I lost my earnest money of {$2500.00}, due to negligence of the staffs communication. I did everything I was asked of. I provided all documents in a timely manner ; within hours if not minutes. I was told my file was in underwriting when it was not, according to my app status. The sellers team tried reaching out to TSM several times with no response. No one worked on my file while XXXX XXXX, Loan Originator, was out sick. Which pushed back the original closing date from XX/XX/XXXX to XX/XX/XXXX. Furthermore, I was now past the timeframe to get my earnest money back in case something did not go through. On XX/XX/XXXX XXXX told me that I needed $ XXXX for closing cost. It was one business day before closing and he and the staff at TSM did not send my file to downpayment assistance ( DPA ) like they should have. This would have covered the cost of the closing cost. They still had my file in underwriting review on XX/XX/XXXX despite them telling the sellers that it was going to be out on XX/XX/XXXX ( see attached emails ). They never sent my file to DPA because they did not work it in time and there was no time left for them to send it and close on XX/XX/XXXX. Even if I may have not qualified, my file should have been sent to DPA prior to XX/XX/XXXX ( the original closing date ). My offer was accepted back in XX/XX/XXXX. There was plenty of time for my file to be worked in a timely manner. There are several emails from me and the sellers team requesting updates and me asking what else was needed to be done. In addition to the {$2500.00}, I lost out on {$1000.00} ; that includes the inspection and appraisal. I am requesting my earnest money back {$2500.00} and {$1000.00} due to the lack of communication and work effort from TSM. I have emails proving that my file was not being worked while XXXX was out sick. I spoke with XXXX XXXX XX/XX/XXXX and was told that I would receive my money back, but only to find out he is no longer there and have not heard from him. I than tried to speak with XXXX XXXX ( Branch Manager Sr. Loan Originator ) about retaining my earnest money back and I have yet to hear back from her since XX/XX/XXXX.

When purchasing a home last year, Town Square Mortgage in XXXX XXXX TX could not obtain my XXXX score. They claim that contacted XXXX and I don't know what the agent told XXXX but after that all they could provide was a mixed up report, with 5 other peoples information. Since that time I have spent over 100 hours on the phone trying to fix the report with no success. When I call Town Square Mortgage or my broker for assistance, they tell me they did nothing wrong.
