RE : Attentively review my formal writ composed declaration of not proven complaint misinformation that is all or in part : deficient of the adequate current status in the fullness of TRUTH, ACCURACY, COMPLETENESS, TIMELINESS, documented OWNERSHIP, certifiable RESPONSIBILITY, or otherwise irrefutable, complaint obligatory, and regulatory requisite reporting thereby mandating your immediate actions to rectify and remedy and any infractions behavior ( s ) by retaining or returning to demonstrate TRUE, CORRECT, COMPLETE, and COMPLAINT METRO 2 data field formatted reporting!!! I am a victim of identity- theft, I am writing to request that you block all accounts disputed as fraudulent on my credit reports with XXXX , XXXX , and XXXX. This information does not relate to any transactions I have made. I did not give anyone authorization or consent to use my personal information. I hereby exercise my legal rights enacted by Congress and The Federal Trade Commission, which explicitly states when a victim of identity-theft dispute a fraudulent account on his/her credit report it shall be honored by all credit bureaus and all fraudulent information should be blocked within 4 days and proper notification shall be given to all data furnishers pursuant to section 605b of The Federal Fair Credit Reporting Act. Failure to comply shall lead to complaints being filed with The Better Business Bureau, Consumer Financial Protection Bureau, and Attorney General stating your companys unlawful collection practices, misrepresentation of creditworthiness, defamation of character, and noncompliance to abide by laws enacted by Congress to protect victims of identity-theft who's credit been impacted by acts of fraud. Because I know my rights under THE FAIR CREDIT REPORTING ACT, CONSUMER CREDIT PROTECTION ACT ( CCPA ), and FAIR and ACCURATE CREDIT TRANSACTION ACT of 2003 ( FACTA ). I will be taking action. I also know my rights under this paragraph of Section 312 of the FACTA LAW : SEC.312. Procedures to enhance the accuracy and integrity of information furnished to consumer reporting agencies. ( b ) duty of furnishers to provide accurate information. -- Section 623 ( a ) ( 1 ) of THE FAIR CREDIT REPORTING ACT ( 15 U.S.C . 1681s-2 ( a ) ( 1 ) is amended ( 1 ) in subparagraph ( A ), by striking " knows or consciously avoids knowing the information is inaccurate '' and inserting " knows or has reasonable cause to believe that the information is inaccurate '', and ( 2 ) by adding at the end of the following : ( D ) DEFINITION -- For purposes of subparagraph ( A ), the term 'reasonable cause to believe that the information is inaccurate ' means having specific knowledge, other than solely allegations by the consumer, that would cause a reasonable person to have substantial doubts about the accuracy of information. Policy states. According to the Fair Credit Reporting Act FCRA 611 ( 15 U.S.C 1681 ), Procedure In Case of Disputed Accuracy. ( a ) Reinvestigation ( 1 ) Reinvestigation ( a ) In general. Subject to Subsection ( f ), if the completeness or accuracy of any item of information contained in a consumers file at a consumer agency is disputed by the consumer and the consumer notifies the agency directly, or indirectly through a reseller, of such dispute, free of charge, conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the current status of the disputed information, or delete the item from the file in accordance with paragraph ( 5 ), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller. Therefore, my position is being clearly stated, these accounts do not belong to me, meaning that you are reporting inaccurate account information within my credit file. The fact that these are inaccurate account information means that you, this credit-reporting agency, are reporting incorrect accounts. 1. XXXX XXXX XXXX bal. {$3900.00} I am well aware of my rights as a consumer. The Fair Credit Reporting Act requires that you, the credit-reporting agency report accurate and/or correct account information within my credit file. My credit issues are very specific, these accounts and/or items do not belong to me. This means that you are reporting incorrect account information within my credit report. It is this in mind that I request that these listed accounts and items be Blocked and Deleted. According to the Fair Credit Reporting Act FCRA, Section 1681c ( 2 ) Block of information resulting from identity theft. 1.Block. Except as otherwise provided in this section, a consumer reporting shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from alleged identity theft, not later than four ( 4 ) business days after the date receipt by such agency of 1. Appropriate proof of identity of the consumer ; 2. A copy of an identity theft report 3. The identification of such information by the consumer ; and 4. A statement by the consumer that the information relating to the transaction by the consumer. I have provided all of the above listed four ( 4 ) items within this package. Therefore, I expect these listed accounts to be deleted and blocked within ( 4 ) business days. This is clearly an identity theft issue. I am also entitled to receive a free copy of my credit report, so I am requesting a free credit report and that all of these accounts, public records items, and inquiries be permanently blocked and deleted. Received a letter on XX/XX/XXXX from XXXX XXXX XXXX, XXXX XXXX XXXX XXXX XXXXXXXX XXXX XXXX XXXX ( my loan servicer ) which was dated XX/XX/XXXX advising that as of XX/XX/XXXX they acknowledge the payment on my account but at the present time I was past due and {$70.00} in late fees. My loan is due the first of every month and there's a grace period up to the XXXX of each month. After the XXXX of the month, there is a {$10.00} late fee. My wife calls the phone number every month to make my payment. Any time she calls and makes a payment after the XXXX of the month which was a few times due to me being laid off from my job, she makes the additional {$10.00} late fee payment. We were perplexed when we received this letter stating that they were {$70.00} in outstanding late fees so my wife and I called them today. The representative explained that there were XXXX consecutive months that the payment was received after the XXXX to which my wife advised that she kept records of the dates that she made payments along with confirmation numbers on most of the payments. XXXX particular payment in question was a payment that my wife made on XX/XX/XXXX to which the agent advised that he was able to see when she made the payment online however, they receive that payment on XXXX XX/XX/XXXX. My wife advised that she had a confirmation number that she made the payment on XX/XX/XXXX to which the agent replied that the confirmation number is just confirmation that a payment was set up because the payment can be made without funds being in the bank, to which my wife replied that yes, in that event, wouldn't then the payment would be reversed, and she would be responsible for late fees and an NSF fee. The agent advised that they were using a third-party payment processing service so that they do not receive their payments on the days that they're actually made, but rather per the voicemail when you pay on the system, it takes up to 2 to 3 business days. The servicer 's recording in fact says payments take two business days. She advised the agent that it's not fair for consumer not to know exactly when their payment posts. He said he understood, but did not offer any other solution other than making sure that we are allowed 2 to 3 business days, and if it's a holiday to add an extra day or two to confirm that the payment would be received by the XXXX. My wife advised the customer service person she never heard of anything like that before. Whenever bills are paid on the days they are due ( and up to and on the grace period ), we go online and we make a payment and receive a confirmation number and within a couple of days the payment would post to our bank account, but we get payment credit from the time the payment is made online or through their payment phone service, and not when the money leaves my bank account. The agent advised that they don't work that way and that payment dates are credited when the payment actually comes out of the consumers bank account. My wife asked the representative if she could call the company directly and make a payment and the customer service advocate explained that they have no way of taking payment and that the only way to make the payment was on the website or through the phone and again the confirmation number given was just to validate when a payment set up was made. He said it's the same principle when you call to make up payment for a credit card to which she advised him that was not true. If I go on a credit card website and make a payment for a later date, the payment is credited for the date that I choose to make the payment not a few days later, when the payment actually posts onto my bank account so that did not make sense at all. My wife made the entire payment today, however, we won't get credit for it being made today as we will get credit when it comes out of our bank account in what he hope is within XXXX days. This begs the question then if I go online or call their system and make a payment on the first of every month, why is my payment not credited for the first of the month, but rather the second or third day depending on how many business days it takes for the bank to clear my payment. I have just never heard of this before I wanted to make you aware of this. I don't mind paying the {$10.00} late fee if I go outside the grace period, what I don't think is fair is that I go online or call in to make the payment XXXX days before the grace period or the day of the grace period, receive a confirmation number, and end up paying a {$10.00} late fee because even though the loan company can see when I actually went online and made the payment, they will not give me payment credit until it posts from my bank account. Add to that the fact that they are saying that the late fees are from XX/XX/XXXX through XX/XX/XXXX and I'm only being made aware of it XX/XX/XXXX. When my wife questioned this she was told that they do not send letters every month for late fees. They are sending a letter 10 months from the first late fee and XXXX months from the last late fee. This does not make sense to me at all. Thank you for your time.

