15 U.S. Code 6803 - Disclosure of institution privacy policy U.S. Code Notes prev | next ( a ) Disclosure required At the time of establishing a customer relationship with a consumer and not less than annually during the continuation of such relationship, a financial institution shall provide a clear and conspicuous disclosure to such consumer, in writing or in electronic form or other form permitted by the regulations prescribed under section 6804 of this title, of such financial institutions policies and practices with respect to ( 1 ) disclosing nonpublic personal information to affiliates and nonaffiliated third parties, consistent with section 6802 of this title, including the categories of information that may be disclosed ; ( 2 ) disclosing nonpublic personal information of persons who have ceased to be customers of the financial institution ; and ( 3 ) protecting the nonpublic personal information of consumers. ( b ) Regulations Disclosures required by subsection ( a ) shall be made in accordance with the regulations prescribed under section 6804 of this title. ( c ) Information to be included The disclosure required by subsection ( a ) shall include ( 1 ) the policies and practices of the institution with respect to disclosing nonpublic personal information to nonaffiliated third parties, other than agents of the institution, consistent with section 6802 of this title, and including ( A ) the categories of persons to whom the information is or may be disclosed, other than the persons to whom the information may be provided pursuant to section 6802 ( e ) of this title ; and ( B ) the policies and practices of the institution with respect to disclosing of nonpublic personal information of persons who have ceased to be customers of the financial institution ; ( 2 ) the categories of nonpublic personal information that are collected by the financial institution ; ( 3 ) the policies that the institution maintains to protect the confidentiality and security of nonpublic personal information in accordance with section 6801 of this title ; and ( 4 ) the disclosures required, if any, under section 1681a ( d ) ( 2 ) ( A ) ( iii ) of this title. ( d ) Exemption for certified public accountants ( 1 ) In general The disclosure requirements of subsection ( a ) do not apply to any person, to the extent that the person is ( A ) a certified public accountant ; ( B ) certified or licensed for such purpose by a State ; and ( C ) subject to any provision of law, rule, or regulation issued by a legislative or regulatory body of the State, including rules of professional conduct or ethics, that prohibits disclosure of nonpublic personal information without the knowing and expressed consent of the consumer. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system. ( 2 ) An elaborate mechanism has been developed for investigating and evaluating the credit worthiness, credit standing, credit capacity, character, and general reputation of consumers. ( 3 ) Consumer reporting agencies have assumed a vital role in assembling and evaluating consumer credit and other information on consumers. ( 4 ) There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. ( b ) Reasonable procedures It is the purpose of this subchapter to require that consumer reporting agencies adopt reasonable procedures for meeting the needs of commerce for consumer credit, personnel, insurance, and other information in a manner which is fair and equitable to the consumer, with regard to the confidentiality, accuracy, relevancy, and proper utilization of such information in accordance with the requirements of this subchapter. Legally, the right of privacy is a basic law which includes : The right of persons to be free from unwarranted publicity. Unwarranted appropriation of one 's personality. Publicizing one 's private affairs without a legitimate public concern. 15 U.S. Code 1681i - Procedure in case of disputed accuracy U.S. Code Notes prev | next ( a ) Reinvestigations of disputed information ( 1 ) Reinvestigation required ( A ) In general Subject to subsection ( f ) and except as provided in subsection ( g ), if the completeness or accuracy of any item of information contained in a consumers file at a consumer reporting agency is disputed by the consumer and the consumer notifies the agency directly, or indirectly through a reseller, of such dispute, the agency shall, free of charge, conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the current status of the disputed information, or delete the item from the file in accordance with paragraph ( 5 ), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller. ( B ) Extension of period to reinvestigate Except as provided in subparagraph ( C ), the 30-day period described in subparagraph ( A ) may be extended for not more than 15 additional days if the consumer reporting agency receives information from the consumer during that 30-day period that is relevant to the reinvestigation. ( C ) Limitations on extension of period to reinvestigate Subparagraph ( B ) shall not apply to any reinvestigation in which, during the 30-day