Tab XXXX XXXX : XXXX XXXX XXXX XXXX XXXX, CFPB, Oklahoma Attorney General On XX/XX/XXXX, I obtained a credit alert for derogatory credit action taken against my credit score. As a result, my credit score dropped 37 points but most importantly dropped from Very Good to Good. I also had 0 late payments on my credit report ever until they marked this late. Tab XXXX is listed as the collection agency taking the derogatory action against me. Tab Collections is attempting to collect an unknown debt for {$140.00}. I have no contract with Tab Services nor have ever done business with them. However, in XXXX, I have a letter from Tab attempting to collect a debt on another entitys behalf. I promptly sent a certified letter to tab disputing the collection attempt. 1. I originally requested and hereby request again the following ; A. The contract that states I owe the amount shown. B. A detailed statement showing exactly what the charges that make up the total balance are. C. A detailed statement showing the dates and what services exactly were given. Not a summary. D. Show proof they own the debt or are contracted to collect upon another companys behalf. E. The name and address of the original creditor. Tab XXXX never sent the above information. However, on XX/XX/XXXX, made a derogatory claim on my credit report without responding to my verification or validation request. In fact, sent nothing. TAB SERVICES NEVER RESPONDED TO THE VALIDATION REQUEST AND THUS CAN NOT CONTACT ME, FILE LAWSUIT, OR SEND INFORMATION TO CREDIT AGENCIES UNTIL THEY DO SO. THEY VIOLATED THE FOLLOWING. 809. Validation of debts ( a ) Notice of debt ; contents Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing -- ( 1 ) the amount of the debt ; ( 2 ) the name of the creditor to whom the debt is owed ; ( 3 ) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector ; ( 4 ) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector ; and ( 5 ) a statement that, upon the consumer 's written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor. ( b ) Disputed debts If the consumer notifies the debt collector in writing within the thirty-day period described in subsection ( a ) of this section that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or a copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector. Collection activities and communications that do not otherwise violate this subchapter may continue during the 30-day period referred to in subsection ( a ) unless the consumer has notified the debt collector in writing that the debt, or any portion of the debt, is disputed or that the consumer requests the name and address of the original creditor. Any collection activities and communication during the 30-day period may not overshadow or be inconsistent with the disclosure of the consumers right to dispute the debt or request the name and address of the original creditor. 2. I demand Tab immediately remove any and all information from my credit report A. All 3 agencies need the information removed immediately. B. TAB Services should pay me for the violations above and for intentionally damaging my credit. A {$100.00} payment to a charity on the XXXX XXXX in XXXX, OK will suffice. C. Tab will cease all collection efforts until they comply with the Fair Debt Collection Practices ACT and restore my credit. D. I also demand Tab mark my credit file as disputed if they chose not to remove the trade line in its entirety. E. I also demand Tab mark my file and send a letter confirming I dispute the charges. 3. Again, I dispute the debt, demand the information I requested, demand the derogatory information is removed from my reports, demand you cease collection efforts until you are in compliance with collection laws, demand a {$100.00} payment to my charity of choice for your intentional harm to my credit and the distress youve caused me from learning this information. The purpose of this letter is to inform you my office has received and reviewed all documents sent to and from my client, XXXX XXXX. Research efforts found no documentation to support your claim in some of the communication dates provided in your statement to the CFPB. My client started sending out communication to your client, XXXX XXXX XXXX XXXX, as early as XXXX XXXX, XXXX. You were C/O on those letters while being sent a copy. It is reasonable to believe you had knowledge of my client 's dispute much sooner than you stated. In fact your first reply back to my client 's dispute is on XXXX XXXX, XXXX. This is the first communication received from your company. Appears my client in good faith attempted to reach your client a number of times. First attempt United States Postal Service ( " USPS '' ) informed my client that her letter was undeliverable due to inaccurate mailing address. This was the same mailing address being reported on her Credit Report via Consumer Reporting Agency ( " CRA '' ). As well as receiving a copy of that notice from you recently. My client went as far as to use the XXXX ( " XXXX '' ) to assist her in locating your client. The XXXX was also unsuccessful and closed their case. This was documented on letter sent on XXXX XXXX, XXXX. Although my client was eventually successful in sending and receiving documentation back from your client. Your client did n't send an invoice rather a payment receipt. It 's important to point out this documentation does n't add up to the amount being reported. Therefore making the amount reported suspicious. My client sent you a letter on XXXX XXXX, XXXX stating such documentation ( " Validation of Debt '' ) was received as suspicious. Yet your reply to this letter was on XXXX XXXX, XXXX stating your company has received a second request and deemed it to be frivolous. You knowingly sent this reply with the knowledge that my client was disputing your documentation. I hereby dispute your statement to the CFPB ; your company sent copies of documents already received including a medical Operative Report ( " Op Report '' ) which had n't been received before. My client on a number of occasions requested an itemized invoice. This type of documentation was never received. My client has a right per the Fair Debt Collection Practices Act ( " FDCPA '' ) to dispute any discrepancies or inaccuracies either in part or whole of the debt being attempted to be collected. My client even informs you of such rights on her letter to your company on XXXX XXXX, XXXX. I find a number of things concerning. First is your statement ( s ) made to the CFPB are misleading. It is a violation of the FDCPA to falsely represent the character, amount or legal status of the debt, or of any services rendered, or compensation he or she may receive for collecting the debt. Second is your communication my client received on XXXX XXXX, XXXX from your company. " WHEN ARE YOU GOING TO QUIT IGNORING OUR NOTICES AND PAY YOUR BILL? '' The tone and language it was perceived was unprofessional. Furthermore it 's considered to be abusive written communication. It is a violation of the FDCPA to use verbal or written abusive language or tone. Third and most important, per my client, she does not recall providing permission under the Health Insurance Portability and Accountability Act ( " HIPAA '' ) to release her protected medical records to third parties. The third party in question is your company, Tulsa Adjustment Bureau ( " TAB Services '' ) and all employees tied to this account. My client is aware HIPAA does allow for limited information about her but anything more is to only be revealed with the patient 's authorization.

