A matter of public concern. Please see the message body sent to a Texas Regulatory Office. My problem is that XXXX XXXX assured me that my file was fully approved. I just needed to meet paperwork documentation to complete the process. I invest lots of time and even money to complete the refinance process. I never told XXXX XXXX to cancel my application but to wait for me to complete some wet signature paperwork he had sent me. I was proactive with him and sent him work history information and updated paystubs from new work I had just started. He failed to address any issues with any of the information sent through a simple message either by text or email. Instead, XXXX XXXX expected I answered calls from him whenever he needed to talk to me. My job doesnt allow that. I can step aside during the day once I get things cleared usually in the afternoon. Not once did XXXX mention the application had a deadline until the day of with a few hours to go. On XXXX # XXXX minute XXXX ( XXXX ), XXXX tells me XXXX I think there is a big misunderstanding hereyou are approvedthis loan is ready to fundI just need to know who you work for. Why then was my application closed not on Friday, or Monday, or Tuesday but on Wednesday when the application was supposedly set to expire. There is something nefarious going on with the Tech company from XXXX, Texas. A simple search of the company reveals that this same outcome has happen with others. Why would a company gather and collect information of consumer only to strategic close out their file on a self-imposed deadline? The average American Consumer cant initiate an investigation and/or audit of their practices on companies like this. The CFPB has been set up to address these types of consumer concerns. XXXX XX/XX/XXXX XXXX Good morning On XX/XX/XXXX, I applied for an auto refinance with RateGenius. I initially spoke with XXXX XXXX on XX/XX/XXXX then on XX/XX/XXXX and the XXXX. From those calls, he stated to me I was fully approved. I told him that I would stop engaging with other lenders and would focus on closing with them as I knew it was a process to complete. On XX/XX/XXXX, the wet signature loan documents were sent via XXXX overnight. Since the application did not allow me to provide the details of a full 2 history, I sent XXXX XXXX a detailed email of my work history information along with supporting documentation for the whole of XXXX and XXXX - employer XXXX. I spoke with XXXX on Thursday, XX/XX/XXXX, and he said all he needed was my Friday, XX/XX/XXXX paystub and a detail listing of my full XXXX work history. That Thursday evening, I sent XXXX that information he was requesting. Today, Wednesday, XX/XX/XXXX passed midday, he said he needed the XXXX XXXX Bill for XX/XX/XXXX. He was sent the Electric BilXXXX for XXXX XXXX dated XX/XX/XXXX and I told him that my billing is done through the mail and I had not received the new electricity bill for this month yet. He stated to me that the loan had already expired ( after XXXX XXXX ) and I had to reapply again. XXXX XXXX and The Savings Group, Inc ( aka RateGenius, XXXX and XXXX ) and has wasted a whole month of my time and in the process collect a whole bunch of my personal information, pull my credit for no reason and lied to me that my engagement would yield the refinance loan I was requesting not underwriting anymore fully approved from the contacts I had with him. I will be submitting a referral to the Office of Texas Attorney General Consumer Protection Unit to open an investigation on this company. I responded to an ad for a auto refinance loan from XXXX at a rate of 2.99 %, completing an application online. The application was very generic and did not include details on what I was requesting, but I immediately got notification that their had been a hard inquiry on my credit report from XXXX XXXX XXXX XXXX XXXX. I contacted them directly, concerned it was a scam, and they said they would investigate. I later received a notice of adverse action denying my loan. I received an email confirmation of loan approval from XXXX from one representative ( XXXX XXXX ), however I ended up speaking with another representative XXXX XXXX XXXX ). I was requesting to refinance my loan with XXXX XXXX to : 1 ) lower the term of the loan from 60 months to 36 months, and I acknowledged that I understood that would increase my monthly payments ; ( 2 ) Lower the interest rate ( which was 4.95 % with XXXX ) ; ( 3 ) Replace the current loan company ; ( 4 ) Secure a Loan with no pre-payment penalties. My XXXX was listed as co-applicant. After discussing my loan needs with XXXX, she seemed positive that they would be able to do my loan. In the final conversation with XXXX, she states they were unable to accommodate my loan request. She stated they hadn't offered a 2.99 % loan for some time, and also stated that my credit was good and did not factor into their decision. I then received letters of adverse actions from XXXX, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX XXXX. I sent a letter requesting specific statements for my credit denial from XXXX, and emailed XXXX XXXX also requesting additional information on the credit denial, and received No Response from either. I contacted both of the other companies, and neither offered at 2.99 % loan, and both indicated they had rejected the loan because the information they had was for a very lengthy loan term ( over 70 months ) that they did not offer. XXXX had submitted incorrect information regarding the loan I was seeking because both said they accepted 36 month loans. Their loan rates were higher than my current loan. Thus XXXX XXXX XXXX XXXX engaged in a bait and switch advertising offering a 2.99 % loan to get me to apply for an automobile refinance. They provided false information on the terms and conditions of my request to potential lenders, leading them to do inquiries on my credit report that effected my credit rating, and resulting in Adverse Action. XXXX refused to provide details on why they denied a loan they had initially told me was approved. I believe they should be investigated and held accountable for unethical business practices that caused harm to the credit of others. I have copies of the advertisement, correspondence with the representatives, Letters of Adverse Actions, and letter requesting additional information on my loan denial. I am unable to download materials but can submit them in hard copy if needed.

