My name is XXXX and my husband is XXXX XXXX XXXX XXXX. We have been married for 27 years. I have a XXXX year old son who just graduated from collage and XXXX year old daughter. We have owned our home in XXXX XXXX XXXX, NJ for 19 years and recently decided to buy an investment property and fix it up to rent in XXXX XXXX, NJ in XXXX of 2017. My and my husbands credit score was XXXX and I am a XXXX of XXXX XXXX and my husband is an XXXX XXXX. Our current mortgage is $ XXXX/month set up to have the home paid off by my age XXXX. I set up the mortgage payment for the investment property in XXXX XXXX, NJ to be paid by auto-pay {$780.00} on the XXXX of every month with the first payment due on XXXX with XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX, NJ XXXX phone number XXXX. I told this company that we have one email it is XXXX and I do all of the bills in the house and everything goes to my email because we only have one and my phone number. They told me that they understood and would use my email and my phone number as the primary contact on the account. But insisted on using my husbands email for security purposes and is phone number as well as a secondary contact. So we had to create an email for my husband. On XXXX the mortgage payment was not taken out and it took my until age XXXX to have an excellent credit score and I didn't want anything to affect my credit poorly. So I just paid it that day online. A couple of days later the payment was deducted. So, I called and asked them if they could apply this payment to the XXXX payment. I spoke with a young woman who told me that the first payment was actually paid at closing and the first payment was not actually due until XX/XX/2017. She said that they can not refund the money that they will put a stop on the auto pay and apply the automatic payment to XX/XX/2017 and the other payment I made online to the XX/XX/2017 payment and my next payment would not be due until XX/XX/2017. We were going on vacation to XXXX on XXXX and not be home until XX/XX/2017. Therefore, I called the woman back just to be sure the 1st payment was paid at closing and the the next payment is not actually due until XX/XX/XXXX and she said yes and that she set it up to restart the auto-pay again on XXXX. We went to XXXX and came back to find a letter stating that we were put into collections for non payment on two mortgage payments. I called the company immediately and they told me that they emailed us twice and called twice and no one responded so they put it into collections at 60 days delinquent. They said the first payment was due in XXXX not XXXX. So I paid the XX/XX/2017 and XX/XX/2017 payment and the XX/XX/2017 payment did not auto pay and then on XX/XX/2017 the next payment was due and therefore we are 60 days delinquent and therefore legally they are allowed to put us into collections. They must have a record of the phone call that the woman told me it would auto pay in XXXX. But when questioned, they said they did not. All phone calls are recorded. They " can't find '' these phone calls. I said, " I was set up for autopay in XXXX, so if I owed in XXXX why didn't I receive a phone call before I left for XXXX, to tell me that my mortgage payment wasn't paid. He told me that there is a grace period and then they emailed and called my husbands phone and email. We were out of the country and could not use our phone and he had no messages left on his phone that our mortgage wasn't paid. We made up his email for the mortgage and never check it anyway, they told us that my email and phone would be the primary contact. I asked why wasn't the XXXX payment taken out with auto-pay as it was set up and you could have contacted me about my XXXX payment. He said that when an account is delinquent it automatically stops the auto pay ( how does that make any sense at all ) so that is why the XXXX payment was not taken out on XX/XX/XXXX. I spoke with customer service, I asked for the managers, I took this dispute to the highest level with the company and none of the managers would even call me back. After many phone calls of customer service reps who assured me that a manager would call e back and did not, I finally called again, did speak with one who told me that they are well within their rights to put me into collections for this and they would not take it off of my credit report. I said, " What about this scenario makes you think the we are trying to get out of our mortgage payment. '' " The fact that my mortgage payment is almost {$3000.00} a month and has never been late? the fact that this is an investment property and mortgage is only < $ XXXX/month? or the fact that my credit score is XXXX? or the fact that I had auto-pay set up for monthly payments? or maybe that I paid the first payment twice. '' and if they were calling my or my husbands phone we were out of the country at that time and there were no messages on either of our phones. I feel that this is a poorly run company that had ruined mine and my husbands credit score which is now XXXX when last year at this time was XXXX, over a billing error, not a delinquency. I was set up for auto-pay which they turned off and did not turn on until XXXX instead of XXXX, this is there error, not ours and now suddenly the company who records all phone call, " can not find any record of the phone calls of the woman telling me that the next payment would auto pay on XXXX and they do not care that the payment should have been auto paid in the first place. They are the ones who set the auto pay to start at the wrong time. I do not know if there is anything else I can do to resolve my and my husbands credit report situation or if there is anything you can do to help me but I am refinancing right now to get a lower interest rate on my primary residence and the mortgage companies executive solutions consultant suggested that I contact you and sent me this link. Once again, I am attempting to resolve this issue. I think that this was a billing error and not a delinquency. My credit is now destroyed because I bought an investment property. I will refinance that loan when this is resolved because I do not want to give them another XXXX of our money. They were rude and would not even return a phone call. They were not concerned at all about how this effects our credit and refuse to take it off of my or my husbands credit report. We are very frustrated and feel helpless. My complaint is against Union Home Mortgage XXXX, based in XXXX and one of their Loan Officers, XXXX XXXX, XXXX XXXX State XXXX ( formerly of XXXX XXXX ) XXXX was acquired by Union Home Mortgage in XXXX. I currently own a home in XXXX and for the last 14 months, have been looking for a home in/around XXXX, XXXX, to be close to family. In XX/XX/2018, I decided to make an offer on a property and was told by XXXX XXXX ( my real estate agent at the time ) he would not submit the offer w/o a preapproval letter and directed me to his contact, XXXX XXXX with XXXX, XXXX Home Mortgage Lender, XXXX. We spoke briefly on the phone and she pulled my credit reports to provide the letter, dated XX/XX/2018. It stated, " Once you have found a home, please contact me and I will help you with the next steps of the process. This letter does not constitute a commitment to lend or lock in a rate. '' The letter had an expiration date of XX/XX/2018. ( attached ). The letter also did not indicate any commitment by myself to advance with XXXX further. Never, at any time, did I make any application or complete any authorization form for the credit inquiry for either XXXX or Union Home. ( The XXXX offer was never submitted because the property owner accepted another while I was waiting on the letter. I continued with my search. ) On XX/XX/18 I made an offer on a property, this time for cash, providing proof of funds. This offer was outbid. On XX/XX/18 I made an offer on another property for $ XXXX which was accepted XX/XX/XXXX. XXXX XXXX, my current realtor/agent on her own, called XXXX to ask if it was possible to get a mortgage on property costing less than $ 50k and XXXX told her she didn't think so, that XXXX was usually the floor. It was at this time XXXX mentioned to XXXX that the original preapproval letter had expired. However my agent knew I'd likely be paying cash due to the price, I'd also informed my agent that I did not care for XXXX/XXXX and would likely not use them for any purchase. XXXX then made a NEW hard inquiry without first contacting me : 1. to inform me that XXXX had merged with Union Home Mortgage 2. to ask if I wanted to continue to work with Union Home ( it was over 90 days ) 3. to tell me that a mortgage under 50K was not possible 4. to tell me the previous letter had expired 5. to ask for my authorization to make another hard inquiry ( past 45 days and a new company ) XX/XX/XXXX, XXXX, I learn from my agent the offer is accepted. My agent talked about the next finance steps, saying that she asked XXXX about the low loan amount and that XXXX was going to get back to her. At this time I reiterate to RE agent that I do not want to move forward with XXXX and XXXX should call me, the buyer directly, not relay messages through my RE agent. XX/XX/XXXX, at XXXX, XXXX called to tell me she could not write a mortgage for under 50K, I told her that was not a problem. Then she made a comment about my having a freeze on XXXX, I told her not to worry about that, I would likely be paying cash or securing a HELOC on my current property in XXXX, thus there was no need for her further credit inquiries. After her comment I was alarmed and asked directly, " did you pull my credit again? '' XXXX replied, no, not yet. This however was a lie, on XX/XX/XXXX I received a text alert from XXXX ( credit monitoring ) stating there was a change on my credit report. I logged on and XXXX showed a hard inquiry came through on XX/XX/XXXX from Union Home Mortgage. XXXX reported the hit on XX/XX/XXXX. Now I have 2 hard inquiries on my reports until XXXX. My next application is for a HELOC and if this current purchase offer were to fall through, a mortgage may be needed on the next property. This will be an additional 1 or 2 hits. My XXXX score decreased with this Union Home hit and because mortgage rates are based in part on credit scores, this might end up costing me the best rate. I contacted Union Home, XXXX XXXX, by finding her name on the Union Home website. We spoke late XX/XX/XXXX, I explained how I believed that XXXX acted on her own and did not provide due diligence of me the customer and my credit. She said someone would contact me after the holiday. Today ( XX/XX/XXXX ) I received a call from a man identifying himself in a leadership role at Union Home. I'm not sure he told me his actual name. He proceeded to tell me that he'd already spoken with XXXX and whatever I believed, was not correct. He stated, he'd " worked with XXXX at XXXX for years and knew that she would not act in a way that was not in my best interest. '' I said I disagreed, and that I wanted him to provide me a copy of my authorization for XXXX to pull my credit again. I also requested he state in writing, his claim of resolution ( mentioned above ) to which he asked, " Why? '' I replied because it seems to me you feel this matter is resolved based on your prior relationship. I, however, as the customer, do not believe this action complies with the basis of consumer protection laws requiring lenders to guard non-public personal information. What pretense does XXXX claim as the reason to make a new credit inquiry when she doesn't have an application, and she's fully aware a loan application for less than 50k will not be approved? This behavior isn't in my best interests, ethical and/or legal and I plan to make a formal complaint to the CFPB. At this point, he said, " Good day '' and hung up. At no time did anyone at Union Home advise me of my right to make a formal complaint under the Fair Credit Reporting Act, Truth in Lending Act, the Dodd-Frank Act and/or the Real Estate Settlement Procedures Act. No disclosures or notices were ever provided other than the original preapproval letter. I never received a copy of the second letter from XXXX, I had to ask for a copy from my agent! ( it had the wrong last name too )