XXXX XXXX XXXX utilized XXXX XXXX for XXXX report. My billing\payment information was not sent with the request for service. I was never contacted by XXXX XXXX billing department. All my XXXX expenses have been honored by the Veterans Administration and have been closed. I did not become aware of the account payable until I reviewed my credit report. I contacted XXXX XXXX XXXX and they acknowledged that I was not contacted or allowed to make payment of the account prior to placing a claim on my credit report. Diagnostic Imagining had written off the account according to the XXXX XXXX XXXX and they are demanding payment and refusing to discharge the claim from my credit report. I contacted XXXX XXXX and gave them my correct billing/payment information to resolve the issue. I called this information to XXXX XXXX agency and they said that they were sending me a thirty day notice and they would take further actions if I do not make the remittance to them. I told them that I was paying XXXX XXXX since they provided the service. My issue is : the XXXX XXXX XXXX has the authority to make an adverse impact on my credit report. A transaction agreement usually requires at least two parties. Even though they acknowledged the fact that I had never been made aware of the account billing and I had not been provided the opportunity to resolve the balance, they have the means to impact my financial being legally. While I have no recourse except to dispute the claim with the XXXX Credit reporting agencies or pay XXXX XXXX XXXX and hope they remove the claim. XXXX XXXX XXXX made the contract with XXXX XXXX but failed provide billing/payment information. XXXX XXXX failed to obtain the billing/payment information from XXXX XXXX XXXX who was paid in full by the Veterans Administration. Since credit reporting is suppose to be about the transactions between two parties, I do not think a third party should be able to hold me hostage and effect my financial aspects without my prior knowledge of the debt. This is why I am here typing out this complaint for all Americans who have been a victim of false credit reporting due to poor business practices.

