So i sent a verification letter XXXX XXXX XXXX(see attachment 1) via email. Texas guarantee responded on the XX/XX/XXXX with the following. Account # XXXX It starts with the fact I am a XXXX XXXX XXXX veteran. To Whom It May Concern : On XX/XX/XXXX, I received a notice from TG XXXX XXXX XXXX advising of the defaulted student loan and for me to contact them with regards to making payment arrangements. I called TG and at that time was informed I had been entered in to the Treasury Offset Program. I had advised I was unclear as to what that program entailed. At this time, I informed TG, as I had informed them various times before, I was in a precarious situation as I had been going through a divorce since XX/XX/XXXX, I was unemployed, had gone through several medical procedures as a XXXX veteran, and had recently been diagnosed with another medical issue. I informed them, I had called several times before and asked if they had that those conversations recorded that they could revert to. At this time, I entered into a payment plan and was informed that I need to make three ( 3 ) consecutive payments in order to show good faith. I had assured them I had no issues with that and signed up via electronical debit with them via phone. On XX/XX/XXXX, I received correspondence from the Department of Treasury that the JOINT ENTIRE federal refund had been applied to that balance. A total of {$20000.00}. On XX/XX/XXXX, I called several times, a few of which I was disconnected, and eventually spoke to a XXXXtwice, ext : XXXX, who could only advise me that although he had seen I had signed up to make payments, I would have to make three ( 3 ) consecutive payments in order get out of the program. I explained that how I could do that, if I had been afforded the opportunity to make three ( 3 ) payments before they touched a refund I wasnt even aware that was coming yet. He then said that for any future refunds, I would be ok ... Im not sure was that meant. I advised XXXX the second time that at NO TIME, based on TGs own TREASURY OFFSET PROGRAM http : //www.tgslc.org/borrowers/default/consequences.cfm page explanation was I ever given the following : By federal law and regulations, you have certain rights when you are facing Treasury offset XXXX You must be notified that TG is proposing to use Treasury offset to collect money from you. A notice will be sent to the address you used when filing your most recent federal income tax return. You must be given an opportunity to : Avoid offset by arranging to repay your loan, Review any records about your loan, Show why the loan is not in default, is not delinquent, or why you aren't legally responsible for repaying it. If your spouse 's tax refund was subject to Treasury offset because of your federal debt, your spouse may be entitled to claim his or her return. You can contact the IRS about your Treasury offset at XXXX XXXX XXXX XXXX. The notice you receive will explain your rights with regard to the Treasury offset process. If tax refunds or other federal payments are withheld, they will not appear as voluntary payments on your credit report although they will be deducted from your balance. In addition, Treasury offsets do not count toward any program that requires voluntary payments such as reinstatement or rehabilitation. Borrowers receiving a letter from TG warning of possible Treasury offset should call TG at ( XXXX ) XXXX or send TG an email message. PLEASE BE ADVISED THAT At no time did I receive a notice stating I was in for TREASURY OFFSET, nor did I even been given an explanation and/or been given my rights regarding this program or given the opportunity to object and/or explain my current position or even review it. As soon as I received the XX/XX/XXXX notice, I called and made arrangements for payment after explaining my situation. TODAY, after speaking to XXXX, I asked to speak to a supervisor, I was told that speaking to a supervisor would do me no good and that my only option was to call and/or write after the payment went it and claim hardship or injured spouse for the other party. I called right after and spoke to an XXXX XXXX, who was a little rude and just recited the same information as if reading from a script. I can totally understand this is an attempt to collect a debt, which makes it even harder as the debtor to call and try to remedy the situation with individuals who are not even trying to help you resolve the issue. As I said, I have called several times in the year XXXX to try to resolve the debt, and have been handled and/or mishandled. I have no problems showing any proof and/or documentation of any of the things I have said, please contact me via email and I will gladly provide and/or call me : XXXX as I believe this has been wrongfully handled and could have been avoided.

My government loans were sold to XXXX XXXX in XX/XX/XXXX by government. XXXX XXXX Harrassed me with phone calls, threats, fraudulent charges. They separated my Stafford loan and my perkins loan and charged over 30,000 to my loan debt. They then sold my loan to XXXX. XXXX harassed me and added over 10,000 dollars in fees to my account. They then continuously called and put my loan under forbearance over 7 times. I accrued over 15,000 in more illegal charges. XXXX damaged my credit by stating I owed monthly payments of 7,000 dollars and was delinquent over 90 days. They then lost a settlement for illegal practices and illegal tactics and I recieved 2 settlement checks that were not close to the damage they had created on my account. In XX/XX/XXXX they sold my account to Texas guaranteed loan company. I accrued again over 15,000 dollars in collection charges. My loans should be protected by my original promissory note and contract with the federal loan companies but they too didn't follow the contract. Not one if these companies have provided me with my original loan contract or promissory note although I have asked for documentation repeatedly. I was told by XXXX that they will ruin my credit and that they will make sure they ruin my life. They sold to TG. Texas guaranteed loan company has charged late fees, collection fees, interest and penalties to my account. In XX/XX/XXXX, I was applying for a mortgage loan. I called TG because the loan underwriter for the mortgage loan needed a payment amount to my student loans to decide if i qualified for a loan. I called TG and informed them that I had a 3rd party loan underwriter on the line and needed to know my payment amount. They refused to answer and continued to ask me if I was ready to pay now and what amount my payment would be now. They refused to answer any questions and harassed me for information during the whole conversation. They would not disclose a payment amount. The third party underwriter witnessed this conversation and could not believe that TG was allowed to practice these illegal tactics. Because the underwriter witnessed the interaction, and agreed it was illegal and ethically wrong to do this, they granted me a mortgage loan of XXXX dollars. In turn, Texas guaranteed loan company hired Trellis company to start garnishing my wages with my employer. I AM A XXXX XXXX! They currently have garnished over XXXX dollars a month for over a year and a half now. They have ruined my credit. Trellis has repeatedly stated that my loan payments are over 7000 dollars a month. They are not. My wages are being garnished by Trellis! However, my credit report shows my account is closed with XXXX, TG, and both companies show a charge off. But they also show negative credit delinquent statements on a monthly basis impacting my credit miserably. XXXX XXXX has conveniently NOW disappeared from my credit report completely. Trellis on a monthly bases shows my account closes and opens and they charge XXXX dollars on my account then the following month they charge XXXX dollars and show garnished wages on my credit report. They then, close my account the following month and show that my account is charged off but delinquent. The damages these companies have done to me and other loan holders is unethical and illegal. I have recieved payments for the illegal practices I have endured.The payments are nowhere close to the damage they have caused to my loan accounts. I HAVE NEVER RECIEVED DOCUMENTATION WITH MY ORIGINAL PROMISSORY LOAN AGREEMENTS. Their fraudulent charges and fees have never been taken off of my account. They have created a loan amount that has tripled in amount because of their illegal actions. My garnished wages of XXXX monthly do not even pay {$100.00} toward my principal loan amount. The garnish wage amount goes to collection fees and interest. The damage and harassment done to me is ethically inhumane and has not been stopped regardless of all the evidence of illegal practice committed by these loan companies. They continue to illegally affect my credit report with fraudulent negative comments on reports. These companies have no one holding them accountable or monitoring their overall illegal actions. TRELLIS is now collecting garmishment payments and still continously adds negative remarks to my credit. XXXX taken from my check is not enough damage done to me, they still add non existing payments and negative remarks to my credit report. They are ignoring policies and committing illegal infractions even dealing with federal student loan holders. Please help me and stop these companies from continuously robbing people and ruinning lives. Please!

