The Cadle Company of Ohio was assigned a debt owed to XXXX XXXX XXXX in magistrate court on XX/XX/XXXX in the amount of XXXX. I was co- signer on this account. My husband and I split up in XXXX, were divorced in XXXX. We did not live together or associate during this time. I didnt know anything about this debt. They served someone with a summons on XX/XX/XXXX but it doesnt say who received it. Just that it was served. I have received no communication of any sort from this Cadle company over the XXXX some years it has been owed. Nothing. I am not hard to find. I have lived and worked in the same area for all these years. NO Attempt that Im aware of has been made to contact me. Since the original debt the Cadle company has gone back to the magistrate court and re-filed this debt at the 10 year mark so the statute is limitations wouldnt expire but still no attempt to contact me. So, with that being said, I woke up on XX/XX/XXXX to my XXXXXXXX XXXX account being seized by this Cadle Company in the Amount of XXXXXXXX XXXX XXXXXXXX garnish/levy fee. I didnt have this money in my account so it caused an overdraft in the amount of XXXX because the bank charged it to both of my bank accounts. I have an account with my current husband and an account with my daughter where I am a co-sign because she was under age at the time the account was started. This caused all of the money I had available to be seized XXXX an incoming transactions to be seized. My paycheck, which is heavily relied on by my family to feed us and provide gas for both vehicles, while we wait on my husbands paycheck, was seized. We would have had nothing to eat if it werent for family stepping in to help. Thank XXXX for that. This money continued to be held by XXXX until I contacted a lawyer and they told me what to do to get the money released because it had clearly been seized illegally. XXXXXXXX XXXX did release the hold on my daughters account but they continue to have a hold on mine and my husbands account which makes me XXXX in the negative. I have incurred multiple fees because of this. I cant seem to get any help for this problem and was wondering if I am actually liable for any of this? So my complaint is against The Cadle Company for shady business practices and XXXX for allowing them to do this to my accounts. Also, XXXX was served with this summons against me on XX/XX/XXXX, they had 20 days from the time of the service to respond to the summons but did not do so until XX/XX/XXXX. There answer is clearly dated for XX/XX/XXXX, that is a full 2 months they took to respond. As far as I know, the Cadle company still has not received any money from XXXX on my behalf even though they have clearly been holding my funds for this purpose. Keep in mind I only knew about this whole debt collection after they seized my bank accounts. I just think it is a gross XXXX of business practices. Nothing was done legally and upright.

Cadle co had purchased my loan in XXXX of XXXX. I have been paying them since then. Cadle Co purchased this debt from my previous mortgage co XXXX XXXX. My loan with XXXX XXXX was a 30 year fixed loan ( FHA ). Now that my loan is with Cadle co. this loan is to be paid in 10 years. I just learned this today XX/XX/XXXX via an email response to an offer that I needed to accept for a payment modification. I had to ask several detailed questions to even learn this information because their offer email was very vague. At no point before this was I ever made aware of this 10 year term. In XX/XX/XXXX Cadle co sent me documents about my mortgage payment going up by {$500.00} due to an error/shortage that they just found in my escrow. That payment increase would start in XXXX. Then in XXXX they sent another document about my mortgage payment going up by {$250.00} due to an error/shortage that they just found in my escrow. That payment increase would start in XXXX. In XXXX of XXXX I contacted Cadle co to ask them about re-financing this loan to get a more affordable payment. In an effort get get help with this process I had also reached out to North west counseling services XXXX XXXX XXXX XXXX, XXXX, PA XXXX XXXX ( a company that does housing counseling services ) I was being helped by XXXX XXXX. They in-turn referred me to XXXX XXXX XXXX for the loan Re-Fi. I was dealing with XXXX XXXX XXXX. After 1 Year of Mr. XXXX & Mr. XXXX trying to negotiate a Re-Fi, Cadle Co declined EVERY offer that was made. So in XXXX of XXXX that is when I made my 1st complaint to this office about my issues with Cadle Co. after my complaint Cadle co. reached out to me seaming as though they were trying to help me but really they were not. Since XX/XX/XXXX we ( Cadle Co, my Wife & I ) were corresponding via emails & they asked us to submit some financials. I did as asked. They then sent me & my wife a very intrusive email asking me about my wife 's monthly income, checking her social media & asking questions about things she posts. My wife is not on this loan she is only on the deed. We responded to their questions. Cadle Co then sent an offer a few days later. The offer was very vague and my wife & I had to ask several questions. Cadle co responded to all my questions and that is when I learned that this is not a Traditional 30 year Mortgage, that is a loan that has to be paid in 10 years, the monthly payment is about 95 % interest only & at the end of the 10 years there will be a very large Balloon payment of about XXXX. Cadle co also does not send monthly statements even though I have asked them repeatedly This offer is extremely predatory & aggressive. I am asking that something to be done about this matter. Or that I am pointed in the direction of how to fix this matter.

