[ XXXX XXXX ] [ XXXX XXXX XXXX ] [ XXXX, GA, XXXX ] [ XXXX ] [ XXXX ] [ XX/XX/23 ] Superlative RM [ XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX [ XXXX, AZ, Zip XXXX ] [ XXXX ] [ XXXX ] Re : Pre-Arbitration Demand Letter Pursuant to the Fair Debt Collection Practices Act ( FDCPA ) and Unlicensed Debt Collection in the State of Georgia Dear Sir/Madam, I am writing to bring to your attention several serious concerns regarding your debt collection activities as they pertain to me, [ XXXX XXXX XXXX XXXX and to demand immediate resolution of these issues prior to the initiation of arbitration proceedings or federal court proceedings. The company XXXX XXXX XXXX XXXX sold my information to a Debt collection company by the name of Superlative RM, XXXX XXXX XXXX XXXX XXXX California XXXX. I had no business with XXXX XXXX XXXX and you have no license to collect debt in the state of Georgia, I have exhibits of you having no license to collect debt furthermore I have written communication that XXXX XXXX XXXX provided my information to this company, and also recorded phone calls from this company stating that you they sold my information. I also was harassed by the agent when I told him I was at work and continuously to harass me at my place of employment stating that I owe a debt. Furthermore, than decided to send me more information after I stated on my recording that I refuse to pay the debt, and you have the wrong person. I have written communication from the company that admit to you selling my information, and recorded phone calls of harassment. You have violated the Fair Debt Collection Practices Act Unauthorized Disclosure : The sale of your information to another debt collector may be seen as an unauthorized disclosure to a third party, which is generally prohibited under the FDCPA. Communication with Third Parties : If the sale of your information leads to communication between the debt collectors that results in harassment or abusive conduct, it could be considered a violation of the FDCPA 's provisions regarding unfair or deceptive practices. Accuracy of Information : The FDCPA also mandates that debt collectors provide accurate information about your debt. If the sale of your information leads to inaccuracies in how your debt is portrayed, it may be considered a violation. You have violated the Gramm-Leach-Biley Act You have violated the Consumer Financial Protection Act You have violated the Federal trade Commission Act 15 USC 1692c 805. Communication in connection with debt collection ( a ) Communication with the consumer generally Without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction, a debt collector may not communicate with a consumer in connection with the collection of any debt -- ( 1 ) at any unusual time or place or a time or place known, or which should be known to be inconvenient to the consumer. In the absence of knowledge of circumstances to the contrary, a debt collector shall assume that the convenient time for communicating with a consumer is after 8 o'clock antemeridian and before 9 o'clock postmeridian, local time at the consumer 's location. ( 2 ) if the debt collector knows the consumer is represented by an attorney with respect to such debt and has knowledge of, or can readily ascertain, such attorney 's name and address, unless the attorney fails to respond within a reasonable period to a communication from the debt collector or unless the attorney consents to direct communication with the consumer; or ( 3 ) at the consumer 's place of employment if the debt collector knows or has reason to know that the consumer 's employer prohibits the consumer from receiving such communication. Violation of the Fair Debt Collection Practices Act ( FDCPA ) : Under the Fair Debt Collection Practices Act ( FDCPA ), debt collectors are prohibited from engaging in abusive, unfair, and deceptive practices when attempting to collect debts from consumers. I believe XXXX XXXX XXXX has violated my rights under the FDCPA in the following ways : 15 USC 1692d 806. Harassment or abuse ( 5 ) Causing a telephone to ring or engaging any person in telephone conversation repeatedly or continuously with intent to annoy, abuse, or harass any person at the called number. a. Harassment and Abuse : [ Provide specific details of any harassment or abusive conduct you have experienced, such as incessant phone calls, threats, or intimidation tactics used by XXXX XXXX XXXX. I have exhibits as in emails and recorded calls from an agency that you sold my information to without my consent. I explained that I was at work to the representative, and he kept talking stating that I need to pay a debt after I explained I refused to pay the debt on recording and Im at work and he caused me to get in trouble from continuously to call me. ] b. False or Misleading Representation : [ Specify any false or misleading statements or representations made by XXXX XXXX XXXX in their debt collection communications. This company has sold my personal information to someone who I have not provided written consent and doesnt have a license to collect debt in the state of Georgia XXXX ] c. Unfair Practices : [ Describe any unfair practices you have encountered, such as misapplication of payments or the imposition of excessive fees. This agency also didnt verify the amount they are telling me to pay that is not my debt. I have been injured by this at work. ] These alleged violations of the FDCPA have caused me significant distress and financial harm, and I insist on prompt resolution in accordance with the law. Unlicensed Debt Collection in the State of Georgia : I have reason to believe that XXXX XXXX XXXX is conducting debt collection activities in the state of Georgia without the necessary licensing as required by state law. Under Georgia law, debt XXXX must be licensed to operate within the state. Please provide evidence that XXXX XXXX XXXX holds the requisite license to collect debt in the state of Georgia. Failure to do so will constitute a violation of Georgia state law. I demand that XXXX XXXX XXXX takes immediate steps to rectify these issues by : a. Ceasing all further debt collection activities against me. b. Providing written confirmation that the alleged debt in question has been withdrawn or resolved. c. Providing written confirmation that XXXX XXXX XXXX is licensed to collect debt in the state of Georgia. d. Acknowledging, in writing, any violations of the FDCPA and a commitment to cease any further prohibited conduct. e. Providing compensation for any damages, including actual damages and legal fees, incurred as a result of the FDCPA violations and unlicensed debt collection. This letter is not an admission of any liability on my part, and I expressly reserve all my rights and remedies under federal and state law. I expect a prompt response to this letter within [ XXXX calendar days ] from the date of receipt. If XXXX XXXX XXXX fails to address these concerns and provide satisfactory resolution within the specified time frame, I will have no choice but to pursue legal remedies, including arbitration, or filing a federal lawsuit to protect my rights. I received a call on XX/XX/2019 from a company calling themselves XXXX XXXX. The lady was rude and said I owed {$1700.00} I told her I had no knowledge of this debt. She said it was for an XXXX store card. I asked her could she send me written correspondence of this in the mail. She became upset and said shed sue me and asked me to give her either my bank account information or a debit card to make payment arrangements. She also asked for my social security number and I told her I didnt feel comfortable giving that over the phone to a company I wasnt aware of. I told her I was not giving her my bank information because I had never received anything in the mail from this company and that I wanted to get something in the mail from them with the amount and the name of the original creditor and that I wanted to call XXXX myself to get that amount to make sure that it was correct before I made any type of payment arrangement with her. Then a man came on the phone and he started being very rude to me. He didnt introduce himself, he just started talking. I asked who are you? He said he was her manager. I told them both that I knew my rights and I was entitled to ask for written correspondence before just giving me bank account information over the phone to a company I never got a letter from. They started telling me that they would sue me so said Im on vacation and I had gotten upset because I was at lunch with family and was visibly upset because this man and woman are screaming at me in the phone threatening legal action and threatening to garnish my wages because I asked that they send me an official letter. Im a mom of XXXX and help my mother who is going through XXXX XXXX. I dont have. {$1700.00} to just give at one time. I gave her my address because I moved and she said shed call me again. I still have not received a letter as of XX/XX/2019. She called me again on XX/XX/2019 and I told her I would contact them once I receive a letter from them. It had only been 2 days and I said I should get your letter this week and I will call them once I did. She was rude again. My mother text me on XX/XX/2019 telling me someone name XXXX from XXXX called MY MOMS CELL NUMBER looking for me about a follow up call for collection for a debt. Why are they calling my family discussing my financial matters!? I dont know how they got my moms cell number. I dont live with my mom. And I never give any company my moms number. They wont validate this debt by sending a letter and they are calling my family which is a violation of the Fair Credit Reporting Act and they certainly can not contact my family. I called XXXX XX/XX/2019 to ask them who their third party collections company is and they gave me a number for a completely different company. XXXX also told me not to give anyone my Social Security number or bank information if this collection company wont send me a letter. I asked them to also send something with the amount owed so I know the collection company isnt telling me the wrong amount and XXXX told me they can not? Im not trying to dodge these people but I want to make sure I get official documentation before I just give a collection company my personal information. Especially when a company claims they are legit but talks to people in such an unprofessional manner. I didnt know that by me asking for an official letter would warrant me bring harassed, threatened with legal action and my mom with XXXX being called.

