Dear Sir or Madam, 1. U S AUTO CR Account Number:XXXX Please correct this inaccurate information on my credit report. I recently pulled my credit report from your Bureau and my attorneys and I had a chance to go over my credit report and in amazement, that you have decided to report me 30 days late on this account in XX/XX/XXXX and XX/XX/XXXX as XXXX 60 days late on XX/XX/XXXX and XX/XX/XXXX. I immediately disputed this information with U S AUTO CR and the results of the investigation came back " verified ''. Not only was I never late on this account, but according to the Fair Credit Reporting Act ( FCRA ), the information furnisher is required to notify me of the insertion of negative listings. Since I have disputed the lates with the creditor, and you obviously " verified '' them, I am very curious as to what kinds of " records '' you may have for this alleged account. I am very confident that you are in violation of the ( FCRA ) and ( FCBA ) sections ( 1666, 1666a. 1666b., and 1666c. ) as stated below : 1666. Correction of billing errors ( b ) Billing error ( 4 ) The creditor 's failure to reflect properly on a statement, a payment made by the obligor or a credit issued to the obligor. ( 5 ) A computation error or similar error of an accounting nature of the creditor on a statement. ( 6 ) Failure to transmit the statement required under section 1637 ( b ) of this title to the last address of the obligor which has been disclosed to the creditor, unless that address was furnished less than twenty days before the end of the billing cycle for which the statement is required. ( 7 ) Any other error described in regulations of the Bureau. 1666a. Regulation of credit reports ( a ) Reports by creditor on obligor 's failure to pay amount regarded as billing error After receiving a notice from an obligor as provided in section 1666 ( a ) of this title, a creditor or his agent may not directly or indirectly threaten to report to any person adversely on the obligor 's credit rating or credit standing because of the obligor 's failure to pay the amount indicated by the obligor under section 1666 ( a ) ( 2 ) of this title, and such amount may not be reported as delinquent to any third party until the creditor has met the requirements of section 1666 of this title and has allowed the obligor the same number of days ( not less than ten ) thereafter to make payment as is provided under the credit agreement with the obligor for the payment of undisputed amounts. ( b ) Reports by creditor on delinquent amounts in dispute ; notification of obligor of parties notified of delinquency If a creditor receives a further written notice from an obligor that an amount is still in dispute within the time allowed for payment under subsection ( a ) of this section, a creditor may not report to any third party that the amount of the obligor is delinquent because the obligor has failed to pay an amount which he has indicated under section 1666 ( a ) ( 2 ) of this title, unless the creditor also reports that the amount is in dispute and, at the same time, notifies the obligor of the name and address of each party to whom the creditor is reporting information concerning the delinquency. ( c ) Reports by creditor of subsequent resolution of delinquent amounts A creditor shall report any subsequent resolution of any delinquencies reported pursuant to subsection ( b ) to the parties to whom such delinquencies were initially reported. 1666b. Timing of payments ( a ) Time to make payments A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose, unless the creditor has adopted reasonable procedures designed to ensure that each periodic statement including the information required by section 1637 ( b ) of this title is mailed or delivered to the consumer not later than 21 days before the payment due date. Because I take my credit very seriously, I contacted every name and account that was listed on the report. I was again very shocked by the multiple names, account numbers and figures. Included with this letter, is every letter written to those who have hampered my ability to obtain credit. I believe that any judge that looks over the report would agree that it is a violation of both the FCRA, CCPA and FACTA. The following accounts were listed on your report and I have demanded from them a full accounting and five years worth of records to see if their accounts were in violation of the FAIR CREDIT BILLING ACT ( FCBA ). We also demanded signed contracts, agreements or any legal paperwork that would tie us to the following accounts. Under the FCRA, you are required to conduct an investigation on this account if I request it. I DEMAND to see all 100 % verifiable proof that I was indeed Verifiably late on these accounts and the creditor fulfilled its obligations under ( FCBA 1666 ( a ) ( 2 ) ), As I was never notified of a billing delinquency on my accounts, which the creditor must do under section ( FCBA1666 ( b ) ( 6 ). US Auto Credit Subject : URGENT - Cease and Desist, Violation of FCRA, and Demand for Lawsuit Dear US Auto Credit, I am writing this letter to express my deep frustration and anger regarding the handling of my account by your company. The documentation provided as validation of the debt clearly indicates that the contract in question is between XXXX XXXX and XXXX XXXX XXXX, and not with US Auto Credit as you have erroneously reported. This is a gross misrepresentation of the facts and a clear violation of the Fair Credit Reporting Act ( FCRA ). Furthermore, it has come to my attention that this account is listed on my credit report as " Paid Off, '' which renders the alleged contract null and void. I purchased a 2009 XXXX XXXX about two years ago. I financed the vehicle