On XX/XX/XXXX an unsigned Writ of Execution ( dated XX/XX/XXXX ) was received by my employer and was sent to me via email on the afternoon of XX/XX/XXXX regarding wage garnishments. I contacted the company listed on the Writ as the plaintiff XXXX XXXX XXXX XXXX XXXX XXXX ) in which they advised they don't have the file and I have to contact the attorney listed on the Writ. I then made several attempts to contact the attorney ( Law Office of Hayes and Welsh ) by phone on the number listed on the Writ of Execution which is XXXX, and spoke with XXXX XXXX who confirmed she received my voicemails and forwarded them to XXXX XXXX who is the attorney working on this case. However, after many attempts made to contact XXXX XXXX, I had not yet received any call back to discuss this case as of XXXX XX/XX/XXXX. I have never received a court summons for the hearing that created this judgement against me nor have I received the Validation Notice that they are required to send me prior to garnishment. The Validation Notice is to include a full accounting of debt principal, interest, original loan date, and current amount due as well as original creditor and account number. This debt has not been verified nor confirmed by me as being a legitimate debt. This debt does not reflect on any of my credit reports that I recently pulled as of XX/XX/XXXX. I had filed XXXX XXXX Bankruptcy in Hawaii on XX/XX/XXXX so all existing debt at that time was discharged and furthermore, I paid off all open collections listed on my credit report as of XX/XX/XXXX. I then submitted a letter of dispute by dropping it off to the attorney 's office as well as mailed a certified signature receipt required copy via XXXX yesterday XX/XX/XXXX. I have been living in XXXX XXXX since XXXX and did not make any new loans. All companies involved ( whoever the original debtor is ), XXXX XXXX XXXXXXXX XXXX XXXX and the Law Office of Hayes and Welsh did not follow the CFPB regulations. Only after I left another voice message for the attorney stating that I was filing a complaint with the CFPB and Federal Trade Commission did I receive a phone call back which was at XXXX ( PST ) on XX/XX/XXXX. I then met with him when I dropped off my attached letter of dispute in which he stated he will contact his client to remove the Writ of Execution of wage garnishments and advised he will hopefully hear back by the end of the week.
