We purchased are home with the help of XXXX XXXX and XXXX XXXX my husband parents because our credit wasn't purchased ready XXXX for XXXX. We were paying our Mortgage on time every month form XXXX until Towne Mortgage raised our Mortgage to {$890.00} in XXXX. We had an agreement with Towne Mortgage to pay all bills included with the purchase of the home located at XXXX XXXX XXXX XXXX MI XXXX this agreement was made at the closing of the property in XXXX. Myself, husband XXXX XXXX Sr. and parents XXXX and XXXX XXXX. XXXX XXXX died in XXXX XXXX. Afterward Towne Mortgage then raised the price of our mortgage in XXXX of XXXX XXXX. Towne Mortgage sent out the escrow overpayment XX/XX/XXXX, in the amount of {$1600.00} dollars or more. We then sent in our payments as schedule for XXXX- ( XXXX ) and the payment for XXXX was sent back. I then called Towne Mortgage and was told our payment has gone up due to the escrow payment sent out XXXX XXXX fell behind sometimes in XXXX because Towne Mortgage refused to help her after the passing of XXXX XXXX. We were told because the mortgage wasn't in our name we had to do a modification it took Towne Mortgage two years to modify at which time they modified and done the purchased agreement at the same time. By this time the mortgage was passed due a year and several months. But the problem is Towne Mortgage stop sending out notices ' and for the next several months we waited, called and no response. Well I contacted a lawyer of which contacted Towne Mortgage and we work through the modification. But no on never knew the correct figures that were owed by the previous owners ' during the modification process. We were completely unaware of the procedures ' next thing we new our Mortgage purchased of the home went we were charged over XXXX dollars I believe. This is what I need your office to look at what was owed at that time, what did Towne Mortgage charged us and was the amounts correct form the time of purchased in XXXX until the previous owners fell behind in XXXX. As well as was it correct for Towne Mortgage to raise the mortgage to {$880.00} XX/XX/XXXX because an escrow check was sent out XX/XX/XXXX. Please check the dates to ensure they are correct. As well as is this legal for Towne Mortgage to have XXXX XXXX and myself XXXX XXXX to assume a mortgage instead to purchased property of which we were not behind on. When they refused to help XXXX XXXX after the death of her spouse XXXX XXXX she gave up on the property and wanted XXXX and I to take ownership of the property. But I know it was a better way of doing that of which XXXX and I was denied by Towne Mortgage to do so. Instead Towne Mortgage refused the purchased of XXXX and me taking over ownership in XXXX. And was told the only choice we had was to assume the mortgage of which the Mortgage Company took two years to do. Look at Towne Mortgage Records as we XXXX XXXXXXXX XXXX of which I called and file complaints numerous times but no one got the answers I requested. The Mortgage should have gone down by this time because we hadn't fallen behind. Then in XXXX my Social Security Income was cut in half. We paid our mortgage until we ran out of money. I called Towne Mortgage for three months and they stated " it was nothing they could do to help us period at that time. I tried looking for resources to help pay our mortgage to no avail no help. I tried to get help form XXXX, Towne Mortgage XXXX and other resources when we fell behind in XXXX or XX/XX/XXXX. So XXXX XXXX, XXXX, I file for bankruptcy and I dismissed the bankruptcy when I received my Income taxes in XX/XX/XXXX. We then file for the modification in XX/XX/XXXX of which took additional several months from XX/XX/XXXX until XX/XX/XXXX. The Mortgage Company is now stated the mortgage raised form XXXX to XXXX of which is XXXX are these figures correct and was this unfair practicing because there are several different figures on are documents. And after all the on time payments From XX/XX/XXXX and XX/XX/XXXX Towne Mortgage did the escrow analysis the Modification together the escrow lowest was {$1500.00} and the projected balance was {$2700.00} my number is XXXX XXXX. Please can you help us to correct any problems that aren't accurate? XXXX XXXX

I am XXXX years old. I purchased my first property for myself and my family in XXXX at XXXX XXXX XXXX XXXX. I purchased a XXXX unit building being converted to a XXXX unit dwelling under the HUD XXXX loan program. XXXX XXXX bank told me I qualified for approx. {$450000.00} to cover the cost and rehab. After six months into the qualification process which should have not taken six months, but I did n't understand that at the time because they kept saying they lost different paperwork, they lowered the loan to {$370000.00} based on an appraisal I questioned at the time and was not given a chance to have my own appraisal done of the property. At this point the seller wanted to walk away from the deal. I was also told I would have six months worth of mortgage payments included in the loan which was the only reason I selected this loan in the first place. When we finally closed in the property, and the escrow was set up. I received a mortgage booklet to begin payments the following month. I told them this was not