We started a process to purchase a home through Taylor Morrison Home Founding XX/XX/XXXX. The realtor that took us there was XXXX XXXX and the representative of Taylor Morrison Home founding is XXXX XXXX. We agreed to purchase property located at XXXX XXXX XXXX XXXX. XXXX XXXX XXXX NV XXXX. There was a downpayment made for earnest money in the amount of XXXX XXXX XXXX dollars split in 3 different payments. A few days after I was contacted by XXXX XXXX loan officer for Taylor Morrison Home Founding via email and telephone. I provided to XXXX XXXX tax statements, paystubs and social security number to run my credit for loan approval through Taylor Morrison Home Founding. A few days later I was again contacted by XXXX XXXX XXXX XXXX giving me the bad news that I did not qualify for the loan to purchase the property. Almost immediately I contacted XXXX XXXX to notify her of the bad news and she told me she would contact XXXX XXXX to find out what exactly was happening and would get back to me. I received no call back from XXXX, so during the mean time I continued to reach out to XXXX but was again notified that there was nothing he could do but I did not qualify for a loan through Taylor Morrison Home founding. I was only notified via phone and never received a Denied Notice or Adverse Notice or anything that said I did not qualify in writing. I reached out to XXXX to request the refund of the XXXX XXXX XXXX dollars given at the beginning of the process. I reached out to XXXX via text messages, phone calls and emails almost every time with no answer. XXXX XXXX days had gone by and still had not received any notices from Taylor Morrison Home Founding about my refund. Our Realtor XXXX XXXX refers me to a company where loan officer XXXX XXXX tried helping XXXX qualify for a loan through a third party lender, I provided all my information again and a few days later was notified that we did not qualify through the either. I kept in contact with XXXX XXXX to obtain my refund and was notified that I would not be receiving my money back because I chose to go through a third party lender. On XX/XX/XXXX I finally received an email from XXXX XXXX stating the above mention details regarding my refund. In the email it states that the company would not be returning the earnest money deposit and they had agreed to hold the money and would honor the deposit if we decided to move forward with the purchase within the next 6 months. My wife and I did not want to lose the earnest money so we decided to move forward with the purchase and comply with the requirements asked by the company for I could qualify for a loan through Taylor Morrison Home Founding again. Once again on XX/XX/XXXX We signed and amendment to purchase agreement with XXXX XXXX, The Price of the house was adjusted, XXXX also mentioned that it would be better if a Spanish speaking loan officer would contact us so that we could understand each other better. I was contacted by XXXX XXXX via email, so I reached out to him via phone call to ask him if they had received documents sent by me to initiate the process and he notified me that yes they had received them but I was going to be contacted by a Spanish speaking loan officer named XXXX XXXX XXXX, that he had already sent her an email to reach out to me but I had to reach out to XXXX XXXX on XX/XX/XXXX to let her know that no one had gotten in contact with me yet so she sent me XXXX XXXX XXXX contact information so that I could reach out her. I called her and left a message asking her to get in contact with me and she reached out to me XX/XX/XXXX. She asked me what I needed so I explained to her that I was notified by XXXX XXXX and XXXX XXXX she was going to be my new loan XXXX because she spoke Spanish and we would understand each other better. XXXX XXXX XXXX notified me that she was never notified that my filed assigned to her so I would have to reach back out to XXXX XXXX because she could not help just like that and that she wasnt qualified to assist clients in Nevada, I tried to contact XXXX XXXX via telephone with no answer but I was able to leave a message. XXXX XXXX never returned my call to message, but I was contacted by XXXX XXXX XXXX the following day and she notified me that she was taking over my application and that there had been something with a system that didnt recognized her and did not allow her to confirm if she could help clients in Nevada but that she was going to be able to help me after all but that she noticed that I was fluent in English so it was better for her to speak English instead. After getting in contact with XXXX I proceeded to provide her with all the necessary information to qualify for the loan through Taylor Morrison Home Founding. On XX/XX/XXXX XXXX XXXX XXXX contacted me via telephone and notified me that I did not qualify again for the loan through Taylor Morisson Home Founding even after providing all the information required by the company, I asked her why I did not qualify and she informed because I did not meet the income requirement and that she was sorry but there was nothing she could do for me. On XX/XX/XXXX I reached out to XXXX via email to ask her to provide me a Denied Notice or Adverse Notice and she responded the same day Via email notifying me that a pre-qualification does not require and adverse action and that only files that go to the underwriting department require and adverse action and to refer to my other lender that initially provided a decision from underwriting on my loan application. On the conversation I had with XXXX XXXX XXXX on XX/XX/XXXX she explained that she would reach out to XXXX XXXX and explain to her what was going on. On XX/XX/XXXX XXXX also responded to an email I sent her asking her for written notification of the Denial of my approval, In which she sated that she would look into what is going on. Its been more than a year since this whole process was initiated and the company Taylor Morrison Home Founding is still refusing to issue me a refund on the money given as down payment at the beginning of this process. To the company it might be a large sum of money but to me it represents years of hard work in this country. I am not asking for any thing more or less that isnt mine, I am simply requesting to be refunded my hard earned money after I was denied the loan from the beginning. I find it highly unfair that the company is not being responsible for their actions and mistakes. My intentions from the beginning were to purchase the property and I understand that if did not qualify it was not possible, but I do not find it just that the company is deciding to keep the money that I worked so hard to earn.