On XX/XX/2023 I applied for a mortgage with Union Home Mortgage to get my preapproval to start shopping for a home. I was preapproved on XX/XX/XXXX and started shopping. Talking with my mortgage XXXX there was a possibility of potentially getting some financial help from my father if it would help me out. When I brought the option to the mortgage officer he took it upon himself to put the money in as additional money to bring to closing when 1 I had not agreed to it, and 2 I had asked what it would look like if I used the additional money to pay off a car note. I had specifically wanted the additional money ( if I had chosen to go this route ) to go to the car note so that I wouldn't have that bill on top of having the mortgage after we closed. However, the mortgage officer felt the need to make the decision for us. This was the first issue and it required fixing from our realtor directly intervening and stating that he was taking liberties that weren't his to take. Fast forward as we moved past this and decided against using the additional money from my father. We found a house and this was the dream house. We put in an offer and it was accepted. We were under contract XX/XX/2023. With the loan structure we had we were getting down payment assistance through XXXX so our loan had to go through the normal process with XXXX and then XXXX. On XX/XX/2023 I paid my credit report and appraisal fee to XXXX. On XX/XX/2023 I had my own personal home inspection of the property conducted. The inspection came back fine, however, there were some areas that would need to be addressed at some point ( yet these areas didn't make the house unlivable or not safe ). Our realtor negotiated with the seller to get $ XXXX towards these areas and because of me getting the XXXX funding reached out to our mortgage officer to gain help on how to best handle ( escrow vs title paying contractors vs credits ). Mortgage officer assured us that we would be fine doing an amendment and stating $ XXXX would go towards closing costs and the remaining $ XXXX would be a check cut directly to a contractor for the work. This meant the majority of the funds would never touch me as the buyer. While this is all going on my appraisal comes back on XX/XX/2023 at value ( {$230000.00} ) as is. Not only does the mortgage officer not share the appraisal with me, he takes a direct screenshot from the appraisal ( including the value ) and emails it to my realtor and the listing agent. Now any hopes of using this as negotiating is out the window. I would finally get a copy of the appraisal on XX/XX/2023, 12 days after it came back, mind you my disclosure states they must provide it to me timely and in real estate 12 days is not timely. After all of this the mortgage officer submits our file without the amendment he requested ( my realtor at the time was still waiting on seller 's signature ). The file gets cleared to close on XX/XX/2023 ( both XXXX and XXXX ). We get the amendment on the XXXX of XXXX and mortgage XXXX insists it must go through the whole process and no one will have an issue. XXXX underwriter sees amendment and immediately halts the whole process ( we're supposed to close XX/XX/2023 ). Claims that this amendment, despite the loan being conventional and the appraisal coming in at value and as-is, means the house is not safe. My realtor and I get statements from our contractors and even home inspector stating these items are not items that need to be done and that the house is fine. These items are just things that would need to be addressed at some point in the future. Underwriter is still not satisfied and demands to see inspection report. I won't show it to her because at this point I know she will take every item and turn it into something that it isn't. Closing date passes and we have to get extension from seller. Underwriter at XXXX will not budge despite multiple supervisors from other departments trying to reason. She demands that we show part of the inspection including photos and that we get XXXX bids for the work. This created yet another hurdle since due diligence was over and we no longer had access to the house. Most vendors/contractors won't bid on work without being able to go see the job. We we able to get what she needed and on XX/XX/XXXX everything was submitted. Underwriter decided that even though I had been completely cleared to close already and she had gotten everything she needed she wouldn't give her blessing until XX/XX/2023. At this point she also required that we now keep 1.5 % of the highest bids in escrow ( totaling over $ XXXX ). Please remember the seller only agreed to $ XXXX in the beginning, the appraisal came in as-is, and my realtor had asked about escrow from the very beginning. Now the whole file had to go to XXXX for their last stamp of approval. Turns out that XXXX had to form a formal committee on this and ending up pulling my funding because of the large escrow amount. I wholeheartedly believe the underwriter at XXXX knew this large amount would cause the loss of funding and that is why this number was chosen. She was spiteful because I fought back on her stance for the and then more so after I was able to produce what she requested. All of this has been a complete nightmare and I would never ever recommend anyone dealing with XXXX again. Their customer service is lackluster at best and their desire to put their customers first is ever worse. I had given my current landlord a XXXX month notice because I am so financially solid and I was told everything would be smooth sailing especially after being cleared to close the first time. Well here I stand about to be homeless because XXXX failed me on multiple occasions.

