not find any other job to today. I am adult XXXX and I was going to school part time and look after my young children. I XXXX in XXXX with a XXXX degree in XXXX. Since then, I am looking for a full time job, but I did not get any. Before XXXX sold my account to XXXX, they used to send me a deferment form for every 6 months hoping to find a job. Now it looks like XXXX has purchased my account. I find that unacceptable, that those lenders are selling us like if we were items. Furthermore, that XXXX has changed my original account. I am not agree with them. I am asking them to keep my original account where I have records from day one when I took loan. I am not sure about the amount they sent to me on the billing statement with a different account. I am requesting my account number XXXX I do n't recognize the new account : XXXX. There is no way to keep record on XXXX accounts for XXXX loan!! It is completely unimaginable!! If they are doing such odd business with student loan accounts, what I am against really, at least the should keep the same account for the same loan. Since XXXX, I am receiving menacing letters like everyday, that they put me in collection. They are charging me late fees while I am in that confusion of stupid changes. You do n't have a job ; you ca n't pay loan with empty hands!! Once in collection, it is going to be hard to find a job in the future! My complaint is : 1 ) How is possible to have XXXX and XXXX different accounts for XXXX loan. It is confusing! I need to have my original account where I have all my records, so that I can recognize the original amount and accrued interests. The Amount on their statement is not the same as one in my records. 2 ) I find not acceptable that the student lenders can sell student accounts to anyone like if we were merchandises! The last time I called the number I find in XXXX website, somebody from XXXX answered my call, It was a man 's voice. He told me that they have purchased my account. He started to ask me my social, my date of birth, address, and other important information. I said that I can not give you my information. If you bought my account, you should have all those things you are asking me as they are in the file. I was surprise! When I came back to XXXX, the lady I talk to did not give me explanation of how they keep selling my account to people even outside of the country. 3 ) I would like to have my original account and I am asking XXXX XXXX XXXX to have my account back. This time I am going to do anything I can to start to pay at least accrued interests hoping to find a real job. By now, I do n't know whom I am talking to ... lastly, I find that thing unthinkable, and I am worried for my kids and other poor and middle class ones, specially young who already have the burden of multiple loans as many do, with those odd business transactions on the back!! In my opinion, students should not be treated that way. We are human beings! We should not be sold as beans or sweet potatoes. America is better than that! My Loan, previously owned by XXXX, was transferred ( or bought ) by a company called UHEAA ( Utah Higher Education Assistance Authority. Before buying my loan, I had just under {$5000.00} remaining on the loan at 6.55 % interest. To avoid paying tons of extra money to the lender, I was repaying the loan at {$240.00} per month, which was above the {$130.00} minimum payment because every responsible recommendation has said pay loans back as fast as you can, not only at the minimum. Once UHEAA bought my loan, one payment was processed for the {$240.00}, but then they reduced the automatic monthly payment down to the minimum {$130.00}. I moved outside the country after university, so I have all my payments automated. To amend them is onerous from outside the country. So UHEAA gave me no notice of changing my automated payment, and I believe they did so to maximise the length of time it would take me to pay it off, and therefore their interest. I am sure that other students who might not check their bank statements frequently could have missed this predatory tacit, and though they think they are paying over the minimum payment, they are now back at the minimum payment. I consider the predatory and illegal. I received an email from UHEAA on XXXX XXXX, XXXX stating : " If you have been making automated electronic payments to XXXX, your bank account information will be transferred to us, and no action is required in order to continue the automated electronic payments '' I contacted UHEAA on XXXX XXXX with the below email and have received no reply : Hello, After acquiring my loan from XXXX, it appears UHEAA has reduced the amount that I was paying by Direct Debit. For years, I have been paying {$240.00} per month, which is more than the minimum payment on my loans. After acquiring my loan, it appears UHEAA has reduced the amount that I am automatically paying to the minimum - {$130.00}. I have serious concerns that UHEAA doing so is actually illegal. Had I not noticed that the amount has ben changed, then I would be paying off the bill for longer, and UHEAA getting more interest. Can you please notify a manager of this and get back to me as soon as possible, informing me 1 ) Whether this is standard practice or is it illegal activity that constitutes predatory lending practice, and XXXX ) that you will change my direct debit amount back to {$240.00}. Do not reply to my request informing me that I can re-register my bank details and start a new scheduled payment amount - it is your responsibility as the new lender to carry on my parents as before without interruption. After being determined to be XXXX by the Dept of Veterans Affairs ( VA ) effective XX/XX/XXXX, I stumbled upon the fact that the law authorized me to apply for a discharge of my student loans ( FFEL Consolidated Loans ; originated on XX/XX/XXXX ). I made that application to XXXX of the Dept of Education on XX/XX/XXXX and it was approved as XXXX, by XXXX, on XX/XX/XXXX. From there it went, supposedly to the Utah Higher Education Assistance Authority ( UHEAA ) for further processing. I was notified in XX/XX/XXXX that I would receive a check for {$4000.00} for my effective date of XX/XX/XXXX thru XX/XX/XXXX. The first scam I noted was that the XX/XX/XXXX date was changed to XX/XX/XXXX because I had made my monthly {$170.00} payment on XX/XX/XXXX. When I called UHEAA they found the VA paperwork of XX/XX/XXXX stating that the " ... VA verifies my effective date of XXXX to be XX/XX/XXXX '' and told me to call back. The UHEAA employee I had talked to and who had found the official VA letter was n't able to verify that anything could be done to correct any possible mistakes since XXXX 's computer data showed the effective date of my XXXX to be XX/XX/XXXX ( Note XX/XX/XXXX and NOT XX/XX/XXXX ). Where XXXX got this date is beyond my comprehension. I called XXXX and talked to one XXXX ( twice I talked to the same XXXX ) and this nasty and mean employee of XXXX refused to offer me any assistance since all the paperwork had been forwarded to UHEAA for processing and there was nothing she could do to clear up XXXX 's XXXX on my effective date. She wanted me to quit calling and hung up. I then sent email 's to both XXXX and UHEAA with the copies of the pertinent VA letter ( s ). Yesterday I received from UHEAA letters stating that they 've received my XXXX application and it appears to be proper and they were going to forward the paperwork to XXXX for further processing. This entire process I have endured has caused me mental anguish which plays upon my " panic attacks '' and these attacks are part and partial of my XXXX. I hate to be considered a whiner but this bureaucratic attack on my intellect and my XXXX is willful and absolutely unnecessary. XXXX and UHEAA appear to be in a collusion to deny any ex-student large portions of the funds that are due the veteran/ex-student for over payment. I have, on hand, records of all my personal checks and/or the dates of the automatic payments made to UHEAA as the collection point for the consolidated loans and the difference between what they sent me in a check ( {$4000.00} ) and what I actually paid is over {$11000.00} for I paid over {$15000.00} from XX/XX/XXXX thru XX/XX/XXXX ( I am missing about 6 months of payment records but can easily acquire them from the bank ). This form of emotional abuse heaped upon me by XXXX and UHEAA is a knowing and intentional conduct directed at me, a vulnerable adult, resulting in my suffering mental anguish, emotional distress, degradation, and confusion. I can see how easy it can be for a bureaucrat of either agency to make a tidy sum through the years cheating a student by " mistakenly '' withholding portions of the funds due the student for over payment and that portion is paid to the bureaucrat ( s ) rather than the student. With the amount of money these agencies process and are responsible for, it is nothing to garner thousands of dollars in a short time period.

My loans were recently transferred from XXXX to XXXX. I was having extra money automatically withdrawn from my account to pay extra towards my loans. XXXX let me select a specific higher interest loan to automatically apply the extra payment to. When my loans were transferred to XXXX, XXXX did not automatically withdrawal the extra amount from my account and in fact did not apply any payment toward the principal of the loan I was making extra payments on. The payment that should have been made to the loan I was paying extra toward was split among my other lower interest loans. I spoke with customer service with XXXX and they told me that their automatic payment system can not apply an extra amount to a specific loan. One customer service representative even said that they could not predict how my payment would be split among my loans each month. Obviously this comment was very concerning. They informed me that I could go in and make a manual extra payment on a specific loan each month. However, making a manual extra payment on a loan places the loan in paid ahead status. When the loan is in paid ahead status none of my automatic monthly payment would be applied to the principal of the loan in paid ahead status, but rather it would be split among my other loans. To me, this system makes no sense. My intent is to pay extra toward a specific higher interest loan to pay it off faster. I do n't want the portion of my normal automatic monthly payment that was supposed to go to that loan to be split among my other loans. I asked to speak with a supervisor at XXXX and he informed me that they could go in and manually adjust my payment each month so that an extra payment would be applied to the loan I specified. Apparently, there is no other way to pay extra toward a specific loan without messing up how my automatic monthly payment is divided among my loans. I asked to receive a written confirmation that they would be making this manual adjustment each month and received an e-mail with said written confirmation. However, this month they withdrew the extra amount from my account as requested, but did not apply the extra payment to the loan I specified. It is not clear whether a manual adjustment was made or not since it is not clear how their system even handles automatic payments. Regardless, my payment was not applied as I requested and as they confirmed in writing. I e-mailed XXXX requesting that they correct the problem, but it has been 6 days and they have not corrected the problem or responded to my e-mail. It was a simple matter to automatically pay extra toward a loan with XXXX. I did not ask for my loans to be transferred from XXXX to XXXX. XXXX needs to provide the same level of service. Additionally, when my loans were being transferred from XXXX to XXXX, there was a period where my interest rate deductions were not applied. That is, for a few weeks my loans accrued daily interest at a higher rate than they should have. XXXX informed me that I was not the only person with this issue and assured me they would go back and correct the problem, but it appears they have not done so yet.

