According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and respect for the consumer 's right to privacy. XXXX and XXXX are consumer reporting agencies and I am the consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states " It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers ' nonpublic personal information. " ( Furnisher of information to credit agencies ) is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. The financial institution and the Consumer reporting agencies XXXX and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a non-affiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. You never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under Subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. " This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s-2 ( A ) ( 1 ) " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681 e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. '' XXXX and XXXX are not maintaining reasonable procedures. Also 12 CFR Subsection 1016.7 states that " A consumer may exercise the right to opt out at any time. I am opting out of your reporting services.

I engaged with Transformers for an emergency loan in the fall of XXXX. I was approved for the loan and then through the process was advised I needed to add a cosigner which I thought was odd being that I had already been approved. I went ahead and added an additional cosigner to the account since it was an emergency need for funds. Since engaging with transform credit, I have requested access to the initial agreement to review since I noticed billing issues and double charges for interest most recently in XXXX after being ahead in payments charged over 60 % in interest charges which is outside the original interest rate. I requested a copy of the agreement in XX/XX/XXXX, the agreement that was sent to me was not for my account but for a separate account that I did not authorize. As a result, I put a fraud alert on my social security number and contacted customer service that I did not have any additional loan and requested a copy of my specific loan, which I never received. As a result of unforeseen hardship occurring in XX/XX/XXXX, my financial situation changed. In XXXX, I hired a debt management company that has a POA and is legal representation over the debt to negotiate the account to resolve the debt as quickly as possible in lieu of filing for bankruptcy. I informed transform credit that I had legal representation and had to join a debt management company. I requested them to work with the attorney from the debt management company to get the account resolved as soon as possible. I also put them on notice that they needed to cease all automatic payment attempts and that they needed to work with the debt management company for payment matters. I also noticed transform credit that they needed to cease contact with the co-signer and me and communicate only with the attorney. Transform credit personnel proceeded to e-mail me multiple times and the cosigner threatening litigation, threatening damage to the credit report, threatening to garnish or place lien on assets and more. In addition, sent additional communications that the account would be autopay even after being notified to cease any automatic withdrawals and payments and work directly with the attorney. I have attached all relevant documents and screen captures of behavior. I'm deeply concerned about XXXX credit 's stance and what appears to be violations of federal regulations and statutes when I've engaged to trying to have a positive resolution on both sides of the aisle.

Application & Extension of Credit : On XX/XX/, I applied for a loan via Transform Credits platform, thereby extending my consumer credit. Subsequent to my application, I was surprised to find that a co-signer requirement was imposed, which was not clearly communicated initially. Unexpected Enrollment in XXXX : On XX/XX/, I was informed by Transform Credit about my enrollment in their XXXX XXXX, which I neither explicitly opted into nor was aware of its implications. I learned that I would be charged $ XXXX monthly, reported as interest against a loan held on my behalf, without actually receiving said loan. This arrangement was unfamiliar and not part of my primary intention. Co-Signer Requirement Clarification : A subsequent communication on XX/XX/, reinforced the co-signer requirement, explaining that all of Transform Credits customers must have a co-signer. Concerns : Lack of Transparency & Potential Misrepresentation : My application was accepted, and in good faith, I extended my consumer credit. However, the introduction of additional stipulations, such as the co-signer requirement after application consummation, seems contrary to transparent business practices. Possible Violations : The aforementioned practices may be in violation of multiple U.S. codes and regulations. Specifically, these actions appear to contravene : The Consumer Credit Protection Act 15 USC 1602, 12 CFR 1026.19 ( e ) ( 2 ) ( iii ), 12 CFR 1026.19 ( e ) ( 2 ) ( ii ), and related provisions. 215.3 regarding extensions of credit. Discrimination against a consumer for exercising rights under consumer protection laws. Unauthorized Credit Activity : Transform Credit reported on my consumer credit without delivering any tangible benefit to me, a potential violation of 15 USC 1602.