correct. I got every excuse in the world from the bank who not only shorted my loan by over {$75000.00} to complete my property but now did not include the mortgage payments with the escrow money to rehab the property. They also assigned me a HUD XXXX consultant who granted fraudulent payments to what turned out to be a completely fraudulent contractor. As my home could not pass one home inspection from the City of XXXX. I have no working, plumbing, electricity, or heating. nothing is connected or completed. When I confronted the bank. They wanted to blame me the homeowner. Saying I signed off on payments to the contractor. I told them they appointed a HUD Inspector and I was paying him {$360.00} per inspection to make sure that the contractor was using the proper material and installing the mechanics of the building up to HUD and City of XXXX Building Code. I also was upset with the bank and asked them once to remove that inspector because he was allowing the contractor to work in the building without a Building License for which money was given him before he even began on our property. Before we could recover our money back from the bank because we told them they were responsible for under funding our loan, appointing a theft to be our building inspector and leaving us vulnerable to hiring a crooked contractor because none of the other contractors would take our rehab because they said we needed more money to complete the rehab they closed the bank abruptly and unexpectedly in XXXX 2016. We desire XXXX to take over our loan so that we may try to complete our rehab. We have paid our mortgage for almost two years on a building we can not live in. We are paying rent on an apartment also. I fear I am going to go into foreclosure because I have used up all the money I had and took money from my retirement just to stay afloat. I new bank took over our loan about three weeks ago and they wo n't call or contact me. I told them our story. This has not been the American Dream for me or my family. This process had been the American Nightmare. I* have a XXXX credit score so why I could n't get all the money I needed in the first place is beyond me. Maybe because I am an older XXXX XXXX, and I recently saw a report that people with credit scores like mine were given the worst loans imaginable because they were XXXX while their white counterparts were given more money on the same type of loan with fare worst credit scores. I just want to get more money to fix my building and live out my days in the home I purchased. I need someone to make this wrong into a right. I feel abandoned and helpless. I have been mistreated and looked over. As soon as the bank was finally ready to help me by restoring money into my nearly depleted escrow the bank closed down. I am sure it is because they defrauded others as well.

This is a written letter to file a formal complaint against Towne Mortgage Company. During the first week of XX/XX/XXXX I contact Towne Mortgage and attempted to pay half of my mortgage for the month of XX/XX/XXXX. I spoke with the customer service rep and inquire if she would accept payment by phone, online would not accept my partial payment. I was advised, partial payment is not accepted and if I send the money in via us mail they would just hold the funds and not apply to my account. I explain to the rep that I was out on medical leave and working on receiving my XXXX XXXX XXXX and at this time all I had was XXXX dollars which is half of my XXXX mortgage. She explains again will not accept payment. I ask what other options are available. After she review my account the rep stated since I have a FHA loan I could completed a hardship for forbearance of my payment for a few months. I inform the rep I would be returning to work on XX/XX/XXXX. The rep stated she could send me via us mail the loss mitigation paperwork. I receive the paperwork and email all docs to the loss mitigation department. I reach out to the loss mitigation the second week of XX/XX/XXXXand spoke with rep XXXX XXXX. I ask her did she receive my paperwork and she inform me no email of docs where receive. Advise her I would send again at that moment and she confirm she receive paperwork. We went on and had a conversation about me trying to make partial payment and they would not accept. She went on and ask me could I set up a payment arrangement because I would be just one month behind. I explain to the rep that would be ok and agree to pay XXXX for XX/XX/XXXX and XX/XX/XXXX. I explain to her I am still waiting on my XXXX XXXX XXXX to payout and if my work check was not enough to make the whole payment arrangement agree on what should I do. I explain to her when I return to work will only have 2 weeks in and I get paid once a month. I explain to rep only receive payment at the end of month and varies on days. She told me if my check is short to call her on Monday I call her on XX/XX/XXXX. I call from Monday until Thursday when I spoke back to rep in loss mitigation. I receive a call from a lady from Towne Mortgage Company and she was inquired about payment and making arrangement. I inform her that I have a payment plan in place and she should speak with XXXX XXXX however ask her to leave her a message to contact me. Explain to the