XXXX of XXXX, XXXX XXXX XXXX salesman who performed unfair deceptive sales practices regarding the XXXX XXXX XXXX. During the period of the loan, payments were rendered as agreed. During the final year of the contract, the vehicle began to generate a cost for a series of repairs. Developing trust with XXXX XXXX made contact for advice, and possibly purchasing another vehicle. Being instructed to get rid of the vehicle and obtain a new one. The vehicle was returned as instructed, however ; a voluntary repossession was reported to all major credit profiles. Attorney General, if you review my payment history again, I remained complaint throughout the entire contract with additional fees as paid online. Placing a burden to compromise my credit along with my creditworthiness after having an exceptional payment history is disturbing. To be a victim of predatory lending practices, DTPA and the OCC are reasonings for a full investigation. To see a voluntary repossession on my credit profile not once did XXXX questioned the return of the previous vehicle. To add insult to injury was served as a debt citation. and received no other correspondence regarding a balance owed prior. With the continuation of aggressive phone calls from Troy Capital LLC, customer service reps falsely implied that they were a law firm working for attorneys, along with using scare tactics to retain debt. Continuing with depletion of credit and creditworthiness, a notice of a judgment for a balance. Several months later, I received a notice that judgment was placed against me for the balance owed. Attorney General, many laws were broken with the series of events that occurred : According to the law. In section 17.41 of the Texas Business and Commerce Code, the Texas Deceptive Trade Practices-Consumer Act ( DTPA ) protects the consumers against false, misleading, and deceptive business and insurance practices, unconscionable actions, and breaches of warranty. For XXXX XXXX to mislead and deceive me to gain a sale is against the law. Also, according to the Office of Consumer Credit Commissioner, holders includes sellers who assign or transfer RICs and acceptance companies and related finance companies that acquire RICs. XXXX XXXXXXXX, License # XXXX at the address of XXXX XXXX XXXX, XXXX XXXX XXXX TX XXXX is in a surrendered status. According to the OCCC, a creditor has failed to send a notification of disposition and has not provided a written relinquishment of the balance after disposition. Sued without any notifications from the courts or balanced owed. In addition, license # XXXX at the XXXX XXXX XXXX XXXX, XXXX Tx XXXX -neither location holds an active motor vehicle sales finance license and probably was in surrendered status during the time I purchased and paid monthly payments on my vehicle. The lending practices of XXXX XXXXXXXX victimize low-income consumers such as me. During my time of possession of the vehicle, I have gotten several robocalls to collect in violation of the TCPA.

Recently I XXXX XXXX, formerly known as XXXX XXXX was sued for a very old collection account. I demanded a full investigation as to the age of the debt, and I won in the XXXX XXXX XXXX as the debt simply was no longer enforceable. So, I started to do some additional research pertaining to a default judgment entered against me in XX/XX/2018 by Troy Capital LLC, as assignee for XXXX XXXX XXXX. I now have a judgment against me that had no right to ever be before a judge in the XXXX District Court, XXXX XXXX XXXX, XXXX, MA XXXX. I am going one step further by stating that the original debt with XXXX XXXX XXXX had been in default for well over seven years, and for that matter the account is not even posted on any of my credit bureaus. The debt buyer known as Troy Capital LLC is protected within the XXXX of Massachusetts from even licensing as a debt collector as per recent Superior Court decisions as well as a mandate from the Massachusetts Banking Department. A law firm know throughout the XXXX of Massachusetts as XXXX XXXX XXXX filed the lawsuit, and I was never given proof of ownership of debt from XXXX XXXX XXXX that Troy Capital LLC had the necessary assignments of debt, and/or any upset price on the purchase of said debt. I am a woman of XXXX status, being a person of 50 % XXXX and 50 % XXXX heritage. I work a very responsible job for the XXXX of Massachusetts, and I believe that debt buyers target minorities due to their limitations within the financial system in general. I have been the target of racism and I do not believe that proper due diligence was proved on ownership in the judgment posted against me. I hereby demand a full vacatur of the judgment against me immediately, and a return of all funds seized from my payroll checks. I will take the following actions within 30-days if my rights under the Fair Debt Collection Practices Act as well as the Fair Credit Reporting Act are not protected : 1 ) I will submit a bar complaint against XXXX XXXX XXXX and XXXX XXXX XXXX, Esq. 2 ) I will submit additional complaints within the XXXX of Massachusetts agencies such as the Office of Attorney General and the Massachusetts Department of Banking. 3 ) I will submit complaint with the XXXX and XXXX XXXX, as I believe that a proper investigation will prove XXXX bias in the debt purchase scam, as well as with their lawyers that enforce these judgment actions in our district courts. 4 ) I have three additional areas to steer this issue to that I will reserve at this time. 5 ) XXXX XXXX XXXX XXXX violated my rights by submitting my collection information outside of legal timelines, and should be sanctioned by the CFPB. Please take my complaint with the Consumer Financial Protection Bureau serious and address my concerns. I do have a civil rights lawyer from XXXX who wants to come on board with my complaint, but I told him that at this time I am trying to protect my family and would like to see if the problem could be resolved peacefully without additional actions. i signed up with XXXX to take classes on line for my XXXX degree.iwas given a loan of XXXX.i was never able to contact any one from the school for assistance or questions regarding my classes, also i was never able to pass any of my exams.i made multiple attempts for assistance but not able to get any.the cost of degree promised to me turned out to be astronomical with hidden fees and no one to contact at college network.doing so i stopped paying loan given to me by XXXX.at present i am being contacted told there is a judgement against me for non payment for something i did not benefit from.i have spoken to other XXXX who verbalized that they have had the samep roblem sign up with the college network get a loan from them and not able to get any assistance thus leaving us with a large loan and no repay with no degree to show.the name of the school is college network the name servicing the loan is troy capital llc XXXX florida.the XXXX which is permanently closed a class action is being taken by them since 2014 i am one of their individual who signed up for their classes.i would greatly appreciate a response to my petition for help.i truly feel i should not have to pay back this loan due to college network incompitence and multiple complaints made all over the united states.forced to pay back a fraudilent loan.

