A man by the name of XXXX XXXX XXXX came out to my home on several occasions. On every date that he came to my home he NEVER came serving a LAWFUL Eviction Notice that was certified by a COURT OF COMPETENT JURISDICTION and a NOTORIZED BY AN OFFICIAL NOTORY PUBLIC. On XX/XX/XXXX ( although its dated XX/XX/XXXX ) a door hanger was left on the door which stated the following ; Date XX/XX/XXXX IMPORTANT PLEASE CALL Third Federal Savings and Loan Association of Cleveland XXXX PLEASE BE READY TO GIVE YOUR NAME & ADDRESS OF PROPERTY WE ARE EXPECTING YOUR CALL TODAY *If you are currently a debtor in bankruptcy under any chapter of the Bankruptcy Code or if you have previously discharged your obligation to Third Federal Saving and Loan Association in a prior bankruptcy proceeding, this notice shall not be construed as an attempt to collect a debt. On XX/XX/XXXX XXXX XXXX XXXX came out with 3 other men ; one identified himself as Deputy XXXX. The other men did not have badges and have not been identified at this point in time. At least three of the men had guns. Given there has never been a lawful eviction notice and two of the men present have not been identified and entered my home with guns this is actually a Armed Burglary/Home Invasion/Tress pass The Victim of this Armed Burglary/Forced Home Invasion/Trespass signed an affidavit attesting to the events that occurred on XX/XX/XXXX. She has been traumatized and has not return to live in the home due to fear. A second witness was present on XX/XX/XXXX and completed an affidavit. He witnessed the event when the four men entered the home and documented what he remembered. He stated that they were in plain clothes and unmarked cars. He stated that they were taking pictures of every room of the house. He questioned whether they were going to set my belonging out on the street and they informed him I have 72 hours to respond to this. On XX/XX/XXXX I was called by the father of the victim who had the guns pointed at her. I left work immediately when I received notification of the Armed Burglary/Forced Home Invasion/Trespass. When I arrived, a man who identified himself as Deputy XXXX was in my driveway in an unmarked car. He was wearing tan khaki pants and a black shirt. I asked him who he was. He stated his name was Deputy XXXX. He informed me that I had to be out of the house. I informed that I never went through federal court. He stated something to the effect that I had until XX/XX/XXXX to be out of the house. I informed him that the process was not lawful and he would need to go through a court of competent jurisdiction. When I asked to see any official paperwork or identification he backed out of the driveway and drove away. The locks were changed in both the front, back and garage doors. The garage door opener was disengaged and a lock was placed on it as well. In addition they cut the main water valve off. Without a lawful eviction, these are all criminal violations.

I learned through research that certain disclosures where to provided when you purchase a home. I learned of this information from several sources including the Supreme Court Case No : XXXX XXXX XXXX XXXX and XXXX XXXX v XXXX XXXX. It is to my understanding that if you never received certain disclosures you had a right of rescission. I exercised this right by sending a notice of rescission to the CEO, XXXX XXXX XXXX and CFO XXXX XXXX XXXX of Third Federal Savings & Loan on XXXX XXXX, XXXX. This notice was sent Certified Mail and I has it was also notarized. On XXXX XXXX, XXXX at XXXX XXXX I missed a phone call. I returned the call at exactly XXXX XXXX I spoke with someone, who I believe was named XXXX and identified himself as some type of analyst. He informed me that he received the notice of recession and that it was invalid because it was beyond 3 days. I informed that he was incorrect and that was not what the Supreme Court stated. He then stated that some attorney looked over it and had come to that conclusion. I asked him when he came to that decision and I believe he said several days ago. I asked why I have not received anything on this decision since he made the decision several days ago..He called back at two other times once at XXXX XXXX and another time at XXXX XXXX on XXXX XXXX. He stated I should be receiving something from the attorney. On XXXX XXXX, XXXX I received a letter from XXXX XXXX. On the top of the letter it states XXXX, XXXX, XXXX, XXXX XXXX XXXX however on the bottom it states in all capital letters and bold print " THIS MESSAGE IS FROM A DEBT COLLECTOR ATTEMPTING TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. " In the letter it states Third Federal of XXXX ( Third Federal ) received my XXXX XXXX, XXXX letter claiming right to rescind the loan and retained our law firm to respond. It stated that Third Federal would not honor my request because it was invalid. It stated I had no right to rescind a loan to purchase real property. It stated I used the fund loaned to you by Third Federal to purchase the property secured by the mortgage so you do n't have a right to rescin and that the mortgage was signed in XXXX so even if it was covered under the Truth in Lending Act ( TILA ) right of rescission would be outside TILA statute of limitations. It also stated the right to rescind expires in 3 business days after the loan documents are signed and if extended for 3 years if the lender failed to provide necessary disclosures. In addition it stated that since the loan is a purchase money loan and even if it was covered by TILA 's you claim would be barred by TILA 's statute of limitations. It then states your claim for rescission is rejected. It is my understanding that a 3rd party debt collector can not make this determination. In response, I sent a letter back certified mail on XXXX XXXX, XXXX stating that he was in no position to make this determination as a 3rd party debt collector. I then sent a Notice and Demand to Validate the Debt in this same letter. I received a letter back on XXXX XXXX, XXXX from XXXX XXXX. It stated the following " To reiterate, you request for a loan rescission will not be honored by Third Federal Savings and Loan Association of XXXX for the reasons set forth in my letter dated XXXX XXXX, XXXX. '' It also stated " Though my letter to you identified our law firm as a debt collector, my letter to you was neither a demand for payment nor an attempt to collect a debt, so your dispute does not trigger an obligation to validate the debt. He then stated that the purpose of the letter was to inform your rescission claim is baseless, and, that, therefore, the rescission request would not be honored. Since Third Federal has not responded directly I am confused and worried and do n't know what to do.

The United States of America Federal Consumer Officer, XXXX XXXX XXXX In the Matter of : JUDGEMENT ORDER Third Federal Savings and Loan Association.

