We are raising a new concern regarding debt collection practices our recent filing on the following : We originally opened an account with XXXX XXXX via their third party creditor - TideWater Finance Company - who has taken advantage of us as consumers, U.S. Veterans, and XXXX XXXX Minorities. We previously reported and wrote a letter in XXXX that we were experiencing extenuating medical and financial circumstances, due to our daughter being hospitalized for over 34 Days in XXXX and my major job loss and made many attempts in XXXX with calling in to request special exceptions and special programs due to these difficult challenges we were having and my husband had already given TideWater the permission to speak with me, XXXX XXXX, ( his wife ), which is documented and taped on TideWaters recording systems as well. They made no attempt to provide us with a special finance program due to the extenuating financial & medical circumstances we expressed and have be exasperated mentally and physically over the last 2 years with caring for our daughters XXXX XXXX and XXXX XXXX XXXX she encountered at the end of XXXX while away at school. We encountered over {$70000.00} in medical bills and had to care for our daughter. Although we made concerted efforts to notify TideWater and request a special exception/program, they showed no empathy nor sympathy concerning our situation and we were not given any notice until someone knocked on our door regarding lawsuit paperwork which were unaware. We also did not receive the proper notification that it was being turned over to a lawyer or the written prior indication that a lawsuit was imminent via a document called a Notice of Intent to Sue. Upon receiving the falsified lawsuit, I again made multiple calls to TideWater starting in XX/XX/XXXX, XX/XX/XXXX & XX/XX/XXXX & XX/XX/XXXX, in an attempt to discuss the account, the letter they received in XX/XX/XXXX, and potential workout plans but was never given the opportunity avail. I explained that I sent letter explaining our situation in XXXX when our daughter was hospitalized for 34 Days Including XXXX and never received a response on workout plan. I also spoke to Ms. XXXX, the Assigned Account Manager, in XX/XX/XXXX who stated she would escalate the request to her management team to reduce the balance and see what type of settlement offer they could provide. However, I never heard back. I made other attempts over 10 to call back in to pick up the conversation which was had in XX/XX/XXXX and was promised they would get back with me but never did and calls were recorded on their systems if they did not delete them. I also reached out to contact Tidewater again in XX/XX/XXXX, & XX/XX/XXXX and spoke with another Account Manager, XXXX, after being directed to the XXXX XXXX XXXX XXXX whom they hired and who also utilized stall tactics, claiming they reached out to Tidewater regarding our multiple requests to negotiate the balance he was attempting to collect on a {$2000.00} card with costs inflated to {$4000.00}. XXXX claimed she was also going to get with her manager to request an exception to negotiate the balance and promised to circle back to me on XX/XX/XXXX, since I made attempts to contact the lawyer via phone and they were screening and dodging my calls. However, I never heard back from XXXX and attempted to call back in on XX/XX/XXXX and received various transfers to different people which was another run around stall tactic. I also made several attempts to contact XXXX XXXXXXXX XXXX XXXX to speak with XXXX the assigned law representative the XXXX XXXX XXXX XXXX and on almost every instant between XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, she avoided my calls and would not pick up the phone. I also had to dial another extensionXXXX, to get someone else to pick up and reach XXXX so I could discuss the account and try to negotiate, after they also received an email per their instruction from my husband to grant me permission to speak on the account. Also, we were originally inquiring with a lawyer via XXXX XXXX to attempt to send a negotiation letter on the account, however, that was denied as well. We did not retain the lawyer and was subsequently told that we now needed to send a letter of release from XXXX XXXX XXXX, but we never retained them. These were also other illegal forms of stall tactics utilized by the XXXX XXXX XXXX which was hired by TideWater Finance Company to come after us, although we made several attempts to notify TideWater of our situation and request a Workout Plan but was denied or lied to on every count. Also, with other attempts to reach XXXX XXXX XXXX via email and voicemail messages, I asked if they had reached out to TideWater on XX/XX/XXXX, and they claimed they were waiting to hear back. However, when I reached out to TideWater on the late afternoon of XX/XX/XXXX and spoke to XXXX, she informed me that they had no indication on file or anywhere in the system that the XXXX XXXX XXXX reached out to them, since we proposed negotiations on XX/XX/XXXX. I also left a voice mail to the XXXX XXXX XXXX regarding their stall tactics, since I did not receive an answer from XXXX nor did I receive a return call on any of the messages I left with XXXX XXXX XXXX. They were also taking advantage of us during this time because they knew an Answer had to be filed by XX/XX/XXXX or else it would Default to a Judgement which were trying to avoid. And widen I did finally get XXXX on the phone after her colleague went to her desk on XX/XX/XXXX, I was told we did not have to file an Answer by XXXX at XXXX XXXX XXXX as she claimed, we are waiting to hear back from the client and most people don't file an answer and I said I wanted to be certain that they would not try to default and she said no that wont happen. However after, the call she never picked back up each time I called in and I, in turn, called TideWater again, and spoke to XXXX who claimed she did not know what filing an Answer was, although she was in the Legal department and also wanted to verify where my husband worked when I called in on XX/XX/XXXX & XX/XX/XXXX, although this had never been discussed previously. Each party, TideWater and XXXX XXXX XXXX XXXX were corroborating against us and not willing to help us and attempting to take advantage of us in the process. Also the account is under {$3000.00}, however, the XXXX XXXX XXXX, on purpose and with ill will intent filed the claim in State of Georgia Civil Court vs. the XXXX XXXX County Court which oversees civil claims under $ XXXX only to take advantage of XXXX Minorities in attempt to take their payroll checks in hopes of one not filing an Answer or making it difficult on the defendant. Therefore, we also believe we are being discriminated and retaliated against as U.S. Military Veterans and XXXX XXXX XXXX Minorities which I stated to XXXX XXXX XXXX as well via email phone call on XXXX & XXXX due to stall tactics lack of empathy, and on purpose telling us lies between XX/XX/XXXX & XX/XX/XXXX and taking advantage of us in a vulnerable state as XXXX XXXX XXXX Minorities and U. S. Military Veterans. We are requesting that TideWater work with us on the real balance of the account which is {$2300.00} and discuss letter and request for workout plan, prior to our account being transferred to XXXX XXXX XXXX XXXX in XXXX, GA who takes advantage of XXXX XXXX XXXX Minorities in the GA. I was informed by a TideWater the balance was {$2300.00} prior to in being transferred to XXXX XXXX XXXX and had to ask for the Account details, but was not provided this information by Tidewater when I called in XXXX, although they had access to it but was told they could not retrieve and had to go through the XXXX XXXX XXXX. I kept getting the run around regarding this request as well and after requesting it repeatedly in email and phone with XXXX XXXX XXXX, they did not send it until XX/XX/XXXX, the last day to file an Answer. This was also done on purpose by the XXXX XXXX XXXX.

We originally opened an account with XXXX XXXX via their third party creditor - TideWater Finance Company - who has taken advantage of us as consumers, U.S. Veterans, and XXXX XXXX Minorities. Therefore, we also believe we are being discriminated and retaliated against as U.S. Military Veterans and XXXX XXXX Americans Minorities which I stated to XXXX XXXX XXXX as well via email phone call on XXXX & XXXX due to stall tactics lack of empathy, and on purpose telling us lies between XXXX XXXX & XXXX and taking advantage of us in a vulnerable state as XXXX XXXX American Minorities and U. S. Military Veterans.

I bought a car in the summer of XXXX that was financed through Tidewater Financial. I was late during the year of XXXX and had one payment returned with a {$15.00} fee. XXXX though was a new and different year. I have not been late, actually paid the NSF fee ( 3 ) times, started paying with a check to avoid the extra {$10.00} fee per payment whether online or on the phone that the company charges. This summer XXXX I called to get a pay off amount. I came into some extra monies and realized that my interest rate of 17.75 % was actually 17.99 % and that I would save four years of interest on a 6 year loan if I paid it off. My payments are {$480.00} per month. I knew this money would be coming in about three months so figuring our the extra payments I should owe around {$18000.00} to payoff my loan on my XXXX XXXX XXXX. I received a notice from XXXX XXXX on XX/XX/XXXX saying my balance had gone UP in the amount of {$200.00}. How could this be when I am making monthly payments? This implies as it effected my credit score I am NOT making my payments when in fact I WAS making my payments. I called into Tidewater Financial and got a really nice girl who stated ( their conversations are recorded ) that their accounting system had changed but a supervisor would look into this and call me back. I called three different times with supervisors supposedly going to look into my requests without hearing from anyone before reaching out to the headquarters of Tidewater Financial. The first person who I spoke to at corporate was a XXXX XXXX who sent me a payoff notice on XX/XX/XXXX stating I owed $ XXXXwhich was MORE than when I called in the summer three months EARLIER! Along with the payoff she sent me a complete breakdown of my allocation of payments. I ended up auditing their payment history as there were many errors in it. I do accounting and finance for a living. I sent back an email with my concerns and it was then escalated to XXXX XXXX who on XX/XX/XXXX sent me another breakdown of my payment history-which had more interesting ways of allocations that contradicted what XXXX gave me-and the balance was the same number even though at this point ( 2 ) additional payments had been made but not allocated to the account. Mind you side note-the payments are sent to XXXX XXXX but get deposited to a Tennessee lockbox which delays payments-I have all my checks dated on the checks cashed and it is conveniently taking enough time for me to incur late fee, charges and accrued interest on my account. I do another audit pointing out the inconsistencies with allocations, the two different system statements sent to me, my findings with no response from XXXX until XX/XX/XXXX when I now hear from a XXXX XXXX who is the Compliance and Credit Supervisor at Tidewater Financial. By the way my credit report updated on XX/XX/XXXX saying my car loan went down {$180.00} BUT this means there is still an increase of {$23.00} they are reporting incorrectly. On XX/XX/XXXX Tidewater puts a note on my credit account about looking into my payment history etc. but then on XX/XX/XXXX my car loan goes up another {$35.00} according to my credit report I sent Tidewater copies of it-so now I am a total on my credit report showing an increase of {$58.00} that they will not credit nor remove from my credit report to adjust it correctly. It is at this time I begin to work with XXXX XXXX who ignores my emails until the XXXX of XXXX stating responses have been mailed to me. I have to ask here if she can send me a copy of those letters before I get them. At this point a XXXX XXXX is now involved and sends me copies of the letters in the mail to me. I email both back asking why I was charged monies for fees I was not told about? I asked them both why my credit keeps getting attacked when they said it would not? I have all the emails and audits to support these claims. I then do ANOTHER AUDIT against the new information provided. I listed again the concerns that I still had. I now had another NSF fee even thought I had not had any payment returned since that one time. They said they were going to credit it me {$550.00} that they charged me in certain fees, yet if you add up the late fees, the convivence fee that I was never told would be included in the amount of {$24.00} monthly, the supposedly late fees, even though the were made on time over the phone but it posted later? All these fees they charged me did NOT end up being only {$550.00} not by how they calculated it but just by using their own allocation on their statements sent to me. To make matters worse instead of giving me the credit of the incorrect amount they only credited my account per their own statement $ XXXXthis is not including the NSF on my statement they can not explain, the extra {$58.00} on my credit or the incorrect calculation of my interest using the governments site of how my payments should be posting using the interest rate I have, months of the loan and also my monthly payment-again I did ANOTHER audit from the last statement showing with their information which is wrong but I allocated it how they said I paid and the numbers do not add up. All I am asking for is them to make the account correct-have a video call with me to resolve calmly the issues-take the payments since XXXX and apply them to principle so I can pay off the account. Why basically should I pay an extra almost {$1500.00} extra for something I do not owe? I emailed XXXX and XXXX again today again after getting another generic letter with again a copy of my contract-the contract is not the issue their payment center processing is. I am asking for your company 's help as I am also trying to get my government representatives involved-but with a global pandemic and also a political change going on it will be some time if I hear anything and I want to resolve this now.

