USA Discounters garnished my account and stated that if I did not pay {$2900.00}, they would keep my account locked. The amount previously stated was more than half of my account. I agreed to pay so that my account could be released and I could use the remainder of my money to buy food and other required things for my children and household. When they garnished my wages, I was unable to pay my rent and bills. My landlord contacted my XXXX my work. Now, I am facing disciplinary actions at my job and possible eviction, as I have been late on my rent before due to financial issues. I was attempting to pay off my debt with USA Discounters previously and agreed on a settlement of {$3600.00}. I paid {$1800.00} XX/XX/XXXX and because of financial hardships was unable to pay the rest. My intentions were to continue paying off my debt once my situation improved. I was going to begin making payments again XX/XX/XXXX as things were looking better financially. USA Discounters contacted the finance department to have my wages garnished and sent paper work to my commander about my debt. This caused me undue embarrassment and interfered with my work. They harassed me at work. When I attempted to gain access to my XXXX account on XXXX XXXX 2015, it was locked due to a garnishment placed there by USA Discounters. There was a note on my account stating that I should call an Attorney, XXXX XXXX XXXX XXXX XXXX. I contacted him and he stated that he can not release my account until I call the creditor, USA Discounters and come to some agreement with them about making payments. I called XXXX XXXX XXXX XXXX ) and she told me that I violated the original agreement by not continuing the payment so now I would have to pay half of the original debt ( {$5800.00} ). I told her that I could not afford to do that because I would n't be able to pay my rent and other expenses. She stated that if I did not pay the {$2900.00}, they would continue to hold my account and I would n't have access to it. I felt like I had no other choice. I needed groceries for my household and I had to pay child care and other acute expenses so under duress, I reluctantly agreed to sign a garnishment disposition authorizing the bank to release the money. After paying USA Discounters the money, my account was released. I did not have enough money after that to pay for all my required living expenses. I could not afford my rent or bills. I used the remainder of the money in my account to purchase needed food, pay for child care and other immediate necessities. Because I did not pay my rent, the landlord went XXXX and filed a complaint against me for not paying my rent. I have to face possible disciplinary actions at this time and I am under extreme pressures from everyone, due to the domino effect of this garnishment. I am requesting an investigation into this situation as I do not understand how the Soldiers and Sailors act did not protect me and how a lawyer, working for XXXX " assisted '' my creditor in getting money from my account by providing them with information about my account and making it easy for them to extort money from me. I am currently XXXX and undergoing immense stress due to this situation. I intend to settle all of my debts. I am a divorced mother of XXXX XXXX XXXX ) and had been experiencing back-to-back financial crisis and this situation set me back even further. I would like to know what my options are in this situation. I believe that the XXXX lawyer and the USA Discounters representative were both wrong in how my case was handled.

I spoke to your company before and informed you that I am in dispute with the medical service provider and that you needed to validate this debt but it appears you have refused so I am sending this letter to you. Be advised, this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 ( b ) that your claim is disputed and validation is requested. This is NOT a request for " verification '' or proof of my mailing address, but a request for VALIDATION made pursuant to the above named Title and Section. I have bi-weekly allotments that come out of my account for USA Living ( previously USA Discounters ). Because I ran in a financial hardship at home, I ceased my payment XX/XX/XXXX to the present date ( roughly one month ). Once the allotment was no longer sent to my account with XXXX XXXX XXXX, I began receiving daily phone calls. Next the emails started. I communicated with a representative by the name of XXXX XXXX and informed her that I had pertinent financial obligations at home, which required me to temporarily stop the allotment, which in turn, I agreed that I would re-start within the next two weeks in order to ensure that the following month 's payment would be received on time. She told me that based upon what was already in my allotted account, that I owed an additional {$160.00} and that as long as it was received before XX/XX/XXXX that she would not report an adverse note on my credit report. I told XXXX that I 'd take care of it before the end of the month, and that I needed a little more time to ensure that things at home were okay. Three days later, I received emails from her stating that I failed to comply and that they would refer me to their pre-legal department since they did n't receive the {$160.00}. Again, I reiterated to her that I said I 'd get it in before the end of the month since two weeks had n't passed since we last talked, and I did n't receive my next paycheck. I then tried to contact the store in XXXX, and noticed the phone was disconnected. I then tried the store in XXXX, and noticed the line was disconnected. In turn, I did an online search and learned that the stores shut down. I emailed XXXX and requested for information in writing about what happened, and also to provide information on how I can mail my balance of {$160.00} since I was not comfortable sharing my personal bank account or credit card information. She still remained persistent and threatened to refer me to the pre-legal team. I 've yet to receive any notice of what happened. She said that I still have my contractual obligations to fulfill and that was it. I would like to mail my remaining balance as my contract does not state that I have to provide a personal credit/debit card for payment. Typically, I could run cash into the store, however, since the stores are closed I no longer have that option. Please help as this is truly concerning in that she is not willing to provide any written communication as to what happened and how I can continue to make alternative payments, which was previously an option.

