I understand that this is another complaint to add to the thousands of complaints already in your office. I am sure, just like in our situation, millions of Americans were hit hard by the recession and the complaints piled up year after year. Twelve years later, when maybe, just maybe, people have started to rebuild and get a little ahead, like in our situation, we have another unprecedented economic downturn and a pandemic. Yet, the secondary debt collector market is stronger than ever and as a consumer I am requesting that they are held accountable. I am hoping you will provide me with some ray of hope that consumers will be provided more protections from these unscrupulous businesses. The Federal Trade Commission ( FTC ) now receives more consumer complaints about debt collectors than about any other single industry. The agency received XXXX complaints about debt collection in XXXX, more than triple the number of complaints it received the previous year. The Consumer Financial Protection Bureau ( CFPB ) received XXXX debt collection complaints in XXXX. In a national survey of consumer experiences with debt collectors, the CFPB found that one in four consumers contacted by debt collectors felt threatened. The company we are dealing with is The Moore Law Group, XXXX a vulturous, predatory and litigious company. Our Story : In XXXX, due to the economic downturn, our lives drastically changed ; losing our jobs and all of our savings, retirement and education funds for our XXXX children, XXXX of whom were in college at this time. After several attempts to receive a modified payment plan with XXXXXXXX XXXX SOUTH DAKOTA XXXX XXXX which by their agreement they offered, were all ignored. They then charged off the account, before requiring immediate payment of the entire account. It was then we heard from the first secondary market debt collector, which, at the time, was unchartered territory to us. We were in the midst of rebuilding our lives, receiving unemployment, applying for jobs and starting a small business simultaneously. We depended on assistance from family and friends to keep our home and pay our bills. As of XX/XX/XXXX, The Moore Law Group has an Application for Writ of Garnishment and there is a withdrawal pending on XXXX XXXX 's savings account of which XXXX XXXX is a signer. She is XXXX years old and her son is only a signer for when she passes, these are solely her funds. It amounts to more than half of her life savings. It is common for outside debt collection agencies to purchase charged-off XXXX XXXX XXXX XXXX accounts that have fallen so behind on payments, which XXXX XXXX XXXX XXXX then files as a loss. The debt collection agency purchases the debt for pennies on the dollar, usually 4 % of the original debt value, while they collect on the full amount plus fees and interest. Our original debt amount was XXXX which translates to being purchased at ~ {$650.00}, but now the Writ of Garnishment is for {$24000.00}. Timeline : XXXX : Last Payment to XXXX XXXX XXXX XXXX XXXX : XXXX XXXX XXXXXXXX XXXX- Debt Purchased & Civil Summons XXXX : Judgment XXXX : Substitution of CounselXXXX XXXX XXXX XXXX XXXX XXXX XXXX Moore , XXXX XXXX XXXX Renewal of Judgment XXXX : Statute of Limitations Up XXXX : XXXX, XXXX, XXXX & Moore XXXX XXXX closed XXXX : The Moore Law Group-Purchases or Absorbs the Account XXXX : The Moore Law Group-Files Application for Writ of Garnishment XXXX : XXXX & XXXX Moore-Answer as Garnishee XXXX : XXXX & XXXX Moore-File Motion To Set Aside Judgment Some debtors fail to show up in court because they can not get time off from work or secure child care. Some are confused by notices, even having received several in the mail. Many are unaware of the consequences of missing the court date. In cases brought by companies that have purchased the debt from the original creditor, the plaintiffs name on the summons will be unfamiliar to the debtor, creating more confusion. According to consumer rights advocates, some debt collectors repeatedly request trial continuances, postponing the case whenever the debtor shows up in court and then moving for default judgment the one time the debtor fails to appear. Even when aware of the suit, debtors almost never have lawyers and dont know how to defend themselves in a legal proceeding. There is no constitutional right to an attorney in collection actions and civil contempt actions, and most debtors can not afford to hire one. As a result, debtors are represented by lawyers in fewer than XXXX percent of collection cases. In regards to the statute of limitations ( six years in Arizona ), The Affidavit of Renewal of Judgment was filed on XXXX, yet the House Bill XXXX revised A.R.S. XXXX extending judgements from five to ten years was signed into law on XXXX. Why was the Affidavit of Renewal of Judgment approved, it seems contradictory and unlawful. The principle of a statute of limitations says that you should not be able to sue on a claim that is too old or stale, as in this case, this debt is XXXX years old. The default judgments are routinely padded with interest charges and attorneys fees, so the amounts end up being far more than the original debt. Once a debt collector gets a court judgment, it gains the power to garnish wages, seize property, clean out bank accounts, or put a lien on a home. It seems to us that there is false representation, The Moore Law Group, XXXX. is not collecting this stale debt on behalf of XXXX XXXX XXXX XXXX but for their own ill-gotten gain. Yet, XXXX XXXX XXXX XXXX is still listed as the Plaintiff on all Court/Legal Documents. Where is the transparency of who we are actually dealing with or where the money will end up? The Debt Collection Industry is a multi-billion dollar racket run throughout the country. Just as a photocopy of a {$100.00} bill is evidence of a {$100.00} bill, it is not the actual Federal Reserve note ; its a copy that doesn't spend. Yet, debt collectors are collecting billions on photocopies of debt. That is, evidence of debt, not the debt. The evidence of debt is being sold for and purchased for pennies on the dollar, while debt collectors/attorneys are collecting on the full face value plus penalties and attorney fees. The Courts have been rubber-stamping these transactions for so long that it has now become custom to rubber stamp. A custom that is at its best, difficult to overcome. The Courts don't like having to actually consider the facts and evidence, it is so much easier to hand out your money than for them to behave according to their own rules of procedure and evidence. The Courts want you to prove a negative that you dont owe. While refusing to require the Plaintiff to prove the charges he has brought against you. According to the Federal Trade Commission ( FTC ), the majority of cases on many state court dockets on any given day are often debt collection cases. In many states, companies that bought debts from original creditors file more civil lawsuits than any other type of plaintiff. When judges automatically award default judgments without scrutinizing the merits of debt collectors claims, these judgments may be for the wrong amount, for debts that are not subject to collection, or against the wrong defendant. The FTC found that the information received by debt collectors is often inadequate and results in attempts to collect from the wrong consumer or to collect the wrong amount. Once a lawsuit is filed, the process is stacked against the defendant, whether the amount is owed or not. Debt proceedings are plagued by substantial due process deficiencies, including failure to serve the defendant with adequate and legal notice of the suit, lack of evidence of the underlying debt, and falsified or improper affidavits such as robo-signed affidavits. Beyond that, debt collectors benefit from expedited judicial processes in small-claims courts, which provide limited due process protections to debtors. Courts overburdened with cases churn through these collection lawsuits with astonishing speed and minimal scrutiny. The vast majority of theman estimated 90 percentconclude in a default judgment against the defendants, in which the debt collector automatically wins because the defendant did not contest the case. Most did not appear in court to defend themselves or respond to the litigation at all. The time has come to make changes and give consumers weapons to fight back these parasites of the American economy. In XX/XX/XXXX The Moore Law Group in XXXX XXXX CA, knowingly violated Fair Debt Collection Practices Act and The Limitation act of 1980 and put an unlawful lien/judgement against my bank account and they fraudulently withdrew {$850.00} for a debt they were collecting that I originally had with XXXX XXXX that the last day of activity was in XX/XX/XXXX. The debt at that time was 6 years past the 4-year time limitation and over 10 years had passed from the date of last activity inXX/XX/XXXX I was injured in XX/XX/XXXXand had to have several XXXX. I was not physically able to return to work until XXXX. I was a XXXX XXXX XXXX and was unable to receive unemployment and had no source of income, which is why I was unable to pay XXXX XXXX after XX/XX/XXXX. Prior toXX/XX/XXXX, The Moore Law Group had threatened and harassed me with letters and phone calls. I informed them the debt was over ten years old and they lied and said I had to pay it or they would sue me. They presented the bank with false paperwork regarding the debt and the bank allowed them to levy my account and they fraudulently withdrew {$850.00} from my bank account. The money The Moore Law Group stole from me was my rent money and they caused me severe financial and emotional damage. The XXXX XXXX also broke the law as they misrepresented the truth and presented false documentation in court on XX/XX/XXXX as they knew the debt was pass the 4-year time limitation and won a judgement against me for {$5600.00}. I did not have the money to hire an attorney and the paper work was very confusing, and I have been emotionally distraught and mentally overwhelmed since the court issued a judgment against me for a debt that the date of last actively on the account was over 10 years old and that The Moore Law Group would blatantly break the law and violate the Limitation act of 1980 and the Fair Debt Collection Practices Act and file a lawsuit against me for a time barred debt. On XX/XX/XXXX The Moore group seized {$24.00} from my account and are harassing me to make a payment plan with them for the XXXX XXXX debt that the last day of activity is over ten years old.

