In XXXX , I placed a call to this agency upon receiving a generic letter saying I owed them money, but not specifying what for. I spoke with a nice gentleman who informed me I owed them $ XXXX for ending my insurance policy with them in XXXX one month earlier than it was scheduled to end. I had been in bankruptcy at that time and informed him of this, to which he said he would update my account to document my bankruptcy. Thinking this was done, I went about my business until I noticed an {$87.00} collection record had been reported on my credit by this company. I was concerned because I had worked so hard to repair my credit after my bankruptcy. I called this company once again and at this time just wanted to pay the debt off. However, I was informed the debt reported on my credit was not accurate and I actually owed even more now. At this point, I became extremely doubtful of the honesty and integrity of this business and once again mentioned that this had been included during my bankruptcy. I was put on a long hold until someone different came back on and rudely advised me to send over documentation. I agreed to do so and sent over what form I could easily find in my email from my attorney in XXXX during the time of this debt. I sent the document over immediately that same day, XXXX / XXXX / XXXX , and called back shortly thereafter and confirmed it had been received and would suffice. I was advised to wait and watch my credit for the file to be updated. On XXXX / XXXX / XXXX I called back as the record had not yet been updated. The lady I spoke to said she could not find any information in my file indicating I had provided the bankruptcy proof and asked me again to prove it. I pulled up the email I had sent to them with the documentation and she put me on hold, she came back on the line and rudely informed me she had found the documentation and that I needed to wait up to 30 days to see the record updated on my credit and advised I check back after XXXX / XXXX / XXXX . I have checked my credit on XXXX XXXX every week since then and finally today, XXXX / XXXX / XXXX , I reached out, thinking this would have been more than enough time for the update to have been made. This time I spoke with XXXX XXXX who was immediately rude off the bat with no apparent reason why. Thinking perhaps she was having a bad day or even week, I tried to ignore her condescendingly rude tone. I gave her very brief background details and she cut me off and asked me to hold. She came back and rudely said while the documentation was in my file, it had not yet even been sent to the credit reporting agency. Naturally, I was stunned, as it had been 52 days since I had provided the requested documentation. I took a deep breath, as I could already tell this representative was in a foul mood and not caring at all about anyone but herself. I calmly relayed to her that I had been advised on XXXX / XXXX / XXXX that my file would be updated within 30 days from providing documentation on XXXX / XXXX / XXXX . She cut me off and told me nobody would have told me that as nobody could know that information. I assured her I had been told that and this was why I had called back again after 30 days, otherwise I would not have called back again after 30 days to check on the status. She kept cutting me off and talking over me and told me the " girls in their center were well-trained and good at their jobs and would never state anything in regards to turnaround times ''. I stated that, while she herself had not told me that the turnaround time was up to 30 days, I had absolutely been told this by a representative in this company 's office. She started to become hostile and raise her voice at me and tell me I was wrong and had never been told that. I said that if she was saying that the turnaround time was 30 to 60 days, instead of 30 days, then why had nothing even progressed on my file after 52 days? The file was still sitting in their office in the same condition it had been 52 days prior. She said she did n't know what more to tell me at this point and that they do n't report to the credit agency every day. Seeing that I was not going to get anywhere with XXXX and no longer desiring to be treated as I was, I asked to speak to a Supervisor. To which she replied that she was a Supervisor. I asked to speak to her Supervisor. She told me she had no Supervisor. I said, everyone has a Supervisor. She said she did n't. I said she must have one as she was not the owner of the company. She said she was the owner of the company. Well that just makes matters even worse if so, what kind of person who owns a business of this nature feels it is in the businesses best interests to treat people as she was treating me and has clearly treated other people based on the reviews on this page, XXXX , XXXX , XXXX , you name it. If you find the time to peek into those reviews, you will see the experiences of 50 other people who had an almost identical experience, and in just about every review, guess whose name pops up ... XXXX ! I ended the call after she told me she was the owner, it was crystal clear I was not going to receive any kind of professionalism, or even the basest politeness. Apparently, she was upset after our conversation, as I was contacted a few minutes later, by a different representative who sounded quite polite actually, it is unfortunate I did n't get her the first time. She had been asked by XXXX to call me back to review my file. The girl was very polite but she kept pausing and somebody was whispering to her in the background. Who was that person? XXXX ! She was feeding information into the girls ear to continue the argument. I would ask a question and the girl would