Good afternoon, I sent this correspondence to United Collection Service Inc & XXXX XXXX XXXX XXXX last year onXX/XX/XXXX. This is for Account # XXXX & XXXX according to United Collection. In a nutshell, XXXX XXXX employed United Collection and United Collection Service is charging {$160.00} more to collect for this service which brings their amount to " XXXX. Originally it was {$950.00} and I have since sent a check of {$350.00} from my insurance company XXXX XXXX XXXX XXXX which the amount should be {$590.00} due to XXXX XXXX. I have already sent a CFPB complaint to XXXX XXXX concerning this and am waiting on a response from XXXX. With respect to United Collection, I know why they added {$160.00} to the amount to make a profit for their business which is OK. What's not OK is that no notice from XXXX XXXX between service rendered on date XX/XX/XXXX and XX/XX/XXXX and then about 6 months later this bill being sent to collections. I have already aired my grievances that other vendors/doctors/hospitals have been paid during this time with my insurance or out of my pocket. I have credit reports that detail my 100 % on time payment history for at least a decade. All the information was there for XXXX XXXX but we never received a letter or a phone call. This complaint is specifically for United Collection because the debt they bought is on shaky and not honorable ground due to XXXX 's negligence. I spoke with XXXX at United on XX/XX/XXXX and they stand on the amount of " XXXX '' and the true amount owed. United Collection is not willing to negotiate. The ideal resolution for this is that United Collection and XXXX XXXX have to reconcile this problem and all I'm willing to pay is {$590.00}. Another ideal outcome is this not to be reported to any credit agency and if it is it will be disputed. **ORIGINAL DISPUTE LETTER SENT XX/XX/XXXX** Good evening, My name is XXXX and Im XXXX husband. I will speak on her behalf concerning this matter. Ill get straight to the point : this debt is not valid and never has been in the first place. Insurance has been available for my son XXXX since he was born ( XX/XX/XXXX ). He has been insured by XXXX XXXX XXXX XXXX and with some exception XXXX through his mothers insurance. XXXX XXXX Hospital ( aka XXXX ) has supplied both insurances for several claims. Almost all claims have gone through successfully since my son was admitted to the hospital in XX/XX/XXXX. XXXX XXXX XXXX XXXX of South Carolina has had to take these claims at this point in XX/XX/XXXX because XXXX ran out of coverage for my son. XXXX had a policy of only covering the mother which is fine since XXXX XXXX XXXX XXXX is covering my son. Long story short, XXXX has covered all claims except for XXXX XXXX. With regards to the claim made by XXXX XXXX, XXXX XXXX ( XXXX ) DID NOT supply XXXX insurance information at the time these supposed claims were made ( XX/XX/XXXXacct # XXXX & XX/XX/XXXX acct # XXXX ). The information given to XXXX XXXX was XXXX which Ive explained earlier is not valid insurance. Therefore, not acceptable payment for this service. Dont ask us why XXXX did not supply XXXX XXXX with valid insurance. We called XXXX and they claim all insurance was handed out. Also, XXXX XXXX has been sending MAILED correspondence to an address we havent lived at since the end of XX/XX/XXXX Our old address was XXXX XXXX XXXX XXXX XXXX XXXX Florida XXXX and our new address is XXXX XXXX XXXX XXXX XXXX in the same city. A phone call wouldve gotten our attention and I promise you XXXX had that information for any claimants. I claim XXXX XXXX has been negligent in collection for this claim. I did speak with XXXX at XXXX XXXX on XX/XX/XXXX and I explained to him the problem with getting the wrong insurance company. He made a claim with XXXX as soon as I supplied that info to him. On XX/XX/XXXX, XXXX sent me a check for {$350.00} and I sent it to XXXX XXXX. I did speak with XXXX at United Collection Service , Inc on XX/XX/XXXX and I let him know his companys collection action is not valid and will not be honored because we had insurance at the time of service. With respect to United Collection Service Inc, I know you are a business attempting to make a profit but the amount of {$1100.00} will not be paid. Instead, the original amount of XXXX will be paid through XXXX and any payments will be sent to XXXX XXXX. As it stands, XXXX XXXX is due XXXX. I have made a claim and am in correspondence with XXXX to get that amount. If United Collection Service , Inc does put this on my wifes credit report, it will be disputed. XXXX : XXXX had insurance all along. XXXX did not supply the right information and XXXX XXXX was negligent in communication. A phone call wouldve fixed all this. By the way, its XXXX.