with US Auto Credit Corp. I recently began to have mechanical issues with the vehicle. The repair costs made it difficult for me to afford my bi-weekly payments. I reached out to US Auto Credit to inform them of the situation and to find out if there were any options available to help me reduce the financial strain to avoid late payments or defaulting on the loan. The only option presented to me was a forbearance. The forbearance wasnt a good option because it would have extended my loan term. The maintenance is going to be required more frequently in the future. The forbearance only provides temporary relief. At this point Ive made over 50 bi-weekly which totals close to {$10000.00}. The interest rate is 26 %. It would be close to impossible for me to pay the car off before it died. Since US Auto Credit didnt have any other options I had to look into refinance options. Luckily my bank approved the refinance but they would only approve {$6600.00} which is the value of the vehicle. I was told the payoff amount was around {$7700.00}. I would have to pay the difference. I didnt have {$1100.00} but I really needed to do this refinance. It lowered my interest rate, payment, and term by almost 50 %. I went back to US Auto to ask if they would write off a portion or reduce my balance. They sent me a settlement offer for {$7100.00}. The loan wouldnt be reported as paid in full but as paid in full- charge off less than balance. They also said that the would issue a XXXX for the any reduction amount greater than {$600.00}. I finally spoke with a supervisor XXXX XXXX who said there wasnt much more they could do. He advised me to continue paying on the car for another year ( {$4400.00} ) and try to refinance at the end of the year. At the end of our conversation he told me that he would have upper management look at it but he was almost positive that they didnt have any other options available. He said hes never seen them offer any other options for situations like mine in the 4 years of his employment. The companys mission statement says the want to help and treat consumers with fairness and dignity. My experience has been the complete opposite. I feel like this company is taking advantage of people with less than perfect credit. I dont feel like the lending practices are designed for you to successfully pay off a loan. And when you get into a situation like mine which I feel was created by their predatory lending practices ... they dont offer viable options to help. They relentlessly demand money and refuse to offer fair resolutions ... leaving you stuck or putting a person into a worse credit situation. I was young with poor credit and I needed a car. This company took complete advantage of that. The dealer made it seem like this company would be doing me a big favor by approving my loan because my credit score was low but I was actually being lied to and taken advantage of. I can only imagine how many people have gone through this and didnt know what to do.

The loan was fradulent from day one when purchased. The car was previously wrecked and unreported at the time of sale. They resold the vehicle to me after it was repoed from another consumer with the same mechanical issues from the previous wreck. Also the amount financed at the beginning was changed after the sale to a higher amount. I was offered a lower balance after I kept experiencing the same mechanical issues which were alignment, transmission issues which the transmission eventually went out and the company agreed on a settlement offer of {$2000.00} due to the fact that the car was unoperable at the time of voluntary giving back to USAuto credit. I made 26 of the 36 months payments. And they sold the car for more that 100 % of what they financed it to me for. Which makes this company a fraud because I had a balloon insurance that I purchased at my initial financing in case of engine, transmission or major mechanical issues malfunction. And US auto credit would not honor the contract to pay their portion of the fees to restore the transmission. US auto Credit forfeited the contract to make another sale to a new blinded consumer to prevent all costs of helping me repair the transmission by reselling the vehicle again making it a third or fourth sale to a new consumer just the same as me. In addition, they have reported ( 3 ) different balances which are contradictory to XXXX XXXX and XXXX A family member has all his credit card receipts of payments made totaling in excess payments made to this account which was requested to turn my car back on and off due to the tracker that was installed on the vehicle. US Auto credit took advantage of the situation when they altered the balance reporting untruth to all credit bureaus. And my XXXX XXXX who is a XXXX XXXX, another with XXXX XXXX, and myself with XXXX XXXX have been denied rental Propertiess as a result of USAuto repair scam and of repeated repossessions to new consumers on this same mechanical issues. A family member has made over {$3500.00} to US Auto Credit using his credit card. And he is willing to take them to court because they are a fraudulent for not including the payments he made in the balance that they have reported. And the account number is XXXX They sold the vehicle for {$330.00} Date Sold XX/XX/2919 XXXX number XXXX Auction - XXXX 's XXXX XXXX XXXX However, they are reporting XXXX to all credit bureaus. Also Im reporting this to every social media and willing to go public including on linked in. Because they were supposed to fix the transmission which was included in the balloon insurance that I purchased for repairs. And just decided to not fix it and sell it. And charge me a ridiculous price at the expense of my family well being.