Except as authorized under subsection ( b ) of this section, no consumer reporting agency may make any consumer report containing any of the following items of information : ( 1 ) Cases under title 11 [ United States Code ] or under the Bankruptcy Act that, from the date of entry of the order for relief or the date of adjudication, as the case may be, antedate the report by more than 10 years. ( 2 ) Civil suits, civil judgments, and records of arrest that from date of entry, antedate the report by more than seven years or until the governing statute of limitations has expired, whichever is the longer period. ( 3 ) Paid tax liens which, from date of payment, antedate the report by more than seven years. ( 4 ) Accounts placed for collection or charged to profit and loss which antedate the report by more than seven years. ( 1 ) ( 5 ) Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years.1 ( b ) Exempted cases. The provisions of subsection ( a ) of this section are not applicable in the case of any consumer credit report to be used in connection with ( 1 ) a credit transaction involving, or which may reasonably be expected to involve, a principal amount of {$150000.00} or more ; ( 2 ) the underwriting of life insurance involving, or which may reasonably be expected to involve, a face amount of {$150000.00} or more ; or ( 3 ) the employment of any individual at an annual salary which equals, or which may reasonably be expected to equal {$75000.00}, or more. ( c ) Running of reporting period. ( 1 ) In general. The 7-year period referred to in paragraphs ( 4 ) and ( 6 ) ** of subsection ( a ) shall begin, with respect to any delinquent account that is placed for collection ( internally or by referral to a third party, whichever is earlier ), charged to profit and loss, or subjected to any similar action, upon the expiration of the 180-day period beginning on the date of the commencement of the delinquency which immediately preceded the collection activity, charge to profit and loss, or similar action. This is a long detailed story that I can not easily sum in XXXX characters. I graduated from XXXX XXXX, my loan was then sold to Texas Guaranteed Student Loan ( TG ). I started a occupation that allowed me to live and pay my bills roughly a year after graduation. I contacted the lender and began a payment plan somewhere between $ XXXX {$350.00} per month. About 6 months to a year in ; I contacted TG to make my payment. They inform me that I need to play upwards of {$500.00} a month. I 'm informed the reason is they no longer offer the plan I was originally paying. They then inform me that if I were to make my regular payment that I would not even touch the accruing interest. 'Mind you, I have not signed a single document agreeing to anything '. I inform them I can not afford this and they ca n't force me out of paying my loan just to accrue interest. They do n't offer me a plan, or a payment arrangement, or any sort of empathy and just try to collect. They make periodic calls through the next few years, and I inform them I can not pay what they ask only to be informed that if I pay what I can afford it is just a waste of my money. During the interactions, they never offer any assistance or options, just that I pay what they want or just continue to accrue interest. A few years down the road, my credit score is trashed, and my interest has spiked over {$10000.00}. I contact them, and they inform me that they are offering debt consolidation. I speak with a rep, and am informed that I am on a consolidated plan and will need to pay {$180.00} first payment and {$210.00} every other month till the debt is paid. I think fair enough, for 6 months I make payments of {$210.00}. My balance is dropping my credit score is increasing. At the end of the year, I see my balance ; it 's higher then when I started paying. I figure it may be an interest spike and disregard it. I pay for another 6 months to a year, balance starts to drop again and credit score is slowly increasing. Then I get a balance recap form again, and low and behold my balance is higher then started. I contact TG and the representative informs me that whomever I spoke with did not send me the consolidation paperwork ; therefore I was not consolidated, and had been paying based on the previous terms that did not even touch the accrued interest. 'Basically just giving them money for no real reason '. Then, with as little empathy as possible the rep tells me she will send me the consolidation paperwork so I can get started. When I ask about the monies I already paid, I 'm pretty much told I 'm up a creek without a paddle. At this point, I contacted another debt consolidation student loan company, worked out them purchasing the loan from TG and now have a set plan that I 'm happy with ; however, this is not before dumping thousands of dollars for no benefit to TG and TG adding over {$10000.00} in interest to my loan. What was once a {$28000.00} dollar debt has become a {$39000.00} debt. I will have to pay interest based on the interest added by TG. TG are crooks! They stole my money, they added endless amounts of interest to my loan, and when I tried to pay them they tell me it 's not good enough. How is this legal? I feel they should return the money, or at least the balance remaining that they have been paid by the new debtor. Or at the very least, pay the interest they accrued onto my debt, and return the monies they stole from me for every cent. I 'm sure they still have my account, and ledgers to review this balance. Personally, I 'd rather see the CFPB shut this company down, or fine them a high dollar amount. I 'm sure I 'm not the only person who was dealt with under unethical terms. I 'm not asking for a hand out, I 'll pay my debt, but they should have to be held responsible for something. I do NOT wish for TG to purchase the debt back.

My complaint revolves around the severe financial, personal, and career consequences I incurred due to false and misleading information provided to me by Texas Guaranteed. For years I was making payment on loans of about $ XXXX with a monthly payment of {$300.00}. Around late XXXX I started falling behind as I received a severe paycut at my job of about 20 % due to loss of bonus at XXXX XXXX contacted Texas Guaranteed numerous times and each time they said I had already exhausted all options and there was nothing I could do. I was still paying though even if late. Eventually I could not keep up and tried to find another solution as lates were starting to impact my credit rating. No one ever returned my call. A few months went by and I finally gathered a few XXXX dollars by selling off personal belongings. I called to try and make payments and I was denied. They wanted ALL payments that were past due. This was not possible as I had just a few XXXX not thousands of dollars available. As a consequence I was advised to wait a few months because they had another solution for me. Their " solution '' come to find out in late XX/XX/XXXX was that they had filed for a WAGE Garnishment! They immediately started taking {$650.00} per month which was over XXXX my regular payment of {$300.00}. I called again pleading for help. They said this was the only route to reinstate a good standing and then conned me for MORE money. They said I had to pay another {$120.00} per month penalty as well. So all in for almost a year they took $ XXXX per MONTH. As previously advised I was already lacking enough funds prior to any of this. This lead to defaulting on all my credit cards as I simply didnt even have any money after rent and student loans and barely any food to eat. After a year they stated congrats you are back on track, we will remove garnishment. However they had ADDED nearly $ XXXX as a " Collection Fee '', So aside from wrecking havoc to my credit forcing me to default, losing XXXX lbs due to near starvation, losing apartment and living in my XXXX they ADDED $ XXXX after I had already been garnished/paid nearly $ XXXX! This damage continues to this day. My student loan is now being serviced by another but it reflects an XXXX of over 130 %. This loan has been negatively amortizing even though Ive been paying for nearly XXXX decades!!! I need all this investigated, fees/penalties removed, lates corrected and compensation for ancillary impacts such as credit decline, increased cost of borrowing, homelessness ( due to forced garnish ), and overall lying and stealing tens of thousands from me. A previous response ignored all my questions, concerns, and allegations. I am very well aware of how a loan amortizes and dont need a lesson there. I want answers as to WHY I was continually lied to, misled, and misguided. Their direction led to me being placed in this position. Their wrongdoings caused me severe financial, credit, and mental impacts. These impacts have been compounded since then. Just as the interest has compounded due to the addition of the collection fee due to their purposeful misdirection. Please provide EVIDENCE of the contrary, pull the call recordings, the notations, and my written confirmations. If you are not able to provide this, then XXXX demand restitution, the fees removed, the compounded interest removed, and additional compensation for the ancillary impacts that at this moment are incalculable. If you cant calculate it then please advise me so that I seek legal counsel. This is the last opportunity I am providing to make this right for me before I present this to our multiple media outlets and newly elected officials that see the new form of slavery that is student loan debt and the malicious behavior of the master servicers that only give direction in their best interest.

