I sent the following letter to the company on XX/XX/XXXX ; I received a message back that they blocked me from sending them anything. I need the CFPB to intervene : XX/XX/2019 XXXX XXXX XXXX XXXX XXXX, California d/b/a XXXX XXXX , XXXX d/b/a XXXX XXXX XXXX XXXX XXXX XXXX XXXX, CA XXXX To Whom It May Concern : After doing research regarding Internet Tribal payday loan laws in the State of South Carolina, I have found that your Internet payday loans are actually illegal. I have been in contact with South Carolina State Department of Financial Institutions and they have verified that your company is not licensed in South Carolina, therefore the loan contracts I had with XXXX XXXX XXXX XXXX XXXX, California d/b/a XXXX XXXX , XXXX d/b/a XXXX according to my state 's laws is not enforceable. It has come to my attention that payday lenders must be licensed by the state of South Carolina in order to offer loans to its residents. Since your company has no license in my state, the loan contracts I have had with XXXX XXXX XXXX XXXX XXXX California d/b/a XXXX XXXX , XXXX d/b/a XXXX are not valid. I have conducted hours of research and have consulted with authorities. The practice of online payday seeking affiliations with Native American tribes in an effort to take advantage of the tribes special legal status as sovereign nations is abhorrent. This rent-a-tribe model is under scrutiny. Courts are cracking down on tribal lenders. The Consumer Financial Protection Bureau recently sued four online payday lenders in federal court for allegedly deceiving consumers and collecting debt that was not legally owed in many states. I am not surprised to have learned that XXXX XXXX XXXX XXXX XXXX, California d/b/a XXXX XXXX XXXX XXXX d/b/a XXXX was one of the four named in the suit. The complaint alleges violations of the Truth in Lending Act and the U.S. Consumer Financial Protection Act. It seeks restitution of money that borrowers paid involving illegal loans, plus penalties and a halt to the practices. While the lenders will likely claim that their loans are governed only by tribal law, not federal ( or state ) law, a federal court rejected similar arguments last year in a case brought by the FTC against lending companies. Tribal lenders have been found and identified in the Public Justice Report to be regularly making loans with interest rates well above state and federal regulations sometimes up to 700 percent. I have researched XXXX XXXX XXXX XXXX XXXX, California d/b/a XXXX XXXX , XXXX d/b/a XXXX and there are volumes of complaints against this tribal entity. XXXX XXXX XXXX XXXX XXXX, California d/b/a XXXX XXXX , XXXX d/b/a XXXX hides behind its tribal status to act in a predatory, harassing, and very nearly illegal manner. In my research, the repeated theme is the harassment, threats and predatory nature. Additionally, the extreme in fee charging which goes against the policies of many states. At this time I am requesting a return email acknowledging that my account is marked paid in full in good standing. Also, I would like a refund of the {$360.00} overpayment. I borrowed a total of {$6000.00} and more than repaid that to the tune of {$6300.00}. A refund of {$360.00} must be issued to me immediately and in an expedited fashion. I am also revoking authorization for ACH withdrawals. I have given a copy of these revocations to both my bank and my employer. Any future attempts to collect funds in this manner will be blocked. Please respond to this email with acknowledgment that my account has been satisfied in full. Details of when I can expect the refund, as discussed above, should also be included in the email. I demand that any contact be made through email only. I will need everything in writing to keep accurate records of all communication as per instruction from my Attorney General 's Office. I prohibit you or your affiliates to contact me via telephone at my place of employment or my home telephone number. I also prohibit you from calling my references listed on my loan. I must also inform you that I will be filing complaints with the Consumer Financial Protection Bureau, XXXX XXXX XXXX, the Federal Trade Commission, and California and South Carolinas Attorney General 's Office. Due to my financial challenges despite having multiple jobs, I have been under-employed as single father of XXXX for well over a year. Earlier this year, when I was stressed and out of options how I was going to make the rent payment, I made a loan request via Golden Valley Lending. I did so both online and via the phone. The loan representative told and I prodded him to do so that they " pay back '' on the {$900.00} was going to {$2000.00} if I paid them via checking account deduction at the beginning and middle of each month. Of course I realized even then that this was a obscene amount of interest, but again I was out of options and hopeful that one of the full time positions with a higher, predictable salary would be happening soon. While the position I hoped to get did not happen yet, I was unable to pay back the loan faster which would have reduced some of the inflated interest. However, I did have payments deducted from my account that were paid consistently at the start and middle of each month. PROBLEM / COMPLAINT / FRAUD : The issue on how this company preys on customers came to light earlier this week when I called their toll free number and spoke with " XXXX ''. I told her my account should be nearly paid off and asked what she showed as the total of my payments on the {$900.00} loan. XXXX told me