I am a cosigner on a loan issued by Transform Credit. For several consecutive days ( XX/XX/23 XX/XX/23 ), they have sent me menacing text messages, even indicating they have tried reaching me by calling and emailing as well. An invitation is given to make arrangements when payment is not made on the due date. The person who is primary on the loan has followed through in making payment arrangements, but those arrangements are never honored by Transform Credit! Even though the arrangement is made within their system, they say it is not a formal payment arrangement but term it a payment note. Their texts to me continuously indicate the number of days past due, threaten processing on my banking account, threaten legal action, threaten efforts to collect the full amount due immediately, threaten my having to come to court and face having a judgement filed etc. Irrespective of the payment arrangement scheduled by the primary loan holder, they have moved forward to collect from my financial account ( several days ahead of the date arranged ). Also, they once collected from both my and the primary loan holders accounts in the same month for that months payment. They would not return the duplicate payment, stating it would go toward the next months payment. ( Thankfully, my bank did return the duplicate payment to my account. ) If Transform Credit is going to offer to allow one to schedule a payment arrangement, can they at least be required to honor the date that is set?

On XX/XX/2023, Transform Credit Inc report a new installment loan account to my XXXX credit report with a balance of {$3100.00} with a monthly payment of {$5.00}. In XX/XX/2023, I applied for Transform loan but was informed that I needed a co-signer in order to receive it. I could not identify a co-signer at the time so I never received the loan. I was shocked to receive an alert that the loan had been added to my credit report and I never received the funds nor completed the promissory process. I disputed the results with XXXX on XX/XX/2023. Transform emailed me on XX/XX/XXXX and explained via email that when I applied for the loan with them, " each month you pay {$5.00}, which we report to the Credit Bureaus as interest against a loan that is held on your behalf. These successful payments build up your credit history, helping to improve your score. Once the 24 months have passed, or if you decide to cancel/stop paying, XXXX is simply marked as paid in full ''. They claim that this service is optional, but I was unaware when I applied online and never received a receipt for these {$5.00} payments so do not recall ever making such a payment. Even though I cancelled the XXXX XXXX XXXX, Transform told XXXX that the {$3000.00} loan should " Remain '' on my credit, which is completely inaccurate. Having an installment loan reported in this amount and I have never received funds for a loan is misleading and negatively impacted my credit score.

XXXX XXXX checked his XXXX credit report XX/XX/2023 and reviewed all the relevant accounts and information that was being presented that day. XXXX also contact XXXX to discuss account information that XXXX felt as not accurate. XXXX on or around this date at reference herein, notified XXXX that the account with a merchant loa servicer, doing business as XXXX XXXX, was a merchant lender XXXX was not recalling ever having done business with. XXXX then placed a fraud alert on his credit profile with XXXX, exported the concern to XXXX for their investigation and is now filing this complaint, and will at a later date, file a police report consistent with this same information being provided herein. XXXX has contacted the alleged merchant lender, displaying information on his credit profile as an alleged creditor, XXXX XXXX, and upon entering his information was advised he as a co-signer on a loan he had no knowledge of ever agreeing to be affiliated with, and was then directed to a chat prompt and disconnected from the call. A screen capture of the chat prompt, following the disconnection from the call is included in this complaint for review and consideration. This account was executed and initiated without any knowledge from XXXX or consent, and XXXX has reported this concern to all respective parties, and will now move forward with an official police report concerning this matter as well.

My personal information was used to forge a signature on a personal loan through a person I don't know in another state through Transform Credit. Although I could not tell whether it was a phishing email, I received an email with documents outlining a loan that had me forged as the cosigner/guarantor on a loan, but the email did come from the Transform Credit email address. On the loan documents my name was spelled wrong and the address used was an old one. It appears that Transform Credit failed to do any due diligence to verify the identity of the guarantor. I am not sure if someone was able to find pieces of information to use my identity for this fraudulent behavior or this is a more serious breech of identity theft. I reached out to Transform Credit to tell them that this application was fraudulent, that I never signed to be a cosigner and that they needed to cancel the loan. I have yet to receive a response from Transform Credit. The email was sent on XXXX XXXXXXXX XXXX from XXXX for a loan application. I emailed back to XXXX immediately because this was the only contact information on the Transform Credit website. Two documents were attached to the email outlining the cosigner agreement and the loan information. The loan was a credit loan for {$3200.00} with an APR of 35.99 % in the state of Georgia ( a state where I do not live ).

I received a notice of my applying for a {$7000.00} loan from a company named Transform Credit which I have NEVER applied for any loan through this company. I finally contacted them but could only text with them which they refused to give me any legitimate contact information for the company ( ie ) a phone number to call, a legitimate physical address, but insisted I give them my personal information via text without my verifying the company as legitimate - which I unequivocally refused to disclose information via text message with an unknown person without actual information that could be verified about this company. I was told that they only take legitimate applications, however, a neighbor actually got a ding on her credit report from none other than Transform Credit for a XXXX loan and she has never applied for a loan either. As far as I am concerned, this is Identity Theft and I want this company to identify itself, its phone number and physical address so that I may proceed to stop the identity theft and identify this company. I want to know who the party was that applied in my name and if they do applications online, then they have an IP Address and other information to provide to me. Just telling me they cancelled the application is not sufficient, as they processed an application and used my info without my consent.