rep having been calling since Monday to inform my check was only XXXX dollars and would they accept. I finally got to speak with XXXX XXXX on XX/XX/XXXX and inform her my check was only XXXX dollars for XX/XX/XXXX and still waiting on my XXXX XXXX XXXX. I ask her could she accept and they the conversation went different. She stated no and do I have the whole amount again I explain myself and she told me we dont include XXXX XXXX XXXX as income but since I am back at work. I told her that all I have at this time and she ask me what Im going to do. I told her I will be going forward in the loss mitigation and she inform me that she would not process my paperwork until I could send her a check stub from the monthof XX/XX/XXXXshowing a full check and to include XX/XX/XXXX as well. I ask her if the hardship is for now how is this helping me if you are only willing to process with check stub base off I am now back at work, working full time. She stated we only do the paperwork when a client is working full time receiving XXXX XXXX XXXX is not accepted. I told her okay and we ended the call. I was force to put my home up for sale because they are not willing to accepted partial payment thus putting my behind in my mortgage payment 2 months. I feel the company is trying to foreclosure my home and I am force to sell my home.

I am filing a complaint against the current holder of my mortgage loan, XXXX XXXX XXXX XXXX XXXX XXXX well as the new lender/servicer Towne Mortgage. A sale date was scheduled for XXXX XXXX, and as I was trying to work things out with XXXX I received a letter addressed to me, but containing the name and address of a different XXXX XXXX client stating that my loan was being transferred as of XXXX XXXX, a week AFTER my sale date was scheduled to occur. This appears to be part of a pattern on the part of XXXX XXXX, XXXX XXXX and now Towne Mortgage. They have engaged in unethical mortgage servicing practices that are meant to mislead me, confusing me as to whom owns my loan, who is servicing my loan, who I am supposed to pay, what is my loan number etc. I believe there is some type of massive shell game going on, where several entities are colluding to transfer loans and securities in order to confuse borrowers, increase revenue, evade taxes and state recording guidelines and game the system. I do n't understand how this is legal, how they can send out paperwork that a security is being transferred when it is scheduled to be auctioned etc. Not only that, neither XXXX XXXX or Towne Mortgage is licensed to do business in the state of Pennsylvania. I provided this documentation to the sheriff who agreed to postpone the sale date for 60 days due to these inconsistencies. We refinanced into this loan in XX/XX/2008 with XXXX XXXX. When they failed the loan went to XXXX and then it was transferred to XXXX. We ran into tough times. I lost overtime and hours and my wife XXXX has had several major medical issues such as XXXX resulting in increased medical expenses, XXXX and loss of employment. We tried to work things out with XXXX and they did put us in a plan where the back payments were put into the balance, although we did not save much. We paid as agreed on this agreement for several months and had an emergency arise where we were short on funds. We fell behind a payment, but after calling into XXXX they told us we could wire in a new payment to put us back in good standing. When we tried to wire the funds in they would not accept it and things went south from there. XXXX told us they would not do anything to help us and that they did not participate in any type of government programs. Then they transferred our loan to XXXX XXXX. We were not able to speak with anyone at XXXX and were not sure what our loan number was. After a few months our loan was transferred to XXXX XXXX. We became alarmed when we looked at our legal paperwork and saw that XXXX XXXX and XXXX XXXX had the same business address in Oregon, but on other legal documents XXXX XXXX had an address in XXXX CO and XXXX had an address in Tennessee. We were also curious as to how these transfers occurred without any substitution of trustee paperwork being filed. We did try to work with XXXX to see if there was a way we could resume payments and get back in good standing and were told the only option was to make a {$10000.00} down payment and then they would talk with us. That was not feasible and XXXX set a sale date. Then we got paperwork a few days before the sale stating our loan was being transferred again, on a date AFTER the sale. However, the borrower name and address on some of the paperwork did not match my information. I called XXXX and talked to XXXX XXXX and asked how this was possible. He stated that they had sold a pool of loans to Towne Mortgage and that it was just a mix up, and that they would send the proper information. I pointed out that our home was scheduled to be sold in less than a week and we needed to know the name and contact information of the new servicer and loan number so we could contact them to see if we could wor