I called Thrift Investment Corp. on XX/XX/2019, and spoke with a man by the name of XXXX and explained to him the reason for my call. I told him that the contract states the cost of the loan is {$820.00} for 21 months. I told him that if you divide {$820.00} by 21 months, it should cost me roughly {$39.00} per month in interest. I spoke with another representative earlier in the day and was told I am being charged {$2.00} per day. I told him If you calculate {$2.00} per day for 30 days, that comes up to over {$60.00} per month, and if you multiply {$60.00} per month times 21 months, it will be well over {$820.00}. He said that's not how they calculate interest. He said you start off paying more in interest and then later on you will pay less as the balance of the loan goes down. He then told me to XXXX amortization and read about it. I told him I didn't want to XXXX anything. I wanted him to explain to me why the contract does not state that interest would be paid in higher amounts in the beginning and then reduced later on. He then said " I am not here to teach you ''. After being totally shocked at his response -- I asked him to send me a schedule showing how much interest I will be paying each month over the life of the loan so I can know where the money is going to, ( principal v. interest ). He said " I don't have that ''. I then told him I would contact Consumer Affairs and perhaps they can get the information I am seeking. He said in a very sarcastic tone " good luck with that ''. I believe I have the right to know the breakdown of my monthly payments over the life of the loan -- how much is going towards the principal, and how much is going towards the interest. I don't know if they take out the majority of the interest within the first few months so that if the loan is paid off early -- they will have collected the majority of their finance charge. I do feel they are obligated to provide me with the breakdown of my payments, ( principal v. interest ), over the life of the loan. Please help. Thank you.