period described in subparagraph ( A ), the information that is the subject of the reinvestigation is found to be inaccurate or incomplete or the consumer reporting agency determines that the information can not be verified. ( 2 ) Prompt notice of dispute to furnisher of information ( A ) In general Before the expiration of the 5-business-day period beginning on the date on which a consumer reporting agency receives notice of a dispute from any consumer or a reseller in accordance with paragraph ( 1 ), the agency shall provide notification of the dispute to any person who provided any item of information in dispute, at the address and in the manner established with the person. The notice shall include all relevant information regarding the dispute that the agency has received from the consumer or reseller. ( B ) Provision of other information The consumer reporting agency shall promptly provide to the person who provided the information in dispute all relevant information regarding the dispute that is received by the agency from the consumer or the reseller after the period referred to in subparagraph ( A ) and before the end of the period referred to in paragraph ( 1 ) ( A ). ( 3 ) Determination that dispute is frivolous or irrelevant ( A ) In general Notwithstanding paragraph ( 1 ), a consumer reporting agency may terminate a reinvestigation of information disputed by a consumer under that paragraph if the agency reasonably determines that the dispute by the consumer is frivolous or irrelevant, including by reason of a failure by a consumer to provide sufficient information to investigate the disputed information. ( B ) Notice of determination Upon making any determination in accordance with subparagraph ( A ) that a dispute is frivolous or irrelevant, a consumer reporting agency shall notify the consumer of such determination not later than 5 business days after making such determination, by mail or, if authorized by the consumer for that purpose, by any other means available to the agency. ( C ) Contents of notice A notice under subparagraph ( B ) shall include ( i ) the reasons for the determination under subparagraph ( A ) ; and ( ii ) identification of any information required to investigate the disputed information, which may consist of a standardized form describing the general nature of such information. ( 4 ) Consideration of consumer information In conducting any reinvestigation under paragraph ( 1 ) with respect to disputed information in the file of any consumer, the consumer reporting agency shall review and consider all relevant information submitted by the consumer in the period described in paragraph ( 1 ) ( A ) with respect to such disputed information. ( 5 ) Treatment of inaccurate or unverifiable information ( A ) In general If, after any reinvestigation under paragraph ( 1 ) of any information disputed by a consumer, an item of the information is found to be inaccurate or incomplete or can not be verified, the consumer reporting agency shall ( i ) promptly delete that item of information from the file of the consumer, or modify that item of information, as appropriate, based on the results of the reinvestigation; and ( ii ) promptly notify the furnisher of that information that the information has been modified or deleted from the file of the consumer. ( B ) Requirements relating to reinsertion of previously deleted material ( i ) Certification of accuracy of information If any information is deleted from a consumers file pursuant to subparagraph ( A ), the information may not be reinserted in the file by the consumer reporting agency unless the person who furnishes the information certifies that the information is complete and accurate. ( ii ) Notice to consumer If any information that has been deleted from a consumers file pursuant to subparagraph ( A ) is reinserted in the file, the consumer reporting agency shall notify the consumer of the reinsertion in writing not later than 5 business days after the reinsertion or, if authorized by the consumer for that purpose, by any other means available to the agency. ( iii ) Additional information As part of, or in addition to, the notice under clause ( ii ), a consumer reporting agency shall provide to a consumer in writing not later than 5 business days after the date of the reinsertion ( I ) a statement that the disputed information has been reinserted ; ( II ) the business name and address of any furnisher of information contacted and the telephone number of such furnisher, if reasonably available, or of any furnisher of information that contacted the consumer reporting agency, in connection with the reinsertion of such information ; and ( III ) a notice that the consumer has the right to add a statement to the consumers file disputing the accuracy or completeness of the disputed information. ( C ) Procedures to prevent reappearance A consumer reporting agency shall maintain reasonable procedures designed to prevent the reappearance in a consumers file, and in consumer reports on the consumer, of information that is deleted pursuant to this paragraph ( other than information that is reinserted in accordance with subparagraph ( B ) ( i ) ). ( D ) Automated reinvestigation system Any consumer reporting agency that compiles and maintains files on consumers on a nationwide basis shall implement an automated system through which furnishers of information to that consumer reporting agency may report the results of a reinvestigation that finds incomplete or inaccurate information in a consumers file to other such consumer reporting agencies. ( 6 ) Notice of results of reinvestigation ( A ) In general A consumer reporting agency shall provide written notice to a consumer of the results of a reinvestigation under this subsection not later than 5 business days after the completion of the reinvestigation, by mail or, if authorized by the consumer for that purpose, by other means available to the agency. ( B ) Contents As part of, or in addition to, the notice under subparagraph ( A ), a consumer reporting agency shall provide to a consumer in writing before the expiration of the 5-day period referred to in subparagraph ( A ) ( i ) a statement that the reinvestigation is completed ; ( ii ) a consumer report that is based upon the consumers file as that file is revised as a result of the reinvestigation ; ( iii ) a notice that, if requested by the consumer, a description of the procedure used to determine the accuracy and completeness of the information shall be provided to the consumer by the agency, including the business name and address of any furnisher of information contacted in connection with such information and the telephone number of such furnisher, if reasonably available ; ( iv ) a notice that the consumer has the right to add a statement to the consumers file disputing the accuracy or completeness of the information ; and ( v ) a notice that the consumer has the right to request under subsection ( d ) that the consumer reporting agency furnish notifications under that subsection. ( 7 ) Description of reinvestigation procedure A consumer reporting agency shall provide to a consumer a description referred to in paragraph ( 6 ) ( B ) ( iii ) by not later than 15 days after receiving a request from the consumer for that description. ( 8 ) Expedited dispute resolution If a dispute regarding an item of information in a consumers file at a consumer reporting agency is resolved in accordance with paragraph ( 5 ) ( A ) by the deletion of the disputed information by not later than 3 business days after the date on which the agency receives notice of the dispute from the consumer in accordance with paragraph ( 1 ) ( A ), then the agency shall not be required to comply with paragraphs ( 2 ), ( 6 ), and ( 7 ) with respect to that dispute if the agency ( A ) provides prompt notice of the deletion to the consumer by telephone ; ( B ) includes in that notice, or in a written notice that accompanies a confirmation and consumer report provided in accordance with subparagraph ( C ), a statement of the consumers right to request under subsection ( d ) that the agency furnish notifications under that subsection ; and ( C ) provides written confirmation of the deletion and a copy of a consumer report on the consumer that is based on the consumers file after the deletion, not later than 5 business days after making the deletion. ( b ) Statement of dispute If the reinvestigation does not resolve the dispute, the consumer may file a brief statement setting forth the nature of the dispute. The consumer reporting agency may limit such statements to not more than one hundred words if it provides the consumer with assistance in writing a clear summary of the dispute. ( c ) Notification of consumer dispute in subsequent consumer reports Whenever a statement of a dispute is filed, unless there is reasonable grounds to believe that it is frivolous or irrelevant, the consumer reporting agency shall, in any subsequent consumer report containing the information in question, clearly note that it is disputed by the consumer and provide either the consumers statement or a clear and accurate codification or summary thereof. ( d ) Notification of deletion of disputed information Following any deletion of information which is found to be inaccurate or whose accuracy can no longer be verified or any notation as to disputed information, the consumer reporting agency shall, at the request of the consumer, furnish notification that the item has been deleted or the statement, codification or summary pursuant to subsection ( b ) or ( c ) to any person specifically designated by the consumer who has within two years prior thereto received a consumer report for employment purposes, or within six months prior thereto received a consumer report for any other purpose, which contained the deleted or disputed information. ( e ) Treatment of complaints and report to Congress ( 1 ) In general The Commission [ 1 ] shall ( A ) compile all complaints that it receives that a file of a consumer that is maintained by a consumer reporting agency described in section 1681a ( p ) of this title contains incomplete or inaccurate information, with