Got a letter from XXXX XXXX XXXX XXXX representing Troy Capital LLC they filed a judgement against me back in XX/XX/XXXX trying to collect old debt that Troy Capital LLC bought from the Original Creditor XXXX XXXX for Pennies to the dollar Troy Capital LLC is a XXXX XXXX XXXX XXXX Debt Buyer and hire crooked lawyers like XXXX XXXX XXXX XXXX to do their dirty work XXXX XXXX like Troy Capital LLC and Crooked lawyers like XXXX XXXX XXXX XXXX need to be held accountable for always breaking the FDCPA Laws they count on the ignorance of Consumers using scare tactics paying for debts no longer owed but written off by Original Creditors it's a shady deceptive business that needs to be looked into and put a stop to it the money they collect don't go toward the debt or the Original Creditors but instead into their own pockets that's how they make their profits I tried to pay the minimum owed in good faith to XXXX XXXX XXXX XXXX but I read alot of bad negative reviews from other consumers sure people gets into messes they shouldn't get into but the people at Troy Capital LLC and XXXX XXXX XXXX XXXX sure as heck ain't perfect and definitely saints themselves for judging consumer remember only God can Judge oh by the way XXXX XXXX XXXX XXXX had the time barred extended to XX/XX/XXXX

Troy Capital , LLC purchased an old auto loan debt in XXXX. Troy Capital , LLC never reported the said debt to any of the credit bureaus and made no attempt to contact me or collect the date prior to filing a lawsuit in small claims court. I was properly served paperwork around XX/XX/XXXX. As far as I can tell, filing a lawsuit without reasonably attempting to collect the debt is a violation of FAIR DEBT COLLECTION PRACTICES ACT As amended by Public Law 111-203, title X, 124 Stat. 2092 ( 2010 ) Section. 809 ( d ) The original court date, XX/XX/XXXX at XXXX at XXXX XXXX XXXX XXXX, XXXX, IL, XXXX, was rescheduled for XX/XX/XXXX. It was filed XX/XX/XXXX and sent through USPS. It did not arrive at my house until about two weeks AFTER the court date. I then received another letter through USPS that a NOTICE OF MOTION has been filed for XX/XX/XXXX at XXXX to enter default judgement against me ( the defendant. ) I attempted to contact Troy Capital , LLC and they referred me to their attorney at XXXX XXXX. I explained my situation and offered $ 100 monthly payments starting immediately to which they countered $ 150 monthly payments. I have since contacted an attorney to further pursue these matters.

When I finally spoke with someone in their office. I was informed the original debtor was XXXX XXXX XXXX XXXX . They sold the debt to Troy Capital, LLC and their law firm filed a lawsuit against me. This person stated they served me with court papers in XXXX XXXX 2014 @ XXXX. I informed him that would have been impossible to do as I was at work on that day XXXX. I asked if they had a signature showing I signed these papers. The guy then tells me he ca n't give me that information and said I could get a lawyer. They took every cent I had out of my bank accounts and left them in the negative by thousands of dollars. I ca n't pay my bills or buy food for my child because all my money is gone. This is not right and I plan to fight this.

Then i get another attorney with the same judgement ( transferred to Tennessee ) and they would budge off their total. {$8600.00}. The loan was originally turned over to XXXX XXXX XXXX XXXX XXXX XXXX, XXXX, PA XXXX ( XXXX ) The company admitted to me that the Social Security Numbers for the name do not match, yet they can not remove the lien. I am not responsible for this debt. Another person with the same name is. My bank is refusing to process a loan for me for this reason. Help!

These inquiries have damaged my credit score and have caused me to pay a much higher interest rate on my current loans. The originally lender XXXX XXXX who I initially was in debt with, sold company to Troy capital who then continued to keep the credit inquiry active when it shows the account was charged off from 2015 which is over 6 years old by now. The original lender who I was contracted and financed through aka XXXX XXXX passed this to troy capital who continues to hold this debt and injure my credit when it has been charged off for six years and solidified.