XXXX XXXX XXXX I recently obtained a copy of credit report and XXXX is reporting debt to my credit report and as allowed under the Fair Debt Collection Practices Act, I have requested that they allow me to validate the alleged debt. To provide me a breakdown of all charges, dates of service, and procedures given including fees associated. Addictionally, I am allowed under the HIPPA law ( Health Insurance Portability and Accountability Act of 1996 ), to protect my privacy and medical records from third parties. I do not recall giving permission for ( XXXX XXXX XXXX XXXX ) to release my medical information to a third party I am aware that the HIPPA does allow for limited information about me but anything more is to only be revealed with the patient 's authorization, therefore my requested is twofold and as follows ; Validation of Debt and Hippa Authorization -Please provide a breakdown of fees including any collection cost and medical charges. -Provide a copy of my signature with the provider of service to release my medical information to you -Cease any credit bureau reporting until debt has been validated by me To send this information to my mailing address listed above and accept this letter as my formal validation request, which I am allowed under the FDCPA. Please note that withholding the information you received from any medical provider in an attempt be HIPPA complaint can be a violation of the FDCPA because you will be deceiving me after my written request. I requested FULL documentation of what they received from the provider of service in connection with this alleged debt. Additionally, any reporting of this debt to the credit bureaus prior to allowing me to validate it may be a violation of the Fair Credit Reporting Act, which can allow me to seek damages from your collection agency. I will await your reply with the above requested proof. Per the standard, you have 30 days in which to respond to this request, or this debt will be considered invalid, and removal from the credit bureaus expected or damages will be sought after. On XXXX XX/XX/2021, I checked my credit report and noticed a negative mark labeled " Collection '' added by TAB Services. The " Original Creditor '' was labeled as " XXXX XXXX '' which is a suspiciously vague name. I immediately sent a letter to TAB Services using the address listed on my credit report requesting formal validation of debt ( see Exhibit A ). On XXXX XX/XX/2021, I received a letter from TAB Services in response. However, the letter only provided a limited amount of information from my written request. The information provided could have been manufactured by anyone. There was not enough information to determine whether this debt was legitimately mine and whether this company has the legal right to collect this debt. ( see Exhibit B ) On XXXX XX/XX/2021, I mailed a second envelope to TAB Services containing two letters ( see Exhibit C, Exhibit D ). In these two letters, I requested the missing information from my initial validation letter including the method of verification used by TAB Services. I received no response from TAB Services and on XXXX XX/XX/2021, I checked my credit report and found that the balance was updated by TAB Services on XXXX XX/XX/2021. My request for proper and complete debt validation is my legal right and it's being ignored by TAB Services. This collection must be removed from my credit report unless TAB Services can provide complete validation of the debt.

I was not contacted for 2 years abd this charge which was paid in XXXX of XXXX and is noted by XXXX XXXX XXXX as workers compensation was attached to my credit for lack of payment. I was hit with XXXX points fir a bill I dont owe. I was told last week by TAB services that this was immediately remedied on theyd end as a workers comp and it would be removed from my credit. YET, they did not remove it, they only updated that it was paid in XX/XX/XXXX still effecting my credit reports and credit scores. Im asking to have these erroneous charges removed completely from my score and that my credit score no longer be negatively impacted by this biking which was paid in full by insurance 2 years ago. There should be laws on the books that if a collection agency is going to hit someones credit, they be required to circle back to their clients first to double check these bills are still outstanding. XXXX XXXX XXXX could have also corrected this by updating my file in the two years they gad a XXXX balance. Tab services is negatively impacting my credit and this bill was workers comp. it was avoidable and they still havent removed it knowing its paid and erroneous & hurting my credit. This is a medical account to my XXXX , XXXX XXXX XXXX , XXXX . The account was paid to his office at XXXX XXXX XXXX , XXXX XXXX XXXX , XXXX XXXX , XXXX , OK, on or about XXXX XXXX , XXXX . This account was originally with XXXX XXXX XXXX , XXXX , OK. The complete file, cancelled checks, and educational materials on correct claims filing were presented in person at their office downtown on XXXX XXXX XXXX At that time, it was agreed by all parties that this case in its entirety was closed and satisfied per contract on all parts. Now, this account keeps reappearing at various times on various credit reporting agencies both national and local. This is a gross violation of the Fair Credit Reporting Act and I have also advised these agencies repeatedly. I expect justice to be carried out, I expect these to be removed from my credit report permanently, and I expect punishment to the full extent of the law to these agencies for repeatedly violating the Fair Credit Reporting Act and my personal rights. I also expect my credit reports to be completely and forever expunged of these items as they have been satisfied for more than three years.