In XX/XX/XXXX, I made 2 mortgage payments during that month. The first payment of {$2500.00} was made on XX/XX/XXXX which was for my XX/XX/XXXX due payment, and the 2nd payment of {$2500.00} made on XX/XX/XXXX which would have paid my XX/XX/XXXX payment. I then proceeded under the assumption that I was 1 month ahead in paying my mortgage payment. I made 2 mortgage payments the month of XX/XX/XXXX as well. The first {$2400.00} payment on XX/XX/XXXX and the 2nd on XX/XX/XXXX. When I then made my next mortgage payment on XX/XX/XXXX, I was under the assumption that XXXX payment was to be applied to XX/XX/XXXX due payment. It wasnt until I received a call from Union Home Mortgage during XXXX asking when I was going to make my now late mortgage payment. Confused as I was, I asked questions regarding payment history as I should have been 2 months ahead in payments. XXXX XXXX XXXX proceeded to tell me I was incorrect, that I was not ahead any payments but paying for the current month, and that the 2nd XX/XX/XXXX payment made on XX/XX/XXXX was returned to me. They claimed to have returned that second XX/XX/XXXX. I have disputed this many of times with Union Home mortgage payment servicing department, with no avail. I have also submitted the included documentation to this claim that proves all payments were received by Union Home, along with my XXXX XX/XX/XXXX bank statement showing all Debits by Union Home but No credits back. There is no record of any refunded mortgage payment to me. With almost a year of disputing this with Union Home, I began to receive mail from Union Home regarding difficultly to pay, and nonpayment procedures, and possible repossession of property is payments not made. I had no choice but to try and refinance with another mortgage company On XX/XX/XXXX Union Home was asked to submit my mortgage payoff, and upon review the payoff listed by Union Home Mortgage is incorrect. It does not account for the XX/XX/XXXX payment, nor any double payments made in one month since XXXX. With this explanation, I have also attached and provided my bank statement from XX/XX/XXXX XX/XX/XXXX showing all debits from Union Home and proof of no credits or returned payments. Also, included is a monthly mortgage payment history provided to me by Union Home Mortgage. It clearly shows all of my monthly made payments, with the false returned XX/XX/XXXX payment. Union Home Mortgage also provided me a receipt with each monthly made mortgage payment, which I have included here as well, along with the XX/XX/XXXX payoff that has the incorrect payoff amount. In resolution of this, I would like for Union Home Mortgage to correct the false reporting to my credit report stating a 30 day late for XX/XX/XXXX and XX/XX/XXXX which they have made, and correct the reporting to read current, and no late payments made. I would also like for the XX/XX/XXXX {$2500.00} payment to be refunded to me, as I have now refinanced this mortgage with the incorrect payoff provided by Union Home Mortgage. On XX/XX/XXXX, Union Home Mortgage without notice or authorization deducted a payment of {$2800.00} payment from my checking account. I did not authorize this payment or debit, nor have I ever signed an ACH agreement allowing Union Home to auto withdraw any payments. I would also like this payment of {$2800.00} returned to me, as the mortgage payoff did not have that payment included in the payoff amount. Provided is all documentation showing these debits, and confirming no credit from Union Home Mortgage. Also, I have included the incorrect credit bureau reporting that shows 30 day late for XX/XX/XXXX and XX/XX/XXXX which needs corrected and I would like for Union Home to correct the reporting to all 3 credit bureaus reporting no late pays in mortgage payments. In total, Union Home Mortgage owes me a refund of {$5300.00} in non-recognized mortgage payments, and {$350.00} in charged late fees for payments that where not late. There was also an excess of Interest charged to the Loan Payoff sent, with {$1100.00} paid and needing refunded to me.

Due to Covid-related hardship, I have been in forbearance on my mortgage since last XXXX ( XXXX ). The forbearance lasted 12 months ; it expired XX/XX/XXXX. I've kept in touch with my lender regularly over that time period and have discussed my options each time and I've also asked for any updates or information on possible assistance. When I contacted the lender last month to make arrangements for returning to my payments, post-forbearance, the representative I spoke with suggested I get in touch with XXXX XXXX XXXX XXXX, an organization that administers funds from the US Treasury Dept. specifically to help people like me who are behind on their mortgages due to a Covid hardship. I'd never heard of this before and immediately went online and filled out the application. However, last week I learned my application was denied because the total amount of assistance they can provide is {$25000.00} and my total owed was approximately {$260000.00}. A representative with the organization said I should ask my lender to allow me to make a payment that would bring down the total owed to {$25000.00} then forward them a statement reflecting this so they could approve my application and send the funds to them. I've contacted my lender twice now, explaining my situation and requesting that they allow me to do this which is in effect making a partial payment. I have offered to make two months ' worth of payments. But they've refused my request, stating they do not accept partial payments. My only options, according to the lender, are : 1 : pay the outstanding sum in full ( this is doable if they'd let me make a partial payment ; otherwise it is impossible ) ; 2 : agree to a loan modification ( however, my monthly payment will increase, since my interest rate will be higher than the one I currently have, making this an impossible scenario as well ) ; 3 : make an FHA partial claim, which as I understand it, would take the amount I owe and load it onto the end of the mortgage ( I don't care for this scenario, knowing there are funds available that would allow me to avoid doing this ). And of course there is foreclosure or possibly selling my home, two other unpleasant but possible outcomes as well. I have done my research and I understand that typically most lenders won't accept partial payments toward overdue mortgages ; I do get it. But my case is fairly unusual in the same way the Covid-19 pandemic and resulting forbearance was unusual. I'm requesting the lender allow me to make a one-time partial payment for a very specific reason : doing so will allow me to bring the loan current. The funds are there, the only reason my application was denied was because of the overage, and I feel as though I've found myself in a XXXX situation. I can make my mortgage payments now and also have the opportunity to bring the mortgage to " current '' status yet I'm being denied the chance to do this because of a policy that appears to be unfairly and almost punitively inflexible given the unique circumstances. I would have applied for the Covid funds if I had known about them sooner. Also I had no idea there was a cap to the funds until I received my denial letter. It's ironic to me that I learned about the program through a customer service rep for my lender ; it's been in place for some time but no one had ever mentioned it before ; I'm not sure why this particular rep brought it up after all this time. I have XXXX children at home, XXXX XXXX XXXX XXXX XXXX. Covid has been a real challenge for my family as it has been for so many people ; obviously, that's why these funds were made available, for people like me. So it is supremely gut-wrenching that I may not be able to take advantage of them. Surely an exception can be made that would allow this to happen rather than the alternative of me and my children being forced from our home.

On XX/XX/XXXX I cancelled my homeowners insurance policy with XXXX XXXX and property insurance because their customer service was horrible and I was having issues with them. Also On XX/XX/XXXX I purchased a new policy with XXXX XXXX. I knew that I had to wait for a refund from my previous insurance carrier that would take several weeks. In order to avoid an " escrow shortage '' and monthly payment increase I paid for the new XXXXXXXX XXXX policy in full out of pocket. I got a receipt from the insurance agent that the policy was paid in full until XX/XX/XXXX. On XX/XX/XXXX I faxed a letter to Union Home Mortgage. In the letter I informed them that I paid for the new policy in full, and I informed them that I did not need any money sent out of the escrow account for the new policy. I provided a copy of the deck page as well as a receipt that the policy was paid in full. On XX/XX/XXXX I received a letter in the mail from Union Home Mortgage that was dated XX/XX/XXXX which stated they received the updated insurance information and that they depleted the remaining funds in my escrow account and if I did not replace the funds I would have a shortage and increased monthly payment because the bank used my tax funds to pay for an insurance premium that I already took the initiative to pay to avoid a shortage while I waited for the refund of the unused premium from the old policy. I contacted Union Home Mortgage at XXXXXXXX XXXX XX/XX/XXXX to ask why they would send out money from my account when I provided a receipt and proof that it was already paid. The Customer Service Rep that I talked to in the Insurance Department put me on hold for a total of 20 minutes, and then came back on the phone with a response that " She did not know why they didn't look at the receipt that I sent in before sending out money causing a double payment on the insurance policy. '' She then very rudely told me that I needed to contact XXXX XXXXl and " track down '' the money and get it back to the bank to deposit in my escrow account or " else I WILL be getting a payment increase '' I explained to her that I did everything that was required of me as a customer to avoid this, that her response was unacceptable because the bank made the mistake with double paying for the insurance not me. I then ask to speak with a supervisor. I waited on hold for nearly 45 minutes with the rep checking in " periodically '' saying she was " trying really hard to get to a supervisor '' Finally she told me she had reached a supervisor and was going to transfer me. As soon as the call was transferred before I could even speak to the manager he or she disconnected the call the on purpose. At that point I was so angry I had my wife call back. My wife got another representative on the phone who threatened to put me in collections for the escrow shortage that the bank caused. My wife asked to speak with a supervisor and the representative laughed and stated " Sorry all the managers went to a meeting and aren't speaking to customers now. '' This whole process wasted nearly two hours of my day, solved nothing, and now I am possibly having my escrow account go to collections for something that was not my error. I have only had this loan 2 months with company as I just closed on my house XX/XX/XXXX. I have made every single payment on time actually a few days early. All I did as customer was change my insurance provider which is a completely routine transaction because I felt XXXX XXXX would better protect my home. Now Union Home Mortgage makes a huge mistake with my money, fails to own up to it, and then due to no fault to me as a customer threatens to increase my payment and due other things that could have detrimental consequences to my financial health and well being.

