Re : Umpqua Bank, XXXX XXXX XXXXXXXX and its XXXX application for customer use through the bank and which is linked to our checking account. In XXXX or 2021, I filled out a form to get authorization from Umpqua Bank to send more than {$300.00} per day via the XXXX app which is available for use from within my checking account. They approved me for {$1000.00} per day. In XX/XX/2021 I tried to make {$1000.00} transaction as payment to a contractor and it was rejected. I called into the branch about it, but my call got routed to customer service where a person told me that even though I am approved for sending {$1000.00} per day, anytime I needed to send over {$300.00}, I needed to contact him at XXXX customer service for preapprove of the transaction. I complained about it, because I needed to get the payment to the contractor immediately and XXXX could do that for me and that is why I chose to use it. The branch manager said there was nothing she could do to help so I spoke with XXXX XXXX the district manager. He offered to send me a cahiers check via overnight mail so the contractor had to wait a day instead of getting his payment in minutes as I had originally told him would happen. On XX/XX/XXXX, I tried sending {$1000.00}. I tried 4 times, it was rejected all 4 times, so I called the branch but the phone call was rerouted to customer service. I told the person that I forgot I was supposed to call in first to get the preapproval from the department which puts the transactions through. Then I asked to speak with the transaction guy. The customer service person did not know what I was talking about but offered to look into the situation herself. I waited while she searched and then she did not know, so I was transferred to another person and retold my story after they identified me again, she also checked while I waited. That person said, it was because my transaction was flagged as fraudulent and that is why it won't go through. I said okay but now you have spoken to me and I'm telling you its not fraud can you release it so that I can pay the contractor? She said she could not but that I needed to be transferred back to the branch and they could help me. So XXXX answered the phone at the branch, and verified me and I asked for the manager but the manager was on another call and couldn't help me, so I asked to leave a message but XXXX insisted I tell her what's happening, so she verified me and then I told my story again. She said she could fix it by talking to the back office guy who can put the transaction through. She called me back about an hour later to say that the guy was going to approve one of the 4 transactions which I tried to do earlier and it will be sent to the contractor by the end of the day. Sadly, it wasn't, so on XX/XX/XXXX, which was a Friday, I called the branch back but I got the answering machine. I left a message saying that I was told the transaction would go through by end of day yesterday and it didn't and could someone please call me back. Hours passed and no one called, so I called XXXX, the district manager, again, but he wasn't available so I left a message. He didn't call me back either and by this time it was closing time. By this time, the contractor had been waiting for two days for a transaction which should have taken only minutes. Then I waited the weekend and now the contractor had waited 4 days for his payment and on Monday, XX/XX/XXXX, the contractor called to inquire about it. So, I called the Umpqua Bank headquarters help line. I was verified and told my story again. She said she would look into it and call me back but she didn't. The next day, XX/XX/XXXX, someone named XXXX called me from the customer service dept and left a message which asked me to call him back, but, he did not leave a number. So I called the branch but reached customer service instead and got verified and retold my story, and asked for XXXX, they didn't know who XXXX was but after sometime located him, so I got verified again and he told me that he was checking my account. Then he said the reason for the problem is because the contractors ' name ( which is XXXX XXXX ) is on the OSAC list. So I said okay can you please fix it and send the transaction through? He said he could not. So I said what it the XXXX list anyway and why was the contractors name on it? He didn't know so I asked for a supervisor. XXXX got on the line and verified me and I told my story again, then she proceeded to tell me the same thing as XXXX. I asked her what did my contractor living in XXXX Ca. have to do with a list for overseas potential XXXX fraudulent transactions? I also told her that we both live in XXXX and the transaction was going to XXXX. XXXX didn't know any answers but she wanted me to fill out a form so that she could submit to get approval and she explained that after submission of the form, eventually possibly a few days time there would be an answer. So I then asked well then why didn't all or any of the people I spoke with previously tell me about this list so I could have done this five days ago and by now my contractor would possibly have been paid? She didn't know. So I asked for a manager and waited again for some time and then XXXX, the customer service resource center manager, took my call and verified me again and then I had to retell my story again and I added that I had tried to send {$300.00} over the weekend and it too was denied. So I ended up sending the payment to the contractor using XXXX but then I had to pay {$49.00} so that he could receive the money. So she said the same as XXXX and XXXX she didn't know why and couldn't do anything to help, but added that my XXXX account was presently frozen and it will take about 3 days for it to be unfrozen. I told her that XXXX days had already passed since my first transaction was denied but that it is still not working. She said she didn't know why and would have to speak with the back office guy and so I should expect to wait about 3 more days before I will work again. I told her, well thanks but I didn't need to send the money any more because I already sent it via XXXX and had incurred fees of {$49.00} and I wanted to be reimbursed for that. She then explained that she will not reimburse me because it was not a bank error. I told her that was just wrong and I asked her if all the frustration and time I wasted asking for help with this was nothing? I then asked her for a letter explaining all that happened and how they handled it. She said she could not but would ask for permission but that I shouldn't get my hopes up. A little later the branch manager called to say that she heard about the situation and is sorry she can not help me. I asked why no one called me back on Friday to say that the payment they promised would go through by end of day didn't go through. I also asked why didn't someone tell me about the form to clear the XXXX list so that I had the option to fill it out on the first day? She didn't know but she thought it might have been something wrong with my phone because she tried to call me about 3 times before reaching me and I didn't answer and my voicemail was full so she couldn't leave a message. I checked my recent calls list and her number was not there at all and I checked my voicemail and it was not full. She insisted that she called me and then said my phone must not be working properly so that's maybe why on Friday someone couldn't reach me. I said there were other ways to message me if not by phone and I asked her if she knew that I had an XXXX app on my phone and she could have left me a message there and that she could also have sent me a message through the mobile banking app. She said that was a good idea for the future but that it probably won't work because as an example, if she wanted to send me a message at that very moment while we were speaking, she could not, because XXXX was not there and XXXX is not always there and so because she was dependent on XXXX being there to send messages through the XXXX app, she probably would not have been able to send me a message using it. I asked her to reimburse my {$49.00} and she said she could not. I asked her for a letter explaining what had happened but she didn't think she could and would have to ask about it. I asked to speak with XXXX and told her he did not call me back. Later on the same day, XXXX the district manager called me back and said he would have to look into what really happened and get back to me before he could write any type of letter. However, he wanted to know why couldn't I just use a check to pay the contractor instead of using XXXX? I explained that no one uses checks anymore and that I don't have any checks and that I needed to get the payment to the contractor right away and that's why I used the XXXX option. So, he didn't ask to see if I agreed or not but decided on his own that the answer to this problem is that he would have the branch create and send me about 10 checks so that I can use them next time.

I opened an Umpqua business account in XX/XX/XXXX. I use the account very infrequently as my business was just getting established. In spring of XX/XX/XXXX, after two projects closed, I let my balance decline to an amount sufficient to cover a recurring XXXX XXXX XXXX XXXX payment while looking for new business. In early XX/XX/XXXX, I made a deposit. Later that month, our family moved my daughter into her first apartment, we moved our home, and our business office suite . While our home office materials were being unpacked in new locations, I used the XXXX XXXX XXXX XXXX branch tellers to check my balance at least 2-3 times - I did not have access to a computer. Knowing my balance was low, I used my business card very infrequently during this period. I also made deposits for my husband into his Umpqua business account at the XXXX branch, and while I was in the branch, I checked my business balance with one of the tellers. During the month of mid-XX/XX/XXXX and XX/XX/XXXX the same teller verified I had over {$100.00} at least twice. I specifically remember having a conversation with the teller about my business. I handed him my business debit card and asked if he would do a balance inquiry. At least twice, maybe three times during the month of XX/XX/XXXX and XX/XX/XXXX, the same teller confirmed my balance - I remember a conversation we had about my business and chuckled to myself when he asked me the same question about my business on two separate occasions. Unfortunately, sometime during this period, we think my daughter or my husband might have mistakenly used my business account when signing us up for a family XXXX account. Our Umpqua cards are all orange and look alike when you are inside the app. I know I used the card very infrequently maybe one business purchase to change my WA State Business License address and maybe some equipment to fix my computer at the XXXX XXXX XXXX store, but because my account has been closed, I have no idea what the charges are that took us into the negative, or if they are even ours. They could be fraud for all I know! On Tuesday, XX/XX/XXXX, I made a {$4100.00} deposit into my husbands business account XXXX XXXX. The same teller again confirmed I had {$100.00} in my business account. On Wednesday, XX/XX/XXXX, my husband stopped by the XXXX XXXX branch to make a deposit into my business account because I had an insurance renewal payment of {$360.00} coming up. Again, the XXXX XXXX teller told my husband, your balance is {$100.00}. But, after taking a second look, she asked another teller to help her and said, this account is closed and we cant tell you anything else. My husband called me at home, handed the phone to the teller and she explained that my account was {$900.00} or so in the negative and was closed and that I had to come into the branch to discuss a repayment plan. The next day, Thursday, XX/XX/XXXX, I went to the XXXX XXXX branch and talked to XXXX XXXX, Store Manager. I explained that I had no idea my account was in the negative and that I had texts between my husband and I throughout the month where he and I talk about the amounts of deposits I made for his business account and the conversations I had with the XXXX XXXX XXXX teller about my balance. XXXX agreed to do some research, said he would talk to the XXXX XXXX XXXX teller, and said he would get back to me with the results. I left XXXX 1-2 voice mails before finally getting him on the phone on XX/XX/XXXX. XXXX said he would refund {$40.00} ( out of {$600.00}! ) of overdraft charges and that I should call the overdraft department to discuss the remainder of the fees. That same day I called the overdraft department to find out that instead of us having the opportunity to come to an agreement about the overdraft charges, or even give me an opportunity to review the charges, while I was waiting for XXXX to return my call, my account was sent to a collection agency. I was very frustrated by this time, and I asked Abner to forward my information to a Supervisor. I spoke to XXXX XXXX, the Community Manager a few days later who also agreed to do some research and get back to me. I called her 3 times and waited for over a week for her to return my call. When she returned my call, I learned she had not followed up on any of the information I had provided her. She simply repeated herself and XXXX and said, " you have a responsibility to know the balance in your account '' and said she would refund {$80.00} in overdraft fees. And, she said they had stayed in constant contact with me which felt like a very disingenuous thing to say to a customer after receiving very delayed call backs. After a heated exchange, she agreed to again follow up on the details I provided, the date of the deposit and what happened, and said she would call me on Monday. I asked her to investigate 3 simple questions : Why had I been told at least twice my account had {$100.00} in it? Why was my account closed and sent to collections while I waited for them to investigate? Why didnt I receive any overdraft notices via email or mail during this period? Instead of receiving a return call from XXXX, on Monday, XX/XX/XXXX, I received a call from XXXX XXXX, the XXXX Store Manager, who began our conversation by asking me, Where did you leave it with XXXX? So, again, I started the story over from the beginning. I repeated the exact same story I had explained to 2 other people since XX/XX/XXXX. I provided dates, times, amount of deposit, and even a description of the teller. This time, XXXX said he looked into the situation and shared that he didnt think it was possible for the teller to provide me a wrong balance because his tellers know what they are doing. He didnt have a response for why I didnt receive overdraft notices by email or mail. But he said that I should have received a statement in early XX/XX/XXXX notifying me my account had gone into the negative. I did not. Basically, no one I spoke to accepted any accountability for the teller providing inaccurate information, had no explanation for the lack of overdraft notices, offered little concession for nearly {$600.00} in overdraft fees, and while I waited for them to " investigate '', my account was closed and sent to collections. And now because of their repeated delays, my credit has been affected. In summary : My account went into the negative by mistake I have no problem paying for the charges we incurred, and if given an opportunity to review them and can confirm they are ours, we will pay them At the time, we had no idea the account had been overdrawn, if we had received any notice in the mail or by email, we would have acted immediately During the period of time the account went into the negative, I checked my balance with the same teller at the XXXX branch 2 or 3 times and was given inaccurate information I utilized the resources Umpqua provides believing them to be accurate The Store Manager, XXXX, waited two weeks to investigate and respond to me during this time, my account was sent to a collection agency The collection agency is calling me 6x per day, every single day sinceXX/XX/XXXX The Community Manager, XXXX, repeated herself, its your responsibility waited a week to respond, said No one at XXXX remembers you after not following up on the detail I had given her ( date and time and amount of the deposit, teller description, location ) The XXXX Store Manager, XXXX, denied the possibility the teller could have made a mistake In spite of XXXX and XXXX telling me that its impossible, and that tellers would never give my husband information on my account, 2 QA tellers made the EXACT same mistake as the XXXX teller with my husband days later, and said, you have {$100.00} in this account All in all, this was the worst customer service experience I have ever had. All three of these employees treated me like I was unworthy of respect throughout. This experience gave me some insight into what poor people likely have to deal with all the time. I am not one whose account is commonly overdrawn, so the experience was new. But, if this is the way their employees treat people who are having money problems, they should be retrained in communicating empathy while on the phone. Their tone was largely condescending, their comments were repetitive, its your responsibility and not one acknowledged the possibility that the bank might have made a mistake or the teller could have contributed to the confusion. And while I waited, they sent my account to collections without so much as a phone call.