Last year I sent a disputed debt letter that was signed via certified letter from XXXX XXXX. I requested debt verification and an itemized statement or a summary of the initial charge. Nothing was sent other than a lump sum amount due without explanation. XXXX v XXXX affirmed in the 6th that debt collectors must provide a minimum verification that a consumer could dispute the debt. XXXX failed to do so yet continues to illegally collect the debt and even filed a derogatory statement on my credit earlier this year. Even though, if the debt was legitimate all they would have to send is an itemized statement. They refuse as the debt is not verifiable. I personally went to collect the letter from the hospital directly and one doesnt exist. Fast forward to XX/XX/2019, I filed a complaint with my credit agency and XXXX removed the derogatory statement because they couldnt provide the necessary information. Proof attached. Now, without any more or new letters or proof sent they attempted to hurt my credit again but have changed the debt amount. Without any new contact or letter. Its harassment and illegal and it continues without new proof.

I have tried several times to resolve this account with this collection agency XXXX XXXX. I was never notified if the debt, it was found on my daughters credit and when we called to verify it, they are trying to collect from myself and daughter on the same account. She was covered under Medicaid in the state of Oklahoma on date of services and also 18 years of age so this should not be a debt in my name to begin with I have sent the documents providing proof that was covered to the collection agency. On Friday XX/XX/2018 I called to see if had been updated and removed, I was told they could not talk to me about it because it is in dispute. I said are you telling me you cant discuss my own account with me and Im the one disputing this, she replied yes. Myself and daughter have tried numerous times to clear this up and have removed from the credit report to no avail. On XX/XX/XXXX I received a letter still requesting payment from the collection agency. I need help getting this resolved. It can not possibly be legal to try to collect the same debt from 2 different consumers

I contacted Tulsa Adjustment Bureau to try and settle this debt that they show on my credit report, only to be told I had several other debts that this company wanted to settle before they would settle the shown debt, the other debts were several thousand dollars or so they said. The problem is that they know these debts are both uncollectable and unreportable. Under Oklahoma statute 14A-5-107 and statute XXXX medical debts of 2 years or more are not collectable or reportable. I called them again and spoke with them on their recorded line and made them aware of this. They said they were within the law to try and collect these debts they are NOT! I am XXXX and live on a modest income and the Americans with Disabilities Act comes into play as well. They can not treat me differently than they treat a non XXXX person. They are not following the law in either case. This debt must be removed from my credit report. As it is unlawful after the 2 year time frame for this to be reported.

I went to XXXX XXXX XXXX in XXXXXXXX XXXX for several months after being referred to them by another Chiropractor. Before going I confirmed they were in network with XXXX XXXX. The office is part of a medical network with XXXXXXXX XXXX that offers discounted rates to XXXX customers. After service was completed the office will not accept the discounted rates and are now trying to send me to collections for the full billing amount, and not the discounted rates Im entitled too. In addition to sending me to collections they have also placed a lien on my unsettled bodily injury claim for the full amount and not the discounted rates. This practice is deceiving and at the very most I should owe is the discounted progressive rates. Once I receive a correct invoice with how much I owe I can settle with them. This should be illegal as they are trying to seek more than they are owed from multiple different methods.