Subject : Complaint against XXXX and The Savings Group for misleading advertising and hard inquiry refusal removal. I am writing to complain about XXXX and The Savings Group ( XXXX ) for misleading advertising and refusing to remove a hard inquiry from my credit report. On XX/XX/XXXX, I was researching auto loan refinancing options through my bank and received marketing offers from XXXX. I submitted a request for more information about buying out my auto loan lease. I was contacted by XXXX XXXX of XXXX, who deceptively misled me with a multitude of " pre-qualified '' auto refi loan rates as low as 3 %. I have attached screenshots of our email conversation below. After several phone calls with XXXX and her team, they haggled me into misrepresenting me with a refinance rate variance of 3 % to 5 %, based on my XXXXXXXX XXXX score, low debt-to-income ratio, and XXXX vehicle lease buyout with a fair down payment. XXXX ran a hard inquiry on my credit report and sent my application to multiple sources, including XXXX XXXX XXXX XXXX and XXXX XXXX XXXX. However, all of the rates I received back were higher than 6.75 % to 8 %. I declined these absurd rates and informed XXXX that I was no longer interested in their services. Despite my decision, XXXX continued to badger me week after week to take their offer. It took them over 60 days to finally give up. My credit report still shows a hard inquiry for this misleading and misrepresented offer that I never accepted. I have reached out to both XXXX XXXX XXXX XXXX and XXXX, but they have both refused to remove the hard inquiry. I am submitting this complaint because XXXX is still misleading consumers about the potential " lowest '' unrealistic rates out there as low as 3 %. These deceptive practices need to be rectified. I understand that advertised rates may not always be exact, but there is a big difference between a plausible variance and a complete scam with more than double the rate advertised, even for supreme prime consumers with over XXXXXXXX XXXX scores, very low debt-to-income ratios, and extremely low monthly carry-over debt with over 20 years of managing optimal credit. I can't even imagine what other lower-tier credit consumers are being misled with much higher rates than falsely advertised. All I am asking for is to formally remove the hard inquiry from my credit report from XX/XX/XXXX. XXXX has refused to work with me on this, even after several attempts and call escalations with different representatives. There needs to be more regulation on these scammers and falsely advertised marketing. A hard inquiry should be able to be removed from a credit report if the deal was never a finalized transaction. I am requesting that you investigate this matter and take appropriate action against XXXX. Thank you for your time and consideration.

