On XXXX XXXX, my vehicle, a 2005 XXXX XXXX XXXX XXXX XXXX XXXX was repossessed by my finance company, TOTAL FINANCE A.C. L.L.C., within just 25 days of my actual " XXXX '' payment was due. I called the Finance company immediately to ascertain why they confiscated the vehicle, and they stated because the payment was late & I had n't reached back out to them directly in a timely-fashion. Ironically, my XXXX installment, which I paid 23 days late in XXXX ; was beyond my control & I disclosed the reason why. ( My bank account/debit card number had been compromised in XXXX, IN. @ a XXXX 's & I had to obtain an alternate debit card ) I asked XXXX, an acting Manager, if she could provide a copy of the agreement that I signed & send it to my email address so I could CONFIRM AND VERIFY that this action that had taken place by them was LEGAL. I also stated to her that my copy of my contract/lien agreement that I signed, was located in the rear pocket, directly behind the driver 's seat. She originally stated that she would ; then when I had n't received anything, within a timely-fashion ( an HOUR ), I became uneasy & curious & therefore, I called back. When I spoke back to XXXX, she then stated that she did n't have access to my file and would n't be able to send a copy of my contract. I questioned that since she was handling the duties of the Manager in their absence. Long story shortened, She was very rude and unresponsive to several inquiries. 1. ) How much would it NOW take to retrieve my vehicle? 2. ) How could I retrieve my personal belongings? *Since my WORK ID and uniform was currently in the vehicle. * XXXX, In addition, I am a XXXX XXXX & I am so grateful and fortunate that I had taken my Personal equipment out of my vehicle ; because I mainly work on the weekends, and I still had XXXX XXXX to do ; which would have been LITERALLY IMPOSSIBLE to fulfill ; based upon the inability to retrieve my PERSONAL BELONGINGS. The entire day/evening was spent with me being transferred from representative to representative that were n't there, and ultimately not being provided with ANY SUBSTANTIAL nor PERTINENT information about my VEHICLE or my PERSONAL effects. On Monday, XXXX XXXX, I patiently waited ALL MORNING to be CONTACTED & UPDATED on the status of obtaining my vehicle & belongings ; to no avail. Feeling totally frustrated and helpless re : the handling of this situation ; my fiancee ' even attempted to intervene by contacting the Finance company & received the same SPIN-CYCLE rhetoric. Even when she disclosed to XXXX that we had the money to obtain the vehicle back, she was then told that we had to make an appointment and be scheduled in order to complete that action ; because the vehicle was not in their possession.???? I HAVE NEVER EXPERIENCED such UNPROFESSIONALISM and SHEER RUDE BEHAVIOR, nor have I had a FINANCE COMPANY REPOSSESS MY VEHICLE ; in less than 30 days from non-payment. ( when normally, it 's done after 90 days of being delinquent. ) As of Wednesday, XXXX XXXX, the ONLY person to assist in my review of the contract/lien agreement that I signed is the salesperson named XXXX XXXX, who sold me the truck ( & whom has also stated that he would FILE A COMPLAINT, on MY BEHALF ) @ XXXX XXXX, located @ XXXX XXXX XXXX in XXXX, IL. Upon reviewing that document, THERE IS NO SPECIFIC LIMITATION/RESTRICTION that denotes that they may repossess the vehicle IN THAT short amount of time granted. In closing, As a SELF-EMPLOYED individual, I would never have defaulted on the loan ; especially when I was in the VEHICLE OF MY CHOICE, personally SATISFIED with THAT DECISION to purchase it & depended on that entity to fulfill my job requirements and SUPPORT MY FAMILY. I have a Car loan for a XXXX Cadillac escalde. I have Fell behind in payments and was concerned I hired a power of attorney to help me out His name is XXXX XXXX He has been doing his job He sent a cease and desist letter to the creditor and they call me non stop and are harassing me daily They even call third parties for me such as my son in aw and my son in law mother It is ruining my family slowly and is embarrassing What else can I do? Also they have now started to take my wages from my paycheck I had no notice of this No paperwork, nothing in fact of this How is that right or fair to me? Why do they harass me? Why are they taking my wages with no notice to me? The creditor, loan company is total finance, they are located in XXXX Illinois at XXXX XXXX XXXX XXXX XXXX, XXXX their phone number is XXXX I have all phone records as proof I also have all the voicemails I have my paycheck for proof of the garnishment I also did my research on this company and found they are notorious for breaking laws Such as not reporting correctly to the credit bureaus also giving people vehicles with bogus social security numbers and very high interest rates that change from the dealership to the paperwork I really need your help to stop them from breaking the laws please I do not know what else to do XXXX XXXX the power of attorney sent the cease and desist with conformation received from them on XXXX XXXX 2015, and XXXX XXXX 2015 They tell XXXX their attorney will call him and they have never called him not one time they call me daily they leave robot voicemails and live voicemails on my cell phone which I also believe that robot message on a cell is illegal Its a fact they are a bogus company that break laws its public information and also have attorney general reports on them

