I lost my down payment deposit as a result of Total Mortgage Services, LLC ( TMS ) deceptive and abusive lending practices. TMS Underwriters APPROVED this LOAN BEFORE I SUBMITTED and SIGNED the APPLICATION ( XXXX Underwriting Finding Form Approved on XXXX/XXXX/XXXX, I signed the Loan Application on XXXX/XXXX/XXXX at XXXX PDT ). On XXXX/XXXX/XXXX, I was referred to Total Mortgage Services, LLC ( TMS ) by my attorney XXXX XXXX of XXXXXXXX XXXX XXXX. When I was applying for this loan TMS employees sent me my loan application and paperwork online though a website that required my electronic signature. On my loan application, I was never given the option to select my Race and Ethnicity. This information was already checked off prior to me receiving the online documents and TMS employees were unwillingly to update/ correct the wrong information on this loan application prior to me electronically signing the documents. I later found out that TMS employees altered some of the information on these documents after I electronically signed them. About 10 TMS employees emailed me regarding this loan. Second, due to TMS employees reckless behavior I am extremely concerned and worried that my personal financial information may have been compromised and shared with other Borrowers and parties outside TMS. On three occasions I received another Borrowers FHA and loan documentation. TMS Processor emailed this to me several times. TMS employees were unaware of this until it was brought to their attention on XXXX/XXXX/XXXX after calling the Loan Officer. TMS seemed unconcern and uninterested about me having received these emails and information. Other TMS employees were copied on these emails and it would seem at no time did they realize or notice this error until I brought it to their attention. Additionally, on XXXX/XXXX/XXXX the Loan Officer, sent me an email and CC XXXX XXXXXXXX XXXX XXXX and some unknown person XXXX XXXX at XXXXXXXXXXXX?? Does sending my personal information fall under your Regulations? Last, TMS knowingly omitted information when processing my loan and mislead me for weeks into believing I was qualified for a loan in the amount of {$260000.00}. As TMS was unwilling to provide me with information related to my loan, I filed a complaint with the Department of State ( DFS ). DFS was able to obtain some documents, one of which included the XXXX Underwriting Findings and a letter from TMS General Counsel XXXX XXXX XXXX, Esq. DFS said I should obtained a private attorney, but someone told me to contact CFPB for help in resolving this issue because the Ability to Repay ( Regulation Z ) falls under their guidelines. XXXX XXXX XXXX purposely made false accusations in her letters to DFS a government agency which I have evidence to proof are untrue, including her statement in the letter that it was my responsibility for not expressing concerns about my Ability to Repay. After searching online, the Ability to Repay falls under Regulation Z The Truth in Lending Act and is the lenders responsibility, not the Borrowers responsibility. Their attorney took advantage of my lack of knowledge about regulations and understanding about the Ability to Repay which seems to be an abusive practice on their part. TMS and their Attorney put the burden and responsibility on me ( the Borrower ) to tell this Lender whether I was qualified for this loan. On XXXX/XXXX/XXXX, as requested by TMS Loan Officer XXXX XXXX ( who is no longer at TMS per the NMLS sheet ) I sent my paystubs, tax returns, XXXX for the last two years ( XXXX & XXXX ), and later signed the IRS XXXX Form. Prior to this loan being approved on XXXX/XXXX/XXXX, at no time did TMS request any additional information or state that they needed to verify my declining income to ensure I qualified for this loan of $ XXXX. My down payment was put in jeopardy the day TMS loan processor issued the Commitment Letter and sent an email on XXXX/XXXX/XXXX stating my loan was APPROVED ; then requested additional information- a letter from HR Department was required regarding my decline in income from XXXX and XXXX. On XXXX/XXXX/XXXX, the loan processor wrote " ... XXXX 's do n't state why income declined. XXXX 's just show the amount you earn from year to year ''. I sent them a letter from my HR Dept. After receiving the XXXX Underwriter Findings from the ( DFS ) the declining income in question for 6 Weeks was my Non-Taxable Income that TMS employees could not find on my XXXX and Paystubs. On XXXX/XXXX/XXXX, their own Wholesale Underwriting Manager emailed and said Not my favorite way of doing it, but XXXX not here so I corrected it the best that I could and just signed the Commitment Letter on XXXX/XXXX/XXXX. It appears that TMS employees and underwriters maybe inexperienced or unable to understand and examine tax documents when processing mortgage loans. I have no idea when this loan was approved! The XXXX Underwriting Form Version 2 stated my loan was approved XXXX/XXXX/XXXX. TMS employees issued a Commitment letter and stated the loan was APPROVED XXXX/XXXX/XXXX, but later the loan was RESUBMITTED back to the underwriter for reviewed on XXXX/XXXX/XXXX and the new Commitment Letters were issued on XXXX/XXXX/XXXX. The loan was resubmitted on XXXX/XXXX/XXXX, why didnt TMS provide the updated XXXX Underwriting Form? In the XXXX Underwriting Findings, appears TMS intentionally omitted the correct figures on the Underwriting Analysis Report, principal and interest, the new Lock in Rate of 4.500 %, and did not factor in the 1.5 % HOA maintenance increase. With these above increases, I would not have been able to live and pay my mortgage and HOA fees. It appears that TMS underwriters added my non-taxable income to approve me for this loan amount. It seems like I would have lost the apartment and everything if I moved forward with TMS as my lender due to their deceptive and reckless practices.