A year ago last XX/XX/XXXX I moved from Oregon to Texas for health reasons. Unfortunately my health did not improve. My previous caregiver in Oregon hired a woman to help me here in Texas. She began working for me on Mothers Day XXXX. She mainly purchased groceries and other essentials. She suggested we used a XXXX XXXX to pay her wages and she helped me set it up. Later on when I looked at my bank statements she was using the XXXX XXXX to pay herself large amounts of money. She booked XXXX 's for me using my email. She began making unauthorized withdrawals of my debit account in XX/XX/XXXX. She also was receiving my mail which was being forwarded to her by my caregiver in Oregon. By the end of XXXX I checked my balance and it had gone to half of what it was in XXXX. I called the Texas caregiver and told her about my balance and she didn't have anything to say. By the end of XXXX my account was down XXXX. I know I had not spent this much money. Then on the XXXX of XXXX I got very sick and had to go in the hospital for 10 days. A friend from Oregon came down to help out. I told him about my suspicions regarding my debit card and he suggested I call the bank to get some bank statements. I called the branch manager of Umpqua Bank in XXXX, Oregon. He emailed me XXXX through XXXX 's transcripts around the middle of XXXX. Because of my health recovery I wasn't able to look at them until towards the end of the month. I was stunned to see she was somehow using the XXXX XXXX to take extra money for herself. This XXXX XXXX was set up for me to pay her wages only. Then she began using the debit card for any where from XXXX to XXXX XXXX dollars a month. These transactions are all documented on statements from the bank. On XX/XX/XXXX I called the branch manager in XXXX and told him what I had discovered. He said, " I will freeze the account immediately and chop the card. '' About XXXX week to XXXX days later I had a question for him. I called him and was somehow rerouted to another branch in XXXX, Oregon. The woman who answered said she could probably help. She brought up my account and said, " this account is active and the card has not been deactivated. '' At that point she said, " I have to freeze the account and chop the card. '' She transferred me to the XXXX branch and I spoke to the manager. I was angry. I told him what she had said that the card was active and his only response was, " I don't know how that happened. '' He would not address the situation any further. I was extremely agitated. At that point I began the long struggle of trying to get access to my funds. The manager said that I had to have a bank account in XXXX in order for him to send my remaining funds. My rent was due and very begrudgingly he sent me a cashiers check for XXXX XXXX dollars. My Oregon state ID and my SS card had disappeared so I had to accumulate new ID which took a long time. Thankfully my friend had ID and was able to cash a cashiers check for me. I talked to the woman at the bank where we cashed the check and she said it sounded like this " caregiver '' had my information very early on even before she was using my debit card for groceries. On XX/XX/XXXX I called the XXXX XXXX XXXX Police to file a complaint. A XXXX came to the house he looked at the transcripts from the emails and took some pictures. I received another cashiers check for XXXX XXXX dollars and after that was spent on housing I had to call the bank for more money. I was denied. I told them I would be broke in a week. I had two nights left of lodging. The third day I became homeless. A caregiver helping me for no pay was told to take me to the XXXX Police XXXX which she did. I was given some peanut butter and some canned food with no can opener. I was driven to a motel which was filthy dirty with dust and moldy things that make me very sick. I lived on the peanut butter for two days. The motel was filled with drug dealers and addicts and I was told not to speak to anyone. Someone called Adult Protective Services and they agreed to pay my rent there for XXXX days. I had no way to do laundry and no money to buy food. My friend had returned to Oregon and he would send me money so that I could eat at XXXX 's across XXXX XXXX. I had accumulated my ID. A woman from a local Church took me to the XXXX to get my Texas State ID. By the first week of XXXX I received the XXXX XXXX dollars remaining in my account. I had stayed in touch with the Lieutenant and he kept me up to date on the investigation. He requested the bank send him the statements from XXXX through XX/XX/XXXX. He went over the statements and found XXXX XXXX XXXX dollars had been stolen. I had to return to the motel as it was all I could afford. I received the news that same month in XXXX of XXXX that this " caregiver '' had been arrested for theft.

On XX/XX/XXXX I received a mailed notice from Umpqua bank stating that my account was overdrawn. Since my son and I also share an account I wanted to contact him to see if this was his account. After he contacted me and stated his account was not overdrawn. On XX/XX/XXXX I went to my local Umpqua brank in XXXX Ca. Since I had an account there with {$500.00} that I did not use I felt I may have been the victim of theft. I spoke to XXXX who informed me that my account had been overdrawn I told her I did not use that account so it may have been hacked. XXXX went on to tell me that monthly service fees drained my account. I explained that when I set up this account the branch manager XXXX XXXX, stated that if I keep this account with a {$500.00} balance and have paperless billing no fees would be charged. I do not use this account so I did not look at my account on line. I was happy with the construction loan I had with Umpqua so I wanted to keep this account open. I THOUGHT MY MONEY WAS SAFE. On XX/XX/XXXX, I received message from XXXX to discuss fees and account. On XX/XX/XXXX I went to the XXXX branch again to check status and to again inform them that I was not happy with the issue I was told that they would clear overdrawn account and close. I was not happy with results and wanted to have manager contact me. I was informed a manager would contact me. On XX/XX/XXXX, I was contacted and told that they would look into situation since my account was being charged for many years the product may have changed and then affected my account. I stated that if account product changed I would have done whatever I needed to do to avoid service fees. On XX/XX/XXXX I spoke to XXXX store manager of XXXX. He stated fee structure and loss of time that compromised reimbursement May look to have other stores help. On XX/XX/XXXX I received mess from manager XXXX who stated reached out regarding checking account and service fees refund. Was told that they do not want to reverse fees and offered number of his manager XXXX @ XXXX/XXXX-XXXX to escalate request. On XX/XX/XXXX and XX/XX/XXXX, I left messages with XXXX to resolve issues with no calls back. On XX/XX/XXXX I reached out to Umpqua customer service sending an email with the above information. On XX/XX/XXXX XXXX with customer service emailed me back stating that she had forwarded my email to upper management so they could take a closer look at my account and would be following up with my supervisor to ensure I am contacted. On XX/XX/XXXX I was contacted by XXXX she was so incredibly rude after I told her of my story with the bank and what happened to my account. She stated that it is my responsibility to look at bank statement online. I informed her that I did not use that account and thought my account was safe. I told her she was providing poor customer service and asked why she thinks she can treat people so poorly. with that she said " You can go and complain about me '' She ended the call stating this is years old but she would see if she could do anything. asked what I wanted and I told her that my fees be reversed. She acted like I was unreasonable not taking any responsibility for this issue. On XX/XX/XXXX, I received call back from XXXX. I have left several messages with no response. It has been over a year and I have never received a written response from Umpqua Bank and I am very unhappy with the unprofessional and unacceptable treatment that XXXX responded with. I know that Umpqua would not be happy with her being any face of their bank. On XX/XX/XXXX, made complaint with XXXX XXXX XXXX. On XX/XX/XXXX, received letter from XXXX XXXX from Umpqua bank. Where they refused reimbursement. No enclosed statements were attached. I have not used this account. Only time this may have been used was when I opened up my son XXXX account they needed {$100.00} to open and I said I could write a check but since I had account they stated could transfer. At that time I assumed since they stated that product I had a bank was ok and I was not going to be charged fee. Bank person may have not understood my product. I did not question. But I am not sure this happened. Only thing I can think of.

Our mortgage bank-servicer is collecting {$250.00} monthly for property taxes and hazard insurance escrow, but only crediting between {$77.00} and $ XXXX monthly to the escrow account. The Bank-Servicer has refused to respond to XXXX written requests for error resolution or explanatory information. We do n't know if this is negligence, fraud, or a misunderstanding. These facts, however, are indisputable : - Our mortgage requires a monthly payment of {$2100.00} : {$1800.00} principal & interest and {$250.00} escrow. The Bank-Servicer website says, however, that our " Total Scheduled Payment '' is {$1900.00}. {$180.00} less than actually paid. - Between XX/XX/XXXX, and XX/XX/XXXX, we made XXXX payments of {$250.00} to the escrow. The Bank-Servicer website for the same period shows that the amount credited monthly to the escrow was usually between {$77.00} to {$96.00}, a difference of {$180.00} each month. ( Website : 1 ) correct amount of {$250.00} in XXXX, XXXX, and XX/XX/XXXX ; 2 ) {$77.00} for next 12 months ; and 3 ) {$96.00} for last 2 months. ) - The Bank-Servicer website shows monthly credits of {$180.00} to " Principal curtailment. '' We never asked or agreed to redirect escrow payments to reduce the loan principal. -The total we have paid into the escrow is {$5900.00}. The Bank-Servicer paid {$180.00} for property tax in XX/XX/XXXX, and none in XX/XX/XXXX. ( County Treasurer confirmed payment, but says it was n't due ; we paid the XX/XX/XXXX property taxes. ) The correct escrow balance should be the undisputed amount paid in {$5900.00}, minus the only amount paid out, {$180.00}, for a total of {$5700.00} The Bank-Servicer website says, however, that the current balance in escrow is {$480.00}, a difference of {$5200.00}. - We wrote Bank-Servicer XXXX times ( XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX ) requesting error resolution and information. The Bank-Servicer has ignored each letter and each request. -Over four weeks ago, on XX/XX/XXXX, a person identifying herself as being from the Bank-Servicer called us and said that we would shortly receive a written response to our letters. None came. From the call, however, there can be no doubt that the Bank-Servicer has received our letters, and that its failure to respond has been knowing, deliberate, and willful. The bank is Sterling Bank, part of Umpqua Holding Corp ( Umpqua ) ; the servicer is XXXX XXXX ( XXXX ). Sterling, Umpqua, and XXXX are collectively referred to herein as Bank-Servicer. Neither Umpqua or XXXX are mentioned in the closing documents establishing the escrow. This information was obtained from the bank 's website. We never received the required notice of transfer of servicing ( XXXX ), nor an annual escrow account statement ( XXXX ) ; thus we do n't know if these are a single entity or about their interrelationship. XXXX notices requesting error resolution and information were mailed to the address required in the mortgage documents and listed on the Sterling-Umpqua Bank website : that is, XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX, IL XXXX. Resolving the missing escrow funds and explaining the likely redirection to " principal curtailment '' would seem the intent of timely error resolution ( XXXX ) and information requests ( XXXX ). This Bank-Servicer, however, refuses to respond and obey CFBP requirements. The Bank-Servicer 's conduct has violated these sections of XXXX XXXX XXXX XXXX : 1 ) XXXX ; 2 ) XXXX ; 3 ) XXXX ; and 4 ) XXXX. The attached documents show the following payments, credits, and balances. I bought what was supposed to be my retirement home in XXXX XXXX. It has a main house and a small guest cottage. About a month after XXXX we discovered the house had XXXX mold in the kitchen, master bath and several other areas. I had a home inspection and the home was cleared for section XXXX. I reported the issue to the XXXX XXXX XXXX and they ended up taking the company, XXXX XXXX owned by XXXX XXXX to the XXXX as they had defrauded and were on probation for with the XXXX XXXX XXXX for doing the same cover up to another homebuyer two years prior to doing this to me. The XXXX ordered them to pay me $ XXXX in restitution, revoked their license and put the owner on probation. I recently collected the restitution funds from their insurance company as XXXX had not kept in contact with the XXXX and was out of compliance with them I also filed against their bond for $ XXXX. The bond company is denying my request as they said the required restitution is $ XXXX even though there is documentation my loss is much more than $ XXXX. In XXXX XXXX I refinanced the home with Umpqua Bank to include a $ XXXX construction loan. The entire loan is a first loan. I used $ XXXX of the loan and due to the extensive mold and structural damage to the home it will cost another $ XXXX minimum to make the main house habitable. I stopped making payments on the house in XXXX XXXX. In XXXX XXXX I applied for a loan modification with Umpqua. I also applied to the XXXX and XXXX programs. XXXX denied my application saying I am not living in the house. My legal residence is the property. I ca n't live in the main house due to the mold so am living in the guest cottage. XXXX has not been able to offer any help. Umpqua Bank has denied my modification request. I sent them pictures of the house. There is no kitchen or master bath and about half the Sheetrock is out. It needs another $ XXXX in mold remediation before work can even begin on the rebuilding. Umpqua Bank said they do not do appraisals on a modification request so they would not lower the mortgage. They will not lower the interest rate or add the payments due to the end of the loan. Umpqua told me verbally I now have too much debt to qualify for a refinance. I have accumulated some debt due to the problems with the house. I can use some of the restitution funds to pay down the debt. My father has offered me $ XXXX to fix the house if I can get a loan modification. Umpqua sent me the denial letter XXXX/XXXX/XXXX. I emailed them a request to appeal the modification denial. I found out from XXXX today I need to mail the appeal letter and I will mail it today. Umpqua Bank has not returned numerous calls and emails from XXXX to discuss the situation. I was told XXXX can assist in lowering the mortgage balance and that I qualify for the program as I applied for the loan modification before the XXXX/XXXX/XXXX cut off date. The real estate brokers involved would not meet for mediation to discuss the XXXX mold problem. The listing broker, XXXX XXXX of XXXX XXXX XXXX sued me for fraud on the sales contract that was written up by their broker and my broker on CAR sales forms and reviewed and OK 'd by a real estate lawyer I hired to oversee the transaction. My broker, XXXX XXXX then of XXXX XXXX, refused to come to mediation and yelled at me on the phone saying I was causing her a problem! She had also advised me not to get a mold test when I noticed a musty odor under the stairs before XXXX. I trusted her and I have a witness that heard her say that to me. I need any help I can get. The house was recently listed for a short sale as I do n't want a foreclosure on my credit. I have already lost over $ 125K on this house and would like to keep it if possible as inflation has made the house worth what I have put into it, though at a break even if the house is fixed

I went through a divorce at the time I was an Joint owner on a checking account. I was told the account had been closed by the bank employee. Throughout the discovery process soon realized the account was still open I had just been removed from the account. I looked into the matter further and notice my signature had been forged on an " authorization to delete form ''. I got an attorney to assist with this issues was advised to send a demand letter because of the wrong doing by the bank for not following compliance when verifying signatures. In that demand I requested a dollar amount, I received a denial letter stating that my demand was denied due to several reasons. I then through both email and verbal communication spoke with the attorney handling the case, which an offer of XXXX was initially presented. I did not accept offer. I then got an offer for XXXX I initially was thinking ok but the way they bank made me feel about the case I declined. I explained again the situation and that the denial was indeed not correct. The attorney in the denial letter made a statement that was completely incorrect and false under banking rules. I then proceeded to communicate both again verbally and electronic only to get ignored. I then sent and 2nd demand letter now using the denial letter and reasoning as to why I was denied the amount requested to show based off of the verbiage used by the attorney indeed I should be entitled to that dollar amount but instead of the original amount I lowered it. I gave the attorney 30 days to respond to my letter. I received nothing from the attorney. I then proceeded to call and email asking the attorney if he is no longer over seeing this matter to let me know who is or what I need to do to resolve this matter. I kept trying for weeks with no success in reaching anyone. I then sent an email Tuesday morning letting them know I would be reaching out to the president and other channels and at that point I received a call requesting a face to face meeting. I accepted the short notice and met with the Bank employee. I advised me that he had actually been receiving correspondents the whole time and was fully aware of the situation. He had a piece of paper when some info on it, the only thing I could see was the dollar amount of XXXX. He proceeded to tell me that during the time the account was negative. I reminded him that when I was removed the account did indeed have a positive balance. He then confirmed that yes the account was positive and that he was willing to write me a check for XXXX ( which was the balance at the time of removal ) within XXXX hours if I would accept it. I was also told if I did n't accept that amount I would then be trespassed from the bank. I was shocked that and offer like that would then be followed by a threat. I then start to think why would I be trespassed from an establishment when I was trying to resolve an issue pertaining to me and my signature. I also was now curious because my initial demand letter I was told " I could not have sustained damages give the negative balance that existed '' I am not wanting my initial demand amount. I have tried multiple times to resolve this issue. I had paid an attorney to assist this matter and the time and efforts involved to be completely ignored and then insulted by the extremely low offer followed by a threat. I can provide documentation showing original signature card along with original demand letter followed by the response and then my 2nd demand letter. I was also told the " authorization to delete signer '' was indeed not necessary. I would like to know also if it is not necessary why have it.