I had paid {$2500.00}. I was very surprised and said that the total installment payback on this loan was to be {$2000.00}. Why have you exceeded this by almost {$600.00}? Furthermore, XXXX said the system showed they were making ANOTHER payment deduction from my checking account at the first of XXXX ... In other words, this lender gets access to a customer account and continues taking money until someone calls them out on their fraudulent behavior. Yes, I say fraud because anyone can make a mistake. However, it is fraud when you choose to not correct the error. XXXX told me the best she could do was close my account " as is '', with me having been charged almost {$600.00} beyond the agreed upon total payback. I said I understood she may not authority to correct this error, but that I needed to speak to a Manager. After waiting on the phone, " XXXX '' did get on the phone with me. I again explained to her what had happened. She did apologize for the problem, but said she did not think she could re-pay me the full amount I had been over-charged. However, she did say she would : 1 ) email me that day that my account was closed and paid in full ; and 2 ) that the most recent payment of {$180.00} would be returned to my checking account. As I was I had to report to work for my 2nd job at this time, I asked XXXX that she please do what she had said. While I have received the email saying my loan is now closed and 2 days later I did receive the {$180.00} -- I have still been over-charged {$400.00}. I have written a request to my US Senator XXXX XXXX and asked if his office can provide any assistance or legislation so that this so called Lenders can make a profit but not be allowed to get away with such outright fraud. I also am making this CFPB complaint as I hope your Agency will take a very close look at Golden Valley Lending and the many scammers like them. I can not begin to add up the number of text and email messages I get every single day from bad lenders who clearly run the same scam ... They all say " my application was approved '' ... and that " my funds are ready ''. Life is hard enough when you are living near poverty level even while working 7 days a week. That there is an entire industry of these XXXX that do nothing but prey on the desperation of people with financial difficulties ... .well, I hope something can be done.

XX/XX/XXXX, XXXX- signed and agreement for an installment loakc with XXXX XXXX XXXX XXXX XXXX located at XXXX XXXX XXXX XXXX, XXXX XXXX , CA XXXX. I was lead to believe that XXXX XXXX was an actual licensed loan company, and would offer me as stated on their website, a small dollar installment loan.The website advertised the cost of the installment loan & included rates of finanice charges but no APR 's. Once recieving the {$1000.00} installment loan ACH wired to my bank account, XXXX XXXX used unfair, deceptive acts and practices charging fees, APR 's, & interest charges so eccessively high they should violate state lending laws. -The Annual Perentage Rate on my agreement, came to 667.2656 %. This violates NJ usury laws ( N.J.S.A. 2C:21-19 ) apply to all loans subject to State of New Jersey law . The maximum permissible rate is 50 % for corporations and 30 % for non-corporate borrowers. - The loan insterest is base over a year and the payment are withdrawns are every pay period. I borrowed a XXXX and have been paying XXXX twice a month for three months. It appears the rate is over 500 %. - They also state on their website that they have " no hidden fee 's '' when in their interest rates, and finance charges are all hidden until they start taking debits from the consumers bank account. The lender- XXXX XXXX XXXX made a loan that is not legal under NJ state laws. And they are also not federally or NJ state licensed. If the loan is not legal, then XXXX XXXX has no right to collect. So by continuing to collect, and continuing to tell me, that I owe, they have engaged in " unfair, deceptive and abusive '' practices under state & federal law. And, also found this : XXXX XXXX XXXX violated the Truth in Lending Act and the Dodd-Frank Wall Street Reform and Consumer Protection Act. The specific allegations include : Deceiving consumers about loan payments that were not owed : The lenders pursued consumers for payments even though the loans in question were void in whole or in part under state law and payments could not be collected. The interest rates the lenders charged were high enough to violate usury laws in some states where they did business, and violation of these usury laws renders particular loans void. In addition, the lenders did not obtain licenses to lend or collect in certain states, and the failure to obtain those licenses renders particular loans void. The four lenders created the false impression that they had a legal right to collect payments and that consumers had a legal obligation to pay off the loans. Collecting loan payments which consumers did not owe : The four lenders made electronic withdrawals from consumers bank accounts or called or sent letters to consumers demanding payment for debts that consumers were under no legal obligation to pay. Failing to disclose the real cost of credit : The lenders websites did not disclose the annual percentage rates that apply to the loans. When contacted by prospective borrowers, the lenders representatives also did not tell consumers the annual percentage rate that would apply to the loans. XXXX XXXX XXXX has done all of the above to me as a consumer, and they are not legal in New Jersey!!!