pause, I would hear a whisper, and then the girl would reply. When the girl got fed up with this back and forth, she told me to hold while she transferred me to XXXX . I told her I did not want to speak with XXXX as I refuse to knowingly throw myself into a toxic situation. However, she had already started the call transfer process, and there was XXXX immediately picking up and trying to bicker with me. I kept trying to get a word in to tell her to just keep the debt open and let me get off the phone, as I think it is incredibly rude to hang up on someone. She refused to let me go and kept yelling at me, finally I calmly said, " I am getting off the phone now as you are incredibly unprofessional, mean, and rude and I refuse to interact with you further, goodbye. '' S he just kept on yelling incoherently, and at this point I hung up, and am just praying to the heavens above they do not call me back. At this point, I am exhausted from this whole experience and am just going to let the debt fall off in its own time, damaged credit be darned. I am going to go leave this awful experience here, and go home to my wonderful family tonight, and just be incredibly grateful I am not as miserable and angry as XXXX . I genuinely hope she figures out how to be happy and stops sending out poison into the world around her, for her sake and yours. This is a collection agency, so writing a BBB review will not put them out of business or help you avoid them ; my only hope is that if you have the unfortunate luck to have them come after you, whatever you do, just do n't talk to XXXX ! I submitted a complaint and negative review with the BBB. XXXX personally replied to the complaint and the review ( which is posted publicly on a website able to be accessed by the general public. In the response, she misrepresented her actions and statements, made up lies about the timeline of the complaint, and posted my personal information and specific details regarding my bankruptcy on the public webpage. This is a violation of my privacy and I feel warrants an investigation into this businesses operation and tactics as they are privy to the private information of so many people! One last thing to be aware of, it would appear XXXX is NOT the owner as she proclaimed. The owner is a XXXX XXXX XXXX as is reported through BBB.

XX/XX/2022 : Received phone call & voice mail message from XXXX with generic message. " This is XXXX calling from XXXX. Please contact me at above number extension XXXX. I did not know who this was, so I did not return the phone call. XX/XX/2022 : Received phone call & voice mail message from XXXX with generic message. " This is XXXX calling from XXXX. Please contact me at above number extension XXXX. It occurred to me I was expecting a call from an office supply delivery service and I thought maybe this was them since it was a second phone call, I looked up XXXX on XXXX, it's a freight company, so I returned the call. Upon calling the number, I find that the company is not XXXX, it is XXXX, and they claim they are a debt collections company. I speak with XXXX and he says he's attempting to collect a debt I owe at a local vet clinic for services rendered in XXXX 2022. I did have a pet at the clinic in XXXX 2022, and asked him to send me information of the debt. He sent me a scanned statement that looks like it's from the Vet office that has no detail other than the amount owing. XX/XX/2022 : In the morning miss a call and receive a voicemail from XXXX and I call him back and request a detailed invoice of the charges and amount owed. Later that afternoon I follow-up the request for detail with a reply to the statement email with an email also requesting the detail. Later in the afternoon I receive a phone call from XXXX to confirm I received the detailed invoice. I call XXXX back and let him know I am out at a client and will check my email once back in the office and we agree to speak on Monday as he will be out of the office by that time. Once back in the office I confirm receipt of the detailed invoice. XX/XX/2022 : In the morning I send a screenshot of the detailed invoice with my disputed items highlighted. I follow up with an email request for update in the afternoon. I receive a phone call and voicemail message not long after the email request for update. I receive another phone call later in the afternoon which I answer. We chat about the debt and he states that he checked with his supervisor and the disputed line item will be taken out. He gives me a revised amount to pay. I ask him what that includes because there is a difference in monies owed outside of the detailed invoice he sent me. He explains verbally the difference ( approx {$44.00} in fees of some sort ) and then asks for payment. I ask him to provide me with an online place to pay and he asks for my credit card information. I tell him I don't feel comfortable giving my credit card information over the telephone, he lets me know there will be a {$6.00} charge for processing the credit card and guaranteeing I won't be reported to the credit bureaus ( i assume this is online ) and when I ask for the url, he again says it will be only accepted via voice over the phone - and that if I don't remit payment immediately by credit card over the phone, he can't guarantee I won't be reported to the credit bureaus. I ask him if the Vet clinic will accept payment if I go in and pay the debt- he says not likely. I tell him I'm going to call the vet clinic and I will call him back. I call the Vet clinic. I am told the finance manager is out for the week but the person who answered the phone tries to help me out. She looks up my account and says she doesn't see that it's in