On XX/XX/XXXX I and my son went to XXXX XXXX to take a look at a vehicle for myself. I requested to see a used XXXX XXXX XXXXXXXX XXXX XXXXXXXX that was offered at around $ XXXX. I and my son were taken out to take a look at the vehicle then the rep took me for a test drive in it. My son remained at the dealership until we returned. Upon arrival back to the dealership, I was speaking with my son concerning the vehicle and asked him to drive it to tell me what his opinion was. After receiving a decent opinion from him, I began speaking with the auto representative of whom I informed that I had a pre-approval from my credit union. He then invited me to sit down with him at his desk while he spoke with me concerning features on and in the vehicle. During the conversation with the rep, I inquired about obtaining GAP for the vehicle if I decided to purchase it. He mentioned that they had it for {$1000.00}. I stated that I didnt want to pay that amount for it because I could get it from my credit union for {$390.00}. He then stated that he would provide it to me for the amount that I quoted. He then began to go back and forth, in and out of his office to speak with colleagues regarding the vehicle. He eventually mentioned that their establishment could give me a better rate than my credit union and later on he introduced me to the finance manager. We were out in the lobby area and the lady came out claiming that she had a credit union that would give me a better rate after they inquired as to what rate Id been given by my credit union. I said 6.2 and then she stated that she had a credit union that would give me a 5.4 APR ( XXXX XXXX XXXX XXXX ). I mentioned that I wanted to discuss it with my son. The male rep then asked why do you need to discuss it with your son? Dont you like saving money? I responded in the affirmative but told him that I still wanted to do this. I walked over to my son to discuss matters and then we stepped outside to call my daughter to get her opinion too. After speaking with the both of them, the agreement was if I were going to get a 5.4 APR and save money, then that was a decent offer. I decided that maybe Id take the vehicle. We returned back inside and I continued speaking with the male rep in reference to the vehicle. He then took me to the female financial manager 's office to speak with her. She took me into an office to a computer that she had documents on. One of the documents that she asked me to sign was one that she stated would grant her permission to retrieve my credit for XXXX XXXX XXXX XXXX. I agreed to allow that, since they were the entity that she stated would be offering the 5.4 APR, so I signed the document. She completed whatever documents and told me that XXXX would be sending me documents to sign later via electronic signature. She then took me back to the male rep, who took me to the vehicle to explain how some things worked prior to letting me depart with the vehicle. On XXXX XX/XX/XXXX at XXXXXXXX XXXX. I received a text message from the female asking if she had the correct phone number for me. I responded in the affirmative, then the mess began with her ( see text messages ). On XXXX XX/XX/XXXX I texted her after two failed attempts on her part to obtain financing because the 2nd financial institution ( XXXX XXXX ) that she tried rejected the request. When I inquired as to what was going on, she responded I dont know. I then called her up and told her how about I just bring the vehicle back there and put it back on your lot and be done with it? She claimed that she was getting it taken care of. When I inquired on XXXX XX/XX/XXXX, she responded stating that she sent all of the signed documents to Town Bank, I never signed ANY documents for that bank. I only signed documents for XXXX XXXX and XXXX XXXX. They both sent me documents to sign when I was supposed to be financing with them and both institutions rejected the contracts. I also have copies of the documents that I signed with both institutions. There should not be ANY documents signed by me with TOWN BANK. I never agreed to conduct business with them and I did not sign any documents with them. If they have a document with my signature, then she ( or someone else she got ) manipulated them. On XXXX XX/XX/XXXX I messaged her regarding my credit report. I was checking on my report and had seen that she pulled my credit about 4 times, This made me extremely angry because I was only aware of her supposedly pulling it for XXXX XXXX. I reached out to her via text to state my position on it and told her not to pull my report again. She responded with " I was just trying to get you a better rate. '' On XXXX XX/XX/XXXX I reached out to inquire because I hadnt heard anything from her since I told her not to pull my credit again. She sent me a text message claiming to have finalized documents with TB ; I did not respond. I had spoken with one of my real estate friends concerning this debacle with XXXX staff and this vehicle and she gave me the name of another XXXX representative that she knew. On XXXX XX/XX/XXXX, I reached out to the lady and explained the situation to her concerning this vehicle and how XXXX was conducting business. Her recommendation to me was as soon as you can, return that vehicle to their lot, give the keys back and let them know that you dont want to do business with them. She stated that it was messy and it should not have taken all of that. I got into the vehicle and drove to XXXX XXXX right after I finished speaking with her. I was accompanied by someone to the dealership. On XXXX XX/XX/XXXX I walked into XXXX XXXX on XXXX XXXX and told the manager and the young lady at the front desk that I was returning a vehicle. They asked me was it for service? I responded in the negative and told them that I was returning it for