I have reviewed the conduct and behavior of Third Federal Savings and Loan Association and have identified the following law violations ; 15 USC 1692 ( c ) Communication without prior consent of the consumer, 15 USC 1692 ( d ) Harassment or Abuse, 15 USC 1692 ( k ) False or Misleading Representation, 15 USC 1692 ( f ) Unfair Practices, 15 USC 1692 ( j ) Furnishing certain deceptive forms, 15 USC 1692 ( h ) Multiple Debts, 15 USC 1692 ( n ) Relation to State Law, Pub. L. 114-38. Public Law for the Current Congress, Third Federal Savings and Loan Associates and it collaborators failed to uphold their sworn oath to the Constitution of the United States of America and provide services that are equitable, fair and in the best interest of me, the consumer. A lawful rescission was ignored and Third Federal Savings and Loan Association failed to contest the rescission by filing a suit in court of competent jurisdiction. As opposed to following the law established to contest the rescission ; Third Federal Saving and Loans Associates engaged in piracy through identity theft, larceny, embezzlement and the foliaging of consumer accounts. They colluded and collaborated with third parties by designing, compiling and furnishing unauthorized explosive weapons ; such as fraudulent securities and fictitious paperwork in order to economically destabilize my personal, family and household structure. These fraudulent securities were created in order launder taxes ; extort personal property and unlawfully convert assets by conversion over to unauthorized third parties. By diverting their tax liability to a nontaxable consumer credit transaction, they are guilty of fraud and tax evasion. If the intimidation was not successful from the paperwork ; domestic violence was implemented in the form of physical threats, harassment and abusive behaviors from third parties. These tactics were deployed in order to increase the severity of the abuse in a effort to scare me into compliance. Third Federal Savings and Loan Associates along with their collaborators wanted to create an ILLUSION to the public that this strategically designed organized criminal system was crafted in compliance with the LAW, when in reality it is a form of terrorism and a menace to Consumers and The People of the United States of America. Without my prior consent and in violation of 15 USC 1692 ( e ) ( a ) my personal and private information has been used in unlawful and fraudulent transactions and transferred to ; The Clerk of Courts of XXXX County Court of Common Pleas, XXXX County Sheriff Department, XXXX XXXX XXXX, and many other Third Parties listed below as violators. All of the above entities have violated their Constitutional Oath to the United States of America and have committed perjury by aiding and abetting the enemy. Third Federal Savings and Loan Associates and their collaborators changed the character of my consumer credit transaction and converted it into a commercial transaction which would ultimately be unlawfully traded on Wall Street. The Constitution of the United States of America, Consumer Protection Laws, Fair Credit Reporting Act and the Truth in Lending Act which have been established and put in place for me the Consumer to participate in International, Interstate, and Foreign Trade for the benefit of my personal, family and household stability has been ignored, neglected and disregarded by service providers and third parties who are nothing more than debt collectors. Control methods must be implemented immediately in order to manage and combat the violent assault being wielded by these invasive species.

READ Entire Dispute attached XXXX XXXX, 2016 Third Federal -Request for Original Loan Level Documentation to CFPB Entire Dispute On XXXX XXXX, 2016 at approximately XXXX I went to the Third Federal Savings and Loan, located at XXXX XXXX, in XXXX , Ohio XXXX. I requested to speak with the person who was in charge with running the branch. I was directed to speak with XXXX XXXX ( XXXX # XXXX ). I informed her that I had some concerns. I requested the status of the loan which was associated with my name. I provided her with the following Loan # XXXX. She informed me that the loan was in Default Services. I asked her how it could be in default services when the loan was rescinded. I informed her that I ran my credit report and it showed there was a XXXX balance associated with the loan. She stated that she was unfamiliar with a Rescission. I informed her that she needed to read the XXXX vs.XXXX case and any of the the AMICUS briefs pertaining to rescission. I informed her that I read them all. I then asked her where the payments went that were previously paid toward this loan. She informed me that that Third Federal receives the payments. I then asked what accounts the payment are deposited into. She again informed me that the payments are made to Third Federal Savings and Loan in XXXX Ohio. I asked her what man or woman is actually receiving the payments. She again informed me that it was Third Federal. I told her Third federal is an entity. I then asked her that if I was going to sue someone, I am quite certain that Third Federal ( the building ) would not be able to come into court. I asked her who would show up in court. She than stated that Third Federal Savings and Loan is made up of a Board of Directors. She than began to type some information into the system. She stated something about payments. I then asked her if there were any payment made into escrow. She pulled up some information in the system and asked me when I sent in the rescission. I stated around XXXX. I informed her that if she does not have any record that the loan was rescinded I could get someone from the Consumer Financial Protection Board to confirm that it was rescinded. The complaint # is # XXXX filed XXXX ( OMB # XXXX ). I also pulled out the Settlement Statements. I received one at closing with page XXXX cut off from line item XXXX down.When I received the Settlement Statement from XXXX XXXX included lines XXXX down however they were not in numerical order. It went from line item XXXX to XXXX. It skipped lines XXXX-through XXXX in the column on the LEFT side. In the column on the RIGHT side it skipped line items XXXX through XXXX ). The skipping of line items also occurred throughout the entire settlement statement. It appears to be manipulation and possible falsification of the documentation. Her next statement startled me. She stated " What do you want me to do cut a check. '' I was surprised she made such a statement. I did not respond to the question. She stated that she would get someone from Third Federal Savings and Loan in XXXX on the phone that could better assist me. She connected me to XXXX XXXX, Legal Analyst in Default Servicing -Legal. I had an interaction with him in the past. He responded to a letter that I sent to Third Federal requesting information on who created the Addendum to the HUD-1 Settlement Statement, Escrow NO ; XXXX, and for what purpose. He stated it was created and compiled by Esquire Title so the parties involved can acknowledge receipt and review of the HUD-1 Settlement Statement. I presented XXXX XXXX with the same question as XXXX XXXX. He informed me that I owe XXXX to Third Federal Savings and Loan and he asked me why I felt like I did not owe it. The applicant alleges, Third Federal deliberately, with intent, determined the applicants application as insufficient, and never requested clarification, or independent verification of any of the criteria used in the declination, refusal of credit. Initial review included a credit check. The credit check was run upon checking the box, in the online application. The credit profile was available almost immediately, the day of application, XXXX XX/XX/XXXX. Yet, they waited until Wednesday XXXX XX/XX/XXXX to call me and indicate they could not move forward with my request and created a letter-communication based off the initial contact ( XXXX XX/XX/XXXX ), with insufficient information, based on a cursory review of the applicant 's age, race, gender and automated underwriting determinations. Third Federal never said the applicant didn't qualify for a loan, they said : she didn't qualify for the product requested, two very different things. Further, FACTORS AFFECTING THE XXXXREDIT SCORE : FALSE AND MISLEADING Medical Bills ... seasoned 3-5 years Number of accounts with delinquency ... questionable Established accounts ... supersede delinquencies Bankruptcy dismissed ... .inadvertent, unnecessary, interpreted by lender The applicants contention is Third Federal looked into any permissible reason to reject the application, and to find reasons to deny the application, beyond facts that could have been ascertained. Discrimination is present and evidenced in correspondence, file, and Third FederaXXXX applicable-underwriting guidelines.