collections. She does see a note on XX/XX/XXXX about the amount owed, but no mention of phone calls to me or info about debt collection. I tell her the story of the supposed debt collector and that they want payment by credit card over the phone, she agrees it sounds suspicious. I ask if I can come into the office to pay the debt, she says she doesn't know - usually the finance manager takes care of the payments- but that she will check with the office manager and have her call me back ASAP. ( probably tomorrow ) I call XXXX back. I let him know the update with the Vet office. He hard presses me again to give him a credit card number over the phone. I tell him I'm beginning to think he isn't legitimate, he tells me he has my SSN and my CA Drivers license number and that I am risking being reported. He gives me the last 4 digits of my social and my license number ( which is correct ). At this point, I request that he email me instructions on how to pay other than credit card over the phone and he says he can't do that because he's not allowed to send email. I indicate that he already sent me emails and I don't understand why this is any different and I state that without them, there is no record of our conversations. He states that the phone calls are recorded. I tell him I don't recall being asked permission to record this particular phone call when we got on the phone. He again asks for payment immediately but also offers to give me over voice where to " mail '' a check for payment - stressing unless I pay now over the phone with a credit card, he can't guarantee it won't effect my credit. I ask to speak with his manager. He tells me they are gone for the day but he can leave them a note. I tell him I think something is off with him/his company and that I'm going to report him and that I am now recording the conversation. He indicates he hasn't given consent for me to do so ( which I find strange being that he just said all the calls are recorded ) - and I hang up on him. I call back the main XXXX number XXXX I found when I googled XXXX. I ask to speak with a manager- I get some ones voicemail, I don't leave a message. I email XXXX requesting IN WRITING how and to whom I should pay my debt and let him know I'm going to file this report. Here 's the text of the email : " XXXX, As a follow-up to our phone conversation moments ago, I contacted the Vet office who said my account does not show its in collections. They also indicated that the Finance ManageXXXX is responsible for A/R and that she is out of the office until Monday of next week. The person I spoke with said she would ask the office manager if she could help me in the absence of the Finance manager I am awaiting their call currently. I offered to go into the vet clinic and pay any outstanding balance, the office manager should be returning my phone call shortly to give me the go ahead, or have me wait until the finance manager returns. As for our discussion regarding remitting payment over the telephone I will not give anyone my credit card information via telephone. Threatening to report this debt as unpaid in lieu of my immediate capitulation is unethical and harassment. Also, refusing to give me the information I requested regarding submitting payment through your company via email or direct mail, and declaring that all phone calls are recorded so I shouldnt need a written record or email trail after which I stated that you didnt ask for permission to record our current call, followed up by another threat to damage my credit and my request to speak with your manager ( which was refused ) and finally your denial of permission for me to record the call by the end is suspicious. Assuming, for a moment, that you are a legitimate debt collector and just unscrupulous, Id like to make it clear that I refuse to remit payment to you by credit card over the telephone, and also request you send me a detailed corrected accounting of my debt as well as a detailed description of how and where I may settle this debt IN WRITING. Lastly, I would like to make very clear, I consider our last conversation to be harassment and threatening, and will be reporting you and your company to the CFPB. "

I am the natural person and consumer who is submitting a dispute against Universal Recovery Corporation a debt collector pursuant to 15 U.S. Code 1692a in regards to an alleged debt ( defined as any obligation or alleged obligation of a consumer pursuant 15 U.S. Code 1692a ). XXXX of XXXX, I received an alert from XXXX XXXX that my credit score dropped. I logged in to see that my credit score dropped XXXX points because of a collection account Universal Recovery Corporation reported to XXXX saying that I owed {$79.00} to XXXX XXXX XXXX On XX/XX/XXXX @ XXXX XXXX, I made a call to Universal Recovery Corporation and spoke with a supervisor by the name of XXXX . I informed XXXX that I never received any mail ( communication ) in regards to this alleged debt and was not given the opportunity as a consumer to request validation or verification pursuant to 15 U.S. Code 1692g. XXXX told me that mail was sent in XXXX of XXXX to the address given by XXXX XXXX XXXX which was XXXX XXXX. I informed XXXX that I moved from that location in XXXX and requested that documentation be mailed to my current abode but was told by XXXX that they are not required to resend mail and that he would update my account to disputed, which he did. This account was last updated on XX/XX/XXXX and I have yet to receive a Determination or Notice of Determination pursuant to 15 U.S. Code 1681i Procedure in case of disputed accuracy and backed by law 12 CFR 1022.43 ( e ) ( 1 ) ( 2 ) ( 3 ) ( 4 ) ; 12 CFR 1022.43 ( f ) ( 2 ) ( 3 ). As