On XX/XX/2021 Town Mortgage flagged my credit report with a comment that said my account was {$1200.00} past due for over 30 days. I submitted a dispute through XXXX because to my knowledge this information was not accurate. My monthly payment recently increased to over {$200.00} however there was no email, text message, phone call or voicemail from Town Mortgage to notify me of this change. Nor was there any sort of alert on my online account. I simply noticed this increase on the amount due section when I went to pay my XXXX bill online. Town Mortgage claims they sent a letter in the mail but I do not have this document they described in my possession and do not recall ever receiving it. I did not have enough money in my bank account to cover the new increased mortgage payment at the time that I originally went online to make my mortgage payment for XXXX, so instead I made a partial payment of {$500.00} on XX/XX/2021 and then made another {$500.00} payment online on XX/XX/2021. This is why I feel that is not accurate to say that on XX/XX/2021 my account was past due {$1200.00} for over 30 days. My mortgage account was in fact past due at the end of XXXX but only {$250.00}. This was due to the newly increased escrow amount. However this past due amount was NOT mentioned anywhere on my online account, nor did I receive any phone call, voicemail, email alert, or text message to notify me of this past due amount. The only reason I know how much was past due is because I called Town Mortgage on Friday XX/XX/2021 to get clarification and I asked what exactly is the past due balance? It was then that I was told the past due amount was {$250.00} and I quickly made a payment for that amount online. I asked if there was anything that could be done to repair the damage that was done to my credit report due to the misunderstanding which was a result of Town Mortgages lack of notification about my past due balance. I was told that they apologize that their notification system is out of date and that sending letters through the US mail is currently their main form of communication to clients. However they informed me they still would not make a correction to my credit report. I feel it is extremely unfair and unreasonable for Town Mortgage to report that my account was {$1200.00} past due for 30 days when it was in fact only {$250.00} past due and I was not given ample notification to resolve this and make the payment. I have a history of paying my monthly mortgage on time with this company without fail for over XXXX years now, and had there been more accurate and up to date information on my online profile I would have taken care of the {$250.00} weeks ago. Instead they left this comment on my credit report and my credit score instantly plummeted as a result of the inaccuracies reported on the past due amount on my account. From the first month our mortgage was bought by Town Mortgage we have had multiple issues. Those include : taking off of auto pay without knowledge, if you go to make a payment it takes days, when you call the phone hangs up, or you will be on hold for hours. I have sat on the phone with my wife to witness that we are the phone for 2 hours plus attempting to pay. They will transfer to the department and the call drops. I have also received no correspondence via mail or email. They will call at times and leave no voicemail. This is an impossible company to even talk too. My biggest issue is 2 major fraud issues. I have written documentation of both of them. The first was in XXXX of 2018. I had noticed the payment was sent back to me. When I called them Town Mortgage stated that I requested the return. When I called and stated that I did no such thing. Town Mortgage then stated that " It was actually your Credit Union sent us a letter to return payment. '' I contacted my credit union and they also stated no such thing. I asked them to do an investigation into the account which they sent an official and notarized form that no such thing had occurred. Town Mortgage stated they had the form from my bank, and sent it to me. I sent that to the bank and they stated that is not a form they have ever used, and the form was clearly made on XXXX with no letter head, no explanation and is clearly false and my bank verified it was false. This is a common practice with town mortgage. At the time I had the bank check, Town Mortgage had stated this has happened 4 times. My bank verified with their investigations department there was not one time. The other form of fraud was that also in 2018 they refused to pay the escrow amount that is supposed to cover taxes and home insurance. It was built into the loan and to this day they refuse to tell me what happened to this money. I had to pay additional taxes and home insurance. I had my insurance broker attempt to contact them about this money and escrow policy. They also refused to talk to him or explain where the money is. I also have a certified letter from the broker stating in 30 years he has never seen this, or dealt with a company that was very easily hiding money or altering a federal loan, and refused to communicate with. So they take escrow money refuse to talk about it, and they send payments back and falsify your own bank documents to try to get you to pay late fees. This type of practice needs to be investigated on a large scale. i was also contacted by an employee via email that stated everything that has happened is true.

