Deadlines were missed due to this mortgage company and XXXX due to major inefficiency and inability to hit KNOWN deadlines. This caused me to have to pay 1 % of purchase price of loan twice to the builder in XX/XX/2021 and XX/XX/2021 for missing close dates. For each month the deadline was the last day of the month. Neither deadline was met by the mortgage company or lender. We were asked for documents that the underwriter needed and in each instance documents were sent back within hours. I finally received clear to close documents 42 days after my deadline. The builder cancelled the contract. The cost of each month was {$8600.00}, so that total is {$17000.00}. The house has gone up in value approximately {$70000.00} based on the purchase price and the appraisal. The builder actually put the house on the market for XXXX. Not to mention the thousands of dollars I have spent on XXXX XXXX and hotels waiting for these documents. We would like to reimbursed XXXX ( cost to push closing twice ), {$70000.00} ( equity we lost in the house ), {$150000.00} ( lost equity ) our cost for hotels and XXXX for XXXX, XXXX and XXXX ( {$16000.00} ) and I don't even know how to figure a cost for the pain of suffering of having to move my family from place to place because we were given dates things would be ready for TWO months. If you add up these totals, it's XXXX we are asking for reimbursement including {$50000.00} for pain and suffering. This is an errors and omissions type of claim. Totals XXXX

The mortgage originator repeatedly asked for us to falsify information on official documenst, and also for our CPA to blatantly lie on official documents. He was replaced with another partner in the company, and we are being told that our loan approval is contingent on the release of our daughter 's medical history - an obvious HIPAA violation. She was adopted from XXXX XXXX, and the mortgage company is including the XXXX XXXX XXXX payments as part of our income. They have received every page of every form they have asked for, but with her medical history retracted from the form. They tell us that releasing this information to underwriting is the only way they can approve us for a mortgage. This is all after months of working with this company, and being told all along that we were already approved for the loan. Now our home has already been sold, and we are in escrow on a new home. They are delaying the process unnecessarily, which could ultimately cause us to lose our bid on the new home, and potentially have nowhere to live at the end of the month, when we are required to move out of our current home.
