I hereby exercise my legal rights enacted by Congress and The Federal Trade Commission, which explicitly states when a victim of identity-theft dispute a fraudulent account on his/her credit report it shall be honored by all credit bureaus and all fraudulent information should be blocked within 4 days and proper notification shall be given to all data furnishers pursuant to section 605b of The Federal Fair Credit Reporting Act. Failure to comply shall lead to complaints being filed with The Better Business Bureau, Consumer Financial Protection Bureau, and Attorney General stating your companys unlawful collection practices, misrepresentation of creditworthiness, defamation of character, and noncompliance to abide by laws enacted by Congress to protect victims of identity-theft who's credit been impacted by acts of fraud. Because I know my rights under THE FAIR CREDIT REPORTING ACT, CONSUMER CREDIT PROTECTION ACT ( CCPA ), and FAIR and ACCURATE CREDIT TRANSACTION ACT of 2003 ( FACTA ). I will be taking action. I also know my rights under this paragraph of Section 312 of the FACTA LAW : SEC.312. Procedures to enhance the accuracy and integrity of information furnished to consumer reporting agencies. ( b ) duty of furnishers to provide accurate information. -- Section 623 ( a ) ( 1 ) of THE FAIR CREDIT REPORTING ACT ( 15 U.S.C . 1681s-2 ( a ) ( 1 ) is amended ( 1 ) in subparagraph ( A ), by striking " knows or consciously avoids knowing the information is inaccurate '' and inserting " knows or has reasonable cause to believe that the information is inaccurate '', and ( 2 ) by adding at the end of the following : ( D ) DEFINITION -- For purposes of subparagraph ( A ), the term 'reasonable cause to believe that the information is inaccurate ' means having specific knowledge, other than solely allegations by the consumer, that would cause a reasonable person to have substantial doubts about the accuracy of information. Policy states. According to the Fair Credit Reporting Act FCRA 611 ( 15 U.S.C 1681 ), Procedure In Case of Disputed Accuracy. ( a ) Reinvestigation ( 1 ) Reinvestigation ( a ) In general. Subject to Subsection ( f ), if the completeness or accuracy of any item of information contained in a consumers file at a consumer agency is disputed by the consumer and the consumer notifies the agency directly, or indirectly through a reseller, of such dispute, free of charge, conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the current status of the disputed information, or delete the item from the file in accordance with paragraph ( 5 ), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller. Therefore, my position is being clearly stated, these accounts do not belong to me, meaning that you are reporting inaccurate account information within my credit file. The fact that these are inaccurate account information means that you, this credit-reporting agency, are reporting incorrect accounts. 1. UPLIFTINC & {$0.00} I am well aware of my rights as a consumer. The Fair Credit Reporting Act requires that you, the credit-reporting agency report accurate and/or correct account information within my credit file. My credit issues are very specific, these accounts and/or items do not belong to me. This means that you are reporting incorrect account information within my credit report. It is this in mind that I request that these listed accounts and items be Blocked and Deleted. According to the Fair Credit Reporting Act FCRA, Section 1681c ( 2 ) Block of information resulting from identity theft. 1.Block. Except as otherwise provided in this section, a consumer reporting shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from alleged identity theft, not later than four ( 4 ) business days after the date receipt by such agency of 1. Uplift is engaging in : unfair and deceptive trade practices ; does not safeguard PII of its customers ; and gives the appearance of legal/law compliance but does not operate within compliance. I called Uplifts customer service after my credit card that I make monthly payments on was declined, as the card was compromised and the issuing bank sent me another one. I called after several of my emails were shuffled around with no resolve and getting nowhere unable to find anyone with common sense via email. After holding on the phone to speak with someone for over an hour, I finally talked to a rep around XXXX on XX/XX/2020. I had concerns with Uplifts customer service to begin with and called to speak with someone in person. I purposely gave incorrect info when the rep asked to validate my account ; as I was considering giving them updated information, eager to see if the phone support was any better and no ... it was worse. The rep I spoke with actually didnt validate the account and proceeded to verbally give me my social security number from the system and tell me what she had on file! Seriously? In an era of rampant identity theft, their rep gives me my own social security number, especially when my account was not validated?? WOW! The incompetence of this rep was unbelievable. I have been trying to update my credit card number that was compromised for days. When the bank sent me a new one, I called to provide the new card info to their reps for payment. I was told I could no longer use my credit card and had to give them my bank account information or debit card info. For Uplift to assume that everyone has a bank account or debit card is idiotic. Not everyone does, regardless of income. Secondly, I have both ( despite being none of their business ) but I do not provide this info freely to anyone. Especially not now, to a company that has proven to have unsecured business practices and does not safeguard my PII by hiring idiots that do not take security