I was originally contacted over the phone by XXXX XXXX to make arrangements to collect a debt. ( I did not record the date, but it might be over 30 days ago. ) When they told me the amount and what it was supposed to be for I was sure it was n't my debt. They had my SS #, my married name ( though that is no longer my legal name ), a birth day that was close to mine, an email address I 've never used, an address and an employer that were mine, but from the XX/XX/XXXX. The company the lease was from was XXXX XXXX XXXX XXXX but i do n't know if that was a brick and mortar store or something online. XXXX said they did n't know either. The Leasing agency was XXXX out of NH. XXXX is out of CA. I live in Indiana, but not in the city that was used on the paperwork. I have n't lived there for almost 20 years. After explaining all this to a supervisor at XXXX XXXX I was told that I 'd have to dispute the debt and that they 'd send me something that I needed to respond to in 10 days. They did not send me anything in the next couple of weeks, and unfortunately I had not copied down all this info so I did n't know who to contact. Then I received a packet of info from XXXX that seemed to just be a copy of the debt they bought. It said our offices are " in receipt of your dispute '' but be advised we have contacted our client XXXX XXXX XXXX XXXX who has confirmed the name and address listed on the account as well as the amount owed '' There was a toll free number from XXXX which I called. It was late in the day on Friday after XXXX. I got a very confused sounding man with a foreign accent who said I had to call XXXX instead. ( Though XXXX has sold the debt. ) I called and left a message. Today XXXX called and was very insistent that the debt was mine and I was just trying to shirk my responsibilities. I asked repeatedly to speak to a supervisor but was told it would not do any good because they knew it was me and I needed to stop lying and just pay. That isnt word for word, but is the jist. Eventually they let me speak to someone who acted more reasonable but told me I had to file a police report and send them a copy. I contacted my local police who told me that was n't how it worked and told me to have the XXXX call him. I tried calling back with that information but was put off until later. I do n't know what else I should be doing. Do I need to file reports somewhere else? Do I need to contact credit agencies?