Today, XXXX XXXX, XXXX I realized XXXX XXXX had withdrawn two {$5.00} fees for UNDELIVERABLE STATEMENT FEES on XXXX XXXX and XX/XX/XXXX of XXXX. My first complaint is that XXXX XXXX ( XXXX XXXX ), Assistant Vice President, was very insolent and rude. She wouldn't even look or listen to me when I spoke to her. My second complaint is that XXXX XXXX with its faulty system is robbing people with their fees. XXXX dollars for UNDELIVERABLE STATEMENT FEE is a ridiculous amount. My third complaint is that I had on several occasions asked for the address to be updated and it was frustrating that it didn't get done when I first asked. I knew they weren't updating because I kept getting mail with the old address forwarded to me. My fourth complaint is that I had to ask the bank to close and delete my old checking account many times. I would go to the bank in person and ask the clerks to make these changes and they would say it was all taken care of but it wasn't. This ended up costing me money because online banking was set up to the old account with no funds automatically and when my bill pay would hit the lender would end up charging me for not having the money. Today, I stopped by the branch and spoke to clerk, XXXX XXXX, and he explained the fees were charged because the bank tried to deliver my statement and it was returned to sender. I explained to him that I have updated my address with the bank on several occasions and that I didn't understand why the statements couldn't be delivered. I told him that in the past I was charged a MAINTANENCE FEE of {$3.00} in XXXX for the months of XXXX through XXXX for getting paper statements instead of electronic. I'm certain I changed to electronic statements at that point and to support that, I can prove the fees stopped until this year but now with a different name. I also requested a refund for the fees. XXXX was very polite and attentive at all times and said he had to talk to his supervisor about the refunds so I waited for about ten minutes. He returns to say he can only refund one {$5.00} fee and that their system showed one address update that took place in sometime in XXXX and that whoever made the change forgot to click something and the address in my savings account was not updated. Basically, it was a bank error that they didn't update my address and that they weren't sending electronic statements. I ask to see his supervisor. When XXXX XXXX finally came to talk to me, she was completely dismissive. I was trying to explain my situation and she was looking at the screen and started talking to XXXX while I was talking to her. She was not happy to refund me because she insisted I had only recently changed my address and wanted me proof of me changing my address before. She finally decided to give me a refund for {$10.00} and told XXXX in front of me and all the customers to add a note on my profile that if I had future complaints I wouldn't be refunded. In other words, I was black listed because I am rightfully asking the bank to give me back money that is mine. I was not asking for a hand out. This was the first time I asked for a refund for my money at this bank and I was treated with extreme contempt and disdain. XXXX XXXX advertises personal and friendly service, " the kind of bank a customer can take home to meet their parents. The kind of bank that customer can be proud to introduce to all of their friends. '' This is false advertisement and they are trying to steal from their customers.

Umpqua bank has created a process that prevents customers from removing PMI. They slow the process by requiring a letter be sent to a XXXX , however the contents of what needed to be contained in the letter are not available on the website, and the mortgage department we spoke with verbally provided inaccurate information. This not only slowed the process even further, but they claim they did not receive the XXXX inquiry. Upon the XXXX attempt I called Umpqua again. I received the same response when I the XXXX time as I did the XXXX, I requested a description of what information was required in the written PMI removal request. We are still waiting for that response. The left hand is telling the right hand to provide inaccurate information to slow or even prevent this process from happening. We have made significant upgrades to our home, and I am going to hire an independent appraiser as the reviews online only further my concern that Umpqua is purposely making this process difficult because it increases revenue and benefits them solely. We have yet to receive a response from Umpqua after over six months of attempting to remove the PMI on our account. Umpqua also did not pay our home insurance this year, upon receiving a cancellation letter from the insurer, we noticed Umpqua had not paid the bill from our escrow account. Upon reaching out to Umpqua, they had no information, and told us that was not possible. It took us several weeks to find the correct person to help us, and we are still waiting for many return calls we were promised, at the very least an explanation of where they went wrong is required. I ended up cutting a personal check to the insurer to ensure we did not lose our coverage, we worked directly with the insurer and we are still waiting for Umpqua to figure out what went wrong. This affected thousands of customers, but what happens when this happens to someone that did not have XXXX of dollars in reserve, because we are expecting the bank to at the very least to pay on time? It is hard to even be disappointed at this point, we have just come to expect shady business practices and terrible service from this institution. To Whom It May Concern, I XXXX XXXX XXXX called Umpqua on XXXX/XXXX/2015 XXXX PST and once prior to request the removal of PMI from our mortgage account. We have not received a response from our first letter. We want to schedule an appointment with an appraiser immediately. The individual that provided the instructions stated a letter was required, but no other information needed to be contained in this letter. We greatly hope the information provided by your institution is accurate as you have consistently provided inaccurate information in the past. We also reviewed feedback from other Umpqua customers outlining how you have taken advantage of them by forcing customers to use an Umpqua appraiser etc. You are making a lot of people unhappy, and they are not afraid to speak out, it seems you are not held in high esteem in the community. The service my family receives is consistent with these disappointing sentiments unfortunately. This process has only proven to be an antiquated one that provides XXXX benefit to the customer. I have a mortgage for my home through Umpqua Bank. In XX/XX/2020 I decided to pursue refinancing my home to take advantage of much better rates than when I purchased the home ( 3 years ago ). I clicked a link on Umpqua 's mortgage website that stated they would get back to me in 72 hours of requesting contact. Nobody ever got back to me and I pursued refinancing through other banks. During the refinance process I was told by XXXX XXXX mortgage underwriting that Umpqua reported my existing mortgage was in forbearance to credit agencies. Shortly afterward I received a letter in the mail stating that I had been approved for forbearance by Umpqua if I wanted to be in forbearance all I needed to do was fill out, sign and return the form they had mailed me. I did not request, fill out, sign or return that form. I am current on my mortgage, have not been late, will never be late. I still have my job, salary, etc ... yet I was put into forbearance. This brings up many questions. Why did Umpqua put my mortgage into forbearance if I did not request to be in forbearance. Why would they put me in forbearance against my will if I was current with my payments and had no qualifying reasons to be under the CARES Act. Why did they report this to the credit agencies even though I did not request to be in forbearance and was and am current with my mortgage??? I am unable to secure refinancing because of Umpqua 's mistake. I have been told that all the underwriters need is a letter from Umpqua explaining I did not want to be in forbearance and have always been current on my loan. They have so far been unwilling to provide this type of letter to me. Umpqua mentioned other people with mortgages with them had run into the same problem I had and that they had been able to get them resolved. They told me they would be able to take care of this. I sent them an email this morning after receiving a letter from Umpqua and talking to my lender. They let me know they were recording the call and then through the course of the conversation let me know that the letter I need would have to be provided by management and that they weren't sure if/when it could be provided. They promised to call me back this afternoon to follow up. I am now almost out of time on the rate lock I was offered by XXXX. 3.125 % on a 30 year mortgage. I have tried getting this resolved through Umpqua directly now with 5 different phone calls and numerous emails over the course of a 4 week period. Now I feel stuck. Initially it seemed that getting Umpqua 's help to resolve this would take time, but that they'd get it done. Now, after pursuing their help for a month, it seems doubtful they will resolve this at all. I have great credit, low debt to income/equity ratios and have worked hard to achieve both. I have never missed a mortgage payment or been late on payment. I am current and have always been current with my loans. Now I am financially disadvantaged until Umpqua fixes their mistake. I am asking that they fix this mistake before it ends up costing me significantly financially. Do the math on the loan I have with Umpqua today and the interest saved versus a 3.125 % loan. This also seems likely to impact my financial future with loans, insurance and anything that relies on credit worthiness to make a determination. Please fix this Umpqua.

To Whom It May Concern, I am a single mom with an XXXX son with XXXX XXXX As a result of the multiple interruptions from school, numerous XXXX appointments, and general disruptions to my work, I lost my job of a year in XXXX of XXXX. I immediately contacted my mortgage holder, Umpqua Bank, to determine my options. XXXX XXXX, of Umpqua Bank was initially very kind and helpful and advised me to enter into a sixth month forbearance program to allow me to search for work. He advised me to not pay on my mortgage during this time and that once I had a job we would put together a repayment plan. In XXXX of XXXX when I secured a full-time salaried position I attempted multiple times to contact XXXX XXXX and determine what steps I needed to take in order to become current on my mortgage and resume payments. XXXX XXXX was unreachable. At one point I went into my local branch and had them email XXXX XXXX directly. However, I was never able to speak with him directly. Shortly thereafter I learned my file was reassigned to someone named XXXX. She was also very difficult to reach and could only be reached via phone, if at all. Eventually, XXXX informed me that she would work on a mortgage modification plan for me and that if that was not workable she would work on a repayment plan. At no point did she or XXXX XXXX advise me of the amounts I would need to earn in order to qualify for either option. During our phone calls I specifically asked XXXX if I should resume making payments on my loan. She advised me that I should not make payments because she was pursuing a modification. Therefore, relying on her advice, I did not make payments. On XXXX XXXX, XXXX XXXX called me to tell me that she was not able to obtain approval for either a modification or a repayment plan and that they were going to begin foreclosure proceedings. After an extensive conversation I learned there are certain income ratios that they need to meet in order to approve either plan. None of this information was provided to me previously and I was therefore completely taken by surprise and unable to put myself in a position to successfully repay my mortgage. Part of the problem is that the unpaid balance is too high to qualify for a repayment plan. Had I know this would be a factor in being eligible for a repayment plan I would have made at least some payments during the period of forbearance to keep this balance lower. I currently work two jobs and have the capacity to add time to my second job. I feel very strongly that I was given false and misleading information by Umpqua Bank and its representatives and that this information has caused me extreme financial hardship and emotional distress. Umpqua Bank was never transparent about the consequences of a forbearance and never encouraged me to continue making payments in order to ensure I could meet financial requirements for a modification or repayment plan. In fact, they did exactly the opposite in specifically telling me not to continue to make any payments at all. Now I am facing foreclosure of my own and destruction of my credit that I have worked hard to build back to a decent place after a disastrous divorce and resulting bankruptcy. The actions of this institution are unconscionable and can not be in accordance with laws and regulations.