I keep receiving calls for an individual that has NEVER LIVED or resided or even visited me in my home - I have REPEATEDLY asked for this collection company to remove my number from their call list ( XXXX ) - I get at least XXXX to XXXX calls per week for a niece that I HAVE NO CONTACT WITH and that resides somewhere in XXXX Tennessee - I live in XXXX CAlifornia. This has been going on for several months. This morning was the final straw. I received a call at XXXX yes XXXX in the morning on XX/XX/2017 from telephone XXXX WAKING UP MY ENTIRE HOUSEHOLD .... I have young children, and it just so happens that my entire household is ill with the XXXX and I had just got everyone to sleep at XXXX am after bouts of XXXX cool baths and medication administration and breathing treatments ... THey had only been asleep for approx. XXXX hours ... so when this CALL came in at XXXX am - I answered thinking that it was an emergency call from a family member ... HOW WRONG AND IRATE I became. I requested the name employee number and corporate telephone number and corporate name from the person who called me - SHE REFUSED saying I could talk to her supervisort -AFTER XXXX minutes waiting I spoke with a XXXX employee of XXXX who stated that the call number they use is XXXX ( not the number on my call log ) .. I advised that they were outside of collection call guidelines by calling me WELL BEFORE XXXX am in the morning which is normal for their company and that I had previously advised at LEAST a DOZEN or so times within the last couple of months that the person they are looking for does not and has never resided in my home and does not even RESIDE In the the state of XXXX. - he said it was a mistake - that the file does indicate DO NOT CALL- I advised that is what I am told EVERY TIME They call. Oh sorry XXXX - we do have do not contact for your phone number. I had advised previously that I was going to contact legal representation for harassment. What can I do to BLOCK this company from EVER contacting me again? - I need to put a stop to their ILLEGAL tactics and also they have divulged information about my niece and the DEBT SHE OWES - which is also illegal - telling me to just tell her to pay her bills and I would not get calls like this. THis is when I went off - this is not my debt nor do I have a relationship with my niece - SO WHY IS IT my responsibility to tell her to do ANYTHING. I did not give her the credit or money - so therefore it is ILLEGAL for them to give me the information that she has defaulted on her obligations, NOR DO I CARE. Deceptive practices and non full disclosure of contracts which gives me the right to rescission under these USC codes 15 U.S.Code 1635 ( b ) - right to rescind and keep the property 15 U.S. Code 1635- right to rescission 15 U.S.Code 1640 ( a ) - each violation is 2x finance charge 1. 15 U.S. Code 1662-No advertisement to aid, promote, or assist directly or indirectly any extension of consumer credit may state 2. that a specific periodic consumer credit amount or installment amount can be arranged, unless the creditor usually and customarily arranges credit payments or installments for that period and in that amount. 3. that a specified downpayment is required in connection with any extension of consumer credit, unless the creditor usually and customarily arranges downpayments in that amount. 15 U.S. Code 1692j- false and deceptive forms 15 U.S. Code 1605 - finance charge defined and what is all included 15 U.S.Code 1635 ( f ) - right to rescind after 3 years. If rescission paperwork was never furnished, deceptive practices were used by not disclosing everything, including the existence of power of attorney paperwork within the contract. They added extra taxes and fees without proper explanation. When asked about the validity of the contract, they refused to validate it. The paperwork they sent had no relation to U.S Auto Credit LLC . The letter mentioned in the previous complaint was not received by the consumer, and the consumer was not informed correctly about the transfer of ownership of the contract during negotiations. US Auto Credit also repossessed the vehicle without any explanation or clarification. Despite requesting this information, it was never provided, raising suspicions about the timing and existence of the letter. It's important to note that I had been communicating with US Auto Credit for months before contacting the consumer bureau, giving them ample time to provide the letter and establish the validity of the contract. These actions indicate that US Auto Credit is operating dishonestly.

