I was served a petition from a sheriff out of the blue at the end of XX/XX/XXXX. I had no knowledge of the lawsuit. I contacted XXXX XXXX XXXX and informed them that I had not been given the opportunity to dispute the debt and that the petition was filed in the wrong parish. XXXX XXXXXXXX XXXX recalled this petition and sent me credit card statements for review. Upon receiving the credit card statements, I found thousands of dollars in unauthorized charges after I reported the card stolen. I have a police report to show my car was broken into. I sent 3 written notices on how to dispute these charges so that I would not be liable for them in the balance and never received any communication from XXXX XXXXXXXX XXXX.
On XX/XX/XXXX I was served another petition for lawsuit even though I had been making best efforts to settle the account with the law firm. The lawsuit was again filed in a parish that I do not reside in. I live in XXXX parish and the suit has been filed in XXXX parish. I have never lived in XXXX parish, do not own property in XXXX parish and do not have any ties to XXXX parish.
I mailed a copy of my answer to XXXX XXXX XXXX that stated the lawsuit was filed in the wrong parish and that XXXX parish did not have jurisdiction over the matter. This was received by the law firm and can be confirmed by tracking number. XXXX XXXXXXXX XXXX then responded to my answer by filing an execution to obtain a judgment, again filed in the wrong parish.
I contacted the XXXX XXXXXXXX XXXX a total of 14 times after I received notice of the court date in the wrong parish and received no resolution from the firm. The clerk of court in XXXX parish said it was the plaintiff 's responsibility to move the venue to the correct parish. The only statement I received from XXXX XXXX XXXX is that " the hearing will proceed. '' I informed the XXXX XXXX XXXX that this is a clear violation of the Fair Debt Collection Practices Act in pursuant with 15 U.S. Code 1692i. The law firm refuses to acknowledge this and is trying to obtain judgment by deceptive practices.

I received a letter from an Attorney on behalf of XXXX XXXX. That is clearly a violation of 15 USC 1692e ( 3 ).
A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section : ( 3 ) The false representation or implication that any individual is an attorney or that any communication is from an attorney.
This is just going to far and XXXX XXXX is becoming a nuisance. I will be filing for default judgement soon as I have all the evidence. Also XXXX XXXX statedbthey would have XXXX attempt to help collect the debt below. That is also another violation of 15 Usc 1692e ( 14 ) ( 14 ) The use of any business, company, or organization name other than the true name of the debt collectors business, company, or organization.
Also XXXX XXXX keeps saying they have validated the debt. All they did was send statements, that is not proper debt validation pursuant to 15 USC 1692g and they never mentioned who the original creditor is which was the consumer.
Pursuant to 15 USC 1611 & 15 USC 1640, XXXX XXXX has civil liabilities and can be held criminally liable.
XXXX XXXX has now incurred over 20 various violations and now this case is now eligible for district court. Will be in contact with the US AG XXXX XXXX.

Someone from this company has called me several times after being told to stop calling. The person then began to use abusive language and call me names that was uncalled for. I'm not a XXXX, XXXX, XXXX, or a XXXX.
This company calls every day. This has stop. The person has even threatened to come to my home. I am in fear for my safety and have alerted my local police.
