In XX/XX/XXXX XXXX XXXX merged with Chemical Bank, my bills had previously been automatic electronic payments with XXXX on my online bill pay account, yet Chemical B ank changed my electronic payment to " manual check '' payment on several of my accounts ( without my knowledge or consent ), with the merger beginning in XX/XX/XXXX . O n XX/XX/XXXX , I realized that XXXX XXXX had not yet received my mortgage payment so in a panic I had a " Stop Payment '' placed on the manual check, and called in my payment over the phone in order to avoid my payment being late. In XX/XX/XXXX , I had the same dilemma and I AGAIN contacted Chemical Bank customer service and requested a Stop Payment, on the " manual check '' generated by my Chemical B ank checking account online bill pay account. I was informed SEVERAL TIMES by Customer Service, that my monthly online bill payment to XXXX XXXX XXXX XXXX in XXXX ( reoccurring scheduled payment ), had " Not been paid out of my account due to the stop payment ''. I called Chemical Bank customer service MULTIPLE TIMES, requesting an investigation into XXXX XXXX still receiving payment after filing my Stop Payment, yet observing that the unauthorized payment was paid, but yet funds were never taken out of my account? I was informed b y Chemical Bank that the Stop Payment WAS in effect un til XX/XX/XXXX , and t hat the error must be on XXXX XXXX side of the issue. On XX/XX/XXXX , I aga in called Customer Service inquiring about m y Chemical B ank checking account online bill payment Account Freeze, and I also observed that my XXXX XXXX XXXX XXXX reoccurring monthly scheduled payment being CANCELLED on XX/XX/XXXX , by Che mical Bank due to Insufficient Funds, when the real problem was that Chemical Bank still ACCIDENTALLY paid my mortgage payment in spite of a " Stop payment '' being in place. I was informed then by Customer Service that my XXXX XXXX XXXX XXXX payment was indeed NOT made on XX/XX/XXXX out of my account, due to a Stop Payment STILL being in effect until XX/XX/XXXX , but that Chemical Bank mistakenly made the payment for the second time, and froze my account even though it was the banks ERROR!!! It has since then been discovered that Chemic al Bank, IN ERROR and in VIOLATION of my Stop Payment still being in effect, did make th e XX/XX/XXXX pa yment to XXXX XXXX XXXX XXXX WITHOUT MY AUTHORIZATION, as I was informed by XXXX the branch manager at my local XXXX XXXX Chemical Bank b ranch office on XX/XX/XXXX . The UNAUTHORIZED and ILLEGAL account freeze that was placed into effect by Chemical Ba nk on XX/XX/XXXX , on my Chemical Bank checking account and online bill payment account ( which was solely due to Chemical BANKs ERROR ), ALSO has resulted in SEVERAL of my creditors NOT being paid as SCHEDULED since XX/XX/XXXX , and my accounts being late/ delinquent! Nor did Chemical Bank inf orm me of the account freeze as required by law, and has consequently affected my good standing with my creditors by not paying my bills as scheduled, and has negatively affected my credit score!!! At that time on XX/XX/XXXX , XXXX asked if Chemical Bank could take/deduct the TWO erroneous XXXX XXXX XXXX XXXX Payments that Chemical Bank had previou sly made ( XX/XX/XXXX and XX/XX/XXXX ), from my Chemical Bank c hecking account, or from XXXX of the XXXX other accounts that I am listed on with other family members with Chemical Bank. On XX/XX/XXXX I had informed XXXX that I DECLINED AUTHORIZATION for Chemical Bank to deduct the TWO previou sly UNAUTHORIZED PAYMENTS to XXXX XXXX XXXX XXXX per the " Stop Payment '' placed in XX/XX/XXXX , from ANY of my Chemical B ank accounts!!! XXXX kept trying to convince me that " Chemical Bank was kind enough to front you the money '', and that I legally " must pay Chemical Bank back '', even though they IGNO RED the stop payment? XXXX stated that she " would see about setting up a payment arrangement, but that until then my accounts/ money would not be touched ''. Shortly after my conversation with XXXX , I had stopped on my way home from work and attempted to purchase some items at a gas station for {$6.00} with my Chemical Bank Debit Card, only to have my transaction/ purchase DECLINED, and yet there was a balance on my chec king account of greater than {$900.00}, previously that day!? When I arrived home I immediately logged onto my Chemical bank checking account, only to discover that Chemical Bank deducted TWO XXXX XXXX XXXX XXXX payments from my checking account WITHOUT MY AUTHORIZATION, resulting in my checking account now being in the NEGATIVE, greater than {$1200.00}!!!! Then to add insult to injury, Chemical Bank has now also charged me over {$400.00} in overdraft fees, that only occurred due to their illegal confiscation of my funds!!! The above actions and UNAUTHORIZED deductions/ transfers of MY funds, and fees made by Chemical b ank, were made in VIOLATION OF MY LEGAL RIGHTS, according to The Electronic Fund Transfer Act ( EFTA ) ( 15 U.S.C. 1693 et seq. ) of 1978, a nd which also states that I am not responsible nor liable for repayment of the UNAUTHORIZED XXXX XXXX XXXX XXXX payments that were made by Chemical Bank, due to the Stop Payment being in effect until XX/XX/XXXX . I n accordance with the Electronic Fund Transfer Act ( EFTA ) ( 15 U.S.C. 1693 et seq. ) of 1978, I exerted/ enforced my rights, and I requested an INVES TIGATION f rom Chemical Bank in writing, into the MULTIPLE ERRORS and UNAUTHORIZED transfers, and now deduction of funds in the amount of {$2100.00} ) o n XXXX , by Chemical Bank from my checking account, and to then RETURN the UNAUTHORIZED deduction of funds back into my checking acc ount! I also requested that letters be provided explaining to my creditors that my accounts NOT being paid as SCHEDULED fr om XX/XX/XXXX - XX/XX/XXXX , due t o MULTIPLE errors by Chemical Bank with FOUR Stop Payments that I previously requested, was solely the FAUL T of Chemical Bank , so that good standing with my creditors can be restored, and the negative impact on my credit score be reversed/ corrected!!! I am currently waiting to be in formed of Chemical Banks investigation conclusion, and CORRECTION into this ERROR/ matter, as required by The Electronic Fund Transfer Act ( EFTA ) ( 15 U.S.C. 1693 et seq. ) o f 1978. I incidentally went to a branch location very far from my little town and had copies provided to me of the " stop payments '', I was very disturbed when I discovered at the bottom of the " stop payment '' agreements that I placed on my XXXX XXXX account until XX/XX/XXXX , that the " stop payment '' agreements were DELETED on XXXX !!! Chemical Bank has also still not returned the money to my account, paid my bills as scheduled due to freezing my bill pay account, and is daily adding more overdraft fees DAILY, that I am not responsible for accruing!!! PLEASE guide me to where I can get legal assistance with this situation, but also get justice in this matter with Chemical Ba nk and their bullying tactics!