I open an account at XXXX XXXX in XXXX XXXX XXXX soon after that I became a victim of identity theft I reported this to the bank my banking account was compromised and some online transfers were made with my money I filed a police report disputed with the bank and my account was credited the bank thing closed my own account and opened me up a new one not even 8 Days Later the bank gave my account information to someone over the the phone they then withdrew XXXX dollars I called the bank because of my online banking abilities and not being able to go online they didn't ask me did I call in earlier that week and I said no only on XX/XX/XXXX I came in sign the paperwork to receive my money back into my account and then on the XXXX I came in and with Drew {$300.00} on the XXXX that's when the money was withdrawn again out of my account the banker told me that she is having trouble identifying me and that the ladies where I opened my account were able to identify me cuz they're familiar with me she asked me to go there the next day and have them call her when I was there so I did so she only told me that someone called and pretending to be me and that they said I was sick but when I came into the branch she proceeded to tell me something different she then told me that person went through XXXX XXXX branch and withdrew {$2000.00} and this is not because of my negligence this is because of the bank 's negligence if you're giving my information out over the phone and not even one week after I had closed the accounts and opened a new one and filed a police report and froze my credit she then stated that they no longer wish to bank with me that I needed to file another police report at XXXX Police Department XXXX Police Department stated that I could not file one there that I needed to file in XXXX cuz that's where my identity was stolen and it or that's where I should file I kept calling back and forth to the branch and to the police department I had XXXX Police Department called XXXX and they told them the same things I am working with a detective or and waiting for him to get back with me from his supervisor answering the questions that I need answered about XXXX XXXX not taking my police report I don't understand why the bank would lie to me on the phone they said they just needed to identify me they did not tell me that the {$2000.00} was taken out and they did not tell me they gave my information over the phone they just said that the same problem was happening of identity theft and fraud they close my account gave me the remaining balance of my account and told me that I would get a check after I filed a police report I don't believe that this is right it is not my fault that they gave my information out over the phone it is not my fault that they let this person withdraw my money when they knew for a fact that I could not be identified by the identification card because it had been stolen and I was waiting for my new one the person 's name that I spoke to was XXXX XXXX off I just wish for this to be resolved with me receiving my funds back I repeated I reported my identity that to the bank directly after it was stolen and still there are online transfers completed as soon as I became aware of them I reported that they they were not from me and I disputed them and XX/XX/XXXX I closed my account and opened new ones and by XX/XX/XXXX the same problem happened again by the bankers negligence

I was told by Third Federal Savings & Loan during several conversations with Loan Department Manager XXXX XXXX That XXXX XXXX XXXX XXXX was trustee after checking this information out I was told on my first initial contact that indeed they was trustee and XXXX XXXX was Servicer. How could this be when Third Federal Savings & Loan claimed they was servicer and have been collecting my payments for the past 20 years on a perfect payment history from myself. After further investigation and meeting with XXXX XXXX he told me that Third Federal Savings & Loan was collecting payment on behalf of the government which is fraud since my Mortgage was paid off by government based on bailout or tarp program. Secondly, after further digging into this matter by contacting XXXX XXXX XXXX XXXX I was my information was no loner in database and they was not trustee after pulling my tittle is where I discovered that I was the assignee which clearly makes me the owner of my property. To sum up what has transpired with myself and Third Federal is I have been making payments just about all on time to them for ten years. About four years ago I filed bankrupcy because I was a single mom and full-time XXXX student. In that time I had always paid my bills to Thhird Federal on time. After the bankrupcy my loan was discharged but I continued to pay because of course I want my house. This has been at least the third time I have received threatening letters from Third Federal as well as them putting a delinquency on my credit report which I have rebuilt. For most of my loan I had paid approximately {$55.00} a month. Apparently after bankrupcy they raised it slightly yet they never informed me. They stated when I called that they are not allowed to send me bills even though I was rerquesting them so I can stay on top of paying them, yet they refused. I paid the outstanding portion I had owed because i was never made aware of the increase. Then about a year later they send me another threatening letter that I am delinquent because of non payment yet I said I have made all my payments. The rep said my loan amount increased and I owed {$220.00} extra, I asked if they could inform me so this does not happen again and they refused. I had made a complaint with you but nothing transpired. I did pay the difference immediately and that was approximately six months ago. Again, I continued to make monthly payments on time which I have enclosed a copy of. Now six months later they send me another threatening notice saying I owe {$450.00} and this letter is a notice of default on my mortgage loan reference # XXXX resulting from my failure to make all monthly installments due as of XX/XX/18. I HAVE made all payments, they continue to reck havoc on my credit and my mortgage, I am trying to rebuild the excellent credit I had had yet they continue to sabatoge it as if to forclose my house and get their money. My loan is approximately {$23000.00} and I had for the most part paid $ XXXX/month, then this year I find out it had gone up to about {$74.00}, the actual amount I am uncertain of whereas they continue to refuse to inform me. I have paid the $ {$220.00} owed plus the $ XXXX monthly, it is impossible that I could owe {$450.00} in six months when I have made AL, again ALL of my payments. This is harassment and sabotage to my home and welfare. It has got to end. They need to remove that {$450.00} and from now on send a written estimate of my payments and what I owe. They can not continue to send me frivolous bills of outrages sums without any explanation. I can not even go online to review anything, I have no idea what they are doing, what they are charging me or what my interest rate is. I believe if I aim making and have made all my payments for ten years I am entitled to receive a bill, a reason for owing {$450.00}. This is UNACCEPTABLE. They are trying to forclose on my home.