them to keep. He asked if it had a lien on it? I told him that nothing was on it and that it had never been financed. I also expressed my disgust with how his staff member pulled my credit a number of times and I told him that this is not how you do business and I would not be doing business with them. I also stated that if there was nothing else for me to do then I was leaving. He and the lady asked me who had worked with me and I provided the names. He said that the female was there and he left my presence. While I was inquiring again as to whether I needed to do anything else, the female staff member came out. She spoke and I spoke to her and she began to say something to the effect of we have been in touch, I sent you a message. I said NO, I dont want the vehicle and this is not how you do business. I also addressed the fact that she pulled my credit numerous times. She began to say that I gave her permission and I said to her again, NO, you had my permission to pull my credit for XXXX XXXX and anything beyond that, you shouldve been contacting me!! She said okay and then walked away from me. I prepared to depart from the dealership when she eventually walked back over to me and stated the bank is still going to hold you responsible. I said what bank is holding me responsible? She responded Town Bank. I responded I havent signed any documents with town bank and I didnt do any business with Town Bank . She responded okay and walked away from me. I then told the person who accompanied me that I was ready to leave and we departed. On XXXX XX/XX/XXXX someone from a mortgage company did a soft pull on my credit report and told me that the female at XXXX had pulled my credit a total of 15 times. I was livid when I learned of this because I had only seen it 4 times AND I had a pre-approval when I arrived at the dealer so there was no sensible reason to pull my credit beyond the one time that I gave permission for. At this time, there was nothing on my credit report regarding the vehicle in question or TowneBank. On XXXX XX/XX/XXXX, I reached out to my credit union to obtain another pre-approval for a vehicle. Naturally the rate provided was higher than the previous one due to the many inquiries on my report. On XXXX XX/XX/XXXX I received a text from the female member being sarcastic concerning the vehicle and telling me that I needed to pick up my XXXX or her manager will have it removed from their lot. She also left a message on my phone asking that I return her call to discuss the vehicle. I ignored both, the message and the voicemail. I did not make contact with her at all. I was determined NOT to do any business with that establishment. The vehicle had been returned with no financing, therefore it was never my vehicle. I had also decided that I would seek legal guidance, so I began to go online researching consumer attorneys. On XXXX XX/XX/XXXX I texted my brother and asked if he would go with me to purchase a vehicle. I spoke with him again on XXXX XX/XX/XXXX and we agreed to go on the next day ( XXXX XX/XX/XXXX ). On XXXX XX/XX/XXXX, I received notification that an envelope had arrived for me from TowneBank. I received an email notification regarding my credit report on XXXX XX/XX/XXXX early, so I checked it as the message suggested. I looked on my credit report ( XXXX ) to find that Town Bank had loaded a bill for {$35000.00} for a vehicle that ( 1 ) was not in my possession and ( 2 ) that I NEVER purchased from them or anyone else. I immediately checked my XXXX and XXXX reports. It was listed on my XXXX but not the XXXX. I called my brother and told him about it and he postponed the vehicle shopping and told me to take care of this matter first. I reached out to all three and placed freezes on my reports until further notice. I went online and submitted a dispute for those that showed up on my reports. I also contacted the XXXX XXXX XXXX XXXX XXXX ) concerning the matter. On XXXX XX/XX/XXXX a lady called my phone from Town Bank ( XXXX ) leaving a voice message, stating that she wanted to verify some information with me regarding the purchase of a XXXX XXXX XXXX. I did not return the call because I was seeking legal representation concerning this matter. She called my phone again on XXXX XX/XX/XXXX and left a message. On XXXX XX/XX/XXXX I reached out to the XXXX XXXX XXXX and was instructed to send documentation to their establishment for review, so I forwarded the documents that I have regarding this matter. On XXXX XXXX another lady from Town Bank called my phone requesting that I return her call to ( XXXX ) XXXX. I did not return the call. After various conversations with XXXX staff, one of the attorneys instructed me to reach out to TowneBank to obtain a copy of the contract that they are attempting to enforce against me. On XXXX XX/XX/XXXX, I called one of the ladies who had reached out to me from XXXX to request a copy of the contract. I explained that I had never submitted an application to or signed documents requesting a loan from them and that I wanted to have a copy of the contract. I also mentioned that I was seeking legal guidance. The representative responded that I would need to have the attorney contact them to obtain this. I stated that as a consumer, I was entitled to a copy since they were claiming that I had submitted it. She eventually provided the address to me. I typed an email request for a copy of the documents soon after and submitted it. On XXXX XX/XX/XXXX I received a copy via email of the XXXX XXXX XXXX from the bank. Upon receipt, I saw that the original document for XXXX XXXX had been duplicated. The financial institution 's name ( XXXX XXXX ) had been crossed out and Town Bank had been handwritten above it. A friend recently informed me of the CFPB and so I am filing this complaint seeking resolution.