I had XXXX XXXX I took in XX/XX/XXXX. The first lender given by government as it is government Loan according to the people in Financial Aid of XXXX XXXX where I went to school was XXXX XXXX XXXX. My complaint is first, how is possible to have XXXX and XXXX different accounts for XXXX loan. It is confusing! Second, I find not acceptable that the students lenders can sell student accounts to anyone like if we were merchandises! The last time I called the number I find in XXXX website, somebody from XXXX answered me and told me that they have purchased my account. He started to ask me my social, my date of birth, address and other important information. I said that I can not give you my information. If you bought my account, you should have all those things you are asking me as they are in my file. I was surprise! When I came back to ACS, the lady I talk to did not give me explanation of how they keep selling my account to people even outside of the country. Third, I would like to have my original account and I am asking XXXX XXXX XXXX to have my account back. This time I am going to do anything I can to start to pay at least accrued interests hoping to find a real job. By now, I do n't know whom I am talking to ... It could spam or something else ... My loan was transferred to XXXX by XXXX in XXXX of XXXX. Since then, I have been trying to get my account back on in school deferment. At XXXX, my deferment was good through early XXXX. Supposedly the terms of my loan stayed the same, but my deferment did not, and XXXX claims my deferment expired, which is not accurate. Regardless, I have called XXXX numerous times since XXXX to help get me back on deferment. The first few months I was placed on short term forbearance. However, by XXXX they stopped that and started to require payments, even though I am enrolled. I sent XXXX emails, minimum, to XXXX, none of which received a reply. I started to get a collection call once a month, so on XXXX/XXXX/XXXX I called XXXX and spoke to a gentleman who told me that there was a huge backlog at XXXX, so that is why I received no reply to my email inquiry. I asked the man if XXXX goes out to the XXXX clearning house to verify enrolled & he said yes, they did and placed me on hold & then came back and informed me that he could see that " they '' were currently verifying my enrollment status and to " not worry '', in a few days they would be done and my in school deferment would be placed on the account and backdated and my credit would n't be affected. So, I assumed the man representing XXXX knew what he was talking about. Then, on XXXX/XXXX/XXXX I got another call from XXXX stating my payment is delinquent. Of course, the in school deferment STILL is not in place on my account. I called XXXX again on XXXX/XXXX/XXXX and spoke to a lady who placed me on hold for quite some time to " review '' my records, only to come back and say that I had to fill out an request form and take it to my school. When I asked why they could not use the information provided by the 3rd party clearinghouse XXXX, she advised me that, contrary to what I was told XXXX/XXXX/XXXX, they do not verify via a 3rd party. I asked for a supervisor, and I sure got XXXX! Who informed me that the person before DID NOT say what she literally just told me about the XXXX, that customer service does not assist with these matters they request another department, she does not know what the other department did, the guy on XXXX/XXXX/XXXX submitted a request, and the status of that request is that there " is no update '', however, she was not saying the XXXX was checked, and because my payment was late and the length of time it takes ( even though I have been trying to get this done for months ) require me to take time off work to get the In School Deferment request completed by my school. I confirmed on XXXX/XXXX/XXXX with my schools financial aid office that they have reported my enrollment information to the XXXX, so the information is there, XXXX just is not taking the steps necessary to assist me, every call I make I get a new person with a different answer, their customer service apparently does not have the means to assist the customers, and their managers are more interested in being combative than trying to find a solution.

I took out Stafford loans while earning my XXXX at the University XXXX XXXX ( XXXX - XXXX ). I have been paying far in excess of what is due each month in order to pay my loans off quickly. I have paid {$22000.00} in total on the loans serviced by XXXX ( others are serviced by XXXX ) and have never been late on a payment. In XXXX , XXXX listed my loans as in default even though I had paid the monthly minimum on all of them and extra on others ; I paid {$2000.00} on XXXX / XXXX / XXXX and {$260.00} on XXXX / XXXX / XXXX . After multiple calls and yet another payment on XXXX / XXXX / XXXX for {$590.00}, they changed the status to paid. On XXXX / XXXX / XXXX , I paid {$2900.00} which far exceeded the amount due. However, on XXXX / XXXX / XXXX , I received an e-mail saying my account needed immediate attention. When I logged on to XXXX 's website, it said my loans were past due and I owed {$160.00}. I paid the amount ( via the website ) immediately even though I should not have had to just so that none of my loans would be listed as past due. However, XXXX continues to list my loans as delinquent. I spoke to XXXX , a supervisor, on Wednesday, XXXX / XXXX / XXXX who said she would refer the issue to Accounting, look into it further, and call me on Friday afternoon. She never did. The company is closed on weekends. On Saturday, XXXX / XXXX / XXXX , XXXX charged my account a {$7.00} late fee without notifying me they would be doing so. I called XXXX on Monday morning, XXXX / XXXX / XXXX and spoke to another supervisor, XXXX , who said he would send another request to Accounting and call me later that day. I received a call from XXXX instead who said XXXX was still looking into the matter and she was not sure when it would be resolved. I asked to speak to her supervisor but was told she was unavailable. I did receive a voicemail message from her supervisor, XXXX , on XXXX / XXXX / XXXX after I left another message for her but she did not provide any information and did not return my call back to her. I also spoke to XXXX in Compliance on XXXX / XXXX / XXXX . She assured me she would have " past due status '' corrected and call me the following day. She did neither. I continue to receive calls via an automated system from representatives telling me my account is past due. When I ask to speak to a supervisor, I am placed on hold for approximately for several minutes, sometimes only to be told that none are available. Yesterday morning ( XXXX / XXXX / XXXX ) for example, I was placed on hold for 20 minutes so that I could leave a voicemail for XXXX , only to be disconnected. I 've also contacted the company twice via e-mail ( XXXX / XXXX / XXXX , XXXX / XXXX / XXXX ) but have not received a substantive response. This is fraudulent and unethical. XXXX should not be permitted to manage student loans, especially federal loans use to fund a public university.

Last year my loan was sold from XXXX to UHEAA, but XXXX was still servicing the loan. This was a change that I was notified of via a letter to my home address and a message when I logged onto the XXXX system. When I logged in today to make a payment the XXXX website would not give me any information on my loan and just said that I needed to go to the UHEAA website. I went to the website and followed the instructions to set up an account with UHEAA which the website indicated would allow me to make payments, set up automatic payments, etc.. I then called UHEAA in order to get more information on why I was not notified of this change and inquire how I would be able to make a payment in the future. They were not able to provide any information except the PO Box to mail the check to in XXXX. Apparently no one would access my loan information to tell me what payment is due, when the due date will be, or the outstanding balance. They just told me I would not be liable for a XX/XX/XXXX payment on the loan that they were " waiving '', but I do n't feel that 's truthful because when I inquired I was still going to be charged interest and be liable for this payment that would then be in XX/XX/XXXX, they just were changing the due date. Just to be clear- I had NO prior information that this change was going to occur. I check my student loan religiously and would have seen any notification on their website that they posted. I feel very fortunate that I have a job that has allowed me to prioritize repaying my loans. I only have XXXX dollars to go. I told UHEAA I was very upset by this change without being notified, so I just wished to get my payoff information so I could send a check for my final payment. That 's when it got even worse- No one can tell me what my final payoff information is. XXXX no longer has the information, but UHEAA has n't processed it yet so all they know is my demographic information and nothing actually about my loans. They told me to " guess '' what the payment would be and if it was close they would adjust it if I did n't pay enough or refund me if I paid too much. They told me to pull an old statement, but of course XXXX has foolishly talked me into doing everything online so I do n't even have a statement at home I can refer to! My complaints are this : 1. How can a loan be switched between companies to service them with NO information given to the customer. 2. How can when this change occur the customer not be able to get ANY information on their loan from either company? To me this seems like what has occurred is questionable legally. Again, I feel fortunate that my student loan balance is no longer excessive and the impact on me with any accrued interest or potential fees would be minimal, but I feel this practice needs to be scrutinized. I have 7 total XXXX student loans and 2 Consolidation loans serviced by XXXX, who took over as my loan servicer from XXXX in XX/XX/XXXX. I have been making regular monthly payments on a fixed repayment schedule for all of nine loans on my account. I have 100 % on-time payments, and believe that I qualify for interest rate reductions that have never been applied to 5 of my XXXX loans. As a result, I believe I have overpaid interest significantly over the repayment history of the loans. Five of my XXXX XXXX ( disbursement dates XX/XX/XXXX,XX/XX/XXXX, and XX/XX/XXXX ) have a 6.55 % interest rate and on the XXXX online account summary for each of these loans, the loan details show potential rebates after 12, 24, and 36 on-time payments. Aside from this general statement of eligibility, no status is given nor indication of number of payments until the benefit becomes active. I believe I should have qualified for each of these three rate reduction milestones several years ago. Additionally, timely payment benefits for XXXX loans are also listed in the XXXX section of XXXX XXXX website. I first emailed XXXX customer service around XX/XX/XXXX and did not receive a response. I made a second email attempt in XX/XX/XXXX and did not receive a response. I called XXXX on XX/XX/XXXX and reviewed the issue with a XXXX representative. The representative acknowledged that my loans appeared eligible for interest rate reduction, and that an inquiry would be sent to the loan processing department, and I would hear back soon. I called back on XX/XX/XXXX and spoke with a XXXX representative who acknowledged record of the previous inquiry into the loan rate reduction. The XXXX representative needed some time to look into the matter, but said she would call me back. I received a call back that day and the XXXX representative stated that my 5 XXXX XXXX were eligible for a 3 % interest rate reduction, which would be applied to the accounts within 2-3 weeks after approval by management. The XXXX representative also acknowledged that these rate reductions would be retroactive to the date on which the loans were eligible to receive them. In addition, the XXXX representative stated that 2 of my other Stafford loans ( at interest rate 6.8 % ) were eligible for a .25 % interest rate reduction. I spoke with the same XXXX representative on XX/XX/XXXX who indicated that after review, the 5 XXXX loans are not eligible for a rate reduction. When asked what changed after management review to make them ineligible, the representative did not know or have access to the review documentation. I requested the documentation that resulted in the determination of ineligibility for interest rate reduction, but the representative did not seem to think that I would be granted access to the documentation.