seriously. Lastly, when I signed up for Uplifts services I agreed to pay with my credit card that I entered in my agreement with them. I honestly do not care what they choose to do moving forward with new customers but that is not what I was in agreement to do when I signed up with them initially. For them to arbitrarily change the policy without notice to existing clientele and expect people to just deal with it? I think not. They claim notice was sent to me on XX/XX/2020 ; however, no notice could be found on my email server or reproduced by Uplift. I would have never used their services if I had to be bound to pay by debit card or ACH. They are essentially forcing people to use a payment method that they may not even have or feel comfortable giving you ; which could arguably be viewed as forcing some of your customers to default by no fault of their own. That is rather unfair and deceptive by many standards. My point is ... when I signed up I used a credit card and that is how I was allowed to pay Uplift ; the new terms are not reasonable and I have not been provided with such notice about their refusal to accept credit cards any longer ( regardless of what they may think or say ). XXXX XXXX ( the General Counsel and Chief Compliance Officer of Uplift , Inc ) excuse was that some issuing banks were posting Uplifts charges as cash advances and not charging as a traditional credit card item. Although, I can note his point ; I am not concerned with what some issuing banks were doing as it was the companys job to mitigate or address those issues independently with those that were affected or think through these issues beforehand. They can paint the picture as theyd like but I know based on the complaints many have openly documented with Uplift ; the fact that Uplift was susceptible to chargebacks and risk exposure. The change in policy had nothing to do with looking out for the best interest of their customers. It was for their best interest due to customers charging back after they got pissy customer service and could get no real assistance from Uplifts customer service department ( which has proven to lack a lot ). As we all know, the safeguards and protections provided with credit card payments diminish and/or are not existent with the payment methods they are forcing their customers to use. All of their payment methods involve exposure to my personal banking information to a company that can not even safeguard my social security information. Another issue of concern is that when I attempted to raise these concerns with Uplift, I ccd their legal department a few times at XXXX and the email bounced back. How is the email address that they have listed on their site for legal/law enforcement not functional if they operate within compliance? Uplifts operations are shady and deceptive on all fronts. I strongly encourage you to see the numerous complaints about their unfair and deceptive trade practices here ( many complaints about absurd interest rates up to 98 % ) : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Before filing my complaint with the Attorney General in all areas they do business in, I offered Uplift the opportunity to resolve this beforehand and all I received were excuses and no accountability whatsoever. Uplift has proven to engage in unfair and deceptive trade practices ; does not safeguard PII of its customers ; and gives the appearance of legal/law compliance but does not operate within compliance.

I summited a previous complaint on XXXX that was not addressed nor resolved. My complaint was as follows : I've had the absolute worst experience with this company during the past 2 months. First and foremost my account was disabled after I made several complaints without any sufficient reason. When I call about it I am given a standard generic response. My accounts were in good standing and paid in full and a few months in advance. I was told to double check my XXXX information and when I called them, they said everything I had was accurate. The address was then updated and yet I still could not process an application even after it says correct the information from your XXXX which was only an address they suddenly changed. After numerous emails I was told it was disabled and no longer can use their services and they could NOT provide a reason. I've had 5 loans and now I get this issue after several complaints and my account is disabled. You can not reach a live person unless you call from a # that is not registered with an account, if you call from a recognized # it is only automated with generic responses. Secondly, my credit report ( XXXX ) still has balances on all my account since XXXX of this year even though they are all paid in full since XXXX and XXXX. I've reached out several times and keep getting told the same generic information which does NOT apply to this situation. It's now XX/XX/XXXX and ALL the accounts still show on XXXX with balances and they should all be at 0. These accounts have not been updated on the consumer report since XX/XX/22 which is CLEARY over 1 1/2 months ago. It's ridiculous and poor service. THEIR RESPONSE ON XXXX WAS THIS : COMPANY BACKGROUND - Uplift , Inc. is a XXXX company based in XXXX, California. We facilitate loans for travelers paying for airfare, cruise tickets, hotel stays, and the like. Most loans, like XXXX XXXX, are originated by XXXX Bank, Member FDIC ( XXXX ) and serviced by Uplift. Uplift also purchases loans from XXXX. SUMMARY - According to our records, XXXX XXXX has taken out five loans through UplifXXXX and has paid them all off. XXXX XXXX complains that her XXXX credit report still reflects balances on her Uplift accounts, though they have been paid in full. We report to XXXX, and have reported to XXXX