a Federally Protected Consumer, I am aware that Universal Recovery Corporation violated several of my consumer rights under the Rosenthal Act and Fair Debt Collection Practice Act. Pursuant to 18 U.S. Code 8, all debt is the obligation of the United States. The term obligation or other security of the United States includes all bonds, certificates of indebtedness, national bank currency , Federal Reserve notes, Federal Reserve bank notes, coupons, United States notes, Treasury notes, gold certificates, silver certificates, fractional notes, certificates of deposit, bills, checks, or drafts for money, drawn by or upon authorized officers of the United States, stamps and other representatives of value, of whatever denomination, issued under any Act of Congress, and canceled United States stamps. Below are listed the violations committed by Universal Recovery Corporation in the pursuit to collect an alleged debt. When Universal Recovery Corporation mailed communication about the collection of an alleged debt to a location I did not dwell ( mail was sent to someone other than myself ) and reported this alleged debt to the Consumer Reporting Agency they violated 15 USC 1692b ( 2 ) : Any debt collector communicating with any person other than the consumer for the purpose of acquiring location information about the consumer shall not state that such consumer owes any debt. ( In doing this, Universal Recovery Corporation also compromised my Personal Information ). Universal Recovery Corporation has also violated my right to privacy by committing identity theft. 15 U.S. Code 1681a - Definitions ; rules of construction ( q ) Definitions Relating to Fraud Alerts. ( 3 ) Identity theft. The term identity theft means a fraud committed using the identifying information of another person, subject to such further definition as the Bureau may prescribe, by regulation. Universal Recovery Corporation never received written instructions from me authorizing the furnishing of any information to third parties in violation of 15 U.S. Code 1681b - Permissible purposes of consumer reports ( a ) In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( 2 ) In accordance with the written instructions of the consumer to whom it relates. Mailing communication to me, the consumer without my consent to another location other than my abode was unusual and inconvenient to me, the consumer therefore Universal Recovery Corporation violated 15 U.S. Code 1692 ( c ) ( a ) ( 1 ) : Communication with the consumer generally without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction, a debt collector may not communicate with a consumer in connection with the collection of any debt at any unusual time or place or a time or place known or which should be known to be inconvenient to the consumer and ; ( b ) without the prior consent of the consumer given directly to the debt collector, or the express permission of a court of competent jurisdiction, or as reasonably necessary to effectuate a postjudgment judicial remedy, a debt collector may not communicate, in connection with the collection of any debt, with any person other than the consumer, his attorney, a consumer reporting agency if otherwise permitted by law, the creditor, the attorney of the creditor, or the attorney of the debt collector. Universal Recovery Corporation reported {$79.00} to the Consumer Reporting Agency. A consumer can not pay on a positive amount ( credit ), only a negative ( - ) amount therefore Universal Recovery Corporation Presented false or misleading representation pursuant to 15 U.S. Code 1692 ( e ) ( 2 ) ( A ) : The false representation ofthe character, amount, or legal status of any debt ; By reporting this alleged debt to the Consumer Reporting Agency, Universal Recovery Corporation has used profane and abusive language that caused harm to my credit health and reputation ( credit score decrease ) therefore violating 15 U.S. Code 1692d Harassment or Abuse : A debt collector may not engage in any conduct the natural consequence of which is to harass, oppress, or abuse any person in connection with the collection of a debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section : ( 1 ) The use or threat of use of violence or other criminal means to harm the physical person, reputation, or property of any person ; ( 2 ) The use of obscene or profane language or language the natural consequence of which is to abuse the hearer or reader. In addition, according to the Fair Debt Collection Practices Act, a Debt Collector is required by Federal Law to verify the with the physical original written and signed consumer contract on recording, related to the account they are attempting to collect on. Otherwise, anyone paying for their Debt Collection services could fax, mail or email in a fraudulent account. Under the FDCPA, unverified accounts are considered a Fictitious Obligation and any demand for payment of such is an attempt to extort and administer property without right. ( 18 U.S. Code Fictious Obligation ( a ) Whoever, with the intent to defraud ( 1 ) draws, prints, processes, produces, publishes, or otherwise makes, or attempts or causes the same, within the United States ; ( 3 ) utilizes interstate or foreign commerce, including the use of the mails or wire, radio, or other electronic communication, any false or fictitious instrument, document, or other item appearing, representing, purporting, or contriving through scheme or artifice, to be an actual security or other financial instrument issued under the authority of the United States, a foreign government, a State or other political subdivision of the United States, or an organization, shall be guilty of a class B felony.