on XX/XX/XXXX, My husband and I went to look at a used car from a dealer we have dealt with three times now. We drove that car away that day. The dealer advised he now uses US Auto Credit for lending and someone would be calling me to do a quick identity interview. This was done on XX/XX/XXXX as I have an email confirming I did this call. Prior to this I rec 'd collection calls to make my first payment which I learned was on XX/XX/XXXX before I even completed the interview and frankly didn't even know US Auto Credit was the finance company as the dealer just stated he uses a auto loan company now and we didn't know the name. Since XX/XX/XXXX the dealership has had to replace the 45 day temp tag on my car several times ( over 125 days total now ) bc the Auto Credit company despite the dealer collecting {$400.00} for my tags and taxes has failed to provide me a tag or registration for my vehicle. I have made every payment until my payment due on XX/XX/XXXX until they provide me my tag, if they don't then the car will be going back to the dealer if I cant get it resolved here and subsequently removed from my credit and a refund of all payments made to the Auto Credit including taxes and tags will be returned even if I have to seek legal counsel assuming it cant be resolved here. I purchased a car and it was financed through US Auto Credit. They wanted payments every two weeks but not on my pay dates. Payments have been made every two weeks then in XX/XX/XXXX I received a call from them saying I missed a payment in XX/XX/XXXX. No mail or email saying that. So I was late more than 6 times paying them which has affected my credit score. I have been searching for that so called missed payment. Then on XX/XX/XXXX they were to take my payment from my checking account. On XX/XX/XXXX they called me saying my bank account was closed and they could no longer take checks from me. I immediately went to my bank and my account was not closed. They are charging me a late fee again and a non-sufficient fund fee when my bank has not. My account was never closed and when I asked what account number they have, the rep, " XXXX '', told me we only have what you gave us. I asked to speak with a supervisor but no one has called me yet. The supervisor s name is XXXX. I was told by XXXX they do n't waive fees, although I did not incur any. She wanted me to make a payment with a debit from the bank she claims my account is closed which makes no sense. Maybe it 's because they charge {$4.00} fee to pay with a credit/debit card, and there is no fee to pay by check. This company has the worse finance company. I purchased a car from XXXX XXXX XXXX. I had bad credit so they let me put XXXX down and get financed. I was assigned to XXXX XXXX whom since has sold my account to US Auto. They financed a warranty for XXXX but my contract does not explain how much of my biweekly payment amount is going towards my warranty and my loan. In XX/XX/XXXX I was contacted by a company I had no knowledge of stating I was late on my auto payment. Apparently my positive account had been sold without my knowledge to a knew creditor. I advised the company I had just made a payment on my vehicle to the place my contract was with. The company it was originally with agreed that my contract would be paid Bi-weekly as that coordinated with my payment schedule and can be seen with the history of receipts as well as my on time payments recorded in my credit report. When I got the car it was through a buy here pay here. NO CREDIT REPORTING. The car was totaled and the company was supposed to have their own insurance on the car as well as mine. They did not put insurance on it and so I checked my credit report and noticed the company US Auto Credit was on my report. I got my car from US Auto Sales in XXXX, Ga. Which is a buy here pay here. I purchased a vehicle in XXXX during the time of purchase. I was told by the sales person about the debt cancellation agreement. The salesperson informed if I had lost of income that the agreement would cancel the debt. I purchased this agreement for {$600.00} a year into the loan I voluntarily surrendered the car. In XX/XX/2017 I lost my vehicle due to repossession there were several errors in the paperwork between the original creditor and the one who my account was transferred to. First of all I signed nothing with their company until almost 6 months after my account was transferred without my knowledge. I'm sure there are several violations in their procedures that I may not be aware of but I do know that they sold the vehicle " BELOW MARKET VALUE '' which proves the sale was not commercially reasonable. When I disputed the debt with the better business bureaus they advised that there was an issue with the transmission or the engine I can not remember however they never provided documentation of such, making it " Hear say. '' The debt is now " in collections/charge off status. '' A creditors failure to resell your car in a commercially reasonable manner may give you a claim against that creditor for damages or a defense against a deficiency judgment. I didn't mind paying this debt but they have put me in a bind and have unfair business practices that prey on the consumer. Did y'all know there is a clause in our original contracts that pretty much says US Auto Sales has the right to transfer our contracts to another financial institution at any time?.. .. There has not been any of the options listed. If this is not where I need to go then please direct me. The company, US Auto Credit has just recieved our lien. It was sold a couple months back. They have been harassing us by calling almost daily. They are instructed to call me and not my husband but they call him daily while he is at work and call me once a week. I received a settlement offer earlier this year from US Auto Credit, I was n't sure why they were offering me a settlement since the debt was XXXX in a chapter XXXX bankruptcy over two years ago. A few weeks ago I tried to obtained credit and was denied so I pulled a copy of my credit report and noticed that this account was reporting as a debt owed and no mention of it being a part of a bankruptcy. I sent a debt validation letter to US Auto credit and that responded stating that the debt was XXXX, however, they still tried to collect on the debt as you can see in the letter I received earlier this year. XXXX XXXX credit has clearly intentionally violated a federal law, as on their letter dated XXXX/XXXX/XXXX they state the debt was XXXX on XXXX/XXXX/XXXX but they still attempted to collect the debt.

US Auto Credit employees are contacting my job, family members, and friends sharing my debt information with everyone. They are showing up to every persons home listed in the contract and letting them know personal information also asking personal information in regards to me. Almost 7 years ago I voluntarily gave back my car to us auto credit. Since then they sold the vehicle and never disclosed info with me. So instead of taking off sale of car off loan they have been charging me late fees. When I first got the car it was with a local car lot, and then they sold my account to US Auto Credit without my consent or knowledge. I started dealing with US Auto Credit and told them that it would cost more to fix the car then to get another one. I had to have auto repairs and I have done this before. It was known that I have 15 days to make payment and I 'm not even 15 days yet. They call me at least 5 times a day, now they contact me email and my job. This happens frequently, and it is a used car but repairs have officially be completely done.