While checking my credit report I noticed that you all furnished an account on my credit report without my consent which has cause to get denied for multiple necessities in life ( XXXX. There are laws in place to prevent your company from furnishing information on a consumers report. 15 USC 1692a ( 2 ) states ; the term " communication '' means the conveying of information regarding a debt directly or indirectly to ANY person through any medium. Therefore, furnishing of the consumer report ( giving information regarding the alleged debt ) by your company is " communication '' as stated by the Fair Debt Collection Practices Act ( FDCPA ) As my rights state per 15 USC 1692c ( C ) I'm giving you formal notice to stop any further communications regarding this account immediately. This includes but is not limited to Consumer reporting Agencies ( XXXX, XXXX, and XXXX ) Please do not respond saying you are not governing by FDCPA or you are exempt. My spouse and I had student loans that we decided to consolidate with XXXX in XX/XX/XXXX for a total of appx. {$27000.00} at 9 % interest. Over the years working through forbearance and deferment because of our decision to raise a family, we ended up making about {$20000.00} in payments, before the monthly payment reached a point we could no longer afford and the loan went into default. So now that we have consolidated with a private lender, we have lost all benefits of ant type of consolidation or refinance opportunities, especially when the government drastically dropped the consolidation loan interest rate cap. We were stuck with what we had. After default, the loan was assigned to Texas Guaranteed, who immediately added a {$15000.00} collection charge and the monthly payment went up even more. After a period of time, we ended up going through a rehabilitation program and after 9 months, the loan was sold to XXXX. Our rehabilitation payments were {$200.00} per month and our understanding of the program is that prior to being sold we would have the ability to review the new terms to see if they were affordable as we could not afford much more than the {$200.00} per month a that time. Well, the XXXX payments came out to be {$650.00} per month, and of course we ended up defaulting again. The loan is again sent to XXXX for collection and they tack on another {$18000.00} in collection charges. Now with interest still continuing to accrue at {$750.00} per month, our only payment option is a $ XXXX monthly payment which is not possible even with all my children out of high school. Even if we paid something like {$400.00} per month, it would be useless as it would not get us out of default and would still be less than just the interest and would do us no good in the long run. We also could reach a settlement with a {$91000.00} lump sum payment. If we were able to make the $ XXXX monthly payments for 30 years, along with what we have already paid towards this loan, the total paid would be appx. {$340000.00} on a {$27000.00} loan. That seems really fair! And that 's not even the end. Now out taxes are scheduled to be offset, even though I have {$500.00} per month garnished on my paycheck for other debts, plus there is a potential my home could be foreclosed on due to some past due property taxes. In addition most of my refund is because of my children 's education credits, which I am only claiming because they are still considered dependents in XX/XX/XXXX. Funny I had no benefit of government programs after I consolidated with XXXX, but now I can be on a government program that harms me and my family. If this was another other government debt, there would be plenty of options, even more settlement options. I understand that I need to pay my debt and am in a better position to be on a reasonable payment plan now, but not {$870.00} per month for 30 years. Why ca n't I pay something like {$450.00} per month for 10 years and be done with this. I would end up paying triple the original loan amount over all the years, which should be a reasonable solution for everyone. XXXX will state that they offered lower payment plans previously, but it was never anything that we could reasonably pay. Even if my wages were garnished, it would still be for less than the monthly interest, so what happens when the balance gets to {$150000.00} or {$200000.00} or higher? Then if I was n't to be on a monthly payment plan, it 's {$1500.00} per month. And maybe XXXX is just getting their direction from the Department of Education. Then shame on both of them!!

Subject : Problems with TG XXXX I got into a Loan Rehab program for my defaulted loans with the servicing provider TG ( Texas Guaranteed XXXX ) who was the gurantor. At the time, TG had XXXX XXXX to be the servicer of the my loans since XXXX. TG agreed to delete my loans from default and remove them from my credit ( See, Exhibit A1 and Exhibit A2 ). I successfully completed the rehab program. I contacted ( TG ) directly and they said they notified XXXX XXXX ( The servicer ) to remove the credit file from each of the credit bureaus. ( TG ) told me that it should take up to 60 days for XXXX XXXX to remove it according to XXXX - Loan rehabilitation agreement. It has now been close to 500 days and they have not been removed. ( Exhibit " B '' is a sample listing on Experian showing defaulted loans ). TG also stated that the problem is with XXXX XXXX because they handled there part. I 'm preparing to shop for a mortgage and was told those defaulted loans still showing on my credit will keep me from getting the best interest rate. I 'm requesting your assistance to correct this error that is being caused by either TG and XXXX XXXX on these loans since the defaults do not reflect my current payment status and agreed upon rehab arrangements. Bigger Issue : I have asked the XXXX credit bureaus to help as well. The last time I asked for help from credit bureaus ( Exhibit E ) was on XXXX/XXXX/XXXX. I also asked XXXX XXXX to remove these items as well ( Exhibit C ) and sent them a letter ( Exhibit D ) on XXXX/XXXX/XXXX. I am needing for the loan guarantor which is TG to have their service provider XXXX XXXX to remove these defaulted loans from my credit immediately as agreed with the TG provider who is the loan guarantor of my loans. My student loans are showing multiple times on my credit as the defaulted loans still show and the current loans show. So if I miss a payment on my current loan, I will be penalized twice on my credit report for the same loan. By TG not working with their servicer XXXX XXXX to delete the accounts is in violation of Section 623 ( a ) ( 2 ) of the FCRA. FTC advisory opinion : XXXX which interprets Section 623 ( a ) ( 2 ) of the FCRA. The issue posed in the advisory opinion is how a lender is to handle a situation when subsequent information updates a report that was allegedly accurate when it was made but no longer is accurate in the present time. The advisory opinion states that the Section 623 ( a ) ( 2 ) of the FCRA addresses the duty to correct and update information by " furnishers, '' or persons who furnish information to consumer reporting agencies ( " CRA '' ) such as credit bureaus. In particular, this section requires a person that " has furnished to a consumer reporting agency information that the person determines is not complete or accurate '' to " promptly notify the consumer reporting agency of that determination '' and provide any information needed to make it complete and accurate. Thus, on its face, this provision requires a furnisher to provide corrected or updated information to the consumer reporting agency that it had reported to originally. This duty extends to all student loan accounts reported to CRAs, regardless of whether they were accurate at one point, because the section requires the furnisher both to " update '' accounts as well as to " correct. ''