On these subscribers that are reporting the affixed information, I am requesting full validation such as, original transfer rights to collect, confirmation of legal timeline to report on credit and/or collection procedures, validation of licensing requirements, posted bonding requirements, oversight on monthly payment histories, proper subscriber agreement compliance with credit reporting agencies, and overall compliance with all Fair Credit Reporting Act and Fair Debt Collection Practices Act bylaws as mandated by federal laws. If all of these requirements are not in order, then I have the legal right to request the deletion of this tradeline accordingly. This letter is addressed to the subscriber furnishing the information on my credit reports, and if this letter is addressed to any credit reporting agency, then it is considered a ghost letter mirroring the actual request for documentation of a credit trade line I may have issues with. It is my understanding that each credit reporting agency has an obligation to maintain accuracy within the banking/credit community, and I will fulfill my obligations to work within the credit system as it was designated. On XX/XX/XXXX I purchased a new vehicle from XXXX XXXX XXXX for {$15000.00}. It was financed through XXXX XXXX XXXX XXXX. XXXX XXXX in XXXX. VA XXXX. My first payment was made on XX/XX/XXXX for {$380.00}. I paid on this loan/vehicle until XX/XX/XXXX when I was laid off from my job. I contacted XXXX XXXX XXXX that I could no longer afford the payments and they agreed to take the vehicle back and sell the vehicle and let me know how much I owed to cover the difference. I contacted XXXX XXXX XXXX MULTIPLE times over the next few weeks and months and years to find out the status of the loan and every time I was cussed at and I was told that they would let me know when they had the information. They were always very rude and hateful and no matter who I spoke with I was given the same answer. I asked them to mail me something saying how much I owed and they said I should get something in the mail. I never received anything from them. I would call again later in the year and got the same response of cussing at me and not telling me what was going on and hanging up on me. I was so frustrated with them I thought that if they wanted me to pay for it then they needed to tell me what to pay and I didn't contact them any longer. Fast forward 5 years.,,, to XX/XX/XXXX and a petition was filed against me in my local XXXX XXXX XXXX XXXX No. XXXX from Tidewater Finance Company for {$30000.00}. The petition states that this amount includes interest at 20.95 %. The amount they said I am deficient is {$21000.00} as of XX/XX/XXXX. The only paperwork used to determine this amount was the finance paperwork that I signed at the car dealership on XX/XX/XXXX. This information did NOT include the 1 1/2 years of payments that were made, the $ amount the car was sold for and it did not include the amount that was NEVER told to me about how much I owed once the car was sold. I took the paperwork I was served to an attorney and he wanted a large sum of money as a retainer that I could not afford so his advice to me was to write a letter to the judge stating what had happened up to that point and see if I can represent myself to hold them accountable for the legal process XXXX XXXX XXXX was supposed to follow once the vehicle was back in their possession. The attorney also said that the statute of limitations for this type of petition is 5 years so Tidewater Finance waited almost to the day 5 years to file this petition in hopes of getting the LARGEST POSSIBLE amount of interest added to the balance. So I followed the advice of the attorney and wrote a narrative of what happened and filed it to the case. I filed that on XX/XX/XXXX. On XX/XX/XXXX, the judgement went in favor of Tidewater Finance for the amount of {$21000.00} plus interest at the rate of 20.95 %, attorney fee of {$2000.00} and court costs of {$330.00}. Fast forward to XX/XX/XXXX and my employer received a garnishment for me from Tidewater Finance Company for the amount of {$55000.00}. they are now taking {$730.00} a month out of my paycheck to pay off this incredibly fraudulent loan amount. At this rate I will be paying for this vehicle until 12 years after I am dead. I have paid a total of {$4700.00} as of this date XX/XX/XXXX. I have been trying to find out what I can do to get some help. There are laws that they did not follow in the process of this entire ordeal. I looked up Tidewater Finance on XXXX and they are doing this exact thing to MANY people! They are refusing to cooperate at the time of the return of the vehicle so that they can come back with an enormous amount of money to collect on purpose. There was NEVER anything sent to me about what I owed, I was NEVER told what the vehicle sold for, I was never contacted by them in ANY way for 5 years. I tried to contact them over 100 times and I was treated like garbage by them. Looking through the case I do not know where they are getting the numbers from, there is no mention of payments, the balance when the car was taken nor the balance when they car was sold and how much for. The numbers do no add up and the amount financed was {$15000.00} and now they are collecting {$55000.00} and the amount is increasing at the rate of 20.95 % until paid in full? PLEASE HELP ME!

On XX/XX/XXXX I Purchased an auto loan from TIDEWATER FINANCE COMPANY , INC. for XXXX with a monthly payment of XXXX a month. I made XXXX on time payments that equaled to around {$9100.00} with this company but still owed almost {$14000.00}. The interest rate was so high on the vehicle that no company that I reached out to would refinance it due to it being upside down on the value by {$7000.00}. I repeatedly reach out to them to work something out with the refinance company but they refused and talk so disrespectful to me, I felt like I had no way out from the company. Around XXXX XXXX I reached out to an attorney that I used in my Bankruptcy case in XXXX and was told that I wasn't supposed to purchased the vehicle at the time I did and I needed to turn the vehicle in because at the time I got the vehicle my bankruptcy case was still open and I should not have made any large purchases. We believe XXXX XXXX XXXX is practicing unfair business practices. In XX/XX/XXXX or XX/XX/XXXX we bought a car and Tidewater financed it. The contract would 'mature ' on XX/XX/XXXX ( see attached ). We tried our best but fell behind on payments many times during those six years, but via e-mails we always requested how much we owed to bring our account current, and did so. According to our contract ( see attached ), Tidewater will notify us before the last scheduled payment was due of any changes in what we must pay. A quick search on XXXX shows that people in a similar situation usually receive a notification two months prior to the last scheduled payment if they still owe a balance. We 've never received such a notification. We never received any notification other than the monthly statements that never show how much the balance is over the years but does have a line where they could add any " Delinquent Payment Due ''. In the last 6 or 7 months, it was blank. Thinking we paid what we owed ( and trusting Tidewater would let us know if we had n't ) the, what we believed to be, last statement ( see attached ) showed a " Delinquent Payment Due '' of {$440.00}. Shocked to see that, we wrote them immediately to ask what that amount was for since they never notified us of that amount in those months prior. More than a month later, we still did n't receive a response. They called vigilantly and ultimately wrote us an e-mail ( see attached ) on XX/XX/XXXX. I wrote them back on XX/XX/XXXX ( attached ) and told them we were waiting for their written response to our letter, asking what that {$440.00} was for. We finally received their email response on XX/XX/XXXX ( attached ), and it was a shocker. According to the Tidewater rep, we did n't owe them {$440.00} but a whopping {$3600.00}! You can imagine how shocked we were to discover that amount! We wanted to respond quickly but tragedy struck our family and we went into mourning. We could n't focus on anything at that time. But when we were strong enough to respond, we decided to offer Tidewater a fair pay-off. On XX/XX/XXXX, we sent them a letter with a pay-off offer ( attached ). We heard nothing back. After the XXXX XXXX, we sent them a follow-up letter ( attached ), giving them until XX/XX/XXXX to respond. On XX/XX/XXXX, we finally received a response ( attached ) but it was sorely lacking. NO mention of our offer. NO yes or no answer. Instead, they ignored our offer completely but *did* say that they 'd honor our 'cease and desist ' - something we 've never asked for! Then, on XX/XX/XXXX, Tidewater sent a repo-man to husband 's place of employment, and since he was off that day, the repo-man came *into* the store and spoke with an underling of his. He just discovered that this morning! Aside from this being embarrassing, this move risked having him lose his job. There is a ZERO tolerance of debt collectors. The parking lot is n't large. It 's on private property and one strip of parking spots only. The repo-man did *not* have to get out his tow truck to see that the car was not there. There was no need for him to come inside the store, which is a high-end XXXX store with high-end customers. This is not how a business conducts fair business practices. We are at our wits end. We believe we 're, contractually, in the right but it appears Tidewater is n't listening to us and we hope you 'll have more luck. We 're not looking for a handout but we 've already paid the car twice and we do n't want to overpay what we contractually owe. This is why we filed this complaint with the CFPB.

