I have been discussing a possible home build with United Built Homes ( www.ubh.com ). On XX/XX/2021 ; I met with XXXX XXXX to provide initial information and discuss the floor plans and style of homes. On XX/XX/2021 ; I met with XXXX XXXX to discuss the initial offer from the in-house lender of United Built Homes. XXXX explained that even though I was willing to offer 3 acres for collateral, the in house lender wanted all 11 acres as collateral and was not considering a down payment. I explained to XXXX that to put up all 11 acres just for the build of the house at a 8.99 % interests rate seemed a bit unreasonable given that : 1. The house would be finished without flooring or appliances, thus making it harder to refinance because the house would already be over evaluated. 2. The house would possibly cost of the house at the time of refinancing could be an issue if/when lumber and construction costs decrease. The house that is costing {$180000.00} now just for construction could be viewed as only being worth {$150000.00} at time of refinancing because the depreciation based on the lower costs associated with building materials being much lower in the future. I then told XXXX that I am not willing to put up all 11 acres. However, I am willing to put up a down payment and reconsider downsizing in other ways like eliminating a metal roof or lessening the height of the house. I also told XXXX that if they are insistent on wanting the 11 acres given the risks that I will be taking on not being able to refinance a construction loan that is already running at the cost of the full build and the huge risk of depreciation then I would not be able to do business with them. XXXX also mentioned that they wanted even more land as collateral. I asked XXXX if there was a way that I could speak to them directly so that I can address any concerns that they had line by line. XXXX stated no, that this was not possible because this benefited me by them not being able to show any type of discrimination. I told XXXX that if she could get me a list of the things that the in-house lender was concerned about then I would address them. On XX/XX/2021 ; XXXX called me back and informed me that the United Built Homes in-house lender was not willing to reduce the collateral down to 3 acres and was insisting on 11 acres. When I asked about what was their concern, she stated the in-house lender told her that I had 100+ delinquencies on my credit report. When I explained to XXXX that I monitor my credit report daily from several different applications and bank services and know this was not true, then she asked " what reason would they have to lie ''. I explained to XXXX, that the benefit of them making my credit look worse would be to justify me putting up more land as collateral for a nearly no win situation for me. Basically, United Built Homes was attempting to set me up for a land grab knowing that they are intentionally placing me in a situation where it would be difficult to find a lender that would refinance the the house for the original loan amount. I also pointed out that even XXXX XXXX accepting/offering me a mortgage on this amount in 12 months is speculative and not guaranteed as we had discussed. I am suggesting that United Built Homes in-house lending service is intentionally making my credit appear to be worse than it is in-order to help place me in a situation where they are almost guaranteed to gain the land and house because they have intentionally created a situation where it will be difficult for me to refinance the home once it is completed because they know the house will be valued less. I am also suggesting that they would stretch out the build process over the year causing me extra expenses and that they are intentionally under estimating their home build completion time. I am also suggesting that the person processing the decision in the in-house lending department is intentionally providing less options for collateral because I caught what appears to be a con-game and trick.