To give you the general idea, my mother was conned into making a large wire to her " boyfriend 's '' overseas friends. They used fake identity 's to pick up the funds. This is covered under regulation e 's error procedures, specifically a fraudulent pickup of a wire transfer. The availability date on the first wire wire wasXX/XX/XXXX and the second was XX/XX/XXXX. The confirmation page we received along with supporting documentation is attached. We informed Chemical bank of the the fraudulent wire on XX/XX/XXXX. They attempted unsuccessfully to recall the funds. Under regulation e a fraudulent pick up is covered under the error procedures and Chemical Bank is required to refund the total funds. The following is the specific comment on regulation e that I am referring to. 33 ( a ) ( 1 ) ( iv ) Failure To Make Funds Available by Date of Availability Proposed 205.33 ( a ) ( 1 ) ( iv ) generally defined an error to include a remittance transfer providers failure to make funds in connection with a remittance transfer available to the designated recipient by the date of availability stated on the receipt or combined disclosure, subject to two specified exceptions, discussed below. The Board proposed comment 33 ( a ) -4 to provide examples of the circumstances that would have been considered errors under proposed 205.33 ( a ) ( 1 ) ( iv ). These circumstances included : ( i ) The late delivery of a remittance transfer after the stated date of availability or non- delivery of the transfer ; ( ii ) the deposit of a remittance transfer to the wrong account ; ( iii ) retention of the transferred funds by a recipient agent or institution after the stated date of availability, rather than making the funds available to the designated recipient ; and ( iv ) the fraudulent pick-up of a remittance transfer in a foreign country by a person other than the person identified by the sender as the designated recipient of the transfer. Fraudulent pick-up, however, did not include circumstances in which a designated recipient picks up a remittance transfer from the providers agent as authorized, but subsequently the funds are stolen from the recipient. Several industry commenters objected to the inclusion of fraudulent pick-up as an error. These commenters suggested that the remittance transfer provider should not be responsible for fraud that results in the pick-up of a remittance transfer by a person other than the designated recipient where the provider is unlikely to know or have control over all the intermediary institutions involved in the transfer or the final institution that will make the funds available to the designated recipient. Other commenters, including the OCC, suggested that this error might result in friendly fraud where a sender claims the amount was not an authorized pick- up when the pick-up was actually legitimate. The OCC was also concerned that the exposure to remittance transfer providers for this error may be aggravated in situations involving large dollar remittances and because of the long period of time that a sender could assert this error. One industry commenter noted that while there may be certain instances when fraudulent pick-up should be considered an error, there may be other circumstances when fraudulent pick-up should not be an error. In particular, this commenter suggested that where the name of the person picking up the funds does not match the name of the designated recipient set forth in the receipt, the sender should be able to assert an error. However, if an individual presents fake identification in the name of the designated recipient, this commenter stated that this fraudulent pick-up is outside of the remittance transfer providers control and therefore, should not be considered an error. Industry commenters also believed that a remittance transfer provider should not be liable for a fraudulent pick-up when a provider and its agent has complied with fraud and risk management policies and procedures. As the Board noted in the XX/XX/XXXX Proposed Rule, treating fraudulent pick- up of a remittance transfer as an error is consistent with the scope of unauthorized EFTs under 1005.2 ( m ), which includes unauthorized EFTs initiated through fraudulent means.See comment 2 ( m ) -3. Although identity theft can present a challenge to remittance transfer providers, financial institutions face similar challenges with respect to unauthorized EFTs and bear most of the risk. Moreover, similar to remittance transfers, the entity in the best position to verify the identity of the person initiating the EFT ( for example, the merchant at a store who initiates an EFT using a debit card ) may not be known or controlled by the financial institution, though such entities may have agreed to abide by system rules ( e.g., payment card network rules, ACH system rules ). However, under current laws governing EFTs, whether the financial institution knows or has control over that entity ( e.g., a merchant ) does not affect whether an EFT could be an unauthorized EFT. Similarly, the Bureau believes that whether a fraudulent pick-up should be considered an error should not be affected by the relationship between the remittance transfer provider and the entity distributing the remittance transfer to the designated recipient. Furthermore, the Bureau agrees with the Boards reasoning in theXX/XX/XXXX Proposed Rule that it is appropriate to treat these circumstances as errors because the remittance transfer provider, rather than the sender, is in the best position to ensure that a remittance transfer is picked up only by the person designated by the sender. For example, in some models, remittance transfer providers could require or contract with the entity distributing the funds, if it is not the remittance transfer provider itself, to request and examine identification from the person picking up the funds. The Bureau believes that including fraudulent pick-up as an error would better align the remittance transfer providers incentives to prevent this occurrence with the interests of the sender. I would like a refund of the amount remitted, as required in the error resolution procedures. In summary I am requesting a reimbursement from Chemical Bank of the funds as required under regulation e.