On XX/XX/XXXX, I discovered a collections account with United Collection Service on my XXXX App. This account was recorded for XXXX XXXX XXXX at a time that I was not in XXXX XXXX. On XX/XX/XXXX, I sent a certified letter to UCS with three ( 3 ) mailings : ( 1 ) dispute of debt, ( 2 ) request for verification, ( 3 ) mail-only communication. Pursuant to FDCPA and Florida Law, UCS had five ( 5 ) days to respond to this, and they did not. On XX/XX/XXXX, I called United Collection Service at or about XXXX P.M. and spoke with XXXX ( spelling may be incorrect ) regarding this issue. I was never provided a last name. I informed XXXX that United Collection Service did not provide a verification of debt, nor provide any form of written correspondence regarding this matter. XXXX confirmed that no written correspondence of any kind was ever issued in this matter from the beginning of the reporting of the alleged debt. Upon informing XXXX that under the Federal Trade Commission Act rules, the Fair Credit Reporting Act, and the Fair Debt Collection Practices Act, United Collection Service had five ( 5 ) days to respond to my document requesting verification of debt by writing only and by mail only, she informed me that United Collection Service would not respond to mail requests for verification, which is in direct conflict with the rules outlined by the Federal Trade Commission Act, the Fair Credit Reporting Act, and the Fair Debt Collection Practices Act. I then asked to speak with XXXX supervisor, and was transferred to someone named XXXX. Again, I did not receive a last name. I left a message on XXXX voicemail regarding this issue, but have not heard back. I have included a relevant timeline below. Under the Fair Debt Collection Practices Act ( FDCPA ), consumers always have the right to request verification of a debt after finding out about the alleged debt in question within 30 days of the first written correspondence with the Collection agency. I notified United Collection Service on my first written correspondence with the company, thus the verification period has not been waived and has, in fact, been fully satisfied. Collection agencies such as United Collection Service are required to respond to these verifications within five ( 5 ) days of receipt of the request. At this time, I have received zero correspondence from United Collection Service regarding any contested matter. When I spoke with XXXX, she informed me that no mailing had gone out regarding this matter, and that it would not, because United Collection Service does not send out verifications as a response to written requests for verification. This is in direct conflict with the FTCA, FCRA, and FDCPA, all federal rules for conducting debt collection. Because United Collection Service did not, and in fact refused, to furnish this consumer with a verification of debt within the statutorily required period, it is necessary that United Collection Service delete any and all debts being reported to any and all credit reporting agencies, as United Collection Service has not complied with, and refuses to comply with, the Federal Trade Commission Act, the Fair Credit Reporting Act, and/or the Fair Debt Collection Practices Act. At this time, United Collection Service has waived their right to contest and report this debt any further. Per my original mailing, United Collection Service may only contact me through written mail to discuss this issue. Additionally, because UCS never sent any kind of mailing regarding this debt, as verified through their agent, XXXX, I was never informed of my ability to dispute, which is required under the law. To date, I have received nothing from UCS in regard to this debt. RELEVANT TIME LINE XX/XX/XXXX : Discovery of Alleged Debt Reported to XXXX and XXXX Credit Reports via XXXX App XX/XX/XXXX : Consumer Mailed Three ( 3 ) Documents Requesting Verification of Debt, Mail-Only Communication, and Dispute of Debt via Certified Mail to United Collection Service XX/XX/XXXX : Mailing Received by United Collection Service XX/XX/XXXX : Expected Date of Mailing of Verification of Debt XX/XX/XXXX : Phone Call Between Myself and United Collection Service Requesting Deletion of Alleged Owed Debt From All Credit Reports XX/XX/XXXX : Second Mailing Sent to UCS Informing Them of Their Failure to Verify