I owed a debt that was satisfied in XXXX. In XXXX, I received a letter from The Moore Law Group that they were going to garnish my wages for this debt. I had my credit report showing that the debt had been satisfied, but XXXX of their representatives by the name of XXXX, said that there was no proof. He argued with me and was XXXX of the rudest men I have ever encountered, not professional at all. I agreed to pay them XXXX just to have them stop harassing me. I did not know my legal rights and I just wanted them to leave me alone. I did not receive any other paperwork from them until XXXX weeks ago when I received a letter of wage garnishment from my employer. The wage garnishment was for XXXX}. The original amount they had claimed I had owed was only XXXX. I called The Moore Law Group and spoke with XXXX of their representatives, XXXX at extension XXXX. He told me that he would put in a dispute with the original company, XXXX. At that time, he told me not to worry about the wage garnishment. On XXXX XXXX, my check was garnished. I called that day and tried to reach the original person I had spoken with. I was unable to speak with him. I proceeded to remain on hold and asked to speak to a XXXX or supervisor. I was then connected to a XXXX XXXX at extension XXXX. I told him about my previous conversation. He told me the wage garnishment was still in effect, the original company had not responded and when I asked for my file information to be sent to me, he stated he would not tell me any information unless I reascended my dispute. When I told him I would n't because I did n't owe the money and they had no proof, he became silent and would not respond to me. I have never been treated so poorly by anyone and that is a large sum of money to owe from a XXXX year old debt that is beyond the statute of limitations.