My name is XXXX XXXX. This complaint is in regards to a loan originally held with XXXX XXXX XXXX. The loan number is XXXX. The borrows are XXXX XXXX and XXXX XXXX. The note was signed XX/XX/XXXX. We have been fighting this loan amount for many years now and have dealt with multiple people over 3 different bank names ; XXXX XXXX XXXX, XXXX XXXX and now XXXX XXXX. This bank is attempting to coerce us into making payments for this loan and refuses to file a lien release. The original loan amount was for {$25000.00}. We religiously paid on the loan for at least the minimum and in most cases, more, from XX/XX/XXXX through XX/XX/XXXX. We ran into a very difficult financial situation when I folded a company I had owned at the time and my wife lost her job at a warranty company that had failed. We were advised by a bankruptcy attorney that we should stop making our mortgage payments to assist with approval for a Chapter XXXX. The Chapter XXXX was filed XX/XX/XXXX and confirmed XX/XX/XXXX, meaning our payments starting for the statement cycle of XX/XX/XXXX would be during our Chapter XXXX. In mid XXXX we became concerned as we stopped receiving statements for our second mortgage. We contacted, at the time, XXXX XXXX XXXX, regarding this and spoke with a gentleman named XXXX. XXXX explained to us that the bank had " written off the loan since it was part of a Chapter XXXX and considered the loan a loss '' and that the bank " could no longer charge interest and any payments made would be considered PRINCIPAL ONLY as the bank is no longer legally allowed to charge interest on a defaulted loan ''. In addition he stated that " the bank is no longer allowed to obligate you to a monthly payment, so send us what you want when you want and we can not collect on this loan ''. We continued to send payment to the bank through XX/XX/XXXX, WELL after the note was set to expire in XX/XX/XXXX per the original loan note. In XXXX we attempted to refinance our home to lower the interest rate on our first mortgage, which should have been our ONLY mortgage at the time. When we pulled credit, the loan in question was showing as a collections item from XXXX XXXX. After investigating the situation, we found out that this was the second mortgage we had paid off. We contacted XXXX XXXX and spoke with an XXXX XXXX, a Loan Service Specialist. We sent her the payment information as well as the Bankruptcy paperwork, and were told, in writing, that the issue was corrected and that they had not properly showed record of the Chapter XXXX. The loan now shows as PAID AS AGREED on our credit reports. We thought that was the end of it. Around this time my wife was diagnosed with a XXXX, XXXX XXXX XXXX that requires constant care and is extremely expensive. Due to the amount of time spent in doctor 's offices, we did not go through with the refinance in XXXX. Since we are now drowning in medical debt, we are attempting to refinance the house again so we have a mortgage payment we are comfortable with even with the medical debt XXXX is incurring. Again, during the title search for THIS application, the lien from XXXX showed up. I contacted the company showing the document that supported them telling us the loan was paid as agreed before and now they are claiming we owe them WELL OVER the original amount, and that they are charging us interest TO DATE even though the loan is satisfied. Since XXXX we have been dealing with a woman named XXXX XXXX, a Loan Recovery Administrator with XXXX XXXX. She is rude, unprofessional, and a very difficult human being to work with. When we spoke with her she threatened us by saying " I show no payment history on this loan and we should have foreclosed on this long ago, and in fact, should begin the process unless payment arrangements are made ''. We proved their payment records were incorrect and supplied evidence from bank statements showing the years of payments. They investigated and found the record of payment from XXXX through XXXX. She continues to threaten us with foreclosure. We felt backed into a corner and explained that we did not have XXXX and no way to get that to pay the bank. We even offered to come to a settlement for a smaller amount just to get them off of our back. They sent paperwork that we read over and decided not to follow up with at the time. We asked for a payoff for letter and were quoted a letter for a principal balance of {$19000.00}, with {$7000.00} interest through XX/XX/XXXX and an additional interest of {$2400.00} from XX/XX/XXXX-XX/XX/XXXX. When we asked for this, XXXX XXXX claimed " I have been calling you guys for MONTHS regarding the paperwork and have gotten nothing in return. '' We have received ZERO phone calls and nothing besides requested documents in the mail. When we asked the number she had called it is a number nobody in the family recognized. I have had the same phone number for well over 15 years. After the amount of contact we've had with them, they have no reason to have incorrect contact information. They have no right to charge us interest on a loan that was satisfied and certainly have no right to forcibly obligate us to a new loan term or payment without us seeing ANY paperwork for this random charge they feel is owed WELL after the loan has been done. After further researching our options though, we realize that XXXX XXXX 's practices are unethical and downright wrong. We are being treated as criminals and threatened with something they have no right the threaten us with to coerce us into making payment for a loan that is quoted as being " written off as a loss to the bank '', that they " can no longer charge interest on '' and is listed on credit reports as being " paid as agreed ''. Even with that information they REFUSE to file a lien release even when requested verbally or in writing and the company is not budging on their stance. Please see attached the payoff letter showing their unethical continued interest charges, the letter proving the loan written off, payment schedule proving they lied about applying anything after XX/XX/XXXX to principal, bankruptcy paperwork and the final decree showing our Chapter XXXX satisfied.