I have sent three qualified written requests to Mattamy Home Funding , LLC to which they sent copies of closing documents I already have. I sent ten qualified written requests to XXXX, the " sub-servicer '' to which they respond with copies of what I already have from closing. I have sent three qualified written requests to XXXX XXXX XXXX XXXX XXXX to which there was no response at all. I have notified all parties at Mattamy Home Funding , LLC, XXXX XXXX XXXX XXXX XXXX and XXXX XXXX XXXX XXXX XXXX that I am exercising my right to rescind. XXXX XXXX XXXX XXXX XXXX is attempting to foreclose on my home with a trial date of XX/XX/2023. They have not responded to any of my letters or Notices. XXXX XXXX XXXX XXXX represents Mattamy Home Funding , LLC. XXXX XXXX XXXX from that firm responded only to my second Notice of Recission to state that my Recission was rejected with no proof that the disclosures were provided. They outright denied us our rights without explanation, justification, or remorse. We were not provided the disclosures, examples of how to rescind, or that I had the right to rescind at the original closing, nor was I made aware as the " loan '' or the " servicing rights '' were sold to XXXX XXXX and XXXX be either of these companies. According to 12 CFR 1026.23 ( a ), 12 CFR 226.23, and 12 CFR Part 1026.15 ( a ). or the Right to Rescind disclosures from XXXX XXXX. XXXX v XXXX XXXX XXXX XXXX XXXX, XXXX. TILA gives borrowers an unconditional three-day right to rescind. XXXX XXXX. 1635 ( a ). The three-day rescission period begins upon the consummation of the transaction or the delivery of the required rescission notices and disclosures, whichever occurs later. Required disclosures must be made to each consumer whose ownership interest is or will be subject to the security interest and must include two copies of a notice of the right to rescind. 12 C.F.R. 226.23 ( a ) - ( b ) ( 1 ). If the creditor fails to make the required disclosures or rescission notices, the borrowers right of rescission shall expire three years after the date of consummation of the transaction. Additionally, as stated in : 12 CFR 1026.23 ( h ) Special rules for foreclosures ( 1 ) Right to rescind. After the initiation of foreclosure on the consumer 's principal dwelling that secures the credit obligation, the consumer shall have the right to rescind the transaction if : ( ii ) The creditor did not provide the properly completed appropriate model form in appendix H of this part, or a substantially similar notice of rescission. 12 CFR 223.23 ( h ) Special rules for foreclosures ( 1 ) Right to rescind. After the initiation of foreclosure on the consumer 's principal dwelling that secures the credit obligation, the consumer shall have the right to rescind the transaction if : ( ii ) The creditor did not provide the properly completed appropriate model form in appendix H of this part, or a substantially similar notice of rescission. We were not provided disclosures Title 16 CFR 433.2 Preservation of consumers claims and defenses, unfair or deceptive acts or practices. In connection with any sale or lease of goods or services to consumers, in or affecting commerce as commerce is defined in the Federal Trade Commission Act, it is an unfair or deceptive act or practice within the meaning of section 5 of that Act for a seller, directly or indirectly, to : ( a ) Take or receive a consumer credit contract which fails to contain the following provision in at least ten point, bold face, type : NOTICE ANY HOLDER OF THIS CONSUMER CREDIT CONTRACT IS SUBJECT TO ALL CLAIMS AND DEFENSES WHICH THE DEBTOR COULD ASSERT AGAINST THE SELLER OF GOODS OR SERVICES OBTAINED PURSUANT HERETO OR WITH THE PROCEEDS HEREOF. We started a contract with XXXX XXXX in XX/XX/XXXX in the Estates of XXXX XXXX in XXXX, TX. We were initially scheduled to close on XX/XX/XXXX. In early XXXX, a trade flooded our master bath, master bedroom, and master closet. The damage was so severe that they had to replace the carpet, sheet rock in all affective areas, bathroom cabinetry, the wood in our kitchen, hallway, and pantry. This was the start to our horrific experience. Since then, our home has not been made a priority to correct and complete damaged repairs. Both the construction and Taylor Morrison lending teams have performed inadequately over and over again. There have been multiple challenges with our backsplash, interior and exterior paint, drywall, lack of delivery of products, light fixtures, tile, ceiling fans, overall execution, and quality of work. It took them 4 months to resolve an engineering issue with our bay windows my husband identified fairly early in the build process. In addition, we have experienced challenges with communication from our sales agent, construction, and the lending team. We have had 2 construction managers and now 2 loan officers ; countless leaders have walked our home to ensure that productivity, and it is still NOT finished. Taylor Morrison Funding has failed us again ( the first incident occurred on XX/XX/XXXX ) by waiting until the last minute to file our paperwork including our closing disclosure which further delays our closing for the 4th time. We have provided all required paperwork since XX/XX/XXXX and we have supplied them with any additional requests multiple times within hours of their request. We have had our external inspector inspect the home twice due to the limited access during his first inspection. We have expressed our anger several times to our sales agent and the construction managers, however, they have only been able to offer " I am sorry '' and " We are working on it ''. We assumed their leadership was not aware of this chaos since they have not made any concessions to offer any compensation, incentives, credits, home additions, etc for the inconvenience and poor client care their organization has caused. As a final result, we reached out to the Divisional President, XXXX XXXX, on Wednesday, XX/XX/XXXX, to express our frustration and disappointment, however, he too has not responded. This delay has negatively impacted us financially. We have lost 3 renters during this process as it will now be challenging to attract renters during the slower season of the year ( the holidays ). In addition, we are paying for furniture and decor we have not received due as we anticipate the move into our new home. Since our experience, a close friend shared her terrible experience with this builder in XXXX XXXX ( XXXX, TX ) as well. This is clearly the XXXX XXXX/TaylorMorrison business practice. We wish we would have known. We were unaware of the challenges this organization faces and the inability to deliver the product our hearts desired. We received better service and product from XXXX XXXX ( our current home builder ). Especially during this depressing season of COVID, racial injustices, and political warfare, this was supposed to be a happy and exciting time for our family. But instead, we are living a nightmare through this process with no end insight. We expect to hear a response from XXXX XXXX ' leadership team about our experience and how they plan to resolve.