Total Mortgage in XXXX CT pre-approved me by XX/XX/XXXX for a home loan by XXXX XXXX ( Senior Mortgage Banker ). We finally decided to put an offer on a property on XX/XX/XXXX and the offer was accepted. By XX/XX/XXXX, the process was started and we were redirected with XXXX XXXX ( Senior Loan Officer ). We received two emails and one phone call from her from then ( XXXX ) to now ( XX/XX/XXXX ). Everything they asked for, we gave the right documentation and I was on top of everything to make sure every paper and information i submitted was 100 % correct with no delay. I was a little worried not hearing back from XXXX after submitting everything because I sent 3 emails to her just asking to confirm if the documents I sent were in order. I did not hear from her so I was in consistent contact with XXXX XXXX and he kept giving me the same answer about XXXX that she was slammed with work because of the influx of people moving to CT from NYC because of the Pandemic. He kept telling me that he would try to get my case submitted to CHFA by XX/XX/XXXX the latest because CHFA is only working from the XXXX to XXXX of each month because of the Pandemic. I completely understand the situation. I backed off and after the XXXX, XXXX told me that the case was not submitted to CHFA by XX/XX/XXXX because XXXX had not processed my case yet because my closing date was put for XX/XX/XXXX and there were cases that were closing before that. Again, I am a reasonable person. XXXX contacted me on XX/XX/XXXX to " speed up the process '' he sent me the loan agreement and to ask for one more letter needed because a address for a different house came up under my name but it was my fathers ' ( my father and I share the exact same name ). But that same day I did the letter, signed and sent. I called him on XX/XX/XXXX because my lawyer and realtor were asking for updates. I called him and he said that everything takes time and we are okay with the process. So with this " speed up '' the case should have been submitted to CHFA by the XXXX of XXXX which was the first monday of the month hence when CHFA started to process cases again. I contacted XXXX on the XXXX Tuesday because again my realtor asked me for an update because the seller wanted to know what it going on with the mortgage lender. I talked to XXXX on XX/XX/XXXX @ XXXX XXXX to see where we were in the process and he said that his processing department is slammed with work and have not yet come around to my case file to submit to CHFA. On XX/XX/XXXX Wednesday @ XXXX he texted me saying they had lost power since Tuesday at XXXX XXXX ( before we spoke and he said he would see where my case was ) and this would delay my process a couple of days. Friday XX/XX/XXXX, my realtor advised me that the seller will not give anymore closing extensions. I advised my realtor to please contact my lender XXXX because at this point, i did not know what else to do when XXXX kept giving me the same run around. So I let the week finish and contacted him Monday XX/XX/XXXX, he said that my case has not yet submitted to CHFA because they are slammed with work. Honestly, we did everything right from the beginning and now the last day that the seller is giving me in Wed XX/XX/XXXX. I have two days, hoping that CHFA will review approve by Wednesday IF TOTAL MORTGAGE has even submitted my case. I might loose out on this property because someone else failed to submit paperwork about 2 weeks late. I understand the influx of people but someone has to be made accountable for a client.customer loosing out on a property for negligence or lack of people on payroll. I did everything they asked, submitted everything right away and for what? to end up with nothing, no home, no mortgage and no results. Process started XX/XX/XXXX, I submitted all paperwork on XX/XX/XXXX, XXXX and lastly on XX/XX/XXXX. Then was contacted on XX/XX/XXXX for additional paperwork, and i submitted that paperwork the same day. Now it is XX/XX/XXXX and I can not close or even attempt to make arrangement because Total Mortgage refuses to move any quicker and i am on a verge on missing out on this property.