Last year, around XXXX we contacted towne mortgage in regards to a drastic payment increase. The payment was {$1000.00}, and increased to {$1800.00} with no warning or notice until this bill. We were informed the reason for the drastic increase was an increase in Insurance payments on XX/XX/2018 ( payment increased to {$4800.00} from {$1300.00} ) and we were NOT notified of this until we received the new notice for billing in XXXX. Upon them telling us this, we asked for options to help as we could not afford the current payment as it was more than one paycheck and we would be late every month cause this amount was not available to us. We were told to shop and change insurances which we did, finding a much cheaper plan at XXXX. We were told to get the refund from the old insurance and pay the new premium, which we did. We called and informed towne mortgage of this, and was told the payment would be adjusted when the account was reviewed upon receiving new insurance information. and the amount we had been behind in escrow paid off. It is now XXXX and I have contacted you'll again and nothing has changed. I was informed today however the reason it didn't change sooner as that we never sent in anything showing we paid insurance. HOWEVER you'll already have the new insurance information on file on your website, including when its due and how much!. My escrow however was NEVER adjusted to reflect this change. This has caused an undue hardship on our family, due to a constant struggle to afford the mortgage, and repeatedly receiving late fees as I do not make enough to make the payment in one pay period. I have spoken with you'll on a few occasions through the year, and was never informed this should have been fixed or how to. If my escrow account had been corrected when this was all discovered, not only would the stress of the situation have been resolved, but the late fees would have been avoided. We have accrued and paid you'll ( Towne Mortgage ) 100 's in late fees due to this error not being corrected to the escrow amount. we are demanding this be fixed immediately, adjusting the monthly escrow payment, and also expect a refund for the late fees due to this, as we made it aware to you'll multiple times over the past year we were unable to afford this amount, and NEVER was this corrected or told to us how to correct the issue. Currently our escrow is scheduled to be overfunded by the end of the year with the current payments, and with the expected new payment due to the amount already overpaid. We would like this refunded ASAP also.

Towne Mortgage, DBA AmeriCU XXXX # XXXX, originated and " manages '' my mothers FHA loan, which I am authorized to manage, handle all business, and make the monthly payments on. Every year, Towne Mortgage slaps a ridiculously expensive XXXX insurance policy ( highly profitable for them ) on my loan that makes my monthly mortgage and escrow payment go from about XXXX dollars per month to over XXXX per month, which we can not afford. This policy is completely unnecessary for FHA ( I know, I spoke with an FHA representative during the time the loan was closing ), as the master insurance policy for our large association covers the interior of all of our units, per the developer-written bylaws of the association. These bylaws have never changed meaning none of us with loans needs an XXXX policy. My neighbors have loans with other large lenders like XXXX XXXX and in talking with them none of them have to go through this year after year with their lenders. I provided this information prior to loan closing, and have provided the online link to the association documents in the past when this happened before, so it is not like they do n't know this. I have a saved email from XXXX of Towne Mortgages employees who fixed this problem for me several years ago PROMISING this would never happen again, yet is has. I will attach that email. Consequently I have withheld my XXXX, XXXX and XXXX payments until the insurance is cancelled retroactively, a new mortgage analysis is done to return my monthly payment to the correct amount, and all late charges are removed from the escrow account. What is most frustrating is that all the times I have tried to communicate this problem to Towne Mortgage in the last months NO ONE other than collections will return my emails or fix this. When I send a form in on their website XXXX no one ever responds to it, when I signed up for their encrypted email and send them a request to remove the insurance off the loan the XXXXXXXXXXXX is restricted