I received conditional approval from XXXX XXXX ( Builder ) to build a new home several months ago for a certain loan amount ( XXXX XXXX ) based on a variety of factors, most of which are variable including the down payment and interest rate just to name a few. Long story short, I put down a good faith deposit of XXXX XXXX and provided the builder with documentation that I divorced and will now be responsible for child support of {$1000.00} per month. The builder failed to take this into account and re-calculate to see if I still qualify for the loan. XXXX ahead several more months in XX/XX/XXXX where I then went to the design center to select options for the home. These selections then increased the total price of the home to XXXX XXXX without taking into consideration other monthly fees associated with the home such as insurance, PMI, CDD fees, HOA, etc. XXXX XXXX again failed to re-calculate the adjusted loan amount to see if again, I would still qualify for this loan. A month or more goes by and I inquire with the finance specialist who I've been working with them to see if the calculations have been made to which she says know and hasn't received the design center spend amount. The finance person and I spoke on the phone and discussed that I obviously could no longer afford this home based on the updated numbers and current interest rates. She suggested that I speak to the sales person to see if they can ask management what my options would be at this point. Two weeks go by and I finally heard back from the sales person stating management would allow me to purchase a lower priced home, but would not return my XXXX XXXX deposit even though I clearly could not qualify. I spoke with the finance person ago over the last few days where she requested more pay documentation from me, inclusive of my last pay stub from XXXX and my last 2 pay stubs. On XX/XX/XXXX, she sends me an email stating they have re-calculated everything and I'm now approved for this loan and send me the new calculations. The new monthly loan amount is {$6000.00} with taxes and all fees included based on an interest rate of 6.375 %. My take home pay is ~ {$7400.00} per month. The loan amount ( {$6000.00} ) + my monthly child support payment ( {$1000.00} per month ) totals to ~ {$7000.00}, leaving me with about {$300.00} for other bills. I have a monthly car payment of {$600.00} and an individual loan with a monthly payment of ~ {$740.00}, both of which they're aware of much less all of the other normal bills a person would have including electric bill, food, etc. I clearly do not qualify for this home purchase, but it appears XXXX XXXX is trying to force a loan approval when the consumer can not afford it. They refuse to return my XXXX XXXX deposit and are trying to either a ) push me to cancel the agreement and keep my XXXX XXXX deposit or b ) are trying to force a sale when the buyer does not have the means to pay for such a loan. Please help!

This is our first home and when we visited the XXXX XXXX ( XXXX ) model home we were shared information about their upcoming community Smooth stream at the time of the sale we were told by the sales person that this is part of XXXX XXXX XXXX. On XX/XX/XXXX we were shared a governing document which we signed and send it back and we also gave {$49000.00} check as earnest money deposit under the impression that we were purchasing a home in The XXXX city. On XX/XX/XXXX we signed the pre contract document. In all of the documents the city information was used as XXXX XXXX XXXX XXXX XXXX XXXX TX XXXX. The closing date for this property was shared with us XX/XX/XXXX. We decided to go with builders lender XXXX XXXX XXXX XXXX funding as part of sales agreement being a first-time home buyer after receiving the appraisal report we had the option to decide whether we should proceed with the purchase of this property or not. We were given an appraisal report with the valuation of home being at {$600000.00}. On XX/XX/XXXX I signed the appraisal acknowledgement report and sent it back to the lender. The closing date was pushed to XX/XX/XXXX due to the property not being ready for closing. The closing for this property happened on XX/XX/XXXX title company was XXXX XXXX XXXX company. In all the loan and closing document the address for this property was used as XXXX XXXX XXXX XXXX The XXXX TX XXXX with the city information being XXXX XXXX. After closing at the time of transferring the utility service we found out that this property is actually located in XXXX but since the USPS uses zip code for mailing information the builder and lender used XXXX XXXX as city information. This property is located in XXXX XXXX township not the city when I tried to solve this with the builder and asked them to address this issue they refused and pointed me to the governing document. When I asked them to show me document with signature showing that we agreed to the fact that although this property is located in XXXX but we agreed to use XXXX XXXX as city information. We were trying to cope with the fact that we were cheated by deceptive tactics used by the builder and lender. The worst was yet to come we tried to re-finance this property on XX/XX/XXXX and on XX/XX/XXXX an appraisal was performed by XXXX XXXX and this property was appraised to the value of {$500000.00}. The builder and lender not only used deceptive techniques to sell us a property making it look like it is located it The XXXX XXXX and appraised the property to inflate the value of home higher than the actual value and being a first time home owner not giving us an opportunity to back out at the time of first appraisal performed for this property before closing.