Since XX/XX/XXXX I started to notice in my XXXX XXXX app that a Company called Trellis Company previously named ( Texas Guaranteed ) was excessively reporting interest accrued to my credit report and I have snap shots of the odd amounts that went up and down. Making it seem to the credit bureaus I was paying it in reality they are abusing the system to hurt my credit score and keep me from ever going over 600 credit score. I was at XXXX and XXXX, preparing to see a significant good change and instead I saw XXXX dollars increase balance??? I called and could not get a straight answer as to why. I later find after digging into their website that they are within the guidelines of the cares act and are in fact abusing the system. 26 payments in a row consistently according to XXXX XXXX?! Its not me making these payments then who is it? I saw in my Student aid account today XX/XX/XXXX that an entity was awarded {$14000.00} where did this money go to? So I took a loan out before I was ever born?! Right, so while I was yet still in my fathers ... .. I applied for a loan and just happen to be affected by this before my own conception?! I have contacted XXXX XXXX in regards to a Student loan that has defaulted agreed to enter the Rehabilitation Program with a payment of {$58.00} a month due by the XX/XX/XXXX of each month ; however, my wages have been garnished from my place of employment either way. I do not understand why this is happening. I received a letter in the mail dated XX/XX/2018 stating : You must make at least nine ( 9 ) monthly payments during a ten ( 10 ) consecutive month period in the amount of {$58.00} due on the XX/XX/XXXX of each month as agreed to between you and XXXX under the established repayment agreement. Under the rehabilitation program, the full payment amount agreed to must be received within 20 days of the payment due date. A payment made more than 20 days before or after the due date will be credited to your outstanding balance but may not count toward the rehabilitation program. This may delay completion of the program or require you to start the program over. I did receive a letter in regards to a garnishment to begin XX/XX/2018 if I did not contact or settle into agreement of repaying my student loan ; however, I did contact the company prior to that date and settle to enter into the Rehabilitation program. I did pay my payment of {$58.00} in two payments : a payment of {$46.00} on Saturday XX/XX/2018 and {$20.00} on Thursday XX/XX/2018 well within the 20 days as stated. I log onto my online account see the payment of the {$66.00} but I do not see my wage garnishment of {$200.00} applied at all to my account. I spoke to a XXXX in regards to this issue twice and asked if my account is placed on wage garnishment why does it state online " Your good faith payment of {$58.00} is due by XX/XX/18? She said that is incorrect and should have taken a couple of days to come off my online account since the garnishment was put into place from XX/XX/18 ; I told her a couple of days we are now XX/XX/2018 that is more than a couple of days and she said there is nothing she could do to help and the garnishment will not be cancelled. I told her so my online account information is incorrect which is deceiving and a lie. It should not show that I am on a rehabilitation payment and still get my wages garnished at the same time. How is it that I paid my Rehabilitation payment well withing the 20 days as stated on the letter and had my wages garnished of {$200.00} but yet that garnishment is nowhere to be seen applied to my account. I feel that this company is not for the people or in any way to help the people. I mentioned to XXXX how unfair is that and I have other loans with the XXXX that have been put on a payment plan/IBR and she told me we have no affiliation with XXXX. Please help to stop this ; I am scheduled to give double payment by paying the Good Faith of {$58.00} and have my wages garnished? My fiancee and I live in the XXXX, CO XXXX area. We have struggled to work through several layoffs and I have supported us both for the last 7 years combined. On top of this, the housing market here has exploded thanks to the legalization XXXX. Rent doubled almost overnight forcing us to give up our apartment and rent a small basement from a private home owner and put most of our things in an expensive storage unit. Several years ago, I entered into a rehabilitation program with Texas Guaranteed to make payments for 9 months at which time responsibility would return to XXXX. Texas Guaranteed would not work with me on the payment amount which led us to move to another suburb that had cheaper apartments so I could pay them and pay all of our bills. After barely meeting TG 's requirements for the 9 monthly payments, XXXX took over again. I made payments for about another year at which time my Fiancee went through her second layoff. I applied for a forbearance/financial hardship and was denied. This is only based on your GROSS income! I have been supporting XXXX people in an area with a skyrocketing cost of living increase and they denied me. I contacted XXXX to speak to a human instead of online applications and the only response I got was - apply online for financial hardship/forbearance. I could not afford to make payments so my loans moved to default and back to Texas Guaranteed. In addition to this the Department of Education ordered the XXXX Treasury to withhold my Federal Tax Returns. They have withheld thousands of my tax dollars over the last XXXX12 years. TG calls me constantly. This time they sent me a letter stating they had added fees to the total I owe for my student loans. When this began, I owed XXXX. Now, TG says I owe XXXX including their substantial fees. That adds up to an increase of 33 % above the total I borrowed!. I also have collection companies trying to cash in on this as well. They are trying to collect on specific loans even though TG is already supposed to be the " XXXX '' of my loans partnered with XXXX. After receiving this letter, I have received a new XXXX stating they are going to have my wages garnished. I can not afford this!!! I am still supporting myself and my Fiancee while she searches for work. While going over this new letter threatening me with garnishment, it occurred to me that there is some fraud going on here. Texas Guaranteed and XXXX as well as the collection companies are still charging me for my full, original loan amount plus 33 % in fees and interest. This begs me to question ... ... ... ... ... .. First of all, what happened to all the monthly payments I made to both organizations? Second, what happened to the thousands of dollars the US Dept. of Ed and the US Treasury withheld to go toward my loans? Third, how can it be legal and ethical for these guarantors to charge fees that make it impossible to ever pay these loans off?

XXXX has completed my disputes but the results are just as incorrect and I 've filed disputes multiple times. I can honestly see that XXXX is letting a computer determine the results because they do n't even make sense. When I call the executive office, they do n't really want to help, the only thing they want to do is argue. There are multiple incorrect accounts of which XXXX creditors are reporting incorrectly. The first XXXX is XXXX Bank, they have violated their terms and agreement and the late payment that was reported is incorrect. XXXX Bank has been reported to the FDIC for the improper conduct and the late payment was removed from XXXX and XXXX . The second Creditor is XXXX XXXX XXXX , they sold th e account to XXXX collection Agency and as a result that TERMINATED the company 's legal right to continuously report. I 've sent in the info to show that the account was settled and closed in XXXX XXXX XXXX , XX/XX/XXXX has yet to update and correct the account as closed. The third incorrect Creditor is XXXX , XXXX is incorrectly reporting that the account is still being charged off As of XXXX XXXX that is incorrect the account was settled and closed in XXXX XXXX XXXX , XXXX has yet to correct this. I know it 's not XXXX 's fault because it 's been corrected on other bureaus except XXXX . The last creditor is XXXX . On XXXX XXXX XXXX has incorrect and mismatching information which violates several FCRA laws. I 've disputed and complained, sent in letters and the XXXX accounts are still incorrect. Multiple months are missing payments and it says ND ( no data ) instead of OK. That is incorrect and a violation. The fifth Creditor that is reporting incorrectly is Texas Guaranteed XXXX XXXX XXXX . This was not a collection account nor charge off in XXXX . The account was paid and closed in XXXX . It has a negative payment for the month of XXXX when it was clearly paid off and closed. Another reason how I know it 's incorrect because the XXXX of XXXX does n't allow individuals to consolidate a student loan that is in DEFAULT. These companies are clearly violation FCRA. Experian is allowing the Creditors to report invalid information in addition to reporting and coding certain incorrect information on the credit report in order to recieve a profit. I 've asked several humans/managers/supervisor to look into this And not to let a computer decide, instead the only thing they do is dispute and let a computer decide. It 's a disappointment because XXXX line of the XXXX Mission Statement says " transforming our relationship with consumers and delivering growth consistently ''. While enrolled as a full time college student I was suddenly struck by a vehicle as a pedestrian. Needless to say this caused me to withdraw from many of my courses for an extended period of time - to which I did report promptly to the governing body within the school in question concerning my need to forego a semester or two. The Withdrawal was misinterpreted by my institution, not as a medical necessity, but as a lack of appetite to attend & complete my degree. Ultimately this dispute was finally resolved within the Institution and the Medical Record, Police Record of the Actual Accident and so on were presented along with an appeal to reinstate my Academic Standing in good form. These proceedings did not, however, impact my Student Loan Status. As this entire process did take an extremely long time I was forced into default on the Loans. Now years have passed, & I have had Lien on my Tax returns each year to the tune of thousands of dollars. Thousands of dollars in payments towards these loans and no ability to gather any specific information about the apportionment of the monies collected to pay the loans. Finally I am able to receive some information after Legal Request. I am able to see in black and White the figures of these Thousands of Dollars of mine that have impacted this loan to no avail. Each payment has been deliberately been forwarded to pay interest and not one penny towards the loans Principle. I have more money to give these Loan Sharks - But I can not in good faith begin making any payments at reducing this loan to any degree now knowing that they are taking advantage of me to no end perpetually with not one penny towards the Principle of the Loan. As you may imagine, paying Interest Alone could go on forever to no end. My complaint revolves around the severe financial, personal, and career consequences I incurred due to false and misleading information provided to me by Texas Guaranteed. For years I was making payment on loans of about $ XXXX with a monthly payment of {$300.00}. Around late XXXX I started falling behind as I received a severe paycut at my job of about 20 % due to loss of bonus at XXXX XXXX.I contacted Texas Guaranteed numerous times and each time they said I had already exhausted all options and there was nothing I could do. I was still paying though even if late. Eventually I could not keep up and tried to find another solution as lates were starting to impact my credit rating. No one ever returned my call. A few months went by and I finally gathered a few hundred dollars by selling off personal belongings. I called to try and make payments and I was denied. They wanted ALL payments that were past due. This was not possible as I had just a few hundred not thousands of dollars available. As a consequence I was advised to wait a few months because they had another solution for me. Their " solution '' come to find out in late XX/XX/XXXX was that they had filed for a WAGE Garnishment! They immediately started taking {$650.00} per month which was over DOUBLE my regular payment of {$300.00}. I called again pleading for help. They said this was the only route to reinstate a good standing and then conned me for MORE money. They said I had to pay another {$120.00} per month penalty as well. So all in for almost a year they took $ XXXX per MONTH. As previously advised I was already lacking enough funds prior to any of this. This lead to defaulting on all my credit cards as I simply didnt even have any money after rent and student loans and barely any food to eat. After a year they stated congrats you are back on track, we will remove garnishment. However they had ADDED nearly $ XXXX as a " Collection Fee '', So aside from wrecking havoc to my credit forcing me to default, losing 60 lbs due to near starvation, losing apartment and living in my van they ADDED $ XXXX after I had already been garnished/paid nearly $ XXXX! This damage continues to this day. My student loan is now being serviced by another but it reflects an LTV of over 130 %. This loan has been negatively amortizing even though Ive been paying for nearly 2 decades!!! I need all this investigated, fees/penalties removed, lates corrected and compensation for ancillary impacts such as credit decline, increased cost of borrowing, homelessness ( due to forced garnish ), and overall lying and stealing tens of thousands from me.