respect to which, the consumer appears to have disputed the completeness or accuracy with the consumer reporting agency or otherwise utilized the procedures provided by subsection ( a ) ; and ( B ) transmit each such complaint to each consumer reporting agency involved. ( 2 ) Exclusion Complaints received or obtained by the Bureau pursuant to its investigative authority under the Consumer Financial Protection Act of 2010 shall not be subject to paragraph ( 1 ). ( 3 ) Agency responsibilities Each consumer reporting agency described in section 1681a ( p ) of this title that receives a complaint transmitted by the Bureau pursuant to paragraph ( 1 ) shall ( A ) review each such complaint to determine whether all legal obligations imposed on the consumer reporting agency under this subchapter ( including any obligation imposed by an applicable court or administrative order ) have been met with respect to the subject matter of the complaint ; ( B ) provide reports on a regular basis to the Bureau regarding the determinations of and actions taken by the consumer reporting agency, if any, in connection with its review of such complaints ; and ( C ) maintain, for a reasonable time period, records regarding the disposition of each such complaint that is sufficient to demonstrate compliance with this subsection. ( 4 ) Rulemaking authority The Commission1 may prescribe regulations, as appropriate to implement this subsection

I contacted Extra on XXXX XXXX XXXX via email because just to find out who a certain merchant was. " Extra Bot '' answered and I asked to speak with a human person, no response. On XX/XX/XXXX at XXXX I contacted Extra via phone in an attempt to speak to a human. I left a message both times and was never given a call back. XXXX XXXX, from Extra emailed me back on XX/XX/XXXX I then expressed to him that I " just wanted to know the name of the merchant on my account ''. Just the name of the company. On XX/XX/XXXX and after multiple emails, I was finally was given the name of the company, XXXX XXXX XXXX. I did make the charges and use XXXX XXXX very frequent so I did not want to pursue anything further. On XX/XX/XXXX Extra deposited {$2200.00} into my bank account. Extra reversed charges from XXXX XXXX with out my permission and deposited it into my account! Once I was made aware of this transaction I contacted XXXX XXXX and demand that I speak to an actual person about the issue on XX/XX/XXXX but was never contacted. XX/XX/XXXX, XXXX from extra contacted me via email and did not understand that I did not approve or give permission to do a reversal or pursue anything. I informed them that I will deal with XXXX XXXX personally. On XX/XX/XXXX, Extra then attempted, with out my permission, to withdraw the {$2200.00} from my personal bank account. There is over 50+ emails between XX/XX/XXXX and XX/XX/XXXX, with multiple agents. In every email I stated that I wanted to speak to someone on the phone and that my account needed to be closed immediately. I was never contacted and my account was not closed when I asked. From XX/XX/XXXX to XX/XX/XXXX my multiple request for my account to immediately closed was ignored and I was still being charged fees until XX/XX/XXXX. On XX/XX/XXXX I found out that Extra had reported a negative mark on my credit report, ( XXXX ). I did not charge the {$2200.00}, it was the mistake of Extra and I do not owe them I owe XXXX XXXX. They have no legal right to report their mistake on my credit report. The Fair Credit Reporting Act ( FCRA ) says that consumer reporting agencies, like XXXX, must handle their responsibilities fairly, impartially, and with respect for consumers ' privacy. I'm the consumer here, and I have the right to make sure my private information isn't shared. This right is supported by another law, 15 USC 6801, which states that financial institutions must always respect their customers ' privacy and protect their personal information. EXTRA, who provided this information to the credit agencies, known as " furnishers of information, '' are considered financial institutions under this law. According to 15 USC 1681 section 604, a consumer reporting agency can only share a report about me if I specifically tell them to, in writing. However, neither EXTRA nor the consumer reporting agencies, like XXXX, have my permission or written consent to share this information. I'm revoking any consent I may have given, whether it was verbal, non-verbal, written, or implied. According to 15 USC 6802 ( b ) ( c ), a financial institution can't share my private information with outside parties unless they explain to me how I can choose not to allow it. EXTRA nor XXXX didn't inform me about this right. Additionally, 15 USC 1681C ( a ) ( 5 ) says that consumer reporting agencies can't include certain negative information in a report without permission. EXTRA and XXXX are doing so without my consent, which is against the law. Under 15 U.S. Code 1681s2 ( A ) ( 1 ) ( A ), it's illegal for anyone to provide inaccurate information to a consumer reporting agency knowingly or if they have a good reason to believe it's inaccurate. XXXX is violating this provision. Moreover, 15 U.S. Code 1681e requires consumer reporting agencies to have reasonable procedures to avoid breaking the law and to limit the sharing of consumer reports to specific purposes. It's clear that XXXX is not following these reasonable procedures. Finally, according to 12 CFR 1016.7, I have the right to opt out of your reporting services at any time. Given the violations and disregard for my rights mentioned above, I am choosing to opt out of your reporting services in the reporting of EXTRA