Hi all, On XXXX XXXX, XXXX, I called the debt collection company " XXXX XXXX XXXX XXXX XXXX '' provided my account information regarding the settlement amount of {$7500.00} I have owned. All the phone call was recorded by them at the same time. I have spoken to one of the representatives saying that I was ready to pay off, and been told that the money was ready to run on that day. However, on XX/XX/XXXX, I have received a summons from XXXX XXXX court saying that the original credit card company is filing a lawsuit against me. I called back to XXXX and asked what happened. after that, I have found out that the representative who answered my phone call on XX/XX/XXXX has never ever submitted my payment on that day. meanwhile, there is another debt collection company name " The Moore Law Group '' that is taking care of this debt after XXXX. now they are asking me to pay the outstanding amount which of {$21.00}, and they have filling a lawsuit if I can not pay on time. I feel very innocent of this situation. compares {$7600.00} to {$21000.00} there is a huge difference. I did what I need to do back in XX/XX/XXXX. It is the XXXX staff 's fault that didn't submit my payment, but why I have to take this responsibility. I hope you can involve this case, and let me know what is rights to protect myself. The Moore Law Group has continued to escalate the amount owed The amount owed at time of filing on XXXX/XXXX/XXXX was {$11000.00} and adding their interest and judgment of {$2200.00} plus {$25.00} for writ fees, the amount came to a total of {$14000.00}. On XXXX/XXXX/XXXX, the Moore Law Group garnished my credit union account for {$1000.00}, leaving only {$25.00}. However, in their writ of execution on XXXX/XXXX/XXXX, they acknowledged that the amount taken from the credit union was {$1000.00} which was incorrect. However, with the interest added in the amount of {$3400.00} increased the total amount owed of {$14000.00}. They ignored the fact that I was not credited the correct amount withheld from my credit union and also ignored the fact that on XXXX/XXXX/XXXX and XXXX/XXXX/XXXX, Card member Services sent me two letters informing me that they were crediting me {$6.00} and {$3.00} for a total of {$9.00} which has never been credited to the enormous overpayment that is continually increasing rather than decreasing. At one point, I called to make payment arrangements but was told it had to be a certain amount each month based on how they had it set up but based on my finances, I could not afford the amount they wanted on a monthly basis. Even after they took all the money out of my credit union account, they harassed me by sending information to garnish my check. However, because I am not employed, there was nothing to garnish. I feel the Moore Law Group has violated my rights and have escalated the amount owed to an outlandish amount of {$14000.00}.

I have attached the documents that the Moore Law group sent to verify the debt. Once again more flat out lies on their behalf. I asked for an original copy of the signed contract between my self and XXXX. They didn't send anything of the like. Instead they lied and said they provided a copy of the application and signed contract. Please see attached documents. There was no application or contract provided. They also go on to say they will " We are a law firm and have a master agreement with the client, but we will not be producing that to you ''. Lastly, I asked for a line by line accounting of the original account. Their response was We will NOT be providing you with a line by line accounting of the original account. We have provided you with monthly statements that are currently available to us ''. if they in fact are a legitimate law firm they should have no problem providing me with a line by line account. I have listed 3 instances of FDCPA violations. The Moore Law group doesn't get to dictate what they will send or won't send to validate my debt. Furthermore, their statement of we provided the original contract is a flat out lie. There isn't anything they won't say or do to try and collect a debt. I found it very offensive that they sent me a debt collection letter in XXXX. Just because my name is XXXX doesn't mean I speak XXXX. I have escalated this matter to the Colorado Attorney general, any action by the Law Moore group should be postponed until the Colorado Attorney general concludes their findings.