We signed a contract to build a home with Taylor Morrison Home Builders on XX/XX/XXXX We chose to use their financing and trust their inspectors. They showed us several lots within the development that we liked and we chose a lot that was larger and listed for {$10000.00}. This lot is included in the contract. We went through a disastrous design and build process ( see letter attached in Step 3 ). Our questions during the process were met with total indifference and/or contempt. When it came time to appraise, the appraisal came in {$25000.00} below our purchase price. Taylor Morrison refused to acknowledge a problem. We met with their mortgage team, the sales department heads, among several others that did not acknowledge any issue and put the burden on us to make up the difference. They eventually gave us roughly {$2500.00} back in the purchase price but failed to explain how they made the difference of that amount up given we did not bring any more to closing, and our monthly payment did not change. At the final walk through of the home, I was asked to sign a paper saying that I acknowledge receipt of the landscaping and lawn in good order and they were not responsible for any dying grass or shrubs, etc. I asked to see the yard before signing. As we were walking the property our construction Superintendent ( XXXX XXXX ) left siting childcare issues. I never signed any document nor did we finish our final walk through as the house had to be locked. Once we moved in, I noticed immediately during the first rain that the yard did not drain properly ( see attached images ). The plan calls for water to move off the property however it ponds and does not move from the back. This has caused the grass to die, and hazardous conditions for our pets and selves. Mosquitos, fungus, bad odors all inhabit the yard. Taylor Morrison claims that the grass is not warranted, and there is nothing they can do about the yard holding water. They claim it is per the plan and refuse to determine why the water ponds. XXXX XXXX stated that our property was a " swale '' and that water ponding for 72 was totally acceptable. In all of our conversations with any representatives of Taylor Morrison, no one mentioned a swale, we did not acknowledge that our property is a swale, and it is inconceivable to me that they will not acknowledge the problem. During the entire process, we feel misled. There were serious misrepresentations that took place and the warranty program is a continuation of this pattern. They claim to be " the most trusted builder '' however our experience is much different.

I wanted to build with Taylor Morrison at their XXXX subdivision. It was the last lot and the sales Manager stated another buyer was waiting to sign a contract. Their loan officer had also said I would qualify for an amount of loan I did not think I could qualify for. With the high pressure to sell that last lot and excitement of qualifying for a big loan I made an earnest deposit for {$20000.00} ( XXXX XXXX dollars ). I did not even have the whole 5 % of the sales amount ready which would have resulted to an earnest deposit amount of about {$31.00}, XXXX. So, I signed a contract with Taylor Morrison about XX/XX/XXXX of 2020 with the $ XXXX deposit. About XX/XX/XXXX, after reviewing the sketch of the proposed building I sent a clarifying email to the sales agent to understand what I am getting and to emphasize the importance of a downstairs guest suite and one master suite on the main and other things of concern such as dedicated study for work at home capabilities. The sales Manager never replied. Instead I got an email asking me to survey my experience during sales. I then indicated that I will not fill out a survey until my questions were answered. After that then the agent texted me and said he was on vacation. So by early XXXX, the agent said no changes to the proposed building will be accepted and that none of those options can be honored. Then I made him aware that I will have to cancel the contract as the building does not meet my needs. He then said I would lose my earnest money deposit of $ XXXX. Later, I noticed that they asked an attorney to respond to my emails. The attorney stated that Taylor Morrison is not admitting any wrong doings but is willing to give 50 % of my deposit back if I would keep keep my mouth shut. Then I stated that losing $ XXXX is a big deal for me. Then he said I should wait for six months and apply it to another Taylor Morrison subdivision. I said that is reasonable provided the subdivision is in my county and I am assigned to a contact person who knows this agreement and will help me to make it happen. Since then, I have sent three emails about two weeks apart to the attorney and no one is responding or telling me anything. Meanwhile, Taylor Morrison has sold the lot I deposited my hard earned {$20000.00} on and yet holds tight my money and yet silent about it despite my several inquiries to resolve this. Please, I need help to recover my money so I will not be homeless. Thank you.

