It was a loan taken for my daughter to attend XXXX College of XXXX XXXX, in XXXX XXXX, Mn and I co-signed the loan for her. In XXXX my husband and I filed bankruptcy due to a preditory lender situation and this loan was in the the Chapter XXXX filing. United Guaranty owned the loan and filed XXXX claims against us against our Chapter XXXX filing and received payment through our Trustee. United Guaranty had purchased this loan from XXXX XX/XX/XXXX when our Bankruptcy was filed. The Bankruptcy was discharged XX/XX/XXXX. On approximately XXXX/XXXX/XXXX we received letters from XXXX XXXX XXXX and XXXX XXXXstating that they had a debt we owed and it was being sent to collections on a delinquent account we had never received any information or bill on, and had no knowledge of owing. After reviewing our bankruptcy it appears as though they had been paid through the court by claims they had made against us when our bankruptcy was filed. I ( XXXX ) made copies of the claims made and the discharge paperwork and sent it to both XXXX XXXX and XXXX XXXX Firm. XX/XX/XXXX a processor came to our home intending to serve our daughter with papers regarding a judgement against her and we explained the situation to him and that our daughter did not reside with us and we had not had contact with her for seven months. He advised I ( XXXX XXXX ) call the law firm he was representing and explain what I had told him. I did that the next day and was told by XXXX ( representing the law firm ) that they had our lawyers name and he asked me if the name they had was correct which it was and that they would not talk to me they would take care of everything necessary through our lawyer and that was the end of the conversation. I ( XXXX ) made copies of all the documents regarding the claims filed by United, copies of our bankruptcy, and the dismissal document and brought them to the law office of XXXX Law Firm on XXXX XXXX, XXXX again stating that XXXX XXXX does not live here. We have now received documents that there is a motion filed and I must appear in court. To the best of our knowledge they have received their claim amount and the bankruptcy is closed. United Guaranty did not file any further claim when asked by the court to do so before the final discharge was approved. They continue to hassle us and have continually threatened us with judgments and to make false statements regarding our credit to creditors.

WHEN FILING BANKRUPTCY DOES NOT EQUAL A FRESH START!
As of XX/XX/XXXX, our bankruptcy became final. Despite the downward spiral of the economy at that time, we believed we were given a fresh, new start. Little did we know that eight years later, while applying for a VA mortgage refinance ( Ref. : # XXXX ), we would still be stuck with a remnant of a second mortgage which was specifically included with that bankruptcy.
Turns out that XXXX XXXX XXXX, now XXXX XXXX, had insured our 2nd mortgage ( Ref. : # XXXX ), through XXXX XXXX XXXX XXXX XXXX of NC, c/o XXXX XXXX ( Ref. : Acct. # XXXX XXXX ), who then, unknown to us, retained a lien on our homes title. So, in order to clear the lien and secure the new mortgage, we had to pay the insurer {$17000.00}. That money was originally slated for some home improvements and bill consolidation.
Here are my points : The original Fresh Start intent of this bankruptcy was totally defeated by the above activity. Plus, we would have gone to our graves while not knowing that our heirs would have to deal with this problem. How embarrassing. Now, if all of this is legal, what good is it? What purpose does it serve, except to protect only those who need it least?
I still have the paperwork and details of the above, as well as of the ignored attempts by us for a Mortgage Loan Modification in XX/XX/XXXX, while the economy and our business started really going south. ( Please note, that the original mortgage was finally modified ( Ref. : XXXX & XXXX XXXX # XXXX ) after the bankruptcy, which then avoided foreclosure. ) When I queried the reason they werent responding, I was told that the bank was so busy, that they were answering only those who were already in arrears ... which, we werent, yet. Of course, there begins the rest of the story, which lead to our filing bankruptcy and later, during better times, the story above.
If someone in your offices can see there is a more positive resolve for us, in this {$17000.00} confiscation, Id be more than happy to supply all the necessary documents. Please, just let me know.