No dates needed... only you need to review these sites for blatant lies affecting peoples credit scores. The company XXXX is a " broker '' for auto loans, and states everywhere within its site that they take only soft inquires and " no credit score impacted ''. Please visit mytresl.com to review. Terms and conditions link at bottom of page is very vague, and only states they " pull credit '', but within their site ... .and every major review company 's site, they exclaim there are no hard inquiries to credit report until someone actually applies with one of the lenders you accept. The term " soft inquiry '' is used throughout. This is obviously being pushed to every site possible by the company. The other is RateGenius. I applied through XXXX expecting soft pulls on credit, per their site, and major reviewers sites, like XXXX XXXX, XXXX, XXXX, XXXX, XXXX and XXXX XXXX. However, I have proof of hard inquiries into my report. Looking further, one of their lenders which did a hard inquiry on my report, is XXXX and can be found at XXXX XXXX XXXX Again, they state no hard inquiry ... and claim partnership with XXXX. Rate Genius is another site which exclaims they do not do hard pull inquiries, but diving further they at least state in their FAQ 's page that a hard pull is possible with just their simple application. However, their application term is vague and leads one to believe it'll be a soft pull until acceptance of a lender offer. Keep in mind, neither of these sites ask for social security numbers, which makes consumers feel like a soft pull is only possible. These sites are owned solely by a company called " The Savings Group '' after a merger in XXXX of XXXX It's apparent that these companies are lying to consumers by stating credit scores will not be impacted due to soft pulls, while they're clearly doing hard inquiries, impacting consumers credit scores. I have documentation to prove it. My credit report now shows multiple lenders/banks pulling hard inquiries for an auto refinance from both companies. This is unacceptable, and made worse by the trusted major financial review sites pushing this lie. All should be held liable ... The Savings Group for misleading with false statements, and the large financial reviewing companies for passing these lies on, without their legal teams vetting the info. The Savings Group needs to be addressed for substantially bad business practice.

I received an offer in the mail from Rate Genius stating I could possible lower my car payment with a new loan and save {$180.00}. The letter directed me to a website. On the evening of XX/XX/23 I visited the website and selected just checking my options, completed the required information and before submitting the application I read the details of the offer. The website clearly stated my credit report would not be pulled until I selected an offer from one of their lenders. By the next morning, I was receiving alerts that my credit report was being pulled. I tried logging into the Rate Genius account that had been created and the link was broken. I called and spoke to an agent who said the application she was viewing indicated I agreed to have my credit pulled, I had been approved for a loan and loan representative would contact me. I waited 3 hours and called again. The next agent said they would send another message to the rep and assured me my credit had only been pulled once and submitted to 150 lenders, I said again, I did not agree to that. 15 minutes later the rep called. I was approved for a loan at the same rate I already had with my current lender. Wouldnt make sense to accept the offer. I asked again, why was my credit pulled. The explanation was not sufficient but my application had been submitted to 40 lenders but one approved me. Something about they have multiples companies and a disclosure statement. I still cant access the account that was linked in the email communications I received. My credit score dropped 2 points immediately. My co-applicant had a 5 point drop. The offer I received was misleading and the explanation as to why they pulled my credit was inadequate. I revisited the site tonight and the application page has been updated to include terms that include I grant permission to have a credit check done. I have to give them credit for fixing their website but that doesnt help me at this point.

I received a mailer with a promotional offer from Rategenius ( see attached ) for an auto loan refinance including a lowered interest rate of 2.74 % on XX/XX/2022. I completed the application using the pre-approve offer code through Rategenius, which including a hard credit pull which I confirmed through XXXX ( see attached ). After completion the application process, I was contact by the company ( XXXX XXXX to finalize the loan but was told that that interest rate in a mistake and that they are working to correct the issue. I then spoke with the manager who said the rate is not a guarantee, and that they are not able to offer me that rate, even given my XXXX credit score. I feel this is clearly bait and switch. Ive asked that they undo the hard credit pull, to which they replied that they are not the lender and to instead to contact XXXX XXXX XXXX XXXX. I will also be filing a XXXX inquiry with this company as well. The business did not agree to remove the credit pull, stating that I had accepted RateGenius ' terms to do so on my behalf. I disagree. Consent was provided on the understanding that I was pre-authorized for a lower rate, which turns out was never available. Their mailer clearly stated on the cover page that I was pre-authorized for a rate of 2.74 %, but after speaking with Rategenius was offered a much higher rate of 6.99 %. RateGenius should provide what conditions would have had to have been met to receive the advertised 2.74 % rate. I believe this marketing practice is a violation of the Deceptive Trade Practices Act ( DTPA ) Sec. XXXX The advertisement is designed to be deceptive and should be changed to reflect a range of potential rates based on market conditions. When I spoke with RateGenius. The representatives indicated that they are fully aware of the market conditions and impact of loan interest rates but continues to send out direct mailing to bait and switch customers.