This complaint is in regards to XXXX XXXX. This company has called me from the number XXXX a few times since obtainingy account with them. If I do not answer my personal phone they then called my work phone on XX/XX/XXXX they were advised verbally by our phone call not to contact my work phone number as I can not take personal calls at this number. They have called a couple of times prior to that on both phones but I do not have those dates unfortunately. On XX/XX/XXXX I received a call from XXXX from XXXX XXXX and I was not able to take this call but someone else did and took down a message from them. Not two minutes later I got a call on my work number after they were advised I can not take personal phone calls at that number. I let the gentleman on the line know again onXX/XX/XXXX around XXXX XXXX not to contact my work phone number again and he ignored me and began talking about my balance owed. The gentleman on the line began raising his voice as I told him I can not pay anything currently nor can I commit to something at this time due to financial hardship and he said he was not there to hear about my burdens just there for business. They stated this was the last time they would call before they sent my account back for refusal to pay. My wife then took over the call and their supervisor got on the line and wanted to set up payments. My wife asked for a letter regarding the payment arrangements first and they did not want to do that and they said they simply did not want to send something out for a {$25.00} a month payment plan. So we advised him to send it back then because we want something in writing. He stated that something was sent in XX/XX/XXXX but we had not recieved it and he stated that we threw it away. They were demanding payment by the end of this month and that is something we could not do and would not without something in writing first and they would not provide it. Each time this company calls they yell and threaten that they have just today to get this resolved before it goes back to the original creditor. I spoke with the original creditor and they stated they are not expecting anything back regarding this account with them. Please get this resolved

In 2018, I had received an 6 months interest free loan from XXXX XXXX XXXX for {$740.00}, which has been paid in full. XXXX assessed late fees on the account ( and compounding interest upon those ) and the cause of late payment was multiple rejected payments from their financial services department due to an unaccepted payment type. I made a {$240.00} payment on XXXX and a second payment of {$500.00} on XXXX. The second payment was rejected by XXXX XXXX XXXX due to a payment type of 'virtual card mailed ' not being an accepted form of payment. I had issued the payment first payment from my XXXX and the second from my XXXX. At the time, I didn't know that the payment had been rejected, I just saw that the payment had been issued from my XXXX/XXXX and XXXX XXXX customer service department had called me to tell me they hadn't received payment. So I coordinated with my XXXX distributor and issued payment again on XXXX, which was again rejected. After multiple phone calls between both the XXXX company and XXXX, I was able to get a number to XXXX XXXX financial services department and finally to understand that the payment type was the problem ( during all of the calls I placed to or received from XXXX never told me that this was the problem until I was able to speak with their financial services department ). I coordinated with the XXXX distributor and issued the payment again on XXXX. This time it was accepted. I continued to receive phone calls and had multiple discussions with collections at XXXX and explained the situation, but they refused to dismiss the late fees and associated compounding interest. On top of that, I've received thousands of dollars of loans from XXXX in the past and had paid each one on time, until this situation. Over a year later, I am now receiving calls and mail from a second debt collector, after having provided written dispute to the first debt collector that included payment dates, payment reference numbers, and the contact information to my XXXX company. Not only has my credit been affected but my family members have received collections calls and been harassed for over a year.