that XXXX XXXX has paid off her loans. In our experience, there may be some delay for XXXX to update reported information. We note that XXXX XXXX provided screenshots from XXXX XXXX. We do not provide information to XXXX XXXX, and have no control over the information that XXXX XXXX chooses to display. We have received prior complaints that information we have reported to credit-reported bureaus was not displayed accurately on XXXX XXXX XXXX and we have no way to address this. XXXX XXXX has also complained that Uplift has disabled her account. We internally investigated XXXX XXXX complaints about her account being disabled, and determined that XXXX XXXX account was blocked, apparently as a result of human error. We have been unable to figure out how or why this happened, but we have removed the block on her account and she should be able to once again use her Uplift account. We apologize for any inconvenience that this may have caused XXXX XXXX, and we appreciate her past trust in us. STEPS TAKEN TO RESPOND TO COMPLAINT - XXXX XXXX did reach out to us prior to filing her complaint and we did not do the best job that we could have in addressing her complaints at the time that they arose. We hope getting her account working again is a good resolution for her. FOLLOW-UP ACTIONS OR PLANNED FOLLOW-UP ACTIONS- We have unblocked XXXX XXXX account as requested and confirmed that her credit reporting shows that her loans have been paid off and closed. XXXX is still showing a balance and my account IS NOT UNLOCKED : Hi XXXX, Based on the information you provided, your application is not a match with the credit criteria used to establish eligibility. Dont let that keep you from traveling! There are a couple things you might want to try : Double-check the information you provided and make sure its correct. If youre traveling as a group, have another member of your party 18 or older to apply. You can always use a different payment method as well. On XX/XX/XXXX I purchased an XX/XX/XXXX XXXX XXXX cruise through XXXX for my family of XXXX. My work had announced an annual bonus for XXXX to be paid in XXXX sometime. So I booked using the advertised lender Uplift. The interest was really high but I figured Id pay it off sooner with the bonus money when it came in ... Only Covid-19 happened and my income went down so I stuck with the monthly payments. XXXX XXXX eventually canceled our cruise. They offered 100 % refund or 125 % Future Cruise Credit. I called Uplift to inquire about these options worried about the interest wiping out the benefits of the 125 % future cruise credit. I also looked up future cruises but they were more than 125 % the cost I paid for our cruise because one of my children would no longer qualify for kids sail free and that made XXXX adults XXXX child so bogo promo was not favorable either. Uplift said they were waiting on the email notification with the offer for the cancellation and terms. They said not to worry about interest or payments I could stop my monthly payments without worry or hassle as soon as they got the confirmation that the cruise was cancelled and the terms of reimbursement. Once they received the funds for reimbursement theyd pay them out to me. On XX/XX/XXXX they received the first adjustment of {$2200.00} and sent me a reimbursement of {$950.00}. I was confused because this was not 100 % of the cruise cost or what I paid. The cruise cost {$2600.00}. I paid {$1400.00}. So I called and emailed all three companies. I was told that they had up to 90 days to reimburse me the 100 % and that was just a first partial payment to Uplift and I most likely the taxes and port fees would still be paid back at a later date. To call after XX/XX/XXXX which was 90 days if I didnt get the full 100 % reimbursement. On XX/XX/XXXX Uplift got another {$280.00} and sent that out to me. So Uplift received {$2500.00} of the {$2600.00} paid for the cruise and they reimbursed me {$1200.00} of the {$1400.00}. I feel that I am still owed {$230.00} from Uplift to make good in the promise of 100 % full refund. Again, not understanding why I didnt get the full 100 % reimbursement promised to me with the 2 options presented to me and after asking questions via phone and email so I could make a fair and sound decision based on information presented to me I called XXXX and Uplift XX/XX/XXXX. XXXX XXXX was not clear or transparent on their offers of 100 % rebate vs 125 % future cruise credit and the consumer costs associated with them and they are not flexible to change terms now that I have answers that I should have had when I made the decision and I was diligent in trying to get the information before making the decision. XXXX says they paid Uplift 100 % of the funds XXXX paid them except a {$24.00} processing fee and Uplift says they are not giving back 100 % they are still charging the origination fee {$39.00} and the interest that accrued up until the cruise was canceled {$160.00}. I asked these question was not told this information had I known this I may have taken the 125 % future cruise credit because I was paying a lot of money for something I did not get and I wouldnt be getting back 100 % Id actually be getting back 84.17 %. They got paid handsomely for a product/service I did not get delivered and they were dishonest at the several points of inquiry. If Uplift wasnt going to honor the 100 % reimbursement and they were going to charge me fees and interest then Id like to have the opportunity to have the option for the 125 % with XXXX only they wont allow you to change your option once selected. And XXXX was the same about their fee. I also noticed Uplift on the XXXX list they get the opportunity for a forgivable loan and dont do the same for consumers thats really disheartening.