On XX/XX/XXXX I entered into a mortgage agreement with your company for the residence in XXXX XXXX, NC. In this mortgage agreement, I had paid for a newly built home at this address. During the walk through, my husband and I expressed concern to XXXX XXXX regarding the viability of the sod and if the drainage was satisfactory for the back yard. We were told by XXXX XXXX that the sod was dormant and would come up in the spring. He also stated that if we had drainage issues after the homes on our side of the street were finished, that they would likely need to re-grade our yard for proper drainage. Unfortunately, after proper and extensive lawn care, the sod has not rooted through no fault of our own and the front yard is completely dead. This was initially brought to XXXX XXXX attention in a warranty request at the end of XXXX. I did not receive communication from XXXX XXXX, so sent another request on XX/XX/XXXX ticket number XXXX regarding the yard issues. XXXX XXXX came to my residence to inspect the yard. I took him to the back yard where the poor drainage could be seen. I explained what XXXX XXXX had told us during our walk through and he told us that we were on a swell so that wouldnt change and there wasnt anything they could do. When I showed him our front yard, he expressed agreement that it was concerning and said that he would get in touch with upper management as landscaping wasnt covered under warranty. I expressed concern that it seemed as though some of the sod that was laid down prior to us closing was actually dead and not dormant. After over 5 weeks of communication with XXXX XXXX and his excuses as to the poor quality of my yard, XXXX XXXX informed me that there was nothing that XXXX XXXX could do. I also requested to see a certification that the sod that was laid down was in fact dormant and not dead, but I was told that wouldnt be possible. It is evident that XXXX XXXX does not stand behind the quality of their work. I would appreciate it if you could organize to replace the dead sod in the yard as well as correct the drainage in the back yard so that the grass can grow in the areas with excess moisture. I have moss, mushrooms and an abundance of insects in my yard due to the excessive moisture buildup and improper drainage. There are other builders in the area that stand behind their product and have replaced friends poor quality yards with no contest.

Taylor Morrison XXXX XXXX XXXX Called Taylor Morrison XXXX to drop my private mortgage insurance ( PMI ) - offered info for improvements they declined and said they would review and notify me in 2 weeks didn't get any info XXXX called back and they told me they needed money XXXX {$150.00} paid they took from my checking- I offered improvement info and they declined it and they said they would contact me by XXXX didn't hear back XXXX called back to follow up and they said they needed 2 more weeks XXXX called back and they said they mailed my money back cuz they didn't get my improvement list- I checked my mail box and no money or letter so called back they took out {$150.00} and gave me an email address to send my improvement list asked me to call back XXXX to verify receipt XXXX called back and they said they received and said they needed to review and to call back XXXX XXXX called and they said to call back on XXXX for status XXXX called and they said it was ordered and to call back XXXX XXXX called and they said it was not ordered and they needed a check for the appraisal XXXX called and they said they didn't need a check and ( XXXX XXXX initials she said ) ordered the appraisal XXXX called back to confirm it was ordered and they said due XXXX but I could call for a status on XXXX XXXX rec 'd letter transferring my servicing XXXX and can no longer assist as of Friday XXXX so I called and spoke to a manager XXXX and she told me to call back tomorrow for a status update. I requested a person 's name and extension and **** I have