On XX/XX/2021, I ordered two pairs of what were advertised as orthopedic shoes. The definition of orthopedic shoes is understood in the public mind to describe only high-quality footwear that is durable and provides excellent arch, heel and toe support for people with orthopedic conditions that cause pain and require this support to alleviate their suffering. Orthopedic shoes are not chunks of plastic foam with no real insole, a plastic upper, and a ribbon of plastic around the edge where upper meets sole to disguise the shoddy workmanship. Unfortunately that was what I received two pairs of. I have uploaded some photographs of these shoes, that arrived in transparent plastic heat-sealed packages. The shoes and their packaging looked, felt and smelled identical to slippers that can be bought in any XXXX XXXX for under {$3.00}. The quality is as bad as possible, while still presenting a photographable appearance. The materials are almost non-existent, resulting in the shoes having virtually no weight. Objectively, you can see this where I have photographed each of these shoes on a gram scale. Compared with the weight of a genuine orthopedic shoe or sandal, of which I send you two genuine examples, manufactured by The XXXX XXXX and XXXX, these fraudulent XXXX shoes weigh much less than their genuine counterparts. These shoes were shipped to me from California, however, this occurred only after I had exercised my lawful right to cancel for their failure to comply with the FTCs Timely Delivery Rule, when I demanded my money back after they gave me a revised delivery time over 30 days past date of purchase. Suddenly, they managed to send them to me from California, ignoring my lawful, timely demand to cancel the purchase based on their promise of untimely delivery, which was justified by the false statement that the shipment would come from XXXX, XXXX. The XXXX fraudsters " are '' wherever is convenient for them, in their search for a good scam to avoid accepting a single return. ( While the Company promises returns for defective materials, that is exactly what I have presented them with, and they have done nothing but lie and reject my demands for the return of my money. ) Thus, when I discovered the shoddy manufacture of these counterfeit orthopedic shoes, and requested to return them, they advised that even though the shoes had shipped from California to me, I would have to ship them back to XXXX. One would think that, having exchanged in the extensive email dialogue, having documented all of my claims of fraud, that UMPQUA BANK, where I deposit my money would enable a charge-back of this fraudulent purchase. ( See scan of their rejection letter, the last page of the Exhibits. ) UMPQUA BANK appears to value the revenue from their share of this fraudulent transaction over the lawful demands of their depositor. That is the only reason why UMPQUA BANK has decided to let XXXX walk with my money. The agent advised me that he will find the best commercial load for me. In short time he called me and said that they have affordable loan to finance purchase of commercial truck ( XXXX XXXX XXXX ) via XXXX, XXXX. [ Address:XXXX # XXXX WA.XXXX Phone : XXXX, XXXX XXXX. In numerous discussions with broker ( XXXX ), the loan amount is set to total {$20000.00}, pay-off in XXXX months, plus admin. Fee of {$1000.00} and XXXX prepayments of {$1900.00}! I signed the contract having these terms in mind. When they cut check to equipment seller, they changed the contract and the monthly payment amount to $ XXXX month. However, they changed the terms of loan from XXXX to XXXX months. I was not aware of this fact at the time. I was making the payments in this amount on the regular basis, sometimes I was even making higher payments in order to pay off my XXXX faster. In XXXX, I called XXXX, to ask for pay-off ( this was my first inquiry about the payoff ), since monthly statements do not have that information listed on the statement .... The response I got was very shocking- the payoff amount was around {$34000.00}!!! Following are the present facts : I already sent close to {$15000.00} in monthly payments. I borrowed {$20000.00} for a commercial loan ( to purchase my truck ). It appears that overall interest on the loan is over XXXX %, with final payoff amount of {$49000.00}. I spoke with Financial Pacific Leasing numerous times requesting the explanation and stating the misleading facts but I received no explanation from them. The only thing they can say is : YOU SIGNED THE CONTRACT AND YOU ARE LIABLE FOR IT, AS STATED IN THE CONTRACT. I asked about option of offer in compromise and would I have an Equipment Title after I pay that off ... The answer was : You should read what you signed, it is NON TRADITIONAL LOAN, you signed it!!!! My question after then was, " Is this a Loan or a Lease, and what does Non-traditional Loan means? " - the answer was " Read the whole Contract '', no further explanation whatsoever ... My only source, to solve current situation and try to bring my life back to track, is to ask You for your legal help. I believe there are lending standards in this industry ( standards for interests, for loan conditions ... ) and other lending regulations/ terms to protect customers from such predatory lending practices. I understand that many lending institutions are regulated and held to certain standards. I honestly believed that I was dealing with legitimate entities, and that they are bounded by industry regulations. But this contract seems to be against all regulations and standards. ( Sorry to be so late in reporting -- I 've been hoping to resolve the issue with the bank directly. An Umpqua Bank representative told me last week that there 's nothing more that I can do with them, so I 'm writing to you guys. ) Summary : My checkbook was stolen from my car. Fraudsters cashed {$800.00} in bad checks at my home branch bank. Bank says I 'm responsible for that money because it was " negligent '' to leave my checkbook in the car. I say it was negligent for them to cash those checks without calling me, or even bothering to check the ( wildly different ) signature on the check against my real signature. Detail : Late in the evening of XX/XX/XXXX I was looking at my online banking and noticed two large checks I did n't write ( {$500.00} and {$310.00} ) had been cashed against my account that day. ( I never write checks. My checks still have my address from two houses ago. ) I called Umpqua, but they do n't have a line to report check fraud late at night. So, I stayed up all night to be able to report the lost check first thing in the morning. Good thing I did, too because the thieves tried to pass another {$400.00} check that morning. ( Having heard from me, the bank denied that one. ) I immediately filed a police report, closed my account, did all the things you 're supposed to do. After this all went down, everyone at the bank assured me I 'd be reimbursed. They just needed to let the process ploy out with the fraud investigation unit. Several weeks later, an justifiably embarrassed teller from my home branch called to tell me that the fraud unit had denied my claim because I 'd been " negligent '' in leaving my checkbook in the car. They expected me to eat the {$810.00} loss. I would like to point out at this juncture that, had I walked into my home branch with a personal check made out to me for {$800.00}, the bank would not have cashed it that day. They would have put a hold of -- at minimum -- 3 days on that check. It 's understandable that they should do this -- if the check turns out to be hinky and I jet off to XXXX never to be seen again, they 're on the hook for {$800.00}. HOWEVER, if XXXX XXXX walks in with {$800.00} worth of handwritten checks against my account, apparently Umpqua Bank is only too happy to release those funds, no questions asked -- no signature check, no phone call, nothing. The only difference between the two situations is that, in the first, it 's the bank that assumes the risk. In the second, I do. In short, Umpqua seems to be taking better care of their money than their depositors ' money, which is not a good look for a bank, in my opinion. I have no doubt that the low-level grunts at my home branch who cashed the checks followed all of Umpqua 's rules. And I 'm sure that not calling the accountholder, or even taking a minute to go look up the correct signature on an accountholder 's check, saves them labor costs. But if you 're going to cut those corners, you need to take responsibility when things go wrong. Umpqua should refund the {$810.00}.

We had a loan with another bank and had no issues for two years, XXXX XXXX XXXX bought out the bank. Never received any paperwork or any phone calls about the changeover. The first bank ( original bank ) took out a payment on the XX/XX/XXXX of the month and XXXX XXXX XXXX cashed a check and also took out payment through automatic withdrawal. Called the first bank and they apologized and overnighted a check for the mistake. Called XXXX XXXX about the double payment and stated it was a mistake as they were only supposed to cash the check and not do a automatic withdrawal. Only reason we sent them a check was we did not want our payment history disturbed. We pall all of our bills on time and there payment is due the first of the month. The said they would just credit our account for the double payment. I said no, I would like a refund immediately. The rep was kind of nasty and said we would have to fill out a 5 page request and said a letter head from our bank and it could be up to 4 weeks to take place. I decided to go to my bank to dispute the charge and they within 3 days had our charge back in out account. XXXX XXXX then at the leisure decides to withdrawal XXXX 's payment and add a return check fee for there original mistake. Called XXXX XXXX XXXX and asked them why they charged me a return check fee for there mistake and they replied that they had made a mistake and would look into returning the fee. Explained that the agreed amount each month is the legal amount they can take and not what ever they feel necessary. So again I went to my bank and disputed the return check fee. The reversed the charge in 2 business days. XXXX XXXX XXXX wants to now charge me two return check fees. I get a call from a rep and she states I now need to pay a payment but over the phone as she states, the bank will no longer do automatic withdrawal. I replied that's fine as I do not want them having access to my account. I stated I will request a paper statement each month and I will send them a check. The rep stated they will not accept our check, I'm floored, They make the mistake and refuse anything other than a pay by credit card payment. I have called in several times and they continue to say upper management is looking into the two return check fee 's that were clearly stated that they would remove them. Now every time I call in they saw ooh you have outstanding fees with us. Then to top it off they charge me XXXX to process my payment by card, well you don't give me any options to pay other then by card. I still to this day have not received any mailings showing there lending practices or there fee 's in regards to our loan with them. I have even tried setting up a electronic payment on there website and it has me locked out from that. I ask them why and they say I do not qualify for that payment option. This bank is horrific and has the worst customer service.

During that time XXXX XXXX, NMLS Number XXXX, made repeated intimation that the mortgage application had been sent to processing, was processed, and all that was waiting was an appraisal. We waited over 2 months subject to such intimations for an appraiser to arrive. Thousands of dollars of cosmetic work was done to the property. Late XX/XX/XXXX, it was disclosed that XXXX. XXXX XXXX did not ever send the request for an appraisal. Then, it was subsequently disclosed by a party purporting to be XXXX. XXXX XXXX XXXX " supervisor, '' a XXXX. XXXX XXXX, NMLS Number XXXX, that XXXX. XXXX XXXX had n't included XXXX XXXX dollars to XXXX XXXX dollars of oil and gas properties owned by the applicant on the mortgage application, all documented assets owned per XXXX 's, leaving the debt to asset ratio affected, complicating the mortgage application.

During the entire time, the DPOA for the applicant, a political person, one of the largest in the jurisdiction in question, XXXX XXXX, and XXXX XXXX XXXX XXXX, and the applicant 's son, was repeatedly questioned about his business activites, the XXXX XXXX XXXX XXXX, XXXX. XXXX XXXX 's own XXXX XXXX in Montana, or that of her family, along with his associations with the Donald John Trump Leadership Conference and XXXX XXXX XXXX XXXX, and the XXXX XXXX of the United States. When XXXX. XXXX XXXX 's conduct came to light and her supervisor 's contact information was requested, XXXX. XXXX XXXX texted from her private cell phone " She just really wanted to find a solution '' to bar involving her supervisor.

Then, in XX/XX/XXXX, someone at the bank reversed a mortgage payment for reasons yet to be disclosed by the bank, seemingly aiming to damaging the applicant 's mortgage application from a malicious impulse rooted in political animosity along with general personal animosity. After the matter was brought to the bank 's attention -- That respective matter was reversed curing that immediate matter.

At this time, the bank in the person of XXXX XXXX, is refusing to account for his colleague 's conduct, the bank 's politically motivated subversion of a standard mortgage application, and is refusing to account for millions of dollars of assets, real property oil and gas interest, which do not appear on the application as processed by XXXX XXXX to the bank 's mortgage processing division.

The applicant 's DPOA has been threatened by XXXX XXXX, hung-up on, and suggested to go XXXX himself : XXXX. XXXX XXXX acting to serve the interests of his colleague as opposed to interests of the bank and the bank 's client subject to the legal rights and protections of the bank 's client.

Dear Sirs : My son XXXX XXXX is an XXXX in the United States XXXX XXXX. From XX/XX/XXXX to XX/XX/XXXX he was in boot camp in XXXX XXXX TX. As his mother I monitored his financial affairs while he is in boot camp, as the military cadets have no access to anything electronic and have no means of communication outside of their base. On XX/XX/XXXX I noticed that there was a balance transfer pending for {$3000.00} from his account. I immediately contacted the bank and spoke with XXXX advising her to stop/block the action, as it was fraudulent. I explained that my son was in boot camp and had no access to any electronics or communication and with 100 % certainty know that he could not be making the transfer. I was advised by the bank that since it was only pending they were unable to do anything about it until it cleared and I was instructed to call back the next day. The following day I called the bank and they stated that a second transfer was now pending as well. They advise me to take the remaining money out of his account immediately so that the second transfer would fail. I went into the branch and spoke with a banker named XXXX in the XXXX, CA branch, she has been my point of contact since that first day. XXXX opened the account to see that someone had hacked in and changed his account verification phone number to a number in Illinois and they changed his security questions as well. XXXX began the process of opening him a new account and went on to say that they would get the issue submitted to get the transaction reversed right away. Week after week I call in and speak with XXXX, she gives me false information and false promises that she never follows through with, including promises to get her manager involved to get the issue rectified, none of which she has ever done. I even had to call in for several weeks just to get her to complete the opening of my sons new bank account. XXXX makes the same excuses with each phone call and has recently stated that the XXXX department is having a difficult time because they have never seen anything like this before. We are now almost 7 months later and I still have had no resolve. My son worked very hard and saved every penny he earned prior to enlisting in the XXXX XXXX as he knew that as an XXXX he would earn such a small income and he wanted to have sufficient funds saved to live on. Now his money is gone and UMPQUA BANK has done nothing to retrieve it, to make matters even worse they actually charged him a fees for the transfers, they appear to not even care. I have heard that there are many others in my small community with similar types of poor customer service issues with Umpqua and more specifically the XXXX branch. On or around XX/XX/XXXX-18 I filed a transaction dispute with a teller at XXXX XXXX regarding a purchase at XXXX XXXX that was missing items. I explained to the teller that my order was incomplete and after trying to get replacement items from the company through emails for about a month they never sent some of the items I had paid for. I provided some of the emails and a statement to XXXX XXXX at their request for my evidence disputing the charge. On XX/XX/XXXX18 I received a credit from XXXX XXXX for {$180.00} which was the original purchase price at XXXX XXXX. On XX/XX/XXXX18 XXXX XXXX removed my credit of {$180.00} and in a letter umpqua bank stated that " no error had occurred and based on my agreement with the merchant my order had been processed correctly '' This confused me greatly as I thought the information that I provided clearly indicated that I did not receive some of the items I paid for. On XX/XX/XXXX18 I returned to XXXX XXXX to re-file my dispute and even provided more of the emails to show my order was never completely fulfilled. OnXX/XX/XXXX18 I received a 2nd credit of {$180.00} while XXXX XXXX re-investigated my claim. I thought the situation would finally be over, as I could not believe that if someone actually looked at the emails I provided from XXXX XXXX and myself it was clear I never received my complete order. Then it happend. On XX/XX/XXXX18 I received a letter from XXXX XXXX stating that my claim was again denied because " no error had occurred " and they closed my dispute. She told me she would call me back that afternoon and never did. XXXX informed me that the dispute department is a closed department and there is nothing I or anyone can do about the situation as they only allow for one dispute inquiry and once the decision is made its final. XXXX informed me that XXXX XXXX provided a tracking number that I received the package form the merchant on XX/XX/XXXX18 and that was the reason why my dispute was denied. I never claimed that I did not receive a package my contention is that it was missing items. Received an email on XX/XX/2019 from XXXX confirming my order. Found out my former partner used my XXXX account to order some items using his debit card. I called XXXX, changed my password as directed and cancelled the orders I did not place. On XX/XX/2019 I received an email about one of the cancelled orders was shipped to my former partner, after I contacted XXXX about the unauthorized use of my account ( due to shared computer that I could not wipe before being forced from my home on short notice, XXXX XXXX situation ). But was told by Umpqua that this is not fraudulent activity because my former partner had access to my information and I kept payment information in my XXXX account. I do not understand why XXXX is not charging my former partner 's card for this item when it was used to make this purchase, or why a replacement item was sent on XX/XX/XXXX when I cancelled the order 9 days earlier. On XX/XX/2019, received an email from XXXX that my account was being charged for the order cancelled in XXXX because the item was never returned. I called XXXX to try to resolve but was only told that I needed to return the item for a refund. Repeatedly told XXXX to charge the original payment account for the order, not my debit card which was saved in my payment accounts with XXXX and never authorized for this purchase. Contacted Umpqua bank subsequent to this conversation ( appx XX/XX/XXXX ) and was offered provisional credit while this was being investigated. The result of the investigation was a rebuttal from XXXX that my debit account could be charged since the order was made from my XXXX account. I told Umpqua bank the original payment method for this order should have been charged. XXXX sent an email on XX/XX/2019 informing me that a refund was being issued. The refund was issued to my former partner. XXXX charges my debit card The only alternative that Umpqua bank has offered is attempting to work this out with my former partner, and if he does not pay me back for this item, that I need to contact law enforcement and get a police report for the fraudulent use of my debit card. My partner did not use my debit card for the original purchase, so this is not true. If anything, the fraudulent charges are due to the unauthorized charges made to my checking account by XXXX. I " purchased '' equipment financed through a company using Financial Pacific Leasing, XXXX XXXX. I believe they call this " leasing '' to avoid XXXX in XXXX Laws, but a brief review of complaints on XXXX show that they are financing, not leasing equipment, which was my experience. I negotiated a price with the company selling the equipment. They then brought paperwork to my office for me to sign. The price was printed, then crossed out, and I was told that the printed price was an error, but the agreed upon price was corrected ad written in by hand. I was told there was no interest as the financing was arranged through the selling company, which was selling used equipment, so that made sense to me. There was no mention of financing fees or interest in the documents. There were multiple places tro sign, all of which stated I was signing under my company name, not personally financing the equipment, which since it was for my company, also made sense. This is except for XXXX line that was sandwiched between XXXX places saying that I was signing as a member or officer of the company. That one line sandwiched in between stated that I was personally guaranteeing the loan, and they didn't have to come after the company for failure to pay, but would rather come after me personally. Of course, with any financial signing, I was told " sign here, sign here, and sign here ... '' Nothing was stated to me pointing out this one clause deceptively placed in the document. Later in the documents, there is an accounting of the payments and how long the payments will be made. I did not calculate this out as I trusted it would accurately reflect the price I was told I was paying. It did not. It was about 50 % more than what I was told I would be paying ( this is the same complaint as all the other complaints on the XXXX ). Now that I can't pay due to effects on my business of Covid, I am attempting to resolve this, and I am told that I still owe more than I originally agreed to pay, even though I have already paid 50 % of the original agreed amount. XXXX says the additional amount is " interest '', and that the amount I agreed to pay was the amount XXXX agreed to pay for the equipment, not what my cost was. When I asked for copies of the documents they had, they could not furnish me with copies of the document showing the original total amount I was to pay. I have this document, but they tell me this is irrelevant, and that the only amount that matters is the payments I agreed to make. They say they are going to repossess the equipment, but that I will still owe the same amount, and that I personally guaranteed the loan, so they are coming after me and not the company.