To Whom it May Concern : I'm currently a XXXX XXXX XXXX XXXX that qualifies for XXXX Loan Forgiveness. According to the rules, I can get up to {$17000.00} because I have met the requirements for that particular forgiveness. I know this because I've had {$11000.00} forgiven in XX/XX/XXXX from my student loan balance of {$15000.00}. Currently, I have {$4400.00} left in 2 loans according to my XXXX account. My guarantor for these 2 loans are the state of Texas which is now Trellis Company. Trellis Company continues to create difficulties for my application in order to get the {$4500.00} forgiven. I have applied seven times. Five out of the seven times, I was told that the documents were not legible. I was told that in XXXX, XXXX, XXXX, XXXX, XXXX, and now again XXXX. The first time I applied was XX/XX/XXXX at the end of my 5 year. My last submission on XX/XX/XXXX, I made sure to clearly type the application and have the appropriate signatures done neatly by both myself and previous administrators. I was denied because I was told the application was " too light '' and that they could not confirm that XXXX XXXX still works at the XXXX XXXX ( which he does ). No phone calls were made to the XXXX to verify his employment nor were there any contacts made to him directly. Now I am being asked to show his employment verification of his position which I am not allowed to request through my HR department. Now with my most recent denial, I'm being asked to do something that is not within my boundaries. All were and have been in good standing ( deferred ) until XXXX drop the ball and defaulted all of my student loans they were holding. According to them they were n't aware of my school attendance. My loan was escalated improperly in XX/XX/2016. In XX/XX/2016 I called XXXX to secure a deferment as I was unemployed and receiving UE benefits, Food Stamps, and XXXX. I was only offered a Debt Consolidation for those loans. I was unable to accept that option based on research I had done. I advised I would call back after I started work. I called back in XX/XX/XXXX. Although, I had just started working, I attempted to make a {$50.00} payment. The representative said I needed to make {$150.00} payment and could not accept my payment. I advise there would have be no reason for me not to have been in some kind of deferment since I was and are still on government assistance. I am now working full time, but I am just barely catching up from being off work. I am also facing eviction because my taxes were taken. I know the government does not require notice if they are taking something, however the servicing contract XXXX has with the government should include proper acceleration of a loan to allow the borrower in financial difficulties to cure. Again I add, I have been on deferment with the other loans I currently have with a different servicer and there would have been no reason whatsoever for me not to have been on deferment or forbearance with XXXX. This should have never escalated to this point. XXXX falsely notified DOE/Treasurer that I was not trying to cure to the point my income taxes were taken.

I have contacted Texas Guaranteed loans collections agency several times in the last few weeks/months attempting to resolve issues regarding a defaulted loan that lead to my tax refund being offset. The first time I was contacted, I spoke to XXXX of their representative XXXX whom was very rude and would not answer my questions regarding the default, instead she was coarsing me into starting a payment plan and this after i previously stopped a wage garnishment while attempting to figure out exactly why I defaulted on a loan, when i have either been a XXXX student or when in between schools have requested for a forbearance. When the initial federal student loan pause was commenced i continued to make voluntary payments until around XXXX of 2021 when I was made aware that i did not have to make the payments and in fact could receive a refund for the voluntary payments i had made since the pause had began. The refund amount was sent for {$1700.00}. My Loan servicer, Trellis company, sent out the refund check and it was lost in the mail. The loan servicer required 90 days to elapse before a new check can be issued. After the 90 day wait time a new check was issued however this check was intercepted and fraudulently cashed.On XX/XX/2021 I cooperated with the loan services providing an affidavit that was notarized indicating that I am willing to press charges to the fullest extent of the law against whomever fraudulently cashed my check as well that i was not involved. This process with trellis was initiated almost a year ago approximately. I spoke to Manager XXXX XXXX and his supervisor XXXX and explained my situation. XXXX advised me that i need to contact Trellis company 's bank, XXXX XXXX for additional information. I did reach XXXX XXXX ( relationship manager at XXXX XXXX ) I again explained the situation and was advised that now XXXX XXXX XXXX ( where the funds were fraudulently cashed ) is causing the delay in the fraud investigation. Again it has been over a year with no response from XXXX XXXX or XXXX XXXX XXXX I have maintained communication with both frost bank and trellis company throughout this process via email and telephone calls leaving voicemails and never hearing back. Trellis company contact number XXXX XXXX bank relationship manager XXXX XXXX XXXX XXXX I dont have information for the XXXX XXXX loss preventention department. i also further believe that my loans were rehabilitated and then due to internal errors between dept of ed and loan services was then back in default. If you review the loan history you can see a history of payments so the fact that the account was rehabilitated and then went right back into default was news to me. I believed that my loans wer not in default since the had gone through the rehab process.