Just got an email purporting to claim that I am a co-signer for a credit application for a " XXXX '' with Transform Credit Loan and purporting to attach a guaranty and imdntiy informaiton along with a promissory note. Fearing a phishing attempt, I am not opening these attachments. Hello, I cosigned on a loan for an acquaintance in medical school and now that individual is unfortunately no longer responding to me and I have decided to default in the loan. XXXX : I expressly requested via text that the lender not deduct funds from my account XXXX : I was called by TransformCredit to confirm a payment for the collections. I informed the rep that I did not want to move forward continuing these payments, understanding the risk of defaulting. She verified the consequences ( eg litigation, wage garnishment ) and I verbally confirmed and she stated she would remove my bank routing number. XXXX : the lender messaged me via email that they would charge my account and to confirm funds. The amount was deducted anyway and I responded on XX/XX/XXXX to request again that they do not continue deducting from my account XX/XX/XXXX : despite the full amount collected ( bringing me out of potential default ) they say I am still at risk at defaulting. At this point debt has been collected. I understand my obligation is contractual however I am trying to separate myself from this individual financially. Yesterday this " loan company '' called me inquiring about co-signing for a loan for someone and I specifically told them I do not approve of this and they can cancel the application. I am a XXXX XXXX, I was working a 16-hour shift when I got several notifications on my cellphone from all 3 credit bureaus stating that a loan was taken out in my name ( unknown to me and unauthorized ) and someone had forged my signature! I called the loan company as soon as I got off of work at the number that was on the loan document, and the number they called me from yesterday while I was working but they are not reachable. I suspect that this " loan company '' is a scam/ not accredited because of the XXXX report and the complaints. I have left a voice mail for the loan company to call me back but I have not heard from them, I have even emailed them, and no response. Someone took a {$7000.00} loan out in my name without my consent, this is unprofessional conduct on their part because I told them that I do not approve and to cancel the application when they called me at work yesterday! I need the GM to reach out to me immediately because I don't want my credit to suffer because of this.

On XX/XX/2022, I received an alert from my credit monitoring company, XXXX ( part of XXXX ), that an inquiry had been made on my credit report on XX/XX/2022, from Transform Credit , Inc. ( Transform ). When I subsequently contacted XXXX, I learned that someone had applied for credit from Transform in my name using my personal information. Because I had no knowledge of this application and had not authorized it, XXXX informed me I was a victim of identity theft and put a fraud alert on my credit report. However, when I attempted to alert Transform about the fraud and identity theft, it would not answer the phone and said it would not provide a call back. Instead, Transform texted me back requesting personally identifiable information to find my account. I responded that I do not have an account with Transform, had received a credit alert that it had made an inquiry on my account, and I was not willing to provide my personal information by text. Instead, I informed Transform that if I did not hear back from it, I would file a dispute with XXXX and a complaint with the CFPB. I subsequently emailed and wrote a letter to Transform and still have not heard back.

Dear CFPB, I am writing to bring to your attention an issue I have experienced with Transform Credit. I recently accepted an offer from XXXX Transform Credit for a credit amount of {$7000.00}, with the condition that I provide a co-signer. However, I have since discovered that Transform Credit did not provide any consideration for my intellectual property, despite my contribution being a significant factor in their decision to extend the credit to me. Furthermore, they have kept my securities and have not provided any form of compensation for them. This conduct by Transform Credit is in direct violation of the XXXX XXXX XXXX and interstate commerce regulations. As a result, I am seeking your assistance in addressing this matter and seeking redress. I believe that Transform Credit 's actions are unfair and unreasonable, and I am concerned that their behavior may be indicative of a larger pattern of misconduct. My daughter took out a loan with this company and I was the cosigner on the loan. My daughter set up pymts to be taken out weekly from bank. They stopped taking pymts. I tried to send a check but the check was sent back. Their excuse is the loan is ahead so therefore no more pymts will be taken out. Now the loan is back up to over a XXXX. I want the loan paid off so we can move on with life. They are waiting for it to accrue more interest before they accept any more payments. That is unfair to allow the loan to continue to rise and we aren't allowed to pay it down. SCAM FOR MORE MONEY IN INTEREST. They will not answer the phone or email. They keep saying you can make extra payments but it will be sent back. No wire transfers, bank checks or anything. They will text back with ahead of payment schedule so no pymts will be taken out. No one will get in contact with us .We need help with this.

