On or about, XX/XX/XXXX, I purchased a vehicle from XXXX XXXX XXXX XXXX ( " XXXX XXXXs '' XXXX XXXX XXXX XXXX, UT. The salesman, XXXX, completed all of the paperwork for the purchase agreement, as well as, the loan application and the finance agreement for XXXX 's in-house finance company, Titanium Funds ( XXXX XXXX 's XXXX XXXX ). XXXX completed the signing of each agreement XXXX well over 30 pages of documents ) using a small tablet device, and the entire process lasted XXXX hours. During the signing of these agreements, XXXX made several misrepresentations of material facts, the one most pertinent to this complaint regarded the flexibility of the payment schedule associated with the finance agreement and the finance company, Titanium Funds. XXXX represented Titanium Funds and the terms of the agreement to be far more flexible than Titanium Funds allows. In fact, XXXX stated that Titanium Funds would work with debtors in the event that they had to make a late loan payment on the vehicle, although XXXX did state that Titanium Funds would report all payments, late or not, to the credit bureaus. The fact of the matter is, Titanium Funds is possibly the most rigid lender doing business, and their inflexibility surrounding loan payments can not be described as anything but mandatory strict compliance with the contract terms. Evidence of this fact can be found in my dealings with Titanium Funds on XXXX XXXX, 2021. On or about, XX/XX/XXXX, I contacted Titanium Funds and spoke with a representative, XXXX, I believe her name was, to discuss a payment plan or a possible extension of the payment deadline on my loan which was due on XX/XX/XXXX. I inquired as to whether or not I could make a partial payment on XX/XX/XXXX and pay the remaining balance two ( 2 XXXX business days later on XX/XX/XXXX. XXXX informed me that Titanium Funds ' policy was to not accept partial payments. I then inquired as to whether or not I could get an extension on the payment deadline to make the full loan payment on XX/XX/XXXX rather than XX/XX/XXXX. XXXX informed me that it was Titanium Funds ' policy to only allow a XXXX ( XXXX ) day grace period to debtors before the vehicle would be disabled automatically using a starter interrupt device XXXX " SID '' ) unless the debtor submitted to inspection by Titanium Funds the financial conditions ( e.g. a note from a doctor, a low paycheck amount, etc. ) giving rise to the request so that a loan administrator could approve it - such a request from a creditor was previously unheard of by me prior to Titanium Funds ' request. At that point, I began to discuss, adversarially, the numerous misrepresentations of material facts that XXXX had made during the signing of the contracts, his failure to disclose the condition of the vehicle, and more. XXXX then asked if I would like to speak to their attorney, and I started that I would. XXXX then transferred me to voicemail, and I left a message. As of the time of this writing, I've received no return phone call from anyone representing themselves as Titanium Funds ' attorney. On or about XX/XX/XXXX, I contacted Titanium Funds a second time to speak with their attorney. In an effort to reach the attorney, I explained the situation to the representative who reiterated Titanium Funds ' strict compliance position. I then requested to speak with the attorney. The representative then transferred me to another representative who stated that she was the paralegal in Titanium Funds ' legal department. I reiterated to the alleged paralegal that I desired to speak with the licensed attorney for Titanium Funds to which she responded that the attorney does not speak to debtors but will only speak to other attorneys representing debtors. She then solicited the details regarding my position which I explained but quickly became aware that she was neither competent to address or willing to address. Instead, the paralegal simply repeated over and over again that their contracts were iron clad. Eventually, the representative terminated the phone call. A short time later, I called Titanium Funds back and asked to speak with the attorney. Again, the paralegal answered the phone and the situation resulted in a similar result to the first with the paralegal again refusing to put me in touch with Titanium Funds ' attorney and the representative demanding that I do not call the legal department again. Now, there are several issues that I want to bring up in this complaint : XXXX. XXXX 's made several misrepresentations of material facts surrounding the terms of the finance agreement, specifically, the flexibility of the payment terms ; XXXX. XXXX and XXXX 's had an impermissible conflict of interest that tainted the finance agreement and motivated XXXX to make these misrepresentations of material facts, to omit material facts regarding the true conditions of the vehicle, and to fail to disclose material facts pertaining to negative equity or unsecured debt and/or to limit the terms of the finance agreement to only secured debt or the actual value of the vehicle ; and 3. The use of coercive tactics, threats, and/or harassment in the collection or enforcement of the unconscionable finance agreement tantamount to a debtor prison or indentured servitude executed by a digital leash, fence, and/or arrest device ( i.e. geolocation devices, starter interrupt device XXXX in their efforts to enforce the debtor 's strict compliance with an unconscionable and/or unenforceable finance agreement. Without question, Titanium Funds is a predatory lender offering subprime auto loans to consumers who wish to purchase vehicles from the partner/affiliate dealership XXXX XXXX 's ), and they use this vertical integration to bypass the fair, honest, and good faith protections available to consumers in m with better credit ratings in order to exploit high risk debtors using deceptive, oppressive, and fundamentally unfair business practices centered on the vertical integration of a dealer that sells vehicles at the highest imaginable price which they then finance at the highest imaginable interest rates while they manufacture debtor default through onerous finance agreement terms in order to seize the vehicle at the first available opportunity so that they can collect interest payments under that agreement while maximizing the principle of the loan when it comes time to resell the vehicle and obtain judgment for a deficiency. If this is legal, then there is no point in complying with the law because the law is a threat to the consumer 's well being.