XXXX XXXX XXXX - XXXX The reporting of such inaccurate information has caused severe damage to my character, my reputation, my general mode of living and my ability to obtain credit for personal and house purposes. You and your inaccurate reporting have damaged my livelihood As defined by the IRS Even if you didnt receive a form 1099-C, you must report canceled debt as gross income on your tax return. The IRS clearly defines a charge off as Gross or Ordinary income, INCOME DOES NOT GET REPORTED ON THE CONSUMER REPORT which in fact makes your reporting of this account inaccurate! By Definition The IRS clearly says a cancelled or charge off is income. The reporting of this account as a debt is inaccurate. Section 166 ( a ) ( 1 ) of the Internal Revenue Code allows a deduction for a debt that becomes worthless during the taxable year. In addition, 166 ( a ) ( 2 ) permits a deduction for partially worthless debts if the taxpayer charges off an appropriate amount on the taxpayer 's books and records and the Internal Revenue Service is satisfied that the debt is recoverable only in part. XXXX XXXX XXXX - XXXX is being reported as a charge off, therefore according to the IRS it is considered income, so why is it still on my credit report? 15 U.S Code 1681s-2 Responsibilities of furnishers of information to consumer reporting agencies ( a ) DUTY OF FURNISHERS OF INFORMATION TO PROVIDE ACCURATE INFORMATION ( 1 ) PROHIBITION ( A ) Reporting information with actual knowledge of errors A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. Duty : a moral or legal obligation ; a responsibility Accurate : correct in all details ; exact PROHIBITION : a law or regulation forbidding something 15 USC 1681 s-2 says you XXXX are a furnisher of information to a consumer reporting agency. YOU ARE PROHIBITED BY LAW to furnish inaccurate information. I demand you to Cease and Desist the reporting of incorrect/inaccurate information immediately. 15 USC 1681 s-2 ( a ) ( 1 ) ( A ) A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. On XX/XX/XXXX, I financed a trip with XXXX through Uplift for a total of {$1600.00}. The first payment was made on the same day with a credit card ending in XXXX for {$150.00}. On XX/XX/XXXX, a second payment was made for {$150.00} using credit card ending in XXXX. On XX/XX/XXXX, the remaining balance for {$1300.00} was paid using card ending in XXXX. Due to Covid, my trip with XXXX was cancelled and a refund for {$800.00} was received by Uplift on XX/XX/XXXX. Per notes on XX/XX/XXXX, that same amount was refunded. On XX/XX/XXXX, I received an email from Uplift advising my refund for {$800.00} has been processed and to allow 2 to 3 business days for funds to be received by the original form of payment. Because of the three cards used when making payments, I was never told that those payments would be split into three payments until I spoke with someone on XX/XX/XXXX. I was then told that all payments would be sent back to the original forms of payment. As of XX/XX/XXXX, refunds for {$150.00} have been credited back to cards ending in XXXX and XXXX. I called on XX/XX/XXXX and spoke with someone who advised me that the remaining payment for {$490.00} was rejected by my bank. I contacted the bank who advised they have no record of a rejected refunds. I contacted Uplift again and spoke with a supervisor who insisted on telling me that my payment for {$490.00} was rejected by their vendor who processes their refunds and the normal process is if transactions were more than 120 days, the refunds would be sent to XXXX. I did advise her that the first 2 payments for {$150.00} were credited back and they were older than the {$490.00}. She still proceeded to tell me that their was nothing she could do because she does not get a reason as to why a vendor rejects crediting a refund to the original form of payment but confirmed different vendors were used to process my refund. I expressed dissatisfaction over the process as Uplift does not make sure that the rules are the same across the board when handling payments/refunds due to vendors they pay to represent their company. I was told I have to wait an additional 2 to 3 days to receive an email from XXXX just for them to obtain my account information and then I have to wait additional time for them to process and send my refund. Due to the incorrect information received, my refund is being delayed outside of the normal timeframe I was advised of receiving my total refund for {$800.00}. The Director of Customer Service contacted me on XX/XX/XXXX by email to advise of the same information after I submitted a complaint to the XX/XX/XXXX. She offered me an insulting {$25.00} XXXX gift card but never offered to assist in resolving my refund but yet advised me that my refund would not be processed to XXXX until XX/XX/XXXX. Uplift 's business practices are not the same in the refund process as they use different vendors but allow the vendors to make their own rules instead of representing Uplift as a whole. As a consumer, I am entitled for my issue to be resolved and Uplift has not attempted to resolve this issue. I have requested by refund for {$490.00} and interest fees for {$250.00} to be refunded as Uplift did not explain over the phone nor through email their refund policy when payments are over 120 days old. The policy is also not stated in the loan agreement that I signed with Uplift.

Yesterday, XXXX XXXX XXXX I was notified via XXXX XXXX that XXXX dropped my otherwise good credit score by XXXX points! Shocked at this revelation, I immediately looked into my credit report to discover that UPLIFT, a loan installment company, reported me late for {$4.00} of residual interest left over from a loan I had satisfied in XXXXXXXX XXXX. Needless to say, I was shocked that I even had a balance with UPLIFT and that they ruined my credit score for {$4.00}. When I called UPLIFT to inquire about the sixty-day-late credit reporting, they said that my loan, which I paid in installments on time in five amounts of XXXX had accrued interest. I was told by the representative that the final payment that I made of {$850.00}, which was slightly hire than the other months, was my final payment and that I would be paid off for the loan. Why hadn't all the interest been applied then? At no point and time was I told to look out for any residual accrued interest ... at all. In fact, my the online portal showed me paid off at the time of my last payment. I spoke to a representative and a supervisor at UPLIFT who were very indifferent and told me that they had sent emails. With SPAM and all of the junk email I get, I didn't see these emails, especially since I hadn't been looking for anything from UPLIFT because I had paid the last installment. I asked why they hadn't notified me by other means like ; via cell phone, sms message, or US mail if I had not been reachable. Surely, I would've paid the {$4.00} immediately if I'd know it was outstanding rather than ruin my good credit that I've always taken pride in maintaining for many years. They're response was that they only notify by email and that only some customers will receive an SMS in addition ; how they determined who gets the secondary notification is beyond me. I'm shocked, despondent and in total disbelief that a company who I had been in very good standing with in paying all of my installments as agreed, would seek to ruin my credit for a mere {$4.00}, the price of a cup of coffee, moreover, without giving me a fair chance to resolve this very insignificant amount. It is not fair that I suffer a hurt credit score for seven years because I didn't know that an account I paid off accrued {$4.00} of interest.