Someone opened a loan from Mountain Summit Financial in my name pretending to be me -- I did not apply for this loan. The criminal used my name and contact details ( email, address, phone number and more ) to open an account at Mountain Summit Financial, apply for a loan, and receive funds all in under half an hour over the weekend. Mountain Summit issued the loan without validating it was actually me in any way. They issued the loan even though all of my credit bureau accounts are frozen, and no loans should be opened in my name while they're frozen. I found out about it because I received 3 emails in rapid succession, with the first indicating the account had been created, and the second saying my loan documents were ready for signature. These seemed like traditional phishing attempts ( and I've received many such emails in the past year due to numerous data breaches containing my PII ), but then I got a 3rd email saying the funds were on their way. This is what scared me and I reached out to XXXX XXXX who has been advising me on security and identity issues since the prior breaches/numerous phishing attempts. He advised me to call Mountain Summit Financial, but they were closed on the weekend and didn't even have a voicemail box to leave a message -- Again, that they were able to open an account, accept an application for a loan, and issue payment on it when they weren't even open to validate it is SUPER troubling. Working with XXXX, we determined that this was likely a successful fraud incident and we logged into the Mountain Summit Financial site to see what else we could find out ( since the criminal used my real email address, I was able to change the password so I could log in ). This is where we learned the money was being sent to an account at XXXX XXXXXXXX XXXX, that the loan application claims the XXXX account was is in my name -- this is not my account, and that the loan carried a 500 % interest rate!! I called XXXX MANY times over the weekend to warn them and try to get them to block the inbound transfer or freeze the account and get law enforcement involved. They wouldn't even transfer me to anyone who could help ( more about that in a second complaint I'll file after this ). When no attempts to work with XXXX ( over multiple hours ) were helpful, and multiple attempts to call Mountain Summit Financial were successful, I filed a complaint on Mountain Summit Financial 's website. I finally reached someone at Mountain Summit Financial today who said they would review my complaint and get back to me with next steps by Wednesday -- They were able to open a fraudulent account in my name and issue funds in under 30 minutes over a holiday weekend, but can't be bothered to sort out a crime in the same amount of time... I'd very much appreciate your help investigating this company.

I applied over the phone for a short term loan in XXXX for {$700.00}, and more recently in XX/XX/XXXX for {$500.00} with the stated agreement that I would be able to pay it off incrementally with the agreed upon minimum payments being toward the principal, with the company to be owed the remainder as interest due within the payment period up to when the principal was paid. after a period of 6 months, wherein I was still receiving notices for payments owed and automatic withdrawals from my bank account. I found this odd because six months should be more than enough with the payments I had been seen being deducted to cover both the principal, As well as any interest. I contacted them only to be directed to an outsourced call center, who was only able to send me limited details for the loan, which that showed I had somehow put my digital signature on a loan agreement that instead stated I had agreed to a loan with an over 800 % annual interest rate wherein that the minimum payments were to cover the financing, and that I would need to manually submit ADDITIONAL payments to count towards the loan principal. This was/is in direct contravention of what I had agreed upon over the phone with the agent who submitted the loan. It is currently six months since the loan was issued, and I have paid into the loan for the full amount of the principal, and nearly an additional 100 % of the loan principal in financing fees and interest. I also discovered that unbeknownst to me, The previously completed loan term the year prior where the principal was {$700.00} and with the previously agreed upon terms, I had ended paid over {$2100.00} over several months without realizing. The company has refused to acknowledge my attempts to correct this issue and address their fraudulent and predatory conduct. They have undermined my financial security over a significant period of time, and have compromised my ability to even keep food on my table. The loan terms are purposefully obfuscated, and the information provided by their loan agents is/was outright falsified. I have been offered no recourse for this, aside from " buyer beware ''. Had they been forthright about the true loan terms, I would not have agreed. Instead, they took advantage of someone with limited information resources and with an extremely limited time frame of action, and lured them into an agreement under false pretenses.

Dear Lender, It has come to my attention that payday lenders must be licensed by the state of Florida in order to offer loans to its residents. Since your company has no license in my state, the loan contract I have with you is not valid. Under Florida statutes, usury is defined as the charging ( whether paid or not ) of interest that exceeds 18 percent on loans, lines of credit, advances of money or any obligation of amounts up to {$500000.00}, and that exceeds 25 percent for transactions involving amounts totaling more than {$500000.00}. Although I am not legally required to do so, I am willing to repay the principal balance of this loan. To date, I received a deposit of {$900.00}, and have had XXXX bi-weekly withdrawals of between {$310.00} and {$230.00} debited from my account. This results in a principal balance of {$1900.00}. This results in an overpayment of {$1000.00}. At this time I am requesting a return email acknowledging that my loan has been paid in full. Also, I would like a refund of the {$1000.00} overpayment. A refund check of {$1000.00} should be mailed to me at the address you have on file. I hereby revoke any and all ACH authorizations with your company from debiting any of my personal accounts, per Federal law, Regulation E Section 205.10 Pre-authorized transfers. I revoke any and all wage assignments I may or may not have signed with your company, I no longer authorize you, your company, or your affiliates to attach any part of my wages or contact my employer for your collection purposes. I have notified my employer about this matter