XXXX XXXX MORTGAGE Pre-qualification by an inexperienced lender can cost you hundreds or thousands! I am a new home buyer. I have never applied for a mortgage and did not know that you should not trust the person you are working with to know their job. On XX/XX/XXXX I submitted my first online mortgage application to XXXX XXXX. I had been referred by a co-worker to ask for XXXX XXXX because she was really helpful with her in the preliminary process and was able to get her approved in spite of credit issues. On XX/XX/XXXX I was contacted by XXXX XXXX of XXXX XXXX in XXXX, MI. She asked if she had my permission to run my full credit report. I gave her consent and the process began. I had worked hard over the course of 2 years to repair my credit that had plummeted due to some personal issues and I knew I still had a little ways to go, but thought it would be worth the time to get feedback from a lender on what I could do. I have also participated in two home buyer education courses and reviewed all of my credit a full year before applying. On XX/XX/XXXX XXXX sent me an email letting me know what my credit score had come in at. It was almost 50 points lower than what the credit monitoring site I had been using regularly reported. So I asked about that and XXXX told me that she seen some derogatory marks but that FHA considers other factors. She said that she would like to get all of my information and submit my file to underwriting prior to me finding a home to get me fully approved. I liked that idea as I had not begun a home search yet. She told me in email that once she submits it to underwriting she will have an answer in XXXX hours. On XX/XX/XXXX I submitted all of the required documents for XXXX to review. On XX/XX/XXXX I received a pre-qualification letter from XXXX stating that she had me approved for XXXX FHA. She then asked me if I had a buyer 's agent or if I was contacting the listing agent. I had planned to contact the listing agent of a home I was interested in and XXXX told me that it is always better to have a buyer 's agent. She gave me the name of XXXX of XXXX XXXX and a phone number to call her. In the same email communication I told XXXX that I wasn't ready to start looking for a home yet and asked how long the pre-qualification was good for. She told me I had 90 days and that there was no major rush. On XX/XX/XXXX XXXX again reached out to me via email and asked me how it was going with the home search and to see if I had decided on using a buyer 's agent or listing agent. I told her I would give the person a call that she had recommended. I was super excited to think that there would not be any issues with financing a home as long as I stayed well under the XXXX to ensure I had the down payment needed and could afford the mortgage without struggling. The fact that XXXX had told me she was submitting my file to underwriting and then gave me a letter and the name of a realtor led me to believe that she had reviewed my credit history, underwriting had no concerns with it, and made me feel confident in starting my home search. I called XXXX, I signed a realtor attainment form with her and together we found a home priced at XXXX. I submitted a purchase agreement and good faith deposit of XXXX on XX/XX/XXXX and it was accepted. I had taken my XXXX children to this home, the first home that they would ever live in, and had them feeling hopeful. On XX/XX/XXXX I paid XXXX for a Home Inspection. The Inspector required a furnace inspection. The furnace inspection costed XXXX and was paid on XX/XX/XXXX. I then met with XXXX in her XXXX office and reviewed my credit history and had to provide details on the derogatory marks before submitting it to underwriting for final approval and to set up closing. On XX/XX/XXXX I received an email from XXXX letting me know that my application was denied due to derogatory credit history. She suggested that I pay off some of the non-medical collections and offered to give me some phone numbers. I want to help spread the word that this is real, families get their hopes up and dream of home ownership but not all mortgage lenders are knowledgeable in reading credit and being honest about concerns in the beginning. Had she told me that I should work on paying off the negative outstanding derogatory marks in the beginning I could have saved the money from the home and furnace inspection and used it to pay off two of them. I also find it difficult to believe that if she submitted my file to underwriting prior to my home search that they wouldn't have identified concerns early on. I feel like she was dishonest about her knowledge and she was not being supervised. I also wouldn't have XXXX heart broken children. I would recommend to anyone, don't go to XXXX XXXX for a Mortgage. A similar situation happened to a co-worker that had also gone through XXXX around the same time as myself. She unfortunately lost out on more money than I did. XXXX also referred her to XXXX as well. Do your research and find someone that has been in the business a long time, or if they are newer, have a very hands on supervisor overseeing everything.

This Complaint is being filed subsequently to those filed last spring. The " Construction '' period has expired and with no further documentation, payments, etc provided by the bank. I closed on my home on XX/XX/XXXX. Unbeknownst to me until XXXX of this year when I finally received my Closing Package, I was given a straight " construction loan '' on my home that was built in XXXX. The " one year interest only " construction '' period '' expired over a month ago. I have not received any updated information or payment amount for the permanent phase. Thus, my " Complaint '' and requests as follows- The correct information to " know before I ( went ) '' was not given to me prior to close. I need it now to know before I keep going. I 'm asking for straight, simple and honest answers to the following- 1. The Closing Disclosure provided by Chemical Bank states I paid {$140000.00} for my home. The loan estimate they prepared and which is dated XX/XX/XXXX also states I paid {$140000.00}. The XXXX states I paid {$110000.00}. Is Chemical Bank correct or incorrect? 2. My home was built and granted an Affidavit of Occupancy in XXXX. I was given a " Construction Loan '' for the purchase of my home. Does Chemical Bank believe current RESPA/TILA rules and regulations allow that? 3. The Mortgage, Deed, and Title are all in my name alone. Does Chemical Bank have any documents that are part of my loan in anyone else 's name? 4. There is no downpayment indicated on the Closing Disclosure. Does that mean no down payment was required for my loan? 5. There is no " Construction Holdback '' on the Closing Disclosure. Does that mean there was not an amount held back for Construction but rather that the entire loan amount, namely {$110000.00}, was disbursed? 6. Other Costs ( E ) states them to be {$110.00}. ( 01 ) a. Does {$25.00} plus {$68.00} equal {$110.00}? b. Is Chemical Bank willing to present the Closing Disclosure to the CFPB to be reviewed for Compliance? 7. Cash to Close. Chemical Bank states the Closing Disclosure was based on the Loan Estimate they dated XX/XX/XXXX and which states Seller would be RECEIVING {$100000.00} at close. This follows estimate dated XX/XX/XXXX for a Purchase Loan. The Closing Disclosure which was provided on XX/XX/XXXX for the XX/XX/XXXX closing required {$26000.00} be BROUGHT to close. Do those numbers meet compliance /tolerance requirements? Please include the specific regulations Chemical Bank utilized to support this {$130000.00} difference. 8. Loan Calculations ( page 5 of CD ) states {$110000.00} was " financed after paying upfront finance charges ''. Please provide the amount of those " upfront charges '' and a ledger of where the {$110000.00} was disbursed. 9. The Closing Disclosure does not state this loan to be " construction to permanent ''. Does that mean it 's not construction to permanent? 9. The closing took place on XX/XX/XXXX. I moved into my home last fall and have not received any " construction draws ''. 