XXXX, on XX/XX/XXXX, I received a text message at XXXX from my bank saying that a quote - " LARGE WITHDRAWAL '' - charge of {$160.00} was posted. I looked it up on my Towne Bank application on my phone and noticed it was listed as a charge from XXXX. When I checked the most recent charges from the previous days, a list of repetitive charges ( all listed as being from XXXX ) for {$45.00}, {$160.00}, {$290.00}, {$160.00}, {$94.00}, {$15.00} ( these were all posted between XX/XX/XXXX to XX/XX/XXXX ) and then I found additional posts of {$63.00}, {$81.00}, {$20.00}, {$13.00}, {$10.00}, {$36.00}, {$32.00}, {$27.00}, {$22.00}, {$18.00}, and {$16.00} ( All between XX/XX/XXXX to XX/XX/XXXX ). On top of those, I had another 2 pending charges ( for {$29.00} and {$94.00} ) listed as well. There were other tiny amounts charged ( most well under {$10.00} ) over the previous week stretching back to XX/XX/XXXX when the first tiny charge happened. I still am not sure why the bank could allow such a blatant pattern of fraud to keep posting charges without making contact with the client who entrusted them with their money ( or how do they let all of this go on without temporarily putting a freeze on the card so they could contact the client to see what was going on ). Upon realizing all of this had been going on yesterday, I immediately used the Towne Bank app to freeze my card. I then drove to the nearest branch located on XXXX XXXX in XXXX XXXX, VA. I reported the fraudulent charges, and asked why I was not notified of these repeated charges for escalating amounts. I also asked why they did not notice this repetitive suspicious activity that was obvious fraud. Even more upsetting is that when I questioned them on what they do to monitor and protect their clients ' accounts, as well as asking why I was not getting any text messages/notifications of this suspicious activity, their response was simply, " we do not know. '' Additionally, they then told me that this is unfortunately probably going to end up being an issue that I will have to resolve with XXXX ( not with the bank ), and claimed that this was XXXX 's fault and this would likely end up being XXXX 's responsibility to resolve. They said that since I would probably be told this after they investigate ( which made no sense to me ), that I should go ahead and call XXXX to file a report with them as well. The rep at the bank looked up a number online for XXXX and gave it to me. I wanted to do whatever I could to find a resolution and have my stolen funds returned, and I did attempt to contact XXXX while I was at the Towne Bank bank XXXX filing my report. Yet, what I found out was that XXXX does not have an actual number that a member of the public can use to reach out to them ( the number the bank had given to me was to an emergency line XXXX provides for people with service animals and/or special needs ). I used my phone 's web browser to try and figure out how to get in contact with XXXX. I logged in through my phone 's web browser to file a request/complaint. XXXX had a section that listed all rides that I had taken on my XXXX account so I could indicate which XXXX charge I wanted to dispute. Yet, the last ride on my XXXX account was from XXXX of XXXX. I showed the bank reps this, and I still emailed XXXX and informed them of what I reported to my bank and requested that they contact me ( the bank also claimed that another rep was trying to find a way to contact XXXX while I was there filing my fraud report ). I was able to file a report on these fraudulent charges with Towne Bank, and I also requested they also put a stop on both the pending charges from XXXX on my account. When I asked about what was going to happen and the next steps, the bank informed me that they would investigate the claim and report back to me. This was all they would say to me after asking multiple times. When I asked specifically about the money that was stolen from my account, they again said that they did not know and would contact me again once they investigated. While they were not rude, they did ask me the same sets of accusatory questions throughout my extended time there. The questions all appeared to aimed at getting me to admit that this was all my fault or only my responsibility to resolve with XXXX. Like previously stated, they even went as far as to say that I should go ahead and just get this resolved with XXXX. After spending well over an hour there filing my report with them, I left without being given an adequate response from the bank to several key questions : Why did I not receive text notifications about the repeated withdrawals as well as the almost all of the larger withdrawals, and how could they not explain why they did not notice or do anything about this obvious pattern of fraudulent activity. To make matter worse, later in the evening ( at XXXX ) I received a text message from Towne Bank XXXX The message said that one of the pending charges ( a {$94.00} XXXX charge ) had been posted and the bank approved the withdrawn amount to be taken from my personal checking account. This is several hours after I physically went into the bank to file a fraud report and watched the bank representative record it as fraudulent as they assured me that they would place stops on the two fraudulent charges while also investigating the fraudulent charges they allowed to be withdrawn repeatedly. After of this is reported to them in person, how do they allow yet another fraudulent charge to be processed 4-5 hours after it is reported as fraudulent? This morning I did receive notifications that the bank did finally start blocking some new pending charges from XXXX, and while the bank rep did indicate that she would follow up with me, I have yet to hear back from anyone at the bank as of XXXX today.