so any attempts to do so on your part will be rejected. I demand that any contact be made through email only. I will need everything in writing to keep accurate records of all communication as per instruction from my Attorney General 's Office. On XX/XX/XXXX I was looking online for a loan and I came across this one apparently I have my information through them before but I never actually got a loan I hastily applied then when I accepted I noticed my bank account information was from 3 years before. I panicked and immediately called them the next morning trying to at least change the information they told me I had to wait XXXX business days to wait for it to return to them and that when they receive it back theyll reach out and I would have to do a new application because it during XXXX XXXX XXXX XXXX XXXX holidays i understand the slight delay but by XX/XX/XXXX they still hadnt contacted me about anything and one the portal on their website was already saying my first payment was due on the XXXX. So I called again asking about that because I hadnt even received the funds so why would be expected to pay back while Im the middle of waiting for it to return to them? The customer rep said to disregard and that they wouldnt charge that date. They said it was still awaiting return to them by this point this is already XXXX weeks or so at this point & nothing i called again on the XXXX and they implied that maybe the bank kept it because I owed money?!! And that I have to contact the bank ( XXXX XXXX XXXX ) to get them to send it back to them? even if I owed the bank I didnt owe them {$800.00} so where would the rest of the money go? And I currently work at a bank Mind you the account closed in XX/XX/XXXX and the loan was sent their allegedly on XX/XX/XXXX over 2 years after this account got closed. now its XX/XX/XXXX I havent received any phone calls except some emails now saying Im behind on payments and that Im past due on a loan I never even received. Im afraid this site is a scam or very sketchy one of the customer reps actually argued with me the interest rate was extremely high for just {$800.00}??!! And then to not even receive it the money anyway Im scared their gon na try to put this in collections & mess my credit up more. They arent even calling to say I owe just sending emails because the account is closed thats linked to the application I havent received the money they claim to not have gotten it back & since they cant charge that closed linked account theyre now saying Im behind on payments and this is attempt to collect a debt. I was not aware of the astronomical interest rate of 720 %, that would result in my final payout would be close to {$5000.00}. After the fact ; I did research on this institution and found out they are a Tribal entity. I was not aware of this fact. There are several complaints against this lending institution, as I have given an example of the BBB below. Government Action Golden Valled Lending, Inc. On XX/XX/XXXX the Consumer Financial Protection Bureau ( CFPB ) filed a complaint against Golden Valley Lending , Inc., Silver Cloud Financial , Inc., Mountain Summit Financial , Inc., and Majestic Lake Financial , Inc. Case # XXXX. The complaint from CFPB alleges that, The companies deceived consumers by collecting debts they were not legally owed. The CFPB also alleges that the four lenders could not legally collect on these debts because the loans were void under state laws governing interest rate caps or the licensing of lenders. The CFPB alleges that the lenders made deceptive demands and illegally took money from consumer bank accounts for debts that consumers did not legally owe. The case is currently pending. XXXX XXXX XXXXXXXX Here are the two payments that I have done up to now ; Pmt Number : XXXX Pmt Date : XX/XX/XXXX Pmt Mode : ACH Fee : {$300.00} Principal : {$50.00} Total : {$350.00} Pmt Number : XXXX Pmt Date : XX/XX/XXXX Pmt Mode : ACH Fee : {$280.00} Principal : {$50.00} Total : {$330.00} I called Golden Valley Lending to find out what the pay off would be if I paid early. For a loan remainder of {$850.00}, my pay off value is {$1100.00}, which I will pay on XX/XX/XXXX. I was not expecting such a high interest rate, thinking my loan would be about paid off by now, if not paid off. I was in for a huge shock. I made a mistake once and will not ever make that mistake again, it was supposed to be for emergency purposes. Remedy Sought : I would like to recoup some of the interest rate that was/is charged on this loan. This practice is highly questionable in my opinion.

Approximately three months ago ( i.e. XX/XX/2019 ) I began receiving SMS text messages suggesting that I had a delinquent loan. The messages were vague, but after receiving several of them, I called the number from which they originated. The person at the other end identified herself as an employee of Golden Valley Lending, and asserted I had taken a {$700.00} loan from the company she represented. I had, until that day, never heard of Golden Valley Lending, and definitely had not taken a {$700.00} loan from anyone. I said as much and, after a short exchange, determined the call was a phishing scam, and hung up. Since that time, I have received not less than 8 calls from Golden Valley Lending per week, originating from numerous different phone numbers. The most recent two are : * ( XXXX ) XXXX * ( XXXX ) XXXX I've blacklisted each new number as I've received the calls, which all adhere to the following format ( paraphrased ) : Golden Valley Lending : " Is [ My Name ] available '' Me : " This is [ My Name ] '' GVL : " This is [ fill in name ] with Golden Valley Lending. We're calling to discuss the status of your account '' Me : " I do not have an account with you ; I've never opened an account with you. '' GVL : " That's not what our records show. '' Me : " I can't account for your records, but we don't have anything to discuss. '' GVL : " Good luck with that. These calls will continue. '' I have repeatedly asked to be removed from their call list, and been denied. I have repeatedly asked for a written record of my debt, and have never seen one. I have received one printed letter via USPS, again vaguely suggesting I need to address some kind of debt-related issue but without any account number, amount, clear indication that the letter is an attempt to collect a debt, advisory of my rights, etc. It seemed to be merely a form letter that looked like it was designed to get me to call their office. I have checked my credit reports with three agencies to confirm no debt has been reported in the amount Golden Valley Lending has asserted. I have received no official attempt to collect a debt, and my credit score remains unblemished even though I've been ignoring these calls, more or less, for months.