On XX/XX/2022 at XXXX XXXXXXXX XXXX I was offered a loan and promissory note. I read I did notice the part about my guarantor. However I said nothing about guarantor signing a separate promissory note. To me this appears as though this lender is attempting to receive 2 ( two ) signed financial instruments as of it were two separate loans on one side and one loan out here in the public. I wasn't comfortable for this reason as well as I'm not going to be surety on a loan that is to be deposited into someone else 's account regardless who my guarantor is. I highly doubt you would either. Now that they have my signed promissory note " witch is considered as currency by XXXX and the Federal reserve. So in my eyes there had not been an even exchange. No equity. This is fraud. I want full legal recourse and remedy to the fullest extent of the law.

I authorized this company to take a payment off of my debit card on Saturday, XXXX, XXXX, 2023 in the amount of {$140.00}. This amount came out of my account that same day. They then proceeded to send me an email and text message telling me my payment failed when they took the money out of my account. The phone numbers they have listed do not work and you can not speak to anyone. Ive tried to email them and they have refused to respond. The company preceded to send me and my mother messages threatening to send us to court for the money they already received from me. My mother went online to process the same payment that they took from me and they charged her double which was {$290.00}. They credited her double payment but never credited my payment that came from my account.

On XX/XX/2023 I discovered and applied for a loan with Transform Credit but had second thoughts after being told I need a co-signer and decided to look into other options. On XX/XX/2023 I reconsidered Transform Credit but was not able to meet their requirements and decided to opt-out entirely. Today on XX/XX/2023 I discovered a charge made from Transform Credit on my account for {$5.00} though I have not yet borrowed from them, as was explained I am not able to get a refund though I should but I can withdraw my application by sending an email. At the email provided I sent Transform Credit three emails along with calling and leaving a voice message informing them I am no longer interested in borrowing, nobody has gotten back to me. I find this to be a great inconvenience.

On XX/XX/2022, I received a credit inquiry from Transform Credit , Inc and a new address on my credit report : XXXX XXXX XXXX, XXXX, GA. This is my sister 's address and not mine. The report says that there was new address activity on my report which was this address. I tried to contact the company and they only texted me. I have also emailed them with no response. I am still unable to tell who attempted to use my credit. I have a credit inquiry and new address on my credit report that is not mine. I have frozen my credit reports and filed a police report but I need an investigation into this matter as I plan to press charges. Please assist me in this investigation if possible.

On XX/XX/09 I applied for a loan with Transform Inc. They said they could loan me XXXX which I never received. Instead on my credit report shows I owe a company called credit builders {$390.00}. XXXX dollars was taken out of my banking account. I reached out XXXX XXXX immediately because I wasnt sure if it was fraud. All I got was a voicemail. You can not speak to a human. So in panic I signed up for XXXX XXXX XXXX, which is XXXX a month and took me lots of time to figure this, a couple days later I did get a text from XXXX XXXX. No one at this company ever calls you on the phone. They do everything by text or email. I feel that this is a bait and switch company.

XXXX had a security breach in witch my personal info has been out. Someone has been using my SSN to attempt to open credit cards and bank accounts. The company never gave me any money but still charged me for a loan I never received. I was able to find a company near me when I applied for it. But now I cant find XXXX at all, and XXXX cant get ahold of the company regarding this issue. Ive called multiple times, emailed, tried to contact XXXX to see what my options are and I still have not found a solution. I dont and will not pay for a loan I never received. Its wrong and unfair.

Since XXXX my credit score has been decreasing a lot I was in XXXX - XXXX range and I couldnt figure out why considering I only have 1 missed payment and I closed that account, after awhile I looked at my XXXX credit report and seen a personal loan took out in my name XX/XX/ for XXXX. Sometime in XXXX I completed a loan application with Transform credit. There was not an option for a " cosigner '' to input their information, they instead have to complete a separate application. Therefore there is no cosigner, this is misleading information. Secondly, they have a signed promissory note already but is withholding my funds. Third, they continue to draft my account despite XXXX not releasing the funds for the loan and me calling them and stating they did not have my permission to do that and I needed to be issued a refund.

Went to transform credit to get a loan to clear credit card debt.