After re-financing my mortgage in XX/XX/2021 with the same company, Union Home Mortgage, I was informed that all previous settings and such would remain in place. I specifically asked about auto-pay and was told that it would not change. Upon missing my first 2 payments ( XXXX XXXX XXXX ) I was contacted by our lenders secretary to inform me. The company made no effort to contact me directly by email, snail mail or by phone. I made the XXXX and the XXXX payment, both with confirmation codes. I accidentally found out in early XXXX that I was about 6 days from foreclosure because of non-payment. The company was not automatically taking the mortgage from the assigned account. Upon discussing with customer service, I was informed they had sent 1 letter in XXXX. No other attempt to reach me via snail mail, email or phone call was made and this was confirmed. I made all 4 payments to bring the account current and was told that because I was current, the auto pay would finally kick in. It did not and I had to make the XXXX payment, again, where I was informed that auto-pay would start. By this time, I had set up a local account and set up my paycheck to direct deposit to this account. I made all of the necessary changes in my mortgage portal and confirmed this with customer service. Neither XXXX nor XXXX was taken out. I tried to make these payments online and could not. I contacted customer service and was told that because I had so many missed payments, I was put on a 1 year certified funds cycle, where I was required to send them a certified bank check for a year before I could go back to any other payment method. I finally made contact with a loan services lead, explained the last 8 months, and he was able to get me removed from the restriction. He reviewed my file and confirmed that the company made several oversights with my account. I am filing this complaint today because I am still unable to get the company to get auto-pay set correctly and pull the mortgage from the assigned account ( XXXX XXXX XXXX Since changing my account in auto-pay ( XXXX ) to XXXX, I have incurred several " insufficient funds '' fees from XXXX, the bank I originally had the auto-pay set to because they continue to try to pull the mortgage from wrong account. I am currently delinquent as a result of this, as there is no place on my portal to make the payment. I have arrangements to bring the account current tomorrow, but I am unable to do this every month. My mortgage portal shows my XXXX account as the primary ( default ), it shows I have auto-pay ON, and I have plenty of funds available in the account, yet they still try to pull from the XXXX account XXXX I tried to remove the XXXX account today, but am unable to. I am currently in contact with the loan services lead that I spoke with before. I have sent him several screen shots of my portal page, bank account balances and so on. He agrees that my XXXX account is primary and can not answer why they will not use this account. Additionally, it takes the company 10 days to post what's called a " Payment Reversal '' to my portal. By then, I am a day or XXXX away from incurring late fees from them. It does not take XXXX days in the digital world to know whether or not funds are available. I feel like the loan servicing company is doing everything they can to make it as difficult as humanly possible for me to make my payments on time. I am financially stable and have no need for financial assistance. I just need the company to take the mortgage from the assigned account.

Hello, I am in the process of buying my first home. I went to XXXX XXXX XXXX because I wanted to work with a reputable and very responsive mortgage officer. I left my previous mortgage officer who failed to walk me through the process and respond to my emails and calls within 24-48 hours. I am smart enough to research info on the internet. But my situation was unique. I am XXXX XXXX with no XXXX income. So I had specific needs and wanted to work with a lender who specialized in working with people like me. My previous mortgage officer freely gave me a copy of my credit report with the credit score showing. In the past, I have received this same type of report from other lenders. I shared this credit report with XXXX XXXX and his supervisor ( XXXX ) at XXXX XXXX XXXX ( XXXX, FL ). He said he could use this report to get a good idea of my situation. The report was only 3 - 4 months old. So my situation or credit score had not changed much. It had actually improved. I thought XXXX could use the current report without pulling another report ( which would show as an inquiry on my credit report ) in order to issue me a basic pre-qualification letter. I provided the income and taxes he requested. I told XXXX that I wanted my credit report. Clearly, I wanted it if I GAVE him my current report with SCORE that was provided to me by my previous mortgage rep. I was disappointed to learn that he would not give it to me. There are many inconsistencies in the mortgage industry. Some mortgage officers have given it to me for free. Others say that by law they are allowed to have me pay a fee to receive my full credit report with the score BEFORE the closing. I asked XXXX XXXX ( XXXX XXXX XXXX at XXXX XXXX XXXX ) and XXXX if I would get a FULL credit report WITH the SCORE at the closing. Neither one of them responded. If I can get this full report at closing, then why ca n't they give it to me NOW. I could have paid a fee for this. I did not even know my credit was being pulled AGAIN! Now that they pulled it, of course I want to SEE IT! After the back and forth and countless phone calls and all of my wasted time, this has caused me NOT to trust XXXX XXXX XXXX. I do n't believe they will disclose everything to you in advance. You will be blind sided by information. I can not risk having another unresponsive mortgage rep. I learned from other mortgage people that XXXX XXXX XXXX is required to give me a consumer report which is my full credit report WITHOUT the XXXX XXXX. I agreed to accept this, but was really disappointed that they did not tell me this in advance. I have worked hard to maintain good credit. Today is XXXX and neither XXXX XXXX nor XXXX have given me the link to or a copy of my consumer report version of my credit report. I have had to go to different lenders to help me. XXXX XXXX XXXX does not even respond to my emails, phone calls or text messages. This is wrong. It 's irresponsible. It 's poor customer service. How can you trust a mortgage company who acts like this? See attached text messages I had with XXXX and XXXX. This situation NEVER had to escalate to this point. XXXX NEVER told me in advance that 1 - He could not give me my credit report with score, 2 - He was not knowledgeable enough to offer me the Consumer Report version, 3 - He and XXXX are refusing to give me the Consumer Report version. They are completely ignoring my request. They have ruined a perfectly good opportunity for me to provide them with other business for my commercial projects, investment and other residental needs.

Union Home Mortgage is forcing consumers to use their automated payment portal as the only mechanism to make monthly mortgage payments without risk of adverse credit reporting and increased fees ( charges to pay by phone, late fees caused by their processing center and random other fees not explained on statements ). We have had a mortgage with Union Home since XXXX and used the automated payment system from loan inception until XX/XX/XXXX. At this time, we chose to modify how we manage all our personal finances from auto pay on the merchant portal ( s ) to direct debit from our XXXX XXXX checking account via their XXXX XXXX Guarantee Bill Pay services, including our monthly mortgage payment to Union Home. We experienced immediate challenges with Union Home refusing to accept an ECH transfer directly from our bank and instead requiring a papercheck to be sent to a PO Box for payment. The first month ( XX/XX/XXXX ) resulted in our payment processing late with Union Home reporting a 30 day late across all 3 major credit bureau agencies for my husband and myself ( with the exception of XXXX for which they reported me as 30 days delinquent in XX/XX/XXXX incorrectly ). Despite a year of trying to resolve this matter our credit reports are still showing a delinquent payment from Union Home during this time frame XXXX/XXXX XXXX. Further, despite cancelling the Union Home 'Auto Pay ' option on their website portal in XX/XX/XXXX, their system proceeded to auto draft our monthly payment on the first of each month, then credit back to our account around the XXXX of each month from XX/XX/XXXX until XX/XX/XXXX. Each month they were in receipt of a papercheck initiated from XXXX XXXX Bill Pay services prior to the first of each month that they would hold for deposit until the end of each month. In XX/XX/XXXX, Union Home then flagged our account as " certified funds only due to non-sufficient funds '' and stopped cashing the XXXX XXXX direct bill payment checks entirely ( all of which were mailed to the PO Box ). They then began adding late fees and other misc fees to our account. I filed a claim with XXXX XXXXXXXX Bill Pay services in mid-XXXX and facilitated a conference call with XXXX XXXX and Union Home representative ( s ) and was advised by Union Home : 1 ) All late fees charged to the account would be reversed ; 2 ) To stop payment on the XXXX XXXX Bill Pay Checks for XXXX, XXXX, and XXXX and reissue payment once funds were deposited back into our account. Note, upon receipt of funds deposited I immediately attempted to make payment via Union Home web portal but our account could no longer be accessed and was directed to call for support and required to make our mortgage payment ( s ) via phone and was then charged a per month fee to make payment by phone. Throughout this period, I attempted to contact Union Home via website message portal, phone, fax, and mail to the directed PO Box for claim issues, all without reply. As a result of these matters, our credit score has dropped hundreds of points, we have had to pay increased insurance rates, and we have lost the ability to refinance this mortgage. A review of the XXXX XXXX XXXX website appears that numerous other Union Home consumers have related challenges in simply trying to pay their monthly house payment. This mortgage company is preying on its customers and should be held accountable to fair credit and consumer standard laws.