Due to money issues I have a consent judgement owing money to XXXX XXXX XXXX. On XX/XX/XXXX at XXXX I contacted XXXX XXXX , Attorney, who is representing Tidewater for collections. My purpose was to determine the remaining balance of the account so that I could pay it in full to satisfy judgement. XXXX quoted me a balance of {$680.00} but then stated that I could just pay {$680.00} and he would call it even. I submitted a payment through my credit union bill pay service, XXXX XXXX, for {$680.00} dated XX/XX/XXXX. For informational purposes my credit unions bill pay service guarantees mailed checks will arrive prior to the post date on the check, generally mailing them 3-5 days in advance. Mr. XXXX did not deposit this check until XX/XX/2018 nor did he send any correspondence advising me of a remaining balance on the account . Furthermore, he did not notify Tidewater of the payment and allowed his client to assess fraudulent interest to my account which should have been paid in full. This was determined by a phone call directly to Tidewater which occurred on XX/XX/XXXX at XXXX because I observed my credit report had not been updated. A Tidewater representative told me that they had not been notified the payment was a final payment and that interest had accrued since my conversation with Mr. XXXX. They did not apologize, refused to recognize any wrongdoing, and stated that I owed a remaining balance of XXXX {$100.00}. Upon researching the history of my payments and comparing the deposit date against the check date, , every single check was delayed for deposit by a significant period of time. Here is a listing of some of these post dated checks and their deposit dates that have occurred since XX/XX/2018 : Check Date XX/XX/2018 {$130.00}. Deposited XX/XX/2018. Check Date XX/XX/2018 {$130.00}. Deposited XX/XX/2018. Check Date XX/XX/2018 {$6.00}. Deposited XX/XX/2018. Check Date XX/XX/2018 {$680.00}. Deposited XX/XX/2018. Since I had determined to resolve this issue, I authorized another bill pay to Mr. XXXX dated for XX/XX/2018 for {$100.00} to cover any remaining balance. Due to my unawareness of Mr. XXXX intentionally making deposits late, I was unaware that my checking account remained in an unbalanced state. On XX/XX/XXXX, XXXX I was again made a victim by a deposit against a checking account that was approximately {$8.00} short to cover because of the 13 day delay. I am now having to pay overdraft fees to my credit union due to Mr. XXXX bookkeeping practices. It is my contention that Tidewater, under the representation of Mr. XXXX, is intentionally delaying deposit of payments after physical receipt with the intention of generating revenue for himself and his client. I am asking for a government investigation into this matter. I personally am seeking legal representation and have put out ads on XXXX, XXXX, and the XXXX XXXX XXXX XXXX seeking other consumers that have been defrauded. I am also researching cases through Missouri 's XXXX XXXX so that I can directly contact consumers that have been affected by this fraud. I received the XXXX XXXX Improver card on XXXX XXXX XXXX issued by XXXX XXXX XXXX XXXX XXXX XXXX, serviced by Tidewater Finance Company. Made my first purchase that same day in the amount of {$60.00} Received my first bill at the end of XXXX with a due date of XXXX XXXX XXXX. I paid the amount in full on XXXX XXXX XXXX. Made another purchase in the amount of {$68.00} on XXXX XXXX XXXX. Received my statement for XXXX with a {$0.00} balance due at that time. I then received my statement for XXXX in the amount of {$70.00} due XXXX XXXX XXXX. I then called Tidewater Finance to dispute the interest fee in the amount of {$1.00}. Per the XXXX statement, there was nothing due at that time, so how can I be charged interest fees. The representative agreed after speaking with her supervisor and inform me that she would be removing the {$1.00} fee from my account and that I was to pay the {$68.00}. I paid the full amount of {$68.00} on XXXX XXXX XXXX my due date. I then made another purchase in the amount of {$57.00} on XXXX XXXX XXXX. When I received my statement for XXXX XXXX, it was in the amount of {$3.00}. It showed that the {$1.00} interest fee was still on my bill as well as a new interest charge in the amount of {$1.00}. On XXXX XXXX, I called in to dispute these fees stating that the representative informed me that the initial fee of {$1.00} was to be removed. I do n't know and still do n't know where the fee of {$1.00} comes from. They informed that since I did n't make a payment on XXXX XXXX after I got off the phone, that she did n't remove the charge. My bill was n't due until XXXX XXXX, in which I made the payment of {$68.00} per their instructions. I was n't informed that I had to make a payment on that exact day to get the fee removed. I should not have been charged the fee in the first place. That was the whole reason of me calling. I was told that they will not remove the fees totaling {$3.00}. I told them that they are very deceptive in their billing practices because I read their process of " How to Avoid Interest Fees '' It states that, " As disclosed in your Open End Credit Agreement and Truth in Lending Disclosure, no interest charge will be imposed in any monthly billing period, in which there is no balance at the beginning of the billing period. I decided to go ahead and pay the {$3.00} as well as the {$57.00} for my last purchase for a total of {$60.00} on XXXX XXXX XXXX because I did n't want them to hurt my credit report. I then received a statement in the amount of {$26.00} for a late payment. I again called on XXXX XXXX XXXX, to dispute this charge. I paid all my statement bills on time. I was informed that I was being charged for the {$1.00} back in XXXX. I told them that I was not going to pay any more fees to them. I was not late on any payments and I was told that they were going to send this to their supervisor and that I would receive a call with 24 to 48 hours. I have not heard from them. I did n't want them to hurt my credit by reporting false information to the credit reporting agencies, however, they have already reported the late payment to them and my credit score was impacted. Three times in XXXX Tidewater Motor Credit ( TMC ) took unauthorized money from our checking account. Using ACH they took the money and credited it to their client. They should return the money, we are not responsible for their dealings with this client as we do not know the client and we had no relationship with TMC prior to this activity. XXXX XXXX, XXXX, TMC used the ACH system to take {$2100.00} from our XXXX XXXX XXXXhecking account in a transaction labeled Loan Payment ID : XXXX ( see attachment 1 ). We discovered this and XXXX reclaimed the money from TMC on XXXX XXXX with no protest from TMC. However, TMC had also used ACH to take money from our account on two prior occasions. On XXXX XXXX, XXXX, TMC took {$500.00} and on XXXX XXXX, XXXX, they took {$1000.00} from our XXXX XXXX account. Both transactions have the same Loan Payment ID : XXXX label as the XXXX transaction ( see attachment 2 ). XXXX offered no assistance on these transactions because of the time that had elapsed before they were discovered. TMC was not authorized to take this money. XXXX XXXX, XXXX, we filed a fraud complaint with the XXXX Police Department. The investigator hoped that TMC would refund the money to close the case. They are not willing to refund the money. On XXXX XXXX, after interviewing the client, he sent a letter to Tidewater Finance Company, ATTN : XXXX XXXX, Legal Assistant, XXXX XXXX XXXX XXXX, XXXX XXXX VA XXXX ( Evidently TMC is associated with Tidewater Finance Company ). The letter states that the client said she " did not know '' us and " did not make any payments from '' our account. The letter also states that our credit union account number differs from the client 's account number by one digit only. The investigation concluded that there had been an error made in entering the account number, leading to unauthorized transactions. Two weeks later the investigator sent a revised letter with the same date ( see attachment 3 ) to that same address. The revision was necessary because of an omission in the first letter. The revised letter states that we ... do not know '' their client and " did not authorize '' the payments from our account ( the original letter was missing the first not in this sequence. From the end of XXXX XXXX until XXXX XXXX, XXXX, we had many discussions with TMC representatives and jumped through their hoops to try to get the money back. We sent them information about our checking account, set up a three-way call with a XXXX representative, authorized XXXX to provide TMC with our personal information, and asked the XXXX Police to investigate. XXXX XXXX, XXXX, XXXX XXXX, Assistant to the Director of Asset Recovery Center for TMC, told me that TMC would not refund the money and that we would have to pursue their client for relief. They took our money but want us to deal with their client to get it back. At the end of that phone call, I pointed out the change in the revision letter, that XXXX XXXX had not previously noticed. Please help me. I am asking for you to look into the XXXX XXXX XXXX/ Tidewater Finance Company because they are destroying my credit report. I say this because They are currently reporting an account to all 3 credit bureaus as having 21 late payments. To clarify the nature of the situation, I will describe to you why what they are doing is illegal. I understand that an account that isn't being paid on time or at all can have late payments reported to the credit bureaus. I also understand that the late payments can accrue if you make multiple of them consecutively. For example, if you do not make a payment for two months in a row you would get a 30 and 60 day late payments. If you fail to pay for 3 months you would get the two late payments mentioned previously as well as a 90 day late payment. I also know that if you are making payments on time but are still past due on a previous month due payment you would get what is known as a rolling 30 day late payment. For example, If I made XXXX 's payment on time but then skipped XXXX 's payment, and then began paying on time starting XXXX for 3 months, then I would have a 30 late payment in XXXX and a consecutive or " rolling '' 30 day late payment in XXXX and the three months afterwards. Well what is occurring with XXXX XXXX the XXXX Tidewater Finance company is something that is not allowed by federal regulation. Those companies have decided to report me with 18 consecutive 90 day late payments even though I have not paid them any money in 2 years! I am not proud that I have not paid them, and it actually is a very stressful thought which is always on my mind, but that does not excuse XXXX XXXX XXXX XXXX/Tidewater to hold my credit report XXXX or ignore federal regulations because they feel like it. According to the FDIC 5000 - Statements of Policy, UNIFORM RETAIL CREDIT CLASSIFICATION AND ACCOUNT MANAGEMENT POLICY, 1, Closed-end retail loans that become past due 120 cumulative days and open-end retail loans that become past due 180 cumulative days from the contractual due date should be classified Loss and charged off. In other words, this account should have been charged off after the 180 day mark. That was nearly 2 years ago. I have attempted to call the XXXX XXXX XXXX/Tidewater and even the store where the account originated from which is XXXX XXXX. I have attempted to get them to correct this reporting as is mandated by the FDIC but they refuse. I have done so on numerous occasions over the past year. Every time I communicate with any of the companies, I am told that the only way to fix this reporting is for me to pay them what I owe. Again, I understand I owe money, but that does not mean that a creditor can keep an account open indefinitely if it hasn't been paid. That is against the FDIC rules. If they could keep it open indefinitely, they could keep it on my credit report indefinitely and then the 7 year statute of limitations for credit reporting would be irrelevant. Please help me in getting tidewater/ XXXX XXXX XXXX to charge this account off starting at the 180 day of no payment.

