On or about XX/XX/2021 I received a letter from XXXX XXXXXXXX stating my mortgage was increasing from {$1000.00} to approximately {$1200.00} due to my escrow have a XXXX negative a balance. I contacted Mr. XXXX, a manager at XXXX XXXXXXXX confirmed that the was accurate. I then contacted the XXXX County, OH Treasurers Office and they informed me that my real estate tax was not paid this past XXXX when I refinanced my home but was paid this past XXXX. The treasurers office did inform me that my property tax had increased this year which I was already aware of. I then contacted Title365 who also sent me a check for {$2200.00} back in XXXX or XXXX of 2021. I spoke with XXXX and he told me that " I should not have received that money because it is a VA loan, and it came out of my old escrow account. '' SO, I asked him who was at fault, he said, it was our fault. " ( Title 365 ). Thus, leaving me with a negative balance and to make up that balance, I would have to either make a payment of {$2300.00} to immediately get my escrow in the black or pay an extra {$210.00} plus my mortgage for the next 12 months. This action has put a strain on my finances. On Monday, XX/XX/2021 I spoke with XXXX XXXX the funding manager for Title365 and apprised him of the situation. I explained to him that I should not be penalized for their mistake. He told me, " since you received a check from us that should have raised a red flag. '' So, in essence he is putting the blame on me for his company 's mistake. Additionally, he offered to pay the fees and penalties for the late real estate filing which he did not give me an amount. I told him I do not know real estate laws and over 75 pages to look over during signing, anyone who is not in the business can miss something. If this was a reputable company, they should make it right. Finally, if they are willing to pay for the fees and penalties, then they can pay the entire amount.

No return phone call. XX/XX/2020 - Contacted Title365 to follow up. No return phone call XX/XX/2020 - Emailed XXXX XXXX XXXX Closing Manager ) for follow up XX/XX/2020 - XXXX emailed me and notified the deed was recorded incorrectly and following up with recorders office for remedy. XX/XX/2020 - Emailed XXXX asking for a status XX/XX/2020 - Emailed XXXX asking for a status XX/XX/2020 - XXXX emailed with two options waiting for the lender to provide a releaseXX/XX/2020 - Emailed XXXX my frustration as this is dragging out too long. No response Loan # XXXX I've made numerous attempts by phone, and email communication to remedy the negligence with Title365, but they have yet to provide a solution and timely response.

{$2800.00} was incorrectly and unnecessarily collected by Title365 at closing of this refi as prepaid by loan servicer, XXXX XXXX, to be paid as property tax to XXXX County for the XX/XX/XXXX year. Section F of Closing Disclosure. However, after calling the XXXX County Trustee 's office it was reported that only one payment was received by previous mortgage servicer, XXXX XXXX, on XX/XX/XXXX, as all mortgage servicers probably do for this county in advance of it being due. This money was collected by Title365 and never used for what it was meant for. My loan is collecting interest on this for no reason. I want all of the money back with a credit for the undue interest as a check, or added into escrow to be disbursed as overpayment later.

I closed on my home for a refinance with Title Company Title365 on XX/XX/XXXX, for a property in MD. In the closing, an amount of {$1500.00} was collected for the XX/XX/XXXX payment of XXXX XXXX property taxes. These taxes were never paid. I received a Real Property Tax Levy Delinquent Notice from XXXX XXXX on XX/XX/XXXX. Since then, both the mortgage lender and I have been trying to contact Title365 to get proof of payment. They have never answered their calls for me for the last three months nor the lender and finally, the lender took the money from my loan escrow account to pay the taxes ( double paid ). I request an immediate refund of {$1500.00}.

I have reached out numerous times to address issues with a refinance on my current home. I had closed on my home on XX/XX/2021, and had a payoff for my supposed previous mortgage on XX/XX/2021. I have contact Title 365 via the mortgage broker numerous times without resolution. I will now incur additional interest costs on my loan since they have not paid off my current loan.