On XXXX XXXX I submitted an application for a refinance with XXXX XXXX XXXX and XXXX. It was done at the XXXX XXXX. Everything was discussed by XXXX XXXX, the loan officer. The product that seemed to work best for us was a XXXX Smart rate adjustable 30 yr low cost loan. The rate was locked in at 3.19 % APR for 60 days. Our credit was pulled and everything was ready to go. We were told that this product was great because it gave you an 85 % loan to value instead of the traditional 80 %. we decided to move forward. The appraisal was done the very next day. It came in a lot lower than we were expecting but it was still enough for the amount we needed. We were a little over the debt to income ratio so we decided to put in a pay off of our XXXX XXXX which was XXXX. We were also paying off the equity line of credit of XXXX. This would have relieved us of XXXX dollars in debt. Thus bringing down the debt ratio as it was explained to us. The loan was sent to underwriting on the XXXX of XXXX. On XX/XX/2020 we got an email asking us to be patient. On XX/XX/2020 we received a call telling us the loan was approved but for only XXXX instead of the XXXX. When we asked the loan XXXX, She said our appraisal was too low?? I didn't understand and pressed further for an explanation and was told on XXXX XXXX that the rules on this product changed and the loan to value changed from 85 % to 70 %. they said they were protecting their bank because of the Corona Virus. I called the corporate headquarters and asked questions to why we were not as the consumer notified of this. I was told they suspended the product we were offered and we were in the pipeline when this happened and all those loans that had been just sitting in underwriting were denied. I feel this is so unfair. We had all the info in for weeks before the virus. I asked to talk to underwriting or if any other product would work for us and we were told no consumer could be transferred to underwriting. We were not offered any other loan except the one that was offered to us but we would have to bring about XXXX to the closing. I asked why I would need that much money at closing and I still don't understand. I am very upset by all of this and Third Federal Savings and Loan was recommended to me by my accountant because he said they cared about their consumers. I don't feel like that is true now. I feel they are looking out for themselves. I received a call from the associate XXXXanager at this branch and basically said there was nothing more that they could do because they were being very protective due to the Covid 19. The corporate office also said that no exceptions would be made because then they would have to do it for everybody. I applied for a home equity line of credit, to refinance an existing home equity line of credit from a different lender. During the refinance, their underwriters pulled a " XXXXroperty Profile '' report allegedly showing XXXX liens that they stated must be paid at closing. I balked at their requirement considering XXXX of the XXXX liens were not in fact liens but instead, simply notices that a previous tenant at my address had defaulted on personal property taxes. I attempted to reason with this bank, explaining clearly that i did not have personal property tax liens but, it was to no avail. I was finally able to contact the XXXX party that provided the bank the property profile and asked them to clarify these " personal property tax liens ''. They immediately saw that the liens were in someone else 's name, not mine and, that they were not liens and provided an updated report to the bank. That left XXXX final " lien ''. I explained to the bank that the other " lien '' that they incorrectly asserted was a judgment against me was instead, a supplemental tax bill, paid semi annually with my regular property taxes. They insisted that this supplemental tax bill be paid in full separately from my regular property taxes because they stated incorrectly that it was a judgment. They threatened to cancel my scheduled close if i did not pay it. I pleaded with them that its property taxes and that it did not impact their lien priority and that XXXX other previous lenders understood how supplemental taxes work. They cancelled my closing anyway. Out of pressure and under duress, I agreed to pay the supplemental tax bill, which would cause me harm when filing my taxes as i lose the write off of property taxes. They insisted i provide them a payoff. I obtained the payoff and submitted it to them. instead of issuing a check to the payee listed on the demand, and in the amount listed on the demand, they issued a check to another entity for another amount. The check has not been cashed because of this and to add to my injury, i've been paying interest on this amount that has yet to be corrected. I asked them to put a stop payment on the check and they refused. I'm at a loss financially for the interest charged on this outstanding cashier 's check and, I'm being required to pay a supplemental property tax that is a normal tax paid twice a year through an escrowed account by my XXXX XXXX XXXX servicer. I want the requirement to pay the lien removed as the lien priority of this bank doesn't change whether they pay it or not and, I want to be reimbursed for the interest for the time that has gone by since they issued an incorrect check and amount.

I currently have a HELOC with ThirdFederal with a line amount of {$100000.00}. My rate is Prime minus XXXX with a 2.00 % floor. The rate is for the entire line amount, regardless of the outstanding balance. I inquired to refi as I saw that the offered a rate, Prime minus XXXX. There was no cost to me to refinance. I spoke to a rep. of ThirdFederal who confirmed the rate of Prime minus XXXX. I applied late XXXX and submitted requested documentation on XX/XX/XXXX. ThirdFederal sent me, electronically, disclosures to explain the HELOC. I signed, along with my wife XXXX, the application and an authorization to proceed. Neither signed document included the interest rate. Even though a different document stated that the rate was Prime minus XXXX if the balance was at least $ XXXX, Prime minus XXXX for less than $ XXXX and a minimum rate of 2.24 %, it was still my understanding that my HELOC would close at XXXX minus XXXX as that is what was told to me. We continued with the process and on XX/XX/XXXX I received an approval notice from ThirdFederal/XXXX XXXX. Their letter stated I was approved with the following terms : Interest Rate : Prime XXXX %, 10 year draw and 20 year repayment and commitment expiration of XX/XX/XXXX. I asked to have the documents sent to me prior to closing to review so the signing of documents could be expedited. In review of the docs, they did not represent what was told to me and what was in their approval letter. The terms of the new HELOC is not a net benefit for me as even though the rate may be lower temporarily, if prime drops XXXX or I pay down to below $ XXXX, it would cost me significantly more money. This is a clear misrepresentation and a bank putting a customer is a worse financial position for their own profit. In speaking with XXXX XXXX, she agreed that the approval letter does not illustrate the true rate or minimum rate. She said she spoke to XXXX XXXX, her manager and is unable to honor the rate that was disclosed to me verbally and in the approval letter. I am writing to you for relief that they honor their approval of Prime minus XXXX for the entire balance with a minimum rate of XXXX %. I believe that I am not the only person who may have experienced this, I just closely read the documents closely prior to signing. If other applicant 's documents were reviewed, you may find the same misrepresentation. This may be the reason they don't want to honor the rates on my loan as it would open them up for many more errors.