My mortgage payment is late, and its largely caused by the actions of Union Home Mortgage. In addition, my mortgage has no provision that permits them to demand future timely payments arriving as guaranteed funds or cashiers checks. Union Home Mortgage making this demand and refusing payments is outside the scope of our contract and is unlawful, unnecessarily burdensome, and causes additional expense, stress, and duress. The emotional turmoil on my end is off the charts. I tried to make payments in XX/XX/XXXX, via the online portal and by phone. I was unable because my online portal is blocked. I called on two occasions and could not get anyone on the phone and on one occasion was informed that your system was down. They have locked me out from making payments online, you refuse to take an EFT payment, they refuse to auto deduct my payment, and have refused to post a cashiers check payment sent to them. You have eliminated every option that I have to pay my mortgage. This is unlawful, unnecessarily burdensome, and causes additional expense, stress, and duress. I spoke to a member of their team on XX/XX/XXXX in the morning that told me that I could send a cashiers check for {$3900.00} ( 2 of the 3 past due payments ) which I did. I sent a cashiers check, # XXXX, USPS, overnight certified mail exactly as I was instructed. What Ive been able to determine is that they would not accept this check either and that I needed to send other cashier 's check for {$8100.00} XXXXthe total past due ) today to bring my account current. No one at Union Home Mortgage is able to tell me when and if this guaranteed funds cashier 's check will be returned to me. The new demand from Union Home Mortgage requires a total out of pocket from me of {$12000.00} even though my entire past due balance is {$8100.00} which is unlawful, unnecessarily burdensome, and causes additional expense, stress, and duress. The terms of my current forbearance agreement require them to accept partial funds. There is no reason even outside the forbearance agreement for them to not accept two full monthly payments ( 2 of 3 that are past due and the 3rd past due is them not permitting me to make a payment ) in the form of a cashiers check drawn on XXXX XXXX XXXX XXXX. You can not tell me when or even if the cashiers check will be returned to me so that I can use these funds for the lions share of what is past due, but you are unwilling to post the payment to my account. The only incentive for them to not accept this payment is additional fees and costs and is unlawful, unnecessarily burdensome, and causes additional expense on my end. I was informed today that my account will require cashiers checks moving forward into XXXX for you to accept my timely not past due payments. No provision in my mortgage gives you them the ability to make this demand with or without notice. I was told today that a letter was sent to me on XX/XX/XXXX that I did not receive. I have a 1-inch-thick package of documents received from Union Home Mortgage and it is not in this information. I need to see what notice could have been sent that would give them the authority to alter the original mortgage contract without my consent. I was told today that I could review this notice online, but I can not access any documentation having been locked out of my portal.

We have a mortgage with Union Home Mortgage. It was a 5 % down mortgage with a balance of $ XXXX at closing. We understood that until we got our principal balance down to 78 % of LTV that we would have to pay PMI. Our loan was originated in XXXX. On XX/XX/XXXXthey processed our first mortgage payment ( that was due on XX/XX/XXXX). Following that payment, we made payments of $ XXXX on XX/XX/XXXX, another $ XXXX payment on the XXXX of XXXX, $ XXXX on the XXXX of XXXX. We followed those payments with a $ XXXX payment on the XXXX of XXXX. By this time our loan balance was well below the 78 % LTV. Per their instructions I sent an email to their PMIloanadministration address on the XXXX of XXXX. We made another payment of $ XXXX on XX/XX/XXXX, and then on XX/XX/XXXX we made an additional payment to the principal balance of {$1600.00}. On the XXXX of XXXX we paid $ XXXX towards the principle and on the XXXX we paid $ XXXX. At this point I hadn't heard anything back from Union Home so I called. They told me they hadn't received any email. I waited a couple of days and called again. I was told by their representative that I would receive a refund of the PMI that they charged our account on the XXXX of XXXX. On the XXXX of XXXX they charged our account for {$68.00} for PMI. So, I sent another request to stop the PMI payments on my account. I sent another email stating the I was filing a complaint with the XXXX Their reply was to send me yet another email stating I need to send an email to their PMILoanadministrators. I called today ( XX/XX/XXXX ) and their representative said they had received a request to review my case ( she assumed it was a response to one of my numerous emails but I'm pretty sure it is a notification from the XXXX ). She stated it would take 30 days for them to review my case and it might require " additional '' information from me. I asked what additional information could they possibly want since they have our SSN 's, our credit scores, the address of the property, the payments we have made, the balance due, etc. In my opinion they are pocketing the PMI funds that they collect from consumers. I am a homeowner in Illinois, and my mortgage and escrow services are with Union Home Mortgage ( UHM ). In early XXXX, we received a letter stating that our monthly escrow payments are being increased by {$570.00}, resulting in our PITI payments increasing from {$1600.00} to {$2100.00} ( due XX/XX/XXXX ). The rationale for this was that UHM estimated second property tax installment to be {$5300.00}. In reality, that number did not reflect 1 ) our homeowners exemption and 2 ) our successful property tax appeal. In fact, our actual property tax bill was {$3300.00}, or {$2000.00} lower than their estimation. I immediately contacted UHM to figure out how I could resolve this. They told me that I needed to submit my updated Illinois property tax bill, on XXXX County letterhead, to an email address called " XXXX ''. I had to wait about 2 weeks for my second property tax installment bill to arrive, at which point I submitted the documents to this email address. I received a mail delivery failure notice. I then submitted a complaint ticket on their website and submitted the same documents to a customer service representative on their chat service, who said that they opened a ticket for me. After 10 days of no action, it was the very end of XXXX and I called UHM again. They informed me that all of these methods are invalid, and that I needed to submit a formal query to " XXXX '' with an attached signature and relevant documents. They also informed me that since I have no deliquent or late payments on my record, I am granted a 15 day grace period, after which the review should be completed. It is now XX/XX/XXXX and there is no resolution. I called UHM again and they gave me the runaround. Every call with UHM takes 90-120 minutes due to their wait times. Three support agents later, I received no recourse. I asked the first support agent how I could cancel my escrow, she told me to email customer service. Her supervisor, who I spoke to later, told me that this was incorrect and that I need to mail or fax a written and signed letter. At first, they told me that they only do escrow reviews once a year in XXXX. However, they performed an escrow review in XXXX. They then told me that it can take 2 months for them to complete a review, even though they immediately sent me a hiked bill. This $ XXXX monthly increase is causing substantial financial stress to my family, especially during covid. It was thoroughly arbitrary and miscalculated, and I feel like the company has either maliciously or through incompetence misled and and misinformed me through every step of this process, while also not resolving the issue or even acknowledging that this could adversely affect honest hardworking citizens. To add insult to injury, they paid my property tax installment last week. It was {$3300.00}, but they still refuse to back down from an escrow ask based on an estimation of {$5300.00}. Personally, I consider this to be mob-style theft, as it is money that I am not supposed to owe, that I am being forced to pay, and every attempt at correcting this mistake has been fruitless.