Around XXXX we took a loan out wit h Sterling Bank in XXXX Oregon. To make payments, we had to have a checking account with Sterling Ba nk. Each month an auto payment was deposited into the checking account. After that, the money was rolled over into the loan to make payment. Time has passed, Sterling Bank bec ame part of Umpqua Bank. For a few more years, there was no change in the initial process. A while back, I started to note {$3.00} charge for paper statements while I was receiving it electronically as well. I contacted the bank and was not able to resolve that issue. Today XXXX XXXX , XXXX , I got into my account via online but was not able to see any information regarding the checking account or the loan. Therefore I contacted Umpqua Bank. The Umpqua Representative questioned me about identification for security which I gave and understand. Then the representative began to ask me specifics about the account which was why I was calling. My online bank account did not give me any information besides my personal information. She then required that I find a bank statement to provide the information. While getting the bank statement, I found a letter dated XXXX XXXX , XXXX , from Umpqua Bank. The letter ( in part ) said we have noticed you have not used your account for over 24 months. This classifies your account as dormant and therefore subject to a monthly service charge of {$5.00}. At this point, I had my bank statement and asked about the XXXX dollar charge. Th e Umpqua Representative responded that it was a federal law. I explained that it was not dormant because a not all payment went into checking, a transfer occurred to the loan and Umpqua Bank is charging 7.75 % interest on the loan. She explained that if I did not physically do anything with the account, it was therefore dormant. I asked her how this could be in a day when technology allows us to take a picture of a check. There are less and fewer bank consumers doing their banking physically. She continued to deny that the account was active and there are numerous {$3.00} charges as well as who knows how many {$5.00} charges have occurred. At this point, I am being told by the Umpqua Representative that my account is dormant while Umpqua Bank is making roughly {$100.00 } plus dollars and charging an additional {$3.00} along with {$5.00} each month. I find it difficult to believe that this is a law and request assistance.

I started making monthly payments of XXXX from that day. *On XXXX of XXXX I was notified by XXXX that my contract was terminated and not willing to renew, and I contacted Financial Pacific Leasing to know my balance on the account because they never disclose that on the monthly statements ( see attached ) and they told me the balance was so much higher of the original amount financed and said my only option was keep making monthly payments or to pay the sum of all monthly installments in XXXX single unrealistic payment. * Even with that response I 've been paying XXXX a month not using those trucks until XXXX. * On XXXX I called Financial Pacific to inform them I was having difficulties to afford the payment and asked to do something with my balance because by that day I had paid XXXX and I was told that the remaining balance was close to XXXX and the only option was paid the whole amount, this is totally unfair and deceptive. * After many aggressive calls from pacific leasing on XXXX/XXXX/XXXX they send me an addendum setting a new monthly payment of XXXX for the next XXXX months and I told them I was n't able to afford it because I do n't have a contract or use for those trucks ; even that I told the representative might try and when I returned that addendum they said it was to late and I 've to pay the entire amount of XXXX. ( see attached ). * On XXXX XXXX I received by mail a very intimidating letter from " XXXX XXXX '' Attorneys at law requiring the payment of XXXX plus late and attorney fees making me and XXXX XXXX personally responsible instead of my company XXXX. I have had an account with Umpqua Bank for over 10 years now. During that time, the ONLY ACH payment I have had taken out was for a mortgage company. The same payment every month for years. When I opened my statement yesterday ( Sunday ) I saw that Umpqua Bank had honored an ACH payment for XXXX XXXX XXXX XXXX for {$9800.00}! I called Umpqua 's fraud department only to be told 2 hours later that they called XXXX XXXX XXXX and were told that I in fact did have an insurance policy with them and that they had my info. I HAVE NEVER HAD XXXX ANYTHING! Umpqua directed me to XXXX XXXX and provided their number. I spent another 2 hours on the phone with XXXX only for them to tell me what I already knew. I have never had an account with them, and I wasn't anywhere to be found in their system! They said that they only had 4 charges for the amount of {$9800.00} company-wide from XXXX until the end of XXXX All 4 of those transactions were paid for by other customers and none of which used ACH, and none of them had anything to do with me. They told me to call Umpqua Bank back and let them know that it wasn't them that did an ACH on my account. I called Umpqua Bank back to let them know what I had been told by XXXX XXXX. XXXX, the representative with Umpqua Bank told me that yes, there has been a scam going on with companies phishing other known companies and this was happening to their customers accounts by way of ACH withdrawals. This never should have happened to my account! They should have filed a XXXX report. This was definitely a case where this activity is completely out of the ordinary for my account! Any form of irregularity in the spending pattern of the account holder is supposed to trigger a fraud alert. When I mentioned this to XXXX, he said that his department didn't handle that part of it, but that the automated systems in place are what should have caught it. I am beyond upset about this! This is not right! Now I am being told that the fraud department has 10-12 days to research it and that I might get my money back. MIGHT??? I should be given all of it back now and they can finish doing what they need to do to make sure this doesn't happen to another customer. I trusted them with my funds. They never should have honored this fraudulent charge!

I submitted an application to Umpqua Bank for a mortgage XX/XX/XXXX, 2015 and was assigned a closing date of XXXX XXXX. XXXX XXXX was assigned as the mortgage banker. On the application I noticed that my home value was listed as {$320000.00}, where this figure came from I do not know. After the original good faith estimate was sent to me and prior to going forward and pre-paying for the appraisal, I asked XXXX XXXX if there were any issues that I should be concerned about and I was told no, everything was fine. Unbeknownst to me, the terms of the mortgage were based on a 60 % LTV which was exactly the {$190000.00} I needed to pay off my existing mortgage. This was never explained to me until after I was sent a new good faith estimate which required me to pay an additional {$1200.00} because the appraisal came back at {$310000.00}. When I questioned the appraisal, how XXXX of the comps used and my property were valued the same by the appraiser, yet the comp was assessed {$30000.00} less by XXXX XXXX, I received absolutely no reply from any representative at XXXX. ( I sent multiple emails to XXXX XXXX ). The appraiser also did not account for a storage shed that would have increased the value. In addition, although the closing date was originally set for the XXXX of XXXX, XXXX XXXX tried to arrange the closing the week of XXXX XXXX to which I was amenable, but when on XXXX I was not able to meet with the title company, I did not hear anything from XXXX XXXX until XXXX XXXX, after the closing date, despite calling and emailing him several times. Lastly, despite providing proof that my second half taxes had been paid by my existing mortgage holder ( record of funds coming out of my existing escrow account and being disbursed to XXXX XXXX ) I was required to pay an additional {$1300.00} to pay for the taxes. I was assured by XXXX XXXX that these funds would be held in escrow until the payment posted to XXXX XXXX website. That is not what happened! The funds were immediately paid to XXXX XXXX by XXXX XXXX XXXX. After realizing what happened I contacted XXXX XXXX regarding this and he told me that he would contact the title company to have my money returned to me. I have yet to hear from XXXX XXXX or the title company as to a resolution of this issue.

The property in question was originally purchased as a primary domicile in Washington XXXX XXXX XXXX VA loan. The lender, Umpqua bank, escrowed taxes and insurance. I later moved for work, but kept the property as a rental. When the original policy lapsed, Umpqua procured a new policy for a rental property on my behalf. It was quite expensive. In late XX/XX/2021 I applied for a new policy with XXXX, consolidating it with my other insurance products, with a policy start date of XXXX XX/XX/2021. I did the same with another rental property with another lender at this same time. As part of the policy purchase, I provided the name of the lender/escrow, and XXXX contacted them. Several months later, I learned that Umpqua did not pay XXXX when billed. I received another notice at the same time re : the non-Umpqua property, but the payment there was disbursed from escrow shortly thereafter, so I thought little of it. I received a subsequent notification from XXXX, however, and they began attempting to collect the amount from me directly. I contacted XXXX to learn that they had never processed a change in insurance provider and XXXX was not on record. In inquired about the change in my monthly payments previously, but received no answer. I also directly inquired about whether or not I should pay XXXX directly, but received no answer. Umpqua contacted XXXX and received proof of insurance shortly thereafter. Additionally, I received an escrow analysis that lowered my payments, effective XXXX XX/XX/2021. However, when I paid the amount provided in the analysis for XXXX, I received a notification from XXXX that I had underpaid. Additionally, XXXX contacted me again requesting the insurance payment. I contacted Umpqua again asking XXXX ) whether they intended to pay XXXX XXXX ) the correct status/amount of my monthly payments and XXXX ) the reason behind the conflicting information on monthly payment amounts. I received no answers but was told they would follow up within the week. It has been XXXX weeks ; I still do not know how much I owe or who is paying XXXX. Note, I believe Umpqua contracts through a third party for escrow. I do not know and was not provided the name of this third party firm.