I purchased a mattress from XXXX XXXX in XXXX of XXXX. The balance remaining was financed by Tidewater Finance Company, XXXX XXXX XXXX XXXX, XXXX XXXX, VA. I have spoken with upper level of management and then the CCO in finance of this company, XXXX at the time in XXXX speaking with her again about not getting any information in XXXX of XXXX in my emails or physical address. I did however get a letter regarding a late payment in XXXX of XXXX and did not come to my address but to the address of where the merchandise was delivered to. While at the store ( XXXX XXXX where the merchandise was purchased ) I had asked that I needed the Truth In Lending Statement, and any other loan papers for this transaction. I was given only the Sales receipt and the name of the company financing this purchase. To date I have not been sent a Truth in Lending nor any kind of financial document relating to this purchase. This loan had special circumstances, when principal was paid within a year there was No Interest charged until then. At the time of purchase, I asked what the payment system would entail. XXXX XXXX had said it was a No Interest calculated for one year from date of purchase. I then asked who would be sending me the financial paperwork, TIL if there were monthly payments or can I just pay it off in three to four months. I was told Tidewater Finance Company would email or send me the paperwork. I have to this day never received any paperwork from XXXXewater Finance Company. They had all the correct information to email, physical address, phone number, transferred from XXXX XXXX and when my financial and personal information was run to get the loan from them in the first place. I am not inferring that I don't owe this company what I purchased. I want them to be accountable. Deliver information that is mandatory to enter into a contract all the correct paperwork, firstly the Truth In Lending Statement. Not at any time currently that I have nor should there be one by them as it would be a fraudulent as I do not posses a TIL nor any other type of paperwork from Tidewater Financial Company stating Principal balance. APR, etc ... a Truth In Lending Statement includes. Contact with XXXX and other financial personnel have been fruitless as to finding a solution. I am concerned that guidelines of financial companies are not being followed. There are others who have been I feel swindled by this company. I humbly write this letter to seek ( and plead for } your help in a matter that I believe to be unfair trade practices and malicious intent. I made a purchase of furniture from XXXX XXXX XXXX in XXXX, NC on XX/XX/XXXX. The furniture was financed through three ( 3 ) finance companies : Tidewater Finance, XXXX XXXX and XXXX XXXX XXXX. As you will see in the enclosed letter from my attorney and supporting documents, XXXX XXXX XXXX breached the contract by not delivering all of the furniture that was ordered by the delivery date guaranteed by XXXX XXXX XXXX. All furniture was to be delivered in its entirety by XX/XX/XXXX. The bulk of the furniture that was delivered was incorrect ( delivered wrong size beds and matrices ) per the purchase order and the remaining furniture that was delivered damaged. I never received all of the furniture that was stipulated in the purchase order and, based upon this breach, I cancelled the entire order. Specifically, my complaint is regarding to the refusal by Tidewater Finance to refund all of the money that was financed through it and remove all negative entries to my credit report. When I cancelled the order in XXXX, I was refunded all of the money from XXXX XXXX and XXXX but Tidewater Finance only refunded part of the amount financed. I returned all of the furniture that was delivered within the original purchase order, including a king size bed headboard and footboard that was incorrectly delivered. I have enclosed all of the documents that I prepared for my attorney to ensure her letters were factual and complete. I have also included a copy of an email I sent to my attorney showing very negative information posted to my credit report by XXXX XXXX. All furniture that I received was returned, including items that were delivered the wrong size. XXXX, however, has not only failed to cancel its financing agreement, it has continued month after month to increase the balance it says I owe. Because Tidewater Finance continues to report that I have an unpaid balance of {$510.00} and their egregious actions of adding to my balance a late fee per month since XXXX. I have been denied credit three times. Tidewater Finance has destroyed my credit and continues to do so each month. I beseech you to help me resolve this injustice. I retained no furniture from the initial order yet Tidewater Finance claims I do. My attorney has tried many times to get Tidewater Finance to remove the posting from my credit report. I have a auto loan with Tidewater Motor Credit an d I wish I did online research PRIOR because every single complaint is the same or worse than mine and the Government has n't shut them down. Tidewater used a predatory loan and changed the terms on us after we signed paperwork, then their online and automated phone systems do not work on purpose to FORCE customers to call in so they can add on ridiculous fees to charge. When you call to make a payment the approximate hold time is in excess of more than TWO HOURS and when you finally do get through they either tell you that you MUST make 3 MONTHS worth of payments or they tell you to pay the vehicle IN FULL or they will not take your payments???!!!!! That will force customers to spend way more than they can afford, or into hiding. There are many lawsuits against them for the same issues. How can they force consumers to call in and charge them through the roof or take the car when I was trying to pay on time. On paper it looks like I was never on time bit the reality is they would never take a payment. And if I could get through, I could not afford 3 payments at a time???? Look online at their own employee reviews and you will see that it 's high stress to meet the incentive money goals and most feel the consumer is being taken advantage of. I have a log book with every date, every threat, every form of harassment from Tidewater and will be taking them to court if they do not fix this issue. I am not sure what Towing Company is involved but their harassment also violates Nevada laws as well a s Consumer Credit l aws. The police have been called here so many times and if you tell the company in writing to stop harassing they ignore it. Tidewater does not care aboit the consumer PERIOD.

In XXXX the car I had purchased through the finance company was in a car accident and the car was totaled. My insurance company paid the car off with the Tidewater Finance Company, XXXX XXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXXXXXX. The finance company and XXXX XXXX XXXX, XXXX. XXXX XXXX XXXX, XXXX, XXXXXXXX XXXX XXXXXXXX just garnished my wages in XX/XX/XXXX for a total amount of XXXX which was paid, now the finance company just served another garnishment on XX/XX/XXXX to my employer for a second amount XXXX. The garnishment summons expressed that all I owed them was XXXX which they have received already through an employer garnishment. I am afraid that after this is paid off they are going to keep asking me for more and more money and that this is never going to stop. Again, my insurance company informed me that the total balance of the car was paid off after the accident. They have not given me the opportunity to make any payment arrangements with them about this matter. They keep serving this paper work at an address that I have not lived at for over 16 years ago which does not give me any time to address this matter. I feel that if Tidewater Finance Company and XXXX XXXX XXXX XXXX. has tracked my employer down, then they should have asked me for my correct address so I can address this matter in a promptly fashion. This company is nothing but incompetent. We called on XX/XX/XXXX requesting that our due date change be moved from the XX/XX/XXXX of the month to the XX/XX/XXXX of the month. We were told when we initiated the loan that after our first payment, this would not be an issue. We were NOT told that it was too close to the due date to change. We were told it had been taken care of. When we first called, they said it was taken care of and to check back in 72 hours. We did. We found out that instead of a date change, they had filed a deferrment, and our due date change wasn't even logged. No worries, as we still had time before our due date, and we could fill out the form again. They assured us that even with the forms, it was ok, because there is an 10 day grace period after the due date. So we did, we asked again. And again, and again. We were repeatedly told that our due date would be the XX/XX/XXXX, until well past the XX/XX/XXXX of the month. My husband had been the one calling, but I called on the XX/XX/XXXX to find out what was going on, and I was told there was no record of him even CALLING. When we called on the XX/XX/XXXX, we were told that now our account had been charged interest and late fees. We stated our situation, we were promised a due date change. We had " supervisors '' tell us that they would waive the late charges because of the previous employees mistakes. We What they didn't tell us, was that they would be charging additional interest for every day passed. I spoke with XXXX, who initially claimed he was management. This was a lie, as when I called again to speak directly to him, he said he would be forwarding a due date change request to management. Management has yet to receive any of our requests, so I am starting to believe this " management '' does not exist. I told him I would make our normal car payment of XXXX today, and escalate the fees and interest to management. He said it wasn't possible for me to make less than XXXX, which was the new charge with " interest ''. On XX/XX/XXXX I returned a phone call to Tidewater. I was advised my account was " under director approval '' for non-payment. The agent asked if I intended on making a payment to which I replied " Yes, I usually pay around the XXXX of the month ''. The agent replied " Actually last month you paid on the XXXX and the month prior the XXXX ''. While her intent was to argue, she actually affirmed my statement and also affirmed that I had indeed been making payments ; which Tidewater has accepted with no issue. I again advised her I would be making a payment for {$320.00} plus a late fee on the XXXX. She then placed me on hold to speak to my " Account Manager ''. She returned advising Tidewater would not accept any payment unless it was made via Debit Card. By doing so, Tidewater has violated consumer protections in regards to abuse/deceptive business practices. She also made a comment they do not accept check payments from me. As my account clearly reflects, my payments are made via Online Banking Bill Pay through XXXX XXXX XXXX. If my account is truly documented in such ways, why would Tidewater honor previous payments? I was advised if I made a payment it would be returned and not honored unless I agreed to make a debit card payment through them. Further, I was advised my account would he escalated for non-payment even though I just offered to make a payment. For the record, all phone calls to and from my cell phone are recorded and retained for legal protection. Tidewater has been previously made aware of this and also records conversations on their end. This voids any recording notice that they feel they should be entitled to. Tidewater charges for payments initiated through them regardless of the method used. Tidewater charges {$10.00} for all payments made regardless of amount. Tidewater 's business practices not only allow it to make substantial profit via this practice but also pass on added costs to consumers. This practice is clearly abusive and aimed at producing additional revenue. ACH payments cost lenders less than {$3.00} per transaction. This business practice is a ploy by Tidewater to take advantage of customers financial situation by offering sub prime lending products and charging unreasonable and unethical fees for such products in regards to servicing. Tidewater also violated collection laws by contacting 2 parties that are not of any relation via blood or marriage to me about the status of my loan.

I bought a vehicle in XXXX XXXX, which was financed by Tidewater Finance Company. I had misgivings about the purchase and I knew it would be a very tight budget situation, but with the salesperson 's coercion, I purchased the vehicle. In XXXX XXXX, I wrecked the vehicle in a parking lot and I was responsible for the deductible to have the vehicle repaired. I was unable to make the payment for the deductible AND my car payment at that time, so I did what I had to do and paid the deductible to have the vehicle repaired. From that point forward, I have been late with my payments. I have kept in touch with Tidewater throughout all of this, but I have n't been able to catch my payments up and with some other unexpected debt, I have n't made MONTHLY payments on a regular basis. I filled out an online request to work out a payment arrangement, but I was told that the loan was too new to work out a payment arrangement, however, they said they wanted to work with me. I have been trying to make some form of payment each month, but have n't been able to make any full payments. I do, however, see my way clear to make up the past due amount on XXXX XXXX. I was in contact with Tidewater Finance on XXXX XXXX and XXXX, both by email and by telephone. They were so rude and nasty to me and have been ever since that I do n't even want to deal with them anymore. I have refused to contact them anymore other than by email. I have attached a copy of the email telling them that I am not comfortable talking to them and prefer to communicate via email so that I have a record of our communications as well as them having a record. They keep sending me text messages and emails telling me that I have to call them and that they want to work with me, however, everything that I have told them I can do has been turned down. Immediately after they turn down what I can offer, they send me another message telling me that I have to call to speak with management about an arrangement. They never let me talk to management, or rather, every rep I speak to tells me she is an account manager and every one of them have been so rude and nasty. I have made what I feel like would be a doable offer, and that is to pay all of the past due amount, on XXXX XXXX, but they wo n't accept that and they said, basically, that I should be able to do better. I made two purchases at XXXX XXXX XXXX using Tidewater Finance, under the agreement that if I paid off the loan within 12 months of receipt of the furniture, and there would be no interest. The first purchase was made on XX/XX/XXXX. I then made a second purchase at XXXX XXXX on XX/XX/XXXX and I again used Tidewater Finance. This purchase was not received for another 6-8 weeks, so I do not believe that I was charged until I actually received the furniture. It was my understanding again that if the loan for the second purchase was paid off within 12 months, there would be no interest. The last payment for the first purchase was received by Tidewater on XX/XX/XXXX. However, when I received my invoice I noticed that there was a significant increase in the balance. I called Tidewater and was told that because I had made a second purchase with Tidewater, both purchases would need to be paid off by XX/XX/XXXX in order for me to receive the no-interest offer. I explained that was not my understanding of the offer and that I was not told that at the time of the purchase. She then referred me to the bottom of the 3rd page of my payment statement, where both purchases were listed as two invoices. Thus, I was responsible for the complete payment. I spoke to a supervisor who was extremely rude of no help. She did, however, email me a copy of the invoices. In XX/XX/XXXX, I received an invoice that listed the final balance as {$100.00}. I sent this payment, thinking this was my final payment. In XX/XX/XXXX, I started to receive emails stating that my account was behind. I call to find out what is going on, and now there is supposedly another {$100.00} in fees. I spoke a representative and explained that I dispute these fees. She was nice and understanding and transferred me to a supervisor who again was rude. The supervisor agreed that I technically did pay off the 1st loan by the due date, but I was still responsible for the interest fees incurred. This was not why I called, I was calling about the current fees. When we could not come to a conclusion I explained that I would be filing a complaint. She said well I have to end this call. The supervisor, Tidewater is participating in predatory lending practices.