and the email gets rejected. When I call and ask the operator for someone, anyones email that can help me, they always tell me to send it to XXXXXXXXXXXX, and guess what happens? - NO ONE ever responds to me. Since I can not get any help, I am sending via certified mail my XXXX XXXX and XXXX payments of XXXX to a person whose name I got who is the manager of loan servicing along with a copy of this complaint. XX/XX/2023 Dear Sir or Madam : I am having a dreadful time with Towne Mortgage, my relatively recent mortgage carrier. We took our a mortgage with them in XXXX of this year. Our first XXXX payments, paid through my XXXX XXXX service at my XXXX bank, went through without a hitch. We had the XXXX payment sent by the bank on XX/XX/2023. The bank account indicated the check was cashed by Towne Mortgage on XX/XX/XXXX. On approximately XX/XX/2023, we received a letter from them claiming the check had been returned and the funds returned. This is untrue. I met with my bank XXXX and the records were carefully searched. It is not actually possible to stop payment on a paid check anyway. No monies have been returned to either my bank or to us. I called XXXX XXXX at Towne Mortgage and was told the check had had a XXXX XXXX placed on it after it was cashed and the money returned. This is not possible. After a check is cashed it can not have a stop payment put on it. My bank checked carefully all records, no stop payment was requested, no money returned. They have provided Towne Mortgage with that information and, at my request started a dispute and investigation. Towne Mortgage, after promising to look into for me and get back with me not only has not done that, they have reported our payment as late to all of the credit reporting agencies. Our credit scores have gone down XXXX points as a result and we are being told by both our bank and Towne Mortgage that it will be XXXX days before this is resolved. Is this fair to ruin our credit for months when we did nothing wrong, the mistake is on their end? I have asked Towne Mortgage repeatedly to provide documentation of who supposedly stopped the check and who they sent the money back to, if they did, indeed refund money. It sounds like they either made an error, have an XXXX employee or have been hacked. Our payment was not late and was for slightly more than the amount due. They have now cashed the XXXX payment as well and have not said anything about a problem with it, at least not yet. I have filed a dispute all of the credit reporting agencies, and appreciate you taking a look at this XXXX XXXX practice. Thank you in advance for your work.information. Towne Mortgage is increasing my mortgage company by {$560.00} per month due to a clerical error on their end. They have drained my escrow account paying XXXX XXXX XXXX. They have not once called in 2 years to let me know there was an error in the amount they were collecting from me in escrow. A customer service representative named XXXX XXXX admitted verbally on the phone that Towne Mortgage has been paying XXXX XXXX ( as we agreed in escrow ) but they were not charging me in escrow since the day they dropped our mortgage insurance ( XXXX/XXXX/XXXX ). When our mortgage insurance was dropped by XXXX XXXX at Towne, she or someone else at the company accidentally took off our home owners insurance and did not tell us. They could have caught this problem the first time they paid out our insurance and multiple times after. If we would have been aware we would have told them something was wrong. We have trusted this company with our loan and escrow and never once gave consent for our escrow to be altered since buying our home in XXXX. The most suspicious aspect is the fact Towne has been paying out XXXX, but not charging us. This shows that they are unorganized and made the mistake. It seems pretty simple for them to find this error since they have paid XXXX multiple times. Instead they send us a new bill of almost {$600.00} increase with no explanation. I had to call multiple times and finally was told by XXXX XXXX that " it was an error on [ their ] end. '' We can not afford to pay an extra {$600.00} a month for an entire year. We would like to pay no more than {$200.00} a month until the debt THEY created by THEIR error is paid off. We have never missed a payment and have trusted Towne with our loan and financial asset. I would like for this to never happen to anyone else, but fear this company is so disorganized, they could let an error like this happen for almost two years. Please help.