paid PMI for 2 months ( XXXX ) and going on 3 months ( XXXX ) which should not be necessary since I know the value of my home is more than what is needed to drop the PMI. I got an appraisal for a HELOC in about 3 weeks time with an appraisal and the value was $ XXXX over what I need to drop the PMI. Every Taylor Morrison XXXX employee said I need to let the process work itself out and they can not rush anything. They just say the same thing over and over and then to call back. I am concerned I am going to have to start this process ALL over at the new servicer Monday XX/XX/XXXX and pay another 2 months of mortgage insurance.

In XX/XX/XXXX of 2021 we entered into a contract to build a home XXXX XXXX XXXXXXXX XXXX XXXX. XXXX XXXX XXXX XXXX, XXXX XXXX, XXXX, AZ XXXX. The home we were building was at XXXX XXXX XXXX XXXX. During our initial phone calls I was asked income, assets and gave credit for approval. We were told that we are approved to move forward based on a conventional loan with over {$500000.00} in assets required which we did not have but they proceeded anyway saying that credit and assets can changed over the time of the build. Not once over the 12 months was anything requested. Income, assets, job information etc. I have included the internal Underwriting approval letter dated over a year after our contract was signed showing as much. They had not reviewed income, assets, earnest money, nothing besides my credit. I also included an email from the lending representative and the contract that states within 45 days the lender ( also Taylor Morrison ) is to provide a notice of conditional approval. The contract clearly states that if the affiliated lender doesn't not provide in that time frame all deposits will be returned. At this time we were unable to qualify and ultimately lost the home. Taylor Morrison has refused to return our {$65000.00} deposit and has also recently sold the home for over {$50000.00} more than we had in agreement for our contract. We are simply asking that this predatory behavior be reviewed and just want our earnest money back. We are a young family and this has caused major strain and hardship. Multiple attempts have been made to the seller, lending officer, Vice President to which we have not got any resolve and as of late will not return any phone calls. 1. lender/builders/builders agent all allowed the realtor to stay in the transaction all the way to closing and was supposed to assist the buyers and did not assist the buyers at all until only after being present on sigining of purchase agreementon XX/XX/2020. They were all informed that on the purchase agreement signed by the buyers and builder it was noted that this realtor would receive commission only if the brokers agreement fee was signed by all partiies. this agreement contract was in fact never signed by anyone and they refused to abide by what was on the contract due to the builder and the realtor having an " economic relationship '' together, which is against the fudiciary duties of the realtor. Realtors interest shoudl be for their client and in this case it was between the realtor and lender and seller/builder. 2. Buyers refused to abide by the transaction and was informed that if not, there will be fined wth fees and can not anymore back up from the transaction. 3. the home was appraised at XXXX and the loan was at XXXX which was noted on the loan estimate. on the day of closing and notarized, the lender changed the price of the home and sent the notary public to the buyers and informed them the need to sign the documents or will be fined with all delays and fees. the price of the home was changed to XXXX which was indeed over the amount they had provided on the apprasail week prior. Week prior the lender, provided different loan amount along with different closing cash needed to close and on the day of notary and closing, all the amount changed and forced the buyers to agree with this and signed.