They called me today XX/XX/2022 Was harassing nasty screaming at me and call me names. They claim that they are trying to collect a debt for XXXX. A furniture company who does not respond to disputes and letters to such. It has been over 5 years that I have sent them letters and calls that I received wrong items. I kept getting the wrong items and they just stopped communicating. I then went a head and wrote more letters as to the defective and poor quality of product sent. Still no answer. They wrote collection bureau and put me on a charge off. I tried reaching out again and was told I received the right order and they never received any of my letters which I have sent them copies. Now this collection agency Superlative RM calls asking me questions I told them I dont owe anything as I sent letters and disputes to their client and never got one answer. They called me a liar, that XXXX would not send them the file for collection if I didnt owe money. They further stated that they want to sue me and freeze my account. They had given me all wrong information and did have proper address telephone number refused to give me an amount owed when I asked them where they are located they refused to answer me. When I told them to stop calling me they said they would keep calling because I owe ment I mentioned to them they are violating the fair credit act they said big deal. I told them I have proof of XXXX violating my rights under the fair credit act they said tough. I am a dead beat and a liar. And they will keep calling me. I again told them to stop harassing me as they and their client have violated the law. I want to sue both of them and to stop collection as the creditor never responded to my numerous letters which I sent and also since they never the creditor responded in the appropriate amount of time they are guilty of violating the fair credit act. I owe nothing had to purchase from another company the items. This company is fraud never received any letter from creditor that account was going to collection or sold.

This company contacted my daughter who said she was a authorized user on my XXXX account which was in collections.I never made her a authorized user.I called them back and explained to them that I could pay {$10.00} a month as now I am on XXXX because of XXXX.At first he said we could work something out.Then he came back and said that my daughter was legally responsible to pay this debt if I did n't pay them {$3000.00} in a lump sum.I told him I did n't authorize her and she and her husband were going to buy a house and if this showed up on her credit report her husband was going to have a fit.He went on to say that maybe she added herself and was doing things behind my back and that she needed to go and ask her husband for {$3000.00} so it would n't go on her report.I said no way since this is my card and she has nothing to do with it.His manager came on the phone and he tried to get my bank account # and for me to agree to pay {$46.00} a month when I had already told them I could only do $ XXXX.When I started asking him if it was true that my daughter was legally responsible he would beat around the bush.When I told him I was going to contact my lawyer and check into the tactics they were using he then said she probably wasn't.The first employee XXXX was telling me this I guess to scare me into asking them for {$3000.00} when they have nothing to do with this at all.She was n't even XXXX when I opened this account.After I came back on the manager and told him I was going to check into all the lies they were telling me he said I could just mail in $ XXXX.I asked the manager how his employee got my daughter 's phone number he said he did n't know.So I said ask your employee he called her and again he started beating around the bush.How can they harass my daughter over a debt that she had nothing to do with? Can they report to her credit when one of them said she was a authorized user and the other said he did n't know why her name was on there but it was there? Please help.

I returned the company 's repeated calls and was told this was a debt that was for a XXXX XXXX XXXX XXXX XXXX XXXX card that went into default while I was very ill with XXXX and unable to perform my full job duties. I asked the representative to uphold the last offer amount from another collector of XXXX and they demanded to know when I could pay. They said they could honor that offer but would have to pay by end of month. I asked for them to send it to me in writing so that I could fit the payment into my budget and also know it was a legit company. I had an issue with paying a company before that ended up not holding the debt. They would not send it then another person got on the line names XXXX XXXX who said he is the General Manager. I asked him to send the settlement offer to me so I could review it and he demanded to know when I would pay. I told him the other gentleman had told me by the XXXX and he said he wouldn't send the information until I gave him a date. I kept repeating " by the XXXX '' He said things like I don't have the money and other things along those lines. I kept telling him I simply wanted it in writing that they had agreed to the settlement and a way to securely pay online. I didn't want to give the my bank info since they were not being up and up by agreeing to give the info in writing, They kept laughing/giggling and being disrespectful. I tried to explain that my husband is like a toddler right now after having a XXXX XXXXXXXX XXXX and I was not sure the exact date I would be able to sit down and pay bills. They claimed at the end of the cal that they emailed the offer to me and I have yet to receive anything. XXXX said things in veiled threats like " you are on a recorded line and said you have the money ''. I never disputed I owed the money. I just wanted to be able to pay securely and have the offer in writing. I am cleaning up a lot of debt and issues that occured when I had covid and medical bills etc as a result