I obtained financing from Tidewater Financial thru XXXX XXXX car dealer while in the process of filing for bankruptcy. When I obtained the financing I was told that I could refinance the loan in a year. I paid the monthly payments on time only to find out after a year that Tidewater would not refinance this loan and neither would any other lender due to owing more on the car than what it was worth. Had I known that this was going to be the case I would have never signed the loan documents as {$430.00} a month was more than I could afford on a long term basis. When I contacted Tidewater to see if they would modify the note to an affordable payment I was told no and when I asked if they would accept a short payoff they said no, well they said they would accept a short payoff but not release the lien until the entire balance was paid in full which is the same as saying no. I have no problem paying for this vehicle but can not pay {$430.00} a month and feel that I was mislead by being told that I could refinance the vehicle when they knew that they were lending more than what the vehicle was worth at the onset of the loan. I have paid around {$10000.00} on a vehicle that I can only get {$2500.00} for now ( XXXX years later ). XXXX years ago they provided a loan for {$16000.00} at a 25 % interest rate. How can you provide {$16000.00} on a vehicle that is not worth that amount with an interest rate of 25 % knowing that it will be a struggle for the person paying the loan. Predatory lending at its finest. I feel that I have paid them more than what the vehicle is worth and that this loan should be paid in full since I have paid them {$10000.00} and they are stating that I still owe {$14000.00}. There has to be some sort of resolve to this. I had a dealer that was willing to pay me {$5500.00} for the vehicle but because they would not accept the short payoff I had to pass on that offer. Now I am still stuck with a vehicle that is only worth {$2500.00} and they want me to pay {$14000.00} for it. I need help as to what my options are at this point.

I originally filed a Complaint back in XX/XX/XXXX. Please refer to complaint # XXXX. Tidewater XXXX Finance was breaking several credit privacy and harassment laws trying to intimidate my entire family speaking to my boss, harassing my neighbors and causing emotional and financial stress refusing to tale payments for almost 2 years and putting us in a black hole of runaround anytime we tried to contact them. After they responded to previous complaint we still could not reach anyone to settle any terms refusing tp accept anything but the full amount for the vehicle and we never received any contact from the manager who responded to you saying that he would contact us so on XX/XX/XXXX the vehicle was surrendered to XXXX XXXX and Tidewater was contacted and told the vehicles location and to pick it up because we were afraid they would charge inaccurate maintenance fees and wanted documented proof that we did not have this vehicle. The entire loan from XX/XX/XXXX until the current date we have not received any final loan terms, or any vehicle payment statements. We had complained that we never had access to their website to pay the bill but needed the terms of contract to verify agreement of final terms since it was " TBA '' on dealer contract and we did not know who our lender was at signing. 2 years go by and they reported nothing. They have the vehicle. I never received ANY bills or communication from them at all and for the last 16 months they have destroyed my credit continuing to charge me like im missing payments PLUS INTEREST ON A VEHICLE I HAVE NOT HAD FOR THREE YEARS AND ITS UP TO {$35000.00}??!! How can thia be legal when i have nothing in writing stating anything including the original paperwork from the financing??!! I have disputed their practices through XX/XX/XXXX and the company continues to charge monthly payments when they have the vehicle. Did I miss any law that allows any creditor or bank to stay dormant for years after what they did to me and my family and now destroying my credit with no regard for the law.

XXXX XXXX XXXX XXXX XXXX card was underwritten by Tidewater Finance Co out of XXXX, VA I opened the account at a XXXX XXXX store in XXXX XXXX, NV. in XXXX or XXXX. XXXX XXXX no longer has this option and the accounts were closed. I still paid my payment on time, every time, and usually more than the minimum. Last month, my payment is due on the XXXX of the month, I paid it a few days early and PAID IT OFF. Now, they are charging me more interest on a {$0.00} balance!!!!! I tried speaking to them today, the first man, XXXX, didn't speak English ( and neither did the receptionist ) which is frustrating as it is. XXXX corrected my address and SAID he put in a request to management to remove the charges. Never said it would be done and REFUSED to send me an email confirming that he changed the address and that he submitted for the account to be cleared. I asked to speak to a supervisor and was given to XXXX, who still had an accent, but not as thick and I could at least understand him, however, he couldn't comprehend English either. Found out that the 1st guy spelled my new city and street name wrong, so he corrected that ( I hope ) and again, REFUSED to send me an email confirmation on anything. Said they cant send out confirmations, only on payments. And he can't send anything out until management clears the account. Then they will send some letter. My payment is due next week. I'm concerned that these people will not do as they say and my credit is going to be impacted. How can they get away with charging interest when the account was paid in full before the due date? That would mean that every time you make a payment in full, they are going to charge you interest so you never pay off the account. Something needs to be done with unscrupulous companies such as Tidewater Finance Co. I would never recommend this company to anyone. They have outrageous interest rates to begin with, which is why I always tried to pay much more than the minimum on this account.

The last statement I received from the company was XX/XX/XXXX and it indicated that the loan balance was {$610.00} with a payment due of {$310.00}. I made my XXXX payment on the XXXX. Which would have made my remaining balance due for XXXX {$300.00}. I paid my next payment on XX/XX/XXXX. I never received a statement for the month of XXXX. I called on XX/XX/XXXX to ask when title paperwork would be mailed and was told I owed more money. I asked at the time for a statement to be mailed because I never received one. I was informed one would be sent. I called back on XX/XX/XXXX because I still hadn't received a statement and was told again that I owed more money and that a statement would be mailed. At that time I spoke with a supervisor named XXXX who told me he would look into it and call me back. I called back on XX/XX/XXXX, still no statements, no call back and was told they were still looking into it. I call back on the XXXX, was placed on hold while the customer service person said she talked to XXXX and their was no new information but that I should get a statement for XXXX. I call back on XX/XX/XXXX after still not getting a call back or statement or title and speak to manager named XXXX. She tells me that they are still reviewing my account. That brings me to today XX/XX/XXXX. I received a call from someone named XXXX who said she was a assistant manager and that my statements were turned off on my account and she was going to email me an account history and she didn't know why I didn't receive any statements the last few months or why my account was reported to the credit bureaus as paid in full. I made my last payment XX/XX/XXXX. I want my title paperwork. I reaffirmed on my loan and continued making payments. Now my car should be paid off and they won't give me my title paperwork or prove that I owe more money.

I purchased furniture from XXXX XXXX XXXX in XX/XX/2020 using their credit service from Tidewater Finance Company. Upon receiving my first bill, I set up auto pay through my financial institution and have paying this way ever since then. In XX/XX/2020, I got a phone call from Tidewater saying they had not received my XX/XX/XXXX payment, perhaps it was just lost in the mail. I simply adjusted my XX/XX/XXXX payment for double what I usually pay ( which is significantly more than the regular payment amount ). I didn't want to go over 30 days late so I was closely monitoring the Tidewater 's website to make sure my payment posted this time. On XX/XX/XXXX I still hadn't seen my payment post so I made an online payment for the same amount as the bill pay check. On XX/XX/XXXX, both the online payment and bill pay check cleared my account, a total of {$1000.00} ( my original required payment was roughly {$200.00} ). At this time, I logged on to Tidewater 's website to make sure the payments were reflecting in my account and neither of the two {$530.00} payments were reflected. I immediately called and spoke to a representative and was told that they were switching their system and to give it a few days to reflect. As of XX/XX/XXXX, neither payments were reflecting in my account. My bill pay was set up to send another {$260.00} payment XXXX my usual amount I send ) for the XX/XX/XXXX due date and to this day, XX/XX/2020, none of these payments are reflecting in my account. Every time I call I get different answers. They don't know " who cashed these checks '' even though I've sent them my bank statements, several cleared checks, etc. I have now received a hit to my credit saying that I was 30 days late on my payment and it dropped my credit score XXXX points on each of the three reporting agencies.