We applied a mortgage with Taylor Morrison Home Funding , LLC ( which is the in house lender for XXXX XXXX in the new home purchase agreement ). When we were told by loan officer that our loan was not approved by the underwriter ; instead of receiving the reason for rejection, they sent us an email stating withdrawn by applicants. We have never verbally or in writing withdraw our application. This is happens when there were less than 30 days before we supposed to close on the house. Now the builder ( which is affiliated with Taylor Morrison stated clearly in the purchase agreement ) pressured us to go with another bank otherwise we would not get our earnest money back. I feel ( its a conspiracy ) this is a common practice where they are forcing borrowers to get a high interest loan because both salesperson for the builder and Taylor Morrison mortgage banker said we would definitely get a loan from this lender ( XXXX XXXX ). This also avoid the chance the purchase agreement would be void due to the inability to obtain loan from Taylor Morrison Funding. I tried to reach out to Taylor Morrison ( via email asking for an explanation ) and they have not replied as to why they put withdrawal by applicants when we were told that loan was rejected. I feel they are conspired to refuse a loan and direct us to another bank with higher interests. This seems to be an unethical and fraudulent practice and I am really scared to lose my earnest money ( pressure from salesperson from XXXX XXXX ).

Dear Sir/Madam, I am taking secondary home mortgage from Taylor Morrison Home Funding for XXXX. Property purchase price is XXXX, Deposit is XXXX & Loan Amount is XXXX. My Credit score is 800+. My closing is on XXXX XXXX. As per the lender, we MUST buy points for all secondary mortgages. They share Scenario Sheet for each day to know about the discount points only for 3 interest rates XXXX, XXXX & XXXX. As per the scenario sheets, For XXXX Month discounts points varied from XXXX XXXX XXXX XXXX XXXX to get loan for XXXX at the rate of interest rate XXXX. Though I have good credit score & deposit of 66.34 %, I had to pay XXXX $ as discount point for Interest Rate XXXX. Couple of questions to understand if lender is fair in his calculations : 1. Is Points mandatory for securing mortgage loan on Secondary Home 2. I don't want to buy any points since I have credit score of 800+ & Deposit made is XXXX XXXX of purchase value. 3. They have provided me choice to take XXXX, XXXX or XXXX. Since i don't have choice I am opting for XXXX XXXX & they are charging XXXX as discount point but they are not ready to share interest rate with no points. Please advise if the lender is correct in their decision or not. We purchased a home with Taylor Morrison and closed on XX/XX/XXXX and used their financing company, Taylor Morrison Home Funding. We are in the process of refinancing with another company to capitalize on a lower interest rate and the new company ( XXXX XXXX XXXX XXXX XXXX ) have been in contact with Taylor Morrison to obtain a payoff amount and Taylor Morrison is refusing to give the payoff amount to us or the other company in order to finalize the refinance loan. They are stating they sold the mortgage to another company, however that company ( XXXX ) is not servicing the loan until XX/XX/XXXX. Taylor Morrison home funding is the current servicer of our loan and they refuse to give us Or the other companies the payoff amount. The request was made for a payoff in the middle from both XXXX and XXXX and after multiple calls and emails they still refuse to give the amount or documentation needed to close on our refinance loan which they are servicing until XX/XX/XXXX. We only have a few days before our rate lock is up and they ( Taylor Morrison & XXXX ) are not responding with the information XXXX needs to approve our refinance loan. Due to their ( Taylor Morrison and XXXX ) questionable businesses practices they are not allowing my husband and I to obtain better financing for our mortgage which will be a huge financial impact after a few years.