I reached out to file a dispute on XX/XX/XXXX about clothes that were sent in the incorrect size and was told a dispute will be filed. I followed up and was told I would hear back but did not. I had to file an additional dispute on XX/XX/XXXX about a defective item that the merchant wouldn't accept a return for as the merchant wanted to keep troubleshooting it. I was able to finally get information on XX/XX/XXXX that it had actually not been filed as they had reached out to me for additional information, which I had not received. I sent the information and it was finally filed as of XX/XX/XXXX. On XX/XX/XXXX, I was advised the dispute had been resolved in the merchant 's favor. When I asked for the documentation, it was just documentation showing the merchandise had been delivered. I then discovered that on their dispute, they listed it as " XXXX not received as promised. '' I asked to appeal the determination as I had never said the merchandise was not delivered, but that it was incorrect and defective. They declined and then stated that they were able to properly state it wasn't received. When I asked about how that was appropriate for it to just require delivery and the merchant should have to provide proof that it was the correct size and not defective, I was told that their decision was final and they followed the CFPB regulations 1005. I advised them that they had broken their policy of provisional credit if not resolved in 10 business days, which I learned once sent the link that it was actually a regulation. They took 65 days to complete the investigation and never issued a provisional credit.

RE : XXXX ; XXXX, Extra ; Account # XXXX Per the FCRA, as a federally protected consumer I have never received notice nor any disclosure to opt out per 15 USC 6802. Also, as a federally protected consumer I have never received any disclosure on XXXX, XXXX nor EXTRA privacy policy disclosing of the sharing of any private and personal information per 15 USC 6803. Furthermore, Per the FCRA, as a federally protected consumer I am now opting out of any and all authorization, I the consumer may have given you whether written, unwritten, verbal, and non-verbal per the rule making of 15 USC 6804 and the enforcement per 15 USC 6805. Per the privacy act of 1974, the financial institution EXTRA violated their terms and conditions against me as they promised not to share my banking, personal, and private information with non-affiliates. I am demanding that each party included in this letter provide proof of this authorization to have and share my information. The credit agencies keep stating the bank gave them authorization to have information, but my institution says they dont give it to non-affiliates. Lastly, this account is reporting inaccurately across all credit agencies and needs to be updated immediately to paid as agreed reflect all payments made on time to be accurate. Per the FCRA a report containing information between a consumer and the person making the report is excluded per 15 USC 1681a ( 2 ) ( A ) ( i ) I am seeking compensation for these violations and damage that has caused me great hardship in life and for the account to be updated as paid as agreed. When I open this account on XX/XX/2021, I was told this is a debit card with a checking account, and it does not require any credit check. I closed this account 2 months after opening it. However, this debit card is shown as credit card and is still in open status today. I contact the company customer service, they again assured me it is a debit card, not a credit card. And in their current website, they still advertise it as 'debit card ' in a misleading way. I am currently applying for XXXX business account and get declined for the reason 'Number of recently opened accounts on credit report ' because XXXX view this 'debit card ' as a credit card. After reporting this issue to Extra, extra 's internal team admit there's a mistake for my account, but extra refused to help me fix it by removing this account from my XXXX credit report. Although Extra keeps assuring me that this is a debit card, not a credit card, but it is actually listed as credit card in credit bureau 's report and affect my life unknowingly during past 2 years. EXTRA is intentionally misleading its customers by advertising a credit card as debit card/checking account, and it is against my will to open a credit card. For me, it really feels like a scam, and all I am requesting is remove it from my credit report so it will not affect my life in the future.