On XX/XX/21 at XXXX am XXXX XXXX of Superlative RM contacted regarding a collection account. I advised Mr. XXXX since this is his first time contacting me that I was uncomfortable verifying my information. First, he only mentioned the name of the company but asked for me to verify last 4 of ssn, address, and date of birth. Stating to him that I needed to know who he was with and the matter he became aggressive with his tone and stated he already told me Superlative RM. Upon him giving the type of account I asked that he provide me via mail a verification of debt. In an aggressive tone he stated I had already gotten this information and he would send via email. I advised no email to send to and he cut me off mid sentence. Stated that this is not the first time I have been contacted regarding this account and he would tell the lender that I am uncooperative and threatened next course of action. I advised Mr. XXXX that I am at work and can not talk at the moment. He became irrate and said since this matter isn't important to me he would proceed with the next actions. Throughout the conversation I asked why was he continuing to cut me off mid sentence and threatening next action when this is his first time contacting me. After being overtalked for so long I asked for a supervisor. I advised him that I was at work and provided an alternate phone number. This company representatives continued to talk when I clearly stated I could not talk. Very aggressive and threatens next action when you ask for their credentials and verification of a debt prior to paying. This is my right as a consumer and in todays society it would be foolish to provide any personal information to complete strangers.

Received phone call from XXXX with XXXX XXXX XXXX XXXX stating that her company bought my original debt from XXXXXXXX XXXX and I owed XXXX. I set up payment arrangement ( XXXX on XX/XX/XXXX ) and 75 monthly payments since that date. In XX/XX/XXXX I received a letter from superlative RM ( SRM ) XXXX stating that their company bought my debt and I owe them XXXX I then asked XXXX from XXXX XXXX XXXX to please send me proof of debt which she only offered to do in an email. XXXX proof of debt included the whole account number XXXX amount owed is XXXX states that original creditor is XXXX XXXX XXXX XXXX ( the actual creditor is XXXX XXXX not XXXX ( thats just where I bought the couch ) also the debt letter email has my old address not miss you current one. SRM proof of debt letter has only the last four digits of the account XXXX, states I owe XXXX states original creditor is XXXX and merchant is XXXX XXXX XXXX XXXX. Debt letter has my correct address. Their debt letter also explains that if I contact them within 30 day in writing they will send me verification of the debt or a judgement against me. XXXX email does not state that. If SRM is in fact who I owe the money to then what happens to all the money that I paid XXXX XXXX on this account? I am unsure of which company to pay or if the debt was double sold? I am unsure who actually owns the debt and have tried calling XXXX for help on who they sold the debt to but they state that there is no account with them at all? I was contacted by a company named XXXX by a man named XXXX XXXX and subsequently by a man named XXXX stating that I owed them {$1400.00} from an emergency room visit that occurred on XXXX/XXXX/2015. I asked them to give me whatever information that they had so that I could verify their information with my records and the hospital, if necessary. They were verbally combative and insulting to me when all I wanted was to be able to verify the details of their claim. Subsequently, I was able to locate the benefits document from my insurance company that shows that I never owed the debt. This was a debt that was purchased from another company which was, presumably, purchased from the hospital where I had the emergency room visit. My insurance benefits document indicates that the charge in question was an 'Ineligible charge ' that the doctor who made was prevented from making through agreement with my insurance company. I am absolutely convinced that this was a cheap tactic by the doctor, the hospital, and every debt collection company that bought the debt to try to get me to pay for something that I was never responsible for paying, and, had I not resisted their strong-arm tactics, I might have agreed that I owed the debt ( which I do not ). I do n't believe that it was necessary for the employees of Superlative RM to speak to me in the manner in which they did -- especially since I do not ( nor have I ever ) been responsible for the amount that they say I was.