This complaint is regarding UHEAA ( Utah High Education Assistance Authority ) Uheaa Address XXXX XXXX XXXX XXXX XXXX XXXX, UT XXXX XXXX UHEAA, serviced my student loan from XX/XX/XXXX until I paid the loan off early in XX/XX/XXXX. I never paid them late. In early XX/XX/XXXX after more than 30 days since I had paid off my student loan in full, UHEAA was still reporting to XXXX, XXXX and XXXX that is was an open trade line on my credit report, with a balance. I contacted UHEAA on XX/XX/XXXX and was told to call back in another 90 to 180 days if it still shows an open account. I then chose on XX/XX/XXXX to dispute the account with XXXX, XXXX and XXXX even providing them the copy of the letter from UHEAA ( XX/XX/XXXX ) stating my loan was paid and closed. On XXXX XXXX XXXX I was notified thru my credit monitoring service that the UHEAA account status changed on both my XXXX and XXXX credit reports. It now showed the account was marked as " closed '' but still had a balance of {$2000.00}, that it was 300 month revolving loan, that it was opened in XX/XX/XXXX, and most upsetting it shows there was a late payment of 60 days past due in XX/XX/XXXX and 90 days past due in XX/XX/XXXX. FIRST AND FOREMOST I NEVER, NOT ONCE EVER PAID THIS LOAN LATE. I HAD AN XXXX CREDIT SCORE AND WAS IN THE PROCESS OF BUYING A HOUSE. FURTHERMORE EVERY ACCOUNT DETAIL LISTED ON THE UHEAA TRADE LINE ON MY CREDIT REPORTS ARE INCORRECT AS FOLLOWS ; 1. ACCOUNT SHOWS BALANCE, WHEN IN FACT MY ACCOUNT IS CLOSED AND WAS PAID OFF. 2. ACCOUNT SHOWS AS 300 MONTH LOAN, HOWEVER THIS WAS A 120 MONTH LOAN 3. ACCOUNT SHOWS I WAS LATE 60 DAYS XX/XX/XXXX AND 90 DAYS XX/XX/XXXX. I WAS LATE NEITHER OF THOSE MONTHS. INTERESTINGLY ENOUGH UHEAA DID NOT EVEN SERVICE THIS LOAN UNTIL XX/XX/XXXX WHEN THEN BOUGHT OUT XXXX XXXX LOANS. ( I HAVE ALSO CONFIRMED WITH ACS THAT ANY PAYMENT TO THEM WE MADE ON TIME ) ** IN REGARDS TO THE UHEAA TRADE LINE ON MY CREDIT REPORT, PRIOR TO MY PAYING OFF THE LOAN IT NEVER HAD INCORRECT INFO LISTED. THE BALANCE, TERMS, AMOUNT AND EVERYTHING WAS CORRECT. XXXX THE INITAL DISPUTE WAS BECAUSE UHEAA FAILED TO UPDATE THE ACCOUNT AND MARK AS PAID AND CLOSED UPON ME PAYING IT OFF **** RATHER THAN CORRECTING IT, THE CHOSE TO FALSELY ADD 2 LATE PAYMENT THAT DID NOT HAPPEN. I have contacted Uhea several times via telephone. each representative has told me they system shows it paid closed, at a XXXX balance and no late payment were ever made. XXXX has initiated another dispute, but has indicated they can not correct the issues since the issues is coming from what Uheaa is reporting. XXXX shows the same information as XXXX does, however XXXX does not. XXXX is showing correctly with not late payment for UHEAA.

I am off of Probation and in good standing with UHEAA. I called and spoke with XXXX to see what I needed to do, going forward. She explained I needed to restate my payment plan and I advised her nothing has changed and I would like to keep the payment the same. She explained she would send me paper work I needed to fill out and return. I received the paper work filled it out and stated I would be doing the Standard repay - understanding that my payment would stay the same. A short while later I get a notice that my payment is late. And, then I get a second notice that my payment is late and I am thinking they didnt receive your payment. I called and spoke with XXXX, he stated that UHEEA received my payment XX/XX/2019. So, I asked whats the problem- he said my payment went up to approximately {$190.00} - I asked why and explained to him - when I spoke to XXXX that explained I want to keep my payment at {$110.00} and I filled out the paperwork she sent me and sent it went my check. So, how can I be late? He put my account into forbearance for two months, I dont want my account in forbearance - When I send my last payment I sent the Forbearance letter back to them stating take me off of Forbearance. I asked him other questions as well, regarding holding my tax refund - he told me I would have to speak with a my tax guy! I tried to explain my question two or three times - he still didnt understand. Also, when I call UHEEA for information about my account, I get a recording to put in my SS and birthday - I put the info in - also my info pops up on their screen so they already know who is calling - then when someone picks up - Im asked to verify my info again - if I dont give it to them they refuse to help me - I feel this is extremely excessive and borders on harassment - of course UHEEA will say they have to verify who they are speaking with - who in their right mind calls UHEEA just to chat? Really? When the reality is -I have received different info with every person I have spoken with - no one knows what they all doing - except to verify a person who is calling about their account? I have seriously wondered if they hire High School Students or if the people are XXXX XXXXXXXX and Im not kidding!!! - nothing is consistent and refusing to give me information about my account after being verified at least 3 times? Its absolutely a ridiculous and a waste of time for them and me. I called once and the recording says there are busy leaving your name and number and we will call you back - UHEEA never retuned my call - the people in this company are absolutely incompetent! And Im tired of it. I just want to be sure Im doing what I need to do and UHEEA makes it horribly difficult!

On XXXX XXXX, 2020, at XXXX XXXX I received an email from my original loan servicer, Cornerstone Education Loan Services ( Uheaa ). The email stated that my loan servicer would be changing to XXXX XXXX around XXXX XXXX, 2020 and it provided modestly detailed information with respect to how the transition would unfold. Note : At that point, my loan information, including principal balance, interest, and payment history were all still accessible on the Cornerstone website platform, i.e., my Cornerstone account. The email clearly states, " XXXX XXXX will contact you after your federal student loan account has been transferred and loaded to its system. '' It is now XXXX XXXX, 2020, and I have not been contacted by XXXX XXXX. Curious about the state of my transfer I logged back into my Cornerstone account to see if there had been any update or if my account reflected the initiation of this transfer in any way. Strangely, while my account still exists, it is entirely void of information with respect to my loans and payment history, which is highly concerning. I have not been contacted by XXXX XXXX, I have not received a welcome letter with account information, and I have not received my new federal student loan account number as referenced in the email provided by Cornerstone. Note : As of today, should I want to go online and pay part of my principal or interest, I would be unable to do so as my account is somehow in limbo. Should I need to check my payment history or share loan information/history with my university as I prepare to register for this next semester, I would be unable to do so. Now, imagine that this current state of affairs continues through XXXX and the moratorium of interest ends, my loans will technically start accruing interest without me being able to pay them. The aforementioned limbo status of my account prevents me from paying any of the principal or already accrued interest before the end of the moratorium. Come XX/XX/XXXX, I will be paying more interest than planned because I am unable to apply anything to the principal in the meantime. This seems unethical to me, and I would think that this violates my rights on multiple levels. Shouldn't this be illegal? I have no accessible information regarding my student loan payments, no proof of my billing history, and I have no way to pay.

I had been attempting to pay my student loans every month. My account information wa correct and my bank information was correct. The company could clearly see that I was going on every month and paying. The system said successful and confirmed. On their behalf, they did call, ONCE from a private and blocked number asking for my information. I went on the account and saw that it had not been successful so I paid it again- which UHEAA can see on their system. I also tried to call twice however I was on hold for over 20 minutes. I work over 50 hours a week, have to live as a single parent who has a XXXX XXXXXXXX - that works specifically to pay my student loans. WHY, would I not pay these? So on XX/XX/XXXX after dealing with this for 2 months I wrote to UHEAA and told them i would have to consolidate because I could no longer deal with hem not accepting my payments- all other companies have no issue but this one. They received the email acknowledged the wait on a loan consolidation. Now miraculously 3 days later they find the time to report me to credit bureau and dock XXXX pts off my credit that I have been building for 10 years. I called them multiple times asking how to fix this assuming it must be a mistake- they informed me I had {$600.00} too much for them to help me. That is {$610.00} over poverty line, do you understand what that means? That I can barely pay bills but they would only help me if I actually could not pay my bills. When I asked why they retaliated my loan consolidation with a credit report they said they absolutely would never do such a thing that they always report people that are delinquent at the end of the month however I have proof they did not report me until at least the XXXX of XXXX. On XX/XX/XXXX my credit was a XXXX when I applied and received a car loan. SO please explain why a company worth BILLIONS of dollars is retaliating against one, mother that singularly takes care of her child while struggling to work with XXXX XXXX including XXXX? I attempted to ask UHEAA for a resolution, multiple times. I submitted my paycheck stubs which apparently was {$300.00} too much in 2 weeks for them to acknowledge I could need financial help. I also showed them multiple emails between myself and UHEAA that I was trying to communicate with them to get the problem resolved PRIOR to this issue occurring and after. Not to mention stating I had always been willing to pay my bill, I had try to pay it which they also acknowledged and furthmore I said I would pay them right away by cash, credit or check. I submitted a dispute through XXXX requesting an update to my reporting, as the status showed Unknown. It was paid and closed in XX/XX/XXXX, and therefore should reflect as such. XXXX responded and updated my report, but did so inaccurately. They updated the status, payment amounts, balance dates, and the payment history inaccurately. It has caused great detriment and undue hardship to me, as Im seeking to finance a home. The updates included negative reporting, and even include the term negative on the payment history data from XX/XX/XXXX through XX/XX/XXXXwell after the loan was paid and closed! Ive called multiple times, submitted emails, provided documentation, and have discussed this matter with a representative at XXXX. They insist that no updates were made, that they will not update and correct the problem, and they wont honor the agreement they offered to me through their own rehabilitation loan program ( which I completed and have since paid off with XXXX ). I have asked many times for contact information to whom I should I send my requested updates and supporting documentation, but the representatives refuse. They insist that no one is there to do can correct the inaccuracies since my loan is paid and closed on their end. Further, they refuse to acknowledge that they even updated in response to my original dispute, and refuse to provide a clear way to submit my requests for further research and correction. The representatives keep insisting that the data on their system is 100 % accurate and they can not help because my loan has been paid, but they are refusing to understand that the data to the credit bureaus was entered differently than what their system shows. Its frustrating when they wont take the time to review the reporting, the actual updates they made, their own errors, or honor their own agreements. I wouldnt have entered into their rehabilitation program if the one benefit on credit reporting was not going to be honored, and theyd later report inaccurately to my severe detriment. The representations made in the agreement were not just verbalits included in the direct correspondence from them and even in their official forms and subsequent contractual agreement. Its a misleading practice and unethical, and I sincerely hope the multiple issues Ive relayed can be addressed and resolved.