Dear Consumer Financial Protection Bureau, I am writing to dispute the late fees that have been charged to my account by Union Home Mortgage. As a licensed therapist, I am committed to providing therapeutic services to individuals who are in transitional living situations. These late fees have prevented me from accessing the necessary capital to invest in multi-unit family homes that can provide affordable housing for those in need. I entered into a forbearance program with Union Home Mortgage on XX/XX/XXXX, which was later extended to XX/XX/XXXX. Despite being in this program, I have been charged late fees for the following months in XXXX : XXXX, XXXX, XXXX, XXXX, XXXX, and XXXX. These late fees have been reported to the credit reporting agencies and have negatively impacted my credit score. Union Home Mortgage has violated several laws and regulations, including : Violation of the Fair Credit Reporting Act ( FCRA ), specifically USC Title 15, Section 1681s-2 ( a ) and ( b ), which requires furnishers of information to credit reporting agencies to have reasonable procedures in place to ensure the accuracy of the information they provide, and to investigate and correct any inaccuracies that are reported to them. Violation of USC Title 15, Section 1641 ( g ), which requires mortgage servicers to provide borrowers with a notice of any assignment, sale, or transfer of their mortgage loan to another servicer. Violation of USC Title 12, Section 2605 ( k ) ( 1 ) ( A ) ( i ), which requires mortgage servicers to promptly and accurately credit payments made by borrowers. Violation of the Truth in Lending Act ( TILA ), specifically Regulation Z, which requires lenders to provide borrowers with a clear and accurate disclosure of the costs associated with a loan. Violation of the Real Estate Settlement Procedures Act ( RESPA ), specifically Section 1024.41 of Regulation X, which requires mortgage servicers to have reasonable policies and procedures in place to provide borrowers with information and assistance related to loss mitigation options. I am requesting that Union Home Mortgage correct these errors and remove the late fees from my account. I also request that they update my credit report to reflect the accurate status of my account during the forbearance program. Additionally, I request that Union Home Mortgage provide me with a notice of any assignment, sale, or transfer of my mortgage loan in the future, and that they promptly and accurately credit any future payments I make on my account. The removal of these late fees is urgent, as it would enable me to invest in multi-unit family homes and provide affordable housing to those in need. In XX/XX/2020, I received a notice from one of the credit bureaus that I missed a payment on one of my accounts. Upon further investigation, I discovered a forgotten mortgage payment. Once I uncovered this mistake, I promptly submitted a payment. Unfortunately, it was already thirty days late. This is the first and only time I've ever missed a payment. Yet, the incident has had significant ramifications on my livelihood. My credit score dropped by 100 points ove rnight, which had a profoundly negative impact on my business. I immediately called a customer service representative from Union Home Mortgage and asked them to forgive my error based on my excellent payment history. The representative informed me that she could not find any late payments and that some mistake must have been made, which required further investigation. The following month, I disputed the late payment with each major credit bureau, based on my understanding that no late payment was present. In XX/XX/2020, the credit bureaus concluded that the late payment was legitimate and could not be disputed. Once I received this information, I contacted Union Home Mortgage to clarify the conflicting conclusions. The representative informed me that if I sent a goodwill letter, they might remove the late payment at their discretion. In XX/XX/2020, I submitted the letter and told them that I took appropriate actions to ensure this would never happen again. I sent it to every address listed on the company website to be sure it would be received. After multiple weeks with no response, I decided to fax the letter, hoping for a faster resolution. On XX/XX/2020, Union Home Mortgage informed me that they would not forgive my late payment because forgiving late payments goes against their company policy. I have spent the last several months attempting to receive accurate and responsive information from Union Home Mortgage. However, they appear incapable of answering basic questions and giving thoughtful and truthful responses to their customers ' inquiries. I am left with several unanswered questions : ( 1 ) Why would a representative be unable to establish whether a late payment was present on an account? ( 2 ) Why would a representative give advice that runs directly counter to their company 's standard operating procedure? ( 3 ) Why would a mortgage company make late payment forgiveness impossible, no matter the circumstances? ( 4 ) Why should a simple problem, like a late payment, take six months and tens of hours to resolve? I am shocked by the routine lack of professionalism, candor, and care shown by Union Home Mortgage and their agents. Therefore, I am filing this complaint to receive a modicum of closure and gain answers to what can only be described as a disjointed and confusing mess. Closed on home loan XX/XX/2022. Borrowed {$400000.00} of a {$500000.00} purchase. This home was purchased of XXXX XXXX, XXXX, a coal mining company with several disclosures and deed verbiage added. We were failed by our real estate agent who didn't explain to use what these disclosure meant to the future value and ability to sell the property. He failed to educate us on the mine subsidence insurance about since we were releasing the coal mine from liability. The underwriter from the bank should have never allowed this loan to go through. Now we have {$100000.00} plus closing costs into the home, {$75000.00} in renovations performed to the home in the year since purchase and find out the insurance is only {$200000.00} for subsidence in WV. We were out of state buyers. I would have never purchased a home for this price had I known we were going to LOOSE all our investment and it not be worth what we owe on it just 2 years later. There was a planned mining date at closing known to the underwriter and loan team. No one from the bank brought this huge issue to our attention, allowing the loan to go through and us to be soon stuck with a home not worth what we paid or owe on. This isn't about the real estate market, it's about known future damage that was to come. We purchased this home as an investment with intentions to sell in 3-5 years and build on family land 15 mins away. Now we don't know where we are going to live when this house is beyond repairable from mining damage. We were at our max budget to begin with and can't afford to buy another home. This risk of foreclosure on this property is high and were in plain sight ; not to be since I didn't know the subsidence cap. I just can't seem to understand why a bank would loan this amount of money on a property with no rights and known drill date when there wasn't enough insurance coverage to cover damages that are likely to occur leaving us with an huge debt and uninhabitable home potentially. We barely qualified for this home to begin with, how are we suppose to afford repairs? With current costs, it would cost close to {>= $1,000,000} to rebuilt the home, pool, pool house, stone walls, garage and shop. We are talking about 4 structures! Our home has a large, full basement providing a high chance of damage. The exterior is stone and stucco. The structure is over XXXX sqft. There is a large all glass sunroom off the back of the home with basement living under it.

In XXXX of XXXX this company contacted us wanting to refinance our home at a lower interest rate through the VA. After sending paperwork after paperwork to them, they asked for more items which we sent. Then they did the title search. Then they came back and forced us to have our property split due to having 2 homes on 1 property which costs us a lot of money. Then they made us pay for an appraisal to be done out of pocket. The appraiser had to make a 2nd trip out to verify the improvements had been done, again costing us more money. All along the loan officer kept telling us everything was going great and we would be closing soon. Finally in XXXX I said I was going to just go with our local bank as they offered us a lower interest rate. XXXX XXXX XXXX, the loan officer told me not to do that. It was just a trick to get us in there and our loan was about to close anyway. On XXXX I asked what we needed to do to get this loan closed. He stated nothing, it would just be in processing for a few days and we were good to go. XXXX he told me they were waiting on the appraisal and he would call me on the following Monday. As of XXXX I had not heard anything from him so I sent him a text. He wrote back stating we were still all good to go and do not worry. On XXXX he phoned me to say he could not get the loan to go through as the VA had raised their points on the loan and it wouldn't work. I have lost money on the appraisal, I have lost money on the surveyor getting the property split ( that we would not have had to do if he would not have lied to us ). We have lost money filing everything with the courts and the county and the attorney to have the split done. I feel this man lied to us over and over and over. All along knowing there would be no loan and we would be out a couple thousand dollars for nothing. This is wrong and they should not be allowed to do this to innocent people. Complaint against- Union Home Mortgage Year to date they have collected more real estate tax than the bills I have received from City treasures bill. In XXXX they sent a notice stating my escrow account was short. I paid over the amount stated {$900.00}. Then I received a notification that my monthly payment had increased because of my escrow account. My payment was automated. So the next payment was not changed. They held that payment as a partial payment. I tried to go online to pay but they terminated my sign on. I called and was told I could pay by phone. The person said the payment and late fee had gone through. Later I received a letter saying it didnt go through send a check. The XXXX payment was on time and corrected but they took the whole payment stating my escrow account. They then sent me a letter saying I was in default because I had made no payment for that month. I contacted the treasurers office for my city. They sent me a statement laying out what my tax payments are. My original payment with Union Home Mortgage would have paid the whole years taxes. To settle up they said I owed over XXXX. I paid {$7200.00}. I still receive delinquent notices. I was told on one call that they had to recalculate my escrow every few months. As an example : my XX/XX/20 statement is after the 3rd quarter tax payment of {$1200.00} My stated escrow balance is {$2200.00} XXXX XX/XX/20 ). Even at the new rate I received from the treasurers office my taxes will be {$5400.00} for the year. On my latest statement from Union Home Mortgage I have paid {$11000.00}. I have homeowners insurance with XXXX XXXX that I pay monthly. I have a yearly flood insurance that is paid upfront yearly. It is paid. My complaint- they have overcharged me. If there are fees they dont state them. They caused my credit to drop. I have over paid them and I would like a check sent to me. Not applied to principal of the loan.