when I was out of state my father received a home equity loan on his home in XXXX he had had a XXXX before this and his doctor had told me he was in need of 24 hr a day care. I talked with the doctor and social services about needing me to help him with his affairs. Their is not a easy or clear way for anyone being someones power of attorney to watch over another affairs when they do not want help. after the loan was taken out I had gone out of state to look for work that I was able to do because of my health and local economic down turn. This XXXX branch and also the lead branch in XXXX, Washington would not let me look into his accounts or even ask questions. one one visit to the local branch my father had ask a question about his balance in his checking account and the teller replyed ... bring your check book in on Friday afternoon and I will take it home over the weekend and look into it. I ask my father if he had done this before and he told me yes a few times. I called the XXXX branch and reported the problem I felt had happen and was told they could not deal with me on my fathers accounts. my father did not want me to look into it any further and I did not until his passing in XXXX of this year when I found out his home was in foreclosure. I had told Umpqua bank I would take over the loan or get my own mortgage and they served me a law suite to remove my self and my wife from his home. I am an employee of a company that is owned by my husband. On XX/XX/18 around XXXX XXXX I received a phone call from a woman who failed to identify herself or what company she was calling from. She called my personal cell phone asking to speak to my husband and refused to give me any information regarding who she was. I am under no obligation to even speak to someone when they initiate a phone call like this. After a few minutes I decided to call the number back, assuming I would get a main menu type of answer, which would tell me what company was trying to contact me/my husband. The same woman answered and identified herself as XXXX from XXXX XXXX XXXX, and she was immediately rude once she realized it was me calling. I, of course, I then reciprocated the same tone and behavior toward her. She works for a company that supplied a loan to my husband 's business and she wanted to speak to him ( the owner ) regarding said loan. He called her back, spoke to her about her issue and told her to never ever call me on my personal phone number again. She has all corporate contact information and there is no reason for her to contact an employee on their personal phone number. Part of my job is to deal with financial aspects of the business, so I sent an email to the original contact used to obtain the loan, asking for direction on other lenders they use. We intend to pull our loans from XXXX XXXX due to the interaction with XXXX yesterday. She decided, after being told never to contact me on my personal phone again, to call me on my personal phone number and complain about how I contacted the original lending company. Her contacting me is completely unnecessary and serves no purpose other than to harass me. She has been told now numerous times to contact only the company phone number if she has an issue. My husband let many of his business owner friends and acquaintances know about this company prior to this unprofessional joke contacting me. Now we will begin the process of letting everyone know they are harassing, unprofessional, and bullies. I reside in Colorado, where harassment is illegal. On XX/XX/18, I received a call on my land line from a person who said that he was calling from XXXX to tell me that my XXXX account had been " breached ''. I had received, the week before, on my XXXX, a pop up that said my XXXX account was almost full. I found that puzzling as I pay for that account monthly and I had never received a pop up like that, so I believed this really was a call from XXXX. At that point, after taking the call, I was transferred to a woman who said that she was an XXXX technician, she had an XXXX XXXX accent and requested access to my computer using Go To Assist. I gave my permission. Once she had control of my computer she began showing me " evidence '' by way of colored charts, diagrams with moving data that she said were XXXX hackers who were at that moment hacking into my bank accounts. She also said that there was evidence of XXXX XXXX on my computer that the hackers were using and that if this was found on my computer it was a federal offense. She said that because of the seriousness of the situation she was going to have to transfer me to an XXXX security supervisor name XXXX. XXXX went on to tell me that these XXXX hackers had placed a " bad limit '' of {$11000.00} onto my credit cart and {$6000.00} on my debit card. He went on to tell me that in these cases XXXX uses " security license cards '' that I would need to buy but that I would be refunded fully by XXXX because the money needed to come in the form of cash or credit from me so as not to inform the hackers of that XXXX was involved in there whereabouts. The " security license cards '' ended up being XXXX XXXX XXXX which I had never heard of. I went to my ATM and withdrew {$2000.00}. XXXX told me that using this to buy the " security license cards '' in the form of the XXXX XXXX XXXX that he and his technicians would be able to shore up my debit account so that the hackers were unable to remove any more money. That day, when I thought this was a scam, I called Umpqua Bank and explained to them what I thought was a scam and placed a dispute onto the {$2000.00} withdraw which was denied a week later because Umpqua Bank said that I went there on my on volition.

On XX/XX/XXXX, a check was deposited that made my business checking account go negative. On XX/XX/XXXX, I used my business checking debit card several times, but that evening I signed into my account around XXXX XXXX and transferred enough money to make the account positive ( covering both the check and the additional charges ) according to the balance shown on my screen. However, Umpqua Bank believes that I signed in on XX/XX/XXXX at XXXX in the XXXX, meaning the charges from XX/XX/XXXX were all subject to overdraft fees. I did not sign it at XXXX in the XXXX, as I was sleeping ( and have witnesses who can confirm ). In addition, I also would have transferred sufficient funds to cover my overdraft fees if I had seen those on my account, since when I signed in, I transferred the amount the bank was showing me, and thought my account was brought current. The next day, on XX/XX/XXXX, I used my business checking debit card again, and knowing my balance was very low and it was likely relying on overdraft protection, I again signed in later in the day and transferred an amount sufficient to bring my account current ( or so I thought ). No overdraft fees were shown from the use of my debit card. It was not until XX/XX/XXXX that I signed in and saw the overdraft fees listed for XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. These additional fees meant that according to the bank, my account was in the negative for days that I thought it was positive, and each instance of my use of my card during those times accrued another overdraft fee which did not show on my account for several days. If I had received an accurate account balance and if the bank had showed my overdraft fees at any time when I was signing in on XX/XX/XXXX, XX/XX/XXXX or XX/XX/XXXX, I would have transferred enough money to bring the negative balance positive and avoided all of the additional charges. I contacted the Downtown XXXX XXXX of Umpqua Bank on XX/XX/XXXX and spoke to XXXX XXXX, who said that Umpqua Bank is not responsible for showing an accurate account balance via their online banking portal and that the bank would do nothing further nor refund these charges.

My mortgage is held with Umpqua Bank. Formerly, Sterling Bank. Since the time Umpqua took over all Sterling clients and loans, my mortgage payments have been messed up. In XXXX 2015, as I normally do, I mailed my mortgage payment, it was cashed by Umpqua Bank on XXXX/XXXX/15, ( proof of the payment is available and was sent to Umpqua Bank ). Then in the beginning of XXXX I received a call and mail from Umpqua Bank stating my mortgage was XXXX days behind and they sent me loss mitigation paperwork. Not knowing if they were accurate, I authorized XXXX immediate payments. I then went home to research whether or not I made my XXXX payment and found out by my records and my XXXX XXXX that not only was my payment made, it was cashed. I immediately phoned Umpqua Bank back, they asked me to fax a copy of the check, which I did on XXXX XXXX and they would get back with me. By Monday XXXX XXXX, no one had called, so I called again. I was told redirected to XXXX different people, I was told they were working on figuring out the issue and because I was a former Sterling customer, they would take up to XXXX additional days to resolve. To date, I have made a total of XXXX payments since XXXX, they have no resolution and they have derogatorily affected my excellent credit. I was told this was happening to many Sterling customers and there was nothing they could do. I provided proof and have NEVER missed a mortgage payment. I believe they have violated numerous laws and I feel as if NO ONE is protecting us from this bank. I would like to have this entity step in and resolve these issues, get refunds for me and other borrowers affected as well as correct our credit reporting. I do believe if I do n't get resolution, I will hire an attorney. Fair Credit Reporting Violations, Misappropriation of customer funds and an inability to have accurate accounting of my mortgage payment and reserve account are all things that I have been advised are part of the Consumer Protection, are n't they?? PLEASE ADVISE WHAT THE NEXT STEPS ARE AND WHAT WILL BE DONE FOR RESOLUTION.

I have tried to request documents to validate the charges they are adding to loan. We had a forbearance on this account due to business being affected by XXXX. They have disregarded the forbearance we signed & agreed toXXXX XXXX XXXX ( Financial Pacific ) is adding fees from the forbearance period which should not be valid. I have requested the documents on this entire loan & they have refused to provide all items I am requesting. XXXX XXXX is requesting double the loan amount which is not what we signed & agreed to on the forbearance loan. They have also signed addendums we did not agree to, I have brought this to their attention & they refuse to provide financial statements or reports reflecting how they are coming up with double the amount of original loan. After almost XXXX years of paying on this loan they are requesting the full amount of original loan. President Biden spoke about this issue with bank overdraft fees in his State of the Union address last night. It is an unconscionable practice that preys on the low income and disabled population, who are least able to navigate it. Biden said that credit card overdraft fees should be {$8.00}, instead of the much higher fees currently charged. My son XXXX XXXX XXXX XXXX, who has a XXXX and no income, has overdrawn his Umpquah Bank account and has incurred {$770.00} in fees. The account was opened when XXXX was in residential care in XXXX XXXX XXXX in XXXX XXXX moved back to XXXX in XXXX and overdrew by {$650.00}, and in XX/XX/XXXX and incurred 5 overdraft fees of {$35.00} = {$170.00}. I called the XXXX XXXX XXXX XXXX ( XXXX ) branch of the bank and was told that some of the fees could be refunded if we brought the account to a XXXX balance. We brought this to a XXXX balance on XX/XX/XXXX - and only one fee of {$35.00} ( of the {$170.00} ) was refunded. XXXX overdrew again in XXXX with a XXXX charges of {$88.00} and {$44.00}. XXXX did not know that XXXX kept trying to charge the account and he incurred 17 charges of {$35.00} = {$590.00}. XXXX XXXX, the bank manager at the XXXX branch XXXX has been helpful, but unable to refund any of the fees. XXXX called XXXX XXXX, the branch manager of the XXXX XXXX branch, and XXXX said will refund {$150.00} of the {$730.00} in new overdraft fees if we bring this to XXXX balance again. XXXX is at the branch on XXXX XXXX XXXX, XXXX XXXX, ID XXXX, XXXX. The balance is negative {$1000.00}, of which {$770.00} ( minus the {$35.00} refunded ) are fees. We are unable to bring it to a XXXX balance again because I am unemployed, and my husband is retired. XXXX was going to a local branch of the bank in XXXX, and that branch was closed down in early XXXX and XXXX did not have a branch that was close by to where he was living. He was therefore unable to deal with this issue in person.

I went to umpqua bank on XXXX XXXX in XXXX Oregon to close my account since no local branch was available in my city of XXXX CA. The teller whose name is XXXX XXXX said to me " I see there are some pending transactions and so I want to get this transaction right. '' She also stated that my account would be closed by the end of the day and any remaining funds would be sent via a check to my address in XXXX CA. The next day I saw that my account was not closed and further the account was overdrawn. I was instructed by umpqua bank to call XXXX XXXX, which I did at least two times. She did not answer nor did she return my request for a call back. I repeatedly tried to get this matter resolved with umpqua bank to no avail. In the meantime, a few months previously, I had requested my account be credited from XXXX due to a charge at a motel in XXXX California. They requested photos and said my account would be credited which I proceeded. They credited my account. This was not an interim credit. This was a permanent credit per their representative. However, following the overdraft incident at the XXXX branch in XXXX, umpqua bank reversed the charge and debited my account regarding XXXX added an overdraft fee and tacked on a service fee and promptly locked me out of my account and closed it and turned it over to a collection agency and then reported me to chex systems. I had vigourouly tried to get this removed my my credit report and am extremely serious about getting it removed both from collections and XXXX XXXX. This practice I believe is illegal and has ruined my ability to open a bank account with the local credit union. I have photos that show the XXXX motel in question was closed down by the health department. When is this bank umpqua bank going to be held responsible for these actions? I know I as the consumer am right in this matter. I want something done in my favor.

On the morning of Tuesday, XXXX XXXX, I received a call from my homeowners insurance company letting me know my annual payment was overdue. This payment should have come from Umpqua Mortgage and was due XXXX XXXX. I called Umpqua to find out what had happened. I waited on hold for a long time, than eventually opted for the " get called back without losing your place in the queue '' approach. I finally received the call back at XXXX. The rep I spoke to made no attempt to investigate or solve the problem, merely telling me that she 'd pass my information along. On XXXX XXXX, I received a notice of cancellation from my insurance company. I checked on their website to verify that the insurance remained unpaid. It was, so I sent an email to Umpqua via their website. On XXXX XXXX I heard back from XXXX XXXX. Her email stated, in part : " I have taken care of the insurance issue. '' I asked to know what had happened and she said she would send the information in the mail. The premium remained unpaid, however, until I finally paid it myself late in the day on XXXX XXXX. Or maybe I should say I " re-paid '' it, since I had already paid the money to Umpqua as part of my escrow. Today, XXXX XXXX, I received a letter from Umpqua stating that they mailed the check on XXXX XXXX. There was no information concerning why they failed to pay prior to XXXX XXXX, why it took two hours to connect to a customer service rep on XXXX XXXX, why my phone call on XXXX XXXX resulted in no action, or how they intend to regain my confidence. As I write this I 'm out the {$640.00} insurance premium twice. I expect to eventually receive a refund of my payment from the insurance company, but in the meantime this has cost me money, time and aggravation. And now I feel like I ca n't trust Umpqua to do their job.

We use Umpquah bank and recently my debit card was used by someone who went on a shopping spree to the tune of {XXXX. I filed a dispute with the bank in XXXX Wa XXXX claim XXXX ) and they sent me a letter saying the claim is closed and they are denying giving my money back because their investigation showed that i provided authorization for these transactions. This is completely ludicrous. I last saw the debit card in the XXXX on XXXX when i used it at a XXXX in XXXX. I then walked across the street to my car in my work parking lot. I dont remember seeing the debit card again after that but i didnt know it was missing until the following saturday when i got a call from visa asking if i made some charges and i indicated that i had not and immediately called the bank to cancel my card. In the meantime i had switched to a new debit card that they had mailed by my request so i didnt even notice the other was missing. the day i last saw it i had to leave work in a hurry due to emergency and by the next day i was using the new one since the other one had a broken chip. Then a few days after using the new card i noticed odd charges under the new card ( 5.00 in online book purchases? ) so i cancelled that card too and i refuse to use an umpquah debit card anymore. Dont think their chips are secure! and i dont shop online or anything crazy. Help please! These people took {XXXX} of food from my babies mouths! I absolutely have no idea who took my card or numbers and i for sure did not give anyone else permission to have it nor would anyone i know use it! My mortgage lender Umpqua Bank has engaged and conducted an illegal foreclosure sale. Umpqua Bank has failed to follow the guidelines and policies and procedures that MUST be followed when servicing a government insured FHA loan. A denial letter that was received indicates that if an appeal is requested, that there is a 30 day appeal review period, and Oregon and federal law prohibits a foreclosure sale to be conducted prior to the expiration of this appeal period. However, Umpqua Bank and law firm XXXX neglected to consider this and moved forward with and conducted an illegal foreclosure sale despite the fact that an appeal was requested. I have attached documentation to back up this assertion. Additionally Umpqua Bank and XXXX failed to offer Occupied Conveyance as an option. The Occupied Conveyance paperwork was never provided for me and this option was never offered, even though FHA and HUD REQUIRE that FHA loan servicers provide this option. I have owned my home in XXXX Oregon for sixteen years. I refinanced into an FHA mortgage loan that is serviced by Umpqua Bank, and after being injured on the job and forced to take an early retirement have been trying to resolve a mortgage delinquency with them. On multiple occasions I asked Umpqua Bank to work with me and consider me for all of the government FHA programs that they have available. They told me on XX/XX/XXXX that I was denied, but I believe significant errors were made so we requested an appeal. I believe that if I were given the option of a review based on my appeal and the chance to point these errors out that I would have had the denial overturned and gotten approved.