through XXXX XXXX I was offered a new loan with a new interest rate with a company called Rate Genius which based off the information XXXX XXXX had they said I was pre approved. I entered all information they requested, address, car, I uploaded proof of insurance, ID, registration and my income of {$52000.00} for last year! With that information I was given an approval and a rate of 9.49 % which was Lowe than my current 14 % with XXXX. They told me my payment would go from {$620.00} - $ XXXXapx and all they needed to do is run us a hard credit check. I have a XXXX credit score which is in the lower good standings but Good. A representative from the company Rate Genius XXXX XXXX mailto : XXXX XXXX called me to verify my information. And said she will get back to me. Rate Genius made it seem as if I was going to be approved with all the correct and current information I have them. XXXX messages me via text and then asked if I can get a co signer, which I dont have or want. The application made it seem I didnt need one. So I got a response email from Rate Genius stating that I DIDNT WANT TO GO THROUGH WITH THE LOAN which is the not case, XXXX is the one who said that my payment would be more than what Im paying now and they cant help me! Im upset because they were miss leading regarding saying they can Lower my payment. And leading me to do a hard credit check hurting my credit score. If I knew they were lying I would have never ran my credit through them. Im also reporting that they did nothing to help or guide me to someone who can help! RateGenius made multiple " offers '' to lower the rate on my current auto loan. They had several offers with different rates and different loan terms. I chose to go with the 3.5 % rate for 60 months. I clicked the " disclosures and details '' tab and it gave a very detailed breakdown comparison between my current loan and what new loan would look like and how much I would save on my monthly payments as well as the overall interest savings over life of loan. It showed my current lender, exact current loan balance, current loan rate, how many months of payments I had left. ( My auto is brand new and I had 58 payments left on a 60 month loan ). It showed every possible data fact regarding my auto loan! They even had my Vin # on my vehicle. So I clicked the " TAKE OFFER '' tab. They confirmed my address, birthdate, and cell #. They did a hard inquiry on my credit reports. They sent me a text about an hour later that said " Congratulations! Your loan is approved! Call us! '' So I called. As soon as he was on the phone he said. " We will not be able to beat your current auto loan rate. That's a very good rate. We will be much higher! BUT, what we CAN do is refinance your loan for a lower monthly payment. How does that sound? '' A complete Bait and Switch! They had zero intentions of refinancing my loan or anybody elses loan at 3.5 %! They used a fake rate to trick me into makeing loan application. Just so they could get me on the phone with a loan officer and hopefully refinance my loan at a higher rate and a lower monthly payment. A complete waste of time with their very misleading " offers ''. They damaged my credit score! ( It dropped 8 points )

On Sunday, XX/XX/23, I signed up for XXXX XXXX after completing my taxes using XXXX. XXXX XXXX " recommended '' an auto loan refinance with RateGenius, and displayed an advertisement for RateGenius showing the outstanding amount on my current loan an estimated monthly payment of more than {$70.00} less than my current loan, and an interest rate of 3.30 %, which is 0.69 % lower than my current loan, for a 36-month loan, and no fees are indicated. That offer made sense to me and so I applied. I completed all of the required information and answered questions for a RateGenius representative who called me. This included agreeing to a " hard '' credit inquiry -- which impacts my credit score. Still, I was willing to do so because of the amount of money I would be saving monthly and over the life of the loan. And, by the way, my credit score is excellent -- XXXX. So there is no legitimate claim that I should not qualify for the best rate. The RateGenius representative then called me back saying I was approved for a loan at more than 4.6 % APR -- far higher than I already am paying! Obviously that is not even close to what was advertised and in no way something I would have even thought about had the advertising not been misleading! Clearly the rate and monthly payment amount advertised by RateGenius on XXXX XXXX was nothing more than a " bait-and-switch '' type offer to get me to apply for a loan. Now I have a " hard '' inquiry on my credit history for no good reason whatsoever.