I demand that these remarks and non payments for several months be corrected immediately, to avoid legal action potentially class action. Your actions have caused me injury to my financing activities because you have used a tricky way of reporting me behind on my mortgage. When this is not the case under the CARES ACT. Additionally, if Third Federal was going to report these negative remarks and gap in payments, which by law it can not, it should have explicitly explained this to its customers so they would have full disclosure. In XXXX of XXXX, we closed our ThirdFederal HELOC account XXXX having it paid off with a new HELOC company. On XXXX we got docs mailed about the lien release. Access to the closed account was removed from our online portal. On XX/XX/XXXX, ThirdFederal drafted {$600.00} from our linked bank account. We had that amount set up as an autodraft previously. On XX/XX/XXXX I called ThirdFederal and said that I wanted the {$600.00} reimbursed. I spoke with XXXX. She told me that the funds were returned that same day. After checking my bank accounts, I let her know that it did not come back to me electronically into the same account it was taken from. I subsequently asked my bank if they saw an attempted return of the money taken and they said no and said to ask for the tracking number on the payment from ThirdFederal. XXXX was unable to assist further. We contacted ThirdFederal through the banking portal ( bc we still have our primary mortgage with them ) and asked for the ACH re-payment tracking number. XXXX XXXX instead stated in response to our inquiry, " When this happens, we hold the funds for 8 business days and mail a check to the address we have on file. I do see a check in the amount of {$600.00} was mailed on XX/XX/XXXX. The check number is XXXX and we do ask that you wait 7-10 business days to receive it. '' We waited until XX/XX/XXXX to receive the check and since we didn't get it yet called ThirdFederal again today and said so. XXXX took the call but was wholly ill-equipped to deal with this problem and had to keep placing me on hold so he could coordinate with the people who really could " help. '' XXXX came back on the phone at one point and said the money went to an account ending in XXXX as though that meant something to us. We confirmed we had no bank account ending in that account number - I even checked our new HELOC #. He also at one point said he was told no check was sent out. I asked XXXX about his supervisor 's name and he didn't give it to me and redirected the question. He said that he will call us back tomorrow after more research is done by this other department. They made it impossible for us to cancel the $ XXXX payment closing us out of the HELOC portal, took the money unauthorized, tell us they are sending it back but don't, and then give us frustrating run arounds and don't let us talk to anyone capable of giving us the {$600.00} back.

Dear Sir or Madam, I am writing to file a complaint against Third Federal Savings & Loan Bank in XXXX, OH. For years, Third Federal wrongly reported an item on my credit report after a version of a short sale in XX/XX/XXXX, which caused me financial harm due to incorrect reporting on my credit report for years. In XXXX XXXX, the bank reduced the interest on the repayment agreement with no initial explanation and that caused me to look back at this whole situation. Several realtors have said that my case was one of the first short sales in XXXX in XXXX and once more regulations were passed my situation would never have been handled as a short sale. How was my case handled? XX/XX/XXXX, Third Federal converted the {$20000.00} deficit after the short sale to a promissory note at 5 percent interest, which I have been paying on for seven years. Yet, Third Federal reported this as a charge-off on my credit report, when not one penny was charged off. To date, I have paid {$11000.00}. As of XXXX XXXX, the balance due was {$9200.00}. I have continued making the monthly payments. The credit report inaccuracies have cost me more than {$10000.00} in interest and higher insurance premiums, as well as immeasurable stress as I struggled to get a new job and buy a new home in the face of the negative information on my credit report. In light of what Third Federal has cost me financially, I asked Third Federal in XXXX XXXX to erase the remainder of the {$9000.00} balance. Third Federal declined. The bank said it had already reduced the interest rate earlier this year, even though this move preceded my request to reduce the balance and had nothing to do with the bank 's admitted errors and the financial harm the bank has caused me. Interestingly, no one at Third Federal will give me an in-depth explanation into why it reduced my interest rate without a request from me. I gladly accepted this interest rate reduction, which the bank says it initiated because I 'm a good customer. But this still does not address the financial harm done to me as a result of the bank 's mistakes. That 's why I 'm writing to you.

I applied for a mortgage with TFSL & was pre-approved for a XXXX mortgage with 15 % down and no PMI. The rate provided was 3.75 % with an annual adjustable rate beginning year 6 with cap of 2 %. I locked in this rate and signed all documents and the " intent to proceed ''. I am under contract to purchase a condo. On XX/XX/13, I was notified by loan officer, XXXX XXXX, that the mortgage had been denied due a high debt-to-income ratio, which was over their 40 % limit. When I expressed confusion because my DTI was between 35-36 %, she said that because I was going with an ARM, the underwriters used the higher rate it might be 5 years from now ( 5.75 % ) to qualify me. Further, they disqualified me with an incorrect salary amount, then disqualified me a second time with the correct amount. Nowhere in any of the paperwork I signed, including the loan disclosure, was there any mention of not qualifying me at the locked-in rate of 3.75 %. I fully believe I was " disqualified '' because between the time of lock-in and underwriting, interest rates climbed substantially, the bank did not want to finance my loan at the cheap rate, and this ruse was the only way to disqualify me since I have a high credit score, literally no debt as my cards are paid off monthly, a 15 % downpayment and substantial liquid reserves. This is further supported by the bank not presenting ANY option to keep the 3.75 % rate, including putting down a higher down payment to bring down the DTI, which I have the funds to do. I turned down other then-competitive offers because TSFL offered a lower interest rate with no PMI, then disqualified me with a hidden interest rate I knew nothing about. TSFL 's opaque and deceptive practices have cost me real damages in time and, if this purchase deal now holds up through the financing delay they've caused, will now cost me substantial monthly costs due to rate increases.