On [ XX/XX/2020 ], I sent Universal Recovery Corporation a Direct Dispute FCRA 623, received by express mail # [ XXXX XXXX XXXX XXXX XXXX ] on [ XX/XX/2020 ]. Universal Recovery Corporation failed to perform after receiving these presentments from me, and Universal Recovery Corporation failed to perform by reviewing all relevant information provided and conduct a reasonable investigation into this direct consumer dispute and notify me, along with the CRAs to whom Universal Recovery Corporation reports credit data. If Universal Recovery Corporation found that the account it is reporting can not be verified or substantiated Universal Recovery Corporation must delete the tradeline if Universal Recovery Corporation failed or refused to comply with the Act, Universal Recovery Corporation may be sued by the FTC, Consumer Financial Protection Bureau, state government and me. Also be advised that as a result of this direct dispute being filed, Universal Recovery Corporation was required by law to hereinafter report this account as " disputed by consumer '' on my credit file if the account is not deleted, or Universal Recovery Corporation is legally barred from continuing to report the alleged account as per, 623 [ 15 U.S.C., 1681s-2 ] ( a ) ( 3 ) which states ; If the completeness or accuracy of any information furnished by any consumer reporting agency is disputed to such person by a consumer, the person may not furnish the information to any consumer reporting agency without notice that such information is disputed by the consumer " [ Emphasis added ]. This is a non-discretionary duty imposed by the FORA and is not subject to the opinion ( s ) of the furnisher of information. XXXX XXXX XXXX omitted the 16 CFR 433.3 disclaimer on the alleged Insurance Contract formally known as [ Consumer Credit Contract ], which means there was no holder in due course ; see UCC 3-302 the " Holder in Due '' course takes the instrument free from all claims and defenses that the payer ( XXXX XXXX ) who could assert against any payee ( " XXXX XXXX XXXX '' ), assignee ( Universal Recovery Corporation ) or transferee. " XXXX XXXX XXXX '' and Universal Recovery Corporation accepted the [ Consumer Credit Contract ( insurance contract ) ] subject to claims and defenses 16 CFR 433.3 Preservation of consumer claims and defenses, unfair or deceptive acts or practice in the connection with any services to XXXX XXXX, in or affecting commerce as commerce is defined in the Federal Trade Commission Act which is a unfair or deceptive act or practice within the meaning of section 5 of that act for a seller ( " XXXX XXXX '' ) and Universal Recovery Corporation to directly or indirectly : ( a ) take or receive a Consumer Credit Contract which fails to contain the following provision in at least ten point bold face type : NOTICE NOTICE ANY HOLDER OF THIS CONSUMER CREDIT CONTRACT IS SUBJECT TO ALL CLAIMS AND DEFENSES WHICH THE DEBTOR COULD ASSERT AGAINST THE SELLER OF GOODS OR SERVICES OBTAINED PURSUANT HERETO OR WITH THE PROCEEDS HEREOF. RECOVERY HEREUNDER BY THE DEBTOR SHALL NOT EXCEED AMOUNTS PAID BY THE DEBTOR HEREUNDER In order to meet the threshold of the Consumer Finance Protection Bureau requirement, the exception is when XXXX XXXX XXXX and Universal Recovery Corporation behaves in an unfair and deceptive manner, which would then allow the Fair Debt Collection Act to apply to the " XXXX XXXX XXXX and Universal Recovery Corporation ''. The facts stated above about XXXX XXXX XXXXe and Universal Recovery Corporation " is construed as unfair and deceptive in nature as defined by the Federal Trade Commission 5 ( a ) and violates the Fair Debt Collection Practice Act 15 USC section : 1. 1692e ( 6 ) implying that transfer of the debt caused XXXX XXXX to lose claims or defenses to payment of the debt. XXXX XXXX XXXX and Universal Recovery Corporation made false or deceptive representation by accepting or receiving XXXX 's [ Consumer Credit Contract '' ] ( insurance contract ) which failed to contain the claims and defense to the payment of the alleged [ Insurance Contract ] debt. The damages are {$1000.00} statutory damages and actual damages of intentional infliction of emotional distress and mail fraud in conjunction with my inquiries and Universal Recovery Corporation responses.