My wife and I have 3 mortgages with Union Home Mortgage on rental properties. On XX/XX/XXXX we emailed signed requests to remove the escrow from all three properties. We received automated responses with our case numbers. On XX/XX/XXXX we followed up by inquiring through their secure message center. On XX/XX/XXXX we receive a reply that UHM anticipated a 20 day response time for this issue. We receive no such response after this. In early XXXX, we received a letter that said they received our escrow cancellation request for property # 1. The escrow waiver fee was {$130.00}. On XX/XX/XXXX we sent the check for this amount and UHM cashed the check shortly thereafter. However, UHM still did not remove the escrow. On XX/XX/XXXX we inquired again about the status via secure message. On XX/XX/XXXX, UHM responded that they had not received our request to remove an escrow. My original secure message included my incident # for this property from UHM 's automated email response on XX/XX/XXXX. On XX/XX/XXXX, we called UHM to remove the escrow. Around XXXX, we received a letter that the escrow was removed for property # 1. 7 months from the start and 2 months after cashing our escrow removal fee, UHM has finally processed 1 of the 3 properties. As of XX/XX/XXXX, we are still unable to get UHM to remove the escrow on our other 2 properties. More generally, this is not the first issue I have had. UHM 's customer service is a black hole. It is where requests go to die. When forms are mailed to them, they are not processed. When forms are emailed to them, they give you an incident number and nothing happens. When the website 's secure message center is used, the response is that the request is being processed or the forms have not been received ( even though you have an incident number from when you sent the form ). When calling, they either say a form needs to be mailed or only partially process the request.

There are several complaints regarding the servicing of my mortgage with Union Home Mortgage. I am in need of assistance and XXXX has not responded to my requests. Union Home Mortgage provided me a mortgage on a new construction home from XXXX XXXX, which closed on XX/XX/XXXX. In XXXX of XXXX I discussed paying off this loan in full but was notified there was a backdoor deal between Union Home Mortgage and XXXX communities where and escrow hold document ( included ) was created for incomplete work on the home. This escrow document was not shared with me at closing nor were any funds held by the title company as noted on the document. I believe it is required that they disclose all documents related to my mortgage and home purchase prior to closing. On XX/XX/XXXX I began communicating with Union Home Mortgage to get more details about this non-disclosed escrow document and funds which should have been retained for work not completed per my purchase contract. I contacted XXXX XXXX XXXX who stated they were not holding any funds as were referenced on this document. Union Home Mortgage said that no funds were held and if I pay off the mortgage I have no recourse on recovering the funds due or work being completed. I think the Truth In Lending Laws and I have been violated and now that this mortgage has been sold to XXXX XXXX, by not disclosing and recording this appropriately so have they. Having the mortgage company who is associated with the builder hide and not collect funds at closing for incomplete work does not seem legal or ethical. I am now prevented from paying off the mortgage or I would have this liability. Email communications are attached and identify several steps where incorrect information was provided and through my contacting the various parties I have discovered the issue at hand. I think Union Mortgage should be required to obtain the escrow funds back from XXXX communities and held at the title company as designated on the doucment they agreed to without my knowledge.

My current mortgage is with Union Home Mortgage. I started the refinance process with a different company in XXXX. My home insurance is in escrow with Union Home and was due in XXXX. Since Union Home knew I was refinancing and it was not with them, when my home owners insurance came due they did not pay my insurance and did not notify me. I found out a week after the insurance was due when the new mortgage company requested the payoff statement so we could close. Union Home refused to provide them a payoff statement. I contacted Union Home to find out the insurance had not been paid. I went directly to my insurance company and paid the full year premium. Then Union Home provided me with a payoff statement that included a fee of {$4000.00} for XXXX ( forced insurance ) because they said the insurance lapsed. It had not lapsed as I paid it in full one week late since Union had not made the payment. They said I needed to provide the verification of insurance to them. I faxed it to them on the XX/XX/2021 and requested a payoff statement corrected. They said it would take up to 48 hours. I called back after not receiving a payoff statement a week later. They said I never faxed the insurance information. I refaxed the insurance information to two additional numbers they provided again. Union said within 48 hours I'd have the payoff statement. As of this morning ( XX/XX/2021 ), I still do not have the payoff statement. This is not the first major issue I have had with Union Home Mortgage which is why I am desperately trying to get away from the company, but they are preventing me from doing so.

Told that another representative who could address this change would call me back in 2 hours. no call. I called back and was told that this would not change and notice was mailed out on the XXXX. We feel that a simple phone call could have prevented this issue from occurring. we feel they were grossly negligent in their communication practice in such a time sensitive issue. This is a complaint is for Union Home Mortgage company failed to comply and give information on portal about my loan. Back XX/XX/XXXX. I filled out application for state assistance XXXX with XXXX. Which is the state of Michigan. My mortgage company failed to comply with the state. Which they also said they did not receive any emails at all until XX/XX/XXXX. Which XXXX sent an email XX/XX/XXXX which asked questions to my mortgage company in a portal. Which the portal is how they exchange information. The mortgage instead of giving information. Went ahead and ignored the emails and letters sent to them wanting information my mortgage. So since they did this which put XXXX months until someone finally sent over information. The grant was denied because my mortgage company failed and put me over the {$25000.00} cap that XXXX was granting me from the state. Not just that Union Home Mortgage denied my grant and would not take the offer and I even agreed to pay on the rest owed in additional payments to be caught. They wanted the loan to be paid in full. Which they knew I had covid multiple times. Also injured at work and was having hard time with workmans comp on getting surgery on my knee area. Not just being denied by them. My husband and I submitted a XXXX XXXX XXXX in XX/XX/XXXX. On XXXX lender confirmed approval and noted that no additional items were needed and did not suspect any issues for closing in XX/XX/XXXX. On XX/XX/XXXX lender sent final closing document for closing on XX/XX/XXXX. Arrived to closing and the loan was only processed in my name. This was never disclosed to me. Lender could not explain why my husband was omitted. XXXX disclosed that a money gift was given to me by my husband for closing. I was never informed of this document or the money gift. XXXX was having discussions with my husband only and making decisions without my involvement, consent or approval. I would never have approved the loan in my name only. XXXX added my husband to the deed without my consent after electing me to be the financially responsible person for the loan. I immediately brought this to the attention of many execs at the mortgage company. They have no resolution except for offering to refi the loan for me. No accountability, no apology. In fact, they tried to blame me for not managing their employee. Accused me of buyers remorse. Blamed me for not bringing council to my settlement since my loan was " XXXX ''. Made mortgage payment XX/XX/2021 full amount on time via my online bank bill pay. XXXX XXXX XXXX told me they received my payment and then returned it, XXXX XXXX XXXX, by accident and all late fees for XXXX would be dropped because they XXXX XXXXXXXX XXXX shouldn't have returned my payment. However, XXXX 2021 mortgage payment was not returned to my bank account as XXXX claims. I sent XXXX the ID trace # for this missing XXXX 2021 mortgage payment so they could it trace payment all the way back to the federal reserve. I also provided XXXX my bank statement for XXXX 2021 to help XXXX find my XXXX 2021 mortgage payment. XXXX is now saying that they received the payment and that my bank XXXX XXXX XXXX XXXX did not honor the XXXX 2021 mortgage payment and it was returned to my account. XXXX XXXX says this never happened per review of my XXXX 2021 bank statement it shows mortgage payment was received and paid in full. I have disputed XXXX claims and have been unable to get the help I need to resolve this " missing XXXX 2021 mortgage payment '' plus late fees. I would like my payment found and returned to me asap. Union Home Mortgage has not obeyed Cares Act agreement, my forbearance went into effect XX/XX/XXXX I was in current status. I have continued to stay in contact and ask numerous questions regarding my Mortage. I received a packet in XX/XX/XXXX and dropped it in a XXXX return center, I was told by Union home Mortage that they didn't receive it in XXXX and they would send new documents out, and to not worry about anything because I was under forbearance until the end of XX/XX/XXXX. When I didn't receive new documents I became worried and contacted them again and they said they would leave a message for the person I had spoke to. When no one called in XXXX XXXX became more worried about losing home and my family member offered to buy my home. Union Home Mortage called late XX/XX/XXXX and asked if I was selling and I stated I have no choice you never sent me paperwork to sign after you stated you didn't get the first set. Fast forward to XX/XX/XXXX. Union Home Mortage is stating they are now charging me interest, late fees, inspection fees etc because they did not receive my paperwork to come off of forbearance. Although I have emails showing confirmation stating I was in forbearance. Closing is suppose to be coming to complete and I received closing statement, where Union Home Mortage is charging these fees while I was in a government forbearance program.