10. The attached Appraisal states the current value of my home to be {$170000.00} ( {$1000.00} more than the value given on the Closing Disclosure ). No work has been done by others on my home in the last 120 days. a. Is Chemical Bank willing to provide a draw for the {$23000.00}? b. If not, is the bank willing to make the required corrections to the Closing Disclosure and all other associated documents and recordings reflecting the actual purchase and loan amounts? c. Refund the {$650.00} " Construction Admin Fee '' I paid at close? d. Refund the differences incurred in the lesser loan amounts? e. Refund any and all other excessive amounts charged and which will be revealed upon executing the Closing Disclosure properly/as required? 11. The Closing Disclosure states XXXX XX/XX/XXXX and XXXX XXXX to be my contacts. a. Did XX/XX/XXXX/Chemical Provide the required letters, information and local contact pertaining to their take over of XXXX XXXX? b. We purchased a vehicle from XXXX on XX/XX/XXXX On XX/XX/XXXX I used my Chemical Bank debit card to pay a {$100.00} hold on the vehicle. They were supposed to collect the remainder of the {$1000.00} downpayment when they delivered the vehicle. 30 minutes after they left, we realized that they did not collect the downpayment. However, I thought I had signed a paper stating that there was nothing due. The next day, the dealership called and asked if the {$900.00} had been collected and my wife said no. He said this needed to be taken care of immediately. She explained the money needed to be redeposited to make the payment and she would call him the next day. He said he would call her but when she had n't heard from him by XXXX, she called him. He said he would call her back in 15-20 minutes. He never called. We received one call from the dealership in the next week asking them to call us back. In the meantime, we had received copies of the paperwork we had signed but became concerned when I saw that I had signed something that said nothing due, as well as questions about the numbers on the bill of sale. XX/XX/XXXX, the salesman ( XXXX XXXX ) called my wife 4 times but she was unable to answer because she was dealing with our sick child. Because of how crazily he was calling my wife, I sent him an email with a letter attached I planned on sending certified mail saying further contact needed to be done via postal mail and that if it was regarding the {$900.00}, we would pay it once we received the financing paperwork and could rectify the numbers. XXXX emailed back and said there was paperwork that was not signed and this needed to be taken care of ASAP. I said my wife would call the next day. On XX/XX/XXXX, I checked my bank account and saw that an unauthorized charge of {$710.00} and some change from XXXX. I immediately placed a stop payment on the charge. When she called, after making arrangements for the signing of the paperwork, he asked when XXXX would get the remainder of the down payment. She asked him, " What are you talking about? You drained our bank account without our permission. '' He replied, " Yeah, you still owe {$180.00}. I was able to dig up your credit card number from when you made the payment to hold the vehicle. I was only able to get the {$710.00} to go through. '' At this point, my wife said we would mail the payment within the next two weeks but after further discussion, we decided to wait until we saw the financing paperwork as we had told them previously. We filed a dispute with Chemical Bank on XX/XX/XXXX. We were told we would get a provisional credit and that it sounded open and shut that we had not authorized the transaction. In addition, we asked why the transaction was allowed to be approved since we know that there were multiple declines on that card from that vendor which is a sign of a fraudulent transaction. We were told, " I do n't know, I do n't have a crystal ball any more than you do. '' On XX/XX/XXXX, we were asked more questions and told that it was not looking likely we would get our funds back. We heard nothing further until XX/XX/XXXX when we were asked to provide more documentation about what we had concerns with. We sent copies of what we had but we are still waiting on the financing paperwork. I have provided the bank with proof that I had not authorized the dealership to take the payment but they are playing XXXX with who should have the funds. This is not their concern. I did not authorize the transaction, period. In addition, the bank has been allowing transactions to go through the account even though it is deeply in arrears and is now accruing overdraft charges because we never received the preliminary funds we were promised for the investigation. Chemical Bank 's behavior is completely irresponsible.

On XX/XX/XXXX my fianc & I were pre-approved for a home loan. I was honest from day one about his bankruptcy & foreclosure. XXXX from XXXX XXXX said it wouldn't be an issue. XXXX referred us to XXXX from XXXX XXXX to help us sell my existing home. We found the home that would fit our family and our budget. We had a few problems with HUD from the home my fianc previously owned and then HUD cleared him. We also had an issue with our DTI ratio & my fianc borrowing money from his XXXX, so XXXX said then later said our DTI was fine. On XX/XX/XXXX XXXX text saying she was targeting XX/XX/XXXX, and XXXX for closing. When those dates came & went XXXX then said she was working out double closings for the old home & the new home on the same day ( XXXX ). Then we were ready to go back to underwriting XXXX said we needed to pay off {$4500.00} worth of our debt, so we did. At this time because XXXX kept changing what we needed to do & to submit we asked for help from her manager XXXX. On XX/XX/XXXX, we were waiting to hear from the underwriter. Then on XX/XX/XXXX the underwriter wanted a whole list of additional paperwork for a conditional approval. On XX/XX/XXXX we signed the closing disclosure & I sold my old house. On XX/XX/XXXX XXXX just sent over our appraisal to FHA after sitting on our appraisal for a week, knowing they hold it for 3 days. So our new closing date was XX/XX/XXXX and she sent over an updated addendum extending our closing date. XXXX then instructed me to finalize my homeowners insurance for the XXXX and either pay it directly or bring the money to the closing. Then she would submit for the final approval. XX/XX/XXXX came and XXXX said she was still waiting to hear to be able to close. Then we get an email from XXXX stating our loan was randomly selected for a pre-funding audit and she was waiting to hear from the compliance department. Two days later on XX/XX/XXXX XXXX emails me stating our loan has been denied. Stating that the 3 year waiting requirement has not been met since the previous foreclosure & she has attached the denial letter. We were already cleared from the foreclosure issue on XX/XX/XXXX. Since the denial I went alone and was approved for a new loan for XXXX through XXXX XXXX which only took them 6 days to approve me..not pre-approve. In the meantime the owner of the home that we had the purchase agreement with had had enough with Chemical Bank 's stuff & listed the house with a realtor. I put in another purchase agreement but I was 6 days too late & he accepted another offer and wouldn't even let us explain what had happened. So we are out the {$1000.00} we putdown on the purchase agreement, the {$500.00} for the appraisal, & {$300.00} for the inspection. We are basically homeless due to XXXX XXXX negligence with our forever home not a possibility anymore. XXXX XXXX did the same thing to a coworker who paid for the same things & then was denied before the promised closing date. This is obviously an ongoing issue but I could get no resolve from XXXX XXXX. I am asking for your help to ensure no one goes through this tedious process, spends their hard earned money, and wastes precious time to be denied in the end. I understand people get denied but XXXX from XXXX XXXX does NOT know her job. A trained person whos job is to help secure loans