Good afternoon, I do n't know if I am sending this to the right department, but I do n't know who else to turn to. I have reached the end of a long rope with a first time car loan company out of XXXX XXXX called Tidewater Motor Credit. I did a Voluntary Repossession with this company because I did not like the way they were doing their business and the way they were treating me as a client. There was a file claimed against me and now they are garnishing XXXX % of my paycheck. Now this may not seem out of the normal, except I told them to take the car, and they did take the car and sold it at auction back in 2003. So they have come back 12 years later and garnished my paycheck for {$10000.00} more than the original loan. I do n't know how this is legal but now it has put me in such a financial hardship that I have seriously considered taking my own life just because I am tired of dealing with it all. I have a severe bleeding disorder and already have to live everyday of my life in XXXX and from that I have XXXX and this just compounds all those things. The attorney for this company, named XXXX XXXX from XXXX XXXX, just acts like he has his foot in my throat and almost laughs in my face. How is all of this possible and no one seems to want to help me. I have contacted the attorney general for the state of XXXX and XXXX and everyone just passes the buck. I even contacted the XXXX Firm and still, no one wants to help me. What in the XXXX can I do? I hope you can help and can shine some light on this issue, because I know they are doing this to more people. I took out a loan with XXXX XXXX to purchase furniture in XX/XX/XXXX for approximately {$2400.00}. I had been making monthly payments of {$160.00} and the account was in good standing. I hadn't checked my balance and realized in XX/XX/XXXX that the loan was paid off in XX/XX/XXXX and had made 5 overpayments. This gave me a credit balance of {$930.00}. When I realized, I called them and asked for a refund check of the overpayment amount. I was told that a check would be issued and could take 7 to 45 days to issue. I thought that a bit strange but given my good standing with the account, assumed it would be closer to 7 days. I followed back up at the end of XX/XX/XXXX when I saw that my account still overpaid and had not received a check. I called again on XX/XX/XXXX and was told that a check was not set to be issued and that I would need to call back AGAIN on or after XX/XX/XXXX. I escalated to a supervisor. After being hung up on twice after being put on hold, I finally got to a supervisor. The supervisor told me that based on my account history/status and poor service experience, she'd make sure a check was sent out right away. Two weeks later ( today, XX/XX/XXXX ), I still have not received a check. I've called back to get a status and have been hung up on twice by the representatives after putting me on hold. When I called back a 3rd time, the representative ( XXXX ) put me on hold to get me to a supervisor only to come back on the line to say that their " system was having problems '' and she couldn't transfer the call and that the supervisor ( XXXX ) would call back immediately. He didn't call back. This is the worst experience I've ever had with a financial company and simply looking to get back my money. XXXX ( XXXX )

I contacted Tidewater after consistently being past due on my car loan due to being unable to afford the monthly payment. The debt worksheet attached shows that with a reduced payment, I am able to maintain payments going forward even after factoring in living expenses. I have spent multiple hours on the phone, exchanged multiple emails. At first I was told I did n't qualify because my worksheet was wrong ( no clear answer ). When I pushed forward, the supervisor said he would resubmit it after I explained my income vs debt ratio step by step. I was contacted today and told my request had been declined again and that even though the worksheet shows I could maintain the new payment, Tidewater said it was n't sufficient to them to justify a lower payment program. Since I have taken this loan I have been past due. I took this loan after a bankruptcy because I had no car. Tidewater is deceptive in it 's lending practices potentially even violating the Fair Debt Collection Practices Act by offering unrealistic repayment options such as a " Double deferment on XXXX and XXXX 's payments ''. On the recorded calls the supervisor agrees this would not resolve the larger picture and would only fix it short term ; not to mention extend the life of the loan so they can rake in more interest charges. I have attached the last 2 months of paystubs, and the debt worksheet. This lender is clearly out to manipulate the lending systems and take advantage of the consumer. It should be noted that on the worksheet there is an error preventing it from updating the total expenses vs total income. Also, due to a payroll change my tax with holdings were incorrectly applied.

I contacted Tidewater in response to a billing statement dated XX/XX/XXXX. The statement indicates a past due payment of XXXX, and a payment of XXXX due XX/XX/XXXX. The total due is XXXX I contacted Tidewater in XXXX to process a payment deferral. The deferral was approved bringing the account current after I was required to pay XXXX in interest to obtain the deferral. I was advised my next payment would be dueXX/XX/XXXX for XXXX and the account is current. Tidewater now claims that there were 2 returned payments on my account from XX/XX/XXXX and XX/XX/XXXX. As a result NSF fees of XXXX each were added to my bill as well as two XXXX payment convenience fees. My bank records do not reflect payments returned. Further, my XX/XX/XXXXand XXXX bills make no mention of these returned payments. Tidewater violated the FDCPA by adding these alleged NSFs to my bill AFTER I agreed to a deferrment and paid XXXX in interest. Tidewaters business practices clearly are intended to take advantage of a consumer who is simply trying to work with them and bring the account current. Further in recorded calls, their agents can be heard advising me that the billing statements are wrong and the account is current. They only changed their position on this matter after I pressured the associate and questioned the legitimacy of their statements. Tidewater has demonstrated they intend to " bait and switch '' theit customers in instances like this while charging fees to make further profit off of consumers who have fallen on hard times.

I am trying to pay off an installment loan with promotional with Pioneer Finance. I called their call center to get a payoff amount ( there is a payoff amount listed on their website but it does say to call to confirm ). There is no indication on the website of when the promotional financing period end or what interest amount is due. Upon calling the customer service line, they were not able to provide me with the amount of interest due but did advise that I would owe the entire interest ( I should note that they did not contact me after I requested a call back and the hold times were excruciatingly long ), even though none of this was stated on their website. The representative insisted that all of this information was stated on my paper bill, which to the best of my recollection, I have not received a single copy of in 2017. I did explain that I had recently moved out of my brother 's house but he continues to forward mail to me and WE HAVE NOT received any statements from this company. I am very bothered by the fact that the website is deceptive in the paucity of available information and I was bothered by the fact that the company itself could not provide me accurate information and the information they did provide was contradictory and opaque. I obviously would have paid this balance off well before the finance period ended, had that been made clear to me. This company exhibits much of the same behavior as a loan shark, which is what the laws of this country are supposed to protect its citizens against.

In XX/XX/XXXX I took out a credit card at XXXX XXXX with tidewater finance company, not long after I lost my job and had XXXX XXXX making the payments, I was in contact with someone regarding that and let her know I would take care of it. On XX/XX/XXXX I called to pay off the entire balance I owed. I was told ( by an automated machine I believe ) that total amount I owed was XXXX so that 's what I paid. I immidiatley received a bill for 40 something dollars, I contacted the phone number with no answer after waiting FOREVER ( over 30 min ) then decided to email the lady I had been in contact with, she simply responded with my new balance ( now in the 90 's ) and said to contact them when ready to pay it off. I told her I did n't understand where he charges came from and how I owed more money she said this is what i owed and if I know a name, time and date of someone I spoke with she would look into that. Next I started receiving emails saying this was a supervisor trying to resolve my account, I would let them know what happened and no response. Eventually I started forwarding them emails I had already sent in reply. ALSO every single day and sometimes multiple times they call me ... but never a live person just a call us back recording, and if I called back I NEVER received a human on the phone to be able to dispute these charges which now are up to XXXX and I have n't even used it!!! I 'd like to be able to speak with someone and dispute these charges and get it wiped from my credit.

I had a load with XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX VA XXXX. Phone # XXXX I was in a car accident on XXXX/XXXX/XXXX reported this to Tidewater. I have XXXX insurance, which totaled the car on XXXX/XXXX/XXXX and Tidewater agreed to accept the payoff amount from XXXX, due to remaining balance they will file a claim with Gap. XXXX Claim # XXXX On XXXX/XXXX/XXXX XXXX letter indicated payment to lienholder will be XXXX and the remaining balance of {$2700.00} will be paid by XXXX XXXX, Tidewater, ( which the insurance department with tidewater email indicating that will be the next steps ). I received a statement from Tidewater, dated XXXX/XXXX/XXXX requesting a payment from me in the amount of {$1400.00} and late fees in the amount of {$23.00} after the agreement with state farm and gap is currently taking place. I called Tidewater they are still expecting payment from me after they have agreed to the payoff from XXXX and will file the claim with Gap for the remaining balance. In addition, they continue to report late payments to the all three agency after they agreed to the payoff amount. I 'm requesting my credit report be corrected and a letter sent to me from Tidewater indicating this issue was resolved, so I may show this letter to other finance company when I apply for a new loan. The action of Tidewater is hurting my credit score after they agreed to closeout the loan. Tidewater still continues to collect money from me, XXXX and Gap for a loan that was totaled by the insurance.

On or around XX/XX/XXXX my vehicle was stolen while I was out of town. Since then my insurance company ( XXXX ) and the GAP coverage company ( XXXX ) has paid the vehicle off. However, Tidewater Finance is still reporting {$8500.00} balance on my credit report with 90 days past due. I spoke with XXXX a Tidewater Insurance representative XX/XX/XXXX in which she confirmed on a recorded phone call Tidewater Finance received : {$12000.00} from XXXX XX/XX/XXXX {$250.00} from XXXX XX/XX/XXXX {$7700.00} from XXXX XX/XX/XXXX The following payments are a total of {$20000.00} in which I mentioned is an overpayment according to the credit reports " highest balance '' amount. Then XXXX ( Tidewater representative ) stated the payoff was actually {$20000.00} not the {$20000.00} reported on my credit file. So, I mentioned this is a difference of ( - {$56.00} ) ... not {$8500.00} which is the outstanding balance being reported as of XX/XX/XXXX. XXXX then began typing again and said " I see we received the payments. I'm not sure why it didn't update. '' After being put on hold she then came back and said there's a balance of {$530.00} on the account. I inquired " how were the payments applied? '' XXXX stated they were applied to the principal and I would need to speak with the Consumer Response Team to get a credit reference letter as this was " beyond my knowledge ''. Upon being transferred the call was disconnected. I have yet to be able to get a representative on the line again.

I opened a credit account at a furniture store in XX/XX/XXXX. I purchased a bed using the store credit account through Tide Water Financial. I ended up canceling the order with the furniture store and requested the account to be refunded since I never received or picked up the bed ; I am not in possession of the bed. The furniture store refuses to refund me because they claim " its a courtesy '' to issue refunds and that they don't have to. I called the credit card company numerous times with different reps stating that they will escalate this to a manager and that I would get a call back. I continued to call the company and yet nothing was done. One manager told me I'd have to fight with the furniture store and that this was a correct charge. As of XX/XX/XXXX this still had not been resolved so I called the credit company again and spoke to someone who actually escalated the call to dispute dept. As of XX/XX/XXXX it still had not been resolved so I called the credit card company and spoke to XXXX my account manager and she stated that the furniture store had in fact admitted that the bed had never been delivered and that the order was canceled. She stated that the refund would be done by the furniture store by someone named XXXX and that she would call Tidewater the following day but that has not happened yet. My credit has suffered because of a charge that shouldn't be there because I do not have the merchandise that the charge belongs to.