I applied for a mortgage with Total Mortgage on XX/XX/XXXX and got a pre-approval on XX/XX/XXXX. I signed a contract to purchase a house thereafter. I reached out to Total Mortgage to let them know about the process the whole time. I got an initial disclosures on XX/XX/XXXX and signed it the same day. I got a mortgage approval XXXX, on that same day I got a comment letter, which I signed right away. The commitment letter specified the terms and I agreed to them. Little did I know, on XX/XX/XXXX I got an email prompting me to sign a revised initial disclosures out of the blue, which mentioned I agreed to a change of circumstance and 2 discount points ( {$8700.00} ) were added to the mortgage. I didnt sign it. I reached out to both the loan originator and loan processor right away to voice my concern and I was told by the Loan Officer, XXXX XXXX, that its a system update and that will be taken care of. This is all documented by emails and I specifically said I didnt want any discount points and my circumstance didnt change ( I didnt get any new credit, change jobs, or made any major purchase, etc ). Three days later I kept getting email notifications to sign that revised initial disclosures. Again, I didnt sign it and I contacted the loan officer again, who wrote back DISREGARD. Do not sign. Two weeks later, the week we are scheduled to close and the appraisal result had come back ( after 16 days ) above purchase price and the title work are completed, I got a final disclosures with the same discount points I didnt agree to and never signed. I called the loan officer again who then told me, he just found out that my loan was changed from XXXX XXXX to XXXX XXXX and thats why the points were added then. Somehow for 3 weeks no one seemed to care to explain that to me, and I was even told repeatedly that he was a system error but now 3 days before closing Im learning this isnt an error after all. My lawyer reached out to them, since this is in direct violation of the loan terms mentioned in the commitment letter ( and the loan estimates ) and my circumstance DID NOT change, they refused to have a civilized conversation with my lawyer. I understand the loan interest rate is floating until locked, but this isnt the case. They slightly decreased the interest rate mentioned in the commitment letter and loan estimates ( from 3.25 to 3.0 ) just to be able to add the exorbitant discount points I didnt ask for, nor was ever discussed with me by the loan officer. After many back and forth, they promised to update the loan terms to the original plan, and confirmed that by email. But we are just 2 days before closing and that still hasnt happened yet. Im still being told my file isnt clear to close yet, after I was told everything should be approved 2 days ago. Obviously, with their assumption that I would just sign the final disclosures as is, weeks after I discussed that issue with them. Im worried that we wont close on time, if at all, and might lost that house. Closing should have happened weeks ago, and has been delayed by them. I provided all the required documentation and everything else requested from me right away. I got pre-approved 2 months ago with the same credit profile, theres nothing new or out of the ordinary. They seem to be trying to change things up on me at the last second, which is illegal, using a change of circumstance as an excuse. I will not agree to $ XXXX more in closing costs when that was not in the original terms and my circumstance didnt change.