At XXXX on XXXX XXXX2023 the debt collector called my phone asking me to pay the debt I specifically told him that I was not going to pay the debt I will let it fall off. He then said what type of person pulls out money that they know they can't pay, I can tell you don't know how to pay your debts. I told him please don't get cursed out I had a really good day. He then laughed and stated you don't think I cant handle that, I deal with it all of the time. I told him I'm not cursing out to you but you're being very rude right now I stated I'm not paying it. He then proceeded to hang up in my face. I called back and the same person answered but changed their name. I told him I would like to make a complaint and he said he would and not only did he not make a complaint about the rude staff member but then started to ask me about my debts. I told him I am not paying it. He then started to lecture me stating what would my mother and father think, what type of person does what you did, what would my reputation look like what type of example would my daughter have. I told him that they would not have access to my credit. He asked me why am I not able to pay. I explained to him I ended up losing my job and gave birth and he stated that that's not a good enough excuse to not be able to pay my debts. In mid XXXX I received a letter from XXXX XXXX, a company I admit I owe money to, informing me the debt was transferred to XXXX XXXX XXXX XXXX XXXX XXXX. XXXX has never contacted me directly. On XX/XX/2018 I received a letter from XXXX XXXX informing me they were acting as debt collectors for XXXX XXXX and I had 30 days to respond. The next day, a Friday, after XXXX, I received a call from a representative of XXXX XXXX wanting to know how soon I planned to resolve the issue. I told him about the letter I got only the day before and I planned on using my 30 days. At the point a supervisor jumped on the call and informed me he was retracting the 30 days, this needed to be resolved by the end of XXXX. I said I could not agree to this, told him the payment terms I might agree to, he said it wasnt good enough and he started to yell at me and belittle me. I said the conversation was over and his response was the conversation was over when he said it was over. I hung up and blocked the number they called from. On Monday I called the offices for XXXX XXXX and spoke to someone I was told is a manager. I told him my story but at first all he was interested in discussing was payment terms. He backed off when I informed him I did some research and know his company has been repeatedly reported for abusive behavior. He then asked me not file a report. On XX/XX/XXXX I received a phone call from a collection agency stating they now own a debt that was once owned by XXXX XXXX XXXX XXXX XXXX XXXX XXXX on an account opened XX/XX/XXXX. The company that contacted me was Supulative RM. During this phone call, I told the representative I was unaware of this debt being sold and asked them to send me a verification of debt. A verification of debt letter was written and sent to them later that afternoon asking for specific information. Superlative responded with a copy of statments from XXXX XXXX. Though this is part of the information requested, it wasn't all of the information requested to prove the debt. In my letter I requested information in occordinance to information provided to me from the Consumer Financial Proctetion Bureau including topics : Why they think I owe the debt, The amount and age of the debt and their athority to collect this debt. I reside in Arkansas and under the laws in Arkansas any debt collector who is attempting to collect a dept must hold a license in Arkansas, neither of the listed companies above hold that or have not provided any proof that they hold athority to infact collect on this debt. XXXX XX/XX/XXXX will be 30 days since I have requested this information and have not had any contact from them regarding this issue. Also, The XXXX XXXX XXXX still reports to my credit as owning the debt, when they infact sold it to a new company.

I advised I had done no business with his company Superlative RM nor XXXX XXXX XXXX and did not feel comfortable going forward due to the fact a business whom ive not conducted business with had all my personal info and was willing to devolve it to someone who answers a phone and no verification. Then Mr. XXXX got upset because i asked questions about who the company was he stated and said that I had no business with them. XXXX XXXX contacted me via mail saying I owed money and they were trying to collect. I asked them to stop contacting me and to send me verification of the debt. I was told that if I " disputed the debt '' by requesting that information they would not work with me in the future on settling the amount. Someone called me and asked to speak to me. I asked who is calling and they told me XXXX XXXX debt collection. Requested my date of birth for verification, I didnt give it to her and I asked what it is regarding, the person then proceeded to call out my date of birth. I asked again, what this was about and she asked for the last four of my social. I told her I wasnt giving that to her until I know what the call is about. She proceeded to call out the last four of my social! Then rambled off what the call was for. I asked to speak to a manager or supervisor and instantly regretted it. The man, XXXX is his name, that I spoke to was so rude to me. He tried to tell me that I agreed to the information for verification purposes. I kept telling him that at no point did I share that information but that his employee gave it to me. I told him that I was upset because it could have been someone else on the line. I discovered fraudulent charges on my credit card around XX/XX/XXXX. They were apparently for a cell phone lease from a company called XXXX XXXX XXXX, which I have never heard of and certainly never done any business with. I reported the fraud to my credit card company who invalidated the charge and issued me a new credit card. Much later, in XX/XX/XXXX, I received notification by mail from Superlative RM, a debt collection agency. Even though I had reported the charge as fraudulent to my credit card company, and its not a debt that I owe, Superlative RM was attempting to collect this debt from me in the amount of {$1100.00}. I replied immediately by mail, telling Superlative RM that I dispute the debt and demanding to see a copy of the judgement against me and any documents related to that judgement, including the name and address of the original creditor. Superlative responded with a letter dated XX/XX/XXXX that showed details from the original purchase through XXXX XXXX XXXX. It revealed that the criminal who made the charges used my name and address, along with an email address Ive never seen before. For the past ~XXXX years, I have regularly received phone calls from various different debt collection agencies, all of whom are searching for a person I have never met. I assume this person is the previous owner of my phone number. I have, on numerous occasions, requested that the agencies do not call me again, and this will work, but then a different agency will just call me instead. Most recently, I received a call from Superlative RM on XX/XX/XXXX, at around XXXX XXXX. It is my understanding that the debt collectors are legally not allowed to discuss the debt, including the identity of the loaner, with anyone except the actual debtor, so it has been impossible for me to identify the actual bank or company that is trying to collect the debt without impersonating the woman who previously owned my number ( since the caller will just hang up on me as soon as I admit to being someone else ). Because the phone calls are often from different numbers ( aka, a different collection agency ), it is not possible for me to just block the numbers. And because I use my phone for other purposes ( such as interviews ), it is not possible for me to just ignore unknown numbers either.