On XX/XX/2022, my husband and I applied for a mortgage loan with Third Federal Savings and Loan. We wanted to obtain a pre-approval to begin shopping for our new home. Initially we tried using the online application, yet it was confusing as it require the applicant to enter the address of the home you want to finance. We would not know that information, thus, requesting a pre-approval to locate a home within our budget. We then called the Third Federal Savings and Loan location at XXXX XXXX XXXX, XXXX OH and spoke with XXXX. I told her that I was looking for a home in several nearby school districts. Via the phone, XXXX took our pre-approval application over the phone. She called us back the same day and spoke with my husband to state that our application was denied due to my husbands credit score and my DTI was high. On XX/XX/2022, I reached out to XXXX to gather more information about the credit decision and she stated that my DTI was high and I would not be qualified for the loan amount that I initially requested, which was {$450000.00}. I asked her how much I could pre-qualify for and she responded that I would not be able to afford what I am looking for in the school districts that I mentioned when the application was taken. XXXX then stated maybe {$800.00} a month and I dont know when I asked about the loan amount. She brushed me off. In addition, XXXX stated that anyone with credit scores less than XXXX will have pmi added to their mortgage loan. After some more house hunting, I went to re-apply for a pre-approval from Third Federal Savings and Loan Association of Cleveland on approximately XX/XX/XXXX A letter of Denial was sent out on XX/XX/XXXX saying my credit was inadequate. I was confused on some of the wording of my credit score. I spoke to a representative at Third Federal and was told " Not to worry about it '' and that she saw " A different number '' on her report. According to her, this letter was sent out by mistake. Approximately two weeks later, on XX/XX/XXXX, I began to become concerned because of the lack of communication after the last conversation. I called the representative back and was told by one of her colleagues that the denial was actually valid. The representative I spoke to originally was out that day. I called back the next day in the morning on XX/XX/XXXX and spoke with the original representative. She stated that the denial was valid, but had me forward a direct pull I received from XXXX XXXX and she would " Talk to her manager and see what she could do ''. I called back once more in the afternoon ofXX/XX/XXXX and asked to speak with the original representative. She was at lunch, so I asked to speak with her manager. After some clarification on the verbage of the denial letter, I was again told the denial was valid and final. I recently learned why this year 's XXXX XXXX XXXX annual premium jumped from an accepted premium of {$2100.00} ( XX/XX/XXXX ) to {$2300.00} ( XX/XX/XXXX ). According to the XXXX representative, on XX/XX/XXXX, they mentioned that my mortgagee, Third federal Savings Bank, called XXXX on XX/XX/XXXX and said that our single-family home insurance should be an HO6 policy! Also, interestingly XXXX claimed that no changes can take place unless they first speak with the mortgagor. XXXX is the agency that found XXXX for me after I learned that my previous insurer, XXXX, of 2 years increased my annual premium by {$800.00} est ; Previously, our initial insurer, XXXX XXXX annual premium increased from {$600.00} est to $ XXXX. No reason for the tremendous rate increases because no claims have been paid to me by any of the home insurers. I have been associated with XXXX agency for over 20 years and they have found me my home insurer providers. Please investigate this financial harm attempt ; I feel that this is another example that our XXXX has attempted to again cause me financial harm; Please refer to the previously filed complaint about Third Federal not honoring the XXXX loan modification at the end of our last approved forbearance. Also, XXXX is the third home insurance company I have had at our current 19+ year residence. Please investigate if my home insurance premium has increased because of my mortgagees interference. I want to report an incorrect transaction done at the local branch o f Third Federal on XX/XX/XXXX . My I R A CD has matured so I requested it closed and the funds to be deposited into my IRA Savings account. The teller seemed to be having major difficulties with this transaction by initially treating it as a regular CD ; this in itself speaks volumes. Finally all said and done, the IRA CD is closed and the funds are moved to the Savings IRA account, only this transaction was entered as a Distribution rather than a Rollover. My pleas were largely ignored and the teller kept on saying that since I made a withdrawal, this is a distribution, period. I was even asked whether I wanted the taxes withheld.

Apparently this teller is n't very knowledgeable about the I RA Rollovers. Ac cording to the IR S 60-day rule, if I take funds from one IRA account and deposit into another IRA account, this is a Non-Taxable IRA Rollover, providing I do so within 60 days. In my case, it was a matter of a few minutes, yet the transaction was erroneously entered as a Distribution. Now I am on my own to try and prove the opposite to the IRS ; I believe the fees start at {$500.00}. This is n't fair.

In the past, I 've done a few rollovers, and never a problem up until now.

I am asking you to please step in and help correcting this mistake. I am requesting the status of the transaction to be changed from distribution to Rollover in accordance with the IRS 60-day rule. I did email the bank but have n't heard back from them.

In XX/XX/2019 it was brought to my attention that my mortgage ( Third Federal Savings and Loan ) was late every month. I then actively started to monitor and dispute these inaccuracies in payment dates and late reporting. To date I have worked with the three credit bureaus and Third Federal to correct these items that were reported wrong. In the process the company Third Federal continued to report payments late ex : XXXX and XXXX I received alerts that these were late. I have had 8 corrections already and it is becoming exhaustive with XXXX care and work. I have spent hours researching and trying to resolve these issues in the middle of handling parents, sickness and death. I am unsure why this institution is unable to provide proper reporting but I don't have the strength or time to continue to hunt and track down their inaccuracies. I have purchased cars and applied for credit that these inaccurate reporting 's have had immense impact on. In this fight with Third Federal 's inaccurate reporting I have been able to raise my credit score over 130 points from disputing and them correcting their errors. Additionally Third Federal reports to each credit bureau different information each month ( some reports show late and some show not late for the same month ). Third Federals letter to me indicating that they have sent corrections to all bureaus ( for a few of the errors that I went directly to them ) and that they apologize for any inconvenience is insulting as the " inconvenience '' is both financial and almost irreparable

I'm writing you today regarding my mortgage loan held through Third Federal Savings Bank. The mortgage balance {$9800.00}. I was behind on my mortgage and received a summons for court dated XX/XX/XXXX. I summitted a letter to the court XX/XX/XXXX. However I was told that I still owed attorney fees and court costs of {$4500.00}. I asked why since this never went to court. The amounts they wanted could have paid off my mortgage in full {$9800.00}. The mortgage payment includes escrow which was never offered to me to include in the modification that I did in XXXX. Today XX/XX/XXXX th is the anniversary of my husbands passing suddenly at work at XXXX. As a widow I'm trying to do the right thing by working XXXX jobs however my other job wasn't putting me on the schedule leaving me with only the XXXX job. on XX/XX/2020 I spoke with loan agent NMLS # XXXX. We discussed general refinance qualification criteria including DTI ratios. She did not disclose a requirement of DTI 36 %. The number she mentioned was 45 % per my notes. She did not disclose their new income criteria requirements that have changed due to covid. Would I have known these requirements, I would have not proceeded with an application and letting her run our credit inquiries. Through their underwriting process, they determined our DTI was well above 36 % thus, declining our application. I spoke with a different agent on XX/XX/2020 by the name of XXXX and she indicated a DTI requirement of 36 % - 40 %. I proceeded to escalate this to a manager with NMLS ID # XXXX who again provided me a different DTI ration requirement of 36 %. I requested transcripts of the calls to verify the agents prior communications and the manager with ID # XXXX indicated they did not have the ability to record voice on their recordings. I asked whether this was not a violation of their policy to record all phone calls and she refused to take accountability and insisted they had no ability to record calls with voice. There should be consequences for such unethical business practices where they practice this 'bait and switch ' scheme. If agents are rated on number of applications submitted I can understand why they will lie in order to get consumers to apply not caring entirely whether an application is approved or declined. On XX/XX/2009, a HELOC Mortgage was completed with Third Federal Savings and Loan Association of Cleveland. and loan payments began, Third Federal received over payments intended to be payments against the principal balance. Instead of applying the payments, Third Federal, changed the description of the over payment to interest and kept the overpaid amount. Frequently throughout the loan double payments were made per month. Third Federal failed to apply the payments were they were received. Instead, the payments were held until the payment date and then applied against the loan. After the ten-year borrowing phase, the loan went into the repayment phase. Third Federal without any notice increased the amount of the payment required per month to {$2800.00} per month from {$650.00}. The lender was contacted after receiving a call from the collections department. Also spoke with customer service to find out what happen to the Notice and found it was sent to a wrong address. A call was placed to customer service explaining that payments could be made if the amount of the payment could be modified to between {$1000.00} to {$1500.00} per month. No response was received from Third Federal. Instead, foreclosure proceeding were started by Third Federal. A modification was requested again and there has been no response from Third Federal. Third Federal is returning payments made against the loan and reporting to the credit bureau that the payment has not been made.