I purchased a home in XX/XX/XXXX. The original mortgage company was Total Mortgage. They sold my loan to XXXX XXXX XXXX. I made payments as they were due to whomever they were due to, as a matter of fact, some months I made 2 payments. I am currently paid up through XX/XX/XXXX in an effort to pay down my mortgage. I take my credit history extremely seriously, I am working 2 jobs and am going to school to obtain my XXXX in XXXX. If I can not afford something, I dont get it! To be told that I am showing up as past due in Total Mortgages system, actually makes my ill. If I made my payment to XXXX, as I was instructed to do, shouldnt XXXX reimburse them instead of saying that I am past due and owe them interest? I am not sure if his is a scare tactic, but its working. I reached out to my mortgage broker, and he is working on this, but I need help. We are talking {$1300.00} here, not a few dollars! The P & I from your first payment were transferred to XXXX in error so your loan is currently showing as past due in our system. I received a copy of your payment history from XXXX on XXXX and it is showing that you are due for a XXXX payment ( *if you have made a payment since this date may differ ) ; since the funds from your first payment were sent to XXXX it technically pushed your due date a month forward being due for XXXX. The error came to our attention and we put in a request to XXXX on XX/XX/XXXX to get the P & I reversed back to your account with Total Mortgage. This would not affect your PMI at XXXX since the escrow from your payment was purchased by XXXX, however, it would bring you back to currently due for the correct month of XXXX. If the funds do get refunded to us at Total Mortgage, I will ensure with XXXX that no late charge is placed on your account if they do not receive your due payment by the grace period. Another option would be to set up a repayment plan for the P & I of this payment to be paid to Total Mortgage for your convenience. We can based this repayment around a time frame you request from 6-12 months. The amount due is {$1300.00} ( principal {$360.00} and Interest {$890.00} ). I applied for the XXXX assistance XXXX XXXX program through my state and was approved for assistance with paying my mortgage. I made all my mortgage payments on time and have never been late, even through the process of applying for this assistance. I physically made my own mortgage payment for XX/XX/XXXX and I was approved for this program in late XXXX. The XXXX XXXX sent payment to the mortgage company on XX/XX/XXXX in the amount of XXXX to cover my mortgage which was still not late or past due or in delinquent status at that time. I called the mortgage company several times throughout this process to keep them aware of the application, process and payment information and paid my mortgage throughout. The funds were sent to the mortgage company on XXXX. XX/XX/XXXX my credit report shows my mortgage was 30 days late for XXXX. I called and spoke with them who assured me yes they see the payment and they will rectify the credit problem as I made my XXXX payment. It has been XXXX days and in the meantime I have called them several times to remedy this issue and it seems every time the story changes and they are not on the same page internally. XXXX credit report shows my mortgage late for XXXX, and the other shows late for XXXX, XXXX days late, although they said it was XXXX, which I paid on time, portions of my credit report show conflicting information on this account with regards to late/current/months paid status. I have called them more than 5 times to find a resolution. I have never made a late payment on my mortgage in the XXXX years I have had it. The payment was sent to them to cover XXXX, XXXX and XXXX mortgage and they have not internally applied it to my account. They said they have a disorganized internal system for dealing with the incoming payments from the XXXX funds from states. This is not my fault and should not be negatively impacting my credit. My credit has been egregiously affected and dropped over XXXX points. You will see my credit I have no late payments or a history of late payments. Another creditor of mine reduced my credit limit on my card by {$2000.00} as a direct result of this negative reporting. This has not been handled properly or in a timely, orderly organized fashion. My credit reporting for this account doesn't match and is XXXX misrepresented.