ACTIONS BY ME : XXXX was notified by email and alert from XXXX- ( A new account was opened ) from UPLIFT , Inc. The Affidavit form would not download to an acceptable PDF. I called back to inform them of the trouble I was having, they said no problem just email it back to XXXX from the XXXX XXXX. XXXX I called XXXX to informed that I was having a difficult time with Uplift , Inc that I asked to speak with XXXX or someone in the XXXX Dept and all I get was voicemail stating to leave a message and someone will call me back..NEVER RECEIVE A CALL. RE : Uplift , Inc. Loan # XXXX I sold some property, and the Title Company sent Uplift , Inc. ( XXXX XXXX XXXX XXXX, XXXX, CA XXXX ) a payoff for my loan ( account number XXXX ) with Uplift from the proceeds of the sale of the property. The Title Company sent a check in the amount of {$550.00} which created a credit balance of {$58.00} on my account with Uplift. On Tuesday, XXXX XXXX, the date Uplift received the payoff check, they ( Uplift ) sent me an email stating that they received the payoff check and there was a credit balance of {$58.00} on my account. The email went on to say that they would issue the refund check back to the Title Company and that they would not send me the refund check. I called Uplift ( XXXX ) and spoke with several representatives. I was told that it is their company policy to send any refund to whoever wrote the payoff check and that they would not send the refund to me. After several additional calls to Uplift, I finally received a call back from a supervisor named XXXX. XXXX again gave me the same response that all of the other representatives gave me and restated that it is their company policy only to issue refunds to whoever wrote the check, not the actual account holder. She finally agreed that if the Title Company sends them an email giving them permission to send the refund check to me the Uplift account management team would review that request and consider sending me the refund check. In speaking with the Title Company, they advised me that they are starting to see this tactic from banks who are in financial stress as an effort to keep customer money in their accounts. They advised me that when this has happened in the past checks are mailed to them with no customer information and that it can take them months to figure out who the refund belongs to. This situation has highlighted an urgent need for improved policies that safeguard the rights and interests of consumers. Upon reviewing my credit report, I've noticed 5 entries indicating a charge-off, which typically signifies a discharged debt for which you've claimed a tax write-off. Following a discussion with the IRS, it came to my attention that reporting such information on my credit report with the intent of collection or maintaining a charged-off status is deemed illegal, constituting tax fraud. Please be informed that the accounts in question are all paid off. Uplift is also furnishing inconsistent information between all 3 CRA 's when all information should be the same. There is also a duplicate account which I will list below. I insist on the immediate removal of the accounts from my credit report, along with the provision of a 1099-C form for auditing purposes to ensure compliance with tax regulations. This reporting discrepancy appears to be a violation of the FCRA specifically 15 USC 1681eb, as the information reported is not entirely accurate. The IRS has advised me to submit a Form 3949-A to report what appears to be illegal tax violations committed by your company. I'd like to emphasize that pursuing legal action is a course of action I'd prefer to avoid. Nonetheless, any violation of the FCRA by a corporation entitles the consumer to seek actual damages and monetary compensation, as outlined by the applicable U.S. Code. I trust that your CEO or VP would prefer to address this matter promptly and amicably to avoid potential legal consequences. I have been a customer of Uplift since 2021. I have had 3 loans and have always paid in full and never late. Recently, I have been trying to get another loan and it kept saying " Application information can not be verfied '' The customer service number is a scam and there is never an option to talk to a live person. I finally got an email from the fraud and risl department asking for my ID a selfie which I Provided. Then they responded saying I had to provide a selfie HOLDING my PAssport. This I thought was odd as no company has ever asked for this and I emailed back saying I would be happy to provide any other documents but that I wasn't comfortable holding my ID in a pic. Nevertheless, after no response I uploaded my passport again and A photo of me holding the passport. In the selfie, I blurred out my background as I took the pic at work and didn't want my background to show. After all this I get an email saying that they have disable my ability to use their services again. This is borderline discrimination, is it because I am XXXX? How can you never question MY identity- I have paid 3 loans on time and with good faith and now this company decides I am not who I am and that I can not use their services anymore. There is no live person to talk to. I feel like these decsions are made by a computer. I just want to be able to use a service I have used in the past and with good results. I think being disables is extreme and uneccesary. I have never filed a fraud claim, I have never said I had issues with UPLIFT, why are you now saying you can't verify me. On XX/XX/22 I received a phone call from XXXX at XXXXXXXX XXXX, I called back at XXXX. They left no voicemail and I've received no letters from them. It took several minutes just to get the caller to name the original debt which they state is from Uplift Inc to the tune of {$500.00}. I have not received any communication from Uplift for over a year. I told them I wanted verification of the debt and the woman argued that I needed to provide her a reason for my dispute so that they could provide verification of the debt. I reminded her this is not the way that it works. I am allowed by law to request a verification from a debtor, especially XXXX I haven't heard from an over a year and I don't have to provide a reason, they are required to provide it. This went back and forth for a minute with the debt collector arguing with me when I told her I am a legal assistant, it is the law they have to provide me validation in writing and that Alaska is a XXXX party state for phone conversation recording she ended the call. I don't believe I owe this debt but, I also believe it's a violation to try to 'talk ' people out of requesting verification. There is nothing in the law that requires I give them the reason for my dispute prior to reviewing what they allege to have. For all I know this lady is a scammer given the odd fact that an entirely different company called me for the same alleged debt that very same morning and couldn't rationalize why I had XXXX debt companies calling me on the same day for the same amount of money from the same creditor.