They are an out of touch and carelessly, corrupt and unregulated because their interest rates are not realistic to student abilities to ever catchup and depend on small payments to sustain and prolong the misery to students. Also corrupt is the Treasury Dept willingly giving my entire paycheck to the pigs at Texas Guaranteed. The latter literally refers to 100 % without any warning or rule or regulation making it a reasonable percentage portion, but instead all of it was taken. Is there no percentages that limit amounts? How can it be the total earnings? Where is tax payers government when needed if our very Federal Treasury Department is doing this for rich corporations intoxicated by anything goes tactics? I have bill realities to contend and attend to and one of them is insufficient funds and accumulating charges versus income and an appropriate balance to be kept. One of them is my son going to college himself this spring. The whole check of a months worth of work is gone without notice of its being taken or even a 40 % amount would have been impactful, consequential and resonable enough but the whole paycheck? Why has the federal government allowed this to be carried out as such? Versus a reasonable and understandable amount? The latter is counterproductive to domestic down to earth income and survival. Why did the federal government take a full income and feed it to a loan corporation in its entirety? Why was I mistreated to a 100 % garnishment? A company Called Texas Guaranteed, later renamed Trellis Company sued me in the wrong jurisdiction, the state of Texas, and I have never even been to Texas. I live in New York. They started garnishing my wages while I was working at XXXX XXXX and that was how I learned they were suing me, they didn't even sue me first to obtain a judgment, they just started garnishing my wages. They also added over {$2000.00} onto my loan. I spoke to the federal government in XXXX and was told I had no federal student loans, they were all private. How did these 2 loans suddenly become federal loans? I was forced to pay {$130.00} per month to Texas Guaranteed, now known as Trellis in exchange for them to stop garnishing my wages, which they were taking over {$200.00} a paycheck as a garnishment. I told them several time they were suing me in the wrong jurisdiction and that it was illegal but they did not care and stated they could get away with it. NSLDS states the total borrowed on one of the loans was {$2900.00} & with an outstanding principal as of XX/XX/XXXX of {$2300.00}. The second loan states the total borrowed was {$11000.00} and the outstanding principal as of XX/XX/XXXX was {$9100.00}. The loan was also for some reason put in forbearance without me knowing or being told on XX/XX/XXXX. I will attach documents but Texas Guaranteed now known as Trellis added on fees, sued me in the wrong jurisdiction, started illegally garnishing my wages to force me into a payment plan from the wrong jurisdiction and added on thousands of dollars in fees to my loans. I had to switch the loan to another service provider because they were not providing me tax forms for the IRS so I could do my taxes and I have need them held accountable for their actions. I would like the loans to be wiped out and the fees taken back and to refunded for the payments I was forced to make to this company as a result of my wages being garnished and me being sued in the wrong jurisdiction. I received a letter datedXX/XX/XXXX stating that I owed a student loan debt in the amount of {$31.00}, XXXX to a company called TG. Their address is XXXX XXXX XXXX XXXX XXXX, TX XXXX Their phone number is XXXX. Their website is www.tgslc.org. This letter threatened to enter me into the DOE offset program to garnish my wages and tax returns. I called the company, who instructed me to send them all of my personal info documents -- driver 's license, social security card, etc. I refused to do this, however, since I have no business with this company, and the more information I give them, the more likely it is that they can steal my wages and tax returns. I sent them a debt validation letter. They returned a letter to me with a promissory note from someone with the same first and last name. That is where the likeness stopped. This person has a different middle name, different social, an address where I have never lived, a phone number I have never had, different birthdate, a city I have never lived in, a different driver 's license number, a lender name I have never used, and relatives with whom I have no relation to. Furthermore, they are still demanding my sensitive personal information along with FIVE writing samples from XX/XX/XXXX. I do not want to provide this information to a company that I have no business with. TG has shown gross negligence in identifying their debtor. This can not be a simple mistake. I only share this woman 's first and last name. No other like identifier exists. They also violated this woman 's privacy by sending me her promissory note with all her personal information. I keep having to dispute a company on my credit report. In the month of XXXX I disputed a company called Trellis Company on my credit report. The credit bureaus take this debt off my credit report because they verify that it is not mine, and then XXXX months later its back on my report and I have to dispute it again. I do not know who these people are. I contacted the company and was told it was a student loan. I have not had a student loan in 30 years. The student loan that I did have was paid off years ago, and the school is now closed down. I will not ever pay them. This Trellis Company is committing fraud and trying to get money from me that I do not owe them. They keep reporting me to the credit bureaus and the credit bureaus keep putting them on my credit report. I have had to dispute this at lease XXXX times now. I want them taken off my credit reports and never put back on there. I am sick and tired of having to fight something that I do not owe. I want the credit bureaus to stop reporting false information on my credit report as well. Just because a company says you owe something does not make it true and for them to just put things on my credit report is just plain wrong. I have proven that I do not owe this company a XXXX and they keep adding it to my credit report. I also want them to take off the bankruptcy from my report as well. They told me they verified the bankruptcy but that was a lie. I called the courthouse and was told that they do not verify bankruptcies, so how was it verified. I even have a letter from the court. Hello received a call a few months ago about a Consumer Debt reduction plan called XXXX XXXX XXXX to lower my dept by lowering the APR 's on my credit cards. I told the guy it really looked too expensive ( 5 payments of {$170.00} per month ). I asked if I could cancel at any time and the guy selling me the service I could at any time and texted me an ACH Payment Auth form that said if I wish to revoke this auth and cancel any scheduled debit to my account I can do so within 3 days of debit and to notify them at XXXX XXXX XXXX XXXX. They had me agree on the phone and they talk so fast and they said that should they not do their job I 'm entitled to a full refund. So I called in XX/XX/XXXX to cancel and the person said ok. On XX/XX/XXXX my account was debited. When I called this time. I could told I did a verbal commitment and could not cancel and they will continue to debit my account because ( I ) did not finish the business with them. They also told me they will report it to the credit bureau until the full amount was paid. Nothing is in righting and if I would have known that the contract was irrevocable I would have never agreed to such a thing. Please help me cancel with this company. All I have is a phone number and they are very rude and refuse to cancel. They make me feel like I 'm abusing them and I signed a mtg agreement. This is misleading and wrong. Please help me. I defaulted on my student loans when I got out of school, because I did not have a job. Texas Guarantee has sidestepped every effort I have made to get these loans out of default. My original loans were about XXXX. Texas Guarantee wage garnished me for 5 years and took almost XXXX from my checks. Texas Guarantee refuses to set up a payment plan and is about to wage garnish me again. They say I still owe over XXXX on my loans. It is easier to wage garnish me, and much more profitable, because I qualify for a low payment. Texas Guarantee is running a racket and has ruined my credit. The people that work for them have no idea how to follow instructions. The new case worker has telephoned me one time. I have asked them to email me repeatedly. I have sent my income tax to them and answered every single question they have asked. It is not an advantage for them to get people out of default, so therefore, they do not put much effort into it. I requested a hearing, and they have given me less than a weeks notice. I tried to get it scheduled for another date and they refused. They are the most difficult company I have ever tried to do business with. If they do n't set up a payment plan for me, I will not let it go back to wage garnishment. I will quit my job and go on food stamps, before I ever let anyone take money from my check that I do not get credit for. Texas Guarantee is a governmental agency which is allowed to steal from the public and has no oversight. All I have asked for is a payment plan and to take my loans out of default.

In XX/XX/XXXX, I reached out to my loan servicer Texas Guarantee Loan or the Trellis Company about payments that were being garnished and were being applied only to the interested and collections fee. Their response was that they were following federal regulations for student loans. However, they advised that in response to the expansion to covid-19 relief act on the Department of Educations guidance, they were in the process of halting garnishments and were working to 'refund the garnishment payment dating back to XX/XX/XXXX. ' As of that contact, I failed to hear from them about this. As of the last week of XX/XX/XXXX, I have consolidated all my loans with another servicer because of how difficult they are to work with, but when I reached out to Trellis in regards to the 'refund of garnished payments ' they stated that my loans were now closed and did not even make an effort to answer my question. My complaint is regarding this refund. I would like to find out if the refund of those payments were completed and or if those payments were applied to the principal balance at all. I was being garnished approx. {$200.00} a paycheck and for a whole year that would be approximately {$2400.00}, or maybe more. I know that may not be a large amount, but I still want to know that they were applied correctly. I do have emails in regards to this conversation and can forward those upon request. I have also submitted this complaint to the US Department of Education and Federal Student Aid.