Approximately 9 years ago, I started working a XXXX at the XXXX. As a result, I could my student loan provider ( XXXX ) and asked them if I qualified for the public service loan forgiveness program, and I was told that I did not because it was only for XXXX. I also asked if I should consolidate my loans, and they told me that I should n't because my interest rate would go up. I called several more times asking about the public service program, and was told each time that my job did not qualify. I recently discovered that multiple people in my office are in this public service program and was directed to apply for it directly with the department of education, which I did. I then got a letter from the department of education stating that my job qualified but my loan type did not, and had I consolidated my loans they would have qualified. I have since called XXXX and found that they have records of all my call history that support what I have explained, but they have denied me and my lawyer access to these records we have requested. I estimate that the miss-information provided me by XXXX ( which is a contractor acting on behalf of the department of education ) has cost me about {$25000.00}. I am currently trying to get ahold of my call history because Senator XXXX XXXX has promised to try to help me get this issue resolved with the department of education since I was miss-informed by one of their contractors. I would like this to be resolved and either the XXXX or the department of education be held responsible for this misinformation. XXXX has argued that it was not their responsibility to inform me of what loan programs I qualify for and that I am responsible. I disagree with this argument for two reasons : 1 ) XXXX was acting as a contractor for the department of education servicing student loans, and as a result should be expected to understand student loan programs offered by the department of education ; and 2 ) if XXXX was not informed about the public service program or was not responsible for providing information about this program, they should have told me so to begin with rather than giving me incorrect information that I then made important decisions with. Loan Discharge : The XXXX XXXX ( XXXX XXXX campus ) announced its campus closure and assured me courses would continue through the end of the Fall quarter ( XX/XX/18 XX/XX/18 ). I enrolled for the Fall quarter expecting to have on-campus courses and complete a full semester. During the registration period, I was told that no courses would be offered. I kept looking myself and found some online courses to enroll in. Online instructors told me to purchase software ( XXXX XXXX XXXX ) the school was supposed to provide. The school was obliged to provide this, so it wasnt an option to purchase it on my own with no instruction or support. I went looking to all the recommended classrooms and the tutoring center and nobody had the software program. Other XXXX programs were unavailable as well. Also, all the teachers and support staff were leaving the campus ( like rats off a sinking ship ). There was nobody to help or give guidance. One staff in the tutoring center/library, one instructor, and one person in administration all advised me to leave XXXX XXXX as everyone was leaving and there was no access to resources. They were trying to help me, but the campus was being deserted. The XXXX XXXX has since closed more branches and gone into receivership. They are now backing out of all assurances made to students, such as transfer grants and reimbursements. We received a Loan Discharge Application ( due to campus closure ) from XXXX XXXX XXXX XXXX. That was completed and submitted timely and completely. Cornerstone summarily denied the application because ONE CLASS HAD BEEN ACCEPTED FOR TRANSFER CREDIT to a new major. They cited proof there was no teach-out agreement ( there wasnt ) and that NO credits could be transferred. I strenuously object to the ethical correctness of this decision. I dont see where one course applying to a new major negates the entire loan discharge process. I need your help to get my student loan properly discharged, as I received absolutely no benefit from my time, energy and expense at XXXX XXXX XXXX. I certainly should not remain financially obligated to XXXX XXXX for a tiny piece of education rendered, especially when they are now unable and unwilling to pay their own corporate debts and good faith financial assurances to students.

Dates starting the day XXXX assumed all 4 loans on XX/XX/XXXX. From XX/XX/XXXX through XX/XX/XXXX all monthly payments were not applied towards all four accounts specifically when I paid online. Loan servicers did not handle payments and process borrowers ' instructions in a that facilitates successful repayment, minimizes costs to me, and ensuring consistency. Payments initiated on XXXX online platform should be accuraltely credited as of the date I initiated the payments. As I stated from XX/XX/XXXX to XXXX, the four multiple loans have different principal balance and are listed as one group account.therfore on my monthly statements I should see a breakdown of each of the loans outlined showing principal balances, payment, principal, interest, and ending balances of what I specifically paid toward each loans including all overpayments. I specifically instructed those idiots on XX/XX/XXXX that every month there 's an overpayment on all specific four loans, and it to be applied towards the outstanding principal balances each month. I expected those incompetent idiots XXXX servicers to post payments correctly. Since the loans that have the same FIXED interest rate ( 6.8 % ) and the same subsidized and unsubsidized status, each excess amount should be allocated in the proportion to their monthly payment amount and the overpayment as instructed specifically to applied to the principal balances each month. XXXX, has been changing all four outstanding principal balances, monthly payments, and interest each month. My monthly payments are fixed therefore the only thing that changes is the decrease in principal balances and decrease daily accrued interest. All loans have been paid on time each month until XXXX SERVICERS started making adjustments to all loans by removing payments from going as far back to XX/XX/XXXX up to this date. I always made monthly payments on all four loans. Attachment and other documents will be attached and along with the correct balances after XX/XX/XXXX payment. I instructed XXXX SERVICERS to change my expected payoff date to XX/XX/XXXX once XX/XX/XXXX payment of {$460.00} is posted correctly to all four loans. That was not done at all.

In XX/XX/XXXX, I applied for consolidation of two Utah Higher Education Assistance Authority ( UHEAA ) student loans, acct # 's XXXX and XXXX, through the Department of Education that were to be serviced by XXXX ( the only account numbers I have at this time are the ones listed on my credit reports ). The consolidation was approved and funds were disbursed to UHEAA on XX/XX/XXXX. At this time I was advised that all future payments were to be made to XXXX. Unfortunately a clerical error occurred and consolidation was rejected by UHEAA however I was not informed and representatives of XXXX did not appear to have any knowledge or record of the rejection by UHEAA and UHEAA representatives did not appear to have any knowledge about the status of the consolidation or that it was rejected. I was being billed monthly by both UHEAA and XXXX for the same loans, and both companies were reporting these accounts to the credit bureaus, unfortunately I could only afford to pay one company the majority of the time so I made XXXX the priority, considering I had received the consolidation paperwork and was told the consolidation was complete. As a result I fell behind on the UHEAA payments and they were reported as late payments on my credit reports. Multiple calls by me to try to resolve the double billing/payments to both UHEAA and XXXX were unfruitful, it took over a year of making calls, asking for forbearance 's and finally an investigation by the Department of Education XXXX office for resolution. As a result of the Department of Education 's Investigation the consolidation was finally successful on XX/XX/XXXX. Payments I had been making to XXXX during the previous 14 months were refunded to me and the accounts they were reporting on my credit reports were removed, however the negative marks on my credit reports regarding the UHEAA accounts remain. Juggling payments and forbearance 's between UHEAA and XXXX and the financial hardship caused by this situation resulted in past-due payments to be reported to my credit files in XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX of 60, 90 and 90 days respectively on both UHEAA loan accounts ( XXXX and XXXX ).

I applied for an in-school deferment the first week of XXXX for the XXXX semester commencing XXXX. I meet Federal deferment guidelines because I am enrolled in at least half-time units. My application was rejected because XXXX, the administrator of my student loans, stated that my college had reported that I was, at the time, enrolled in less than 1/2 time units. However, I had submitted the application for the XXXX semester and the form was completed by my college 's registrar. I was also informed that an updated Deferment Application form was available and that I needed to complete that form. Please note that the form contained and required identical information as the one I had submitted in XXXX. Nonetheless, both I and my college 's registrar completed the new form and I submitted it in hard copy by U.S. Mail the first week in XXXX. I also uploaded it to XXXX 's website. XXXX again rejected my application erroneously claiming that my college registrar had not completed Section 4 of the form. This was absolutely incorrect. I called XXXX and confirmed with their representative that the form indeed my college had completed Section 4 of the form and that they would reconsider the application. I called again on XXXX, to learn the status of my request and was told that it would take at least two more weeks to consider the application. XXXX has erred at every step of my application process. I asked to speak to a supervisor when I called today, XXXX, and after waiting on hold for several minutes, was told that " no one was available and try calling back later. '' I stated that I would prefer to remain on the line because it had been two months since my initial application and that XXXX repeatedly rejected my application due to XXXX 's own errors. I was placed on hold again for several minutes and was again told that no one was available. However, I was told that someone would call me back today. Because I have repeatedly been given incorrect information by XXXX, I am concerned that they are not complying with Federal guidelines with respect to In-School Deferments. I would greatly appreciate your assistance with this matter.

It appears that XXXX, my student loan provider has reported my current loan status to credit bureaus. I noticed my credit score dropped for no reason. The only thing I believe could have impacted my score is utilizing the CARES Act and going into an emergency forbearance. However, based on Cares Act sect. 3513 loan servicers are supposed to report suspended payments to credit bureaus as if the payments have been made and NOT use any type of forbearance or deferment code. I believe some of the servicers are not reporting correctly. On XX/XX/XXXX my XXXX score dropped by 14 points even though my balance for my student loan had dropped. After filing an investigation with XXXX it appears that XXXX is reporting to the credit bureau that my repayment status is in forbearance. This goes against Cares Act sect. 3513 : ii ) REPORTING.Except as provided in clause ( iii ), if a furnisher makes an accommodation with respect to 1 or more payments on a credit obligation or account of a consumer, and the consumer makes the payments or is not required to make 1 or more payments pursuant to the accommodation, the furnisher shall ( I ) report the credit obligation or account as current ; or and ( d ) REPORTING TO CONSUMER REPORTING AGENCIES.During the period in which the Secretary suspends payments on a loan under subsection ( a ), the Secretary shall ensure that, for the purpose of reporting information about the loan to a consumer reporting agency, any payment that has been suspended is treated as if it were a regularly scheduled payment made by a borrower. Forbearance is typically a derogatory mark on ones credit report but since this is a special forbearance it shouldn't be counted as such per the above section of the CARES Act. According to the Cares Act sect. 3513 loan servicers are supposed to report suspended payments to credit bureaus as if the payments have been made and NOT use any type of forbearance or deferment code. I believe XXXX is not reporting correctly. I will be filing disputes with all three credit bureaus as this has had a negative impact on my score when per legislation this should not be the case.

My bankruptcy was discharged and XXXX contacted me, I am assuming my student loans were bought by them. First person I spoke with was XXXX, he was evasive, rude, kept throwing around garnish your wages, he would call and not leave a message and when I asked him about it he would deny calling me, especially after telling me I would only be working with him. I looked up XXXX /XXXX XXXX XXXX and there is page after page of complaints, so I was very concerned about what I would be dealing with. I finally got a Supervisor and complained about XXXX and I have advised he never to call me and I will not deal with him. In talking with the Supervisor, I am to call in back in a certain amount of days to do this or do that, as though I am a puppy in training and again garnishing your wages is always mentioned. I set up a repayment plan, after advising them I have paid off two prior student loans. I was not advised that they would take my state tax returns. We settled on a payment that would be due on the XXXX of each month and I told them the payment would coincide with my pay day, so it may be before or after the XXXX, that it would be sent. I am told that I must call them and tell them my payment is in the mail, when I mail it to them, even though there is a grace period of 20 day before/after the payment due date. So now, I get emails every other day from XXXX, saying Please read the following carefully ... ... Action is required. It then goes on to say You have failed to make satisfactory arrangements to repay your student loan ... ... it is now due in full. I was told by a Supervisor my first payment isnt due until XX/XX/2018. I have received two of these emails so far. This is by far the worst, the most unprofessional, unethical way to collect a debt, fear and intimidation and lack of maturity, that I have ever witnessed. There is apparently no oversight and I am horrified and disgusted by this treatment and I am tired of it. And, it is important to me to be anonymous, if you contact this State run company.