I opened my loan in XX/XX/XXXX when I closed on my new home. I was told that if I did not use the bank to escrow my taxes I would have to pay a fee. So I let them escrow my taxes. I was told that the additional escrow funds collected at closing could be used to pay interim tax bills. I sent 2 interim tax bills to them in late XXXX. In XX/XX/XXXX, I receieved notices from both agencies with late fees. I called and was told they do not pay interim tax bills. I asked what the procedure was to pay my own taces and get the funds back that were in my escrow account. I had to pay a fee of $ XXXX and fill out some forms. I paid the fee, and a few days later, was approved to pay my own taxes on XX/XX/XXXX. At that time, I was told by Union Home Mortgage that I would receive a check for the {$4700.00} in my escrow account within 30 days. I called last week for an update and was told the check was being mailed by end of week. As of today ( XX/XX/XXXX ), my account still shows that full amount in escrow account meaning the check is not even in process. As our fiat currency currently is being made worthless and banks and lenders are collapsing and creating new businesses to sell to, I can not accept this sale as legally binding. It began due to the pandemic, ( approx. XX/XX/XXXX ) Asked for the forbearance program. Was told to send payment when ready to end the forbearance. Which I did. They held the check for a month and then returned it ( UnionHome Mortgage ). They wanted the entire amount. No way did we have that amount of money. I was on the phone and computer back and forth with them for over a year. Requesting a modification. Just wanted the back payments set the end of our mortgage. They just jerked me around and around. Then we got bills and info from a company XXXX XXXX XXXXXXXX. We sent a payment. They did the same. And denied us a Modification. Next ( XX/XX/XXXX ) thing they sent a letter with information about XXXX XXXX. a debt collector. I have tried to find an agency to help us with the arrearage. Government agency said they don't do that. I've sent a request for help to the XXXX 's office. We have been lied to from the beginning. We had no idea that mortgage companies were crooked like this. We were told we were closing on XX/XX/2019 at XXXX and our lender told my husband that she would contact him 24 hours before with more information. She sent my husband an email on on XX/XX/2019 that said our pre-closing documents were enclosed. We reviewed them and had questions about it because a lot of stuff wasn't marked that we thought should have been. Come to find out we were only sent the pre-closing documents for our second mortgage loan ( down payment ) and nothing on our initial mortgage loan. When we were on the phone with her the night before ( XX/XX/2019 ) we were to close, we had to beg to have anything for us to review. We were able to talk our agent into sending us a draft copy of our first loan closing disclosure at XXXX the night before we were to close. I then finally got a final closing disclosure when I went to the title office the next day at noon after asking the tittle office to print me a copy. Union Home Mortgage offered 3 months with no payment last year after the hurricane. We didn't pay for two months and then restarted payments. In XX/XX/XXXX & XX/XX/XXXX we paid an extra {$160.00} for a total of {$320.00}. In XX/XX/XXXX we received an annual escrow account statement that showed we were due a refund of {$1900.00} for overpayment of escrow but " due to delinquent status ... we will retain your surplus. '' We called Union Home Mortgage numerous times to ask that the surplus they we holding please be applied to to what we owed. We talked to first one person and then another with no answers. One person even suggested this money was put back in our escrow to which I asked why, as it was not needed there. My Loan Servicer ( Union Home Mortgage Corp ) paid my former and terminated previous homeowners insurance company ( XXXX ) with a payment XXXX requested a year after service has been terminated with them. I had refinanced my mortgage back in XX/XX/2020 and changed homeowners insurance to XXXX XXXX. In XX/XX/2020 I asked mortgage company to end my escrow account. I wanted to pay my own property taxes and home owners insurance as for two year they underestimated the cost. Each year my escrow cost increased and I had to pay extra for the shortfall. Mortgage company sent me a letter stating I needed to pay shortfall which I did in XX/XX/2020. I applied to get a loan with XXXX XXXX XXXX at the beginning of the summer XXXX She requested I give to her a picture of my id and a picture of my social security card. She also recommended that I get a new credit card because when I applied my credit did not show on their system. XXXX does not have a license. In XXXX of 2021 I refinanced my VA loan, and Union Home Mortgage became the servicer. In XXXX of 2021 they remitted a payment for my property insurance from the Escrow account for {$2100.00}. In XXXX of 2021 they again remitted a payment for my property insurance for {$2200.00}. In XXXX of 2021 I was notified of an Escrow analysis that expected me to pay {$3500.00} up front or an increased monthly payment my {$400.00} due to an Escrow deficit. The only deficit is from Union Home Mortgage negligently mishandling my Escrow account, and now they expect me to pay a higher monthly payment as a result. I have put back the refund provided to me by my insurance company for the additional payment, but Union Home Mortgage still expects me to pay the errantly higher payment until they can do another Escrow review. This is an unsavory business practice where I pay for their incompetence.

For ten days I have been trying to get modification doucemnts from Union Home Mortgage. The first time they said would take about 48 hours to be email. Nothing happened within this time frame. I called back and it was stated the request was never put in. This has been going back forth for 10 days. It has to be requested and then I was told it could not be email. I gave them a fax number to fax it to and still they are saying it will take 48 hours for the request to go through. Today X/XX/2017 I called again trying to get the documents and was informed of the soame 48 hours request to be sent. Union Home Mortgage, actually using XXXX XXXX, IN branch has been delaying my mortgage process without excuses of me turning back the little or almost nothing they had to request me because I gave them more than they needed. I had have to extend contract with seller twice because since XX/XX/2020. The case has been in underwriting department for around a month and still is not going to USDA. In XXXX of 2019 I received a second letter that our escow account were again short and we need to another {$600.00} on and {$500.00} on the other. After discussing this issue with them I discovered 90 % percent of the amount they are requesting is going into a cushion fund. I sold my house and closed on XXXX XXXX with my loan paid in full by XXXX XXXX. I had updated my address both online and over the phone before closing. After not receiving an escrow refund, I called the mortgage company to inquire about the refund. The mortgage company told me that they had sent the check to the address that was just closed on. They then cancelled the current check and started a work order for a new check. They stated that the new check would be mailed by XX/XX/XXXX. My most recent mortgage statement reflects a {$5.00} charge on XX/XX/XXXX for a Payoff Rush Handling Fee. I did not request a payoff quote on XX/XX/XXXX or any other day. I called the customer service number on my statement. The representative from the services said the request came through their automated system for someone with a phone number with area code XXXX. I have contacted Union Home Mortgage multiple times since they purchased my mortgage from XXXXXXXX XXXX UHM is holding the payments which I have made in suspension. The payments are not being applied to my mortgage. I have had my mortgage for 8 years with no issues. I have asked to them to correct the issue and the claim will but I have not. They claim the issue is caused my having filed bankruptcy in 2020. This is a lie, XXXX never had this issue. Something happened during the refinance process on my mortgage. My payments were as they promised for XXXX year. Then I was told that the loan was {$1800.00} short in the escrow, and had been since the refinance. It's made the mortgage payments much bigger to catch up with the shortage, resulting in late payments and additional fees. On XX/XX/2023, I enrolled into automatic payment of my mortgage. I was going out of town, and was ensured by the UNION HOME representative that they would do automatic payments from my checking account which I had enough money for withdrawing these payments. I have autodraft setup to pay my mortgage. The company stopped by my autodraft because the payment changed by {$7.00}. They sent me several letters regarding the change and missed payment but they were delayed because I am currently working at the XXXX XXXX in XXXX. My Union Home mortgage escrow payment has been incorrect for two months. I submitted a request to have this reevaluated on XX/XX/2019 and was provided an incident number XXXX.