I financed some items from USA DISCOUNTERS in XX/XX/XXXX while I was stationed at XXXX XXXX in XXXX State. I started soon after getting calls at work asking to speak to my supervisor. A women called my office XXXX times a day telling my supervisor my account was late and how much I owed to them. I returned their call and asked them not to call my job. They continued to call and tell anyone who answered, my detailed info about my account. I talked to someone in the debt section and I was told that my account was n't over due yet but it would be in 30 days. I asked so why all the calls? I was told because my full payment was short by {$45.00} and if not paid I would be over due. I paid the money. Shortly after I was placed on orders to XXXX XXXX and sad to say, I was going through a divorce. I called USA DISCOUNTERS and told them my money will be short because I no longer have XXXX incomes. I fell behind on payments and I received a court sums soon after saying I was being sued in XXXX courts. I never bought any items in the state of XXXX and I was still stationed in XXXX. I sent a letter to the court stating I was in XXXX. I never hear anything back from them. This XX/XX/XXXX, I retired from the XXXX. My account was frozen by USA DISCOUNTERS because of the lawsuit. I can not get any money out of my account which is my retirement. They are trying to garnish my retirement. I was told by my jag office that it could not be garnished but seems like they were wrong. I 'm currently living day to day trying to make it on what little money I have almost just change now. My account is frozen and I have medical issues I have to take care of and bills to pay but I ca n't. Just need help trying to figure out what to do.

My husband XXXX XXXX XXXX XXXX and I opened a joint account with this company in XXXX for furniture. We purchased a mattress set and a bedroom suite XXXX My husband is civilian DOD and the payments come out of his pay automatically through allotments bi weekly for {$100.00}. We have roughly paid over {$5000.00} on a balance that was supposed to only be a little over {$4000.00}. After two years we have not seen much decrease in the balance so I have called on several occasions to try and get a physical statement mailed to me so that I could see all of the payments and balances over the past two years. We 're going on close to three years for a balance we were told would be paid off in 30 months. The first attempt was inside a store and after arriving I found out the store had closed, so I called the XXXX number listed on our contract. The representative I spoke with refused to give me information on the account because she said I was n't listed on the account any more. Well I found out they rewrote the contract in XXXX after my husband added a jewelry purchase. I was not notified by phone or in writing that the terms of the contract had changed nor was my husband told that day that I would be removed from the contract. He has also attempted to get an itemized statement reflecting all payments and balances and to no avail. Additionally, the full contracted amounts are still being reported on my credit reports as closed accounts even though they unlawfully removed me from the contract. When I call they claim there is no record of me being on the contract prior to them rewriting it.

In XX/XX/XXXX I purchased a TV on contract from USA Discounters, I was laid off a few weeks later. I was unable to meet the agreement and defaulted. USA Discounters began to harass me thru phone, email, and third party contact. I mailed a cease and desist letter in XX/XX/XXXX as well emailed and verbally informed then of the XXXX XXXX XXXX. Then then Sued me in XXXX a state that I have never lived in nor been to. For the last 5 years now they continue to harass me, friends and family in a attempt to have me pay for the loan. Today XX/XX/XXXX XXXX XXXX with USA Discounters / USA Living. called a third party friend to reach me, also back in XX/XX/XXXX they called the same third party and openly discussed the account with him. I called today XX/XX/XXXX USA Living to discusss why they continue to not fallow the XXXX XXXX XXXX order, I spoke to XXXX XXXX. He claimed there was no XXXX & XXXX on file but did acknowledge the emailed XXXX & XXXX as well as the verbal XXXX & XXXX back from XX/XX/XXXX as well as USA Discounters releasing private account information to the same third arty they called in XX/XX/XXXX he said it on in the notes in the file. I again claims that they will not call me or any third parties again, but I have been told that over XXXX times and it continues to happen.

USA discounters has not been refunding the total amount back to customers when they add new products to a contract. When they rewrite the contract They do n't apply the full refund back to the customers. A little bit it left in the principle to keep accumulating interest and the principle. This happened over my XXXX rewrites as I added new items. I did n't catch it until I was in a court battle with USA discounters and reviewing all my contracts. I noticed the difference when I compared there previous warranty and debt cancelation charges to the refunded amount. I read thought there bankruptcy paper work and they stat in there that those XXXX items are broken down over the length of the contract. When I went to court about the matter we settles but the lawyer told me I would probably win that section of my case if we went to the judge. I settled on a XXXX pay back ay 9 % interest over XXXX months. Which is fine by me when I was suppose to pay XXXX total. I need to bring this forward because if they did this to me they are doing it to other customers before they started there chapter XXXX. I hope you can look into this and it is found to be true and they are stealing form customers.

