In XX/XX/XXXX I ordered some supplements from XXXX. Upon receiving the products it was discovered that I was allergic to some of the ingredients in the product. I sent an email as well as called the company and informed them that I needed to return the product. I obtained a RMA # and sent the items back. After not receiving the refund I was due I contacted them several times and inquired about the status of the refund. I was told that the refund would be given as the product had been received. I did not get a refund so approximately a month later I filed a dispute with my credit card company. My credit card company then notified me that XXXX had not responded so I was given the refund back to my card. In XX/XX/XXXX ( 2 years later ) I received a call and a letter from a collection agency trying to collect on the charge back amount. I responded within the required time frame and received another email on XX/XX/XXXX stating that XXXX is now claiming they never received the product back. I thereby went onto my XXXX account and looked at the history and it shows my order was canceled and that no other orders were mailed out. XXXX has no right to try to collect on a debt not owed to them. I returned any product ever sent to me and have not made any other orders since. XXXX is threatening collection and negative credit reporting in the use of their vendor they are using as a collection agent. They have failed to provide any proof of an order coming to me and also have failed to document the numerous calls I made them asking about the refund status. They also failed to respond within the 60 days required when my bank originally reached out to them when I filed the dispute. XXXX should be barred from collecting on the debt as they failed to respond in the 60 days originally and for two years never communicated with me directly. For them to hire a vendor who is attempting to collect a debt not owed to them is in violation of FDCPA, UDAAP and Reg E.

In XXXX and XX/XX/2016 I attempted to cancel my gym membership with XXXX XXXX I sent email communication and certified letter to the gym. Due to personal reasons I took a unpaid leave from work and moved to XXXX I provided the lease to XXXX XXXX and no further communication was received from them so therefore my thought was that it was canceled. I have never received statements via mail or collection letters. I travel for work so a process server showed at a previous address where my friends reside and I stay on occasion when Im in town versus going to the address that I previously resided that is listed on my driver license 1.5 hours away from work. I contacted the process sever because I was out of town at the time explained that I was in corporate housing but still worked for the same company. Needless to say this guy made a scene at my place of employment. I contacted the lawyer to let him know that sent signed lease I was told to fax the information and was given the wrong information. XXXX XXXX I clearly in violation of there agreement to arbitration and they have violated my rights to dispute the alleged account. They have scheduled to go to court for an account that they have never sent out any notice via mail to any address that I resided at in XXXX XXXX or XXXX XXXX. The contract says that if you move over 20 miles from you membership location you can cancel you contract. I did that. The attorney Office stated that you can cancel via email well I have a friend that canceled and she lived right around the corner from the gym and she canceled via email because she lost her job. XXXX XXXX never stated that they received my certified letter they asked for my new address and stated that they would verifiy whats to verifiy If I have a signed lease for an apartment over 300 miles away

I did join the gym. I took out a membership. I stopped going to the gym due to a racist employee working. I pay my bill just as any one else would. I agreed to pay the cancel fee and all. But the manager never would call me or face me face to face. The only person I ever seen was the rude employee. I left # serval times and called no one ever called me back. Now I call to this day and I 'm informed they ca n't take this off my credit and they apologize bc they are the new owners and that was XXXX their time.I ca n't help the manger never called. They was n't ever in the building and I 'm not going any place that I do n't feel welcomed.I paid my bill and always went. I just wanted to be treated with respect which I did n't get. This should n't have ever got reported to my credit. I agreed to pay cancel fee the manger needs to man up and call me or talk face to face. I 'm not the only XXXX in this situation. And it 's sad a manager ca n't call a member personal and talk on XXXX and solve the issue. No wonder why they had to find new Owner 's. Now the new ownersowners claim its nothing to do with them it was XXXX their time to take it up with collectors that they would agree to take it off my credit but they did n't know how to go about doing it. Do I need to get a attorney to help me get this removed??????

Creditor called at XXXX from XXXX claiming to be with " National Fitness '', only revealing they were with a collection agency 5 minutes into the phone call. I explained to them I canceled the gym membership and did not owe anything. They then asked me did I get this cancellation in writing, I said no, I spoke with the gym employee at the front desk and they said they would take care of the cancellation. Apparently, the gym employee never did this. I told the agent it was therefore illegal for them to to still be charging me. The collection agent then got belligerent, so I told them not to call my phone anymore and hung up. The same agent then called again at XXXX from XXXX, again stating they were with " National Fitness '', and began reading my credit card number aloud, at which point I hung up the phone.

XXXX XXXX XXXX XXXX XXXX XXXX I just got a letter in the mail today stating Are you going to pay this obligation?
" We have been trying to communicate with you concerning your past-due balance. So far the communication appears to be going only one way. If you continue to ignore us we will assume that it is not your intention to pay this debt. And we will take further activity against you.
Waiting does not benefit either of us. Contact us immediately to arrange repayment of your debt.
Okay first of all I never even heard of XXXX XXXX XXXX XXXX first time I've heard anything of them and if they dont leave me alone I'll take " further activity '' against them. And I have called national fitness center to settle my debt and they said they'd get back to me and they never did. I will not be harassed.

XXXX of 2020 my XXXX National Fitness closed due to Covid. I called to close my account and end my membership. They told me I had to come in and fill out a paper to cancel. After months of continuing to stop by to sign the piece of paper, they were always closed when I went. I later found out the location closed completely. After paying for months for a membership that I could not even go to, I yet called again and got the run around that my membership was moved to another location and they could not close my account. I would have to come into that new location to cancel. I did that and they still did not cancel my membership. They continue to try and charge me and will not stop.

I joined the XXXX XXXX XXXX. When I cancelled my contract with the company due to moving, I had to mail in proof that I moved out or the XXXX mile radius of their corporation. I did so, but almost a year later they contacted me to inform me they would only accept XXXX of my documents even after proof of relocation. I talked to a representative and they stated I would still have to pay the full amount after XXXX of my documents was valid, although their contract stated XXXX of the type of forms that I submitted.

I have something on my credit report from National Fitness. I have contacted the number listed by the BBB and by XXXX and the number is not in service ; their website is not a working number anymore, either. I have no way to request Debt Validation from this company and would like this information removed my credit report, due to false pretenses.

The company National Fitness has a gym account for " XXXX '' on my credit report and it is not my account. The company National Fitness has gone out of business and representatives from the Fitness company say that I just need to contest the matter as they agree the account should not be on my report.