In XXXX of 2009 I was down on my luck & had bad credit. Thrift Investment gave me a car loan & an astronomical rate ; with no chance of re-finance or early pay-off without a steep penalty. Unfortunately in XXXX of 2009 - I was in an accident and the car was deemed totalled by my insurance company. My insurance company paid them ; but per my insurance rep - they wanted the total payoff of the loan ; not the amount the car was worth retail. If memory serves I bought the car around XXXX ; with an astronomical interest rate for a total payoff of like {$9000.00} ( my numbers here can be wrong, since the paperwork & loan info for the car has been in storage ). My insurance paid them. But apparently not enough. They are claiming I owe them {$69.00}. I tried to call them to day to get information on why I owe them {$69.00} when the car was totalled 6 years ago & they got a hefty sum from my insurance company. The ONLY thing I got in return was verbally assaulted, asked how I could look at myself int he mirror and what the XXXX is wrong with me that I ca n't pay my bills and I was XXXX because I didnt pay my bills. I was never offered proof of this debt or anything. The only thing I received from them was a continual non-stop onslaught of verbal abuse throughout the entire telephone call. I was an still am deeply disturbed by the apparent lack of not only common courtesy but humanity by the representatives of this company. The lack of human decency by XXXX from Thrift Invesntment is something that no human being should EVER have to be subjected to. I was repeatedly called XXXX & asked how could I look at myself int he mirror knowing I dont pay my bills. I was not even given an opportunity to ask for proof of this debt, I was no t allowed a word in edgewise after my initial inquiry to provide my name & ss # - that is when the onslaught of personal attacks began & did not end until I was hung up on.