My husband and I went to a company called USA discounters back in 2009 when we were XXXX with our XXXX child and just getting settled right off base. We were both in the Military. Everything was fine, until my husband was suddenly XXXX three days after I XXXX and I moved home to be closer to my family. Money was extremely tight, things were getting worse, and we started missing payments. The payments were around XXXX a month. USA discounters started calling us threatening legal action, and finally started sending letters talking about taking us to court ... in XXXX. I lived in XXXX at that point and my husband was in XXXX. There was no way we could have ever gotten there. Now, this debt sits on my credit score. It gets updated every year, and it has prevented us from getting a house. We have XXXX small children. I still do n't know what to do. I 'm hesitant to even try and pay it, because of how terrifying these people were in the past to us. Now it is with a credit reporting agency, the same one who USA discounters was sending these horrible notices through. I need help.

I had an account with USA Discounters and I saw that they are now going out of business. I received a letter from XXXX ( I am Military ) saying they were going to garnish my wages. I did not receive any paperwork or court order of having to pay them. I had trouble paying and they ended up suing me in XXXX back in XXXX 2015. I did not know that they did this and before tried working with them. Now that they are out of business how am I supposed to fight this? I am XXXX and according to XXXX I got the court order which I did not. What am I suppose to do to combat something I did not know was happening? I looked up Warrant of Debt ( that is what I guess they supposedly served me with ) and it says that they can not sue me in a state where a contract was not signed. I was in XXXX at the time and When XXXX said they sued me, I was in XXXX and the court proceedings were in XXXX. Attached is what I got from XXXX but never got any court orders.

In XX/XX/XXXX, USA Discounters/USA Living filed a lawsuit in the state of Virginia for an account I opened on XX/XX/XXXX while serving as an XXXX Service-member. They charged me 18 % to 19.05 % interest rate and {$5.00} XXXX Specialist service fee. In XX/XX/XXXX, I was medically discharged from the service and could not make my payments on time or at all due to lack of or fixed XXXX income. In XX/XX/XXXX, I could not keep up with payments, and finally had to stop payments to USA Discounters in order to live. I offered USA Discounters to retrieve its merchandise several times prior to the lawsuit and was told they can not retrieve the merchandise. On XX/XX/XXXX, USA Discounters filed a lawsuit and was granted a judgment in the state of Virginia ( in which I could not attend court due to lack of funds to travel the distance ) instead of my home of residence which is out of the state of Virginia. I have not been employed since XX/XX/XXXX.

On XXXX XXXX, 2016, I sent a validation letter to a USA Discounters XXXX an account listed on my credit report. The collection agency responded that they were not considered a debt collector as defined by the Fair Debt Collections Practices Act ( FDCPA ). They did not provide proof of debt they are claiming I owe. In the state of Texas, debt collection means an action, conduct, or practice in collecting, or in soliciting for collection, consumer debts that are due or alleged to be due a creditor. In addition debt collector means a person who directly or indirectly engages in debt collection and includes a person who sells or offers to sell forms represented to be a collection system, device, or scheme intended to be used to collect consumer debts. Therefore, I feel that they should respond to my request of validation for a debt they are claiming I owe.

I recently was attempting to lease an apartment when the property management discovered a judgement on my credit report for over $ XXXX from USA DIscounters. This account has been taken care of for over a year. I called them to get a letter stating it was taken care of and they told me they 'd have to check and see if they had one since it had been over a year. I also asked about the credit report and they proceeded to tell me that it was my responsibility to file a dispute with the bureau. They have handled their part. My experience with them has been nothing but a hassle since day one. I also noticed there was lawsuit against them. I am not in the military any longer, but am I able to get retributions from these illegal procedures and charges.

I purchased furniture from USA Living in XXXX on XX/XX/2015. The purchase price was about {$4300.00}. They also added on a warranty and something called debt cancellation program totaling over {$1500.00}. No one explained what the warranty was for or what the debt cancelation was or why I needed it. Neither of these charges were explained in the contract to me. I was XXXX when I signed this contract. I have recently found myself being overwhelmed with debt. They have been calling me 2 to 3 times a day hounding me and harassing me for my late payments. They threatened to contact my chain of command. I finally met with an XXXX Personal Financial Counselor and I asked them to stop contacting me by phone.

USA Discounters has illegally obtained a judgement against me in XXXX when the debt was made in XXXX. I was never notified of this civil claim and had no knowledge it existed until the XXXX County Sheriff 's department attempted to place a levy on me. I did not own any property so there was nothing to levy. This company forced me into a Chapter XXXX in 2009 because of their bully collections tactics. They called my job and harassed me by phone several times a day. I included them in the Chapter XXXX and they were paid 1/2 of the {$5000.00} they claimed I owed. Now they are pursuing a judgment, that is illegally obtained for {$10000.00} that I do not owe.