Tidewater Motor Credit has an automated phone response system that doesnt give due dates and says vague statements like upcoming amount due that doesnt match car payment amount. It offers the option to speak with associates who refuses to give you information and only requests payment. XXXX I checked my checking account and noticed I hadnt made a payment and paid immediately. XXXX I was notified by the credit bureau I was reported 30 days late. I contacted Tidewater to ask why it was reported after I paid and asked for a supervisor and was told to call back to leave a voicemail but was routed to another agent. I asked for a supervisor again and was transferred to another agent. I repeatedly told the agent that I did not understand the billing because he offered to take a payment for less than the regular payment amount and asked for explanation and he refused to answer and asked for a payment again. I was setting up the payment he requested and asked him to explain the billing and he implied he needed to set the payment before he explained. I called later in the day XXXX in hopes to get a different agent to get an explanation but I got the same agent who said at the end of the day you have to pay. I dont know how far or how much I am past due because they refuse to tell me. I want the 30 day delinquency removed from my credit report because they do not make this information easily accessible or easy for the consumer to understand.

On XX/XX/XXXX I filed an Identity Theft report, and Police Report with my local police department XXXX XXXX XXXX police department, because I got alert that someone had opened, different credit lines in my name without me knowing. Someone was using my Identity to apply for loans and, lines of credit online. There were over seven accounts opened, and over 18 hard inquires. I reported everything right away to all three credits companys, XXXX, XXXX, XXXX,. A alert was supposed to be put on my credit reports for 90 days. From XX/XX/XXXX to XX/XX/XXXX. However, whoever is using my social security number has been still trying to get credit in my name. I spoke to ( XXXX XXXX XXXX ) and they could not release information because some of the information did not match what I what information I had. However, they still put a Hard Inquiry on my XXXX, and XXXX credit reports. on XX/XX/XXXX a total of three times in a matter of a three-month span time. As of today, I have contacted Social Security Administration, and have a appt to get a new social security card this does not keep happening. This is affecting my credit and, I take my credit serious. I am shocked, and still shocked as, to how this is has happened, and it has taken me almost months so far to try and, clean up my credit report.

We financed a car with Tidewater XXXX XXXX in XXXX XXXX and did well with payments until we hit a financial wall. We then went through their fresh start to remove any past due payments and start over with making on time payments. Our car was repossessed by Tidewater XXXX XXXX in XXXX XXXX three days AFTER we made the agreed upon payment and setup our next arrangements. It was sold within 2 weeks. We offered on many occasions to work out a payment plan but due to lack of employment the amount was significant enough for them to agree to anything. We applied for a mortgage and discovered a judgement on our credit report from Tidewater XXXX XXXX through XXXX County and them filing a lawsuit against us. We were never served any documents and unable to respond to anything in court. The first paper we received was from their attorney that they tried to serve us and were unsuccessful. The paperwork states that someone knocked and no one would answer despite noise inside ( this is false ). The paperwork also states that someone answered the door and said they were our roommate ( again, false. We have never had a roommate and know no one fitting the description that they mentioned ). I did n't hear or receive anything from them until I received paperwork saying that a judgement had been entered by XXXX County Court. Along with the judgement, Tidewater has not charged off the account and still reports monthly to the credit bureaus.

I submitted a payment online through my XXXX ACH. I was told by my bank the payment would post on or before XXXX/XXXX/2016. But instead the company Tidewater finance posted the payment on XXXX/XXXX/2016. By Tuesday XXXX/XXXX/2016 the payment should withdrawn from my account and sent the the company. However due to no fault of my own Tidewater could not locate the payment. I had to go to my bank to see if the acutally sent it which they did because they can see it drawn from my account. This took Tidewater 2-days to locate the payment and they posted to my account. The payment posted on XXXX/XXXX/2016 due to Tidewater. Which made my payment post on the XXXX day instead of the XXXX. When I contacted tidewater to change the payment date to XXXX/XXXX/2016 they said I would need to contact my bank as it was their error. This was not the case this was completely the error of Tidewater finance. I was told by Tidewater they could n't locate the payment till after XXXX which caused it to post on XXXX/XXXX/2016. That is unacceptable to me considering the payment was received in the an adequate amount of time. Tidewater should not have the liberty to post payments when they feel like it. If the payment was received on XXXX/XXXX/2016 or XXXX/XXXX/2016 before or after XXXX it should be considered received on that day. The 31-day late will have a teremendous negative impact on my credit if this issue is not resolved immediately.

So I was approved for a loan through TIDEWATER FINANCIAL ON XX/XX/2016. However, my monthly payments per contract is due the XXXX of each month. I made the payments on time which was 45 days after I got the vehicle. However, in XXXX, I fell ill and a payment was not made. When I learned of this I immediately made a payment. I had been in communication with TIDEWATER, letting them when a payment would be made. I 've been making my payments on time and they have reported my payment 90 days past due. TIDEWATER took upon themselves to change my due date without my consent, written documentation. I have my bank statement and/or money order receipts as proof that my payments are made 10 or more days in advance. I have wrote letters, emails, text messaging requesting that my due date be changed back to its original date. TIDEWATER IS REFUSING TO DO SO AND KEEP RUINING MY CREDIT with false/wrong/fraudlent information. I spoke with TIDEWATER ON XX/XX/2016 trying to recify this but they refuse to clean my file up. I have disputed this with the credit bureaus and nothing is being done. Also, per TIDEWATER representative that all my payments went to interest. How is that possible, who has {$530.00} in interest each month? There is clearly some fraudlent activity going on here and this needs to be investigated ASAP. I 'm more than willing to send a copy of my loan contract to you to back up my statement.

I called Tidewater finance on XX/XX/XXXX and requested a full copy of payment history and an original document with signatures and verification of how much according to them I owe only account # XXXX. My loan agreement states that the loan is for 66 months ( 56 payments ) at XXXX per month Ive had this account with tidewater since XX/XX/XXXX. My account with tidewater should end in XX/XX/XXXX. Tidewater is stateing that I still owe them over 7200 in payments. I believe that I owe tidewater far less which should be XXXX. XXXX dollars exceeds the the loan agreement. I was financed by XXXX XXXX XXXX ( XXXX XXXX XXXX XXXX, XXXX XXXX, VA XXXX ). While financing the vehicle, this company has placed my payment on another customers account and have called and harassed me multiple times about the payment that was made even though there were notes in the account that stated that they had to put the payment on the correct account. On XXXX XXXX, 2017, I received a notice from XXXX XXXX stating that I had a change in my credit report. When I checked the report XXXX had my account with Tidewater labeled as closed-paid and on XXXX it showed the same and stated that this loan was included in my Chapter XXXX bankruptcy. With that being said, all of my payment history was erased and my credit score plummeted. This has caused me a tremendous amount of undue stress and mental anguish. Seeing as how this company has no regard for its customers or their credit, I would like for Tidewater to take possession of the vehicle that they have written off and not hold me liable for said loan since they have destroyed my credit. I would like all correspondence to be submitted in writing and all phone calls to cease. Any correspondence should be forwarded to myself as well as the Consumer Financial Protection Bureau for their records.

Case # XXXX I made a complaint against this company Tide Water Finance hoping that they will stop sending me monthly statement hence they see a Government agency aware of their shady practices. They have not stopped ; the monthly statements keep on coming with charges that do n't make sense. I will send you a copy of this month statement to show you what I mean. It is ambiguous, confused ; I do n't understand the reason for the charge. The account says XXXX balance ; yet there is still a {$25.00} bill due. I had concluded my financial obligation with them last month. Their representative on the phone assured me that if I pay my final balance with a live person instead of the machine ( computer generated assistant ) ; for {$8.00} fee, this {$73.00} balance will be my final statement. This is the third final statement I received from them. I had {$100.00} final statement before, followed by {$73.00} which was supposed to be the last. Now I have a new statement with XXXX balance and a {$25.00} charge that can not be explained. When does final means final. I do n't want to have any surprises later on if I do n't pay and receive a bill for XXXX of dollars a year or so later. Their representative on the phone before I pay {$81.00} [ {$73.00} + $ XXXX {$81.00} ] gave me a confirmation number and the assurance that my transaction with them was final.

So I had been using my debit card to pay every month. I started to run into financial difficulties in XXXX and then finally filed for bankruptcy in XX/XX/XXXX. There was a " stay '' that was in place to protect me for 90 days until the debts are discharged. Throughout the period from the time I filed on XX/XX/XXXX, I received several calls from Tidewater XXXX XXXX. They left messages on my voicemail demanding payment on every occasion. They also sent me a letter " Congratulating me on my Fresh Start with my bankruptcy ''. They also offered me {$15000.00} to purchase a new vehicle. They knew I filed bankruptcy. They finally came to repossess the vehicle on XX/XX/XXXX. I called them on the date of this complaint and they did could not give me information because I was not the owner of the loan is what they stated. I only have one payment remaining with Tidewater XXXX. On XX/XX/XXXX I went on the Tidewater website to make my payment. Tidewater later took the funds from my bank account on XX/XX/XXXX. I received an email from XXXX XXXX advising me to contact the office immediately, that they had some payment processing issues. I responded with both my XXXX payment history, and my bank statement that matched with the payment history to Tidewater. XXXX said they cant take that they need to see a statement is needed showing a running balance and the deduction of the {$450.00} on that balance. I know for a fact that the XXXX can run a trace on my payment to see if it was returned to me or not. The funds were removed from my account as it always has the last 5 years. The vehicle that I am purchasing, is finance through Tidewater. It is under a recall, on the engines The vehicle was towed to the dealership where i purchased it. The dealership stated that they could not look at the vehicle for three months and they did not know when it will be fixed. I reached out to all the four dealerships that service the vehicle and they stated the same. They also said they don't have any loaners available. It has been going on four months. They state that they are overwhelmed and can't do any better. I call every day and they say the same thing. I have explained this to Tidewater, but they still say it does not matter, I have to continue paying on a car that I do not have or use. I don't have anything to drive and don't know when or if I'll have something to drive. I want to work something out where my credit doesn't get bad for none payments, but it doesn't make sense to make a XXXX payment every month, on a XXXX XXXX XXXX that you can not drive. If Tidewater could work out something with me until or if I get a car back, or even if I can get a loaner, it would be helpful to me. Account was reported as charge-off and updated every month currently as late. This information is incorrect and should be reporting as a XXXX balance and bankruptcy discharged XXXX XXXX. I had an auto loan w/ Tidewater XXXX XXXX . The car was repossessed in XX/XX/2014 approx., they are in turn suing me for the remaining balance. They had auctioned the car off which left the balance at XXXX. They ended up garnishing my wages and received XXXX. This garnishment was lifted because they attempted to go through my previous employer. While this lift was in place I negotiated to pay the Lawyer that is handling this debt ( XXXX XXXX ). Over the course of time I've paid in total XXXX. Yet they are stating I still owe XXXX ( for fee 's because I've already paid the loan amount back ) and are again garnishing my wages. So technically they will be getting well over XXXX from me for a car that's not even worth that amount and no longer in my possession. I am in the process of waiting for my court date, I went to the lawyer 's office where payments were being made and requested transaction history. I obtained a Tidewater credit line from one agent in a XXXX XXXX store ( XXXX XXXX, MN ) in XX/XX/XXXX. While he quickly walked us through the terms, I believe he intentionally concealed / lied/was deceptive about interest and falsely represented this product to be interest free for one year upon which interest would resume on the balance. I signed up and paid without fail, over {$200.00} a month in hopes to pay off ASAP and avoid interest. When the year was up, they added {$500.00} of interest in the balance and warned to increase daily interest at 34 % daily if I don't pay immediately. I paid {$290.00} which was owed and requested to have the interest cancelled or resolvedas I believedI had been fraudulently misguided. Sign under a promotional deal with Todewater Finance and received a 0 % interest bill up to my final payment. Each bill failed to state the amount of deferred interest getting charged to my account and the final bill stated that the interest charged to the account was still 0 %. Paid final bill then received a bill stating that I was charged an extreme amount of interest, as well as, vague and/or misleading information of the itemization of the account. Called to speak to the company and was rudely told that monthly statements are a courtesy and did not have to state accurate information. Was also told by two separate managers and several employees multiple stories about why my account was charged this amount. I received a payment history that had a missing payment made by myself. The company told me to get with the store that I financed my items from or to go back and provide my own information of my payment history for all payments. Ultimately, the company is using misdirected, misleading, and/or unethical business practices and according the last statement I received, before the fraudulent statement afterwards, the account is paid in full.