United Built Homes XXXX, XXXX Signed contract with the United Built Homes, Builder. The construction loan was 12 months no payments. I requested home be complete by XXXX, XXXX. The sales manager and construction manager said it would be closer to XXXX. However the contract does not state a completion date. XXXX, XXXX UBH poured foundation and began the build. XXXX, XXXX Construction Manager informed me the previous construction manager did not file any of the contracts that he was now having to complete. All construction stopped and I was told we were waiting for HVAC. XXXX, XXXX I went to file for my septic and driveway permit and was informed the builder never filed for a development permit. I filed the development permit at this time. No construction on home since early XXXX. XXXX, XXXX Construction loan has come due and an extension was completed to XXXX, XXXX. HVAC was installed late XXXX, no other work was completed on home. XXXX, XXXX Filed a complaint with the Attorney General and XXXX. Builder began construction late XXXX. XXXX, XXXX Payment is due. I requested an extension because construction is still incomplete and they have no closing date. XXXX extended to XX/XX/XXXX. XXXX, XXXX Closed on the house on XX/XX/XXXX. Requested information from builder regarding my prequalification which was at 3 % interest. XXXX, XXXX Did not receive prequalification information until mid XXXX. Did not make XXXX payment. Began talking to mortgage officer about refinancing. XXXX, XXXX Did not make XXXX payment. Still trying to refinance, but my debt ratio was an issue. Currently 60 days past due. XXXX, XXXX Spoke with XXXX XXXX with the builder and requested an extension in order to complete my refinance. He denied the extension. Made XXXX payment. 60 days past due. XXXX, XXXX Made XXXX payment. 60 days past due. XXXX, XXXX Did not receive a mortgage statement for XXXX. Called on XX/XX/XXXX to make payment over the phone and spoke with XXXX XXXX. He refused to take a payment by phone. He informed me I currently owe XXXX payments and the house was in foreclosure. I'm currently 60 days past due, with a payment due XX/XX/XXXX which would make it 90 days past due. I requested that XXXX send me the XXXX statement and/or the foreclosure notices, with no response. I wrote a check and sent it via XXXX XXXX for delivery by XXXX XX/XX/XXXX in order not to go 90 days past due. I also informed XXXX XXXX that I had consulted with an attorney regarding wrongful foreclosure on the home. United Built Homes is the Builder and the lender. The construction loan is at 9 % interest. They delayed the building of my home ( 16 months ), refused extensions to refinance and have roadblocked my refinancing. I feel this has been intentional so they can maintain the loan at 9 % interest at $ XXXX per month. At this point they are playing games.

Requested information to pay off homeXXXX Received first incorrect payoff statement-XXXX. This was incorrect because of the amount of interest due, an item called " Funds owed by borrower '', and because the amount of taxes paid by the lender. The lender is also the home builder and paid taxes on the property but paid them late which resulted in late fees. Since XX/XX/XXXX we have received multiple payoff statements. United Built Homes ( UBH ) has not responded to requests for an explanation of Funds owed by Borrower, has not stated if they will pay for late fees due to their late payment on property taxes, and on the most recent payoff statement, UBH has included insurance and property taxes with these disbursement dates : property taxes XX/XX/XXXX and insurance XX/XX/XXXX. We were told in email to disregard the insurance, but the most recent payoff statement does not reflect this. I have asked for documentation from UBH that the current year 's taxes have been paid and have not received this, and the county website ( last time I checked ) does not show these taxes as having been paid. It is documented in email that I have requested accurate payoff statements multiple times. Further, I have sent two wire transfers dated XX/XX/XXXX and XX/XX/XXXX that when combined amount to the cost of the home with taxes that were paid for XXXX minus the late fee incurred by UBH, though UBH is including this amount in the payoff statement. UBH is currently stating that they are refusing these wire transfers, but I confirmed, through speaking with my bank, that as of today those transfers were not rejected or returned. That money is no longer in my account and has not been since the dates listed above. However, UBH has not updated their payoff statement and we consider the most recent payoff statement to be inaccurate and to include interest and charges that we either have not received explanation for from UBH or is simply inaccurate. Further, we do not consider the work on our home to be complete as outlined in our agreement with UBH and communication with UBH employees.

I bought land and dirt and then paid United Built Homes ( United Built Homes is a Bank, A Mortgage Company, A Lumber Company, A Warranty Company and a Builder ) to build a shell home on XXXX XXXX in XXXXXXXX XXXX. I paid United Built Homes half with a cashier 's check on XX/XX/2021. They claimed my home was substantially complete and asked for the remainder. After we had an engineering firm ( structure ) and an HVAC inspection we were notified there are structural and HVAC defects. The ceiling could collapse in our family room if left as is. United Built Homes was notified by certified mail. United Built Homes ' reps referenced the contract ( where it states that I must accept the home even though it's defective and I also must accept home if it is not in liv-in condition. ) I asked United Built Homes to fix but they refused and filed foreclosure against my house instead of fixing defects. I either have to accept a dangerous defective home ( shell ) as is and pay the remainder or I have to loose my life savings that is tied into this home. They advertise on their website ( International Residential Code standards & oversight - ( my house was built with little to no oversight and certainly not Residential Codes ). They also lied about the size of the lumber which could have caused an accident. ( This home building agreement is a cash deal for a shell. I did not see any categories that fit my circumstance. If there is a better profile for my situation, plese let me know and I will re-file. )