Upon further investigation, I have retained new copies of my credit reports, and noticed that you did not furnish the credit bureaus with the required disclosure, within the period required by law. You are required by federal law to place a notice of dispute on my account within 30 days of my dispute, which you signed for. I have retained a copy of your signature and date of receipt, as well as a time-stamped copy of my credit reports, showing that you have violated the Fair Credit Reporting Act, Section 623 ( a ) ( 3 ) and/or the Fair Debt Collection Practices Act Section 807 ( 8 ) by not placing the disclosure within the required 30-day period. I further remind you that you may be liable for your willful noncompliance, as per FCRA 623 ( a ) ( 3 ) - Responsibilities of furnishers of information to consumer reporting agencies [ 15 U.S.C. 1681s-2 ] ( 3 ) Duty to provide notice of dispute. If the completeness or accuracy of any information furnished by any person to any consumer reporting agency is disputed to such person by a consumer, the person may not furnish the information to any consumer reporting agency without notice that such information is disputed by the consumer. ( B ) Time of Notice ( I ) The notice required under subparagraph ( A ) shall be provided to the customer prior to, or no later than 30 days after, furnishing the negative information to a consumer reporting agency described in section 603 ( p ). As you have violated federal law, by not properly providing the credit bureaus with proper notice within the required timeframe, and I have evidence of such, via certified mail receipts, you must now remove the item. Any other action ( or inaction ) on your behalf may result in a small claims action against your company. PLEASE ALSO ATTACH COPIES OF : Any agreement with your client that grants you the authority to collect on this alleged debt, or proof of acquisition by purchase or assignment, and authorization under subtitle D of the ARRA, SEC. 13401. APPLICATION OF SECURITY PROVISIONS AND PENALTIES TO BUSINESS ASSOCIATES OF COVERED ENTITIES ; and SEC. 13407 ( 1 ) BREACH OF SECURITY. The term breach of security means, with respect to unsecured PHR identifiable health information of an individual in a personal health record, acquisition of such information without the authorization of the individual. Please note that enforcement of penalties against you is covered under the penalty rules of the Omnibus Final Rule effective XX/XX/XXXX interpreting and implementing various provisions of the Health Information Technology for Economic and Clinical Health Act of XX/XX/XXXX ( HITECH Act ) as issued XX/XX/XXXX and the penalty rules of the FCRA and FACTA including FACT Act changes final rules effective XX/XX/XXXX.

****THIS IS NOT A DUPLICATE COMPLAINT*** *****additional information is attached. ***** Recently I disputed these accounts on my credit report, and I noticed accounts from your company are still being reported on my credit. I am highly upset about the information that you are reporting about me. I do not owe your company any money. Additionally, I know it is illegal for a collection agency to collect on behalf of another one. How can a collection agency extend credit to consumers? They simply ca n't. Since you ca n't produce a contract between me and United Collection Service these accounts need to be deleted from my credit report. You are in violation of both the FDCPA, HIPPA & THE FCRA. If these listings are not removed from all 3 o f my credit reports, I will report you to the proper agencies and possibly seek monetary damages for violating my consumers rights.

In th e US law encyclopedia, XXXX XXXX , 73 Am Jur 2d. Sections 90-93 ; it says that one can not subrogate onto a contract that they were not originally on, did not have any interest to protect, and then claim successor in rights and interests. Thus, when an original credit sells the debt, they give up their rights to collect on the debt, BUT they do not give those same rights to the collection agency. The collection agency can not act as a substitute for the original creditor.

Th is debt has not been " VALIDATED '' you did n't give me the opportunity to validate before add ing it to my credit reports. YOU ARE I N VIOLATION OF FCRA and FDCPA laws. Its evident that United Collection Service do n't have proper documentation to collect this invalid debt. You do not have access to files allegedly SIGNED by me, because I do n't recall signing any documents ; which is why I 'm requesting the documents that " I signed '' from United Collection Service. I have the right to request documentation with my physical signature ; as ide ntity theft is at an all time high. I 've sent a complaint to BBB as well as I 'm in XXXX with the tactics of this company and how they 're destroying my credit worthiness. Feel free to respond to this complaint with '' HIPPA RELEASE '' - Medical records and or Documents signed by me. If United Collection Service have a right to collect, they have a duty to produce legitim ate validation. Until I receive documentation requested ; my HIPPA rights are being viola ted. Producing a statement from some medical facility with diagnosis codes, procedures, a date of birth, and address does not validate this debt as mine. Your acts are damaging and disheartening. THIS IS NOT MY DEBT.. However if this can not be fixed within 5 days I have no choice but to file a HIPAA complaint with XXXX