for people had to have know my fianc had no chance of securing a loan because of his foreclosure but still had us go through the whole process only to lose the home we so desired. I purchased and closed on a condo on XX/XX/2016. I obtained my financing thru XXXX XXXX who was at that time working for XXXX. I 've attached his current contact info. XXXX never informed me that XXXX was being purchased by Chemical Bank, which purchase was in the news 2 weeks later. He sent me an email the day he left XXXX to go to XXXX XXXX Bank informing me of his move and that he was very upset with Chemical Bank. I believe, along with a couple of other Realtors who have done business with him, that he may have deliberately not passed along the appropriate info to spite them. That being said, I know that it 's ultimately the bank 's job to get things done correctly and legally. XXXX told me I was getting a conventional portfolio loan for the condo purchase ( {$110000.00} purchase price ) with a {$23000.00} XXXX Homestyle Construction Loan ( on PA ) attached for renovation. I had to go thru a ton of hoops to get my financing but finally got the clear to close a month after the original contracted date. We closed on XX/XX/XXXX at XXXX with a closing agent who had not previously seen nor done any work on my file so she was flustered making me the same. The contractor who was going to do the interior work on my condo was at the closing as well but he was not asked by XXXX to sign the Construction Indemnity Agreement which has created a ton of duress since he made a mess of my condo, left the job XX/XX/XXXX, refused to the lien waivers needed to receive payment and has filed a Notice Of Lis Pendens XX/XX/XXXX. Although the Construction Contract I signed states that I am the contractor, Chemical Bank has refused to give me any draws from my construction loan leaving me in financial squeeze play. Although the only person in Chemical Bank 's entire staff who I 've been told repeatedly has any say regarding my construction rider, XXXX XXXX, says he refuses to disburse any of my money has been saying it 's due to the contractor, I believe it 's actually due my {$23000.00} having been stolen/laundered or vanished by some other means or person. I 've repeatedly asked both the XXXX and XXXX where the money is/for accounting or deposit records but they both refuse to give them or any other info. I 've attached the Closing Disclosure, XXXX Settlement Statement and most recent Chemical Bank statement. I do n't have a GFE and XXXX XXXX claims he does n't have access to it. The CD and XXXX do n't match up. They have different purchase prices, {$110000.00} and {$140000.00}. XXXX has a construction holdback. The CD does not. Another title company said a Commencement of Construction should have been recorded but was not. There is not a broker statement in my package either. XXXX XXXX, my broker until last Friday, has financial interest in XXXX.. When I started asking questions about all of this mess, XXXX deactivated my business email account along with other necessary computer/electronic signing capabilities, thus hiding evidence of all the work I did to try getting this figured out and resolved, along with making it impossible for me to work. I have been trying to get answers, explanations and resolution on my extremely TRID defiant home loan since I closed on XX/XX/2016. I did previously submit a complaint and XXXX XXXX, attorney for Chemical Bank responded to me via email, that although he knows NOTHING about TRID, RESPA/TILA or their rules that regulate mortgages, he believes the bank has done nothing wrong. I ca n't find anything right about my loan. There is nothing consistent about anything on either the LE or CD, along with their choosing to ignore forms they had me sign, from a Construction Loan Agreement for the construction rider, to an Affidavit of Occupancy which forced me to live in my home without basic items such as toilets, lights, sinks, faucets, cabinets, counters or a safe electrical system due to their refusal to disburse funds from my construction rider and although the XXXX claims to have dispersed the funds to them. Why would a buyer have to sign one to occupy in 60 days if this was a construction loan from the ground up??? Chemical Bank 's emails to me clearly indicate that they will do nothing to right this extremely WRONG situation without outside assistance. I have shown my closing docs to several title companies, lenders and Realtors with decades of experience who 've all said they 've never seen anything like it. Although the LE says I was to bring no money to close, the CD said I had to bring almost {$28000.00}. There is major inconsistency in the interest rates, purchase price, estimated payment vs bank statements, I received the CD the afternoon prior to closing at XXXX the next day. None of the docs show my XXXX % downpayment although the docs clearly state mine to be a conventional loan. I could keep going but am hoping and praying that the CFBP steps in for me just seeing what I 've attached and/or talking with Chemical Bank to personally hear that they are not willing to do anything to correct this. I 've asked them to cancel the " construction portion '' of my loan, which I showed them TRID allows me to do since they have not given me even a penny from it. They refused. I asked if they would convert the " construction loan '' to a " home equity loan '' because the " construction '' is basically complete, thus a " construction loan no longer needed. Again, I was denied. And again, I see the only way for Chemical Bank to comply to TRID regulations and my loan made to be even sane, is to have the CFBP step in. On XX/XX/2019 I transferred all funds ( less {$50.00} ) from my checking account ( xxxxXX/XX/XXXX ) to my savings account ( xxxxXX/XX/XXXX ) at the TCF Bank # XXXX, Branch XXXX located at XXXX XXXX XXXX XXXX., XXXX, AZ XXXX. On XX/XX/2019 I submitted a Recurring Debit Card Stop Payment Request Back Up Form. I was informed by the teller that my account would be charged {$37.00} for this request. Also, on XX/XX/XXXX XXXX XXXX Payment submitted an ACH debit request for {$340.00}. On XX/XX/XXXX my savings account was debited {$350.00} which included a {$10.00} Overdraft Protection fee. My checking account was also debited for the {$37.00} Non-Sufficient Funds fee. I went to the bank to challenge this mistake and to clarify that I did not have Overdraft Protection and for my funds to be returned to the savings account. The teller presented my Stop Payment receipt to the branch manager who advised that she would resolve the matter and notify me accordingly. Before leaving the bank, I transferred {$100.00} to my checking account from my savings account. Later on XX/XX/XXXX I received an email thanking me for enrolling in TCF Banks Overdraft Protection Savings Transfer Service. On XX/XX/XXXX I received an email notifying me that the Overdraft Protection Service has been cancelled. On XX/XX/XXXX I sent an email to XXXX stating that I did not order Overdraft Protection, that my wife was given the runaround when she contacted customer service through the toll number, and that my funds should be returned to my savings account by XX/XX/2019. On XX/XX/XXXX I received Confirmation of Stop Payment Request by email. Also, on XX/XX/XXXX I went into the branch and spoke with the manager who advised me that I could not have my funds that were impermissibly removedreturned because the debit was a legitimate transaction. This made no sense to me and I politely left the bank. On XX/XX/XXXX I received and email notifying me that the {$37.00} Non-Sufficient Funds fee was reversed. Later on XX/XX/XXXX, my wife who generally handles the bankingwent to the bank and spoke with the assistant manger and still was not able to resolve the matter of the bank owning up to its mistakes and refunding our money. The assistant manager sent an email to the branch manager that we wanted the matter escalated beyond the branch. To date, we have not heard from TCF and our savings account has not been credited.