XXXX offers 0.25 % interest rate reductions if you setup direct debit. They state that one should allow 2 weeks for this application to processed. I filled out the form, mailed it in, and heard nothing for over 3 weeks. I then called to inquire what had happened. I was told that XXXX did not setup my account on direct debit for my current 3 XXXX degree loans because i had previously setup direct debit on loans i had fully repaid approximately 6 years earlier for my XXXX degree. 1 ) This does n't make any sense, and 2 ) why could n't anyone from XXXX contact me about this? A few weeks after this phone call, my first automatic payment became scheduled. Neither the payment due ( approx {$460.00} ) nor the payment scheduled ( approx {$1100.00} ) reflected the 0.25 % interest rate reduction, so i called on X/XX/17 to inquire why. I asked why they did n't reflect the reduction and why the payment scheduled was so much larger than the payment due. I was told that the interest rate reduction would take effect the following month, after the first automatic payment, and I was also told that the larger payment was because the scheduled payments would always be for the same amount, regardless of any prepayments made. I did n't like these answers, but I accepted them. The payment was due on X/XX/17. I had a payment scheduled for X/XX/17. I checked back on X/XX/17 and found that XX/XX/XXXX canceled the scheduled payment ( approx {$1100.00} ) without my knowledge and that my account was now 3 days delinquent. I called to ask what happened and was told that direct debit always starts the month after enrollment which is 1 ) at odds with what my account previously shown and 2 ) at odds with what the other representative had told me on XX/XX/XXXX. I have had multiple issues with XXXX and their handling of my account. This is just the latest issue. I just made a manual payment on X/XX/17. I hope that this particular issue is now resolved. My goal is to bring broader awareness to XXXX 's poor quality of servicing.

On XX/XX/XXXX, I submitted a payment to XXXX XXXX XXXX XXXX XXXX ( XXXX ) from my XXXX Education Award account from XXXX to pay off the account # : XXXX in full, {$3500.00}, based on the payoff generated on that date. I just came into repayment and the actual payment was not due until XX/XX/XXXX. So, I was trying to pay it off a month before it even came due. According to the education award account system, XXXX is set up to receive payments from them electronically via EFT. The payment was NEVER picked up by them, it sat there " pending institution action '' for two weeks. I emailed them on XX/XX/XXXX, never received a response. I contacted their customer service and spoke to a rep named XXXX on XX/XX/XXXX, she had no idea what was going on, could not provide me with any information regarding the payment, and why they could not access it. Told me I would be called the next day ( XX/XX/XXXX ), as she had to refer this to an area in accounting that handled payments. I never got called and had to call them back. When I called back, I got the same run around, no one knew anything at all. I am now receiving calls via an autodialer regarding payments, even though the payment itself is NOT due until XX/XX/XXXX, almost two weeks from today. I have spoken to three different people and NONE of them have been able to provide ANY rational logical explanation as to WHY the payment was not accessed by XXXX and applied to my account. All I am trying to do is pay off my student loan and they seem incapable of allowing that to happen. I requested to speak to someone in accounting ( since they state that is who would have the answers ) and that request was refused. I asked to speak to a supervisor, same thing. All I want to do is pay off this account with the funds from my XXXX award, why is this alleged FEDERAL student loan servicer incapable of facilitating that process when they are supposed to be participating in it?

In XX/XX/2017 I was denied XXXX because of my husbands income. UHEAA my loan company assumes that you have % XXXX of ur gross income for expendable income. They do not factor in taxes or our bills. They refused to look at our financial statement and ignored his XXXX in student loan debt. We can not afford the {$260.00} they want in my payments at UHEAA. When I first called them they told me i could lie on my application and put that i do n't have access to his income because i make less and they could go off my income. I refused to lie on an official document. The second time I called they told me I could make a payment of {$120.00} a month for 6 months but after that I would owe the {$260.00} I told them we will not have the money then. We have a lot of bills. They still refused to look at a financial statement. I have called them trying to get them to lower the payment 4 times this week. The first time I was told by XXXX at their office that they have graduated plans and consolidation plans on student aid.gov. I called back the next day to apply and they said that they do n't have those. I called again the next day on Wednesday XX/XX/XXXX and they told me that another loan company can consolidate for me, like XXXX. I called them and that turned out not to be true. I have a student loan with UHEAA. I have been scheduling automatic payments for years with no problems. I recently adjusted the automatic payment to pay more each month to pay down the principal faster. After adjusting the automatic payment the problems started. My online account shows the automatic payment setup correctly but it is not going through. The first time this happened I wasn't notified until they were about to send me to collections. I used the SAME information used for my automatic payment to schedule a one time payment that got me caught up ( including the late fees they applied on my account ) and that went through. I contacted UHEAA about this and they stated my account has an automatic payment setup so it was my bank 's fault that the payments didn't go through, even though there has always been sufficient funds in my bank account for this payment. I went to my bank and asked them and the ACH department reviewed my account and stated there were no request for a payment from UHEAA except my one time payment. I called UHEAA about this and they stated it should be fine at this point. I asked them to contact me if it doesn't go through again. The representative stated they would notate that in my file and I should be contacted for any problems. The next month, the automatic payment did not go through AGAIN. UHEAA also did not contact me. I checked it the day of and day after to see if the payment would go through but it has not and UHEAA did not contact me about a failed automatic payment. I'm trying to pay the company, and pay my loan faster than required, but UHEAA is not taking my money as schedule on their system, yet still fining me late fees when the automatic payment in their system does not work correctly due to their fault. In my opinion this is now predatory lending tactics to get fines from their consumers.

I am a military Veteran who has been in the process of purchasing a home for me and my kids since start of XX/XX/XXXX. After working with loan officer and to get all requested parts of the process completed for Pre Qual we moved forward and then in XX/XX/XXXX Utah Higher learning reported 90 days late. This came as a surprise and cost of a home for me and my family after reaching out to Utah Higher Learning Education and started an investigation on the reason why the loan was reported late and due to the Cares Act loans was prohibited from being reported late during the pandemic at the time until XX/XX/XXXX until the Cares Act was extended into XXXX. I reached out to UHEAA loans department to try and get this reporting removed and this went through first line reps up to a Supervisor which informed this loan wasn't a federal loan at the time I received around XXXX and due to my filing it should have been removed with XXXX bankruptcy. One first line rep suggest I file their forbearance paper which I did and faxed on different occasions which different reps gave me numbers for faxing for review. At the same time I have started the process for XXXX and XXXX XXXX. I call back again at least once a month up to presence with bankruptcy attorney and loan officer and once the process for XXXX process started my status change and being review by XXXX ( Dept of Education ) The UHEAA reps stated they can't go back and update the reporting late error in XX/XX/XXXX and the forbearance request will be denied without review due to TPD processing put me in a pending status. The docs I faxed to UHEAA was denied and I lost on the home and now in a month to month process where me and my kids can end up homeless and due to VA loan process the error is creating an issue to move forward. UHEAA has failed to provide income sensitive/income driven repayment plan request forms to me after several requests. Over the past 2 years I was XXXX XXXX , and have been unable to make the requested payments on my student loans. UHEAA has not provided requested assistance to have applicable forms sent to me vi a USPS. I do not have a printer or a fax machine, and after the threat of having my account default and sent to collections, I had to spend money that was reserved for groceries and utility bills to have The UPS Store print forms out for me. When I visited UHEAA 's website to obtain the forms I needed, the links they provide on their website to access their forms section are broken and lead nowhere. After finally accessing the forms section and printing the documents I needed, I attempted to submit my forms via fax, only to find the fax number printed on their forms ( ( XXXX ) XXXX ) is an invalid number. I called UHEAA to obtain the correct fax number, reached a pre-recorded message that listed their fax number as ( XXXX ) XXXX ... which is also invalid! This number is an actual PHONE number. I called UHEAA to complain about this, and was told by the customer service rep that their actual fax number is ( XXXX ) XXXX . I was told by the rep that she receives multiple complaints about this daily ... .yet they do not correct this issue. I took the risk of submitting my forms via email, which I understand is not recommended due to the sensitivity of the information contained on these forms, because I do not trust this company and want my communications with them to be documented from now on. This company appears to be crooked and it is unfair to make it nearly impossible for someone with the inability to repay their student loans to be placed on an appropriate repayment plan.

Attending the University XXXX XXXX from fall XXXX I took out four ( 4 ) FFELP Stafford subsidized and six ( 6 ) FFELP Stafford unsubsidized loans totaling {$66000.00} from the Utah State Board of Regents. After my third attempt to apply to the program ( Utah lost my paperwork twice ) I was told that the loans were consolidated and were no longer under the federal umbrella. I was told 'tough ' you're a rich XXXX from DC and I was going to have to pay them off. I learned about two weeks after the phone conversation that my loans were bought AGAIN .... BY THE SAME LOAN COMPANY! I feel this THIRD refinance had to do with my request for forgiveness and gave them to raise my interest another point. My last payment is due XX/XX/XXXX ( I'll be XXXX yrs old - did I mention I plan to retire next year? ) Since beginning payments in XXXX I've never been notified about anything or have I signed any kind of agreement. I had previously submitted complaint and have case number XXXX. This is an update to that complaint. On XX/XX/XXXX, XXXX confirmed by phone and by email that my application for deferment had been granted, after two months of delays on XXXX part based on what appears to be intentional delays or absolute incompetence, as described in my original complaint. I further checked my account status online at XXXX website and saw that my loan had been placed on deferment from XX/XX/XXXX through XX/XX/XXXX. Despite these confirmations of deferment approval, on today 's date, I received an email stating that a payment was due on XX/XX/XXXX! I immediately called XXXX and spoke with their representative. The representative informed me that my account had not been updated and that only XX/XX/XXXX reflected deferment status. This made no sense in light of the fact that a payment was due on XX/XX/XXXX! The representative went on to inform me that she would submit an expedited request for review of my loan status and that this process could take several days. I replied that her answer was insufficient because I have been repeatedly told that every error in XXXX processing of my deferment application that had occurred since XX/XX/XXXX, would take two to three weeks to process and again I 'm being told that I had to wait for some unspecified period of time to learn the status of my loan. The representative replied that she would put an extra urgent note on the inquiry. She agreed to call me by XX/XX/XXXX, to advise me of the status of the correction to my account status that I am seeking. Dear CORNERSTONE / Cfpb ; I'm not sure where to take this anymore, but for the last 3-4 months I been deliberately trying to reach out to the department of education, credit bureaus in regards to negative entries on my credit report and no one seems to help. It's been more than 90-120 days and the creditor, and the credit bureaus have both failed to report. It's impossible that these student loans were verified because it continues to report incomplete, inaccurate, erroneous information on my credit ; & it's basically an unverifiable account. Plus i have never gone to college or universities in the USA - These accounts as i stated before doesn't belong to me and i'm not liable for me. Also, after several research into this matter, through the ftc and cfpb website, i noticed that several student loan servicers were sued for mismanaging for not handling the accounts properly, and then falsely reporting information on an individual credit report.. I believe that section 609 of FCRA also allows me to ask for detail information about the account and how you indeed investigated and your detail process. Im extremely upset and shocked about the way this charge-off account is reporting on my credit report which continues to report with incomplete, inconsistent and unverifiable Info. How can you honestly say that you verified as it being accurate? This was NOT verified! I am requesting this investigation under the authorization of the Fair Credit Reporting Act Section 623. ( a ) ( 8 ) ability of consumers to dispute information directly with the furnisher. What I am disputing : The account you have reported to the three credit bureaus. My basis for this dispute is that I have no knowledge of this account.

In XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX, my student loan servicer, UHEAA ( Utah Higher Education, Assistance Authority ) claimed that I had late payments on my student loan. I was a XXXX at this time and was in no way required to be making payments on my student loans. After finding this mistake on my credit report in XX/XX/XXXX, I contacted UHEAA to help correct this mistake. I was asked to submit documentation of my full time enrollment status ( transcripts ) to UHEAA, which I did. I also, at this time sent documentation to XXXX credit bureaus along with a dispute on this matter. Over our conversation on the phone, the representative with UHEAA was able to see in their own database that this was a mistake on their end and assured me that this would be removed from my credit report by the end of the month when they send their next set of reports to the credit agencies. Months went by and these late payments are still haunting my otherwise perfect credit score. I have contacted UHEAA numerous times to follow up and every time they have assured me that things are showing correctly on their end. I have also disputed again with TransUnion and Equifax and both reports have come back stating that UHEAA is showing up to date information regarding my account, yet the late payments are still being held against me! HELP! I have never made a late student loan payment! This mistake is dragging my score down unfairly. I do not know what else to do to get this issue resolved. I am extremely unhappy. my student loans got transferred from XXXX to Uheaa and my payment schedule is completely wrong. I called when it was transferred with concerns that the balance was reflecting higher then I last saw at XXXX after viewing my online profile. My husband got a strange call to say his account number on his payment is wrong ... umm its my account he has one as well but as he just finished XXXX school his should still be deferred. XXXX took over servicing my student loan in XX/XX/XXXX. The first payment I made they didn't apply until I called them. Since then for over 6 years I received bills from them that said {$0.00} due each month. I continued to pay {$120.00} per month in the hopes that I would pay off my loan early. Unbeknownst to me in XX/XX/XXXX my monthly payment amount increased to {$160.00} so the {$120.00} I was paying was not satisfying the monthly amount due ( at this time I was still getting bills saying {$0.00} due ). Turns out they were taking the extra amount I had paid over the previous years ( paid ahead money ) and were applying it to monthly amount due. In XX/XX/XXXX of this year I got a bill for {$130.00} then the next month for {$160.00}. At first I just thought my monthly bill had gone up. Then in XX/XX/XXXX I received a bill for {$240.00} so I called XXXX. Turns out my monthly payment amount was supposed to increase every two years but they had never sent a monthly due amount on the bill so I wouldn't know it. After multiple calls trying to resolve the issue the response I received was we made an error ( for 6 years they made an error ) and there is nothing they can do but apologize. Now instead of being paid off early for my student loans I am back to the original loan term due to the error on their part of sending a {$0.00} bill every month until all of my paid ahead money was used up. UHEAA ombudsman employees have been applying all principal payments to my interest and unaccrued interest which is incorrect, changing expected payoff dates to XX/XX/XXXX in which all four loans expected payoff dates should be 36months/ year XX/XX/XXXX, illegally deleting each indivual monthly payments ( paid towards principal balances ) ( All interest owed was paid off ) ( UHEAA ombudsman added/ applied all interest back towards all four principal balances knowing that borrower had paid off all the accrued interest applied to all four loans since XX/XX/XXXX ( Unsub/Sub loans ) and XX/XX/XXXX ( Unsub/Sub ) at 6.8 %. Combined four loans total should be XXXX and not over 10k when all monthly payments are doubled and unacurrued interest is added into my monthly payments. Overage payments are to be applied towards principal balances not applied towards interest. Interest should not be higher then principal payments unless I missed payments. I have never missed nor Ben late on monthly payments. When I informed UHEAA of the countless errors they are making, in response to my complaint the errors would be corrected on each of my four loans, instead they apply unacurrued interest calculating from expected payoff dates XX/XX/XXXX and applying it towards all four loan balances. Illegally changing dates, moving monthly payments around to other loans. One balance higher then the other they would go in and remove payments that have been applied or applied incorrectly and apply it to another loan with a small payoff balances ; then turn around and add more unacurrued interest to all four loans again.

I brought my loans to an active status and it was suggested by UHEAA that I consider consolidating my loans. I elected to do so. In 2018 I consolidated my loans with XXXX as it was a " sister '' company wit UHEAA and located here in Utah, locally. I recently had my credit report pulled to prep to purchase a new home. There is a report on my credit dated in 2018 just before I consolidated my loans, causing my credit score to have a pretty substantial hit. I contacted XXXX to figure out what it was. They informed me that it was a hit from UHEAA, who I contacted immediately. UHEAA stated that as the account was closed and paid, as part of the consolidation, which they recommended, that they " could not do anything about the hit '' on my credit report. I plead my case, stating that I did everything they asked, got my accounts current, consolidated on their suggestion, and they are still dinging me on my credit. This hit, which was done while I was consolidating, and I would not have been able to consolidate if there was any delinquency on my account, is preventing me from securing a much better financial situation to purchase a new home. Again, I plead my case to UHEAA, who repeatedly stated there was nothing they can do. This does not make sense as they are the entity who applied the hit. Again, I did everything as they asked and complied with their programs. I need this hit removed so that I can continue to move forward in providing for my family.

I am a XXXX XXXX at the XXXX XXXX XXXX XXXX ( XXXX ). I have a Direct Consolidation Loan that is serviced by XXXX XXXX XXXX XXXX. My employer, the XXXX, has a student loan repayment program ( SLRP ). As part of the annual application process for its SLRP, the XXXX gives me a loan data verification form that I am required to forward to XXXX, so that XXXX can confirm certain details about my student loan. This XXXX form, together with the XXXX XXXX cover letter, asks XXXX to return the completed forms directly to the XXXX, either by mail, email, or fax. I submitted this XXXX form to XXXX on XX/XX/XXXX, using their " File Upload '' feature on my account portal. Three weeks later, XXXX still has not supplied this information to the XXXX. I have contacted XXXX multiple times, both by email and over the phone, and they keep telling me that it can take them 30 business days or longer to process such a request. I do not believe it is acceptable for XXXX to take so long to process such a simple request for information. In fact, last year, in XX/XX/XXXX, XXXX faxed the completed form to the XXXX the very next day after I submitted the request to XXXX. They are now either incapable of providing a minimum level of customer service to the borrowers whose loans they service, or they are deliberately trying to impede my ability to accelerate repayment of my loan through the XXXX XXXX SLRP.

Hello, one of my student loans was recently sold without any day of myself to a new organization UHEAA who then notified my via email that they would need me to log in providing all of my most sensitive information to an unknown company oh, but by the way they already had all of my pertinent bank information and with complete disregard to my pre scheduled payments at my previous loan company were billing me at their discretion ( and by Bill I mean removing the monthly balance that they determined from my bank out directly on a random date. ) The lack of consent needed by the loan recipient to have such sensitive information directly transfered to another company is appalling and I am sure that the sale of my loan is to help bundle with less desirable loans to provide a marketable product that investment funds can purchase, similar to the practices that lead to the housing crisis. The lack of oversight and attention to security of personal information is quite astounding and scares me. Is there no regulation of how this information is passed? In signing up for a student loan do we give up our privacy rights and the security of our financial information for the foreseeable future? I am appalled and I urge you as a regulatory body to intervene sooner rather than later because the implications of these fast and loose processes are frightening

I began receiving harassing phone calls nearly everyday. I tried to explain I will send a check as soon as I get paid. The amount they required was more than I could afford that week. This week I sent them a check in the full amount requested. The phone calls came every day and grew more and more aggressive. They threated to call me 3 times a day and claimed they have every right to do so legally despite the fact I told them they have been paid. They continued to repeat themselves redundantly. The caller/ collector insisted, she had confirmed with her manager and she was with in her legal right. Part of the reason my account went into collection status is due to the fact they stopped sending me a bill ( US Postal service ) and the last few bills they did send are clearly printed " XXXX due, XXXX owed '' dated XXXXXXXX XXXX. I may have misunderstood the rehab program believing that my account had been settled. XXXX XXXX 13 months later after no contact, I got a letter and began getting calls from their collections. I immediately budgeted for a payment and made the full payment requested about a week later when I had the money. Today I continue to get calls threatening to call me three times a day in addition to the interrogating questions. I believe this to be excessive abuse of their authority and illegal behavior.

I contacted XXXX to tell them that I wanted any payments in excess of my minimum payment to be allocated to specific loans ( ie the loans with the highest interest rates ). They told me there was no way for them to do that and that additional payments would be treated as payments in advance and such additional amounts would be allocated equally among all loans of various interest rates. I told them that this was unacceptable and that alternatively I could provide the exact amounts each month that should be allocated towards specific loans from the aggregate autopayment. They said they could not set this up in advance and my only option was to call them by phone each and every month after the date on which an additional payment had been made and request that such additional payments be reallocated after the fact ( which would require the phone representative to email their accounts team who would effect the reallocation within 3-4 business days ). In XXXX of XXXX I submitted a consolidation application and selected XXXX as my loan servicer. At the time all but XXXX of my loans were being serviced by XXXX. Those XXXX were being serviced by ACS. XXXX processed the application and they tell me that they sent payment to ACS on XXXX XXXX, XXXX. ACS has informed me that they transferred my loans to XXXX on XXXX XXXX, XXXX. XXXX now says that those XXXX loans are in repayment and have not been paid. XXXX tells me that they have not received the returned payment they made to ACS and can not, therefore, proceed with the payment to XXXX. ACS informed me today that they received payment from ACS but because the loan was already transferred to XXXX they returned the payment, but that they show that it was returned to XXXX XXXX Servicing, with whom I have never had an account. They tell me they will investigate but I was told on XXXX XXXX by a XXXX representative that they would investigate and take care of the situation. I 've been waiting for almost a month but the consolidation has not been completed I am repeated told by all XXXX servicers, XXXX, ACS, and XXXX that they are waiting on something from the others and it will be taken care of if I 'm patient. But that 's simply not true and it would never have made it to this point without my persistence.

I received XXXX loans, XXXX unsubsidized and XXXX subsidized, through XXXX. On XX/XX/XXXX I processed a payment for the full amount of my unsubsidized student loan through XXXX, with specific instructions to apply it to my unsubsidized loan. When I checked on my loan on XX/XX/XXXX I noticed that the payment had not been applied, and called customer service. After a lengthy conversation with their representative, the payment was accepted and showed as such through the XXXX payment system. Before completing the call I confirmed with the representative that any extra interest accrued since the XXXX would be written off and the money would be applied to my unsubsidized loan. On XX/XX/XXXX, after receiving another loan disbursement, I checked my account and found that, although the payment had been accepted on the XXXX, it had not been applied until XX/XX/XXXX, almost a full month after I initiated the payment. Additionally, the money had been divided between my unsubsidized and subsidized loans, against my express instructions and despite the assurance I had received from their representative. On XX/XX/XXXX I sent an email to Cornerstone detailing these issues and received an email saying I would hear back within two business days. After two full business days I have still not received a response.