On XX/XX/2019, I received a letter from Superlative RM ( see attachment ) trying to collect a debt apparently posted by the company XXXX XXXX XXXX XXXX. I have never heard of nor dealt with XXXX XXXX XXXX XXXX. Considering that my credit information has been and remains permanently frozen, I must question whether any debt was ever incurred in the first place short of extreme lack of due diligence on the part of XXXX XXXX XXXX XXXX. I am further aware of no debt with any company or person on my part short of credit cards which I pay off in full every month rather than carry a balance. I have not communicated with either Superlative RM or XXXX XXXX XXXX XXXX since the whole experience and rather threatening tone of Superlative RM 's letter has the feel a scam that could only grow if fed any personal information. XXXX Superlative RM on the internet turns up not only numerous complaints but also a law firm specializing in dealing with problems with Superlative RM. Street view on XXXX maps of Suplerlative RM 's address shows a small, nondescript, unlabeled building behind a cinder block wall further reinforcing the unsavory impression of Superlative RM 's letter and its content.

They have 2 business names listed on the debt notice. Superlative RM and XXXX XXXX XXXX XXXX. I spoke with the debt collection agency in an attempt to have this cleared up. I have never recieved a bill for this prior to the debt collection notice. The debt collector would not send a paper with proof that the debt belonged to me without me sending in money. A relative then paid XXXX and we still have yet to recieve proof this debt is mine. The debt collector claims its from a hospital that I have only visited one time in the last year and that was a workers comp visit due to my finger being chopped off at work. I do not owe anyone money. If the debt was not paid that is an issue for the worker comp company that was given the bill. The nurse took all of the information needed for workers comp as well. The manager of the company I worked for ( XXXX ) stated that this visit was paid for by the workers comp. I know for a fact that you can not collect a debt from me on medical bills paid for by workers comp. I will not be sending them any money. They need to remove my name from this debt as it clearly is not mine or they would have provided proof like required.

I contacted XX/XX/XXXX to dispute their claim that I owe a debt of {$310.00}. The phone numbers provided on the credit report XXXX and XXXX do not connect to the XXXX, but it connects to a company called Superlative RM. Several Managers and Customer Representatives have stated on multiple calls they do not have an account pertaining to me and there is nothing they can do to assist me with removing the debt or resolving the debt. I have not been provided proof of the debt from the XXXX, and they have not responded to letters, and the phone numbers do not connect you with the company. I disputed the validity and accuracy of the debt with XX/XX/XXXXand they reported back that the company verified with them the debt is valid. However, XX/XX/XXXXrepresentative stated to me on a recorded phone call XX/XX/XXXX is not required to provide one shred of evidence that the debt is accurate, they did a self investigation and reported back to XX/XX/XXXX their findings. I asked how is it possible to report a debt on my report without 1 piece of evidence? Called multiple times after being told not to call as they have the wrong phone number. All calls are robocalls/prerecorded messages, but in two different flavors. All represent a company named Superlative RM ( superlativerm.com ) Variation 1 : A message in a mans voice saying this is XXXX from Superlative RM and to call back at XXXX XX/XX/XXXX - XXXX - XXXX XX/XX/XXXX - XXXX - XXXX XX/XX/XXXX - XXXX - XXXX Variation 2 : A female robot voice saying to to call Superlative RM and to call back at XXXX. This one references case XXXX. XX/XX/XXXX - XXXX - XXXX XX/XX/XXXX - XXXX - XXXX They have call previously, but i have deleted those messages. I have informed these guys more than once not to call. First time was on XX/XX/XXXX at XXXX. They are calling a number that has been mine since XXXX. They must be working off of phone number lists that are more than a decade old. I wish the FCC would go after that stuff too. Example, if the phone number hasn't been validated in 7 years, they are not allowed to call it. And perhaps if one debt collector is alerted of a bad phone number, they should pass that along when a debt is sold.