I paid the loan that I owed and I am still receiving payment notices in the mail. I asked them what do I need to do to conclude the matter and close the account and the representative said to me if you pay today {$81.00}, XXXX XXXX XXXX dollars and XXXX cents, plus XXXX dollars processing fee ; I can finalized the account. [ {$73.00} + {$8.00} = {$81.00}. I told her that I can only make the payment on the XXXX of the month, since the due date is on the XXXX ; I should still be on time. She said if I did not make the payment today, right now on the phone, she can not guarantee that the amount that I owed to be the same. I bought furniture from XXXX XXXX XXXX in XX/XX/XXXX. My credit access is frozen because my wallet has previously been stolen. ( I have Excellent credit ). To make things easy the salesperson used Tidewater Finance. I had planned to make 3 payments over 3 months to pay off the credit line. I was trying to keep my great credit score by borrowing and quickly paying off the credit line. On XX/XX/XXXX I wrote an electronic check for {$1000.00}, but oops I extra zero and I sent them {$10000.00}. That check cleared the bank on XX/XX/XXXX. I contacted them as soon as I realized it ( within 15 days ). I have since had my request for a refund escalated to a supervisor w/ no response. Today they told me that I requested my most recent escalation in XX/XX/XXXX and I would need to wait another 45-60 days from that date ( working days only ) before they would issue a refund. They charge 31.99 % interest on balances not paid by XX/XX/18. I had a credit line for {$3000.00}, I overplayed, by accident, {$6900.00}. I am filing a complaint against XXXX for reporting incorrect information on my credit report. I have filed numerous disputes and it is still not resolved. Tidewater Motor Credit should have been removed off of my credit in XX/XX/XXXX. I have contacted Tidewater Motor Credit directly numerous times and they have confirmed that the first late payment on this account was XX/XX/XXXX and the first missed payment was XXXX. All other credit reporting agencies have the correct information and have removed this from my credit report except for XXXX XXXX has been very rude and will not even try to help me resolve this issue. I submitted a previous complaint ( XXXX ) where I stated this credit card was not approved per customer service rep and a letter was sent to my home address from XXXX XXXX explaining the reasoning for disapproval. As the time went by, I had no acknowledgment of this credit card until tidewater sent me a notice of hearing for small claims. This item never showed up on my credit report. After looking into these allegations, not only was the card approved, but it was wiped out the first week it was opened. The items forwarded to me by tidewater as their proof of acknowledgment was a very incomplete application with a clearly forged signature and a inflated income which is very off because I am on XXXX. Because my complaint was denied by cfpb, the attorneys office pursued legal matters along with tidewater and received final judgment without my presence at the hearing. I did not receive a notice to appear. If I genuinely applied and utilized this card as I am being accused of, it should be easy for them to validate and show me all those cash advance purchases made the first week the card was opened.

On XX/XX/2022, I sent affidavit with recision of contract to my finance company XXXX XXXX XXXX, due to the FDIC rules and regulations that were violated with my contract through the dealership. I'm enclosing all documents and correspondence I've had with them. They sent me a response on XXXX with my contract saying I signed the contract so I had to pay. In XXXX and XX/XX/XXXX I'd called Tidewater Finance Company three times to inquire about information posted on my credit report. I'd provided them with my current address ( over 5 yrs here ) in order for them to send me paperwork. I'd sent back the competed documents. I have since written them five times, requesting that they validate the account in the amount of {$3600.00}. However, with my proof of address ( during the time of account opening ), police report and valid drivers license, that Id provided, they have altered the original address and creditor that was noted on the account. I called the company. I first called on XX/XX/19, the day they received the payment, but the representative that answered the phone was unable to find the account. I repeated the information slowly and clearly, but they could not understand the numbers. They finally were able to access my account, but then could not understand what I was asking. After the fourth unsuccessful attempt to explain my request, I asked to speak with a supervisor. The rep then put me on hold for 12 minutes at which point I was hung up on. Then, I attempted to use their web chat, which there was no response. I finally called again and spoke with a person who now says they will return the money, but not for 60 days. They should not be allowed to hold onto my money and earn interest on it for 60 days. That is an unreasonable amount of time to hold someone's money on an account in good standing.

Tide water finance company has reported my purchase of furniture on my credit report as a maxed out credit card. It took XXXX points off my credit score and I am in the process of closing on my house. My first payment is n't due until XXXX . As it stands, I contacted XXXX XXXX XXXX , they stated they are unaware of TWFC practices, so they would not be able to inform the consumer of this potential damage. XX/XX/2020 I spoke to a representative who set my account up for a deferment due to covid-19 under the CARES ACT. I was told this would not have any impact on my credit as I would be reported current and that the balance of the payments that were deferred would be added to the end of the loan. Tidewater Credit is reporting late notations on my credit file that are inaccurate. I had an auto loan with Tidewater Credit however, this has been settled and paid in full by my insurance because my car was totaled. They let me know that they would take care of the rest of the loan and I was unaware that I was receiving late notations. I was under the impression that GAP insurance had paid off the loan amount and when I called them to inquire about it, they said that it was taken care of. My guess is they probably paid it out late. It was not my intention to be late on this loan, and this is not my error. I ask that Tidewater please remove the XXXX late notations. As for the XX/XX/XXXX late. Tidewater XXXX credit told me since Ohio was on gov't ordered quarantine until XXXX they would put payments on the end of the loan for 3 mos. I was told XXXX was taken care of and to call back for each ensuing month. I did not receive disclosures per TILA that after my down payment, that I would be charged a 35 percent interest rate by Tide Water. I would have never agreed to that. My credit score was mid 600 's. So after I purchase there, and they reported my purchase to credit bureau as a maxed out card, it dropped my credit score 109 points immediately. That way they would be justified in charging a 35percent interest rate. I have been paying since 2017 on a XXXX dollar charge. They pyramid fees and don't count your extra payment. I enrolled into ACH with Tidewater Finance back in XXXX. Due to a missing debit card in XXXX, I had to cancel my card and made a priority to notify all my creditors with autopay of the change. Per Tidewater 's request, I had to now provide a routing/checking # instead of a debit card. Which I did about 2 weeks before my ACH date on XXXX of 2015. Unfortunately, their system has continued to fail to withdraw my account for months now and my payments have been late. Tide Water continues to call my home number, my cell number and my childhood home number. Trying to collect on a debit that they are stating is out there on my maiden name. The car was paid off on XX/XX/2020. I had made 3 calls to get a payoff letter and after driving over 40 miles one way told the agent I refused to get off the phone until they emailed it to me. I filed a chapter XXXX bankruptcy on the XXXX XX/XX/2018 and got a discharge on XX/XX/XXXX, throughout the discharge proceeding I was getting calls and letters from this company and constantly harassing me about repossessing the vehicle the entire time, they have someone calling me about picking up the vehicle every day, which I did, even after I got the discharge Im still getting letters and calls from this company saying I have a balance, and it still showing on my credit report as a open account with a balance. I bought a car while I was in the process of filing chapter XXXX bankruptcy in XXXX. I finance the car through Tidewater Finance Company. It was a XXXX XXXX XXXX. Because my chapter XXXX had not been completed and discharged when i purchased the car, it was also included in the bankruptcy. I fell on hard times in XXXX and the car was voluntarily repossessed because the motor went out and I did not have the money to repair it. Even though it was included in the bankruptcy, they still continue to come after me and will not remove it from my credit report. This is not right. They resold the car and got there money. I want this permanently deleted off my credit report please.

I have an auto loan with Tidewater Finance Company. My scheduled payment is {$490.00} a month. I pay {$150.00} weekly from my bank account using my bill pay feature. Payments are always sent on Monday ( unless a holiday ) and received on Friday. Tidewater used to post them on Saturday or Monday to my balance. This was until my last 3 payments which were not posted until I questioned it. This is allowing additional interest to accrue on the account as they dont go back and ost on the date received. My last payment has not posted at all even though they received it a week ago and when contacted all they will tell me is my account is under review by management

I submitted a previous complaint against tidewater finance for false credit reporting they responded back stating that they are reporting accurately and that the account on my credit was not reflecting open and had been closed and charged off since XXXX/XXXX/XXXX however the current reporting on my credit shows that the account was closed XXXX/XXXX/XXXX agar my complaint that was filed in XXXX XXXX. They falsley claimed that they did a thorough investigation and are reporting correctly. I bought a car from Tide Water. I brought my old car in for a trade in. The signed papers say they will take my car as a trade in and pay that loan off. They did not pay the loan for the old car off. I call the Texas Attorney General 's office. His resolve was to take the new car back to TIDE WATER, and just drive my old car. Tidewater Motor Credit provided different loan pay off amounts on XXXX and X/XX/17 , though the payoff amount is supposed to be valid for 30 days.