The mortgage statement only lists one mortgage company ( AmeriCu Mortgage ) - there are two mortgage companies affiliated with our mortgage loan ( AmeriCu Mortgage and Towne Mortgage ). XX/XX/XXXX - contacted AmeriCu today - they sent a statement two days ago stating we owed late fees of {$61.00} as listed on the statement. Upon reviewing our account online and speaking with the representative I was informed we are late because we make payments bi-weekly online. But, the Towne Mortgage and AmeriCu Mortgage ( they use the same online system ) allows for biweekly payments and I have been paying in this manner for years. The representative further stated that I ' can not ' make biweekly payments and that is why I owe them additional money, and that the XX/XX/XXXX had not been paid. Further review of my payments ( via their online system ) indicated they have been applying my mortgage payments to PRINCIPLE which makes it appear I am not payment the mortgage. The issue ; they online payment system breaks the payment up and allows for additional allocation to principal, which I tend to make payments towards principal each month ( from {$10.00} - {$50.00} ) but, never for hundreds of dollars. When I asked why the mortgage payments were NOT applied as I indicated on the payment system, the representative did not have a valid response and basically stated, again, that it was my fault for making biweekly payments - I asked to speak with a supervisor - the rep stated the supervisor was not in until XXXX XXXX. As stated on the call today, our payments are paid one month in advance ( in biweekly payments ). We are NOT late on our mortgage. My husband is a XXXX veteran. Towne Mortgage is a company that purchased a home sometime this year from XXXX, a company that held a mortgage on which I filed chapter XXXX bankruptcy and had discharged in XXXX 2014. Towne Mortgage has fraudulently reported on my credit report that I have an account with them that was included in bankruptcy, so that it seems I have XXXX mortgage accounts that have been included in bankruptcy. I have never held an account with them and because the loan was discharged, I was legally no longer obligated to this home or loan. Since they have recently purchased this home, it has began to appear on my credit reports in the last 2 months and has negatively affected my credit score. I have provided proof to the company that this account is also showing with a balance owed on my XXXX report and is being reported twice by Towne Mortgage on my XXXX report. I have been back and forth with Towne Mortgage for the last 3 months over the inaccurate reporting and the negative impact it has had on my score and subsequent ability to gain credit. They have yet to resolve the issue. As I have explained to them, as well as my bankruptcy attorney, once the debt was discharged, they do not have the right to report anything on my credit report regarding the debt, since they were not the holders of such when it was discharged and the loan was not reaffirmed after my bankruptcy. XXXX XXXX has correctly reported the debt, and it reports on all XXXX as included in BKP, as it should. Approximately on or about XX/XX/2018, I called my mortgage company and explained that I would be out of work for a few months and requested to be set up on their financial hardship plan. They offered me the " Forbearance Plan '' option which would consist of No late fees or penalties, no negative effect on credit or reporting to bureaus, and in I would be able to " skip '' my XXXX mortgage payment of {$800.00} and instead make three payments of {$1000.00} in XXXX, XXXX and XXXX. I agreed to these terms, and upheld my end, but I was not only charged tons of fees, I was threatened with foreclosure, reported to all credit bureaus, called at all hours of the day. I explained to them that had I known that this " help '' they offer was really going to hurt more both financially and mentally, I would have never agreed. Then to add insult to injury, after finally getting tired of losing time at work trying to straighten this all out, I just coughed up all the money for fees and I get a call saying that my mortgage company is charging me for mortgage insurance ( at an outrageous rate ) ( stating I dont have it ) that I have continuously carried since day one without fail. Upon further investigation, I have found that My home was double insured ( I carrying my own, and them sneaking one in ) since spring 2018. I purchased my home on XX/XX/20. When I purchased my home, it was clear that my property taxes were ~ {$11000.00}. Last year there was a significant shortage with my escrow account and there needed to be an adjustment made. On XX/XX/XXXX we entered into a contract to sell our house with a closing date of on or before XX/XX/XXXX. The mortgage on this house was with Towne Mortgage. We received the loan payoff amount dated XX/XX/XXXX and it included our XXXX payment in that amount. As of that date we had no ownership interest in the property and the funds were properly distributed. We have a 30-year fixed rate mortgage through TOWNE MORTGAGE COMPANY, which began in or around XX/XX/XXXX. Our monthly mortgage payments were {$1100.00} up until last XXXX, when they suddenly spiked ( without notice, since we are set up for an automatic deduction every month ) to {$1400.00}. They have remained at this level since last XXXX. I have contacted the mortgage company twice and my wife has contacted them once. We have been provided with varying explanations ( property tax increase, home insurance increase, a combination of the two ). In XX/XX/2023, I had a conversation with XXXX from Town Mortgage regarding a financial hardship I was facing at that time. XXXX assured me that she would pass on the information, but I did not receive any further communication from her or Towne Mortgageuntil yesterday, which was XX/XX/XXXX. It was frustrating to realize