Previously I have filed recent complaints about this collection company : Universal Recovery Corporation. They have been notified through the Federal Bankruptcy Courts, Myself, and my attorney, and most recently they have been notified yet on two More occasions through this complaint portal that I HAVE FILED FOR A BANKRUPTCY OF WHICH THIS COMPANY HAS BEEN NAMED AS ONE OF THE CREDITORS AND THUS THEYCANNOT COLLECT ON ANY DEBT IN WHICH THERE IS AN ACTIVE BANKRUPTCY STAY AND/OR ARE GETTING PAID THROPUGH THE BANKRUPTCY TRUSTEE AS HE SEES FIT TO DO AND IS COMPLETELY UP TO HIS DISCRETION AS TO WHO HE WILL PAY AND HPOW MUCH HE WILL PAY THEM. This is a very simple and known fact throughout the credit and finance world and even in the collection industry world as well. Yet, URC ( Universal Recovery Corporation ) has repeatedly and knowingly done just the opposite of what our Federal Laws allow them to do while I am under the Courts Protection and has ordered an active stay. They have acknowledged through this portal in fact that they are aware of my bankruptcy status yet they continue to violate many Federal Laws regardless of what that law states. They have continued to leave two previously disputed debts on my credit report and they show these debts as being an OPEN account when the law clearly states that they can no longer collect on this debt or leave it in an OPEN status and report that to the credit bureaus., which is exactly what they have done and continue to do. Last week this collection company not only defies our Federal Laws and Consumer laws by continuing to leave the first two collection accounts on my credit in an open status, but they have just recently ( within the last week ) added three more accounts to my credit report adding to the other two that were already on there for a total of 5 collection accounts in which they are trying to collect on and they are doing this with the full knowledge that I am in an active Bankruptcy right now. They are also reporting these three additional collection accounts that have been added within the last week as OPEN AND ACTIVE COLLECTION ACCPOUNTS WITH OWED BALANCES AS WELL.. They have done this knowing about my bankruptcy status and they are blatantly disregarding the court order by doing this. See the attachment for proof. They also have backdated these new collection debts illegally as well and reported false and damaging information about me and had it placed in my credit file with XXXX just within the very last week. They also have lied and reported false and erroneous information about me trying to completely obliterate my credit and my chances of obtaining any type of credit or secure my new place to live as well. In fact, because of their actions, I was denied to rent my new apartment because their reporting of these additional uncollectable accounts has dropped my Credit score by more them 60 points just by what they have reported last week. This company needs to be investigated for their shady and extremely questionable debt collection practices because of what they have done to me alone and by how they have purposely done this just to harm me and to damage my credit in the process. I will say that this is not just going to go away with them. They will pay for what they have done as soon as I report them to the Federal Bankruptcy Courts and I will make sure that I will not rest until they are either shut down or having their business license revoked for doing what they have done to me and with no regard to our Federal Laws or the agencies that govern them. I am fed up with this company and this is a clear retaliation tactic because last year I settled out of court with them because of another debt collection issue and this is their way to get me back and they know it. I was first contacted by the Universal Recovery Corporation on XXXX XXXX, 2017, I had not had any previous knowledge or correspondence with this company or individual before this date. When we spoke on XX/XX/XXXX, she told me that a letter had been mailed to me and I had " 30 days to dispute from the date of the letter ''. When speaking to an attorney I was told that this is incorrect. Bringing to your attention California Code of Civil Procedure Section 1013, which extends the time frame an additional 5 days. Further the debt collector must inform of the right to dispute the debt in whole or in part within 30 days of receiving the notice. The 30-day time frame starts running on the day you receive the letter, NOT the date of the letter. Therefore, when I spoke to XXXX on XX/XX/XXXX, I was well within my 30-day period and offered to pay the amount then, but she refused. Fair Collection Credit Act is a Federal Law prohibiting debt collectors from engaging in abusive or deceptive bill collections. Not only did she fail to give me my 30-day time frame, she had insisted it had expired based upon the date