On XX/XX/XXXX I contacted a debt collection agency ( tulsa adjustment bureau ) regarding a written collection I received from them after having never gotten a first bill from the original medical lab ( XXXX XXXX XXXX ). When I asked for the labs contact information on the phone, the collection agency employee refused to give it to me. I then had to call my doctor and get the phone number for the lab from them, and was told by them that tulsa adjustment bureau should have given me that information themselves. I have since tried yesterday and today to reach the medical lab over the phone with no success, despite leaving voicemails and calling repeatedly and waiting on hold repeatedly. This is the second time this lab has sent me directly to collections without first sending me notice of a bill so I can pay and keep it out of collections, and they are affecting my credit score unnecessarily and wantonly.

I noticed a derogatory mark due to account in collections this month ( XXXX of XXXX ) of which is for a supposed charge from XXXX of XXXX, nearly 4 years ago. Of which in the last 4 years, I have not received any notices or communications that I am in collections. The charge is of a very minimal amount, one that would have never gone to collections. My standing credit score is in the mid XXXX 's, with no late or missed payments, and this is extremely out of the norm as well as not to mention the fact that I have received zero communication in the last 4 years about this supposed debt of mine. The original debt is supposedly from XXXX XXXX XXXX, of which I do not remember ever going to or getting a bill from, which then sold the " debt '' to XXXX XXXX in XXXX, OK, of which have not contacted me regarding this, and then 4 years later decided to run it on my credit report.

XX/XX/2019 A lady called my work, demanded to speak to myself. My co worker asked to take a name and number she told her name and the company she was with XXXX XXXX. I called her back, she was very hateful telling me that if I didnt pay this {$120.00} I will be sued and my wages would be garnished, asked my why it wasnt paid, why did I let it get this far into collections, I advised her I wasnt aware it was turned over, she said she will be taking legal action if it wasnt paid today. I told her well I dont owe you I owe the hospital, she said well now u owe me. And you need to pay up. I got mad and hung up on her bc she called my work to begin with instead of my cell phone. XX/XX/2019 I received a collections account from XXXX XXXX for " XXXX XXXX XXXX XXXX. XXXX for the amount of {$810.00}. I have no knowledge of this practice or doctor as I have never seen them before. I have tried to dispute it several times through XXXX and XXXX XXXX but have failed to have it removed. I have reported it as fraud and identity theft. I have also contacted XXXX XXXX and sent in for a dispute with them as well. When calling the number for " XXXX XXXX XXXX XXXX. XXXX '' you hear what sounds to be a child saying if you're calling for the doctor this is no longer their number and to leave a message. I sent a debt validation request to TAB services requesting information to validate debt for account XXXX listed by TAB services. In return, they sent a letter back on XX/XX/22. In this letter, it contained my private medical records/information that is a direct violation of HIPPA privacy regulations. I never signed a HIPPA form authorizing them to have access to this information. As such, I would need them to delete all information of this balance from their collection agency, remove debt listed on all 3 major credit bureaus, and cease all contact for the above noted accounts.

Services were on XX/XX/2019 from an imaging location. The single account had 3 claims, all part of the same service/procedure but what TAB did was broke it out I to 3 of their own accounts and then reported each one individually to my credit. When I brought this up and reviewed the original bill and the letter from TAB it was represented as 1 single account yet they broke it out, essentially multiplying the impact on my credit, and refused to correct or even explain how this occurred.

I have repeatedly contacted company and have gotten 4 different excuses on why collections from Tulsa adjustment bureau and also faxed numerous paperwork proving bill was discharged in bankruptcy. ive disputed this bill with credit bureau numerous times yet Tulsa adjustment bureau has responded all info is correct. Tulsa adjustment bureau has reported this debt to XXXX as recently as XXXX XXXX 2017. clearly this was after all my previously efforts to resolve this issue.

I only found out that I have collections after me by checking my credit report. I was never contacted by the creditor, nor the collections bureau about the amounts owed. I have received nothing in the mail and no one has attempted to call. Being fully unaware that I owed the creditor a balance, I do not think it is fair to have had this passed on to a collections bureau as it is making a great impact on my credit.