I've had the absolute worst experience with this company during the past 2 months. First and foremost my account was disabled after I made several complaints without any sufficient reason. When I call about it I am given a standard generic response. My accounts were in good standing and paid in full and a few months in advance. I was told to double check my XXXX information and when I called them, they said everything I had was accurate. The address was then updated and yet I still could not process an application even after it says correct the information from your XXXX which was only an address they suddenly changed. After numerous emails I was told it was disabled and no longer can use their services and they could NOT provide a reason. I've had 5 loans and now I get this issue after several complaints and my account is disabled. You can not reach a live person unless you call from a # that is not registered with an account, if you call from a recognized # it is only automated with generic responses. Secondly, my credit report ( XXXX ) still has balances on all my account since XXXX of this year even though they are all paid in full since XXXX and XXXX. I've reached out several times and keep getting told the same generic information which does NOT apply to this situation. It's now XX/XX/XXXX and ALL the accounts still show on XXXX with balances and they should all be at XXXX. These accounts have not been updated on the consumer report since XX/XX/22 which is CLEARY over 1 1/2 months ago. It's ridiculous and poor service.

We took a loan from uplift in my name and my wife 's name to pay for an onboard XXXX XXXX trip. We were to take this family trip on XX/XX/2022. At point on checking in for the cruise, a XX/XX/XXXX representative misplaced our travel document we had presented to them leading to a chaotic episode. Eventually, our entire family was denied making trip and carnival is yet to take responsibility for the misplacement of our travel document which led to them denying us a planned vacation trip. Part of that is XXXX also refused refunding us the full fare paid through uplift for this trip. I reached out to uplift to dispute the charge paid for the trip following the outcome explained earlier. As the company that financed this cruise fare, we what to dispute the total fare charged because we were never provided the service or trip we paid for. When I called the uplift representative on Tuesday XX/XX/2022, to report this complain and to file the dispute, I was promised a call back due to a long hold time to speak with someone who will handle my case, but they never called back. I am now wondering what is the customer protection offered by Uplift as a loan company if the service the loan was taken to pay for was never provided and the amount paid not refunded? Right now, I am paying uplift the loan as agreed and they need to take my complaint and act on it in disputing the charge paid to XXXX XXXX XXXX who never provided the service they received payment for.

I received communication in XX/XX/2019 that there was a loan outstanding in my name ( XXXX XXXX XXXX ) as well as my wife 's name ( XXXX XXXX XXXX ) from an UPLIFT.COM. My wife and I *never* apply for loans online ; we believe that it's something that needs to always be done in person. Furthermore, I have alerts on our 3 major credit bureaus that due to our excellent credit and perceived high net worth, we tend to be a victim of Identity theft. I shared this in a letter back to Uplift and heard back from them today ( almost 2 years later ). They've " transferred '' my loan, they claim, to another fintech/bank. So now my personal information is in two places I don't need it to be, not just one. The XXXX have been largely a self-policing community but identity theft, and not taking it seriously enough to stop it in it's tracks, is a violation of the FCRA along with several local laws in my jurisdiction ( Texas ). I seek to have an investigation open on this XXXX company - a startup, who's selling fraudulently obtained data ( like mine ) as underperforming loans in order to generate revenue. It's the sad side of capitalism that needs to be addressed firmly and immediately, especially given what many of our families have been through with COVID-19. This XXXX ( Uplift.com out of XXXX XXXX, California ) have gotten " looser '' with compliance issues, not tighter - when they should be doing the opposite.

On XX/XX/2022 I filed an identity theft claim with Uplift regarding a travel loan that was taken out in my name without my consent. I also forwarded a police report that I filed with my local sheriff department on XXXX XXXX, 2022. I spoke on the phone to an Uplift fraud analyst to answer questions regarding the circumstances regarding my claim. On XXXX XXXX, 2022 I received an email from Uplift stating that my identity theft claim was approved and that the charge-off for the fraudulent loan would be corrected in XXXX business days. On XX/XX/2022, I checked my credit report and saw that the loan charge-off was still on my credit report. On XXXX XXXX, 2022 I contacted Uplift again via telephone to find out what the status was on the removal of the fraudulent account. I was told to forward a screenshot of my credit report showing the information. I did so that same day and included a copy of the email that Uplift sent approving the ID theft claim and stating that the account would be removed in XXXX business days. As of today XXXX XXXX, 2022 I have not received any update on the account removal and to my knowledge it is still on my credit report. Having this account on my credit is greatly hindering my ability to purchase a home for the first time in XXXX XXXX and because of my status as a military member, this credit information is endangering my security clearance and potentially my job.