of the letter, which again is not accurate. Not only was she abusive and hostile to me on the phone by continuing to call me a liar, but her means of collecting were deceptive by making me believe my 30 days had expired based on the date of the letter. Since I had no correspondence in front of me, I believed her. After she bullied, threatened and scared me, I made an immediate payment of {$400.00} plus set up an additional {$200.00} to be paid on XX/XX/XXXX, which ended up coming out to {$210.00} which I am assuming is yet another fee she has added. After I received the letter I tried to call her back, but instead of talking with me, she yelled at me and again called me a liar multiple times. She not only bullied me, but she also threatened me. Based upon the above, notice is given that I dispute a portion of this claim. There is a small outstanding balance of approximately {$25.00}. This amount will be paid forthwith. Notice is hereby given that any other arrangements for payments are null and void. I notified her that she had no permission to withdraw ANY OTHER FUNDS. However, on XX/XX/XXXX she tried pulling money from XXXX separate accounts without my permission. I notified by both my bank and credit card company of the fraudulent charges.I mailed her a certified letter on XX/XX/XXXX, which she did in fact receive. I will attach all documentation. Since then she has repeatedly called my work, my work cell phone, my corporate office demanding to speak to me, my home, as well as my person cell phone. I have told her multiple times to NOT CALL ME AT WORK. These calls start from XXXX and continue throughout the day. I believe her correspondence to be deceptive and a form of bullying. Every time I try to contact her and speak to her about this situation she ends of yelling at me, speaking to me in a demeaning manner, or hanging up on me. I recently signed up for a tanning package with a local company. I payed XXXX + some additional free for there basic membership, allowing access to the most basic tanning beds. The benefit to the membership is that the cost to use the top of the line tanning beds is greatly reduced for members. I bought single upgrade to the top tier tanning bed totaling XXXX $ cash. While paying the employee informed me of a {$90.00} package that included 6 tans. Being the sucker that I am I agreed that I would benefit for saving money buying the tans in bulk vs each time I visited. The employee recommended I tan for the full 10 minutes in the bed for my first session, and since I wanted to expedite the process of tan skin I agreed. The end result was 3 weeks of XXXX XXXX, 1 week of XXXX XXXX, and 1 visit to the ER funded by myself. Dissatisfied with the business, I decided to dispute the charge for the remaining 6 tans that I hadn't used. I called the company myself without the guidance of the bank and they refused to refund the money, and insisted that I could come back and use the remaining 6 credits anytime. I informed them that after visiting the ER and suffering for 3 weeks I wouldn't be tanning again, but they stuck to there guns. A few days later I contacted XXXX XXXX XXXX XXXX card customer service about disputing this charge. They proceeded to 3 way call the company with me on the line. We discussed out the details of the dispute to the tanning company tele rep, and she informed me/XXXX rep that the appropriate person would be in contact with XXXX if needed later that afternoon. Time carried on and XXXX never heard back from the tanning company regarding the dispute and I was refunded the money for the 6 tans. Approximately a month later I received a letter from the tanning company claiming they were sending the total of {$90.00} to collections along with a {$25.00} charge. I immediately called the tanning company and asked what was going on, they informed me that there is nothing they could do, and that the debt had be acquired by a collection agency. I then proceed to call XXXX and inform them of the situation, learning there is little they can do for this type of situation. The debt collector actually made initial contact the very same day I received the letter and called the tanning company. Seems like they were out for revenge regarding the dispute I was awarded. I informed the creditor of the dispute being settled and even offered to send the documents from XXXX showing this process. I am done with this company and trying to reason with them. On XX/XX/XXXX, I found XXXX false derogatory reports on my XXXX Credit Report. Also, she stated it was with a joint account and I have never met or known of the other person whom she gave the name of. My concerns with this is : 1. About a month ago I received a bill from XXXX XXXX XXXX, stating they had forgotten to charge me {$45.00} for my daughter 's XXXX. 1. I had a check returned to XXXX XXXX XXXX XXXX, even though I did have overdraft protection, my bank did not cover. 