that XXXX denied being the person I had spoken to in XXXX, despite my clear recollection of her introducing herself by name. She was rather XXXX and unhelpful during our brief interaction. Instead of guiding me towards any assistance or providing any direction, she simply brushed me off. To my surprise, when I mentioned that I had given consent for a third-party to handle the matter on my behalf, she abruptly informed me that they do not engage with third-party individuals and would only communicate with me directly. XXXX 's behavior, attitude, and lack of professionalism have left me feeling unsupported and disrespected. I contacted XXXX XXXX & Towne Mortgage Escrow department by E-mail on XX/XX/2018 as instructed to do by customer service. I had issues with how they calculated our monthly payment. The monthly payment should be XXXX they are billing {$610.00}. I Emailed them a copy of our 2018 homeowners policy showing the amount that they showed was paid on the statement was higher then what was due for the 2018 policy. They responded on XX/XX/XXXX but did not answer fully my questions. On or around XX/XX/17, we initiated a no-cash-out refinance application with Towne Mortgage. Since I am a XXXX veteran, and on a fixed income, I only wanted to reduce my mortgage payments by eliminating the PMI on our current conventional mortgage. We have been waiting on a closing date since XX/XX/XXXX, and have now been advised that we will be denied for the refinance due to ONE late mortgage payment. We were given the opportunity to explain the late payment, which was caused by clicking on the wrong date on the website when setting up a payment. We have had the home inspection, provided the appropriate documentation and other subsequent documentation. We feel that the denial reason that Towne is giving us suspect and feel they are engaging in discriminatory practices. We got a construction loan from an out of state lender. It is over a year past construction completion date and the house is unfinished and exposed to elements. We continue to pay the mortgage in its entirety, even though the bank has only release a fraction of the approved funds. The bank and its CEO are all aware of the situation but continue to ignore the situation and have not done anything to protect the house or rectify the situation. We are not allowed to access the borrowed money. We continue to bare the financial burden of paying for a mortgage on a house which is unfinished and is in perpetual worsening condition and is rendered uninhabitable. The bank is the ultimate arbitrator within the mortgage agreement yet has acted irresponsibly and negligently within respect to the house and its condition to the elements and in respect to not mending the mortgage payment monthly to reflect what amount of money has been released to offer some kind of financial relief.

He was paid to close a wall ( wall wasn't completely closed ), installing and reframing windows. He was also paid to stucco my property and that was not completed. The plumbing was also done incorrectly and had to be altered by the new XXXX. All windows were not installed nor reframed, he was paid to remove all debris accumulated in the back yard. I had to pay to have it removed by another XXXX. The XXXX was also paid an additional {$3000.00} for drywall that was not installed. It started off that we are unable to make a payment, including additional principal, online. Each month we call to make the payment over the phone so we can add additional principal and they give us a hard time because we can't do it online. They have told us the only way we can pay over the phone is if we pay a {$9.00} fee each month, which would be fine if it wasn't for the fact that the entire reason for the issue is because they can't seem to get there website fixed. The mortgage broker failed to provide accurate closing escrow numbers on loan payment, taxes and insurance. These number were also verified by the mortgage company before the closing. Almost 2 years later the mortgage company is claiming an error was made at the closing in calculating the escrow accounts which is resulting in a significant increase in my mortgage payment which I can no longer afford due to a fixed SS income. I have tried several times, unsuccessfully, to have PMI removed as a requirement for our mortgage. My last complaint was responded to with the following : 'According to the terms of the mortgage loan, the Mortgage Insurance Premium ( MIP ) is due for the life of the loan and can not be waived. ' Per the PMI Cancellation act, it is prohibited to require PMI for the life of the loan. I have provided AmeriCU with a recent appraisal showing that we are easily below 80 % LTV. Refinancing at this time with rates so high is prohibitive as we currently have a 3.125 % interest rate on our mortgage. Towne Mortgage Company does not accurate communicate all monies owed on my mortgage on their website. Apparently, there is a late fee on my account that I would not know about because it is not presented anywhere on the website. You'll see on the screenshot I provided they only publish the regular monthly payment due yet nowhere is there a late fee communicated. Yet when I call they say I owe a late fee. At the same time, you'll see an additional screenshot for making a one time payment, there is no entry available to dedicate funds to the late fee owed. This is perpetuates an infinite cycle of fines which is dishonest!

I have called couple of times explaining to the mortgage company of transitioning jobs that I am financialong struggling, they did not help whatsoever, and did not give me options, I applied for a payment XX/XX/XXXX and on my bank end it went through, but they did marked it as a late payment. We have a mortgage on our home which has been sold multiple times to different lenders. Because the property in question is a condo, it requires hazard insurance.