Third Federal- XXXX XXXX XXXX XXXX , Ohio XXXX -opened an equity line of credit on my home which resulted in a first lien being placed on my home. I had no knowledge of the account until XX/XX/2019 when I had a second mortgage opened through my bank. I contacted Third Federal and they told me I had a credit limit equity line of {$21000.00}. I explained to them I did not want an equity line of credit with them and to close the account. I explained that I have never used the credit line ( which each monthly statement shows a XXXX balance and XXXX available credit ). Every month Third Federal sends me a bill with the same information. A XXXX balance, available credit, and payment due. I have requested multiple times to close the account and have the lien removed off my home and each time they have me submit different documents and speak with a representative but someone it is not closed out. This month they sent me another bill ( attached below ) and I contacted them again to explain the situation as I have done monthly since XXXX. /a very rude woman assisted me and told me that there is nothing they will do about the fraudulent account and the fraudulent lien on my home. My compliant is against Third Federal Loan and savings, account # XXXX. I disputed with this company a wrong payment that they included in my reports. We applied for a refinance on XXXX XXXX with Third Federal. We entered the date that we requested to close on the refinance for XXXX XXXX. We submitted additional documents after the initial application and Third Federal did not communicate that they were not able to close by XXXX XXXX. Our credit was pulled, we submitted w-2s, bank statements and tax statements at a later time than the XX/XX/XXXX. At no time did they include or disclose that we would not be able to close on the date requested. We contacted them the week of the XX/XX/XXXX to find out the status and a date for closing. We were told that it would be 4 months possibly more depending on underwriting. XXXX XXXX with the XXXX office told me on Tuesday XX/XX/XXXX that half of the application had not been reviewed. I asked if anyone was going to contact us to let us know that we were not closing on the date asked and she said no why would we. An appraisal was done on the property and would not have been done, and an extra pull on our credit. Third Federal was not clear about their business practices and let us think that we could pick the date to close by posting it on the application. They also did not provide a rate lock and have no idea what the rate could be in 4+ months. It was very misleading and a misrepresentation of their process.

I called Third Federal toward the beginning of XX/XX/XXXX ( I cant remember the exact date ), to request online access to start making my mortgage payments. The representative stated that I would not be able to have online access to my account due to my bankruptcy. I explained that my bankruptcy has been XXXX. She explained that because I had a bankruptcy I would never be able to access my account online, and that it was Third Federals policy. I can understand not being able to have access to your account online while in an ACTIVE bankruptcy, but I don't understand why I wouldn't be able to have access after it has XXXX. This practice is bias and prejudice. I completed my bankruptcy, I am current on my payments. I should be afforded the same conveniences as other customers. Third Federal should not be permitted to make it harder for me to make my payments. I should not be forced to go into a branch, especially during a pandemic, or use a break or my lunch at work, to make a call. I should be able to pay my mortgage online like I pay all my other bills. I should not be discriminated against because I fell on hard times and had to file a bankruptcy.

Calling their XXXX recorded message system, I am immediately asked to say/enter my social security number, enter my birth date, home phone number, name, address, etc. This is very inappropriate in this day of trying to secure personal information - leaving requested info like this, not knowing who or how it will be captured/received appears lacking in security. I have an HELOC account with Third Federal with a balance of {$190000.00} as of XX/XX/2023. My monthly payments fluctuate and have been increasing because the interest rate is not fixed and has been increasing. The last payment due for XX/XX/2023 was {$1300.00}. I applied for a new {$190000.00} loan to replace the current loan with a XXXX XXXX on XX/XX/2023. The monthly payments for the first five years would be reduced to {$1200.00}, and there would be no closing fee because of my existing loan with Third Federal. Sirs, I have a HELOC account with ThirdFederal Savings & Loan. I have setup monthly payment thru signed documents for the regular and specific principle payments. This should satisfy the regular payment obligations with this loan account. Every time I make any additional payments online [ thru ThirdFederal site ], I choose the option for applying the additional payment amount towards PRINCIPLE ONLY [ Two options are there - Regular or Principle ]. However, every such additional payments are being processed in such a way that part of the amount is taken to Regular/Interest payment First and what is left is considered towards Principle. Contacted ThirdFederal on this and I was told that there is disclaimer at the online payment screen indicating this process and what they do is legal. Could you please help me with the following : 1. I have a HELOC with Third Federal Savings & Loan. My required flood insurance with XXXX renews every XX/XX/XXXX. Third Federal issues me a Notice of Flood Insurance Requirement on XX/XX/XXXX stating my flood policy has lapsed. They state I have 45 days from the date of the letter to rectify or be charged by them for a policy. They immediately charge me {$67.00} on XX/XX/XXXX. I provided my policy showing no lapse in coverage ( old policy XX/XX/XXXX-XX/XX/XXXX new policy XX/XX/XXXX-XX/XX/XXXX ) via their online portal. I also have XXXX sent copies of the policy. I call their XXXX number to verify but they still insist my coverage lapsed from XX/XX/XXXX-XX/XX/XXXX. I resend the policys, I have XXXX resend the policies, no luck. I go into a local branch in XXXX FL and show the representative the policies. She forwards the copies to their main office and then calls them. They STILL think I should be charged the {$67.00} even with all the documentation. Opened a Third Federal Savings & Loan HELOC and drew down a balance in XX/XX/XXXX. Set payments on Autopay via their website which ran fine for six months until I received a call from their Collections department in mid-XXXX saying I underpaid my loan payment. Tried to pay online but was unable to do so from their website, online payment was blocked and their website notified me to call Customer Service. Was assessed a late fee even though I was unable to pay online. Called back on XX/XX/XXXX and was notified that AutoPay service can only be for a fixed amount every month and I need to monitor my statement and cancel AutoPay every time the payment amount changes, which is monthly now with changes to the Prime rate and a variable rate loan, and setup a new AutoPay service. Every other Financial Institution I have worked with has an AutoPay for the minimum payment amount due however Third Federal refuses to provide that option. I took out a HELOC with Third Federal in 2006. Along with the loan I received a brochure that states Lowest Rate Guaranteed For The Life Of The Line, you get either a rate adjustment or {$500.00} if they dont match it. It also states If you ever find a lower rate, a year from now, or even ten years from now, we will beat it, or give you {$500.00}. My HELOC is Prime - .51 %. Third Federal currently offers HELOCs at Prime - 1.01 %. I submitted a rate adjustment online and the response was I would have to apply for the loan. I talked to the local office in XXXX FL and made the request and was told its only for when I first get the loan ( even though I pointed out it says for the LIFE of the loan and gave an example of guaranteeing it even 10 years later ). The brochure states To receive a competitive rate adjustment, either fax or deliver to your local Third Fedral branch or Customer Service department, a copy of the competitive product advertisement. Ive done both with no satisfaction.