On XX/XX/XXXX, I received a letter from : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, CA XXXX The letter stated that I was delinquent on a loan. I was instructed to pay the amount due by the due date. If payment was not received I would be considered in default. The letter further stated that if I did not notify them within 30 days after receiving the notice that I disputed the validity of the debt or any portion thereof, the lender would assume the debt was valid. No loan information was provided in the default letter. I never have nor would I ever apply for a loan with XXXX XXXX XXXX, which I believe is an online payday lender. I contacted the company using the site provided in the letter ( XXXX XXXX XXXX XXXX ) using the Contact Us feature and notified them that I did not apply for loan through nor did I receive funds from their organization. The organization did not accept my notice that the debt is not valid. In follow-up correspondence that I received, the following information was included regarding the invalid debt. Customer Information Loan Information Original Amount : {$1000.00} Fee on Appl. : {$300.00} Payment Due : XX/XX/XXXX Application Date : XX/XX/XXXX Origination Date : XX/XX/XXXX While my social security number and address were correct, all of the other information provided by XXXX XXXX XXXX is not. More specifically, phone numbers, e-mail, payroll, bank, and employer information is not correct. I do not have a XXXX XXXX XXXX account nor have I ever worked for XXXX XXXX XXXX XXXX XXXX failed to do its due diligence ( e.g., credit bureau report ) that would have confirmed that I am not the borrower. My situation is identical to the allegations, more specifically Collecting loan payment which consumers did not owe, noted in the action taken by the CFPB against XXXX XXXX XXXX on XX/XX/XXXX. I did not apply for a loan with XXXX XXXX XXXX. I did not submit any of my information to the organization nor did I sign any loan documentation. This company needs to be shut down for its inability to confirm the identity of its borrowers and aggressive collection efforts against individuals that I have not applied for credit with them.

In late XX/XX/2021 I had fallen behind in monthly bills and was seeking some relief. I went to what I thought was a direct-contact website where I would apply for a loan directly with a lender. Turns out I entered my information into a clearinghouse site and received several XXXX emails in the space of a few hours. Mountain Summit Financial was one of those respondents and I clicked on their page to apply. I do NOT recall signing a loan with SIX HUNDRED NINETY PERCENT INTEREST, nor would I have knowingly signed such terms. They were removing more than {$270.00}. every XXXX weeks, but now my bank account is frozen due to fraud that I no doubt incurred as a result of that original clearinghouse site. After removing the payment a number of times ( 4 payments would have repaid the {$1000.00}. principal and given XXXX more than {$92.00}. in interest ) I thought the debt would have been repaid, but the fifth payment came out and I started calling. Six times I called between XXXX and this week. One time i got through and I was told the XXXX financial instruments are " non-negotiable beyond original disbursement of funds. '' Following these calls, I noticed that the clearinghouse site added some fine print stating that loans originating from tribal financial services may have high-interest terms. This is a XXXX XXXX doing this, and if they are knowingly doing this to people, the whole shebang ought be shut down. As you can imagine, I can not afford to be saddled with a debt like this for five years. I am recently divorced and XXXX and I have a mountain of debt following my ex-husband wringing me out and setting me off to dry. Upon receipt of this form I called Mountain Summit Financial to report this fraud and was provided the following information : When asked why I have never received any statements regarding the opening of this account, request for payment, or the delinquency of alleged loan payments, I was informed that Mountain Summit Financial is an on-line only institution and would have sent emails to the fraudulent email address used in connection with opening this fraudulent account. When asked why I am unable to see any credit inquiries on my credit history regarding this fraudulent account, I was informed that Mountain Summit Financial does NOT use the XXXX major credit bureaus when decisioning to provide loans. When asked how Mountain Summit Financial performs required verification checks, also known as Know Your Customer or KYC controls as required by federal regulation to ensure it is actually doing business with the correct person, I was told that additional detail could be provided during the fraud investigation. I have continued to receive communications by e-mail for several payday loan companies saying I still owe money which I went through a payday loan relief company to payoff any that I did have and that has all been completed over 2 years ago. I feel as this whole scam of payday loans is unfortunately somehow allowed to continue as they probably figure that people forget and will probably give up and pay what they say. Also my husband and I went through bankruptcy which was completed last XX/XX/XXXX and there were some loans that were applied in the bankruptcy but the companies never pursued in a timely manner with the bankruptcy rules and then were not included. Everything was paid in this plan. XXXX had a Revocation of Authority to Contact Third Parties and if any companies tried to do this it is considered a violation of the Right to Financial Privacy Act, 12 USC 3401. Just as a note ; GOVERNMENT ACTION Golden Valled Lending, Inc. On XX/XX/XXXX the Consumer Financial Protection Bureau ( CFPB ) filed a complaint against Golden Valley Lending , Inc., Silver Cloud Financial , Inc., Mountain Summit Financial , Inc., and Majestic Lake Financial , Inc. The complaint from CFPB alleges that, The companies deceived consumers by collecting debts they were not legally owed. The CFPB also alleges that the four lenders could not legally collect on these debts because the loans were void under state laws governing interest rate caps or the licensing of lenders. The CFPB alleges that the lenders made deceptive demands and illegally took money from consumer bank accounts for debts that consumers did not legally owe.