On XX/XX/2022 I purchased a XXXX XXXX XXXXXXXX XXXX from XXXX XXXX XXXX in XXXX, XXXX At the time of my purchase I already had financing to purchase and without my consent the Sales Manager requested financing, resulting in a hard pull to my XXXX score, with XXXX institutions that I did not authorize to do so. This was after the conversation between myself and the sales person advising of the financing I already obtained for the purchase of the car. Regrettably, it wasnt until the next morning that I was made aware by XXXX and the other credit reporting systems I use of the inquiries made by XXXX XXXX, XXXX, XXXX, XXXX XXXX XXXX XXXX XXXX, Towne Bank, XXXX XXXX and XXXX XXXX XXXX XXXX making hard pulls to my credit the previous day. I followed up with XXXX XXXX and they provided me with a letter stating that the inquiries we not accurate and should be removed from my report due to their error. I submitted a request to XXXX through the online website to dispute and less than 24 hours they stated it was accurate and would leave them on my credit report for 2 years. No proper investigation was done nor was I asked or able to provide the documentation to support my request to have those inquiries removed. Today, XX/XX/2022 I called into XXXX to resolve the issue and instead of being assisted I was transferred back to the automated message at the start of the call. Prior to me being transferred back, the representative advised Id speak to a supervisor and that 3 of the companies had retracted their pull. However their report states otherwise. I requested documentation to show proof of those inquiries being deleted and the representative refused to comply.