On XX/XX/XXXX a mortgage agreement was made for {$190000.00} between myself and United Built Homes, L.L.C as both the lender and the seller of a home in XXXX XXXX, TX. In this agreement no prepayment penalty was disclosed. A simultaneous agreement was entered to build the aforementioned home that included the seller providing a proper survey and permitting according to local law and jurisdictions ( XXXX XXXX ). This loan agreement at 6.97 % is well above the current market interest rate. Beginning in early XX/XX/XXXX, I have been attempting to refinance the mortgage with United Built Homes L.L.C. I can not refinance my mortgage into a more suitable interest rate because United Built Homes L.L.C refuses to provide a proper survey and permitting ( that is owed to me according to my original agreement ) that will allow me obtain an address for the home and thus allow another lender to provide a mortgage. Not only is the home unlivable, but United Built refuses to allow me to refinance out of their mortgage. When raising my concern with the mortgage servicing department, the associate refused to escalate my situation to the Office of the President much less his manager and advised I must pay the mortgage and it's my responsibility to figure out a way to refinance ; before hanging up on me. I have also requested reimbursement for the interest expense that I have occurred due to the lenders mistakes and lack of response to fix the issue. This too was denied.

On XX/XX/2015, I returned a call that was left on my phone's voicemail to XXXX(XXXX) from United Bilt Homes Corp in XXXX LA. During this call, XXXX said we had missed our payment for XXXX. I informed XXXX, our due date was on XXXX and we had a 10 day grace period and we had up until the XXXX of the month. He was quick to say no, that is when we will receive a late payment penalty. And then asked me how I would like for him, XXXX, to take away our home from us. I told him, we were still in our grace period and the payment should be there that day or the XXXX. And there was not legal right for him to say that statement when we were not in past due status. I ask if the Owner knew how he treats people unfairly and was told the owner back him 100% and hung up. I called back, he asked if I would like to talk to the owner, XXXX and said he would transfer me to him. XXXX transferred me to XXXX, and other employees but never XXXX. After repeated times to call back, XXXX would put me on hold.

Since my first complaint It was asked in the months of XXXX, XXXX and XXXX of 2023 to put the {$4500.00} on my remaining balance on our mortgage and they've refused.Since XXXX XXXX refuses to talk to me ( because I have been bringing a witness with me ) I was told to contact XXXX but he hasn't responded to our phone calls ( from three different phone ) or e-mails.Since XXXX XXXX refuses release the funds to any of our contractors to get our home repair we request ( once again for the fourth time ) just put it on our mortgage so we can be done with this wicked company. P.s before you respond with any negatively please talk to the employee at the XXXX office and ask them why they call a man who's 16 years ahead on his mortgage and ask him what time he'll be in with his payment and then close early!

We live in XX/XX/XXXXand have a home mortgage with United Built. They take your land as collateral to secure the mortgage. We are in a mortgage with over 9 % interest, which is unheard of rates at this time. My income lowered by over 40 % at the time of the pandemic. We fell behind our payments and have been unable to get refinanced due to late payments. United Built would not even discuss a forbearance during the pandemic. So we are stuck in this high interest mortgage. We also have been unable to get any relief assistance because we are not in a federally backed loan. This mortgage company is so unfair to myself and others. While the government continues to offer help to those of us who have been impacted greatly by this horrible pandemic our mortgage company offers none. Very sad.

Myself & 2 other females contracted United Built Homes to start construction on my property on XX/XX/XXXX. First 6mos. no interest. We were prequalified for a 3.75 % int.rate ( the house had to be completed before XX/XX/XXXX ). In XX/XX/XXXX, our int. rate was 6.50 %, house not completed. In XX/XX/XXXX, one of co-owners died, reducing our income {$1100.00}. Three days later, our int. rate jumped to 9.47 % because we had not refinanced with our pre-qualified lender We tried to abritrate, explaining oc the co-owners death. We had a home built by United built home and the appraisal came back low so instead us getting financing though a mortgage company we got stuck with them our mortgage payment is only supposed to be {$1000.00} a month not {$1500.00} a month they didnt let us know before even started on the building the home about the other value of the other homes around this could easily be avoided

A Insurance claim filed/paid to United built Homes for repairs to my home in 2001 and till this day they are still holding the funds and my home has yet to be repaired.Every contractor has been ran off because they refused to pay them.