We started a loan application with Third Federal on XX/XX/XXXX they did not provide their XXXX until XX/XX/XXXX, failing to comply with disclosures by day 3. Throughout the process, certain information has been shared that would be within Third Federal 's underwriting guidelines since they don't follow XXXX or XXXX, their team including their XXXX XXXX, didn't seem to know those guidelines, which at this point now have caused us to try to shop with another lender and rates have increase by at least XXXX to XXXX since we started this application. My wife, a resident of the state of Kentucky applied for a mortgage from Third Federal Savings and Loan. Since the house is her premarital asset, with the existing mortgage and title only in her name she applied for the loan with her resources and credit only. When the day came to close, I was informed that I had to accompany her to release dower ( since Kentucky is a dower state ). On XX/XX/XXXX, we were informed by Third Federal personnel that we had been denied for our mortgage refinance. They cited our income to debt ratios and the loan to value ratios were too high. Below is the email we received when we asked them to explain exactly what their ratios were. " Currently we require our debt to income ratios to be 28 % ( housing ) /36 % ( housing and all other debt ) Youre ratios were at XXXX Also, the loan to value needs to be at 70 % or below, you are currently at 80.9 %. '' We feel we were grossly mislead by Third Federal. Had they disclosed their requirements upfront, we would have sought another lender. We've never heard of requiring a 70 % loan to value from any lender. my wife and i were pre approved for a conventional loan through 3rd federal savings and loan with a 5.84 % interest rate good through XX/XX/XXXX XXXX we signed our offer to purchase on XX/XX/XXXX. On XX/XX/XXXX we were told by 3rd federal our interest rate had gone up to 6.79 % When I asked, " why it was going up? ", I was told it was because we had to be pre approved again due to a previous contract being cancelled on another home purchase agreement. I requested my credit be permanently unfrozen with XXXX and XXXX on XX/XX/2021. Third Federal Savings and Loan is attempting to process a mortgage pre-approval for me and they said my credit is still fully frozen one week later XX/XX/2021. I received a " demand '' letter on my 2nd mortgage with Third Federal, giving me 35 days to pay them {$50000.00}. This mortgage had been " written off '' supposedly as I was a casualty of the Great Recession having lost my full-time job in 2009. We were quoted a figure of {$430.00} for title charges on the original estimate of costs, and on the final closing cost form, but when the title company contacted us to close the loan, the fee for title charges was {$1400.00}. When we asked about this, we were told that they had quoted the {$430.00} because they expected us to get some sort of credit which they figured out we were not eligible for after they sent us the final closing cost form. So we basically had to come up with an {$1100.00} to close the loan the day before the signing. This feels like a bait and switch, but with the closing happening, we didn't feel we had a choice but to pay it.

The XXXX loan I requested was on a home that is also 100 % paid off, and my average annual salary is likely right around XXXX or more. There is no reason why I should not qualify for the loan. Apparently Third Federal says they sent 3 requests to XXXX XXXX for payoff amounts but XXXX XXXX says they haven't received any payoff requests. Third Federal bank reported a very small amount of {$5.00} 30 days late when payment was made exactly 30 days after the initial payment was due. I made a payment of {$320.00} on an estimate of rising interest rates, when the statement was later received, it was already too late to adjust the outgoing payment, so I added on additional funds to the next months payment to cover it understanding that it would simply cover the missing amount. We sold our home. Paid off the loan. The bank continued to withdraw funds in the amount of the monthly payment AFTER the loan was paid in full. We caught the error when the withdraw was merely pending and notified the bank of the error. The bank refused to stop the withdraw. We asked them to return the charges. The bank refused and said they would send a check. It has been several weeks and the bank has been unresponsive to emails and phone calls have been unhelpful. I have been attempting to get on the forebarance plan with Third Federal. They offered me three options. With 2 options my credit would be negatively impacted, with the third, they would accrue interest during the forbearance plan, which directly violates the CARES act. I have recorded my conversations with the bank as well, for proof. I also was denied a modification. They ran my credit several times unnecessarily, so I am now in a worse position ( lower credit score ) due to the hit my credit score took ( because of their inquires ) They don't care about their clients.

1. Loan Denied, they said my debt to income ratio was too high. When I do the calculation I fall within their range. I showed them where a mistake was made and it was ignored. They would not give me any info on what figures they used for there calculations. The one mistake that I pointed out too them was, they added my insurance and taxes on top of my mortgage payment and those numbers were already included in the mortgage payment. I even mad an attempt to remove one of my debts and it was ignored.