I have a Texas guaranteed student loan-which originated 1st with XXXX XXXX XXXX and has been transferred to Texas guaranteed student loan corp. Im contacting you because unjustified wage garnishment of Temp worker, because the lender is unwilling to accept less money than possible. I requested copies of original loan agreement w signature and they only sent a statement and not original docs. XXXX/XXXX/2016 wage garnishment is supposed to take place. Also, 2 years ago, I submitted for a payment plan and was told {$45.00} was my payment which I agreed to do, provided all information, and then while I was waiting for approval, was told I needed to give address of reference, and I did call to do so. The person who i spoke with didnt submit the information of address, then because of the lender employees fault of not submitting was told I was turned down and had to do everything from the start. I have told the lender the situation and they only said now they want {$350.00} now to negotiate. Im a temp worker. I had unemployement for XXXX week this month, and they wont renegotiate to what I first was approved for. {$45.00}. They want me to go through the whole process again although I did everything they asked. I want to be a plan of {$45.00} as I agreed long ago and copies of originals. And no wage garnishment.

I first contacted Trellis on XX/XX/XXXX disputing the first date of delinquency. I asked for proof of payment history to back up the date. All I received was a loan summary with ZERO payment history that they sent XX/XX/XXXX. I was told via email that XX/XX/XXXX was the date of delinquency was given by XXXX but there is ZERO paperwork of them getting this date. If there is, it wasn't sent to me as requested. This company is in violation of 623 ( a ) ( 5 ) ( A ) ( ii ) as they didn't follow reasonable procedures to obtain the original date of delinquency since the original creditor did not list it on my credit report. ALSO, once I disputed the information, they violated the FCRA by not conducting a reasonable investigation. I did a reasonable investigation and obtained payment history from the original creditor that is listed. The original date of delinquency is XXXX of XXXX. All of this is backed by email correspondence. That was the date I fell behind and my account was NEVER current from that point. I have payment history, they don't. There is NOTHING to back up THEIR date This company has CLEARLY violated the FCRA and I want these accounts IMMEDIATELY removed from XXXX, XXXX and XXXX. I'm confident that now that I've pointed out this issue and completed THEIR investigation for them, which all I did was make a phone call to the original creditor, that I will have the desired outcome I asked for.

First I do apologize for bugging CFPB in reference to this problem. I previously submitted a complaint against The Trellis Company in reference to a Student Loan from back in XXXX. I received information through CFPB, per Mr. XXXX XXXX to contact him. I contacted Mr. XXXX in which I asked him for information showing I did not ask for this forgiven loan to be repaid by me. I informed Mr. XXXX the last thing I knew about this loan it was forgiven. I also informed Mr. XXXX if something had changed no one notified me in any way. I informed him nothing, to this day Ive yet to be notified from anyone at Trellis Company in any way. I have contacted Mr. XXXX numerous times only to be sent to his voice mail. I have left numerous voice mails messages however, he has yet to return a call or supply me with any documents. I feel this is the same reason a {$2000.00} XXXX XXXX is now over {$6000.00}, due to not being notified or communicate with. May I PLEASE have some assistant with this from CFPB? I received a letter from the Trellis Company on XX/XX/2020 claiming that I owe {$11000.00}. They went on further to say that I defaulted on this obligation. I saw no other information about who the original lender was, and what the terms and agreements were for the loan. They simply stated that I owe {$11000.00}, and they would proceed with contacting the U.S. Department of Education to resolve the issue. It appeared that they were coercing me to make a decision. There was no other specific information as to the account number, the initial date the loan was started or which financial institution loaned me the funds. I financed my education for my degree with grants, scholarships, veterans financial aid, work study, and regular employment with two jobs. I need Trellis to be forthcoming with specific details. I am currently paying for defaulted student loans with an offset of my social security and income taxes with the United States Treasury. My current financial situation is dire and difficult I have fully cooperated with my lenders. I am currently on an IBR because I am at the poverty level, and I have a serious medical condition with high medical bills and prescription medicine that I take. I am on a Federal Loan repayment plan and have set up monthly payments to offset my past due amount. I spoke with a representative at Texas Guaranteed to set up all the details and spoke with them at length about my options. I was told that I could make monthly payments that were configured based on my income and my bills and that after I had made enough qualifying payments that my loan would be considered in good standing. In my first conversation with Texas Guaranteed representatives we discussed taxes and noted that I had not been able to file in the past couple of years because I was the victim of identity theft. We discussed that I hoped to file this year. I set up the payments and have made them on time since I set them up. I was able to file my taxes and was expecting a federal tax refund of almost {$3000.00}. A couple of days after the IRS notified me that my tax refund was supposed to be deposited in my account I had to call several different numbers to find out that my tax refund was seized by Texas Guaranteed. At no point in our discussions was I notified that my federal refund would be taken, and I did not receive anything in the mail that my federal refund was going to be taken. I called a spoke with a different representative and was basically told 'oh well too bad we wo n't release your refund '.

I had a Stafford subsidized loan that went into default. My servicer was Texas Guaranteed. They began garnishing my wages, and on top of the 3.5 % fixed interest of my loan, Texas Guaranteed saw fit to charge an additional 12.5 % each month as a " service fee, '' even though my HR department did all of the labor to complete the transaction and Texas Guaranteed just passively took my money. I tried multiple times to transfer my debt to another organization, but Texas Guaranteed refused to relase it. The debt is now paid in full, but the account still shows delinquent on my credit report. If this is n't a crime, it should be. Somehow, my generation and income bracket ended up being the first people in history who actually had no way of getting out of debt without being subjected to the abuse of a private debt collector. Even bankruptcy would n't have saved me. I was n't even an adult when I ( actually, the signature on the MPN was forged by my mother ) signed up for this loan. I was unfairly pushed into the idea of signing up for the loan by an education system that misrepresented the return on investment that it would provide, and the loan was approved without consideration for my ability to repay because it was guaranteed that I would be compelled by the U.S. federal government, without recourse.

These accounts have been consolidated in XX/XX/2014. At no time was I contacted in writing by XXXX XXXX XXXX XXXX XXXX about my multiple accounts being delinquent or sent to collections. Texas is currently reporting this as a collection account. This is not only inaccurate, but it is placing my military clearance in jeopardy. XXXX XXXX XXXX is reporting multiple accounts as 120 days past due, all having a XXXX balance, and all in excess of 7 years old. At no time, have I ever had any written correspondence from XXXX XXXX XXXX indicating I had past due loans. I did not even know I had loans with XXXX XXXX XXXX. XXXX XXXX is also reporting that I had student loan accounts with them in excess of 120 days past due, many of which are greater than XXXX XXXX XXXX. At no time did I ever had any written correspondence from XXXX XXXX indicating I had past due loans. Another student loan creditor, XXXX XXXX XXXX, is also reporting multiple loans as 120 days past due and these loans are older than 10 years. The United States Department of Education/XXXX is also reporting 14 old student loan accounts as payment after charge off/collection. Most of those loans, if not all, are in excess of 7 years old.