I am a XXXX. I have been harassed for literally years by loan collectors. I have been in school, continuously, for the past several years, and I am in deferment on my student loans. I have received a threatening message, yet again, claiming my loans will go into deferment. I have filled out multiple forms with every loan provider I have ever had, with the proper documentation, showing that I am supposed to be in deferment. I have done this at least four times in the past six months with hard copy forms, and several more electronically and via email. I have paper records, and electronic records of such communications. I have repeatedly sent information to XXXX to request IBR, etc as I am not in school. I can not afford to make ANY payments. I work at a restaurant and hours have been cut due to the season which causes a reduction in business. I supplied my check stubs and was advised that based on tips that were averaged that I do not qualify. My check stubs at the time showed I made about $ XXXX/ {$15000.00}. I have repeatedly faced this information. My family has faced information including check stubs. I ended the year {$17000.00}. No one knew anything, the answers were ludicrous, and no one seems to care. I was supposed to begin paying my loan serviced by XXXX in XX/XX/XXXX as I graduated in XX/XX/XXXX. XXXX claimed that I was in school until XXXX. I advised that this was wrong and I asked to begin paying my student loan and asked how much the payments were. They refused to give me a payment amount blamed the wrong date on XXXX ( the school ). I know this is not correct as I have another servicer and they provided me with payment information. They offered my a forbearance, which they said I could only have one. I declined as I want to have it available for a future time in case I need it. My student loan was moved from XXXX to your UHEAA company. It was placed in forbearance for some time, then was paid at XXXX $ / month since my marriage in XX/XX/XXXX. By your policy I was to receive bill notifications, but the last received was XXXX XXXX. The email on file was validated as correct. Notifications are not present in my email nor spam nor trash folders. Yesterday, our checking account was debited the remaining XXXX without notice, overdrawing our account just prior to our mortgage payment. Complaint to your customer representatives ( XXXX, and XXXX other ) was met with policy statement of 60 days to return erroneous withdrawals. My bank takes 10 to 45 days to process unauthorized transactions, and decline of payment takes 30 to 45 days. All effort to persuade your representatives that your offical error correction policy is utterly inadequate to this specific situation was unsuccessful. It was made clear, by your policy, that our ability to pay our mortgage and other bills, and our credit rating, are inconsequential to your company 's adherence to a policy of taking 2 months to correct an error. This complaint is about Utah Higher Education Assistance Authority ( UHEAA ) in XXXX XXXX XXXX, Utah ( XXXX ) XXXX. For nearly a year I have been requesting my due date be changed so I could avoid late fees. Not once have I received an answer and not once has the date been changed while they continue to collect late fees from me. Two-three months ago I spoke with a rep who said my requests had been denied because I have one subsidized and one unsubsidized and neither qualify. Regardless, I'm extremely frustrated that these lame excuse seems to be the reason why I can never do anything with my student loans such as consolidate or modify interest rates. Today, I spoke with XXXX who informed me the reason I've been denied is because my account is always delinquent when they review the account for due date change. That's even more absurd because I request the change every time ( once a month ) I make my payment. I want this due date changed so UHEAA can stop collecting late fees from me. This is extortion by ignoring my requests, not communicating the real reason for not changing. I want all my late fees returned to me or applied to my balance. I had my federal student loans at multiple places, XXXX and XXXX, and applied to have it consolidated, to XXXX. During the consolidate however XXXX decided that they to sell my loan, to XXXX. XXXX never bothered to verify that information was still accurate after they completed their process before they sent the money. XXXX is now charging me for the new consolidated loan even thought the original loan still exists. XXXX has now been paid twice for the same loan they claim to have sent the money to XXXX however XXXX claims to never have received it, even though it has been over a month, and is continuing to charge me for the loan. I have spoken to customer service at each company multiple times and all they do is tell me to call the other companies. Having the loans duplicated is hurting my credit and having to pay the same loan twice is straining my budget. Even if I eventually get this worked out and get reimbursed the money I am paying to the principal, I doubt I will ever get back the payments I am making to the interest. Right now everyone is making money off of me and I end up with double the debt and having to pay the same loan twice, and the longer this goes on the more it is costing me.

I have been a XXXX student since XXXX, enrolled at XXXX XXXX University. XXXX University has up-dated my enrollment status on the national database system every semester. As of XXXX 2016, Utah higher education Assistance Authority ( UHEAA ) has billed me, requesting payment on my student loans. As of date ( XXXX XXXX, 2016 ) UHEAA is showing me as XXXX months past due on my federal student loans, my credit score has went from a XXXX to a XXXX due to the negative reporting, and my Federal and State tax refund have been placed on hold due to this negative reporting. Every month I am told I am past due on my loan, that I must make payment today, that it will be reported to the credit bureaus ... in the next breath they report that they see I am in school and that they will get this taken care of. I have federal student loans serviced by Utah Higher Education XXXX ( XXXX ). XXXX recently transitioned to paperless billing, and claimed to provide access to billing statements online. This is false. When logged in to my account, I can see the date of my most recent bill and am given the option to " view/print bill, '' but doing so opens a PDF with an error message. There is also a " paperless inbox, '' which claims " You Do Not Have Any Billing Statements to View. '' I called XXXX, and the customer service representative seemed to be aware of the issue with the error message PDF, but said only that the IT department was located elsewhere and she could not provide me an estimate of when it would be fixed. She also could neither provide a copy of the billing statement via email, or upload it to the " paperless inbox '' section of my account. Instead, she said my only option was to wait to receive a paper copy, which she had to " generate, '' that would be sent in 2-5 business days. I believe XXXX is intentionally making it difficult for borrowers to obtain their billing statements, by transitioning to paperless billing but then failing to make billing statements actually available online.

My loan was purchased by XXXX from XXXX in approximately XX/XX/XXXX. I received a loan payment disclosure statement on XXXX/XXXX/16 that stated my interest rate was 6.8 %. However, the loan had an interest rate of 5.8 % at the time it was purchased. I contacted XXXX about this and they gave me instructions as to the documentation I needed to provide to prove the correct interest rate. I sent the documentation to XXXX on XXXX XXXX, 2016 via email as they requested. Since then, I have called approximately 5-6 times to get a resolution on this matter. Two months have passed and there has been no response via email, snail mail or phone. Each time I call, a representative has told me that they are processing it. However, I have not received any confirmation from the company that the documentation was received ( no reply to the email ), nor has any representative followed up with me to update me on the status of my request. All the while, my loans are being charged the higher interest rate. The stalling and delay tactics are extremely frustrating and obviously I will not pay the higher rate and expect to be credited the difference in the interest amount charged at the higher rate.

Last fall ( around XX/XX/2018 ) I was renewing my IDR repayment plan with XXXX servicer and requested that they send me via mail, a hard-copy of all qualifying payments for my own records. It has now been more than 6 months and I have yet to receive this in the mail. I also spoke with them today to follow up and they apologized for not getting me these records and that they would have to put in a new request into their system. Unfortunately, their website is pretty basic and there is no way for me to run a query to display my qualifying payments. Any bank or credit card company needs to be able to get their customers this information so there is no reason by a student loan servicer should not be any different. I also wish to note that nowhere on there website do they state the type of repayment I am in. As someone who is on a student loan forgiveness track this is incredibly important information to see. Also none of their IDR repayment forms display this information which is also incredibly misleading and hurtful to customers wishing to confirm their repayment or gather documentation towards forgiveness for a particular repayment plan.

On XX/XX/XXXX, I met with a Legal Aid lawyer about my loan with XXXX. I am unemployed, and can not afford to pay this loan.I try my best to make ends meet to feed, clothe and house myself and my XXXX children, but paying this loan makes that impossible for me to manage. Legal Aid helped me to fill out a REPAYE application on XX/XX/XXXX which was faxed to XXXX, my servicer for my federal loan. At the end of XX/XX/XXXX, I received notification from XXXX that they could n't process my application for REPAYE because my loan was in " paid ahead/deferred status '' I contacted XXXX and cancelled the deferment. They still refused to process my REPAYE application, and told me I used the wrong form ( the one I used was the official Department of Education form ) Because I received a bill that was due on XX/XX/XXXX, my attorney recommended I contact XXXX and have them put my loan in deferment/forebearance temporarily. When I called, XXXX told me that " the Department of Education eliminated the option '' to stop payments temporarily. This is ridiculous. In the summer 2016 XXXX XXXX closed it 's doors while I was going to school. I had gotten student loans from XXXX XXXX and was told because the school closed those loans would be discharged. I followed XXXX XXXX 's instruction and was denied. They told me i was denied because the loans were in use with another school, XXXX XXXX XXXX XXXX, the school I go to now. However, because XXXX lost its accreditation no school i found will take XXXX credits including XXXX. They first claimed the loans were knew and only for XXXX however I got the loans three months before I even enrolled in XXXX. They said they made a mistake and told me to resubmit my paperwork and they 'll take care of it. Something I sent along with my forms were documents from XXXX that they did not receive XXXX transcripts and if they did n't they would n't be able to use them because of loss of accreditation. I have been on an income-based repayment plan for my student loan for several years. Recently, my loan servicer, XXXX, sold my loan to XXXX XXXX sent my income-based repayment ( IBR ) application weeks AFTER they say it was due. They mailed it on XXXX XXXX, 2016, according to the date on their letter with the application. It arrived on XXXX XXXX, 2016. Their letter said the application had to be returned to them by XXXX XXXX, 2016 -- weeks BEFORE THEY SENT IT or I 'd have to start paying {$71.00} a month. I wrote a letter along with my IBR application, explaining that I could not send it in before they even mailed it to me. They ignored my letter and began billing me.Apparently, they wo n't process my IBR, although I have been in the program for years and should be paying {$0.00} based on my income. I can send you the letter, the application, and any other evidence. If you look at the XXXX XXXX you 'll see they are doing similar things to lots of other people who were on IBR and have been unfairly removed from it by XXXX. This outfit is a scam, preying on people who ca n't afford to fight them.