On XXXX XXXX Titanium funds called me to get a payment for a vehicle I crashed ( XX/XX/XXXX ). First off I was told I had traditional GAP insurance ( day I bought the car ), come to find out after my car had been totaled I had collateral damage insurance. They arent the same thing. They told me I could go back to the dealership I bought the car to get my old cars balance wiped clear ( XX/XX/XXXX. Told them that isnt gunna happen I already bought a car and wasnt going to have a high interest rate. I got my lawyer involved to help resolve the situation. I had let titanium funds know what was happening and they proceeded to call text and email me daily. XX/XX/XXXX I received a call from titanium funds, I told them the situation again and told them I would not be paying for the car until I was instructed to by my lawyer. The gentleman on the phone told me no lawyer would ever tell me that, I told him yes they would because they did. I told him I have dealerships, lawyers, and family who have seen this tell me to stop paying. The gentleman proceeded to tell me nobody would tell me anything like that. The gentleman was very disrespectful to me. I asked him to put a FULL cease and desist on my account I didnt want further communication with titanium funds. He told he wouldnt do that due to my account being an open account and me owing balance. I informed him I worked in auto financing, so my jab is the exact same his is and I know he HAS to put a cease and desist on my account if that is what I request. The gentleman on the phone said once you learn the correct verbiage I will put a cease and desist on your account. I proceeded saying you are harassing me so put a full cease and desist on my account. The gentleman on the other line refused to put one on my account. I ended the call and emailed titanium funds this is your written notice to put a FULL ceased and desist on my account. DO NOT contact me, my references, relatives, neighbors, or my place of work. Proceed to XX/XX/XXXX I received a text and an email. I didnt respond. XX/XX/XXXX I received two calls back to back, a text and an email. Again didnt respond or answer the phone calls. XX/XX/XXXX ( today ) I received two calls back to back, a text and an email. Again no response

I purchased a used vehicle back in XXXX at XXXX XXXX XXXX where i was referred to by a friend of the family and at the time i didnt have much money to put down on a new vehicle and they were advertising you could get a vehicle with little as XXXX cents down on approved credit so i figured i would give them a shot. Upon going to the dealer lot and filling out an application i noticed alot of the cars on the lot were old after sitting down with a sales manager i was approved at first for the XXXX cents down then they told me that i didnt make enough and would have to put down more so i ended putting down {$300.00} and my financed amount was {$11000.00} so i ended up getting a XXXX XXXX XXXX le they dont charge you monthly like a normal car dealership its based off your pay frequency so i was paying for my car every two weeks in the amount of {$210.00}. The amount of interest i was paying for that car was around XXXX XXXX which is way too much for such an old vehicle i could of bought the exact same car cash for $ XXXX ended getting into a accident XXXX of this year where someone rear ended me on the freeway and totaled the car and the airbags did not deploy. unfortunately i had to get another vehicle through the same place because once i again i was short on money to go anywhere else and i needed a car as soon as possible to be able to go to work so ended up getting a XXXX XXXX XXXX XXXX for {$17000.00} which the car is nowhere near worth XXXX only values the car for XXXX or XXXX XXXX at the most. my issue is not only with price and high interest rate but they also do not fix anything on these cars they have a very limited warranty that covers parts that are not even going to break down on the vehicle any common issues they dont cover and leave you on own to fix or pay for this new car is already giving me issues regarding the suspension and struts and the brakes and wheel bearing there is all kinds lights going off and the check engine light on

On XX/XX/2022, at approximately XXXX XXXX. Pacific time, I received a call from XXXX related to an attempt to collect a debt allegedly owed by my sister. The person on the phone identified themselves as working for Titanium Funds. The call violated 15 USC 1692b, 1692c for the following reasons. First, the caller identified her employer ( Titanium Funds ) without my " express request, '' in violation of 1692b ( 1 ). Second, in identifying her employer, the debt collector implicitly revealed that the call related to the collection of a debt, in violation of 1692b ( 2 ), not just because the name of the company itself discloses the nature of its business, but also because Titanium Funds publicly holds itself out as a " Consumer auto lender in Utah. '' Third, the stated purpose of the call was not to collect location information. Instead, the debt collector told me she wanted me to pass a message along to my sister ( whom the debt collector identified by name ). 1692c ( b ), only allows communications with third parties for the sole purpose of collecting location information : the debtor 's usual place of abode, the debtor 's telephone at that place of abode ( i.e., a landline telephone number ), or the debtor 's place of employment. The debt collector did not ask me for any such information. She asked me to communicate a message to my sister, in violation of 1692c ( b ). I informed the debt collector that I understood her call was not allowed under debt collection laws and that I would not act as a middleman in delivering messages to family members. I then terminated the call.