I have had a checking account with this bank for about 2 years now, and seemed to have no problems with anything. However, I went to open a savings account recently (XX/XX/XXXX ), and could no longer access my bank account online. All of my accounts with this bank are currently locked and frozen. I called the online banking customer service number by phone and all they could tell me was that I needed to visit a local branch to verify my identity. However, I do not have a local branch. It has been more than four months now that I have not had access to the money in my accounts that total well over {$2000.00} at this point. I have not been able to pay all of my bills due to my money being held up like this. I do not care if I keep the accounts at this point, I just want my money back. It looks like I will be resorting to XXXX, XXXX, CFPB and local state attorney general complaints until I can get this problem resolved. I would not recommend for anyone to do business with this bank as they will attempt to do nothing but steal your money outright. If there was a problem with my savings account application, then the account should have simply been denied, versus you taking {$2000.00} via my XXXX XXXX XXXX debit card out of my external bank account to fund it, and then freezing all of my accounts at your bank. I know that I provided all my correct information on my applications, and even received a paper account statement recently at my home address, so I know that my address is correct. I purchased a home XX/XX/XXXX with XXXX through Umpqua. The loan was for $ XXXX on a home appraised for $ XXXX. I was told prior to signing papers that I could get PMI removed without another appraisal if I reached XXXX % loan to value ratio within 6 months. On XX/XX/XXXX, I received letter from Umpqua stating the same thing. On XX/XX/XXXX, I mailed a check for {$40000.00} along with letter requesting removal of Private Mortgage Insurance. Umpqua applied the $ XXXX to my principal, but did not remove PMI. On XX/XX/XXXX, I got on the phone and got in touch with loan manager. She stated that the original letter was incorrect, that PMI was figured off the sale price of the home, not the appraised value. Loan manager said that a corrected letter would be in the mail, but I have not received such letter. She requested that I send {$8500.00} more dollars, and that she would take care of getting PMI removed. On XX/XX/XXXX, {$8500.00} I have sent this payment along with another detailed letter, and wait for their response. This last payment takes me down to XXXX % loan to value of home, within 3 months of signing the loan. These funds that I have sent them were moneys that were allocated towards improvements on the home. Everything online that I am reading states that mortgage companies HAVE TO automatically remove PMI when loan gets to or is scheduled to get to XXXX % of appraised value of home. If the interest rates did n't just jump recently, I would have just refinanced. Now, I am stuck in trying to get Umpqua to do what they stated they would do in emails, and in writing from them.

Financial Pacific Leasing is preying on small businesses who have been impacted by the COVID-19 pandemic and struggling due to the current state of the economy. My business entered into a loan agreement with Financial Pacific Leasing in XX/XX/2020 in the total amount of {$33000.00}. The business suffered terrible hardships as a result of the COVID-19 pandemic. A business partner/investor passed away from COVID-19 in XX/XX/2020. Then the country shutdown in XX/XX/2020 and the business was subsequently not able to operate. When the Government allowed businesses to operate again the tow truck had severe mechanical breakdowns including the engine failing and could not operate. We spent XXXX of dollars on repairing the tow truck but unfortunately it is still not operable. During these hardships I made payments to the bank in a temporary reduced payment plan and I also remained in communication with Financial Pacific Leasing by phone and emails. I even offered to turned over the equipment to them but they said it was of not value to the bank. I have been receiving collections notices demanding full payment for balance owed in several different amounts. Some notices state the balance due is as high as {$75000.00}. There is no documentation stating how they have come up with these balance due amounts and I am extremely concerned that a bank can legally charge such an exorbitant amount of interest and fees. There are several similar complaints about Financial Pacific Leasing online and there are many other businesses being victimized by their predatory and unethical lending practices.

on XX/XX/2019, I deposited 4 money orders into my account that I purchased, that were not used for the intended purposes. The total was {$1000.00} ; one for {$13.00}, one for {$12.00}, and two for {$500.00} each. On XX/XX/2019, my account was frozen. I called to see why, and they told me that the money orders were suspicious & altered. While I did make these money orders out to my former apartments, they did not accept them and returned them to me ( providing a dated letter stating that they did so ), and they did not endorse them. I crossed out the " pay to the order of '' line and wrote my name beside that. I then endorsed the money orders and deposited them. I saved my receipts, so once informed of the issue, I provided the receipts along with the letters from the apartment community to my bank as they requested. They said once they got receipts, they would be able to unfreeze my account. They did not. I am still having the same issue as of XX/XX/XXXX. I need these funds as I've accepted a promotion in XXXX, and have bills that need to be paid. This is the 10th business day, and I spoke with a customer service rep and supervisor in the call center today that said as of now, they don't have a resolve date for me. They are requesting a new letter from my apartments that I am unable to get, as I'm currently in a legal dispute with them and we're only speaking through lawyers. I don't feel that the proof of burden is on me in this situation, as they are the ones who have decided to freeze the account and I have been their customer with no issue for over a year.

After opening my initial complaint and coming to the realization of the facts after further research ... XX/XX/XXXX we notified our then current mortgage company, Umpqua Bank, that we would change our existing home owners insurance from XXXX XXXX to XXXX XXXX. On XX/XX/XXXX Umpqua added XXXX and made policy payment to them for the year. Rather than cancel XXXX XXXX, they made a year long policy payment to them as well on XX/XX/XXXX. XX/XX/XXXX Umpqua transferred our loan to XXXX XXXX. Upon prior complaint and CFPB investigation, XXXX stated that Umpqua neglected to include XXXX policy and listed XXXX XXXX as our insurance. In the meantime, on XX/XX/XXXX XXXX XXXX once again, requested payment from the mortgage company for XXXX policy and XXXX paid them another {$1400.00}. Meanwhile XXXX insurance is mailing us cancellation notices for nonpayment. XX/XX/XXXX XXXX finally pays the correct insurance company ( upon request ). But once again, for the second year in a row I have paid TWO homeowners policies. That makes me sick to think how hard this pandemic has hit our family financially this year. We didnt want to pay for two policies but we did unbeknownst to us until now. We just wanted to save $ XXXX {$700.00} per year by changing companies to a more affordable option. We had enough of XXXX XXXX increasing their rates year after year. I began the process of refinancing a rental house I own. I was qualified and all was needed was the appraisal. It came out fine for value but the appraiser e stimated the rent to be {$1900.00}. The house is currently rented for {$2500.00}. I had no problem filling the vacancy in two days last XXXX . I 've asked the appraiser to both explain his reasoning and to accept my provided comps for rent which shows comparable houses for rent or rented in the $ XXXX - {$2700.00} range. He refuses to even respond. The mortgage company underwriter will not move forward based on the appraisers opinion. So, they will not fund my loan however I should have recourse. I 've provided proof of rents and lease agreement and the bank has chosen to rely on the appraisers opinion over my actual data and now I 'm out {$850.00} for a flawed appraisal. It 's the banks prerogative to not fund but at the same time their opinion should be based on fact not opinion. I am entitled to a refund for the appraisal. I 've performed and they 've chosen to accept the opinion of the appraiser over my documented and provided proof of the income from this rental. If I was n't qualifying or not providing documentation needed to process the loan, I completely understand. However, I 've performed, complied and provided all documentation. I 've done everything they 've requested. If they 've decided to not move forward, at the very least I 'm entitled to a refund for the appraisers opinion over my fact.

I have been dealing with first Pacific funding. XXXX was the guy I was dealing with. I thought he was a lender later to found out from Umpqua Bank that he's a Salesman never told me that. I m financing a XXXX XXXX XXXX XXXX XXXX for my XXXX. Purchase price was {$49000.00} that was with Idaho State Tax. He said he could get me 9 % interest rate on a loan with no prepayment penalties. I told him I thought that was high for having a XXXX credit score and paying off some previous equipment. He said I didn't have a long enough history, more lies. I was kind of in a pinch and was going to lose this XXXX XXXX if I didn't get something done. So I proceeded and he sent the paperwork over. Umpqua bank allowed a transaction of {$180.00} out of my checking account from a garnishment, then charged me an additional {$120.00} in fees. My paycheck that Friday was only {$300.00} and my checking account consisted of only XXXX dollars and change prior to my direct deposited check. They wiped my entire account to XXXX balance then closed it. When I requested all funds be refunded as that was my very last paycheck prior to going on XXXX which could take weeks to process prior to receiving any payment at all. I 'm a single mom with now not a dime to feed, clothe or shelter my own children. I did not have the funds to garnish, I did not have a phone call, a letter or any notification of this transaction and if I had I could have paid the garnishment and at least had XXXX to feed my children. This was a violation of my rights and should be illegal,, I 've been robbed from my own financial institution who I have trusted. My bank assisted a fraud against me. I went to my bank with a check from a new customer. I told the teller, XXXX, I do n't want anything to do with the money written on this check until it clears their bank. She said, '' Ok. It should clear in 24 hrs. '' I left the bank and returned 3 days later. XXXX was my teller again and she said to me, " The check has cleared. You can withdraw the funds. '' And I did. Two weeks later I went to the bank for another transaction. XXXX saw me and came over upset and said, '' That check you gave me a couple of weeks ago, it was a bad check. '' I reminded her that she assured me it had cleared their bank. She said, '' I know, but I did n't key it in. I should have keyed it in. I 'm sorry. You need to give the money back. '' I was very upset and told her it was gone. I trusted her to tell me the truth that it cleared their bank. I walked out. I wrote letters to the XXXX and to the bank to no avail. This was all recorded on their cameras. Then, I was told I had an unpaid debt on my credit report. When I looked at my credit reports the bank has reported it as an overdraft oper (? ). I disputed it with the credit report agencies and told them how I was deceived by the bank teller into believing the check had cleared and how XXXX had admitted she did n't follow procedure, but they wo n't remove it. Per prior case # XXXX ( with CFPB ) XXXX # with Financial Pacific Leasing ( XXXX ). This matter should not have been so closed so quickly from the CFPB. It didn't allow me ample time to provide a response to Financial Pacific Leasing 's response. Perhaps I will file a complaint with whoever oversees the CFPB. XXXX As the listing agent, I received a conditional pre approval letter from Umpquah Bank. 30 days later - 4 days prior to closing - the loan was denied due to insufficient income! The lender at Umpquah said that the buyer 's financial documentation was not provided until 21 days after mutual acceptance of contract. At that point the lender discovered they could not qualify. I asked why we received a conditional loan approval and he said he always does that even if they are not pre-approved. I called his supervisor in XXXX, Oregon. To my dismay, she confirmed that is a common practice. Umpquah will provide a pre approval letter even if they know the buyer is not pre-approved. She went on to say it is my fault for not asking the right questions and just taking it for granted the pre approval was actually a pre approval. She said they do n't want to lose a buyer to another lender if they do n't provide a pre approval letter. I told her I think she is doing something against what the guidelines of the CFPB by providing a pre approval letter with zero income documentation. She said she is not doing anything wrong. The loan was made XXXX 2015 for around XXXX. However when I received the loan instrument It reads in bold letters at the top LEASE WITH OPTION TO PURCHASE however after reading the loan it was my interpretation to purchase the full XXXX would have to be paid then you would have an option to purchase for XXXX. Subsequently I refused to sign the lease. However Pacific Financing XXXX called me at least 30 times swearing the lease did n't read that way. So I agreed to sign the lease and supplemented it with an addendum clarifying the loan amount the interest rate and I had the option of paying the lease at anytime with the loan amount plus interest minus my payments. After I signed no copy of anything was provided to me. I contacted them in XX/XX/XXXX to finish paying the loan off and was told {$24000.00} at that point I stopped making payments. I am a XXXX person and they have sent men threatening me with bodily harm unless I paid. I contend the contract is void because they intentionally told me the contract said what it did '' t because the essential part of any contract is understanding. Furthermore they are using extortion methods to enforce a contract they swore they were not presenting. I feel this is a fraudulent contract with extortion to insure payment.

We have been having ongoing issues with the deposit of funds and balance of our mortgage account. In XXXX our mortgage account was credited over {$5000.00} with consent, or contact made to us by the bank before hand. I then had to argue with the bank for a while til about {$1500.00} of it was taken off, through about 6 phone calls each time saying there was n't an error. I had to provide proof of over {$5000.00} of deposit, because they were not keeping an accurate record. Previous to this change we had opened an account with the bank for checking in order to directly make payments to our mortgage with a easily accessible paper trial of deposits. However we were not able to transfer money between the XXXX for over 5 months resulting in cash deposits. XXXX I tried sending money via XXXX on Umpqua Bank website, I signed up for XXXX, the amount I needed to send was over limit according to Umpqua, which was {$500.00}. I completely logged out and went back into the Umpqua Bank website and tried doing it a total of 3 more times to no avail receiving the same message every time transaction could not be completed. On the evening of XXXX my husband and I went to get groceries and our debit cards were denied, having to leave our groceries behind. We then went ahead to Umpqua Bank ATM and got a receipt stating Card was reported Lost on my card and my husbands card. I went home and tried logging into my account and my account information is GONE! I called on XXXX and spoke with someone in the Fraud Department who proceeded to tell me that I have a restriction on my account because of the attempted XXXX transaction I tried on XXXX and there was nothing they could do for me until Monday when the investigative team is back. On XX/XX/XXXX I submitted regular mortgage payment plus {$50.00} for principal payment to be applied. This was a friday so the payment would not come out until after XXXX XXXX so I expected the full payment to come out by XX/XX/XXXX. On XX/XX/XXXX I called my normal bank where I hold my checking account to check if my Mortgage bank had taken the fees and payment out. they had not. On XX/XX/XXXX I filed a Research Request with my Mortgage Bank to locate any trace of them trying to take out my payment that I had scheduled, I also contacted my Normal Bank where my funds are, and they had no record of my Mortgage Bank even attempting to take money out. I have other bills, debts so the money was not going to stay in my account forever and I was trying to get the Mortgage company to hurry and take out the funds.