Started a mortgage application with Total Mortgage on XX/XX/2020. At the beginning of the process I was treated as if my business wasn't welcomed by XXXX XXXX. Once I applied and sent in my documents there was no follow up and when I called to follow up it was met with push back and disengagement. Another time when I spoke with XXXX XXXX was told because I didn't do exactly what he asked me to do then he didn't feel like he could help me. I asked if XXXX XXXX could assist me since he was initially the first person that reached out to me when I first applied, and he said you can give him a call in which I did and left a message because XXXX did not answer. I followed up with XXXX about a week in a half later in which my first conversation with him I received total attitude and proceeded to talk down to me before I could even fully explain why I was calling. I am not sure why I was treated this why by this company. I simply was trying to obtain my first home and sough out their company for a potential mortgage loan. Before the end of the call on XX/XX/XXXX, XXXX advised he would be re pulling my credit at my request. Then on Monday XX/XX/XXXX I received an email from XXXX saying that there are multiple layered risks and they do not feel comfortable taking my file on given the current financial climate. I was never asked any questions about my file, I provided every single document along with proof and account sign ins, my id and social, and more ; during this process I paid off 3 items that were hurting my credit ( which XXXX appeared to be displeased with me doing ). I was denied further service based on opinion and not facts. I also believe race played a role in that has well. By law if I am denied a loan based on my credit, finances, or any other factors I should be told exactly why I was denied and I wasn't.

We contacted XXXX XXXX XXXX XXXX # XXXX back in XX/XX/XXXX to get a mortgage loan for the house. The loan number is XXXX. - Their office manager XXXX XXXX orally and wrote in multiple emails confirming that our rate was locked at 5.125 % with no point on XX/XX/XXXX, but he actually locked us at 5.5 % with XXXX point and sneaked this in the agreement without telling us in advance until we read the agreement and noticed this after a few days. We negotiated with him, and he promised to ask for the discount to get us to the 5.5 % without any point before the closing. - On XX/XX/XXXX, they vetted all of my income and offered me the commitment letter. I asked him about that XXXX point he promised to remove, but he told me to send him more clients and then he can help me with that. Hes basically asking me to bribe him. - However, they suddenly came back to me on XX/XX/XXXX and said that my income doesnt qualify anymore and wanted to raise our rate to 5.99 % in the last minute without any valid information. At this point the rate already went up nationwide, and we missed the window to get a good rate as 5.5 % because of the fraud they committed to change the rate after they locked it. - We didnt have enough cash to buy the XXXX point to lower it from 5.99 % to 5.5 %, and our closing date is on XX/XX/XXXX in two weeks, so we had to go with 5.99 % interest with another lender because XXXX XXXX XXXX committing fraud and we dont trust them anymore, and we dont have the {$5700.00} cash to buy the point from 5.99 % to 5.5 % at this point. - We reached out to their XXXX XXXX XXXX, but he only refunded the appraisal fee we paid to them, and refused to pay the {$5700.00} to cover our financial loss.

Acquired a mortgage in XXXX through XXXX XXXX at Total Mortgage in XXXX, CT. XXXX rarely responded to emails after he and his staff demanded we get documentation in by a certain day. We needed our lawyer to request XXXX extensions from the seller 's attorney as a result of XXXX dropping the ball several times. He told us he would try to float down our rate, then never told us when our rate even expired, then tried to bully us into paying for a rate lock extension. XXXX many times threatened us by stating we did n't deserve good customer service and he could charge us what he chose to extend the rate. We had to ask for the GFE paperwork XXXX times until it was finally emailed. 4 days before our closing the company all of a sudden demanded we close all our credit card accounts since they were paid off. XXXX associate XXXX, then told our lawyer we would n't be closing until at least 3-4 days after the set date. The icing on the cake was right before closing where XXXX admitted to bullying us because we asked to many questions and again said we did n't deserve good service. He then began shouting about all the loans he 's closed this year and how great the company is. Many people we worked with to close our loan were surprised and apologized for the poor service we received by this company. I was fine with dropping this but felt a complaint should be filed after I posted a review on XXXX and now XXXX has begun harassing me by texting my cell phone about my review. The next step if I get another text from him will be a visit to the police station in the town he does business in order to discuss harassment charges.