I am in receipt of my credit report dated in XX/XX/2017. Since obtaining my credit profile I came across this account that does not belong to me. I sent UNITED COLLECTION SERVICE INC. certified letters and have not received a response from them regarding inaccurate marks on my credit report. I am for certain that I do not owe your company any money. For starters, I have never done business with you. In fact, I had never heard of your company until having received my credit profile. What I find strange is your attempt to settle the debt with me when I do not owe you any money in the first place! Please see this as me disputing once again this alleged debt with your company as well as requesting debt *VALIDATION*. You have more than enough time for you to send me and CFPB legal supporting documents bearing that I 've done some type of business with you, *HENCE OWING YOU MONEY*. This is not my debt. I have sent multiple, certified letters for the company to send me other information than a bill printed off of their computer stating that I owe {$780.00} and that they demand payment now. They refuse to send me : *A validation letter *A written contract with my hand written signature on it, that includes date, amount and all of the detailed information showing that I received or agreed to receive any services. *Proof they are licensed to collect in my state *Provide me with their license numbers and registered agents The only thing they continue to send are letters demanding payment or they will report the bill to the credit bureaus. I have receipts from USPS showing that they have received my letters requesting the information that I am entitled to under the Fair Debt Collection Practices Act.

With regards to account # XXXX, I observed that this company had been reporting fraudulent information to the credit bureau and was listed on my credit profile. This false information plummeted my credit score and I told them three times- this account does n't belong to me. I have even asked them to validate the debt to which they have refused to comply. I further asked for as copy of the contract that contractually obligates me to pay them a debt- I do n't owe. I know I have rights as a consumer according to the FCRA and the FDCPA to which they have already violated three times by reporting. This information can be litigated as a civil matter. However, I just want them to delete these account due to it being reported in error.

I recently wrote UNITED COLLECTION SERVICE a letter asking them to verify the debts that they keep under my name. According to FCRA they are required to validate any debt. Not to mention, withholding any information they received from any medical provider in attempt to HIPPA complaint can be a violation of the FDCPA. I have requsted full documentation of what they have to verify this/these accounts. There is no signed documentation that they sent me stating that I have a binding, contractual commitment with UNITED COLLECTION SERVICE. According to FCRA any company is REQUIRED to provide a method of verification which should consist of the actual and original signature of the individual they are contacting.

I have asked United Collection Service to validate a collection they are reporting on my credit reports on XXXX/XXXX/XXXX, XXXX/XXXX/XXXX, XXXX/XXXX/XXXX and they have failed to provide anything that would support the fact that they are attempting to collect interest on a debt without an agreement or contract. Nor have they supplied anything other than a statement on one of the collections. I told them that I would be reporting them to you but they obviously do n't fear you because they failed to delete themselves or answer questions about the debt ( s ) that they are using to damage me financially. Its damaging my credit and it is important to me.

Nor have they supplied anything other than a statement on one of the collections. I told them that I would be reporting them to you but they obviously do n't fear you because they failed to delete themselves or answer questions about the debt ( s ) that they are using to damage me financially. Its damaging my credit and it is important to me.

My name is XXXX XXXX. In 2016 a debt was incurred for " XXXX XXXX '' using my social security number ending in XXXX for XXXX XXXX XXXX. This debt does not belong to me, has not been validated, and the collection agency as well as XXXX is till reporting and the investigation has exceeded 30 days without validation. I have called them and they have refused to speak to me because the debtor is " XXXX XXXX ''. They are not in compliance with FDCPA nor federal consumer protection laws. Their inaccurate reporting has adversely affected my quality of life and has caused undue hardship.

I mailed a certified handwritten letter to the United Collection Services on XX/XX/2019. USPS tracking states that it was received XX/XX/2019. This letter is a debt validation letter requesting that they send the required proof they have to assume this debt against me as per my rights under the FDCPA. They were given 30 days to send me the documents that I needed ; if they did not, they were to DELETE these accounts off my credit. They have violated my rights and I demand that action be taken to resolve this matter. Thank you for your time.

Recently a complaint was resolved between me and United Collection Services on XX/XX/2017. CFPB Complaint:XXXX The terms which were made by Manager XXXX XXXX XXXX ( XXXX ) stated that my collections would cease and that all reported information to the credit bureaus would be deleted entirely. It is exactly 20 days later and the fraudulent collections are STILL being reported on my XXXX credit report preventing me from acquiring new credit. Please confirm the removal of all collections and forward them to either me or the CFPB.

XXXX XXXX, 2016 {$350.00} I called and notified the collection company that this is not my bill when it was received in 2016. This is a Bill for a XXXX XXXX XXXX in Florida. Which is not my name nor a name I have ever gone by. The last 4 of the Social Security number on my credit report that was also included on the report is not my last 4. When I spoke to someone at the company last year they said they would take care of this I even told them the last 4 of the social was inaccurate/ not my final 4.