My Mortgage Loan and Equity Line of Credit Loan were purchased in an acquisition by Chemical Bank based out of Michigan. For the last five months I have made my payments on time however they ca n't seem to post the proper information to my account. Notified each and every month since they have acquired XXXX and every month I receive a different story. They have posted my payments improperly and continue to charge interest never making an adjustment simply telling me they will get it corrected. This month for example my payment due date is the XXXX and due no later than the XXXX. I made my payment on the XXXX carried into the branch and today I receive my statement dated the XXXX that I am past due by one payment. Of course they continue to charge interest based on the statement of the XXXX. Today when I contact them I am told they are required to send out the notice and or statement 10 days after it is due however in prior months the statements are dated the XXXX of the month. Now all of a sudden if payment is not received 10 days after the due date they will consider it to be late. The terms continue to change. On my original loans my payment stub read due on the XXXX and if paid AFTER the XXXX a late fee would apply. They conveniently changed their coupon slips to read that if the payment was made ON the XXXX that a late fee would apply. No notifications sent to the consumer and defending this action by telling me that this was a mandated Federal requirement. I have made payments on my accounts and they posted it all to principal then send me a statement the following month telling me I am past due and that I owe additional interest. Every month is a different set of problems and a different set of terms. I have been paying on this account for going on the 12th year and have never been late and never had a problem, THAT IS until these folks acquired the loan. How many folks are they gouging for late fee 's that do not realize it. How many folks are they posting improperly to the account to generate additional interest and folks do not realize it. I am tired of the aggravation monthly and am tired of the EXCUSES!!!!!

During the month of XX/XX/XXXX, several fraudulent charges hit my account from XXXX See attached. I reported these charges as fraudulent and received a provisional credit. Several months later, the provisional credit was reversed without any explanation. When I called and spoke with TCF Bank security department, I was told that the merchant provided a copy of the transaction as it appeared from their end. I explained to XXXX (? ) that a receipt for a fraudulent transaction does not make is any less fraudulent as that is not proof I authorized or benefited from the charge. She fumbled with her words and failed to add any logical reasoning and referred to TCF policy that simply having the vendor respond is proof enough. This is absurd. Here is the statement from the TCF Bank website on Identity-Protection which does not match their actual practices : We provide zero fraud liability. Consumers are not held responsible for fraudulent charges made from your account. Consumers must notify us within 60 days after we send you a statement on which the unauthorized use first appears. Certain conditions and limitations may apply. Unfortunately, your security department is not protecting your customers and instead protecting merchants. I am disappointed because of the basis of the decision and I was wrongly billed for services I never received. To resolve the problem, I would appreciate your company reversing the fraudulent charges. Enclosed are copies of my records. Ive copied this message to all consumer protection and banking regulation establishments in order to facilitate the process and help you produce better safeguards to protect your customers. Im also seeking an investigation into TCF Bank procedures as I can only imagine the other families that have struggled through this nightmare. I look forward to your reply and a resolution to my problem before seeking help from additional agencies or council.

I had quite a bit of frustration after receiving information that I would be charged upwards of {$33.00} an hour to have someone find a transaction for me from XX/XX/2015. I told XXXX from the Grand Haven branch on XXXX XXXX that this seemed backwards to me that I would have to pay to access my own history. She stated that it was the policy and that she stand by it. I told her that seems really unfair and that it does n't make sense that I would be charged when in my opinion the payment equals out pretty well considering that its the combination of they customers money that allows Chemical to loan money and earn interest. She laughed lightly and continued to state that this conversation is not going down that path. I told her alright well I do n't want to pay that, and I 'd like to file a complaint not on the person, but on the policy because it does n't seem fair to me ( I just want Chemical to know that because none of the credit unions I belong to have ever asked that ). She giggled again and said that she would transfer me but then hung up on me. I called back again and asked why she hung up on me, she hung up on me again. I called for the 3rd time and the call was answered and immediately send to a waiting line. Around 3-5 minutes later someone answered, apologized for the situation and said that I had been transferred to the wrong line. I said thats okay and she transferred me again but I have now been on hold the duration of me typing this message. ** editing this after 12 minutes on hold - I was hung up on again from the call waiting line. Overall, I came in rather disgruntled at having to pay a lot of money to look up one transaction on a specific date and time, and I came out with a total distaste for the employees at my bank. This is why I prefer to deal with credit unions. I will not be banking with Chemical for much longer.

On XXXX XXXX TCF bank authorized XXXX XXXX to recieve a {$110.00}. payment from my checking account. I contacted the back the same day I explained to the bank that I did not authorize this transaction. I requested an investigation to be made into this purchase and I acclaimed that it was fraud. I also contacted XXXX XXXX and requested that my funds be returned to my account. For the next 4 months TCF bank harrassed me lied and continued to take money out of my account causing mental and financial distress. I have been a customer with this bank for over 12 years i have never overdrawn my account. i called this bank numerous times and spoke to numerous reps explaining that the refund had been issued i was even told that the situation was resolved. I went to a local store to purchase a cup of coffee my transaction was declined. I was so frustrated and embarrassed i couldnt understand what was going on. I then got a letter saying that after the investigation they resolved it was my fault and it was something i had to take up with the company. Now 4 months later XX/XX/XXXX the bank goes into my account when i had exactly the amount to cover my transactions the bank tries again to recover {$110.00} from my account again sending me into the negative and switching the dates on the statement to seem as if their transaction was before my transactions that i had funds for and charged me 3xs {$35.00} over draft fees TCF and started sending me letters for their money. How is it that a bank can look at an account and maliciously attempt to aggresively collect revenue from a false claim? The bank gave zero effort into the investigation they claimed that was done because i contacted the company and used it as an attempt to collect money from me a poor single mother of XXXX a loyal customer who actually had the funds to pay for my purchase.???