I was contacted twice in two day 's time by Superlative RM. At both points of contact, the agent and his superior were demeaning, derogatory, questioned my intent to resolve, and accused myself and my partner of having unreported funds with which we were capable of resolving the debt. They pushed unnecessarily for closure of the debt, while I insisted on a 7-day time frame with which to discuss financial means to close the account. During the initial call, my assigned agent became so insistent and derogatory that he worked himself in to a frenzy and begun yelling. His supervisor curbed his enthusiasm enough to not yell, but was almost as aggressive and demeaning. I ended the call with a request for electronic confirmation of agreement to settle at which point i would return a call to follow up... which was never sent. They called the following day asking why I hadn't reached out, with veiled accusation of avoiding the debt. Again, pushing for immediate settlement, and dismissing reasonable request from myself and my partner. If this is common practice for this company, i will avoid interaction with them at all cost.

Yesterday, XX/XX/2018, a man called my employer by the name of XXXX XXXX and was very rude to the receptionist when she explained that I was not there. He indicated that he was collecting on a debt and told her to demand that I call him back at XXXX. As I researched this, it is to XXXX XXXX ... a debt collection agency. I do not owe them money. On XX/XX/2022 I received a call from XXXX. I answered the phone and it was a lady from Superlative RM collection agency. She was very rude and very aggressive. I told her of why I was unable to make my payment and she said Why should I care what other bills you have to pay. That has nothing to do with me! Even though I have been paying payments to them for months and I had also tried calling days before. I would try to talk and she would just cut me off. I would say something and she would twist my words. Unsolicited call from " debt collector '' Superlative RM, telephone XXXX XXXX XXXX. Company stated, " We are a debt collection company trying to collect an outstanding debt. '' Was requested to call XXXX XXXX XXXX referencing a case number. When I called, an automated answering machine indicated who they were, all agents were helping other customers, please wait on the line for the next available agent. The line was answered within one minute and the answerer immediately hung up. This happened successively three times. I have no outstanding debts and believe this company to be a scam. This morning I got a call from a company by the name of Superlative RM. The person refused to give his last name but his first name was XXXX. They have the CFPB logo on their website so I assume you are somehow endorsers of theirs. Anyway, I calmly explained to this person I did not owe any debt to the company. The rep laughed at me and said they were going to report the debt to the credit bureaus and said that I had to dispute the debt in writing. I demanded that they validate the debt as is my right under Federal Law but they refused to do so. I never signed any contract with this company and have never heard from them. Our phone number keeps getting calls from Superlative RM, a debt collector company. The last date was XX/XX/XXXX at XXXX XXXX. We do not know which of us they are calling for because they never leave a name in the message. The truth is, we do not know why they keep calling because we declared Bankruptcy in XXXX XXXX and have had no debts since the Bankruptcy. We will not answer the phone to them because we do not owe any money to any person nor to any company. I have been getting calls from Superlative RM Debt Collections. They call using a DIALER system but 90 % of the time I wait on the line and there is no one there, it just hangs up. A few times I have waited and a representative comes on the line and asks me to verify my identity, I only verify my name and then ask what company they are calling from and then they hang up. Today I had a representative tell me the company name. I went ahead and verified my address and date of birth then asked what it was about. I am not familiar with the company he said. I then let him know I had not received anything in the mail and I had been trying to figure out who/what this was about. He said they would not mail anything else out. I said Im driving please just resend it and you can call me back 4-5 days later and we can discuss. He said no they were taking legal action. At that point I ended the call.

They also have violated 15 U.S. Code 1692g as i did not receive a 1692G letter and I haven't been able to dispute an alleged debt that they claim. I will not tolerate my federal rights being violated and I will not be harassed by phone calls from a company that breaks federal law. On XX/XX/2023, Superlative RM contacted me. There has been over 50 phone calls to my place of work as well. On one occasion I was repeatedly threatened with legal action while attempting to verify the alleged debt. On a separate occasion ( XX/XX/XXXX ) the associate I was attempting to speak with verbally yelled at me repeatedly and would not allow me to ask to verify the debt via writing. When I requested verification he continued to yell and refused to provide verification. Received a harassing call from Superlative RM where the rep named XXXX placed his so called supervisor on the phone once I requested to negotiate payoff amount.