We purchased a XXXX and their finance company they required us to use provided us a loan for 5.96 %. We have excellent credit ( XXXX- over XXXX ) and once we received the XXXX we went to have the loan refinanced. With research through XXXX and reviews on auto loan refinance, Rate Genius had favorable reviews and advertised 2.39 % auto loan refinance rates, so we applied with them yesterday. We received an email reporting that the contract was being written last evening. Received a text today asking me to speak with them. I asked them to email me the rate offer and they declined to provide that information to me in writing, requiring that I call them so they can record the call. I called them and the representative asked me what I was trying to achieve with my loan. Very odd question since they are an auto loan refinance intermediary. They informed me that my rate with XXXX XXXX for 5.96 % is a great rate and they couldn't get anything less. I asked why they would advertise 2.39 % for excellent credit and he had no response other than telling me that's the current market. I noted that I would never applied to Rate Genius if it wasn't for their false advertising and now they had run a hard inquiry on my credit causing damage to my credit rating. I informed them I would be filing a complaint and reporting them to the XXXX. Upon subsequent research with the XXXX, numerous complaints on this same issue have been filed by other customers related to false rate advertising.

Sometime around XX/XX/22, I received a letter from Rategenius ( see attachments offer-front.jpg and offer-back.jpg ). After reading it carefully, it was my understanding that they were offering me a rate of 2.64 % and a lower payment to refinance my truck. Since this was for an interest rate less than I am currently paying, I proceeded to go to the URL they provided to receive my personalized offer page. What I received instead was a form to fill out additional information. I did not realize I was actually going through the loan application process until it was too late and an inquiry had been made to my credit. At that point, I figured I'd just go ahead and provide the documentation they asked for, and proceed with the loan. This morning however, I received notification the loan application had been cancelled, with the attached document ( rategenius-denial.pdf ). Essentially in the letter they said they couldn't find a lender willing to offer the rate they promised. So I have two issues with this. Number one is them providing bait and switch interest rates that don't exist. Now they have all my financial information. This is completely unacceptable. The second issue I have is with the link to the personalized offer, which page was not indicative that I was actually making a loan application, and since it didn't show any additional details, I simply thought I was giving additional information so I could receive more details specific to my circumstances.

-- Applied via RateGenius.com for an auto loan refinance on XX/XX/2022. Application ID XXXX. -- On XX/XX/2022 I received two hard inquiries from XXXX XXXX XXXX and XXXX XXXX XXXX XXXX XXXX without my authorization. These two companies are network lenders with Rate Genius. -- Per XXXX website & FAQ section, they will NOT allow lenders within their network to check your credit via hard inquiry. They will provide their network lenders with the information obtained via Rate Genius hard inquiry. Network lenders will NOT pull hard inquires. -- XX/XX/2022 I received a piece of mail from XXXX XXXX stating my application was denied and clearly lists Rate Genius as the dealer. -- Only Rate Genius was authorized to do a hard pull on my credit. One company. These other two inquiries are unathorized and are a violation of my rights under FCRA 604 and violation of my rights to privacy. I now have 3 hard inquiries on my credit. -- Monday XX/XX/2022 I reached out to RateGenius and requested copy of any documents authorizing a credit inquiry from myself specifically to *XXXX XXXX XXXX XXXX* and *XXXX XXXX* signed on my behalf so I may verify its validity and Rate Genius will not provide any supporting documentation. -- XX/XX/2022 I mailed letters out to XXXX as well for XXXX XXXX XXXX XXXX and XXXX XXXX in attempt to remove these unlawful and unathorized inquiries.