I called Thift Investment Corp on Friday XXXX XXXX in an attempt to payoff my car loan. XXXX was the representative I was speaking to was XXXX. XXXX advised that my XXXX pay off would be {$5000.00}. I asked how that was possible when I am paying the car off an entire year early. XXXX was having problems reviewing my account history and said he was getting his supervisor 's assistance. He then said that I was being charged more because my account was over almost XXXX ovedue each month so I was being charged " per diem '' interest. I told him I did n't understand. Here are my calculations. The original loan total would have been {$14000.00} we made 25 payments of $ XXXX {$9500.00}. $ XXXX {$14000.00}. Why would we be only saving {$280.00} in interest if we are paying the car off 14 months early. The balance of {$5300.00} minus the 18.95 % APR should yield a savings of {$1000.00}. Where is this additional {$720.00} coming from? I asked XXXX if we didnt pay the car off and paid till the end would we get charged more at the end. He did n't respond but became belligerent I reminded XXXX that I am a customer and his response " no you are n't you are a debtor. '' I then asked for a supervisor XXXX 's response " You are going to get it far worse now you just wait. '' I am very concerned about this threat because not only does this individual have my personal financial info but also my address. I do not take threats lightly I am putting this in writing as proof that I am very concerned about my financial and personal safety since I was issued this threat by XXXX. When I spoke to the supervisor he was not apologetic at all, only saying he is sorry that I felt threatened. I attempted to review the account again with him but was way too shaken up to continue. My account balance online even shows {$4900.00}. The supervisor advised that that information was not correct.

The account has been an issue for several years. We have tried ( husband and wife ) to work out payment plans and get a comprehensive accounting of our account. What the company has sent to us is a print out that has codes that we do not understand and nobody has taken the time to explain. When asked how much we need to pay they gave us 3 different amounts within days apart. When we requested a print out because of the confusion on the amount they repossessed the vehicle and the company they hired for the repossession caused damage to the garage of the home we are temporarily staying at. Both companies have refused to provide us with the insurance company of the repossession company. The company has harassed us, threatened us, and violated our rights by not giving us proper documentation. They forced us into another loan which added more money onto the original loan. We have numerous text messages, and recorded conversations with the car loan company and the repossession company.

I have an account with Thrift Investment for XXXX for an auto loan of a car that was repossessed. At the that time my significant other passed away and he was responsible for the bill and i no longer couldnt afford it. I did try to get the car back from the 3 months that i owed but they wanted the payment of the car in full. This account on my report has stopped me from being able to rent apartments and to get a car. I still am not able to get a car at this time. I would like this account removed. Im even ok with setting up payments to pay my debt back. That year was very hard for me i lost my car and apartment im just trying to get things back in order for me and my son.

In XXXX I was laid off due to COVID-19. I havent been able to pay my car payment for 2 months. I called and explained my situation and the collector asked me when Im getting my unemployment? My unemployment is less than what I was making before and I have a family of 5 to take care of. Thrift Investment Corp, which holds my used car loan, have been completely unreasonable to work with. Today the collector called and texted me over 20 times and threatened to repo the vehicle for not being able to make 2 car payments during the COVID-19 pandemic, in which the whole country is in crisis. Thrift Investment Corp is aweful to work with during a crisis.

i had a car loan with thrift investment in 2014 the car was deemed a total lost the car was damaged beyound repairs in an accident the insurance company sent a check for XXXX to the balance of XXXX and i was charged off the balance because the dealership didn't place me with the gap insurance i had no knowledge of no gap or any balance owed nor was i able to dispute or validate the debt prior to being charger off to my credit report once placed on my report i have made many attempts to remove the debt and or work it out with thrift with no success

This business is so unprofessional and rude. I call XXXX and they said the person I needed to talk to wasn't in till XXXX and that I would get a call back. I end up calling XXXX since I didn't receive a call back and they tell me the person I'm suppose to talk to left the office for the day and No one can answer a simple question and they can't help me! These people are ridiculous and never dealing with them ever again.