XXXX student loans in XX/XX/XXXX were taken out that had 6 month terms that were ironically XXXX loans totaling the exact same amounts as defaulted amounts on letters I received claiming I was in default for these amounts. On XX/XX/XXXX, I receive a letter of collection from XXXX ( XXXX XXXX, soon to be XXXX XXXX ) about a debt that I am already paying on via offset of my Social Security. They are threatening collection action if I do n't make payment arrangements ( current letter included, dated XX/XX/XXXX ). I have been paying this debt, above a reasonable amount since XX/XX/XXXX ( Documents attached, except XX/XX/XXXX as that document is missing ). This company does not participate in an Income-Driven Repayment Plan with the US Government, Dept of Education, yet, they collect for the Dept. of Education. I have submitted such a request ( IBR ) to the Dept. of Education, via XXXX, and they have long-since accepted this. I am currently on forbearance. I highly resent their letters to me threatening collection when they are already collecting on the debt. I do not talk to them as they contact me through various, unknown phone numbers and often, the people on the other end are not helpful. I took out a student loan back in XXXX in the amount of $ XXXX for XXXX school. I started paying them back but after 3 years I was pregnant, moved, and did n't work for a while. They deferred the loans but eventually they went into default. Texas Guarantee has been trying to collect payments for a student loan that 's not mine. For the past 2 years, they 've taken my tax return and I 've to them the loan is n't mine. Problems started from the very beginning with trellis. They gave me the option to consolidate and add a ton of interest or threatened to mess up my credit and keep me in default and take my money from my work. They even locked me out of my account so I couldnt pay. They didnt let me in until I threatened to get a lawyer. I was not about being forced into adding $ XXXX to my loans so they took the money from my checks. They will not let you pick how its applied so they put the money towards the low I retest loans first leaving the high interest. I have finally gotten to below {$1400.00} and they stopped cashing the checks and threatened to give my money back. Because they Have been charging illegal interest against covid rules and still taking my money. I wrote them and called them. Then emailed what they told me to. I emailed them to keep the money and apply the illegal interest towards the loan. Instead they have now sent me a refund and put all my balances back to $ XXXX on the higher interest loans. On XX/XX/2021 the federal government made it possible for those who had defaulted on their student loans to get a refund of the payments they were making to get their loan back in good standing. I had been doing this for 7 months thru Trellis. I requested a refund of the money. I had been paying them $ XXXX/month for a total of {$930.00} when this possibility was made possible. I requested my refund of the {$930.00} on XX/XX/2021. They still have not refunded my money. I have made 3 attempts to contact Trellis and find out why. Each time they say the money was sent to the wrong address ( meanwhile I have received regular correspondence from them at my mailing address ) and they would send me another check. received document from the company ( trellis company ), stating that they had acquired a delinquent student loan debt from another company. I received this notice on XX/XX/19, however the letter was dated, XX/XX/19. With that, the letter states that they ( trellis ) acquired this debt from another company ( XXXX ) who was well aware of the fraudulent nature of this student loan, as I not only have never taken out a student loan, I have never been a student outside of receiving a free public high school education. Trellis Company, formerly known as Texas Guaranteed, contacted my employer on XX/XX/XXXX with a garnish order for unpaid student loans. This issue is the error of the Trellis Company. For every semester a student takes a loan, the company has it in their system as a separate account. I send one check a month and the company splits the payment between five accounts. 11 months ago, they started splitting it between four accounts and left one unpaid without notifying me. My credit is ruined and they are going to garnish my wages for 15 % of my income. I don't know if I ever took this loan out. I haven't been getting credit for my payments. Texas Guaranteed sued me in Texas, i live in New York, and garnished my wages prior to the judge giving them permission to per the court paper work i have. Now Texas Guaranteed is called Trellis. I recently learned that Texas Guaranteed Student Loan Corp. was reporting that I allegedly owe them a debt. I mailed notice disputing the alleged debt. I sought numerous, very specific documents that would substantiate TG 's claim that I owed them any debt. I am attaching a scanned copy of the request, the credit report, along with all other pertinent documents. In reply, I received from TG : " a True and exact copy of the original '' alleged note which shows TG as the Guarantor or lender. However, not only have i never procured a loan from this company or any other student loan guarantor, I have never been a student, considering I began to serve in the U.S. military directly after my high school tenure and have remained XXXX since XX/XX/1998, thus proving that I have not been a student since XX/XX/1998, and could not have applied for any student loans. A woman called on XX/XX/2018 at XXXX and refused to identify herself other than to say her name was XXXX. Asked her at least 5 times to identify the company or what the call was about because she wanted me to confirm my name and year of birth before she would say who she worked for. Finally identified the company as Trellis Company, who I do have a payment plan with. I pointed out to her that it was XXXX in my time zone, which didn't seem to phase her at all. I was fired from my job XXXX of this year and just received notice from the IRS that they are taking my tax refund to pay an unpaid federal debt. I checked my credit report and my student loans are all in good standing. So I tried calling the phone number listed on the screen and the answering system stated that the company I was calling was a debt collector Trellis Company any information obtained would be used to collect the debt. I was never notified by Trellis Company that they were taking my refund. The one and only notice that I received was last week from the IRS after they finally approved my refund. I paid {$500.00} to receive a XXXX yr forgiveness on a student loan. I was granted the forgiveness and a payment plan was established with the Federal government. To date, those payments are current. The loans that were supposedly forgiven ( school is defunct ) are now being garnished from my wages because a debt collector sent a letter to my employer stating that by law the money can still be collected. The collector stated a court order, however no court order was sent to my employer or myself. The order was issued by the collector. According to my credit report, the loans that were forgiven are listed as closed. These are now being garnished from my wages by the collection agency.

Original loan service purposely kept me in default to collect outrageous fees and interest for years without every paying a dollar toward principal. The Trellis Company is a collection agency that is requesting money from me that I have already paid and I have records to prove it. There was one other collection agency which was XXXX XXXX and they passed it to Trellis Company. Trellis Company took funds from my Social Security. I sent letters to them and they still continued to sent threatening letters to take my wages and any other monies. I think this is fraudulent and I'm willing to believe that other people have had this done to them. Trellis, formerly known as Texas Guaranteed sued me in the wrong jurisdiction, I live in New York and they sued me in the state of Texas. I have never been to Texas. They also added on thousands of dollars in fees to my loan. they also started illegally garnishing my wages and forced me into a settlement over the telephone in exchange for them to no longer garnish my wages. They took over {$300.00} from each paycheck and forced me into poverty. While I was paying on a credit recovery plan on my Texas Guaranteed loans through XXXX I was under the impression that once I finish that plan that I was going to continue making payments to XXXX to finish paying off my loans. However once I finished with the plan they transferred it back to TG without my knowledge. I had to actually call TG to find out what had happened to my loans with them. Had I been informed that would have happened in the first place then I would n't have had issues paying TG right away. This switch also happened right when we moved from one state to another so it took some time to get it straightened out.

About 2 months ago, I received a phone call from TG XXXX, stating that I owed a {$100000.00} student loan debt I did n't recognize. The rep I spoke with apologized and said they would take my name off the list. Hello. I was a student at the XXXX XXXX XXXX at XXXX XXXX. My students loans were transferred to Trellis Company a few years ago. Under the Cares Act, current student loans are forgiven for the time being because of Coronavirus. Currently I continue to received threatening and harassing letters from the company Trellis, who currently has my student loans. Trellis company is willfully ignoring my requests and willfully violating my rights. I have notified them about identity theft. The loan includes a 100 % origination fee to the student loan request which is considered predatory. Additionally, the university had an 18 % student default rate at the time of the loan. The borrower was unaware of the default risk until after the loan was executed and transferred to the US Department of Education. Trellis Company, the debt collector to whom I have been paying my student loans agreed to accept a smaller portion of monthly payment. After the agreement, they were supposed to send my employer a letter so that they could stop taking payment from my check. It has been almost 2 months, and they have not sent the letter. I have been paying an amount that exceeds my required payment with the expectation that the excess payment wouild go against the loan principal to work toward lowering that. The company refuses to apply my excess payment in this manner insisting that the law says that excess payments must go to collection costs first. Twice now my federal tax refund has been withheld in its entirety to go toward these student loans. However, my credit report reflects that while my entire refund was withheld, only a portion of that actually went toward the balance on the loan. My refund amount from 2016 was {$830.00}. They are calling my employer every day after I told them they could n't call my work. I just received a credit alert from my credit monitoring service stating that Texas Guaranteed has placed my account in a charge off status.