On XX/XX/2020, I called Mountain Summit Financial customer service to make a partial payment on a loan. After requesting to make an early partial payment to reduce my amount owed, the agent informed me that she could only accept full payment to pay off the loan or increase my payment to the scheduled payment day, which was in 8 days. I explained that I wanted to make an early payment because of the high compounding interest of 776 % and requested to speak with a management member because it didn't make any logical sense that I couldn't make a partial payment. She replied, " I am the floor manager. '' I then requested to speak and have the name of the office director. She replied, " I am the manager and can't give you the name of the director. I received an email from Mountain Summit Financial about me being preapproved for a loan so I contacted them about getting a loan but at first they were trying to charge me way too much interest in the loan but then they agreed to a better price and I was supposed to be paying them two payments of XXXX. The first payment was due on XX/XX/2017 and the second payment was due on X/XX/2017, but today I was going to tell them they can just take the XXXX that is due on X/XX/2017. But, due to my surprise when I typed in their website publications popped up from the Better business Bureau and other government sites saying that Mountain Summit is not licensed to conduct payday loans or collect on them and that they are currently being investigated by the BBB. The Washington State Department of Financial Institutions urges consumers who have gotten payday loans from Mountain Summit Financial to contact the Federal Trade Commission to report identity theft because of the nature of the personal information that has been collected by this unlicensed company. Because according to them that have not right to issue payday loans or collect on them. So today on X/XX/2017 I contacted Mountain Summit Financial to ask them about these allegations and their current investigation and to get clarity on their situation because I currently have a loan with them and I do not know if my information is safe or if this loan is legal. However, they would not answer any of my questions and so I informed them that I would be contacting the BBB and the FTC to figure this out. I foolishly accepted a loan from XXXX XXXX XXXX in the amount of {$1400.00}. XXXX XXXX XXXX is a predatory payday loan lender. The payment schedule is {$490.00} per pay day which is extreme. Per South Carolina law ( where I reside ), payday loan lenders can only charge up to {$15.00} per {$100.00}. On a {$1400.00} loan, the fees collected should be {$210.00}. On XXXX XXXX, 2017, I received a text offering a payday loan. Since I was in financial need at the time, I clicked on the link in the text and filled out the online form. I then received a phone call from a woman at XXXX XXXX XXXX who walked me through the steps to get approved for a {$1000.00} loan. When I asked the rep how much this loan would cost me, she informed me that with the interest, the total amount to pay back was {$1100.00}. I received an email stating that my loan was approved and the funds were on the way. After making my initial payment of {$330.00}, I noticed that the loan balance had not decreased very much, so I contacted the company. A rep informed me that only {$50.00} of my payment went to the balance and that the rest went to interest. The rep then emailed me an interest statement that I " allegedly signed '' agreeing to an astronomical interest rate of over 600 % and that the cost of the loan was actually {$4000.00}! I never signed this interest disclosure and was not ever made aware of anything that was included on it. After further review of the disclosure, I realized that my name was n't even spelled right on the document and the electronic signature, with my name spelled incorrectly, was time stamped for XX/XX/XXXX at XXXX. The loan approval email was received on XX/XX/XXXX at XXXX. How could I have signed something at XXXX when the loan was already approved and the funds were being transferred at XXXX. I contacted this company to see what help they were providing customers like myself during this pandemic. The best they would do is place one payment at the end of my payday loan, which is no different from what they would do as one-time courtesy outside of this worldwide pandemic. I told the representative that I was unable to keep up with these payments. The representative offered no help. The representative went on to say that missed payments would be subject to the terms and agreements documented in the contract. In speaking with a friend about it and describing the loan I was in, the person informed me that payday loans are illegal in Massachusetts given the high interest rate that exceeds the lending requirements of the state. I was also informed that this loan falls under predatory lending and violates Massachusetts law. I went to the Massachusetts website to obtain more information. The website did have information stating payday loans being illegal in Massachusetts. The original loan amount was XXXX dollars. The company is withdrawing more than XXXX dollars out of my checking account every two weeks. The interest rate on this loan is 584.6071 % and I'm paying close to 700 dollars per month, most of which is interest. When I took out this loan, I did not realize