Loan Closed XX/XX/2021 I was not able to qualify with the Builders Lender. All income and asset docs were submitted to the Lender along with my offer letter detailing my compensation. I was advised by the loan officer that my differential income ( production bonus ) would be treated as " commissions '' for the purpose of averaging my income. Egregious errors were made by the Mortgage Company in regards to calculating my income showing my earnings to be less than half of the actual income. It was presented to me that I had to sell my house and pay off a car loan in order to qualify. I was able to obtain financing and closed as scheduled without those conditions. It not only cost me extra in Rush fees, but I also lost the incentives listed in my contract. My loan was underwritten in accordance with XXXX XXXX guidelines as a XXXX loan. The mortgage company should have been able to do the same and approval should not have been contingent on the sale & settlement of my house + the payoff of a car loan. o I was given additional options due to an accommodation given by the Builder to address Contract issues. The incentives were more than the additional options, so it appears to be a claw-back. I contacted the XXXX XXXX XXXX & XXXX XXXX for resolution. The XXXX declined to make any adjustments.

My mortgage processing company 's name is XXXX XXXX. XXXX XXXX not credit a mortgage payment to my account. I contacted them in writing via their preferred method of contact, email to their research department, with evidence of payment for my XXXX bill. I emailed proof of payment in the form of an endorsed check - endorsed by XXXX. The payment never processed the account even though the check was cashed. They credited the next month 's check earmarked for XXXX payment as my XXXX payment and continued this moving up to this date with my future payments ... I emailed this information on XX/XX/XXXX and XX/XX/XXXX. My check in the amount of payment due, {$1900.00} was processed by my bank, XXXX XXXX XXXX, and sent to XXXX XXXX on XX/XX/2020. The check was cashed on .... I continued to followup with the lender weekly via email and phone calls. They did not address the issue and have sent multiple notices of " default and cure letter '' without reviewing my proof of payment which created the issue. They have not said they tried to located funds I sent and credit to my account.

I wanted to pay off my loan, so I mailed a check for an amount which included the monthly payment and slightly more than the principal balance. I indicated that I wanted the excess {$9500.00} to pay off my loan. The check was cashed on XX/XX/XXXX. I received my next payment coupon and it showed the {$9500.00} had been put into a suspense account and would be used to make future monthly payments. I immediately called on XX/XX/XXXX and I was told the following. The money in the suspense account would be returned to my checking account within 9 business days. I have to wire the final payoff. I asked for the payoff amount and wire instructions and was told they need to be mailed to me, and I should have it in 4 business days. It is now the 10th business day and I have not received payoff instructions, nor has my {$9500.00} been returned to me. I want my money applied to the principal or returned immediately. I want the payoff amount and wire instructions immediately, not in the mail.

The closing date for this loan was supposed to be on XX/XX/XXXX. The company did not deliver a ready for closing and/or moving in. Even though I had applied for the loan more than an year back as Taylor Morrison builder required all its customers to apply for a loan and get pre-approval to sign any house contract with them. I never intended to take any loan from them. I then have withdrawn my permission that I gave them on XX/XX/2022 in an email asking them to never again pull my credit without my consent. Since I requested the company to remove me from the forbiddance plan, I'm trying to resume payments, but they do not move the balance acquired during the forbiddance to the end of the mortgage, so the website doesn't allow me to resume my payments. Lender provided me with a Loan Estimate on XX/XX/28 and refused to honor the rate on the Loan Estimate when I asked them to lock it just XXXX minutes after receiving. The manager in the email chain indicated the Loan Estimate didn't have today 's rate on it, even though it was dated that day. They should be disclosing accurate information with the correct rates if that is the case.