XXXX was managing this loan but moved it UTAH HIGER EDUCATION ASSISTANCE AUTHORITY ( UHEAA ) earlier this year. At the time it was moved to UHEAA, I was on deferment due to hardship. Prior to my applying and being granted deferment, my monthly payment was {$280.00} but I consistently paid {$300.00} monthly for over two years. On XXXX XXXX, 2016, UHEAA sent me a Repayment Disclosure Statement, which showed that my loan amount had ballooned in spite of the fact that I was paying a little more than my monthly repayment sum ; also, I was making payments even while I was on deferment to eliminate some of the principal and the interest that would have accrued during the period of deferment. Surprisingly, UHEAA statement did not reflect those payments. I am truly suspicious of what UHEAA claimed to be the balance of this loan. I had called them several times in my attempt to get answers to my questions but I have not succeeded in speaking to anybody because I am usually put on hold for AT LEAT 30 MINUTES on each occasion that I do hang up out of frustration. My loans were recently transferred from XXXX to UHEAA. Since being transferred, I have had double payments withdrawn from my checking account. I was also sent a letter dated a month after they claim my IBR application was due. They told me repeatedly they would fix double payment and over payment issues, but never did. They told me they would put a hold on my direct payment, while issues were being resolved. They did not do this and continued to pull XXXX times my IBR amount out of my checking account causing a severe hardship for my family. We work hard to have good credit. Contact links on their website are frequently broken. They take weeks to reply to emails. If you read the reviews on their facebook page you will see XXXX people with similar complaints. They straight up lie to people. They take 60+ days to process IBR applications. We never had any issues with XXXX and have had nothin but problems with UHEAA. They need to be seriously looked at for bad or illegal business practices. They are ruining peoples ' credit and their lives. Please help all of us find resolve.

XXXX was contacted and reports to me as a consumer that my student loans are in closed status as I am still in my 3 year review period from XXXX and XXXX XXXX Discharge. The review period ends on XXXX XX/XX/XXXX. But the Credit report given to a potential creditor on a hard pull of my credit still lists my student loans as delinquent and not in the closed status. The Credit dispute procedure was followed by me with XXXX online in previous weeks and months. I rechecked my credit report with a local credit union and the delinquent student loans are still included in the information that the creditor receives but not in the information I see on my XXXX credit report I am shown by my XXXXn consumer account. My student loan servicing was sold from XXXX to XXXX. I contacted XXXX to ask if this would require any of my Auto-Pay information to be changed or confirmed. They informed me that there was no need to change anything as all of the Auto-Pay information was coming over from XXXX and payments with XXXX would continue as normal. I 'm paying more than the minimum in order to pay down the loan faster and reduce how much interest I 'll be paying. The first payment went through at the correct amount, but the second payment did not. The second payment was reduced, without my knowledge or consent, to an amount over {$50.00} less than my previous payment. Furthermore, my interest rate of the loan mysteriously went from ( an already ridiculous within this market ) 6.55 % to 6.8 %! I 've written to XXXX and have not received any response. This increase in interest ( which has potential to be fraudulent ) as well as their decision, without my permission, to decrease my monthly payments via AutoPay will greatly increase the interest that they 'll collect.

To whom it may concern, Last Friday, XX/XX/2018, I scheduled a payment of {$500.00}. Usually the money gets debited from my bank account the next 1-2 business days and is then reflected in my XXXX account the next day. However, it is now XX/XX/XXXX, almost a week later and the money has not been debited from my bank account. According to their website, it says " please allow up to 3 additional business days for the payment to be posted to your loan account and debited from your bank account. '' However, as previously mentioned, the money usually gets debited from my bank account a day before it's reflected on the XXXX website. Therefore, even if the money gets debited tomorrow, it won't be reflected on my XXXX account until Monday at the earliest, and I'll surely be gaining interest on my student loans until then. This morning I received a call from XXXX of the Utah Higher Education Assistance Authority -- a collection agency contracted by the state of Utah. He contacted my employer for garnishment on A LOAN THAT NEVER EXISTED. He had my name wrong, my SSN wrong, said I attended XXXX XXXX University ( never did ), that I owed {$250000.00} ( never took out a loan ), and that Ive been in default since 2007. All wrong. Since I didnt cooperate by giving him my true information he said he was issuing a garnishment order on my pay. He was belligerent and didn't care that all his information about me was wrong. I called another person at his agency, who confirmed that he does work there ( UHEAA ). She said he violated several company rules. Then I spoke to a person from XXXX XXXX XXXX who said these companies use scare tactics to get money from people who don't owe and that it's becoming a national epidemic. I am paying only partial of my student loan and I was advised, by Cornerstone ( XXXX ), that i would still receive phone calls, that was fine, but I told them not at work. I have literally told this company over 50 times to stop calling me at work and call me after XXXX XXXX. I got so mad that I blocked the number. Now they are calling me from another number! I have told them every week this month to stop! They are being deceptive even though i have communicated with them and are paying something when I can. Prior of leaving I contacted my student loan company XXXX for SCRA benefits and deferment of payment while on orders. When I contacted them they told me I was ineligible for the benefits due to me not in a " XXXX or XXXX XXXX ''. This is the first I have heard of this in my conversation with numerous other people who use this while in training. The only assistance I was offered was to reduce my payments to a smaller amount. I have a number of issues with my new loan service provider XXXX. 1. They do not provide bill pay access to Banks. So I have to log into their system to pay my bill. 2. They do not list under my account the amount I need pay each month. I assume it is the same as under XXXX but can not find it. Nor have they ever provided me with a pay by date. I do not know when it is due. 3. I have not been able to get email statements despite trying to sign up for it numerous times. The system says I require 2 emails, 1 or the account and 1 for the my statements. I only have XXXX email account. All of these issues combine to make it a big hassle to pay. And the only reason they do this is to make money, hoping I am confused and pay the wrong amount or fall behind. By far the most hassle I have every had to deal with in paying bills. My loan was purchased from XXXX by UHEAA, and it has been nothing short of a disaster. A number of customer service problems and servicing issues. However, the one that needs to be fixed is that my paid-up status ( approximately 1.5 yrs ) was not transferred, making it difficult for me to take advantage of employer based payments on my loans ( would fall short of the minimums ) without having to pay out of pocket. It 's now been 6 months since the purchase of my loan and they are still 'working on ' a solution that should be fairly straightforward. I did not choose to go to UHEAA, I was moved there because they purchased my loan but they are not keeping to the parameters outline when I originally agreed. They have had to put my loan in forebearance, which means I can not access the employer program ( loan must be in good standing ). I have federal student loans from Utah Higher Education Authority ( UHEAA ), which I am making monthly payments of principal and interest of {$420.00} on the XXXX of every month. I made an additional payment of {$10000.00} on XXXX XXXX, 2016. It is my understanding that XXXX percent of that {$10000.00} should go towards the principal of the loan, since it is an extra payment on top of my regularly scheduled monthly payments. This is also what UHEAA representatives have told me on numerous occasions. However, XXXX applied {$21.00} of my payment towards interest for the four days of interest that accrued from my normal payment date of the XXXX to the XXXX. I have been trying to arrange an income based repayment plan for XXXX months now. I mailed in my forms and supporting documents on XXXX XXXX, and did not hear back from XXXX. On approximately XX/XX/XXXX I submitted a request for in-school deferment to XXXX, my Federal loan servicer from when I completed a XXXX post-bac program. On XX/XX/2020, UHEAA that administers my student loan sent me an email telling me that my state-New York was declared a disaster region and that I qualify for loan forbearance without interest accruing during the forbearance period. I accepted the loan forbearance program which was to end in XXXX. On XX/XX/XXXX, UHEAA sent me another mail reminding me that the forbearance period is coming to an end in XXXX. I have asked to have my account pulled for {$150.00} a month no matter what my payment might be ( it is lower than that ). I have paid off XXXX loans and each time I pay off a loan they lower my payment amount and stop taking out the {$150.00} as instructed. I 'm so frustrated as I want to keep my payment amount the same so I can pay off my loans more quickly than required. I attend XXXX and graduated in XXXX, and like most people my age I live at the poverty level. XXXX assumed my loan from my old loan holder in XXXX of XXXX and have been nothing but a problem to work with. I had a change in bank accounts. In XXXX XXXX , I filed paperwork to have my autopay account changed to my new account. The change was never made. I called in XXXX and a representative told me the paperwork was received and she was unsure why it was never processed. She assured me that she would make sure it was processed. However as of this date, it has not been processed. My student loan is held by XXXX. I had issues creating a profile and logging into my online portal. I called the company and they said there were known issues with their mobile app and I should try to set up my account on a desktop computer, which I do not have access to. They did take my payment over the phone and it brought my account current. I found out after this that although they send me a bill for 1 student loan payment, they turned in 5 separate delinquencies to the credit reporting agency. I successfully completed rehabilitation of my federal student loans in 2018. Per the rehabilitation letter I received from the company, " ED will request that credit reporting agencies remove the record of default on the rehabilitated loans '' US Dept of Education has my loans listed as open and payment status as current, however a previous servicer, Utah Higher Education Assistance Authority, still has these accounts listed as closed and sold to another lender, but they still have them in a negative status on my XXXX, XXXX, and XXXX credit reports. A set of my student loans are managed by XXXX. I had signed up for direct bill pay and had expected that my student loan payments were being made automatically, on-time. Cornerstone Federal Loan service incorrectly reported that my student loans were late on XX/XX/XXXX. I have 3 90 day late payments. At that time they closed my account and transferred it to XXXX. I was on a deferment you can check the student publishing clearinghouse. I was able to correct this information on my XXXX report, but both XXXX and XXXX wont let me conference call with a Cornerstone representative. I 've filed 5+ online disputes with each Credit Bureau and each time the results come back that the information ca n't be changed. Please help me! My loan was recently transferred from XXXX XXXX to XXXX. I was never notified about the transfer in writing, I only found out when I tried to log into my XXXX online account to make a payment on my loan. This gave me a message that the loan was transferred, and I would need to go to uheaa.org. I created an account on XXXX, but my loan does not show up. UHEAA/ UTAH XXXX is reporting erroneous lates on my credit file. I have had my account in deferment and every time it would go out of deferment i would get a call asking if i wanted to go back on deferment. Unfortunately during COVID i was out of work and unable to make those payments which is why i kept deferring my payments. The above options do not apply to my situation, so I just picked XXXX. Actually, they never call me! Which is part of the problem. In short, I try and make payments and they repeatedly send it back unpaid. I have successfully made XXXX payments since XX/XX/XXXX. My student loans were transferred to XXXX from XXXX. I had a rate reduction to 4.3 % while at XXXX for setting up auto payment at graduation.. After the transfer, XXXX set my rate back up to 6.8 %, I have the letter showing the terms of my loan with the rate reduction. XXXX acquired my federal XXXX school student loans from XXXX and took the opportunity to remove the 2 % discount afforded to my loan repayments, because of auto debit. I recently changed my auto-pay from XXXX checking account to another to my student loan account via Cornerstone. They never notified me that by doing that they would skip my current payment and continue next month.