United Guaranty XXXX XXXX XXXX of North Carolina, has come after me for a property that was foreclosed on in XXXX. The original loan was with XXXX XXXX as Account # XXXX and is currently listed on my credit reports as foreclosed. XXXX XXXX indicated the property was foreclosed on XXXX/XXXX/XXXX and after they sold the property the transferred my account to United Guaranty. I had NEVER received anything from United Guaranty and do n't know why I would owe them anything since the house was foreclosed on, the property was redeemed, I received a cancel debt XXXX to report as income in XXXX. They have now transferred the written off, cancel debt to another malicious collection agency called XXXX XXXX XXXX. This company has now redated the debt, added thousands of $ of interest and put on my credit report account stating that I owe them {$43000.00}. United Guaranty/ XXXX XXXX XXXX and XXXX XXXX has the same debt listed on my credit report! Different Dates, different amounts and different companies that I supposedly owe. My complaint is that they are willfully and maliciously reporting false information to my credit report. ( XXXX ) companies have the SAME information reporting on my credit report and according to FDCPA 807. False or misleading representations- these companies United Guaranty XXXX XXXX XXXX and XXXX XXXX XXXX are clearly violating my rights. I am requesting that because they violated my rights and addition I believe my loan may have been apart of the sham kick-back scheme XXXX : XXXX ).
I am desperately seeking your the help of the Consumer Financial Protection Bureau to get this information deleted from my credit reports.

I had applied for a modification with XXXX on my XXXX lien last year. I went to a XXXX non profit agency for help. I misunderstood the counselor helping me and I did not pay payments while I was waiting to hear on the modification. a whole year went by and I kept submitting the requested docs to XXXX for the mod then in XXXX of this year I received a notice of servicing transfer stating my loan had been transferred to United Guaranty. By this time my new counselor with the XXXX office helped me call the new servicer to explain I was waiting to hear on my modification. we spoke to XXXX XXXX with United Guaranty she explained to me that my account is XXXX payments passed due and my balance is {$4000.00}. My payment with XXXX is {$120.00} if you do the math, XXXX payments x $ XXXX XXXX plus late fees. when the housing counselor and I called XXXX to discuss options to bring my account current since XXXX said I would not qualify for a modification. she said I had to pay {$4000.00} and my payments would not go back to the {$120.00}. I do n't understand why if all my information and terms of the loan was transferred this to me means that the current balance, rate and payment would remain the same. we told XXXX on the letter it also states that " nothing else about your loan will change '' I do n't understand why I can pay the 15 months of missed payments and go back to my {$120.00} payment, instead United wants to increase my payments which I can not afford. please help me to work with the new servicer, I just want to pay the pass due and go back to my regular monthly payment of {$120.00} which I had before it was transferred.

Three months ago while looking at my credit report, I noticed that there was a collection account for XXXX put there by a company called XXXX. The next morning I called them, they claim to be collected for a company called United Guaranty XXXX Lien and they did not put that on my credit report since they are a non reporting collection agency. I never heard of that company before. I then reached out to United Guaranty XXXX Lien, they told me they were the issurance company for XXXX XXXX XXXX but they did not place this on my credit report. They said XXXX XXXX XXXX put in a claim and they paid it. Now, I had a mortgage with XXXX XXXX XXXX which they fraudutlently foreclosed on when they told me that I was going to get a loan modification.
Neither United Guarantee nor XXXX is taking responsibility for adding that mark on my credit report. XXXX XXXX XXXX is asking me to pay them 22000 to settle, eventhough they told me that they did not report to XXXX, they are saying until I pay them the item will remain. After pressing the issue with them, they told me that it was XXXX XXXX XXXX who place the item on my credit report. The item does not say XXXX XXXX XXXX anywhere, yet I already have a foreclosure Mark for XXXX XXXX XXXX on my credit report.