In XXXX I took out a student loan with XXXX. I did n't repay it properly. In XXXX I entered into a Consent Judgment with them. I did n't repay that properly either. The loan was purchased by The Cadle Company in XXXX. They sent a Demand Letter setting the interest at 6.679 %. In XXXX they applied to renew a default judgment. It was granted XXXX/XXXX/XXXX. It was dismissed, and the case closed XXXX/XXXX/XXXX because of non-service. On XXXX/XXXX/XXXX they filed to reopen the case. It was granted on XXXX/XXXX/XXXX. On XXXX/XXXX/XXXX, XXXX/XXXX/XXXX and XXXX/XXXX/XXXX they refiled applications to renew default judgment. THE JUDGE DID NOT SIGN EITHER OF THE APPLICATIONS OR ORDERS OF JUDGMENT. ALL XXXX APPLICATIONS AND ORDERS ARE WITHOUT A JUDGE 'S OR CLERKS SIGNATURE WHICH RENDER THEM INVALID according to XXXX. In XXXX they brought the XXXX/XXXX/XXXX judgment to the district court and began garnishing me and had retroactively reapplied the interest of 12 % back to XXXX, when they knew that the order had been dismissed and that no subsequent order of judgment had been granted ( The XXXX reads that it was granted, but the actual judgment for XXXX/XXXX/XXXX is unsigned ). They also knew that the interest rate had been set by their prior document at 6.676 and not 12 %. They also knew that they could not retroactively reapply it back to XXXX as that practice had been deemed " deceptive and in violation of FDCPA by the United States District Court ( See XXXX ). The courts are wrongfully allowing these and many other contradictions to the court rules showing bias for the debt collector. On XXXX/XXXX/XXXX the district court allowed them to renew the default judgment ex-parte without meeting any of the specified criteria like attempting to serve me first, etc. Most importantly, they are ignoring that the judgment that they were allegedly renewing was invalid, because it had never been signed by a judge or clerk. I know that it is also against federal law for them to collect on an invalid judgment and to fraudulently manipulate the interest. I hope that you will act to see that this invalid judgment is set aside.

My husband and I Applied for Home modification around XX/XX/XXXX. When the modification was approved the mortgage payment went from {$1600.00} to {$2100.00} adding an extra {$520.00} and still remains the same currently. In XX/XX/XXXX our mortgage was sold to a debt collection agency & not a real mortgage company. This company does not report to the credit bureaus or give monthly statements. In XX/XX/XXXX my husband and I tried to refi the home so that we could get a better mortgage rate and monthly payment but our current mortgage company has been adding on extra unexplained fees & adding extra Interest from a previous modification ( XXXX ) before my account was even with their company of XXXX. XX/XX/XXXX my home was appraised for XXXX. My loan balance with my current ( mortgage co ) / debt collector is over XXXX. The company that I contacted to try to RE-FI my home with could not help me. They said that the current mortgage company wants to refi the home at appraisal price but they still want the interest to be added as a second mortgage at the same time. As of XX/XX/XXXX I received a letter from my current mortgage company/debt collector stating that starting in XX/XX/XXXX my payment will be XXXX. More unexplained fees. At this point my husband I cant afford to pay these amounts & we feel that this a predatory loan situation. Please help us resolve this matter & save our home. Lastly my current mortgage company/debt collector offered me XXXX to sign a mortgage document that was not signed when my husband & I originally went to closing in XXXX.

On XX/XX/XXXX, I applied for a loan modification due to me getting XXXX and lost my job. I applied for a loan modification through the current mortgage XXXX Mortgage. I was on track for a modification through XXXX mortgage. XXXX Mortgage sold/transferred my mortgage to the Cadle Company on or about XX/XX/XXXX. I made contact with Cadle Companys representative, XXXX XXXX and XXXX XXXX told me that they are not under obligation to continue the loan modification. XXXX XXXX has told me that the XXXX XXXX for XXXX does not apply to the Cadle Company XXXX I have further researched the Cadle Company and have learned that they are a debt collector not a mortgage servicer. The previous mortgage company has sent the entire loan modification file to the Cadle company that includes my application for a loan modification. I have also sent the Cadle company a copy of the application that XXXX mortgage had sent to them during the transfer. The Cadle Company has not honored the modification and denied my assistance. I applied with NM XXXX for assistance in catching up with the arrears and the Cadle Company has been paid of {$20000.00} to help catch up on my payments. To date, I have had no luck with the Cadle Company completing the loan modification.

The Cadle Company, Assignee of XXXX XXXX, XXXX Assignee of XXXX XXXX XXXX XXXX, placed a wage garnishment on my salary, without appropriate notification. Furthermore, I did not open an account with XXXX XXXX XXXX, which is now owned by XXXX. My identity was compromised and my social security number was used to fraudulently to open numerous accounts. I was initially sued in 2008, while away at training for the XXXX XXXX XXXX XXXX. I was not able to defend myself for this allegation of owning money to this company. I was also never given the chance to dispute the validity of this account. They are required by law to produce documents, such as the original agreement. I spoke to XXXX XXXX at the Cadle Company and she was very rude and would not provide any information on rectifying this situation.