During the first week of XXXX my husband and I began application to refinance our home. On XX/XX/XXXX the title company found that there was a lien attached to our home. We did not know of this lien until XX/XX/XXXX. XXXX had sold the loan to the Moore Law Group in XXXX XXXX California. Moore Law group filed a lien on our home XX/XX/XXXX. My husband and I filed for bankruptcy on XX/XX/XXXX. When we looked over the paperwork regarding bankruptcy the Moore Law Group was included along with XXXX and XXXX. We began phone calls to XXXX on the XXXX they gave us to the Moore Law Group who told us they sold it to XXXX XXXX XXXX. We phoned the number they gave us and they were no longer in business. We phoned XXXX once again. After many transfers and I had to repeat my social security number to the same person 5 times I became very skeptical. They told us we would have to use mail as there were no email or fax machines. We told them we were applying for a loan and dont have that amount of time. On Tuesday XX/XX/XXXX we began again with XXXX and after many transfers from XXXX to XXXX then back again to XXXX we reached a XXXX!! She said she would contact the Moore Law Group for a XXXX demand letter, she said she saw our bankruptcy and there was XXXX balance. On XXXX XXXX we contacted the Moore Law Group for XXXX demand and received a notice that we owed XXXX then they would release the lien. On Friday XX/XX/XXXX I emailed a settlement request for XXXX. For them to remove the lien.

I have never given The Moore Law Group, XXXX any permission to use any of my identifying information to commit mail fraud by contacting me about an alleged debt they claim I owe. I am aware that in accordance with UCC Article 9, the assignment of a defaulted note is illegal. Both the assignee and the assigned are liable for violations under 15 U.S. Code 1692e ( 12 ). Moved in XX/XX/XXXX, spoke to the office manager XXXX to let her know the smoke in the apartment as well the disregard in cleanliness were overwhelming. XX/XX/XXXX - Sent a follow up email asking for help to resolve this, heard nothing back. On this day, I bought cleaning supplies for about a XXXX dollars to try and remedy the smell. XX/XX/XXXX - Asked the office for help again and did not hear back. XX/XX/XXXX - Reached out yet again, received a response that they would credit me the cleaning supplies but nothing to get rid of the smell. Let them know that there were cigarette stains/ burn holes all throughout the bathroom and no response. XX/XX/XXXX - After spending months stayed with friends, asked if I could terminate the lease as nothing had been done nor was any other option given to me to not have to live in a smoke filled apartment. Reached out to the office to let them know my mailbox was broken into for the XXXX time as well. XXXX XXXX They quoted me the termination fee. XX/XX/XXXX - XXXX, Office manager, said I would not have to pay any other additional fees. XX/XX/XXXX - XXXX my final bill ( attached below : moveout statement ). My Complaint pertains to : The Moore Law Group, XXXX. located at : XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX, CA XXXX ( Collection Agency ) The Moore Law Group is collecting a debt which started XXXX XX/XX/2020 and I also disputed this debt they claimed I need to pay. But I have no idea or do not know anything about their collection. I have been asking or requesting a copy of the credit card contract/written application who opened the credit card under my name. But what The Moore Law group did was to filed a lawsuit against me. Until now, after various letters to produce the written contract or credit card agreement with the valid signatures was not provided. I believed that they are committing unfair debt collections because that in spite of Identity Theft Report that I submitted with FTC and Police Report they continually insisting on this debt unknown to my knowledge. Also, The Moore Law group involved other people such as my friends with regards to their collection. Their alleged accusations against me does not have a valid proof and I feel that it is already in a form of harassment on my part as well as others such as friends of mine that they communicated about the collection they are doing.