I signed up for a company called EXTRA and their debit card program which said that it will help to build credit as we do transactions from their card. I created an account and signed up and sent in an application. First of all the application process took more than 3 months. After that the card never arrived. They said some documents had been pending and I will have to submit them through their application. Which I did. The documents then are in the review and its been more than a month the documents are in review. When I speak to the customer service they say that they did not receive the documents and ask me to submit. There is no place to submit the documents through the app and they insist. This way I have been going back and forth for more than 1 month now. Moreover all this time they are still debiting the fees from my account as it is automatically linked. It is a mess. I have asked them to cancel my card but that is also pending as they have to get the documents. The company says that there is a technical problem and their technical team is working to solve it. This is also going on for a week. I am so irritated. This company seems like a fraud. They clearly mentioned they will not charge any fees but they are charging. Please help me.

I purchased it on XXXX using my XXXX card. Within minutes I canceled that purchase meaning no item would be delivered or charged on my account. Unfortunately, a charge was placed on my XXXX card. That card is linked to my debit account. As stated on the XXXX site under the refund it shows that the refund went to my XXXX card and shows the last 4 numbers. The company, XXXX is stating I owe them {$67.00} for purchase but I already showed them transactions of the refund being sent to them and the purchase is canceled. I have no connection and am locked from all services and functions from my XXXX account but continue to be charged a monthly membership when I can use any services. They made a report on my credit for money owed. Ive spoken to 3 separate reps they all keep telling me I owe without any phone conversation and explaining how. I used their credit card and XXXX shows the refund went to their credit card but theyre insisting I pay them from my bank account linked. They are a finance app in the apple app store.

There is an account on my credit report Extra that does not belong to me. I contacted the credit bureau XXXX with a dispute. They supposedly investigated and the company told them it was my account w/o any proof. I called XXXX and was told that my next step would be to file a complaint with the FTC. This Extra account started showing up on my credit report in XX/XX/XXXX with a XXXX balance but since XX/XX/XXXX it shows a balance of {$25.00}. Im concerned about this fraudulent account that somebody is trying to get loans in my name. This is NOT my account. I tried to contact Extra. On XXXX XXXX I disputed a charge with XXXX for {$120.00} dollar payment my bank XXXX XXXX stopped when I had available funds. I disputed this claim also because I dont recall making a purchase at XXXX for this amount which I stated to the representative. I sent a letter via certified mail showing I had available funds and this was a bank error. XXXX XXXX representative told me on a recorded line that XXXX received a payment of {$110.00} and a payment of {$120.00}. Then another XXXX XXXX representative told me on a recorded line that the payment of {$120.00} processed only. Either way I disputed this claim I do not recall making it. I payed them in full for everything I allegedly owe and want this removed due to miscommunication with my bank. And if I disputed this claim on XXXX XXXX how is it 30 days late on my credit report?

I was using a credit building app that links a secured credit card to your bank account, so you could only spend money that you have. I was trying to access the credit monitoring fubction of the app. So I inputted my personal details like name, DOB, SS #, etc. After that I was met with questions about my credit history from years ago, with the earliesr being from 2018.