how high this interest would be. I accepted a payday loan of {$300.00} from XXXX XXXX XXXX on XX/XX/XXXX this year. When I accepted the loan I was told that {$360.00} would be the total amount I would pay back. I have payed approximately {$280.00} of the {$360.00} amount I was told I needed to pay back. After receiving an advance notice of an upcoming {$96.00} withdrawal scheduled for XX/XX/XXXX, I took a close look at my current principal balance and saw that my {$280.00} payback amount had only reduced the balance from {$360.00} to {$330.00}. I found that most of my payments had covered finance fees undisclosed at the outset of the loan. Some of these fees were in as high as {$85.00} per {$15.00} borrowed. At such an interest rate, I would have to pay them more than {$3000.00} in total for my {$300.00} loan, which I can not afford. Shocked, I did some research on XXXX XXXX XXXX and discovered that they are not licensed to conduct business in the state of Illinois ( where I live ). In addition, their finance fees are far in excess of Illinois laws that cap such fees at {$15.00} per {$100.00} borrowed. Every two weeks {$100.00} was taken out of my account and I was notified a couple days before every withdrawal, but when I tried to contact the company and access my account on their website to keep track of the withdrawals and the payment schedule I was denied access. On XXXX XX/XX/2019 I was sent three emails from XXXX asking if I was applying for loans. I responded, NO I was not. I received a letter, dated XXXX XX/XX/2019, from Silver Cloud Financial Inc. notifying me of an unresolved balance on " my '' account. The letter did not have any amount, just an account number. I called the number on the letter ( XXXX ) and spoke with XXXX ( supervisor ) on XXXX XX/XX/2019. I gave her the account number on the letter and she said I would have to give my Social Security Number. I refused and said this account was fraudulent setup without my consent. She said I would have to email : XXXX. On a side note : the XXXX phone number had been calling my cell multiple times each day since XXXX XX/XX/2019. I emailed on XXXX XX/XX/2019. They responded back on XXXX XX/XX/2019 requesting their " Identity Theft Victim Complaint and Affidavit '' form to be completed along with sending copies of my personal identifiable information ( PII ). I received another letter dated XXXX XX/XX/2019 stating that 'If you do not pay the amount by the next due date your loan will be considered in default '' The letter did not have any amount or due date listed. It also stated that " unless you notify us within 30 days after receiving this notice that you dispute the validity of this debt or any portion our office will assume this debt is valid. ''

I received a letter ( in mail ) from Golden Valley Lending ( 'GVL ' ) regarding the pending default on a loan. I have never had a loan or done any business with GVL. I called the customer service number and they indicated it was a for small unsecured loan of {$1000.00} distributed via ACH on XX/XX/2019. No such distribution was received and I believe that, if the distribution ever occurred, it was done fraudently to another individual using my information. Per directions, I initiated a complaint with the complaint department at GVL. They have indicated that the actions have been placed on hold for 30 days for supporting documentation to be provided. Since that point I have initiated fraud alerts with the credit reporting agencies ; am working to provide the requested information including a filed complaint with my local law enforcement agency. In addition, I am in the process of filing an Identity Theft report with the FTC. Personally, I believe that the loan may never have occurred and GVL was using the letter and other actions as part of a larger scam. I have no evidence of this, however, I have read several accounts online, including this site, of others having this problem with GVL. My understanding is that filing this complain will allow me to see what documentation GVL has with regard to the alleged loan.

I was very unfortunate enough to come across this company for a short term loan I needed when I lost my job to pay bills. I took out a loan for $XXXX to pay for the bills, and was under the impression that I would make monthly payments on the loan. What I later found out is that the payments would come out every two weeks and would basically cover interest with very little going towards the principal, I made 3 payments of $XXXX towards this loan and still owed over $1000 after the fact. The lending practices of this company are predatory, and they lock you into payments that go well beyond the principal and normal interest rates which I verified and are highly illegal in the state of Florida on top of the fact that they are not even legally registered to conduct business in this state they have no license. To date, I have paid back twice the amount I have borrowed, and am expected to pay three times the amount of what was borrowed. This company is praying on individuals who have an immediate need and turn this nerd into an ongoing. Financial hardship. Charging close to 300 percent interest on their loan. You can not gather information from their website on your loan, get any documents anywhere and can barely contact them whatsoever. This is unethical and should be considered illegal practices by this organization.