On XX/XX/XXXX, I obtained a mortgage insurance policy from United Guaranty Residential Insurance Company as a stipulation for a mortgage loan. A default of the mortgage required United Guaranty to pay the balance of the loan to XXXX XXXX after the foreclosure sale. Since that time, United Guaranty has made several ( 6 ) attempts to obtain reimbursement via civil actions ( Case No. XXXX ) to no avail. Once again United Guaranty has filed to obtain reimbursement in hopes that at some point they will receive a positive judgement. The fact United Guaranty received payments as a insurance company, but now seeks to be reimbursed leaves me uneasy and cause me to question the necessity of obtaining insurance. Though the courts to date has found United Guaranty claims to be baseless, it has been aggravating to have to take time away from my work to defend myself against an entity I paid to supposedly protect me from civil action. It is also to be noted that the claim was less then the amount which I was insured for. The insurance company is attempting to act as the subrogate of XXXX XXXX, who has taken no actions for or against United Guaranty.

I received a letter from XXXX XXXX XXXX XXXX XXXX XXXX stating that I owed {$7200.00} ( {$4800.00} principal and {$2400.00} interest ) to United Guaranty and they were collecting. I have never heard of this company and do not have any unpaid loans. Upon calling to inquire I was told that this was a student loan of my daughter 's that I had cosigned on from XXXX XXXX XXXX University in XXXX where she attended in XXXX. She has not had anyone contact her from this or any other collection agency and is currently making payments on her student loans monthly.XXXX XXXX told me they did not have to contact her because I was a cosigner of her loan and I was responsible for paying. This is the first I have heard of this issue and it seems shady to me since it was over 10 years ago and no one has contacted me about it or contacted my daughter. She is paying her loan so this seems like a scam of some sort.

On or about XXXX XXXX, XXXX United Guaranty XXXX XXXX XXXX of North Carolina paid the balance of a second mortgage on a property in which I dwelled with my former wife. On that date they sent me a letter indicating that they had accelerated the balance of the loan and that the " balance in full '' was due " no later than thirty days from XXXX/XXXX/XXXX ''.
On XXXX XXXX, XXXX I received a letter from XXXX ; a local law firm ; indicating that they were authorized to file suit against me. I requested verification of the debt by mail on XXXX XXXX, XXXX. They responded by filing suit on XXXX XXXX, XXXX. I have yet to be served a summons or receive verification.
I believe that this is a violation of multiple parts of the Fair Debt Collection Practices Act, not the least of which is the fact that the attorney filed suit on a debt that is time-barred under Florida law.

I was hired to list and sell my clients house as a short sale. After obtaining all of the documentation to submit a short sale package to both lien holders the 2nd lien holder United Guarantee ( AKA- XXXX MI ) asked for my letter of authorization in order to discuss a short sale review. After submitting the offer, letter of authorization and closing disclosure i received an email from a XXXX XXXX who simply stated he declined in participating in a short sale for the client.
The first lien holder has accepted their package for review, and the 2nd would not even look at the request for modification of the original loan to do a short sale.. They would not look at any of the seller financials or requests made for a review. XXXX XXXX just sent me an email declining participation with no review.

On XX/XX/2020, we respectfully served XXXX XXXX XXXX XXXX, owned by parent company United Guaranty Corporation with a RESPA inquiry, see attached proof herein. Under Section 6 of the Real Estate Settlement Procedures Act ( RESPA ), a loan servicer or financial institution must provide consumer acknowledgment of request within 5 business days of receipt.
As of today XX/XX/2020, the company XXXX XXXX XXXX ( owned by United Guaranty Corporation ), have failed to even acknowledge our request. This is a clear violation of RESPA under section 6 of the Real Estate Settlement Procedures Act.
We are asking for a copy of the HELOC loan note. Under Florida statutes we have every right to make such servicing request. We have no idea who the company is and how they obtain our account.

I closed on my home on XX/XX/XXXX with XXXX XXXX and I had a PMI payment of {$710.00} per month. The company, United Guaranty, was the company that the monthly PMI payment went to. I paid this exorbitant private mortgage insurance for over ten years. I have paid roughly {$90000.00} in private mortgage insurance fees ALONE. I think that I was given a subprime loan because of my race and gender. I feel that money should be awarded back to me. I am still in my home as of XX/XX/XXXX. After years of paying the ridiculous month of {$710.00}, the PMI on my loan was finally reduced to {$34.00}. I want my money back. I feel like I was scammed. United Guaranty should be ashamed.