This has absolutely been the worse experience I have had with a lender. They have caused much distress and sadness in our family. We filed our Application with Total Mortgage Address : XXXX XXXX XXXX, XXXX, CT XXXX on XXXX XXXX, 2016. Our signing date was to be XXXX XXXX and closing date XXXX XXXX, 2016. Total mortgage missed our signing date and closing date. Did not find out until XXXX XXXX that the house would not close on XXXX XXXX. We were due out of our rental home on XXXX XXXX. They almost made us homeless. Thank goodness our landlord let us stay. They stated to our lender that they sent out closing documents on XXXX XXXX but the documents did not show up until XXXX XXXX. Their sales person sent us an email right after the documents were sent to disregard the closing documents that it was sent in error. Per their website : 30 Day Guarantee Need to close on your new home quickly? We guarantee that we 'll close your purchase within 30 days. * Otherwise, we 'll make your first mortgage payment As you can see, this did not happen. We are still in limbo. They have disregarded the VA regulations and the email from the manager that was sent regarding our loan. They cost us {$490.00} in appraisal fees and {$1000.00} penalty fee ( normally {$250.00} a day ) to our builder because they did not close on time. They told our lender that this loan would get done and as of XXXX XXXX, 2016, nothing has been completed nor communicated on this loan. I want people to be aware of this companies false hopes. I would like for them to refund my fees for not closing on time.

I started a mortgage refinance application on XX/XX/2021. For the most part, everything was going fine until the processor ( XXXX ) asked for my son 's birth certificate. My son is XXXX, and I include him on my income since he gets SSDI. Total Mortgage Services stated they need to confirm our relationship. I told them that this makes no sense why they are requiring excessive documentation to see the relationship. Do other people have to confirm relationships? A birth certificate is extremely sensitive paperwork that should not be floating around in a loan package. I can see a federal or state agency asking for documentation but not for loan. Furthermore, they already had his social security verification letter for income and our bank statement which has both our names listed as owners. XXXX XXXX said he could add my son to the loan which we did not want to do nor is it acceptable to try changing what I already had applied for and my locked rate. The point is I am a senior citizen and my son is XXXX and I feel the excessive asking for his birth certificate is unacceptable and reckless -- this is not normal paperwork for a mortgage. So since I replied to him we are still not providing a birth certificate nor changing the loan application he decided to cancel my mortage application today.

Total Mortgage serviced a mortgage for a period of time in 2016 on my house. They have been unable to furnish my tax document for the interest I have paid. I tried calling them, their phone consistently bounces me to their sales desk with someone looking to take my personal information to have a loan officer call me back. They can not give me the number nor can they connect to someone in customer service. They say that they are giving me someone in customer service, but the phone number merely connects right back to the sales desk. This happened more than once. I got a call back from a loan officer and the number used was a local number. The sales rep was located in CT. I think that is a deceptive sales practice. I just want my tax document. It should have arrived by now.

I currently working with Total Mortgage regarding my loan modification due to COVID-19. I gave them all necessary documentation and was told my payment would be lowered by {$200.00} from {$3300.00} to {$3100.00} dollars. When filling out the documentation, I requested my payments to be returned to the original amount of the refinance contract of {$2800.00} that had been increased because of the misinformed representative that told me not to pay my equity while XXXX XXXX XXXX XXXX XXXX XXXX 2020. In addition, while my account was on forbearance they informed the 3 credit bureaus that I had a month of late payment which gave me a negative rating. I requested it to be removed being that by law its not supposed to show any negative remarks while on forbearance.

This company is nothing more than a " bait and switch ''. I contacted Total Mortgagein XXXX, CT to refi a mortgage currently held by XXXX XXXX XXXX. The loan offier is XXXX XXXX. My credit card was charged a processing fee of {$690.00}, which I was assured was simply a " HOLD '' on my card and would be removed once the loan was processed. The loan was processed on XXXX XXXX. The company refuses to credit the {$690.00} charge on my credit card. I paid {$460.00} for a home appraisal that was also included in their processing fees as part of closing. I was informed I would no longer be paying PMI. Exactly one day prior to closing I was informed I would still be paying PMI, however, it would now be included in my monthly payment.