I have submitted an ID theft report to UPLIFT. I had to file and pick a police report as well. Today when I updated my ID thieft report through XXXX. I received an automated response. I did not authorize these accounts to be taken out, nor do they relate from any transaction by me. The company is knowingly and willingly committing Aggravated Identity Theft to collect on an extension of credit and punish me for non repayment of, when I am in fact not the debtor as they are alleging. This is a violation of 15 USC 1681a, 18 USC 1028A, 18 USC 894, The Gramm-Leach-Bliley Act, and RICO. This is an Identity Theft pursuant to 15 USC 1681a ( 3 ). The information I am demanding to be removed is not sent in error and is an affidavit of fact, so there is no material misrepresentation of the fact. If you believe I obtained possession of goods and services, then have a senior executive member of this company put this information on a signed and notarized affidavit under penalty of perjury. On XXXX XXXX we cancelled a cruise financed by Uplift. The account has been been paid in full for months. I notified them that the bank account used was closed on XX/XX/2022. I requested that they update my account so my refund would in fact go back to me. They refused and stated that it would be refunded back to the card that was used. This card was deactivated on XX/XX/2022 when my account was closed. Uplift is showing that the refund was successful, however the bank stated that the arn numbers given by uplift to track refund were not legit numbers. The bank has no record since the account was closed. Uplift informed me to send documents showing that the account was closed from my bank. I provided this and was sent an email stating that they could not use this documentation as proof although thats what was requested. They informed me I had to wait until the bank sent it back to Uplift. XXXX XXXX has no record of the refund being sent back even with the arn numbers provided. There is no phone number to call to speak to someone and they just chat the same thing. Now I was informed by uplift it could take 45 days for them to get the refund back from the bank. I use the travel agency uplift.com. when XX/XX/XXXX of 2022 I called in to pay my bill for XXXX and XXXX. After having a brief conversation on the phone with the representative as he was confirming my identity and taking my information to pay my bill, later that evening I received the text from an unknown number which turned out to be the representative that I spoke to at this company. This representative took it upon himself to take my telephone number off my application and reach out to me for his personal gain. After letting him know that he should not have reached out to me I googled his area code and he lives in the same state as I do. That alarmed me I have been petrified ever since. I have since went and brought some kind of protection from my door, I also went to start the process of getting my license to carry a concealed weapon. This situation I feel that it is harassment, it has me nervous all the time, I'm always watching my surroundings, and I just do not feel comfortable in the place in which I reside anymore. Purchased airline tickets on XX/XX/2021 with a payment made to the airline via Uplift , Inc. The itinerary was cancelled within 24 hours, after which according to the airline, a full refund would be processed within 7 business days. According to the airline, a refund in full would be made to the original form of payment, in this case to Uplift , Inc. Uplift , Inc has proceeded to claim that the money is still owed and accruing interest although the airline claims the refund was issued within 7 business days in accordance to the requirements established by the US Department of Transportation for operators. Uplift , Inc has been unlawfully attempting to collect a debt and accrued interest charges for a cancelled itinerary that followed all airline policies and US Department of Transportation regulations regarding this process. Uplift , Inc is deceptive and fraudulent in their practices because they claim interest is owed while awaiting refunds just like a credit card charge, and yet offer no protection such as allowing to dispute charges like a credit card does. It is suspected that Uplift , Inc may intentionally be misrepresenting balances owed and a supposed lack of payment from their partner airline in order to claim additional money owed from accrued interest.