2. I received a notice from Universal Recovery Corp. which I signed for on XX/XX/XXXX. 3. Due to upcoming holiday I did not call right away, that day. I DID in fact call on XX/XX/XXXX, ( which I have call record from my cell provider proving I called the company, left message as the person handling my account was not there. 4. XX/XX/XXXX, I received a call from the Universal Recovery, which I answered and was happy they finally returned my call, I was prepared to set up arrangements to take care of debt. 5. I was told that I now owe {$640.00}. I asked for a supervisor and got XXXX XXXX. This person told me, I NEVER called on the XXXX date, or she would have called within 24hrs. She harassed me, laughed at me, asked if I made arrangements for the food I ate, and I was being ridiculous if I thought she would ever make arrangements. I was never told what the {$640.00} was for, and I stated I was trying to make arrangements for the total on the letter. 6. I was contacted before 30 days was up, I was upset that she made fun of me for being in a hardship, even knowing I had recently had a XXXX XXXX. She said she had no sympathy or empathy for someone who wrote a bad check. The first account belongs to XXXX XXXXXXXX XXXX and the second to XXXX XXXX XXXX tax attorneys. -I never received the validation or the initial call or email, possibly, due to moving although a forwarding address was filed with USPS . I do not believe the reporting agency Universal followed procedure. -My credit reports shows 3 derogatories preventing me from securing housing. There are only the 2 accounts and they are related to tax issues with the IRS. This has been confused by XXXX credit reporting. -The agency continues to thrash the account to make the two derogatories appear to be new which they are not. -I disputed both and this does not show. XXXX XXXX in court told the judge that both were XXXX firms which they are not to make me look like someone who dodged debts. You can see from my report that I do not. XXXX XXXX XXXX XXXX XXXX XXXX chose collection as a punitive move although the attorney representing me left the firm and I was not notified. This company is violating my consumer rights and breaking Federal laws by continuing to report their collection debt to XXXX-a credit bureau-after I have already formally submitted a dispute through XXXX regarding this debt collection company. They not only have kept their collection entries on my credit report, but they are also falsely reporting it as being an open account for two separate entries on my credit report. I lost my dispute by the way because somehow they managed to lie to XXXX and enable them to keep reporting this no longer valid information to the credit bureaus. There is not a single collection company that has continued to leave their entries on my credit report asides from this company. Every other Collection company has removed and deleted their credit entries on my report, but Universal Recovery Corporation refuses to comply with my rights and the law after I have filed for Bankruptcy on XX/XX/2022. I honestly believe that this is an act of retaliation on their part towards me from a previous legal matter that was filed against them, and was settled in my favor outside of court. Person called me from Universal Recovery XXXX on behalf of XXXX. The bill was {$92.00}. They want me to pay $ XXXXwhich I know I have to pay. I wrote a check and it bounced. When the guy called, he said his name is XXXX he was very rude and abusive verbally. I tried to explain what happened but he was loud and told me that " I should n't have wrote a check anyway and this is what I get '' I told him to never call me again. I called a couple of weeks later to try to pay the bill and a lady answered the phone. I told her what happened during the last call, she said " he should have spoken to me that way. On XXXX XXXX, XXXX at XXXX PST I called Universal Recovery Corp to inquire on debt I found on my credit. A gentlemen answered the phone and I ask for the current balance. For account # XXXX he stated I owe {$66.00} and for account # XXXX he stated I owe {$83.00}. I asked him how come the balance is different on my report, it says I owe {$56.00} and {$55.00}. Stated : 'PAID -pci ' Debt Collector Name : Universal Recovery Corporation Apparent Creditor : Deciding to keep name private, since U.R.C may keep track of their accounts based on false Creditor Names. We noticed them that this is a recorded line and that we are asking them to not call until after XXXX becasue this is a business peak time. They continued to call 16 times and even called our neighboring business lied to them and said something is wrong wth our phones and asked them to walk over and hand is a phone. I was contacted today and told I owe a {$70.00} debt for a cancellation fee on auto insurance that is over 2 years old.