XX/XX/XXXX the Mortgage bank tried to take the money out of my account at a much later date than i had previously expected, hence throwing off my money management schedule, and bouncing back with NSF funds because the money was NOT in my account. Now I am being asked to pay 2 x the mortgage amount and that is unacceptable! I did my part, always paying on time since I signed into this Mortgage, and I have NEVER missed a payment.

There were suspicious hard inquiries about my credit that I did not authorize. It happened XXXX XXXX and XXXX. I was at work on those dates but I received a notification that there were changes on my credit report thats why I log in to my account. I saw that there were atleast 7 hard inquiries from different companies that I did not authorize. That is unlawful and that is illegal viewing of my finances. Hi I have had a relationship with Sterling Savings Bank and then when it got merged with Umpqua started a new 2nd mortgage account with them. It was a product called " Relationship Checking '' and was a premier account. At the time I opened, i wasn't sure about any special requirements. Around XXXX of XXXX I consolidated my mortgage and 2nd mortgage with XXXX XXXX XXXX XXXX. Hence my 2nd mortgage got closed. I had electronic statements, and there was no mention of any change in fees being accessed. I just recently was curious about this account, and when i logged in, found they have been debiting {$18.00} per month. I recently had a 17 mo. CD mature on XX/XX/XXXX. I received a letter informing me of the maturity date sent XX/XX/XXXX.., I received this letter while I was out of town. after returning I saw the notification of maturity but didn't read further to see the notice of automatic roll over to an 18 mo. CD with a new maturity date of XX/XX/XXXX. Today, 1 day after a grace period ended I was looking over my banking mail and read this information, it took my breath away, I was not aware of the automatic roll over policy and was never verbally told this. I now have an unwanted 18 mo. CD with the amount of {$250000.00} at 0.5 % which I never formally signed up for. I am continuing to try and resolve this with the bank but have had little consideration. They will charge me a XXXX penalty to withdraw, I feel like someone stole my money and I'm being held hostage. I am trying to qualify for a loan to build ( and get a with a take out mortgage too ) my residence on a small XXXX I own. I have been told that by federal banking laws, I can not use any of the net income on the XXXX to qualify for the loan. I do not understand why this should be true. Is it? Without the house, there is {$7000.00} of property taxes on the land, mostly attributed to the value of the XXXX. The bank says all of the property tax obligation under federal banking laws must be included in my residential tax obligation, even though it is fully paid by the XXXX income, which I can not include in my income. I think only the additional property tax associated with the new residence should be included. I asked my XXXX credit association. They can only lend me money for my XXXX activity, which they do. They can not lend for the residence because most of my income is from non XXXX activities. I had three loan brokers tell me they can not lend based on the XXXX income and that I had to include the full property taxes in my annual expenses and could not any off set for the XXXX income. Hello, in early XXXX I opened a new checking account with Umpqua Bank to take advantage of the {$500.00} new account bonus. As part of funding my new account, I used my brother 's ( XXXX XXXX ) credit card to fund my account with {$2000.00}. Around 10 days after my account was opened, Umpqua Bank locked my account. I provided Umpua Bank with a picture of me holding my ID, my brother holding his ID, and also a picture of the credit card used to fund the account. I stared my mortgage forbearance payments on XXXX, i tried reaching out to my mortgage company to resume payments, which ever i wasnt able to this was on early XXXX, as I seen the interest rate drop i had a refinance team look in to my mortgage account and said i was able to refinance, all processed 1 week before closing my refinance my mortgage decided to take me off the payment forbearance plan and report to my loan as 180 days late, that dropped my credit score over 160 points, my refinance team advance me to try and work with my mortgage company which i did and their reasons for all this is that they tried getting contact me and where not able to, i asked if tha could work with me and removed me from being delinquent but they are not willing to work with me, i even asked if i pay the amount you reported me late which is XXXX something and the representative said there was no way i would have to pay the whole amount of XXXX. My original mortage payment through Umpqua Bank was {$2100.00} with {$580.00} going into to the escrow account. The escrow was to cover an estimated {$6600.00} in property taxes and {$940.00} for insurance. After the first year, our taxes were {$3400.00} and our insurance was {$1400.00}. They collected {$7000.00} for the escrow account and on XX/XX/XXXX, issued us a refund check for {$2500.00} for over payment. They continue to estimate the property taxes for {$6600.00} and have raised our mortage payment to {$2100.00} to cover what they say is the overage in insurance. This increases the amount they will collect for the escrow account to {$7100.00}. I called and was told that the escrow account always has to maintain a balance. It currently has a balance of approximately {$1800.00} after the reimbursement to me, insurance and tax payment. I believe that my payment should decrease not increase. This is my money that they are collecting interest on when they know there was an overage prior to raising the payment. My last mortage through XXXX XXXX lowered or raised the payments based on only what they needed to collect.

I applied for the third time for a FHA refi and wasted 2months of valuable time only to find at the end that I could not have more than XXXX FHA at one time. Because it was check in the front I paid for an appraisal and was denied. This caused my credit report to be affected with two more months of past due on an balloon payment. Today I received denial reason which are wrong. The bank changed the product so they could then deny me for the 1 ) excessive obligation 2 ) unacceptable payment record on previous mortgage and then 3 ) Does not meet FHA guidelines. All of the above is wrong because I applied for the product with a co borrower and was told early in the process that all was good. I explain in advance that my income had changed and that I knew that could affect the outcome. So in the end all was good until we found out that I already had an FHA, That was the only reason I was denied. My credit score was XXXX until I started my loan quest with XXXX different banks. They only reason that I became past due is because all of the banks did not do their fact checking on the front end. They did it on the back end.

I opened account at my local Umpqua Bank XXXX the XXXX because I took out a lawsuit loan from XXXX settlement loans to able to receive the wire transfer. My partner and I were in court for a XXXX weeks and had to borrow a lot of money to get through those XXXX weeks of not working. I filed a complaint on XX/XX/21 through this website, complaint # XXXX. Today I received the following response ; We reviewed your complaint and sent it to the company for a response. The company let us know that it cant respond because this complaint lists someone who is not listed on the account or loan or authorized to receive the consumers financial information. This makes absolutely no sense, because I am the only one who is listed on the account, I am the only one who has money going to the Umpqua bank account, and I am the only card holder to that account. The complaint I filed listed the company that Umpqua Bank apparently hired or works through to work on over drafted accounts. Along with the above referenced complaint I filed several attachments which proved the charges were fraud, because I was working in New Mexico at the time the charges were made in Texas. These attachments also referenced 2-3 other credit companies in which fraud charges were made on my accounts during the same time period. This is absolutely an unacceptable response to my original complaint.

We used Umqua bank bill pay at the beginning of this year. I have submitted a complaint before earlier this month. Umqua never called me and only looked at XX/XX/XXXX of this year. A late payment on our credit would not show up this fast. I have called the bank twice with no return call. XXXX of the payments we used Umqua 's bill pay for was over XXXX days late. We had this figured out earlier this year between the XXXX banks. When XXXX puts their full faith in bank to do the right thing and they do n't and make a mistake, XXXX expects them to make it right. On XXXX XXXX a company called XX/XX/XXXXXXXX took {$2000.00} from my checking account. I contacted the Umpqua bank to tell them that I had not authorized this transaction. They then cancelled the card that was used and issued me a new one. Ran an investigation and said I had authorized a third party transaction. Which I had not. So we called the number and it went to a square reader. The invoice issued to the bank clearly is fraudulent. There is no phone number for the XX/XX/XXXXXXXX XXXX. When I looked up address it is a farm house in Pennsylvania. No where had I signed or authorized this transaction as I have presented proof that I was in XX/XX/XXXXstaying in a condo paid for by another party. Even the dates is while I was gone. Umpqua Bank shut off the debit card that belonged to the joint on my account for no reason. The local branch said it was because he had n't used it in 6 months. This account is over 20 years old and has thousands of dollars in it, has never been anything other than in good standing. This account started with Sterling Savings at least 20 years ago when I worked their, they never did anything like this. Typically joints are on the account for the just in case and I had such a case come up and that is when he found out his card was no longer good. Luckily, the joint was not traveling because they would have just left him stranded. I did not get any notice of this, the disclosure does say that they can take a card for no reason, but I have been in the banking industry for years and this is done for account abuse. If this process continues the joint will need a card every 6 months, so really they are n't thinking to clear as the cost of the cards do add up. You do n't have a correct issue on the bottom that best describes my issue. Thank you! XXXX

I purchased a commercial vehicle in XX/XX/2016 from XXXX ( XXXX ) and was informed that the product was a loan and that there were no penalty to payoff the loan. I later learned that XXXX was not the loan holder and that company was Financial Pacific Leasing. I also learned it was not a loan as explained by XXXX and that it was a lease agreement. This complaint is about Umpqua Bank 's nicety policy of prematurely crediting a fraudulent check of {$2300.00} the next day, even with insufficient cash in my account and my first name as the payee was spelled wrong. This practice contrastswith those of major banks which usually reject the check or put the check on hold until the funds are available. Theirpractice has helped a scammer run away with nearly {$2000.00} taken from my checking account. I have already filed a police report on XX/XX/21 immediately after the incident. I wrote to the CEO twice ( on XX/XX/21 and XX/XX/21 ), asking him to forgive the {$2000.00} charged to myaccount because the fraudulent check bounced. The response to my first letter was made in the usual bureaucratic fashion by their so-called Consumer Insight Department . Mishandling of funds. XXXX XXXX, XXXX I sent a check to cover my escrow shortgage. They did not apply my money correctly, evidently I wrote the wrong amount on the check. I sent them messages to no avail on XXXX/XXXX/XXXX which has still not been addressed. They finally called me when I sent in my mortgage payment asking why I was sending in another payment - this was on XXXX/XXXX/XXXX as well, not even looking at my messages. I was talking with XXXX and sent another immediate transfer to cover the amount. She assured me as assistant to the vice president, she would make sure this was done correctly. I now get a statement with my last payment pended, an overdue payment amount ( XXXX ), a partial payment unapplied ( {$1100.00} ) and an amont due of {$2100.00}. My escrow balance shows {$1500.00} - my shortage was {$1500.00}. My payment amounts should have stayed at {$870.00}. My wife and I invested in XXXX, XXXX, XXXX, ( parent company : XXXX ) in 2001. I have XXXX business loan agreements with Financial Pacific Leasing at {$5000.00} each The loans were acquired through a broker. The terms were presented with very misleading and deceptive language. I was told the loans had no pre-payment penalty and I only had to pay 36 equal payments. I was also told that there was no pre-payment fee. Account balance of {$2000.00} is locked up and not given access by the bank. It's been on hold since XX/XX/27 and phone calls have been futile. Requesting to escalate the issue goes nowhere and they ask to go into a branch XXXXmiles away from my residence and they are only open Mon-Fri for five hours a day during my working hours for which I can not leave nor take time off. I had initiated a bill pay check for {$2000.00} to my landlord, and UMPQUA issued and mailed out the check. But I am now informed the check bounced and now I'm being charged late fees and returned check fees. Why did they give the premise of available funds by sending out the check then? I was informed via a scam looking email that my mortgage had been sold to XXXX XXXX. I was not informed in any way by my original bank, Umpqua Bank, although they keep telling me they sent out a letter. My problem is not that my mortgage was sold. Financial Pacific Leasing 2 c ontract agreements I filed a concern about this company last year with NO resolution. This deal was negotiated through a broker who told me that I could pay off these two {$5000.00} leasing loans at any time, without penalty. When I attempted to do so, the finance company gave me the pay off at 50 % interest. This is NOT what I agreed to. I have maintained my payments in good faith, but I am having difficulty maintaining payments at this time. Around XX/XX/2022, a check I had written was processed earlier than I expected, and I incurred a {$35.00} overdraft charge. While I think this is excessive, I understand it was my fault. Knowing the check cleared early, I transferred funds to cover, since I had also written 2 {$10.00} checks that needed to be covered. The bank processed the {$120.00} check first, which overdrew the account, then processed two {$10.00} checks, which further overdrew the account, resulting in two additional {$35.00} overdraft charges. I discovered a check I wrote to pay a bill, never was received by the person it was sent to and that whoever stole it, wrote their name in above the payee and cashed or deposited it. I disputed a charge on my Umpqua Bank Checking account from a motel I stayed at back in XXXX of 2021. When I first stated my account with Sterling savings I was asked if I wanted to have my debit purchases continue even when my account was over drawn. I stated I did not want to be able to continue using my card if there was no money in my account raking up huge overdraft fees. Sterling savings became Umpqua bank. I have been attempting to get a payoff quote for a HELOC for over a month from Umpqua. This is to complete my refinance. They are holding me hostage in my mortgage and preventing me from accessing my liquidity by holding up the refinance process. Each agent I speak to on the phone says they will emails it in 1-2 days. They never send it. They have all the correct contact info, I have no issues getting bills and statements from them. To make matters worse, I have never even used this HELOC. I called to cancel a line of credit with Umpqua Bank in 2018 after the fees became excessive. I called and requested to cancel and was told it was done. I had over {$13000.00} stolen from my account by an employee who had taken several checkbooks without my knowledge and wrote himself checks and forged my signature. Because I didn't catch the fraud within 30 days, the bank is refusing to cover the stolen checks. Many of the checks were cashed at the bank itself over a span of over 2 months. I purchased a home XX/XX/2019, flood insurance was not required. Now the mortgage company Umpqua is requiring flood insurance. I contact a flood company and they say it is not required.