My husband and I used Uplift financial services in paying for a XXXX trip by XXXX XXXX. XXXXl agent at the time of check-in misplaced the travel document of our child and ended up denying us the cruise we planned for and have refused to refund our money. Since we paid through uplift financial services, we reached out for consumer protection from Uplift to dispute the payment made to XXXX for never providing any service, and we are finding out that Uplift is biased on this matter, refusing to offer us any protection as consumers who have been ill-treated by a merchant. As consumers we need protection from companies like uplift who provided the financial services but in our case, Uplift has refused and denied us that. Therefore, we are filing this complaint. I have received two letters from XXXX XXXX concerning {$1600.00} of debt that I allegedly owed. The last of these letters was sent on XX/XX/2023. I had no idea where this debt came from. My wife called the number provided by XXXX XXXX to inquire on XX/XX/2023. They told her the name of the person who had taken on the debt, when purchases were made, and what payments he made, as well as the person 's address and phone number. This debt came from " Uplift '' and was through XXXX XXXX. At least one charge was made on a XXXX XXXX XXXX. I have never been on a XXXX XXXX, much less opened a credit card through them. The address provided to us was of the house I lived in when in 8th grade ( 28 years ago ). It seems that one of these companies found my name as connected with that house and then started sending me these notifications. The person my wife talked to did not know how my name was attached to the debt. The same day, I called XXXX XXXX to file a complaint. I tried to ascertain from the call person how my name became connected with this debt. He said that the man probably somehow got my social security number and address and opened an account. I have been trying to get several errors fixed on this account for 6 months and it's been horrible. First, they my balance kept reflecting {$760.00} dollars even though it was paid In XXXX of this year. Now they made ANOTHER ERROR and my payment history was changed on XXXX to missing 2 payments in XXXX and XXXX of this year, while the actual late payment from XX/XX/XXXX was removed. I WAS NOT LATE. I was in a hard ship program that Uplift offered and credit reporting was postponed. The payment was due by XX/XX/XXXX which it was, hence why my payment history was accurate until someone made a HUGE MISTAKE! I called today and spoke to a rep who indicated the whole financial team who reports and call center were new and she never knew they had it because it's no longer offered. It doesnt matter if it's no longer offered because at the time, I was in it. All the emails are attached to this complaint and CAN BE SEEN IN THE SYSTEM AS WELL AT THE COMPANY THAT CLEARY SHOW I WHAT I SAID was accurate. She has no idea why this happened and told me I must dispute it and show proof that it is reflecting wrong. This is horrendous. There was a credit adjustment made on my account on XX/XX/2019 according to XXXX, I contacted the department multiple time regarding that adjustment, believing that it should cover 2 payments, I spoke to Uplift multiple times in XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. It wasn't until our conversation in October where I finally received a clear explanation as to what happened through a follow-up call with an employee. She expressed management almost chewed her head off for asking about the adjustment again, stating they had resolved this issue. The problem was that no one actually emailed me back or called me to let me know why there was a difference in payment. Then I realized that the refund they received XX/XX/XXXX was not applied until XX/XX/2019. This caused there system to generate an over 30 day payment delay in my credit report. When I contacted them about removing the late payment, as the adjustment should have applied prior to that, they said there was nothing they could do and the system did not recognize it as a payment. I do not agree with their answer and I am very dissatisfied with the length of time it has taken to resolve the issue that led to this moment.

I reviewed my credit and there is a collection from Uplift Inc for {$280.00}. I had an account with Uplift that was resolved back on XXXX XXXX. I used Uplift in XX/XX/XXXX to finance a cruise for my honeymoon and unfortunately my fianc passed away on XX/XX/XXXX. I contacted them immediately and was advised the steps to take to file an insurance claim so that the cruise line could reimburse them and the account could be closed. I did exactly as directed and was told my account would be put in suspension mode until the death certificate processed. I received an email on XX/XX/XXXX, XX/XX/XXXX and on XX/XX/XXXX stating they received payment from the cruise line. This is the last correspondence I received from them on this account. I was never notified of an outstanding balance and I never received any correspondence from XXXX XXXX XXXX XXXX which is who I was recently told that the account had been turned over to. This company said l signed up for travel account for a cruise. I told them l didn't do it and they shouldn't have been selling it because covid was in affect and cruises were not even sailing out. At that time they weren't even allowing people to travel. I also filed a report with the police because there was a lot of fraudulent activity happening with my credit report, bank accounts, mail and so forth. Firstly, I am unsure if this company was allowed to charge me an interest rate of more than 6 %. They charged 29 %, I believe. I refinanced my trip through Uplift / XXXX XXXX to speak at a university in XXXX, California on XXXX XX/XX/XXXX, but due to the coronavirus crisis the speaking engagement was cancelled. The total trip, including the travel protection cost was {$1500.00}. This complaint is following an attempt by Uplift in collaboration with XXXX XXXX to defraud a customer for services they did not provide. I had filed a complaint against uplift in 2022 for a full refund of the money I paid to them for service that was never received after a representative of XXXX XXXX misplaced the birth certificate of our daughter jeopardizing our planned vacation trip. Several accounts are inaccurately reported on my XXXX report. The XXXX XXXX XXXX was already removed from the other credit bureaus as well as the XXXX report. My credit union gave all members new debit cards, so my existing card on file with Uplift was no longer valid. I entered my new debit card into the Uplift system but kept getting this message : " Card is not accepted. Please try a different debit card or connect your bank account ''. I began the process to connect my bank account. Uplift uses a third party app called XXXX XXXX XXXX XXXX to do this. The problem- which seems like a scam- is that XXXX requires us to give them our username and password to our bank accounts in order to withdraw Uplift payments. Upon review of my credit report I see a negative account report from a company named Uplift. I have attempted to reach this company via certified mail, asking for them to validate the debt as well as list it as DISPUTED on my credit report. I applied for a loan to buy ticket some time ago. I had 2 loans with this company and then it came to a time that I had to leave and visit my family back home in another country. In XXXX of XXXX I was notified by my bank that there was a debit going to Uplift Inc. which has overdrafted my account and was I aware of it. I was provided with a telephone number for the charge. Tried to log into their payment portal multiple times to make a payment prior to it being 30 days late. The only way to pay is with a debit card that requires text sent to your phone before it will let you log in. In XXXX I had run into financial difficulties. I contacted my lender and asked to change my payment date so that I had time to catch up. They agreed and sent me a confirmation and I paid off my loan. Now eight months after the fact they're trying to report me late for that month to the credit bureaus and taking zero responsibility for their actions. I want these people held accountable.