I went into the XXXX XXXX XXXX XXXX located in XXXX XXXX XXXX XXXX in XXXX Illinois XXXX, to purchase a used automobile. When and while negotiating for the vehicle we came to an agreement. To my surprise the car outlet charged me a " Voluntary Debt Cancellation ( VDC ) '' coverage in the amount of {$2200.00}. This particular fee and coverage was not explained to me nor was I advised of it when I was executing the documents. I had expressed to the dealership that I would obtain full coverage insurance on the vehicle and that my insurance carrier would cover any potential loss that may occur. This particular VDC fee had a {$1000.00} deductible if a loss were to occur. On XX/XX/XXXXI went to the XXXX XXXX to return the vehicle or enter into some better financial arrangement as I was experiencing some hardship with the moving of my business to a new location. The dealership refused to renegotiate lighter terms or extend the term of the loan thereby lowering the payment. I finally left the car in the custody of the dealership at their XXXX location. I left for my home to think about my options returning the following day to see that the car had been placed in their back lot with all the windows and trunk wide open allowing the rain to completely soak the interior of my car. The XXXX XXXX was under the impression that I had turned the car in and decided to walk away from the obligation. I discovered that the XXXX XXXX had purposely left the windows and trunk open in order to file a claim with the very insurance company coverage they had secretly sold to me. The interior of the car was full of water, mold and terrible odor. I had expressed to the XXXX XXXX what I had witnessed and they completely denied it.

I purchased a used vehicle from XXXX XXXX in XXXX, IL. around XX/XX/XXXX. A week after the purchase I came to realized that it is a Used Lemon vehicle. The vehicle has been serviced by their auto mechanics 4-5 times in regards to the same issue ( Engine and Cooling system ) and had to pay {$350.00} deductible each time, it has been address to the company 's customer service along with the Finance Company ( TOTAL FINANCE, LLC. ) and the person and his manager that sold me the vehicle. I have already invested a little more than {$4500.00} in repairs for the same issue. It was sold to me at an interest rate of 29 %. Well getting to the issue, I have been trying to get in contact with the finance company ( as of XX/XX/XXXX ), to do a voluntary surrender of the vehicle, I already explained that I can no longer afford the vehicle payments and also can not afford to be making more repairs. They have been refusing to talk to me, after leaving voicemail messages to contact me, but have been calling my wife 's cell phone non-stop and also sending her text messages, and even threatening her that they are going to get a hold of her social security number to garnish her wages. She ( My wife ) was also told that they are not even interested in doing an voluntary surrender. As of today, she has received 5 phone calls from the company and so far 1 text message. The XX/XX/XXXX information clearly states that I 'm currently the 7th owner of the vehicle, and the rating is XXXX, the vehicle is only worth less than a {$1000.00} for trade in or to sell. My payment was due on XX/XX/XXXX, I 'm only 10 days late.

My car was taken by city of XXXX i called my finance company many times on status updates with my vehicle a guy that originally handled my account i spoke with and he called trying to collect on a debt first time we spoke i started asking questions regarding my car and told him after repeated attemps to find out whats going on how can i continue to pay and know nothing about my vehicle when he then got closer to the phone and with a lower voice states thats not my problem that your car was taken very rusely so i asked for a manager and which he refused to pass me to one so i hung up and called back repeated time which i was then ignored so i waited a few days and called again they said they will get a manager to call back which never happened and then the same employee called again trying to collect on the debt this time not verifying who he was speaking with jist told all my information to a 3rd party so i finally got in contact with a manager which said she was sorry etc and i told her i only want to spk with members of management which continued to not happen so then another guy called and with no recordi g statement no mini maranda warning which was also never done prior then has the same remark stated by first employee so i then vr he was a collector he said yes i vr he knew his fdcpa laws said yes then i pointed out everything he did wrong and cease and assisted all Communications and started to look for a attorney which i still am seeking

I financed a vehicle from XXXX with Total Finance Company in XX/XX/XXXX. Upon financing the vehicle I was told that I didn't need full coverage insurance. I got into a car accident XX/XX/XXXX. The finance company tows the vehicle away XX/XX/XXXX They have had the vehicle since then up all the way until now. they have had my vehicle for two months now and every time I call they tell me my vehicle is under review. They are still collecting payments for my vehicle but yet they are not giving my vehicle back or letting me know if they are going to fix it or not. They claims department doesn't answer the phone and when you try to file a complaint no one never answer the phone. This finance company is a scam. And they keep threading me saying well if you don't pay your loan we gon na hit your credit. These people are telling folks they don't need full coverage insurance on their vehicles and taking their cars hostage and still making them pay for loans hoping they eventually default because they know people are not going to pay for product that they don't have. If this finance company would have never advise me that I don't need full coverage insurance I would have had my cat fixed and would not be going through such hard ships this finance company has cost me two jobs because the won't relinquish my car or fix it.

I have a current loan open with Total Finance out of XXXX. I am having some issues as far as harassing and extremely demeaning treatment from multiple representatives there. And every time I have tried to speak with someone in management I have been hung up on. My XXXX is not very good, and I am thinking that maybe that is why I am being spoken to that way. Today XX/XX/2015 I called to place my son on as POA, so that he could better understand them so we could clear up any further issue they may have, which I will explain their current issue in a moment. Instead of being helpful, my son was yelled at and ridiculed as if he was not smart enough to handle the matter. I am now beginning to have anxiety about the treatment and with no manager to ever get on the phone, I do n't know who to turn to. As for the issue they are having, of course I keep a current loan with them, and I do fall behind from time to time. I have been paying for over XXXX months, and yes I have been late several times, but my intention is to pay always on time. My issue is that they are calling my sister and mother with the same type of harassing demeaning approach. Please I need help on what to do.

My name is XXXX and I have a big issue with this financial group. The problems started when they could n't show me my payments and with the overall balance. For a little over 2 years now I 've been with them. I have also have asked to speak with a manager but they have denied me that privilege and only handed me to speak with someone on the phone but I needed someone in person so they can explain to me my issues.