In XX/XX/XXXX I moved out of the state of Michigan. I was unaware that anything that my bank account at XXXX XXXX went negative. I had stopped using it when i moved. in XX/XX/XXXX i attempted to open a joint account with my teenage son at XXXX XXXX XXXX and was declined because a XXXX report. They said the account was charged off, and i could not pay it off ( {$39.00} and some change ) I asked how i could have this removed, the representative at the time told me to dispute it with XXXX. I did. The dispute showed i was responsible, which i never actually disagreed with. I just wanted to pay it. I finally contacted a corporate office, who gave me the ODP department. They told me to pay the balance, and it would be removed. they also told me to include a letter stating i wanted a copy of the letter of it being paid for my records. When i recieved that letter XX/XX/XXXX It was titled Paid in full letter. and stated that i had paid my balance and closed my account with XXXX XXXX, however, it would remain on XXXX XXXX. This is unfair. I paid my balance. This remark should be removed. It is keeping me from opening accounts for my children and improving my financial future. I paid my debt. Have had problems with this account since opening 5 years ago, this account is hardly used, pretty much for auto deposits from employer ( Ive been on medical leave most of this year ) - 1 ) To this very day have NEVER received a Debit Card even though requested at least 3 times. 2 ) Originally when opened set up to access at the BRANCH, until last month have never been able to access again online even though called them several times for help, they referred to Illinois office, who never followed up. 3 ) Last month after getting a statement showing they were charging me for mailing statements, they finally unlocked account and I was able to access online ONCE. I changed to paperless statements and logged out and have not used the account since. 4 ) Yesterday I received an alert email from them that the account was frozen due to to many incorrect attempts to login at XXXX. I did NOT try to login and no one could have possibly gotten the account information from me. Thinking that someone was trying to hack in to TCF, I called them. I tried several times yesterday, called & spoke to THREE different employees. They were NOT willing to help and only offered to help unlock the account and said they DO NOT have a Department that handles security isses! I emailed & sent the details through corporate contact, with NO response. Its really sad that fraud was attempted and they don't even care to help.

I applied for a refinance of my existing mortgage with XXXX Bank on XX/XX/2019 and was denied on XX/XX/2019 after being told repeatedly we were near closing as early as XXXX. I had a closing date scheduled for XX/XX/2019 that was canceled due to problems on the lender side, that should have been resolved prior to scheduling closing. The lender will explain that there were liens on the property that delayed closing, but all liens were in the form of forgivable - conditional grants originated from and held by the lender. I even had to put in a call and resolve one of the liens because of incompetence on the part of the lender. I was able to complete this on the same day. The email and letter documentation are attached. From the outset of this process I have been disregarded as a person and instead treated as just another file. As an existing customer, I expected courtesy, decency and communication. It is not lost on me that after it was decided my loan would be denied the swiftness the lender was able to send out that paper work. Because of the unnecessarily long process and delay I had to make financial decisions that made the most sense for me in the moment. Ultimately, this process has destroyed my credit and ability to now refinance with a different lender.

Chemical Bank sent a check from my escrow account to the wrong Homeowner 's Insurance provider, and my escrow account has not been credited for the mistaken transaction. XX/XX/2019 : Chemical Bank issues a payment of {$1500.00} to XXXX XX/XX/2019 : I switch Homeowner 's Insurance providers, from XXXX to XXXX XX/XX/2019 : XXXX issues a refund check for {$1300.00} for the cancelled homeowner 's policy. XX/XX/2019 : Chemical Bank issues a payment of {$1600.00} to XXXX ( the old Homeowner 's Insurance provider who no longer services me ) XX/XX/2019 : I deposit the refund check of {$1300.00} into my escrow account. XX/XX/2019 : I receive a letter from XXXX stating they have not received payment for my homeowner 's policy from my bank. I call Chemical Bank and the discover the original payment for {$1600.00} was sent to the wrong insurance company, XXXX. The issue a payment to XXXX for {$1600.00}. I am told to contact XXXX to about getting my money back. XXXX have no record of the payment associated to me, stating that the money would've come over in a larger check, associated with many policies, and have no record of anything for my account. XX/XX/2016 my mortgage was sold by XXXX Bank to Chemical Bank. My XXXX XXXX payment went to XXXX who was to transfer to Chemical. Dear Sir or Madam My Mom passed XX/XX/XXXX. I was a co signer on a loan for Her. The Estate properly notified for all debtors to collect through the probate court as required by Law. Not once did I receive a notice that the account was delinquent or in jeopardy of prosecution as a co-signer. I responded to the letter personally thinking that the Holidays would not count in a 21 day response time. Prior to this transfer, I stopped my automatic payments and wanted to pay them myself. In XXXX 2017 I changed my primary checking account and signed up for E-billing services as advertised. Since then I have been receiving the e-bills sporadically and have called Customer Service several times, most recently today. The probem extends to more than one biller so I think the problem is within my bank. In each case i was told it would be up to me to contact the biller to resolve the problem. As I think the answer to the problem is technical in nature and in " bits and bytes '' terminology I do n't think its my place to resolve the problems. If they offer E-Billing, and I signed up for the program, I think its up to my bank to resolve the problem.

I received a statement from Chemical Ban k reflecting a balance of {$75.00} consisting of a {$75.00} annual fee for the line of credit PLUS a 0.18 in terest charge. Chemical Bank also charged the {$75.00} against my line of credit. When I called to inquire about this practice, I was informed that it was permitted by my contract. On Thursday XX/XX/2019 I went to a branch of Chemical Bank to pay off the existing balance of my home mortgage. Instead of charging me the existing balance, they added a {$30.00} " registration fee '' that was no where described in their truth in lending disclosure or complete terms of the mortgage. My mortgage was transferred to Chemical Bank 3 months ago. Every month the bank has assessed me a late fee.