I submitted my personal details to XXXX in order to pre-qualify for a new vehicle purchase. This was required as XXXX does not openly disclose its rates but instead submits borrower 's information to lenders to match them with an offer. Per XXXX XXXX own FAQ ( XXXX ) : " During the application, we do a soft pull on your credit that will not negatively affect your credit score. Only when you choose an offer to submit for lender approval, does XXXX run a hard pull against your credit which may affect your credit score. '' I also received an email confirming the same : " We run the numbers and find you our best rates and terms, all without affecting your credit score. '' Both the FAQ and email confirmation are attached. Despite this, XXXX immediately performed a hard pull on my credit, negatively affecting my score.A representative from XXXX ( XXXX XXXX ) called to discuss my application. I asked why a hard pull was made and he answered that they do so before sending applicants ' information to lenders so I can be matched with the best offer available to me, rather than individual lenders having to run a large number of separate pulls. I reiterate : I did not choose an offer for lender approval, and per the FAQ and confirmation email, a hard pull should only have been made AFTER I did so. This is a deceptive practice which has harmed my credit rating.

I was attempting to refinance my truck through RateGenius.io a financial website for these types of matters. The representative called my several times, and was unable to make a competitive offer that would be better than my current interest rate. After a few days the representative ( XXXX XXXX ) called again and offered a much better interest rate, upon reviewing the documents and going to sign the paper work, I found that he had lied about the rate. His sales tactics were deceptive and I questioned him on various numbers and he was vague and unclear. The rate of my current loan, is 3.65 % XXXX has stated he found me a loan for 2.79 % upon reviewing the documents, the loan was 3.49 %. When I asked XXXX about this, he said that the loan was good and the final rate was just " after they do all their stuff ''. Unknown what that actually means, but he was unable to clarify, and it was clear to me he was being deceptive.

On XX/XX/XXXX, I had requested a Rate from Rate Genius. It was not clear by requesting a rate that a hard pull would result from my request. I was under the impression that I was only getting a preapproval. On XX/XX/XXXX I got a notification from XXXX XXXX that my credit was pulled which resulted in a hard inquiry. Informed XXXX XXXX at rate genius who informed me that on XXXX XXXX there was a check mark that I needed to click if it was ok to do a hard pull. Informed him I wanted the inqury removed because I was just looking for a preapproval. He refused. All I wanted was a preapproval not a total approval. I was just shopping rates... not looking to close which is further evident that I did not upload the required documents for a full quote on their website ( Proof Of Income etc ) How could they pull my credit without having all the facts?

On Monday XX/XX/XXXX, I saw two credit checks on my credit report that I did not recognize but it was too late to do anything. On XXXX morning I received a call stating that I applied for an auto loan refinance with 'rategenius ' and that they had pulled my report and were calling me to follow up. I informed them that it was not me and they said that the info came from rate genius and I would have to follow up with them. I followed up with Rate Genius and informed them that my identity was stolen and asked them to provide me the authorization they claim they received from me to give my social out to different companies. They claim that this is proprietary information and they are unable to share it with me. They refuse to take the credit checks off my report and refuse to provide me with any evidence that I provided authorization.

I reviewed the website for RateGenius to see what rates they were offering on a refinance of a car loan that has a 6.49 % rate. My credit score is well above XXXX and the rate advertised by RateGenius for a 3 year amortization loan was 4.67 %. I have taken a picture of the website which states the rates are as of XXXX XXXX, 2023 I went through an extensive process to apply for a loan based on the advertised rate and was offered a rate of 6.19 % and told the APR would be over 7.5 % when including fees. On the advertised rate there was no asterisk for any additional fees that would cause the APR to be higher than the advertised rate. I queried as to why they would not offer me the rate advertised and they had no response.

Received letter in the mail approximately XX/XX/2022 offering lower interest rate of current vehicle loan. Letter was very specific regarding my current rate and what I was " pre qualified '' to get from their company. Current rate is 10 they offered 7.44. I then logged into their website and completed application based on prequalified offer. After a couple of days and 2 hard inquires I reached out to the loan guy who then offered me a rate of 15.7 ( XXXX ). I told him that was much higher than advertised. He told me that was their best deal. On XX/XX/2022 I clicked one button to view offers ( as it claimed ) to see new auto-rates through XXXX, I made sure that in the title that It didnt say it would do a hard inquiry. I have received another text today from someone named XXXX XXXX, claiming to be my loan officer. I texted back to never text me again and to never pull my credit ever. I initially reached out to RateGenius for a potential auto loan refinancing. I noticed that they did hard inquiries, so I canceled the request.