Also, I knew that it is a crime in NJ to issue a loan for more than XXXX APR, ( The criminal usury limitations ( N.J.S.A. 2C:21-19 ). The company was charging me {$XXXX} every Monday. On or about XX/XX/2023, I submitted a loan request and it was received and processed by Ascendloans.com. It was approved and funding would be complete by XX/XX/2023. I noticed in my final loan docs, I could not make any changes, only submit? Once submitted, I went through to print my docs and discovered Ascend had my routing number incorrect? I immediately contacted Customer Support and spoke with a Rep, who stated not to worry, once the Loan rejected for incorrect routing, they could resubmit again. Golden Valley Lending sent me a letter dated XX/XX/2020. I received the letter from Golden Valley Lending on XX/XX/2020. The letter stated that there was an unresolved balance on the account. I called Golden Valley Lending on XX/XX/2020 @ XXXX. I have a {$1000.00} loan with XXXX XXXX XXXX that was initiated on XX/XX/2019, with my first payment being made on XX/XX/XXXX. The payments are extremely high and extremely frequent. They call it an installment loan but in effect it is a payday loan that circumvents the California {$250.00} limit on payday loans because they are a XXXX XXXX XXXX. However, they still collect payments on paydays rather than monthly. At the start of the repayment plan, each payment every 2 weeks surpasses {$300.00}. I knew this when I accepted the loan and knew money would be tight however I'm reaching a point where payments of this frequency are going to cripple me. I've had to miss work to get dental work done. A monthly payment at a lower amount would be much more manageable for my current financial situation. Otherwise I don't know what's going to happen in the next month. These payments could spiral me into inescapable debt, largely due to the biweekly collections resulting in over $ XXXX/month due. I began the application process of applying for a loan through Mountain Summit Financial online. However, when it got to the point of signing documents, I decided that I would not go with proceeding with the application, therefore I did not sign the documents. However, I received an email on XXXX/XXXX/17 from Mountain Summit explaining that I was late on a payment for a loan I " supposedly '' received from them. Because I never signed the documents, I never received a deposit from Mountain Summit Financial in either of my accounts that I hold with XXXX, however they charged my account with a return fee because they tried to retrieve funds that were not there. I took a loan for {$700.00} on XX/XX/2017 via the internet. I made arrangements to have the payments taken directly from my checking account. I made 2 successful payments. I was contacted via e-mail to notify me that my next payment was being made. It is then when I noticed that my payments of {$240.00} and {$230.00} had resulted in a remaining balance of {$810.00}. I still had not received a paper or digital copy of my agreement. I tried logging in and they made that difficult to do. XX/XX/2020, I received multiple emails thanking me for applying for loans. Later that night, I also received notices from credit bureaus that XXXXXXXX XXXX XXXX had accessed my credit files. InXX/XX/2017 I signed up for what I initially believed would be a payday loan from XXXX XXXX for XXXX dollars. Just enough to pay my rent. When I initially agreed to the loan, it was presented in such a way that I was made to believe that I would make four large payments and the loan would be paid off. It appeared that I would pay around 200 dollars for a XXXX dollar advance, which I was okay with. However, after the four payments were made they kept taking payments out of my account in the amount of 150 - 250 dollars per check, with only 35 - 45 dollars going toward the principle. That is when I realized what it was that I had actually signed up for. At that point, my only option was to pay off the principle, something that was nearly impossible to do when they were taking XXXX dollars a month from my check before I even saw it. This loan has cost me around 2600 hundred dollars so far and has made me perpetually late on all of my other obligations, destroying my credit in the mean time. This has also kept me in a payday cycle that has made it nearly impossible to stay afloat.

My Daughter took out three pay day loans online from three different agencies. One was called XXXX XXXX, In XXXX XXXX, and the third was XXXX XXXX XXXX. She ended up being late on all three accounts. All three online loan companies do not follow the regular mandated rules by the state on which the loan originated. Instead they were all three routed through different reservations and all were charging 7.9% interest daily 2,883.5% interest rates per year. When I called to make restitution's for these loans only one company agreed to take a check from her father. I am a little confused by this, it should not matter who is paying the debt along as the debt is being paid.Would like to see the online lending loan sharking business to follow the state's guidelines where the loan was originated. Hence a Drop Down box on the state. If you are borrowing from XXXX, XXXX, XXXX,etc. They could charge you no more interest than the state would allow. This loan was obtained in 2017 and due to being laid off in XX/XX/2017 the loan was eventually defaulted. My bank account at the time was extremely negative and the bank closed the account. I received a billing statement ( XX/XX/2017 ) about a loan that was taken out in my name. The company is " Majestic Lake Financial ''. The letter insinuated that the company had been corresponding with me but I had never even heard of this company until the statement was opened. Curiously, the bill was lacking an amount owed, requesting me to call for a billing amount. I have 16 payday / installment loans. I live in the state of Illinois. I was not aware that, by law, I should not have been allowed to have more than three & that they should not total more than 22.5 % of my income. Why 16 loans? I have entered into a debt management program and I had let the company know this by leaving a comment here and leaving a message on their " Contact us " form on their website. This had happened one time before with this company and my wife spoke with them back in XXXX about it. They are doing this thinking we won't notice it and then have to repay them the money with interest a ridiculous interest charge. This is fraud plain and simple. The first time, someone tried to take out a payday loan from Golden Valley Lending in my name and have the money go into a XXXX XXXX XXXX Account that does not belong to me. I called Golden Valley Lending and let them know that the account is NOT mine. They stoppped it that time and I let them know to deny any other loan going to that account that is not mine. They said they'd make a note of it. This afternoon, I received an email that it was done again and still going to the same XXXX XXXX XXXX account. I tried calling but they're closed on Saturdays. I received a loan of {$1200.00} and signed the documents while XXXX and not reading the details. After receiving the loan I noticed the payback amounts were astronomical. I then looked at what the payday loan laws of my state were and these loan payback amounts are way above the state of NJ laws on how much a lender can charge in interest. This company claims to be exempt from state laws due to their tribal affiliation, however they are using the tribal law affiliations to thwart state laws and to act as a predatory lender.