On XX/XX/2023 I received a car from them. Other than the fact that they prey on people in tough situations with absurd APRs, overpricing their vehicles ( XXXX for a vehicle valued at XXXX ), they're also thieves and frauds. They took the car back before I even had a chance to make my payment because " my paystubs were fake ''. When I offered him to come talk to my employer directly for proof, suddenly my XXXX wasn't interested. I called to see when I can retrieve my tools out of the car ( worth around XXXX dollars ), was told I can come in Friday after work. I went in, XXXX said " the shop is closed and I can't get them, but I should be able to get them on Monday. '' I wasn't able to come before Tuesday, and suddenly their place was " broken into '' and no Tools of mine were found anywhere. Funny how that works. When I asked for camera footage for a police report XXXX said " they have no cameras ''. A dealership with XXXX of XXXX of dollars in cars doesn't have any surveillance? yeah right. I spoke to a few other employees and none of them were aware of any break ins somehow. I have attempted several times to pick up my tools and have good reason to believe I am being lied to and my tools were stolen by someone at the dealership. Its also possible they sold the vehicle to someone else without looking ( several of their vehicles we looked at had belongings, including the addresses of previous owners ) and needed an excuse to come up with why my tools are gone.

I have had a car with XXXXXXXX XXXX XXXX since XXXX of XXXX and here is is XXXX of XXXX and none of the on time payments Ive made have been reported to the credit bureaus which is why I took a car from XXXX XXXX XXXX and they have no followed through on their end of the bargain but Ive been holding mine. If I dont pay on time by a few hours they are quick to contact you and disable your car so you cant drive. XXXX has almost cost me a job by turning off the car which is what they want so you cant pay them and they can either sue you or tow the vehicle. I have asked many times why they cant report my payments and I get told different reasons every time. I am just going to take this car and trade it to XXXX and pay the {$800.00} a month I would to XXXX and pay for a model XXXX. This business has also been telling people on their reviews for years that the credit issue and them not reporting payments will be resolved. I am contacting a lawyer to get what I am owed for having this vehicle but someone needs to look into their shady business practices. Also they lie about the warranty

Back in XXXX I financed a vehicle through Titanium Funds in Utah. After 2 years of on time payments I fell on hard times and the vehicle was repossessed. They resold the same vehicle less than a month later as it was parked across the street from my house and the key fob I had still worked, I talked to the new owner that got it through the same dealership and finance company and gave him the extra key. To this day I'm still being garnished for that vehicle, they have collected over {$12000.00} from me, and XXXX know what they have collected from others on the same vehicle. My biggest issue is on the only credit report of mine it shows on, the last balance they reported in XXXX of XXXX was less than {$3000.00}, but on the garnishment paperwork they are wanting to collect over {$5000.00}. My most recent check stub shows I have paid just over {$2000.00} and there should be only 1 more payment to be taken. I fear they are going to keep collecting as much as they can. Please please help me put a stop to this.

Lucky auto is a scam I did not get XXXX cents and a job gets me a car I had to pay down payment of XXXX dollars first fraud they did second I have now purchased two vehicles from this lot the first they reported 5 ontime payments I have been paying ontime for now two separate purchases and the closed the account when I got on XXXX XXXX without updating almost 4 years worth of on time payments and also don't know the balance owed on credit. I need my credit I need them to report they are known to scam people if you can't help I may need to get a lawyer because they are taking advantage of people with bad credit! They lock you into a used car that is 3 to 4x as much as the car value so yeah please help!

I placed a dispute on my XXXX credit report for an item that was incorrect. XXXX resolved the dispute but removed the wrong account from my reporting. They removed my current auto loan from my finance company and my score dropped. I have documents and invoice statements and I need it readded and corrected, as well as my finance company has not reported on my XXXX report since XXXX of last year. I purchased a vehicle that was financed through titanium funds back in XXXX. I had the car for about XXXX week and I could not afford to insure it and i returned the vehicle to the car lot. Titanium funds has been reporting negatively on my credit every single month since XXXX. I am on XXXX and Ive asked several times about forgiveness or what I need to get this off my report and they said that there is no statute of limitations on how long they can report and refuse to give me any kind of assistance in resolving this.

Re : Titanium XXXX Titanium is reporting a debt on my credit file that is not owed. I recently had my credit pulled and noticed this debt is still reporting a balance. I had previously disputed this with the company and never received any correspondence back which leads me to believe they did not receive it or they ignored it. This debt was paid off months ago but they haven't changed it and it's really affecting my credit. This is erroneous and needs to be removed from my credit.

I went somewhere to trade in my car and they pulled my credit and found out I dont even have a car loan on my report I got a car from lucky auto credit becaue they said it would help with my credit found out they havent been reporting to any bureau for a year even properly longer for other people

Mislead by the sales person and the advertisement on the wall about an additional fee that would cover insurance, this turned out to be untrue and the vehicle was impounded for no insurance. Not reporting anything to the credit bureau about the loan, not applying payments when made online.