Each year the XXXX and the law firm who is representing them harrassed me and file diffrent claim against my bank account, by phone call and last week by the involuntary lien which they put on my property. On XXXX XXXX. XXXX, I received a letter from The Moore Law Group, a professional Corporation who represent XXXX about payment agreement to make a {$25.00} monthly for XXXX payments by XXXX of each month every month. They sent me a contract to sign and Since then I have been paid the due amount on time, each month without even one day late. The XXXX and their representative never on XXXX served me or notified me, that involuntary lien were put on my house. About two days ago I received a letter from Registrar-Recorder/County Clerk, to notify me notice of involuntary lien which was renwed again against my house. What the XXXX and their firm did is a fraud, they never told me that the lien was put on my house in XXXX when they asked me to make monthly payment, they never told me that they will renew the lien.If I am making payments, why withourt my knowledge they have to go to the court and renew the lien.

Some time in XXXX, or XXXX someone who moved into my former residence opened a XXXX card, the troubling thing is apparently the card was issued to a XXXX XXXXmy name is XXXX XXXX, I did not find out about this until XXXX, when I was looking at court records & there was a judgement against me that matched my S.S. number. I looked up the court case and saw the person they served for the lawsuit was not me, it did not match my physical description, it was way off. I was not even living at that address at the time, so it was impossible to serve me. So the creditor, Moore Law Group got the judgement, and apparently when 10 years pass, they need to renew the judgement, which the Moore law group did. I filed a motion in court to have the judgement vacated, and the court granted my request because the person they served was NOT me. I have filed an identity theft report with the XXXX XXXX police dept. and notified the Moore law group of identity theft, but they are continuing to try to enforce the court case against me. I never had a discover card & did not open this alleged account.

XXXX XXXX, XXXX and her law firm, XXXX XXXX XXXX are attempting to sue for " legal fees '' they claim where accrued while trying to collect on a debt for plaintiff, XXXX XXXX ( XXXX ). Originally, the debt went to collections in XX/XX/XXXX and was bought/transferred by several different agencies and attorneys over the years. XXXX purchased/acquired the debt recently from the Moore Law Group, and is now suing for legal fees, they say were ratcheted up while representing XXXX. XXXX did NOT hire Moore Group, according to the conversation I had with an XXXX representation, soem time ago. Neither firm is the original collector. XXXX recently subpoenaed my bank statements on XXXX/XXXX/XXXX in an effort to move forward on the phony suit. Her office is using predatory practices to obtain money from those who fell behind on their bills and found themselves in debt, years ago, when the economy fell. The debt is over 7 years old and the statute of limitations have passed for this debt. They have no right to collect on any fees and did not represent XXXX in any fashion.

XXXX has filed suit a few years ago but at the time I have been unemployed and have tired to work with this company to repay them, they did not respond to me. And I have asked for documents pertaining to this and have not received anything. It was filed in XXXX XXXX NM and when I did appear for court the company dismissed the case, so the judge stated I was free from this. I am not sure if they are trying to just obtain funds without me contesting it. This is the second time they are trying with another company. From the looks of it that is what I see, trying to get money without me fighting or questioning it. So this is my concern I have tried to work with this company and if they do not want to give me what I have requested I feel that I should not have to pay. It is like they wait and then try to renew the statute of limitation. Like I stated I have tried to work with them but they are not willing to submit documents to me. So I am not sure what more I can do.

I have not lived at the house that they supposedly sent details to. I have not received a call, nor have I been able to call them. Their number does not work. I've attempted to call local offices as well. I have recorded what happens when I attempt to call them. I get a recording every time. How can I work with a debt collector when I can not contact them? Are they not required to be reachable? it seems like a very shady tactic to tell consumers to contact them at a specific phone number, then that phone number does not work. Now my wages are being garnished???? I could have worked this out with them had the been communicative and reachable. Additionally, my name is spelled incorrectly, which might be why I don't receive any mail communications from them. They've failed to correclty spell my name, but received a default judgement against me with my name incorrect? I don't receive any mail from them because no one by that name lives at my address.

This is a debt collection agency. I have received numerous harassing calls from them and a threatening letter of intention to sue me after I asked them via certified mail which they received on XX/XX/XXXX, to validate the debt is mine. All I've received are statements that anyone can make up. Firstly, I received no debt validation letter or a notice for the transfer of debt. Secondly, they sued me and won judgement and afterwards I asked for email communication only. THEY CALLED ANYWAY. Thirdly, I asked for the original agreement from them which I NEVER signed up for WITH " THE MOORE LAW GROUP '' and for the debt validation letter I was supposed to receive 30 days before any action was taken on their part. I don't know why this company is making threats to me in the attached letter. I have tried asking the company for a copy of the contract and they have not produced it. There's no way for me to know how much the debt is for and how much the fees are without the original contract. Simply sending me bank statements does not establish that anything is owed and is not enough information.