Security fraud, Ignoring the power of attorney, Identity theft is taking the promissory note that the P.O.A. gave a signature to and credited that promissory note as it belongs to them. We need to see the actual copy. Please mail it to the power of attorney because it was made pay to the order of TOWNEBANK transferring the interest on the note to TOWNEBANK. Power of Attorney XXXX, XXXX XXXX/ Agent authorizing one party to the interest of one instrument specific and clear to the point so, Identity theft the moment a signature was put on that promissory note it was XXXX XXXX XXXX promissory note and I XXXX, XXXX XXXX / Agent perfect performance of the transfer of the interest in it to the secure party creditor who must credit the face value. Identity theft is stealing the signature and putting that instrument in street name not giving XXXX XXXX XXXX the credit which is the face value of the instrument. They act like they gave consideration, that's what this is all about authorizing one party to the interest of one specific and clear to the point, the moment a signature was put on that promissory note, that was XXXX XXXX XXXX promissory note. I XXXX, XXXX XXXX / Agent did perfect the transfer of the interest in it to the secure party creditor who must credit the face value of the note. XXXX XXXX in XXXX, NC.

I closed on my loan XX/XX/XXXX with Monarch Mortgage company. A year later I received an email from Monarch requesting my signature on a document. I didn't feel comfortable about signing documents after the fact ; therefore, i reached out to Bank XXXX XXXX ( XXXX ) to seek advice. i was told XXXX didn't have any documents regarding my mortgage. Therefore, I refused to sign any documents from Monarch. On XX/XX/XXXX I logged onto XXXX XXXX website to retrieve a copy of the deed of trust because XXXX sent a letter claiming they transfered my deed of trust to XXXX XXXX. This was alarming because XXXX was never listed on my deed of trust nor were they listed as the trustee. I found four new amendments with my signature ( forged ) and reference of consenting to the amendments. ( I didnt consent ) I was unaware of these amendments. Documents are attached. Please advise me of my rights. greatly appreciate any assistance in this matter. Thank you.

On XX/XX/2020 I closed on a home and {$10.00}, XXXX was awarded to me by Housing Opportunity Made Equal ( HOME ) to Towne Bank as a grant down payment. This money was released contingent that the home was up to code based on US Dept. of Housing and Urban Development. An addendum was drawn up and repairs were supposed to be completed. At the closing, the seller did not provide any receipts or warranties for repairs completed according to the addendum. I requested receipts from closing attorney 's office via email, and they came back and replied they do not have any receipts or invoices regarding the repairs made prior to closing. Because the repairs were not completed as the required per the addendum no grant funds should have been released on my behalf.

After dragging my mortgage process out for almost 45 days, TowneFirst Mortgage of XXXX VA pulled my loan on XX/XX/2021, less than 36 hours from my initial closing date of XX/XX/2021. I was never given a concrete answer as to why the loan was pulled, nor was I able to get a response from anyone within the company advising on same. I believe they have been mishandling VA loans as they did not follow procedures and regulations regarding multiple issues including length of income, suitability of partner generating income, and transparency of underwriting decisions.

Monarch Mortgage company fabricated mortgage closing documents years after closing settlement and amended my Deed of Trust years after the fact. Although, I refused to sign or amend any documents that were omitted during closing. Their response is that I signed a Power of Attorney document. ( false ) The POA would have been valid to conclude settlement documents and when Monarch held my loan. Instead Monarch, XXXX XXXX XXXX and XXXX XXXX added forged documents to the Deed of Trust years after settlement without my consent and/or signature/initials.

Hi, On XX/XX/XXXX, I made my normal monthly mortgage payment to TowneBank, on XX/XX/XXXX, I made a principal payment of {$5300.00}, on XX/XX/XXXX, Townebank transferred my loan to a new servicer without the {$5300.00} and kept it for themselves. After many phone calls, they finally sent the {$5300.00} to the new servicer on XX/XX/XXXX. Townebank refused to make the interest adjustment for the delay in applying the payment. They also refused to give me a written explanation about why they refused to make the interest adjustment.

My bank accounts were hacked by a scammer for XXXX dollars on XX/XX/2021. The scammer instructed me to purchase gift cards and give him the information on the back in orde to have my accounts refunded. He also wrote 3 checks for XXXX dollars to people I didn't know. He got into my phone to set up an online banking account and moved money from my savings account and transferred it into my checking account to have the money available for me to use my debit card to purchase the gift cards.

I have contacted credit bureaus several times explain that I closed and paid off mortgage XX/XX/22 and paid all balances on my account except car payment and when my morgage company pulls report it does not have updated balances sothat I may acquire a new mortgage.its been paid.
